Thefollowinggeneralrulesapplytotheuseandservingofalcoholunderthispolicy:
● PossessionanduseofalcoholareprohibitedatSmithHall
● Where students of the college are present, alcohol will be allowed only at specially registered events. Procedures for planning and serving alcohol at a registeredevent(seesectionIIIbelow)mustbeinplace
● PublicSafetyofficersandothercollegeofficialswillmonitorandstrictlyenforce thesepolicies.
● Large student events that involveoutsideadvertisingwillbesubjecttostricter controlsthan,forexample,anopeningreceptionforanexhibition
● Alcoholicbeveragesmayonlybepossessedby,servedto,orconsumedby personsoflegaldrinkingage:
○ AteventsthathavebeenregisteredwithorapprovedbyMassArt;
○ InareasoftheMassArtcampusthatareallowedtoservealcohol(see
site-specificlocationsinsectionIIIbelow);
○ Inon-campusstaffresidences,andbystudentsoflegaldrinkingagein individualstudentresidenceroomsintheArtistsʼResidenceandTree House.
Exceptasfollows,alcoholservedataregisteredeventmustbeservedbyDiningServices. TheonlytypeofeventservingalcoholthatdoesnotrequireDiningServicesisaclosed eventsponsoredbyanadministrativeoracademicdepartment.
Anexampleofthiswouldbeagraduatestudiesreceptionforgraduatestudentsonly.For theseevents,acertifiedserverisrecommended Forallothereventsthatarein site-specificlocations(seebelow),anAlcoholServerhiredthroughDiningServicesmay servealcohol,providedthattherequirementsofthispolicyhavebeenfollowedandthe eventisregisteredandapprovedinaccordancewithsectionIII.
Possessing,serving,orconsumingalcoholisprohibitedunderallothercircumstanceson theMassArtcampus
TheEventOrganizeristheindividualfromthesponsoringMassArt organization,department,orresidencehallwhotakesprimary responsibilityfortheevent Theyareresponsibleforunderstanding thisalcoholpolicyforplanningandservingalcoholatevents.They must:
● BeamemberoftheMassArtcommunity
● Beaminimumof21yearsofage,
● HireanAlcoholServerthroughDiningServices
● Bepresentfortheentireevent,and
● Besoberandnotconsumealcoholduringtheevent Incaseswhereeventsareco-hostedorco-sponsoredwith organizationsnotaffiliatedwiththecollege,MassArtwillconsiderthe OfficeofCollegeandVisitingEventsprimarilyresponsibleforthe event Theeventregistrationgroupsignerswillonlyaccept reservationsandlogisticalarrangementsmadebytheMassArt affiliatedorganizer.
All events, whether organized/sponsored by students, faculty, staff, student groups, or departments, must be registered and approved withtheComplexEventAdvisingGroup.Inaddition,allinvitedgroups
who utilize college facilities are subject to the event registration processandprocedures.
Iftheeventorganizerisplanninganeventwithalcohol,theymust starttheeventregistrationprocessthirty30calendardaysormore beforethescheduledevent.Iftheeventorganizerisplanninganevent withoutalcohol,he/she/theymuststarttheeventregistrationprocess fifteen15calendardaysormorebeforethescheduledevent
● Alleventswherealcoholisanticipatedtobeservedmust submittheEventRegistrationFormandAlcoholProposal Formatleasttwenty-one21calendardayspriortothe event.
● TheAlcoholProposalFormmustbesignedbytheEvent OrganizerʼsareaVicePresident;theVicePresidentof StudentSuccessandEnrollmentManagement oran appropriatedesigneeisresponsibleforauthorizingall student-sponsoredeventswherealcoholisbeingproposed tobeserved.

