City to take comment on charter review The process may or may not lead to a charter review. If it does, the City Council — rather than a resident committee — might lead the review process.

Palm Coast may get a city charter review. But whether it will happen — and what form it will take if it does — is still uncertain.

Residents, City Attorney Bill Reischmann told council members at a City Council meeting May 30, tend to assume that a charter review would be led by a citizen committee. That’s not necessarily so.

“It’s an option,” he said. “It’s common, but it’s not mandatory.”

In fact, there are three ways to change the city’s charter, all of which ultimately require a referendum, Reischmann said. One is by adding an amendment through a referendum after collecting petition signatures from at least 10% of the registered electorate. The second is by having

City Council make a list of possible amendments, and submitting those to the electorate for a referendum vote. The third is by holding a charter review, then submitting for a referendum the changes proposed in the charter review processs.

If the city decides to hold a charter review, it could decide to use a resident-led charter review committee. The city’s current charter dictates the form that committee must take: five members, one each appointed by the four council members from among residents of their district, plus one at-large member appointed by the mayor.

But the council could also decide to review the charter on its own, an approach council members and the city administration seemed to favor.

Reischmann noted that the committee members would likely be lay people with limited government experience. “When you start getting into the specifics of the charter … it gets into the weeds, and there’s a lot of details, and there’s a lot of legalities,” he

said, so the city would probably need to assign someone to assist the committee. A facilitator, he said, could cost anywhere from $6,000 to $27,000.

Milissa Holland, the city’s mayor, has gone through the charter review process before — not with the city, but with the county, when she served as a county commissioner. It didn’t go well.

The process took about half a year, she said, and “it took a tremendous amount of resources from our staff to really inform them, and educate them as to, for example, ‘You recommend this; this is the effect.’”

And then the County Commission didn’t accept any of the committee’s suggestions, she said, because commissioners understood that the proposed changes “were not necessarily the most efficient effective way to do the day-to-day business of running our county government.”

Holland said the council should handle any potential charter review on its own.

“We were elected by the majority of the residents in this city to make decisions on their behalf in the best interests of the residents, and I think each one of us takes that very, very seriously,” she said.

Councilwoman Heidi Shipley agreed with Holland, preferring a charter review process led by the council.

So did Councilman Bob Cuff, who noted that most comments he’d heard from the public in favor of a charter review centered around issues that wouldn’t actually require a charter review.

“The feeling that I get from the people that are talking to me about charter review… It’s this vague feeling that, ‘charter review: good; not charter review: bad.’” Cuff said. “I don’t mean to oversimplify it, but that’s kind of the input that I’ve gotten so far.”

City Councilman Steven Nobile said residents have mentioned to him a number of things they’d like to see changed in the charter that are in fact issues dealt with in the charter. But he agreed with the rest of the council on taking public comment and then considering a council-led review process.

Holland suggested that the process take place after snow birds return to town and after the city’s budget process is complete.

The council developed a consensus to hold meetings with the public about the possibility of a charter review and to seek feedback.

Jirawadi Marie Battenhouse, a 19-year-old resident of Flagler Beach, died May 27 after a car crash on Interstate 95 in Flagler County.

Battenhouse was driving south in a Lexus ES300 at about 12:20 a.m. when the car entered the emergency lane, struck a guardrail, then reentered the southbound lanes, according to a Florida Highway Patrol report.

Battenhouse’s Lexus was then struck by an Acura TLX driven by 45-year-old Lake City resident Stephanie Finnell.

Battenhouse was airlifted to Halifax Medical Center in Daytona Beach in critical condition, and died of her injuries. Finnell was taken to Halifax for minor injuries.

Battenhouse “was an avid photographer, musician, and curator of art, but most importantly a selfless daughter and sister,” a GoFundMe page set up by Battenhouse’s sister Caroline Battehouse and mother Sue Soinak stated.

The page at gofundme. com/jirawadi-maries-funeralfund, created to raise money for Battenhouse’s funeral expenses, raised $11,020 in its first day. Its goal had been $5,000.

While many people know Jacob Oliva as the gregarious do-nowrong superintendent with a bald head and a graying goatee — someone who talks incessantly, makes everyone feel important, and insists on leading Flagler Schools not just to local but to national recognition — some might not realize how obsessed he is with bowling.

