AlcoholPolicy ALCOHOLUSEREGULATIONS

TheuseofalcoholatMassArtissubjecttotherequirements,restrictions,andapprovals prescribedbythisalcoholpolicy.MassArtobservesalllawsandregulationsgoverningthe sale,purchase,andservingofalcoholicbeveragesbyallmembersofitscommunity,and expectsthattheselawsandregulationswillbeadheredtoatalleventsassociatedwiththe college ThisincludesallactivitiesonMassArtʼscampus,andactivitiesatoff-campus functionssponsoredorsupportedbyMassArtoranyofitsaffiliatedgroups.

ThisalcoholpolicypermitstheresponsibleuseofalcoholbymembersoftheMassArt communitywhoareatorabovethelegaldrinkingageoftwenty-one21.Itprohibitsall otherusesofalcoholbymembersoftheMassArtcommunity.Theobligationtoobserve existinglawsandregulationsinanenvironmentwherethemajorityoftheundergraduate studentbodyisnotoflegaldrinkingagemakesitnecessaryfortheCollegetoimpose constraintsonthosewhoareoflegaldrinkingage.Thefactthatsomeoneisoflegal drinkingagedoesnotexempthimorherfromtherequirementsofthecollegeʼsalcohol policy

Thefollowinggeneralrulesapplytotheuseandservingofalcoholunderthispolicy:

● PossessionanduseofalcoholareprohibitedatSmithHall

● Where students of the college are present, alcohol will be allowed only at specially registered events. Procedures for planning and serving alcohol at a registeredevent(seesectionIIIbelow)mustbeinplace

● PublicSafetyofficersandothercollegeofficialswillmonitorandstrictlyenforce thesepolicies.

● Large student events that involveoutsideadvertisingwillbesubjecttostricter controlsthan,forexample,anopeningreceptionforanexhibition

● Alcoholicbeveragesmayonlybepossessedby,servedto,orconsumedby personsoflegaldrinkingage:

○ AteventsthathavebeenregisteredwithorapprovedbyMassArt;

○ InareasoftheMassArtcampusthatareallowedtoservealcohol(see

site-specificlocationsinsectionIIIbelow);

○ Inon-campusstaffresidences,andbystudentsoflegaldrinkingagein individualstudentresidenceroomsintheArtistsʼResidenceandTree House.

Exceptasfollows,alcoholservedataregisteredeventmustbeservedbyDiningServices. TheonlytypeofeventservingalcoholthatdoesnotrequireDiningServicesisaclosed eventsponsoredbyanadministrativeoracademicdepartment.

Anexampleofthiswouldbeagraduatestudiesreceptionforgraduatestudentsonly.For theseevents,acertifiedserverisrecommended Forallothereventsthatarein site-specificlocations(seebelow),anAlcoholServerhiredthroughDiningServicesmay servealcohol,providedthattherequirementsofthispolicyhavebeenfollowedandthe eventisregisteredandapprovedinaccordancewithsectionIII.

Possessing,serving,orconsumingalcoholisprohibitedunderallothercircumstanceson theMassArtcampus

PLANNINGANDSERVINGALCOHOLATEVENTS

A.ProcedureForPlanningAnEventWith Alcohol

1.EventOrganizer

TheEventOrganizeristheindividualfromthesponsoringMassArt organization,department,orresidencehallwhotakesprimary responsibilityfortheevent Theyareresponsibleforunderstanding thisalcoholpolicyforplanningandservingalcoholatevents.They must:

● BeamemberoftheMassArtcommunity

● Beaminimumof21yearsofage,

● HireanAlcoholServerthroughDiningServices

● Bepresentfortheentireevent,and

● Besoberandnotconsumealcoholduringtheevent Incaseswhereeventsareco-hostedorco-sponsoredwith organizationsnotaffiliatedwiththecollege,MassArtwillconsiderthe OfficeofCollegeandVisitingEventsprimarilyresponsibleforthe event Theeventregistrationgroupsignerswillonlyaccept reservationsandlogisticalarrangementsmadebytheMassArt affiliatedorganizer.

2.EventRegistrationPolicyToServeAlcohol AtEvents

All events, whether organized/sponsored by students, faculty, staff, student groups, or departments, must be registered and approved withtheComplexEventAdvisingGroup.Inaddition,allinvitedgroups

who utilize college facilities are subject to the event registration processandprocedures.

Iftheeventorganizerisplanninganeventwithalcohol,theymust starttheeventregistrationprocessthirty30calendardaysormore beforethescheduledevent.Iftheeventorganizerisplanninganevent withoutalcohol,he/she/theymuststarttheeventregistrationprocess fifteen15calendardaysormorebeforethescheduledevent

● Alleventswherealcoholisanticipatedtobeservedmust submittheEventRegistrationFormandAlcoholProposal Formatleasttwenty-one21calendardayspriortothe event.

● TheAlcoholProposalFormmustbesignedbytheEvent OrganizerʼsareaVicePresident;theVicePresidentof StudentSuccessandEnrollmentManagement oran appropriatedesigneeisresponsibleforauthorizingall student-sponsoredeventswherealcoholisbeingproposed tobeserved.