B. ProceduresForServingAlcoholAtAn Event
1.HiringAnAlcoholServerFromDining Services
Ifapprovalisgiventoaneventorganizertohostaneventwithalcohol, theeventorganizermustcontactDiningServicestohireanAlcohol Serverfortheapprovedevent.DiningServicesand/ortheir subcontractorsaretheonlyvendorapprovedtoservealcoholon MassArtʼscampus.
2.HiringAnAlcoholServerFromDining Services
Ifapprovalisgiventoaneventorganizertohostaneventwithalcohol,
theeventorganizermustcontactDiningServicestohireanAlcohol Serverfortheapprovedevent.DiningServicesand/ortheir subcontractorsaretheonlyvendorapprovedtoservealcoholon MassArtʼscampus.
A. RestrictionsOnTheUseOfStudentActivityFunds
ItisprohibitedtouseMassArtStudentGovernmentFeeFundsto purchasealcohol Inthecaseofeventssponsoredbyacademic departments,orbyadministrativeoffices,thisprohibitionmay bewaivedwiththeapprovaloftherelevantVicePresident,or otherseniorofficer,basedonadeterminationthatthe requirementsforservingalcoholateventsareunderstoodand willbeobserved.Theprohibitionmaynotbewaivedwhenthe sponsoringorganizationisstudent-run.Funds,however,from student-runorganizationsmaybeusedtohireDiningService alcoholservers.
B. AdvertisingAtAnEventWhereAlcoholWillBeServed Advertisingmustfocusontheevent,notthealcohol.Phrases suchas“BeveragesAvailableˮand“PositiveIDRequiredˮare acceptable,whilephrasessuchas“Wine&CheeseParty,ˮ“Free BeerandWine,ˮand“BeerBashˮarenot Advertisingmaynot promotetheavailabilityoffreealcohol,providedetailsofthe typeorbrandofalcoholtobeserved,orincludephrasessuch as“AllYouCanDrinkˮAcopyofadvertisingmustbesubmitted withtheeventregistrationform

Ifafeeforadmissionischargedatthedoororotherwise,itcannotbe usedtocoverthecostofalcohol
AlleventsMUSThavedoubletheamountofnon-alcoholicbeverages basedontheamountofalcoholicbeveragesavailableandservefoodto guests.

● AlldrinksMUSTbeindividuallypouredandservedtocustomersor guests.
● Aservermaynotservemorethanonedrinktoonepersonatanyone time,withtwodrinksbeingthemaximumperpersonforathree-hour servingtime.
● Alcoholmustbeattendedatalltimes.Guestsmustneverbeabletohelp themselvestodrinks
● Pitchersorkegsmustnotbeserved.
● AppropriatesignagemustbedisplayedindicatingthatanIDisrequired foralcoholconsumption Proofofagewillbecheckedwhenalcoholis beingservedbyDiningServicesand/ortheirsubcontractors.
UnderMassachusettslaw,ahost/organizerofaneventmaybeheldliablefortheinjuries sufferedbyothersifthehostkneworshouldhaveknownthataguestwasdrunkand neverthelessgave/permittedtheguesttotakeanalcoholicdrinkandthereafter,becauseof theguestʼsintoxication,theguestnegligentlycausedinjurytoothers.Iftheguestwho causesaninjuryisaminor,thehostwhoservedthealcoholorpermittedalcoholtobe servedtotheminormightbeheldliabletootherseveniftheminorwasalreadyintoxicated whentheminorwasservedalcohol.
ThePublicSafetyDepartmentencouragesalternativetransportationtoandfromthe collegeincludingtravelingthecitystreetswithbicycles,mopeds,andmotorcycles.
Afewsimplebuteffectiveguidelinescanhelpmakeyourtrip,andusingalternative transportation,safe.
Bicyclesshouldbesecuredtodesignatedracksandareasonly,andnottorailings, banisters,orfences Bicyclessecuredinunauthorizedareasareatincreasedriskoftheft andofblockingentrancesandexits Atnotimemayanyvehiclebeplacedonafire escapeorstairwell.

TheSeniorStudentAffairsOfficerSSAOhasultimateauthorityforadministrationoftheCommunity Standardsandmaydelegateday-to-dayoversighttotheirdesignee TheSSAO,ordesignee,may appointCommunityStandardsOfficersCSOorHearingBoardMembersasnecessarytoeffectively andefficientlyadministertheseCommunityStandards.TheSSAO,ordesignee,willconducttraining sessionsforthoseresponsibleforadjudicatingcasesfollowingtheprocessoutlinedbythese CommunityStandardsandwillmanageandmaintainallrecordspertainingtotheadministrationand enforcementoftheseCommunityStandards