After having started as a teaching intern at Flagler Schools in 1998, he ultimately became the Flagler Palm Coast High School principal and started bowling as a high school sport there. He was hired as superintendent in 2014 and

attended school-related events seemingly every night, but he still occasionally managed to travel to places like Las Vegas for bowling tournaments. Not long ago, he bowled a 300. He wears professional bowling shoes, the cost of which he is too embarrassed to reveal.

And so, to those who know him well, it might not have been a big surprise to learn that, for his last official duty as superintendent, he chose to go bowling with the Matanzas and FPC high school bowlers May 30, at

In my role at the newspaper over the past few years, I was able to meet with Oliva regularly in his office to talk about education issues, and I saw in him someone who truly loves his job and never takes himself too seriously. I was impressed with the lack of a desk in his office; he got rid of it one day because he spends so much of his time at the conference table anyway.

Don’t label all pit bulls aggressive Dear Editor: I am very outraged by a previous letter proposing that pit bulls be outlawed. I have known several pit bulls and pit owners, most of whom have little children, and I have never met one who was aggressive!

I have spoken with many other community leaders about Oliva in the past three years, and I never heard a single one say anything negative about him.

Many said the Flagler Schools organization was lucky to have him and said things like, “As long as Oliva is superintendent, the district will be going in the right direction.” He has been an inspiring, charismatic administrator.

But I do one negative thing to say about him. I witnessed his first bowl on May 30, and I have it on video: It was a split. He tried on the second bowl of the frame, but he couldn’t knock them both down, and he ended up leaving one pin. I mean, even I could do that. I thought he was supposed to be good?

It wasn’t until later that evening when I learned that Oliva had knocked down every other pin in the game. His second frame was a strike; then he had a spare; and he concluded with nine strikes in a row, finishing with a score of 259. Just an average day at work for Superintendent Jacob Oliva.

They do make excellent guard dogs. A relative of mine almost had their house broken into. Their pit heard something rustling around the backyard and went to investigate. All the dog did was growl and showed his teeth, and the crook thought better of it, and he beat feet off their property.

The dogs that you are against were bred to fight, and that’s all they know to do. They will attack anything that comes near them. And yes, those should be banned and the owners severely fined and/or jailed.

I’m sure you have heard the phrase, “It all depends on how they’re raised.” It is true. Our pits are just big, silly, Marmadukes.

You should never lump anything as being the same and label them, just because you don’t like them.

The Flagler County service at the Government Services Building honored the late Jonathan “Nat” Spicer, a Marine medic who died March 8, 1968, while serving as a stretcher bearer evacuating wounded soldiers in Vietnam.

Spicer, a graduate of Bunnell High School and the son of a traveling Methodist minister, realized after joining the service that his understanding of his faith was not compatible with taking a human life. He was offered a discharge as a conscientious objector, but declined it and went into service as a medic.

He died aiding wounded men in the battle of Khe Sanh.

At the county ceremony, Randy Morris, one of Spicer’s classmates, read aloud the text from the Navy Cross commendation that was awarded to Spicer after

Florida Hospital Flagler shut down one area of the facility for safety reasons May 23 after a man made death threats and anti-Muslim comments on the hospital’s Facebook page because the hospital employs Muslim doctors.

A hospital security guard called the Flagler County Sheriff’s Office about the comments, which had been made by 68-year-old Lorenzo Dow Fields, a resident of Palm Coast’s Bay Road, according to a case report.

The guard showed a deputy “several pages of comments made by (Fields) stating that the hospital employs Muslim doctor’s (sic) and that they are killing people,” according to the deputy’s case report. The comments included death threats, according to dispatch notes.

While dispatch notes from the call from the security guard to the Sheriff’s Office’s administrative line state that Fields’ “threats talk about killing people,” the deputy’s case report doesn’t specify the nature of the threats or quote the comments Fields made on the hospital’s Facebook page.

But Fields’ personal Facebook page is replete with comments raging against Muslims and calling for armed people to “eliminate Islam in a single day” by attacking

The hospital security guard told the deputy that in addition to making comments on the hospital’s Facebook page, Fields called the hospital saying “that he was going to come into the hospital and make some sort of scene.”