3.E-MailDecisionNotificationWillBeSentTo

TheEventOrganizer

➔ Ifthealcoholproposalisdeniedforaspecificevent,noalcohol willbeallowedtobeservedatthatspecificevent Thisdecision willbefinalwithnoappeal

➔ Ifthealcoholproposalisapproved,theeventorganizermust followtheproceduresforservingalcoholataneventdescribed insectionBbelow

B. ProceduresForServingAlcoholAtAn Event

1.HiringAnAlcoholServerFromDining Services

Ifapprovalisgiventoaneventorganizertohostaneventwithalcohol, theeventorganizermustcontactDiningServicestohireanAlcohol Serverfortheapprovedevent.DiningServicesand/ortheir subcontractorsaretheonlyvendorapprovedtoservealcoholon MassArtʼscampus.

2.HiringAnAlcoholServerFromDining Services

Ifapprovalisgiventoaneventorganizertohostaneventwithalcohol,

theeventorganizermustcontactDiningServicestohireanAlcohol Serverfortheapprovedevent.DiningServicesand/ortheir subcontractorsaretheonlyvendorapprovedtoservealcoholon MassArtʼscampus.

3.GeneralGuidelinesToServeAlcoholAtAn Event

A. RestrictionsOnTheUseOfStudentActivityFunds

ItisprohibitedtouseMassArtStudentGovernmentFeeFundsto purchasealcohol Inthecaseofeventssponsoredbyacademic departments,orbyadministrativeoffices,thisprohibitionmay bewaivedwiththeapprovaloftherelevantVicePresident,or otherseniorofficer,basedonadeterminationthatthe requirementsforservingalcoholateventsareunderstoodand willbeobserved.Theprohibitionmaynotbewaivedwhenthe sponsoringorganizationisstudent-run.Funds,however,from student-runorganizationsmaybeusedtohireDiningService alcoholservers.

B. AdvertisingAtAnEventWhereAlcoholWillBeServed Advertisingmustfocusontheevent,notthealcohol.Phrases suchas“BeveragesAvailableˮand“PositiveIDRequiredˮare acceptable,whilephrasessuchas“Wine&CheeseParty,ˮ“Free BeerandWine,ˮand“BeerBashˮarenot Advertisingmaynot promotetheavailabilityoffreealcohol,providedetailsofthe typeorbrandofalcoholtobeserved,orincludephrasessuch as“AllYouCanDrinkˮAcopyofadvertisingmustbesubmitted withtheeventregistrationform

C. Site-SpecificLocations

Alcoholmayonlybeservedinthefollowingsite-specific locationsandONLYaftertheeventisregisteredandapproved:

● ArnheimGallery(includingthecorridor)BrantGallery

● DMCAtrium

● DoranGallery(includingthecorridorarea)Frances EuphemiaThompsonGalleryGodineGallery

D. PublicSafety

PublicSafetymayrequireanadditionalpublicsafetyofficerdetailfora four-hourminimum Thecostoftheadditionalpublicsafetyofficerwill bepaidbytheorganizationsponsoringtheevent PublicSafetyreserves

therighttohalttheservingofalcoholatanyeventiftheyobserveany violationsofthealcoholpolicy.

E. AgeRequirement

Atanyeventatwhichalcoholisserved,allguests,includingstudents, MUSTbetwenty-one21yearsofageoroldertobeservedortodrink alcohol.Alcoholmaynotbeservedtoanyindividualwhoisunder twenty-one21yearsofage.Violationofthissectionmayresultina fineof$1,000,6monthsimprisonment,orbothunderMassachusetts lawMGL c138,§§34

F. AdmissionToAnEvent

Ifafeeforadmissionischargedatthedoororotherwise,itcannotbe usedtocoverthecostofalcohol

G. Non-AlcoholicBeveragesAndFood

AlleventsMUSThavedoubletheamountofnon-alcoholicbeverages basedontheamountofalcoholicbeveragesavailableandservefoodto guests.

AlcoholServerGuidelines

● AllservershiredthroughDiningServicesandeventorganizersmust remainsoberandnotconsumealcoholduringtheevent

● AlldrinksMUSTbeindividuallypouredandservedtocustomersor guests.

● Aservermaynotservemorethanonedrinktoonepersonatanyone time,withtwodrinksbeingthemaximumperpersonforathree-hour servingtime.

● Alcoholmustbeattendedatalltimes.Guestsmustneverbeabletohelp themselvestodrinks

● Pitchersorkegsmustnotbeserved.

● AppropriatesignagemustbedisplayedindicatingthatanIDisrequired foralcoholconsumption Proofofagewillbecheckedwhenalcoholis beingservedbyDiningServicesand/ortheirsubcontractors.

SocialHost/Organizer

UnderMassachusettslaw,ahost/organizerofaneventmaybeheldliablefortheinjuries sufferedbyothersifthehostkneworshouldhaveknownthataguestwasdrunkand neverthelessgave/permittedtheguesttotakeanalcoholicdrinkandthereafter,becauseof theguestʼsintoxication,theguestnegligentlycausedinjurytoothers.Iftheguestwho causesaninjuryisaminor,thehostwhoservedthealcoholorpermittedalcoholtobe servedtotheminormightbeheldliabletootherseveniftheminorwasalreadyintoxicated whentheminorwasservedalcohol.

BicyclesandMopeds

ThePublicSafetyDepartmentencouragesalternativetransportationtoandfromthe collegeincludingtravelingthecitystreetswithbicycles,mopeds,andmotorcycles.