AlthoughMassachusettslawpermitstheuseofcannabis/marijuanaandthe possession,use,distribution,andcultivationofcannabisinlimitedamounts,federal law,includingtheFederalControlledSubstancesActof1970,theDrugFreeWorkplace Actof1988andtheDrugFreeSchoolsandCommunitiesActof1989,prohibitsthe possession,use,distribution,and/orcultivationofcannabisateducationalinstitutions. Further,ascannabisremainsclassifiedasanillegalnarcoticunderfederallaw, institutionsofhighereducationthatreceivefederalfundingarerequiredtomaintain policiesprohibitingthepossessionanduseofcannabisontheircampuses.
Additionally,studentswhopossessamedicalcannabisregistrationcardwillnotbe grantedADAaccommodationsrelatedtoitsuseorpossession.However,uponrequest, theCollegemayconsiderreleasingastudentfromtheirResidenceHallLicense Agreementasareasonableaccommodationforadocumenteddisabilitythat necessitatestheuseorpossessionofmedicalcannabis
Accordingly,thepossession,use,distributionorcultivationofcannabis,evenfor medicalpurposes,isprohibitedonallCollegepropertyoratCollegesponsoredevents andactivities.Alsoprohibitedistheoperationofamotorvehiclewhileunderthe influenceofcannabisonCollegepropertyoratCollegesponsoredeventsoractivities.
Further,thispolicyprohibitsthepossession,use,ordistributionofallcannabis accessoriesandcannabisproducts Cannabisaccessoriesshallinclude,butarenot limitedto,anydeviceorequipmentusedforingesting,inhaling,orotherwise introducingcannabisintothehumanbody Cannabisproductsshallinclude,butarenot limitedto,productsthatarecomposedofcannabisandotheringredientsandare intendedforuseorconsumption,suchas,butnotlimitedto,edibleproducts.
Inaddition,noADAaccommodationswillbemadeforanystudentinpossessionofa medicalcannabisregistrationcard Uponrequest,theCollegemayreleasestudents fromtheirResidenceHallLicenseAgreementifapprovedasareasonable accommodationforadocumenteddisabilityrequiringuseorpossessionofcannabis formedicalpurposes.

Afacultymemberwhosuspectscheatingorplagiarisminworksubmittedinfulfillmentofaclass requirementshouldconferwiththestudentsubmittingtheworkinanattempttodeterminewhethera violationhasoccurred.
Thefacultymemberhasthediscretiontoaccepttheworkasacademicallyand/orartisticallyhonest, toresolvetheissueasaclassroomissue,ortoreferthemattertotheDepartmentChair.Intheevent thestudentdoesnotconcurwiththedispositionproposedbythefacultymember,thestudentmay referthemattertotheProvostortheirdesignee.IfthematterisreferredtotheDepartmentChair,the Chairandfacultymemberwillmeetwiththestudenttopursueinformationthatmaybepertinent.
IntheeventthattheChairandfacultymemberdeterminethataviolationhasoccurred,theywillreview thestudentʼseducationalrecordtodetermineifapriorsanctionforacademicmisconducthasbeen imposedandmayimposeoneormoreofthefollowingsanctions:

IftheProvostordesignee,inconsultationwiththeDepartmentChairandthefacultymember, determinesthatjustcauseexists,theProvostordesigneemayreferthemattertotheSeniorStudent AffairsOfficer,ordesignee,tobemanagedasaconductmatterunderthegeneralprovisionsofthese CommunityStandards.
TheCollegereservestherighttoissueaninterimmeasurewhenitreasonablyconcludesthata studentorStudentOrganization:
● Posesathreattothesafetyofanyperson;
● PosesathreattoCollegepropertyorequipment;
● SubstantiallydisruptsorinterfereswiththenormaloperationsoftheCollege;
● Engagesinoff-campusconductthatadverselyaffectstheCollegecommunity;and/orIs arrestedand/orchargedwithacrimeinviolationofstateorfederallaw
Theseactionsmayinclude,butarenotlimitedto:no-contactorders,restriction/lossofprivileges, relocationorinterimsuspensionfromhousing,lossofrecognitionorinterimsuspension.
InterimAdministrativeActionsarenotsanctions Theyareeffortstoprotectthesafetyandwell-being ofmembersoftheCollegeCommunity,theCollege,orproperty.InterimAdministrativeActionsare preliminaryandtemporaryinnature.FailuretoabidebyanInterimAdministrativeActionisaviolation oftheCommunityStandards
Wherereasonablypractical,withinfive5daysoftheissuanceofaninterimaction,theSSAOor designeeshallmeetwiththestudentorStudentOrganizationtodeterminewhethertocontinueor revoketheinterimmeasureduringtheconductprocess.AstudentorStudentOrganizationshallbe notifiedinwritingofanydeterminationmadeatthatmeeting.