The deputy served a trespass order ordering Fields to stay off the hospital’s property. Although the Sheriff’s Office call record mentions that Fields’ “threats talk about killing people,” the incident report does not specify what any of those threats were, and Fields is not being charged with making threats.

“I just think that our deputy did not find that there was cause to pursue it,” Sheriff’s Office spokeswoman Laura Williams said. “It doesn’t seem to rise to the level of probable cause to press charges.”

Accused of having sex with inmate, jail deputy resigns Two deputies who allegedly covered for him also resigned.

Part of the laundry room in the Flagler County Inmate Facility is out of sight of its security cameras. And according to an ongoing investigation, that blind spot was where a deputy arranged to have sex with an inmate.

Three Flagler County Sheriff’s Office detention deputies resigned amid a Florida Department of Law Enforcement investigation into allegations that one deputy had sex with an inmate in the jail’s laundry room during his shift. The two other deputies faced charges that they had warned that deputy about the impending investigation and lied to cover for him, as well as engaging in other misconduct.

The deputies were placed on administrative leave during the investigation, which was the first major internal investigation to occur under the watch of Sheriff Rick Staly.

“I was elected to bring strong ethical practices and leadership to the Flagler County Sheriff’s Office,” Staly said in a Sheriff’s Office news release. “This bad behavior tarnishes the badge and will not be tolerated under my administration.”

The alleged sexual contact occurred between detention Deputy Bradley Gilyard and an inmate in the jail’s laundry room on Jan. 16, according to documents from the investigation. The contact was brought to light Jan. 19, less than two weeks into Staly’s tenure, and Gilyard was to be fired the afternoon of May 26 as a result of the internal affairs investigation.

Instead, he resigned.

The two other deputies, Julio Vazquez and Jonathan Vitale, resigned earlier in the course of the investigation.

Although the FDLE presented its case to the State Attorney’s Office, the State Attorney’s Office declined to file charges against any of the deputies, finding the evidence insufficient to ensure a conviction, according to the news release.

While attending a cheerleading event May 24, two young girls found an emaciated cat wrapped in a towel by Cattlemen’s Hall at the Flagler County Fairgrounds.

The Flagler County Sheriff’s office was called.

“I believe the deputy picked up the cat, and it meowed,” Flagler Humane Society executive director Amy Carotenuto said.

Flagler Animal Services officer Bryan Denker responded to the scene and took the animal back to the Humane Society.

Denker texted a photo of the cat to Carotenuto, who said that at first she wasn’t sure what she was looking at or what species she was looking at on her phone.

“The cat had laid there a couple of days and hadn’t eaten in some time before that,” Carotenuto said.

The Sheriff’s Office began investigating on Jan. 19. The next day, the jail began implementing Prison Rape Elimination Act Protocols and offering services to victims and witnesses. The FDLE was called in. Here is what they found. n A female inmate told investigators that she’d been working in the laundry room with another female inmate Jan. 16 when Deputy Bradley Gilyard entered the room and had sex with the second inmate. n Although there is a blindspot in the security camera setup, footage from cameras outside the laundry room seemed to corroborate what the witness had said. n The inmate who was a witness also told investigators that Gilyard had told her and gestured to her to “zip it.” Camera footage showed Gilyard making such a gesture to her. n Gilyard denied the allegations in interviews with investigators, who called his statements “non-committed and non-explanatory answers.” n The investigation of Gilyard led to Deputy Julio Vasquez, who, according to the allegations, contacted an inmate who was scheduled to work that day and told her to call in sick, telling her that Gilyard wanted to have sex with the other inmate who would be scheduled to replace her. n The inmate who had originally been scheduled to work the shift also told investigators that Vasquez had kissed her and fondled her in a blind spot in the jail’s supply room. n The morning of Jan. 20 after the investigation began, Vasquez allegedly called Deputy Jonathan Vitale, to give Vitale a “heads up” about the investigation and to tell Vitale to warn Gilyard.

Vitale then texted Gilyard and spoke with him by phone. n Vitale had been disciplined for untruthfulness twice previously, in 2011. n There were also other allegations of misconduct: that Vitale had been passed a note by an inmate, and that he’d handed two inmates contraband — a styrofoam cup of iced tea. n Gilyard had been with the Sheriff’s Office for five years when he resigned.

He was a deputy of the quarter in 2013.