Afewsimplebuteffectiveguidelinescanhelpmakeyourtrip,andusingalternative transportation,safe.

Bicyclesshouldbesecuredtodesignatedracksandareasonly,andnottorailings, banisters,orfences Bicyclessecuredinunauthorizedareasareatincreasedriskoftheft andofblockingentrancesandexits Atnotimemayanyvehiclebeplacedonafire escapeorstairwell.

Ifyoudorideabicycleormoped,remembertoweartheappropriatehelmetandsecure yourvehiclewithaneffectivelockingdevice.PleasecontactMassArtPublicSafety Departmentforadviceandhandoutsregardingbikesecurityandsafety

ThePublicSafetyDepartmentalsooperatesabicycleregistrationservicethatcan discouragetheftandmayassistintherecoveryofastolenbike

Parkingofmopedsandmotorcyclesisnotpermittedonthecitysidewalks,orcollege walkways,andrepeatviolatorswillbeticketed.Motorizedvehiclesshouldbeparkedonly atCityofBostonmunicipalparkingspaces.

CommunityStandards

TheCommunityStandardsareestablishedtosupportstudentsʼpursuitofeducation, upholdtheeducationalmissionoftheCollege,andmaintaintheCollegeʼsrelationshipwith thesurroundingcommunityandpartnerschools.

Underthetermsoftheirenrollment,individualstudentsandstudentorganizationsareboundbythese StandardsandacknowledgetherightoftheCollegetotakedisciplinaryactionforbehaviorthat violatestheseStandards Thestandardsareapplicableandshallbeenforcedwithrespecttobehavior throughoutenrollmentatthecollege.TheenforcementoftheseCommunityStandardsisan educationalendeavorthatfostersstudentsʼeducational,personal,andsocialdevelopmentbyactively engagingintheresolutionprocess.

PHILOSOPHYANDLEARNINGOUTCOMES

ByactivelyengagingintheCommunityStandardsresolutionprocesses,studentsshall:

Understandtheimpactoftheirchoicesontheiracademicandpersonalsuccess; Acceptpersonalresponsibilityforchoicesanddecisionsmadeandtheimpactoftheirbehavioron othersattheCollege;

Recognizetheroleofthecommunitystandardsasapartoftheoveralleducationalexperience;and

Identifywaystoaddresstheirbehaviorsoitdoesnotnegativelyimpacttheirlong-termeducational goalsorthecollegecommunityinthefuture

AUTHORITYOFTHECOMMUNITYSTANDARDS

TheSeniorStudentAffairsOfficerSSAOhasultimateauthorityforadministrationoftheCommunity Standardsandmaydelegateday-to-dayoversighttotheirdesignee TheSSAO,ordesignee,may appointCommunityStandardsOfficersCSOorHearingBoardMembersasnecessarytoeffectively andefficientlyadministertheseCommunityStandards.TheSSAO,ordesignee,willconducttraining sessionsforthoseresponsibleforadjudicatingcasesfollowingtheprocessoutlinedbythese CommunityStandardsandwillmanageandmaintainallrecordspertainingtotheadministrationand enforcementoftheseCommunityStandards

VIOLATIONSOFTHELAW

Allegedviolationsoffederal,state,andlocallawsmaybereviewedandaddressedundertheCode WhenanoffenseoccursoverwhichtheCollegehasjurisdiction,theCollegeconductprocesswillgo forwardregardlessofanycivilorcriminalcomplaintorprocessthatmayarisefromthesameincident.

TheCollegereservestherighttoexerciseitsauthorityofinterimsuspensionuponnotificationthata studentisfacingacriminalinvestigation.

DISCRIMINATION

Incidentsinvolvingdiscriminationwillbeaddressedundertheresolutionproceduresoutlinedinthe EqualOpportunity,Non-discrimination,andTitleIX Plan.Thosereports shallbeaddressed according totheCollegeʼsEqualOpportunity,Non-discrimination,andTitleIX Plan

Insituationsofmedicalemergenciescausedbyalcoholand/orotherdruguse,theprimaryconcernis thehealthandsafetyoftheindividual(s)involved Nostudentseekingmedicalassistanceforan alcoholorotherdrug-relatedemergencywillbesubjecttoCollegedisciplinaryactionfortheviolation ofpossessionorconsumptionofalcoholordrugs Thispolicyshallextendtothereferring student/organizationwhocalledformedicalassistancesolongasthereferringstudent/organization remainswiththestudentexperiencingthemedicalemergencyuntilmedicalassistancearrives

Studentsmustmeetwithanadministratororcounselingservicesuponreturnfrommedicaltreatment orwithin24hoursofbeingevaluated.AtthediscretionoftheCollege,studentsreceivingmedical amnestyfromdisciplinaryactionmayberequiredtocompleteamandatoryalcoholand/ordrug evaluationandeducationalsessionsand,whereindicated,mayberequiredtoseekfurthertreatment. Failuretocompletetheassignedsupportiveactionsmayresultindisciplinaryaction

InsituationswheretherearerepeatedusesoftheMedicalAmnestyprovisionwithintheCommunity Standards,theCollegereservestherighttotakedisciplinaryactiononacase-by-casebasis regardlessofthemannerinwhichtheincidentwasreported

Studentsmaybehesitanttoreportsexualmisconductoutofconcernthatthey,orwitnesses,mightbe allegedtohaveviolatedtheCollegeʼsalcoholand/ordrugpolicies WhiletheCollegedoesnot condoneviolationsofpolicy,apriorityisplacedontheneedtoaddresssexualmisconduct. Accordingly,CollegeofficialswillnotinitiatetheCommunityStandardsprocessagainstastudentwho, ingoodfaith,reports,witnesses,orpossessespersonalknowledgeofsexualmisconduct.More informationaboutamnestyforreportingsexualmisconductcanbefoundintheCollegeʼsEqual Opportunity,Non-discrimination,andTitleIXPlan.