STEP1InitiationofStudentConductProcess
TheStudentConductProcessisinitiatedonceacomplaintofanallegedviolationisreceivedbythe SSAOordesignee.AcomplaintisdefinedasanallegationofaviolationoftheCommunityStandards, whichisfiledwithorbytheSSAOordesignee TheSSAOordesigneemayactonacomplaintofa potentialviolationwhetheraformalcomplaintformiscompletedornot.
STEP2PreliminaryInquiry
WhentheSSAOordesigneefilesorreceivesacomplaintallegingthatastudenthasactedinamanner whichmaybeinviolationoftheCommunityStandards,theSSAOordesigneemayconducta preliminaryinquiryintothenatureofthecomplaint,theevidenceavailable,andthepartiesinvolved. Thepreliminaryinquiryleadsto:
Adeterminationthatthereisinsufficientevidencetopursuetheinvestigationbecausethebehavior alleged,evenifproven,wouldnotviolatetheCommunityStandardsandthereforetheConduct processends;or

Alcoholandotherdrugabuseeducationandpreventionprogramshavebeenestablished andarecoordinatedbytheDepartmentofCommunityHealth&Well-Beingandthe CounselingCenterwithassistancefromStudentSuccessandEnrollmentManagementand othercollegedepartments ProgramsprovidetrainingandservicestotheMassArt communityandofferpreventativeeducationandoutreachactivitiesaboutthecollegeʼs AlcoholandDrugPolicies,substanceuseawarenessandalcoholandotherdrugabuse. ResidentDirectors,aswellasstudentstaff,ResidentAssistants,intheresidencehalls, receiveregulartrainingonissuesregardingalcoholandotherdruguseandabuseona regularbasis.
CommunityHealth&Well-Being,alongwithotherStudentSuccessandEnrollment Managementstaffareavailableforconsultationwithindividualstudentswithsubstance useconcerns ServicesprovidedbytheDepartmentofCommunityHealth&Well-Being andstudentstaff,PULSEAdvocates,includealcoholanddrugeducationalworkshops, campuswidepreventionprograms,educationalandalternativeprogramming,information onsubstanceabusetreatmentandsupportprograms,andreferralstooutsideagencies. TheDepartmentofCommunityHealth&Well-Being,theCounselingCenterandDeanof StudentsOfficehaveestablishedworkingrelationshipswithareahospitals,community mentalhealthcentersandothersocialservice/non-profitagenciestofacilitatereferrals whentreatmentisneeded.
MassArtintendsforitsstudentstoabidebyMassachusettsGeneralLawswhichprohibit thosepeopleundertheageof21frompossessing,purchasingortransportingalcoholic beverages.Studentsoflegaldrinkingagelivinginanareaoncampuswherealcoholis permitted,whichincludestheArtistsʼResidenceortheTreeHouseonly,(alcoholisnot permittedatanytimeinSmithHall,regardlessofage)whowishtopossess/consume alcoholwithinthebuildingmustfollowspecificconditions,includeregisteringwiththeir respectiveResidenceHallDirector.Studentsoflegalagewhochoosetopossessanduse alcoholmustdosoresponsibly.Studentsareexpectedtoknowandunderstandthe policiesestablishedbyofficessuchasResidenceLife&HousingandPublicSafety beforebecominginvolvedinanyeventwherealcoholicbeveragesaretobepresent. InMassachusetts,theminimumageforthesaleorpurchaseofalcoholicbeveragesis21 yearsold Theselawsalsoapplywithinthecollegesetting Citiesandtownsin Massachusetts,particularlyBoston,strictlyprohibitpublicconsumptionofalcoholand imposefinesforviolations.Thestatealsoenforcescriminalpenaltiesfortheuseof controlledsubstances,withtheseverityofthepenaltiesvaryingbasedonthetypeofdrug Generally,narcotics,addictivesubstances,anddrugswithahighpotentialforabusecarry heavierpenalties.
DrivingwhileintoxicatedinMassachusettsisconsideredasevereoffense,andthose convictedfacestrictpenalties,includingdriver'slicensesuspensionandimprisonment.
Possessionofdrugswithoutvalidauthorizationisillegal.Underfederallaw,distributing drugstoindividualsundertheageof21carriesdoublethenormalpenalty,witha mandatoryone-yearprisonsentence.Athirdconvictionforthisoffenseresultsin mandatorylifeimprisonment.Thesepenaltiesalsoapplytodrugdistributionwithin1,000 feetofacollegeorschool.Federallawimposessignificantlyharsherprisonsentencesfor themanufacturinganddistributionofdrugsiftheiruseleadstodeathorseriousinjury Whilepenaltiesfordrugpossessionaregenerallynotassevereasthoseformanufacturing anddistribution,possessionofarelativelylargequantitymaybeconsidereddistribution. InMassachusetts,itisillegaltobeinalocationwhereheroinisstoredortobeinthe presenceofapersonknowntopossessheroin.Merelybeingpresentataprivateparty whereheroinisfoundcanresultinaseriousdrugconviction Thesaleandpossessionof drugparaphernaliaarealsoillegalinthestate.
Individualsconvictedofdrugpossessionunderstateorfederallawareineligibleforfederal studentgrantsandloansforuptooneyearafterthefirstconviction,anduptofiveyears afterthesecondconviction.Distributingdrugsresultsinalossofbenefitsforfiveyears afterthefirstconviction,10yearsafterthesecondconviction,andpermanentlyafterthe thirdconviction.