The animal was in extreme distress and barely alive, and it was determined euthanasia was the humane action to take. The cat was determined to be about 10 years old by the veterinarian who performed the necropsy (autopsy for animals).

Palm Coast plans for expanded street lighting program Streetlights could be added along major roads, starting with Belle Terre and Lakeview boulevards.

Palm Coast’s 2,715 city-funded street lights cost the city about $700,000 per year, but those lights illuminate less than half of the city’s major roads.

The city is now trying to change that, planning to contract with a firm for $107,630 to create a comprehensive plan to add street lighting along all major city thoroughfares and to start some of the design work. City Council members discussed the proposed contract with Ormond Beach-based Lassiter Transportation Group at a workshop May 30, and will vote on it at a future council meeting.

lights are over $700,000, they look at me like I’m absolutely insane, but that’s the cost,” Palm Coast Mayor Milissa Holland said at a City Council workshop May 30. “So when we make these decisions, we can’t just say, ‘Yes, we have this immediate need,’ but we have to be very sensitive to how it’s going to impact our overall budget.”

The plan to illuminate the city’s roads through a citywide program known as the Continuous Lighting Program has been in the works for many years. The city cut back on the program during the economic downturn, but residents have spoken publicly about dark streets recently, after the death of 16-year-old Matanzas High School student Michelle Taylor, who was struck by a car and killed while walking along an unlit stretch of Lakeview Boulevard in March.

The proposed contract with Lassiter would require lighting along major roads, including now-unlit stretches of Belle Terre Parkway and Lakeview Boulevard.

tently can lead to roads dappled with light and dark spots, he said, and when drivers pass such areas at night at high speed, their eyes often don’t have time to adjust to the changes, hurting their night vision.

Of the current city-funded

lights, City Manager Jim Landon said, 1,542 are already part of the continuous street lighting program. Another 1,173 lights are in residential areas. There are also an additional 4,038 private security lights in the city.

The lights are installed and

maintained by Florida Power & Light Co. Most of the current bulbs are regular phosphorus bulbs, and not the more efficient light-emiting diodes, or LEDs. FPL plans to include Palm Coast in its push to switch to the more energy efficient technology.

The Smiths have spent a large portion of the last nine years with the Palm Coast Little League at the ball fields. Greg has coached and umpired, and they both work the concession stand and have served on the league board.

“We have six kids, and five are usually playing at the same time,” Greg Smith said. “It was only right to do it at the field, and I think it went better than I could have imagined.”

League President Patrick Johnan presided over the wedding, which was a first on a baseball field.

“I actually expected it, and I thought it was beautiful,” Johnan said. “This is their home, where they are all the time with their kids, so why not, right?”

With family and friends in attendance, Greg stated that everyone loved their wedding location.

“If you’re out here at any given time,” he said, “you’ll most likely see one of us there.”

Then, they get to the field — but can’t play because several teammates failed to show up and caused the team to forfeit.

I’m afraid this issue has occurred too often this season in the Palm Coast Little League.

When I arrived to cover a playoff and championship game this past weekend, both were canceled because there weren’t enough players.

Coaches and parents had purchased snacks and all the necessities to make ready for the game, only to have to reload it all back into their vehicles, because the game was canceled.

“It’s the parents’ responsibility to teach these kids that this is a team sport,” said Teresa Cestare, wife of a head coach who had to forfeit his playoff game. “If we would’ve known that we were going to be short, I would not have bought this cooler full of Powerades, and we wouldn’t have wasted everybody’s time.”

While a sickness or any other dire situation is excusable, the parents and coaches whose time is often wasted criticize the lack of communication from the parents who fail to notify anyone they won’t be attending.

For some families, baseball is just a fun little hobby they let kids use to pass the time. On the other hand, some parents expect PCLL to prepare their kids for high school baseball or beyond.

So, those parents will make sure their kids are out there early and ready to warm up.

I asked PCLL President Patrick Johnan about the issue, and he proposed a solution that may be helpful going forward.

“We can start the season a week earlier and cut it to 16 games instead of 18,” he said.

“Hopefully, we can play all the games before graduations and Memorial Day.” If people decide not to take the league seriously enough to show up, nothing can stop them.

Whether the board decides to shorten the season or not, hopefully some solution can be found to prevent so many players from missing games.