Advisor–Advisormeansanypersonwhoaccompaniesarespondent,acomplainant,oravictimfor thelimitedpurposeofprovidingsupportandguidance.

AppealsOfficer–TheCollegeʼsdesignatedadministratorresponsibleforreviewingappealsin accordancewiththedisciplinaryprocessesoutlinedintheCommunityStandards.TheCollegeʼs AppealsOfficeristheVicePresidentforStudentSuccessandEnrollmentManagementordesignee.In casesofacademicdishonesty,theAppealsOfficeristheProvostordesignee

BusinessDayDayShallmeananyday,MondaythroughFriday,thattheCollegeisopen.All reasonableeffortsshallbemadetoexpeditestudentconductprocesses,buttheSSAO,ordesignee, mayextendtimelimitsattheirdiscretionwithnoticetoallpartiesinwriting,includingforinclement weatherand/orunplannedclosures.

DisciplinaryHold–meansanadministrativeholdplacedonastudentʼsrecordoronaStudent Organizationʼsactivitiesorprivileges Studentswithadisciplinaryholdmaynotregisterforclassesor

accessofficialtranscripts.StudentOrganizationsmaynothostmeetings,events,orotherwisebe recognized

EducationalRecords–arethoserecordsthataredirectlyrelatedtoastudentandmaintainedby MassachusettsCollegeofArtandDesignorbyapartyactingfortheCollege.Theseinclude,butare notlimitedto,papers,examinations,gradeinformation,transcripts,disciplinaryinformation,billingand financialaidinformation.

Guests–meansanindividualwhoisnotcurrentlyenrolledatMassachusettsCollegeofArtandDesign whoisanassociateorinviteeofastudentand/orStudentOrganization.

Policy–isanyregulationoftheCollege,including,butnotlimitedto,thosepublishedinthe CommunityStandards,theStudentHandbook,theEqualOpportunity,Non-discriminationandTitle IX Plan,ResidenceHallHandbook,licenseoccupancyagreementsandtheAcademicCatalog.

Sanctions–Anobligationthatastudentorstudentorganizationmustabidebyorcompletewhen foundresponsibleforviolatingtheStudentCommunityStandards.Sanctionsarenotrequiredtobe imposedprogressively,butarebasedontheseverityand/orfrequencyoftheviolation.

Sanctionsunderthispolicyshallinclude,butarenotlimitedto:

WrittenWarning–AnofficialwrittennoticetoastudentthattheirconductisinviolationofCollege rulesorregulations.

Restrictions/LossofPrivileges–Restrictionorlossofprivilegesasastudentforaspecifiedperiodof time,includingbutnotlimitedto:attendingCollegeclasses,eventsand/oractivities;accessingCollege propertyorspecificallydesignatedareas;orparticipatinginCollegeorganizations.

EducationalSanction–Aprojectordevelopmentalactivityimposedwiththegoalofeducatingthe studentaboutpersonalresponsibilityand/ortheimpactsoftheirbehavior.

Restitution–Theassessmentoffinancialchargesorotherformsofreimbursementforanydamageor lossincurredbytheCollegeoranymembersoftheCollegecommunity.

Parental/GuardianNotification:Studentsmustinformtheirparentand/orlegalguardianoftheir involvementinandresponsibilityforviolationsoftheCommunityStandards Thestudentʼsparent and/orlegalguardianmustcalladesignatedadministratortoinformthemthatthestudenthasspoken tothemregardingtheincidentandviolation(s).

DisciplinaryProbationIIDisciplinaryProbationIIresultsinamoreserious,documentedwarningthat astudentʼsbehaviorhasbreachedthestandardsoftheCollegecommunitywellbeyondthe parametersofastandardverbalorwrittenwarning.Furtherpolicyviolationsduringtheperiodof DisciplinaryProbationIImayleadtosuspensionfromtheCollege Probationlastsforapredetermined amountoftimebasedontheseverityofthepolicyviolation.StudentsonDisciplinaryProbationIIare notconsideredtobeingooddisciplinarystandingattheCollegeforthedurationofprobationandare ineligibletoparticipateinCollegeactivitiesunlessanexemptionismadebytheSeniorStudentAffairs Officer.

Disciplinary Offenses

AstudentorStudentOrganizationshallbesubjecttodisciplinaryactionundertheseStandardsfor engaginginactsincluding,butnotlimitedto:

1. Actsofdishonestyincludingbutnotlimitedto:cheating,plagiarism(artisticoracademic); furnishingfalseinformationtofaculty,staff,department,oranyCollegeofficial;forgery, alterationormisuseofanyCollegedocument,record,orinstrumentofidentification(including allsoftwareandcomputerdatabases,systemsoremail);tamperingwiththeelectionofany StudentOrganization;ormisrepresentingoneselfasanother.