● Tobacco smoke contains carbon monoxide and may cause cancer and bronchial disease, a chronic cough and respiratory irritation. Smoking by pregnant women mayresultinfetalinjury,prematurebirth,andlowbirthweight Chewingoftobacco maycausecancer.
● Adderall,Ritalin,andConcertaaredrugsprescribedtotreatADHDAttentionDeficit Hyperactivity Disorder). These drugs are Schedule II controlled substances; distribution or possession of these drugs without a prescription is illegal These drugs are sometimes abused to increase alertness, focus, and energy. Risksand side effects of these drugs include irregular heartbeat,increasedbloodpressure, inability to sleep, dangerously high bodytemperature,headache,nervousness,or shakiness.Thesedrugsareaddictive.Repeatedusecanleadtofeelingsofhostility and paranoia. Prolongedusemaypermanentlydiminishthebrainʼsabilitytofocus orconcentrateontasks.
● Marijuana has properties of both depressants and stimulants and isconsidereda psychoactive drug. Marijuana alters perception and coordination, making it dangerous to operate a vehicle under the influence. Marijuana contains more tar thantobaccoandmaycauselungandbronchialdisease,achronicdrycoughand respiratoryirritation Marijuanausebyteenagersandyoungadultsundertheageof 24hasbeenshowntonegativelyimpactbraindevelopment,harmingoneʼsabilityto learnandrememberinformation.
● MDMA (also known as "Molly" or Ecstasy) is anempathogencausingtheuserto feel euphoric. Its short-term effects include increased heart rate and blood pressure, increased body temperature, sweating, and muscle tension and involuntaryteethclenching.MDMAsignificantlyimpactstheserotoninsysteminthe brain In the days following use, feelings of depression, anxiety, hopelessness, paranoia, fatigue, and difficulty sleeping are very common. It can take the brain several days for your brain to adjust and returntoitsnormalstateoffunctioning.
Repeated use may permanently damage the serotonin system, leadingtochronic depressionandothermentalillness.
● LSD is a psychoactive hallucinogenic drug that causesuserstoseeimages,hear sounds,andfeelsensationsthatseemrealatthetime,butdonotexist.Someusers mayexperienceterrifyingthoughtsandfeelingsofdespair,fear,lossofcontrol,and extremeparanoiawhileundertheinfluence.Thismaylastforupto12hours.Other risks include impaired judgment, visual distortions, and abnormal thoughts and perceptions.YoushouldneveroperatemachineryordriveacarwhiletakingLSD.
● Cocaineorcrackusemaybefatal,dependinguponthecardiovascularresponseof theuser Thisdrugishighlyaddictiveandwithdrawalresultsinseveredepression
● Tranquilizers and sedatives are also highly addictive, even in low doses Use of these drugs in conjunction with alcohol is extremelydangerousandmayresultin comaordeath.
● The intravenous useofdrugscarriestheadditionalriskofinfectionduetoshared needles.HIVandhepatitisaretransmittedinthisway.