After a stellar high school season at Flagler Palm Coast, Tamara Henshaw often heard naysayers declare she couldn’t play on Division-I level and wouldn’t play much. But this past season, Henshaw averaged 26 minutes (fifth-most on team) and won American Athletic Conference Freshman of the Year.

In high school, Henshaw helped lead the Lady Bulldogs to their first ever State Final Four in 2015, and she led the team to a 24-2 record and second straight playoff berth her senior season.

Considering her college stats and accolades, Henshaw remains an impact player in one of the best conferences (home to UConn) in women’s basketball.

“I was extremely surprised I won it, because there were a lot of really good freshmen in the conference,” she said. “It makes me feel like I am showing those people who ever doubted me that I can do so much more than what they think.”

In her first season as a University of South Florida Bull, Henshaw posted a team-best and secondbest-in-the-conference field goal percentage (63%, minimum of 100 attempts) and helped lead the Bulls to the Women’s NCAA Tournament and a season 24-9 overall record.

She scored in double figures at least 10 times and recorded double-digit rebounds in nearly as many games. Henshaw also won back-to-back Player of the Week awards and had back-toback games where she recorded 13 points on 73% shooting, 5.5 rebounds and 1.5 blocks over the course of those weeks.

After winning Freshman of the Year, Henshaw made a call to FPC girls coach Javier Bevacqua to thank him for all he had done for her and is still doing.

“She called me and thanked me for helping, training and getting her ready for college ball,” he said. “But anybody who has ever

seen her practice or play knows she never takes a play off. I expect her to be a building block for USF going forward. I think they will be recruiting to put pieces around her.”

Henshaw was recently invited to the USA Basketball U19 World Cup Team tryouts May 18-21.

Although she didn’t make it on the team, she said it was a great experience that motivated her even more.

And, for high school girls looking to follow in her footsteps, Henshaw gave this advice: “Condition, condition, condition. It is no joke in college. Listen to your coaches and don’t ever let people tell you what you can’t do. They will say you can’t do a lot. Prove them wrong.”

Kaelum was first inspired to DJ when he visited his godfather, Nicholas Marrero, in Miami. He came home with a mini mixing board, and his parents, Kaelum Sr. and Yasenia Montes, realized DJ-ing was a gift and began to buy more expensive equipment.

In the last two years, Kaelum has DJed Flagler Palm Coast girls basketball games and other FPC sports events. He’s done sweet 16s, family parties, Hangar 15, Europa Lounge and Bistro and other events and venues.

“We are a family that loves to party,” Montes said. “We play music when we cook, clean, sit

Kaelum will DJ a wedding this weekend, and, at only 12 years old, he’s already getting paid for his services. When asked what he was saving up for, Kaelum said college, a car and a house.

Even with a job that usually takes up his weekends, Kaelum finds time for his school and family. He has won a Terrific Kid Award each year in elementary school, and, after every DJ gig, he takes his mother to Steak ‘n Shake.

“Kaelum is a loving kid and loves to see other people happy,” his mother said. “I believe that’s what he loves most about DJing.”

Instead of recruiting a veteran disc jockey to pump up the students, Rymfire asked one of its own — sixth-grader Kaelum White Jr., known as “DJ Kid K”— to spin records and excite his peers.

From the moment the soon-tobe seventh-graders crowded the gym, Kaelum was bombarded with compliments and music requests, and he gained a new fan base.

He’s experienced very few feelings that beat the one he gets when he puts on a crowd favorite and his audience voices its approval by singing and dancing to his music.

Gloria Max, the diminutive force of nature behind the Jewish Federation of Volusia and Flagler Counties’ Backpack program, is worried about being able to provide quality backpacks filled with school supplies to the children this year.

The original backpack project is short on cash, partially because of the expected increase in demand.

“I know that this year especially, there will be a lot of disadvantaged kids needing assistance because Hurricane Matthew did a number on a lot of families, because we are seeing families that haven’t been to us in years, coming back for food,” Max said.

“You know if they can’t afford food, they certainly can’t afford school supplies.”

For years, the federation gave gifts to children until one day it was suggested they might like school supplies. Max wasn’t convinced but agreed to give it a try and when “a really big young man” gave her a hug and said, “Now I have a nice backpack like the rich kids, even better, for school,” she knew the change was appreciated.