2 Actingonoroffcampusinamannerthatsubstantiallyinterfereswithordisruptsthenormal and/orsafeoperationoftheCollege,includingbutnotlimitedtodisruptingorinterferinginthe educationalprocess,includingteaching,advising,research,administration,publicserviceor otherCollegeactivitiesorfunctions.

3. Harmingand/orEndangeringBehaviortowardsanyperson,self,orgroup,whichincludes,but isnotlimitedto:thethreatoforactualphysicalforceorabuse;or,allconductwhichthreatens orendangershealthorsafety.

a. Use,possession,cultivation,manufacture,distributionorbeingundertheinfluenceof drugsorothercontrolledsubstancesexceptasexpresslypermittedbystateand/or federallaworCollegeregulations,whileonoroffcampus,isprohibited.

AlthoughMassachusettslawpermitstheuseofcannabis/marijuanaandthe possession,use,distribution,andcultivationofcannabisinlimitedamounts,federal law,includingtheFederalControlledSubstancesActof1970,theDrugFreeWorkplace Actof1988andtheDrugFreeSchoolsandCommunitiesActof1989,prohibitsthe possession,use,distribution,and/orcultivationofcannabisateducationalinstitutions. Further,ascannabisremainsclassifiedasanillegalnarcoticunderfederallaw, institutionsofhighereducationthatreceivefederalfundingarerequiredtomaintain policiesprohibitingthepossessionanduseofcannabisontheircampuses.

Additionally,studentswhopossessamedicalcannabisregistrationcardwillnotbe grantedADAaccommodationsrelatedtoitsuseorpossession.However,uponrequest, theCollegemayconsiderreleasingastudentfromtheirResidenceHallLicense Agreementasareasonableaccommodationforadocumenteddisabilitythat necessitatestheuseorpossessionofmedicalcannabis

Accordingly,thepossession,use,distributionorcultivationofcannabis,evenfor medicalpurposes,isprohibitedonallCollegepropertyoratCollegesponsoredevents andactivities.Alsoprohibitedistheoperationofamotorvehiclewhileunderthe influenceofcannabisonCollegepropertyoratCollegesponsoredeventsoractivities.

Further,thispolicyprohibitsthepossession,use,ordistributionofallcannabis accessoriesandcannabisproducts Cannabisaccessoriesshallinclude,butarenot limitedto,anydeviceorequipmentusedforingesting,inhaling,orotherwise introducingcannabisintothehumanbody Cannabisproductsshallinclude,butarenot limitedto,productsthatarecomposedofcannabisandotheringredientsandare intendedforuseorconsumption,suchas,butnotlimitedto,edibleproducts.

Inaddition,noADAaccommodationswillbemadeforanystudentinpossessionofa medicalcannabisregistrationcard Uponrequest,theCollegemayreleasestudents fromtheirResidenceHallLicenseAgreementifapprovedasareasonable accommodationforadocumenteddisabilityrequiringuseorpossessionofcannabis formedicalpurposes.

9. BeingknowinglypresentwhereaviolationoftheCommunityStandardsisoccurring.

10. Unauthorizedpossession,duplication,ormisuseofCollegepropertyorotherpersonalor publicproperty,includingbutnotlimitedto:records,electronicfiles,networksystems,forms ofidentification,keys,IDs,orentrycodes.

11 Attemptedoractualtheft,damage,and/orvandalism,byintentornegligence,topropertyor possessionofstolenproperty.

12. Uncooperativebehavior,whichincludesbutisnotlimitedto:disregardingtherequestof, and/orfailuretoidentifyoneselftoanyCollegeofficial,fireorlawenforcementofficersacting inperformanceoftheirduties.

13 Creatingafirehazardorasituationthatendangersothers,includingbutnotlimitedto:creating falsereportsoffireorbombs,possessingfireworks,failingtoevacuate,throwingobjectsfrom windows,tamperingwith,covering,damaging,orremovingfiresafetyequipment,burning candlesorincense,intentionallyburningorsingeingCollegepropertysuchaspostedsigns, andsmokinganysubstanceindoors.

14. Use,possession,creation,orcarryingoffirearms(forthepurposeofthissection,firearms shallmeananypistol,revolver,rifle,orsmoothborearmfromwhichashot,bullet,orpelletcan bedischargedbywhatevermeans),incendiarydevices,smokedevices,huntingorassault knives,explosives,orotherdangerousweaponsonCollegepremisesoratCollege-sponsored events

18 FailuretoabidebytheSmokingPolicy

19. AbuseoftheproceduresoutlinedintheCommunityStandards,includingbutnotlimitedto:

a. Failingtoprovide,destroying,orconcealinginformationduringaninvestigationofan allegedpolicyviolation

b. Falsification,distortion,ormisrepresentationofinformationtoaCommunityStandards officer,HearingBoardmembers,oranAdministrativeReviewCommittee

c. DisruptionorinterferencewiththeorderlyconductofaStudentConductproceeding.

d. Influencingorattemptingtoinfluenceanotherpersontocommitanabuseofthe StudentConductprocedures.

e. Attemptingtoharass,intimidate,orretaliateagainstamemberofareviewbody, accusedstudent,orwitness,priorto,during,and/orafteraStudentConduct proceeding.