MassachusettsCollegeofArtandDesigniscommittedtomaintainingasafeandinclusivecampus communitywhereallstudents,faculty,andstaffaretreatedwithdignityandrespect Thispolicyis
enactedincompliancewiththelawsoftheCommonwealthofMassachusettsandfederallaw, includingbutnotlimitedtotheJeanneCleryDisclosureofCampusSecurityPolicyandCampusCrime StatisticsActCleryAct). HazingisindirectconflictwiththevaluesoftheCollegeandisexplicitly prohibited
InDecember2024,amendmentstotheHigherEducationActʼsCleryActrequirementswereenacted. TheStopCampusHazingActSCHA,added:newdefinitionsfortheterms“hazingˮand“student organization;ˮhazingasanewreportingsectionintheCleryActAnnualSecurityReports(“ASRˮ); hazingpolicystatements,preventiontrainingrequirements;andrequiredpublicationofCampus HazingTransparencyReports(“CHTRˮ)forcertainfindingsoforganizationalresponsibilityforhazing.
PursuanttotheSCHA,hazingisanyactivityexpectedofsomeonejoiningorparticipatinginagroup thathumiliates,degrades,abusesorendangersthem,regardlessofaperson'swillingnessto participate. TheSCHAfurtherdefineshazingas:anyintentional,knowing,orrecklessactcommitted byapersonagainstastudent(regardlessofthatstudentʼswillingnesstoparticipate),that1is connectedwithaninitiationinto,anaffiliationwith,orthemaintenanceofmembershipin,an organization(eg,aclub,athleticteam,fraternity,orsorority);and2causesorislikelytocontribute toasubstantialrisk,abovethereasonableriskencounteredinthecourseofparticipationinthe institutionofhighereducationortheorganization,ofphysicalinjury,mentalharm,ordegradation.1 Notably,thedefinitionencompassesconductthatismerelyaffiliatedwithastudentorganization,and activitiesrelatedtoinitiationormaintainingmembershipwithinthestudentorganization,makingthis definitionbroaderthantheMassachusettsdefinitionofhazing,whichonlypertainstoconductrelating toinitiationintoastudentorganization.Hazingtypeactivitiesmayinclude,butarenotnecessarily limitedto:
a.whipping,beating,striking,electronicshocking,placingofaharmfulsubstanceon someoneʼsbody,orsimilaractivity;b causing,coercing,orotherwiseinducingsleep deprivation,exposuretotheelements,confinementinasmallspace,extremecalisthenics, orothersimilaractivity;c.causing,coercing,orotherwiseinducinganotherpersonto consumefood,liquid,alcohol,drugs,orothersubstances;d causing,coercing,or otherwiseinducinganotherpersontoperformsexualacts;e.anyactivitythatplaces anotherpersoninreasonablefearofbodilyharmthroughtheuseofthreateningwordsor conduct;f.anyactivityagainstanotherpersonthatincludesacriminalviolationoflocal, state,tribal,orfederallaw;andg anyactivitythatinduces,causes,orrequiresanother persontoperformadutyortaskthatinvolvesacriminalviolationoflocal,state,tribal,or federallaw.

Notwithstandinganyotherprovisionsofthissectiontothecontrary,consentshallnotbeavailableasa defensetoanyprosecutionunderthisaction.
PursuanttoMGLch 269§18,Whoeverknowsthatanotherpersonisthevictimofhazingasdefinedin sectionseventeenandisatthesceneofsuchcrimeshall,totheextentthatsuchpersoncandoso withoutdangerorperiltohimselforothers,reportsuchcrimetoanappropriatelawenforcement officialassoonasreasonablypracticable.Whoeverfailstoreportsuchcrimeshallbepunishedbya fineofnotmorethanonethousanddollars.