AcademicMisconductProcedures

Afacultymemberwhosuspectscheatingorplagiarisminworksubmittedinfulfillmentofaclass requirementshouldconferwiththestudentsubmittingtheworkinanattempttodeterminewhethera violationhasoccurred.

Thefacultymemberhasthediscretiontoaccepttheworkasacademicallyand/orartisticallyhonest, toresolvetheissueasaclassroomissue,ortoreferthemattertotheDepartmentChair.Intheevent thestudentdoesnotconcurwiththedispositionproposedbythefacultymember,thestudentmay referthemattertotheProvostortheirdesignee.IfthematterisreferredtotheDepartmentChair,the Chairandfacultymemberwillmeetwiththestudenttopursueinformationthatmaybepertinent.

IntheeventthattheChairandfacultymemberdeterminethataviolationhasoccurred,theywillreview thestudentʼseducationalrecordtodetermineifapriorsanctionforacademicmisconducthasbeen imposedandmayimposeoneormoreofthefollowingsanctions:

● Thestudentdoestheassignmentoverorretakesthetest

● Thestudentreceivesnocreditfortheplagiarizedassignment.

● Thestudentfails(orreceivesnocredit)fortheclass.

● ThestudentisreferredtotheProvostordesigneeforfurtheracademicsanction.

TheChairwillinformthestudent,inwriting,ofthefindingandthesanctionimposed.Ifthesanction imposedisfailure(ornocredit)fortheclass,theChairʼslettertothestudentconstitutesaletterof reprimand.AcopyofanyletterofreprimandisretainedbytheCollegeasacomponentofthe studentʼseducationalrecord.

AnacademicsanctionimposedorapprovedbytheProvostordesigneeisnotsubjecttofurtherreview orappeal

IftheProvostordesignee,inconsultationwiththeDepartmentChairandthefacultymember, determinesthatjustcauseexists,theProvostordesigneemayreferthemattertotheSeniorStudent AffairsOfficer,ordesignee,tobemanagedasaconductmatterunderthegeneralprovisionsofthese CommunityStandards.

INTERIMADMINISTRATIVEACTION

TheCollegereservestherighttoissueaninterimmeasurewhenitreasonablyconcludesthata studentorStudentOrganization:

● Posesathreattothesafetyofanyperson;

● PosesathreattoCollegepropertyorequipment;

● SubstantiallydisruptsorinterfereswiththenormaloperationsoftheCollege;

● Engagesinoff-campusconductthatadverselyaffectstheCollegecommunity;and/orIs arrestedand/orchargedwithacrimeinviolationofstateorfederallaw

Theseactionsmayinclude,butarenotlimitedto:no-contactorders,restriction/lossofprivileges, relocationorinterimsuspensionfromhousing,lossofrecognitionorinterimsuspension.

InterimAdministrativeActionsarenotsanctions Theyareeffortstoprotectthesafetyandwell-being ofmembersoftheCollegeCommunity,theCollege,orproperty.InterimAdministrativeActionsare preliminaryandtemporaryinnature.FailuretoabidebyanInterimAdministrativeActionisaviolation oftheCommunityStandards

Wherereasonablypractical,withinfive5daysoftheissuanceofaninterimaction,theSSAOor designeeshallmeetwiththestudentorStudentOrganizationtodeterminewhethertocontinueor revoketheinterimmeasureduringtheconductprocess.AstudentorStudentOrganizationshallbe notifiedinwritingofanydeterminationmadeatthatmeeting.

DISCIPLINARYPROCESS

AnypersonmayfileareportregardinganystudentorStudentOrganizationallegingmisconduct.To initiatetheConductprocess,reportsshallbepreparedinwritinganddirectedtotheSSAOor designee Areportshouldbesubmittedassoonaspossibleaftertheallegedmisconducttakesplace Communitymembersmaysubmitreportsthroughthiselectronicformlocatedatmassart.edu/help.

PROCESS

STEP1InitiationofStudentConductProcess

TheStudentConductProcessisinitiatedonceacomplaintofanallegedviolationisreceivedbythe SSAOordesignee.AcomplaintisdefinedasanallegationofaviolationoftheCommunityStandards, whichisfiledwithorbytheSSAOordesignee TheSSAOordesigneemayactonacomplaintofa potentialviolationwhetheraformalcomplaintformiscompletedornot.

STEP2PreliminaryInquiry

WhentheSSAOordesigneefilesorreceivesacomplaintallegingthatastudenthasactedinamanner whichmaybeinviolationoftheCommunityStandards,theSSAOordesigneemayconducta preliminaryinquiryintothenatureofthecomplaint,theevidenceavailable,andthepartiesinvolved. Thepreliminaryinquiryleadsto:

Adeterminationthatthereisinsufficientevidencetopursuetheinvestigationbecausethebehavior alleged,evenifproven,wouldnotviolatetheCommunityStandardsandthereforetheConduct processends;or

AdeterminationthattheallegedbehaviorconstitutesapossibleviolationoftheCommunityStandards, resultinginarequesttoscheduleanAdministrativeResolutionmeetingwithaCSOwithinfive5days; or

Furtherinvestigationisneededtomakeadetermination.TheSSAOordesigneemayassignaCSOto conducttheinvestigationifneeded

STEP3AdministrativeResolution

AfteraPreliminaryInquiry,orwhenaPreliminaryInquiryisnotnecessaryasdeterminedbytheSSAO ordesignee,aCSOwillmeetwiththeStudent/StudentOrganizationtoreviewthecomplaint,and providetheStudent/StudentOrganizationanopportunitytorespondtotheallegations.

TheStudent/StudentOrganizationhastherighttobeaccompaniedbyanyadvisoroftheirown choosingandattheirownexpense Theadvisormaybeanotherstudent,facultymember, administrator,oranattorney.AnadvisorʼsroleislimitedtoadvisingtheStudent/StudentOrganization discretelyandisnototherwisepermittedtoparticipatedirectlyinthemeeting Ifthestudentelectsto haveanattorneyastheiradvisor,theCollegerequestsnotificationthreedayspriortothescheduled meetingastheCollegeʼsattorneymayinsuchcasesattendthehearing.Pleasenote,requeststo changeproposedmeetingstoaccommodateanAdvisorʼsschedulewillbeconsideredbutmaynot alwaysbegranted.

ThepossibleoutcomesofanAdministrativeResolutionmeetinginclude:

Alcoholandotherdrugabuseeducationandpreventionprogramshavebeenestablished andarecoordinatedbytheDepartmentofCommunityHealth&Well-Beingandthe CounselingCenterwithassistancefromStudentSuccessandEnrollmentManagementand othercollegedepartments ProgramsprovidetrainingandservicestotheMassArt communityandofferpreventativeeducationandoutreachactivitiesaboutthecollegeʼs AlcoholandDrugPolicies,substanceuseawarenessandalcoholandotherdrugabuse. ResidentDirectors,aswellasstudentstaff,ResidentAssistants,intheresidencehalls, receiveregulartrainingonissuesregardingalcoholandotherdruguseandabuseona regularbasis.

CommunityHealth&Well-Being,alongwithotherStudentSuccessandEnrollment Managementstaffareavailableforconsultationwithindividualstudentswithsubstance useconcerns ServicesprovidedbytheDepartmentofCommunityHealth&Well-Being andstudentstaff,PULSEAdvocates,includealcoholanddrugeducationalworkshops, campuswidepreventionprograms,educationalandalternativeprogramming,information onsubstanceabusetreatmentandsupportprograms,andreferralstooutsideagencies. TheDepartmentofCommunityHealth&Well-Being,theCounselingCenterandDeanof StudentsOfficehaveestablishedworkingrelationshipswithareahospitals,community mentalhealthcentersandothersocialservice/non-profitagenciestofacilitatereferrals whentreatmentisneeded.

MassArtintendsforitsstudentstoabidebyMassachusettsGeneralLawswhichprohibit thosepeopleundertheageof21frompossessing,purchasingortransportingalcoholic beverages.Studentsoflegaldrinkingagelivinginanareaoncampuswherealcoholis permitted,whichincludestheArtistsʼResidenceortheTreeHouseonly,(alcoholisnot permittedatanytimeinSmithHall,regardlessofage)whowishtopossess/consume alcoholwithinthebuildingmustfollowspecificconditions,includeregisteringwiththeir respectiveResidenceHallDirector.Studentsoflegalagewhochoosetopossessanduse alcoholmustdosoresponsibly.Studentsareexpectedtoknowandunderstandthe policiesestablishedbyofficessuchasResidenceLife&HousingandPublicSafety beforebecominginvolvedinanyeventwherealcoholicbeveragesaretobepresent. DISTRIBUTIONOFILLICITDRUGSORALCOHOL

Theuseofdrugsandalcoholisconsideredaseriouscrimeunderlocal,state,andfederal laws Ifconvicted,individualsmayfaceimprisonment,fines,andassignedcommunity service.Itisimportanttonotethatprisonsentencesarenotliftedtoallowconvicted individualstoattendcollege.

Additionally,afelonyconvictionfordrugoralcohol-relatedoffensescansignificantlylimit careeropportunitiesforstudents

InMassachusetts,theminimumageforthesaleorpurchaseofalcoholicbeveragesis21 yearsold Theselawsalsoapplywithinthecollegesetting Citiesandtownsin Massachusetts,particularlyBoston,strictlyprohibitpublicconsumptionofalcoholand imposefinesforviolations.Thestatealsoenforcescriminalpenaltiesfortheuseof controlledsubstances,withtheseverityofthepenaltiesvaryingbasedonthetypeofdrug Generally,narcotics,addictivesubstances,anddrugswithahighpotentialforabusecarry heavierpenalties.

DrivingwhileintoxicatedinMassachusettsisconsideredasevereoffense,andthose convictedfacestrictpenalties,includingdriver'slicensesuspensionandimprisonment.

Possessionofdrugswithoutvalidauthorizationisillegal.Underfederallaw,distributing drugstoindividualsundertheageof21carriesdoublethenormalpenalty,witha mandatoryone-yearprisonsentence.Athirdconvictionforthisoffenseresultsin mandatorylifeimprisonment.Thesepenaltiesalsoapplytodrugdistributionwithin1,000 feetofacollegeorschool.Federallawimposessignificantlyharsherprisonsentencesfor themanufacturinganddistributionofdrugsiftheiruseleadstodeathorseriousinjury Whilepenaltiesfordrugpossessionaregenerallynotassevereasthoseformanufacturing anddistribution,possessionofarelativelylargequantitymaybeconsidereddistribution. Bothstateandfederallawsimposegreaterpenaltiesforsecondandsubsequent convictions Manylawsmandatemandatoryprisonterms,requiringindividualstoservethe fullminimumterm.

InMassachusetts,itisillegaltobeinalocationwhereheroinisstoredortobeinthe presenceofapersonknowntopossessheroin.Merelybeingpresentataprivateparty whereheroinisfoundcanresultinaseriousdrugconviction Thesaleandpossessionof drugparaphernaliaarealsoillegalinthestate.

Individualsconvictedofdrugpossessionunderstateorfederallawareineligibleforfederal studentgrantsandloansforuptooneyearafterthefirstconviction,anduptofiveyears afterthesecondconviction.Distributingdrugsresultsinalossofbenefitsforfiveyears afterthefirstconviction,10yearsafterthesecondconviction,andpermanentlyafterthe thirdconviction.

EffectsofOtherDrugs

● Tobacco smoke contains carbon monoxide and may cause cancer and bronchial disease, a chronic cough and respiratory irritation. Smoking by pregnant women mayresultinfetalinjury,prematurebirth,andlowbirthweight Chewingoftobacco maycausecancer.

● Adderall,Ritalin,andConcertaaredrugsprescribedtotreatADHDAttentionDeficit Hyperactivity Disorder). These drugs are Schedule II controlled substances; distribution or possession of these drugs without a prescription is illegal These drugs are sometimes abused to increase alertness, focus, and energy. Risksand side effects of these drugs include irregular heartbeat,increasedbloodpressure, inability to sleep, dangerously high bodytemperature,headache,nervousness,or shakiness.Thesedrugsareaddictive.Repeatedusecanleadtofeelingsofhostility and paranoia. Prolongedusemaypermanentlydiminishthebrainʼsabilitytofocus orconcentrateontasks.

● Marijuana has properties of both depressants and stimulants and isconsidereda psychoactive drug. Marijuana alters perception and coordination, making it dangerous to operate a vehicle under the influence. Marijuana contains more tar thantobaccoandmaycauselungandbronchialdisease,achronicdrycoughand respiratoryirritation Marijuanausebyteenagersandyoungadultsundertheageof 24hasbeenshowntonegativelyimpactbraindevelopment,harmingoneʼsabilityto learnandrememberinformation.

● MDMA (also known as "Molly" or Ecstasy) is anempathogencausingtheuserto feel euphoric. Its short-term effects include increased heart rate and blood pressure, increased body temperature, sweating, and muscle tension and involuntaryteethclenching.MDMAsignificantlyimpactstheserotoninsysteminthe brain In the days following use, feelings of depression, anxiety, hopelessness, paranoia, fatigue, and difficulty sleeping are very common. It can take the brain several days for your brain to adjust and returntoitsnormalstateoffunctioning.

Repeated use may permanently damage the serotonin system, leadingtochronic depressionandothermentalillness.

● LSD is a psychoactive hallucinogenic drug that causesuserstoseeimages,hear sounds,andfeelsensationsthatseemrealatthetime,butdonotexist.Someusers mayexperienceterrifyingthoughtsandfeelingsofdespair,fear,lossofcontrol,and extremeparanoiawhileundertheinfluence.Thismaylastforupto12hours.Other risks include impaired judgment, visual distortions, and abnormal thoughts and perceptions.YoushouldneveroperatemachineryordriveacarwhiletakingLSD.

● Cocaineorcrackusemaybefatal,dependinguponthecardiovascularresponseof theuser Thisdrugishighlyaddictiveandwithdrawalresultsinseveredepression

● Tranquilizers and sedatives are also highly addictive, even in low doses Use of these drugs in conjunction with alcohol is extremelydangerousandmayresultin comaordeath.

● The intravenous useofdrugscarriestheadditionalriskofinfectionduetoshared needles.HIVandhepatitisaretransmittedinthisway.

Narcotics

PursuanttotheSCHA,hazingisanyactivityexpectedofsomeonejoiningorparticipatinginagroup thathumiliates,degrades,abusesorendangersthem,regardlessofaperson'swillingnessto participate. ● martial arts-type weapons, swords, pointed metal darts; metal knuckles;

● bows,crossbows,arrows,slingshots;

● switchblade knives, double-edged knives, hunting-type (fixed blade) knives of any length, throwing knives, folding-type (pocket style, including Swiss army knives)withabladelength greaterthantwo-andonehalfinches;

● weapons unlawfully possessed, carried, discharged, brandished,orotherwiseusedinviolationofMassachusettslaw;

● any object used as a weapon or otherwise used to threaten harm,oranyobjectdesignedto,orreadilyconverted,toperform essentially the same function as any of the prohibited objects listed above, or any other destructivedeviceorinstrumentthat maybeusedtodobodilyinjury;

● laserpointerswhenimproperlyused;and

● anyobjectorweaponoflikekindasthoselisted.

Ifastudentwishestoincludeaninoperable,facsimileweaponinmaterialstobeusedin class,permissionmustbegrantedinwriting48hoursinadvancebythefacultymemberof thatclassandPublicSafetymustbenotifiedinwriting.

InterimAdministrative Action

TheCollegereservestherighttoissueaninterimmeasurewhenitreasonablyconcludesthata studentorStudentOrganization:

Posesathreattothesafetyofanyperson;
