On March 11,2021,President Joe Biden signed the American Rescue Plan Act,a $1.9 trillion stimulusbill to aid publichealth and economicrecoveryduring the CoronavirusDisease 2019 ("COVID-19") pandemic.The plan included $350 billion in emergency funding for states,territories,and tribal governments:
- to respond to the publichealth emergencywith respect to the COVID-19 or itsnegative economicimpacts,including assistance to households,small businesses,and nonprofits,or aid to impacted industriessuch astourism,travel and hospitality.
- to respond to workersperforming essential work during the COVID-19 public health emergency byproviding premium pay to eligible workersof the State,territory,or Tribal government that are performing such essential work;
- for the provision of government servicesto the extent of the reduction in revenue of such State,territory,or Tribal government due to the COVID-19 public health emergency relative to revenuescollected in the most recent full fiscal year of the State,territory,or Tribal government prior to the emergency; or
- to make necessaryinvestmentsin water,sewer,or broadband infrastructure.
On May24,2021,Governor Ralph DLG.Torresannounced at the Judiciary'sLaw DayProclamation Signing Ceremonyhis commitment to give the Judiciary$10 million in ARPAfundsand potentiallyanother $10 million in March 2022.
The Judiciary'stop prioritiesto respond to COVID-19 include sustaining judicial serviceson Saipan,Tinian,and Rota; retrofitting and improving facilitiesand infrastructure to prevent the spread of COVID-19 and allow for social distancing,and enhancing technologyfor remote hearingsand services.
Thisreport outlinesthe expendituresand activitiesunder ARPAfor the month of November 2022.Historical data and information can be found in the Appendix
Revised SpendingPlan No. 4
The Judiciaryisresponsible for managing $13,160,703.00 under Sub-Award No.CNMI220004 and $873,485.30 under Sub-Award No.CNMI22047in American Rescue Plan programs.The Judiciary'sspending plansare part of a comprehensive strategyto support the Judiciaryduring the pandemic.Since March 2020,the Judiciaryhassubmitted four spending plansand anticipatesthe submittal of Spending Plan No.5 in the near future.
In November,Budget and Finance Director John T.Villagomezwasasked to assessthe Judiciary'sAll Othersanticipated expendituresthat could not be covered under PublicLaw 22-22,which onlyprovided $430,463.00 in All Others.Asof November 31,2022,the plan hasnot been finalized.
The Judiciarywill continue to use ARPAfundsto respond to the COVID-19 pandemic,including sustaining judicial serviceson Rota,Tinian and Saipan,and building,retrofitting and improving infrastructure.
The current Spending Plan No.4 includesreprogramming of fundsfor Personnel and All OthersExpendituresincluding Professional Services,Repair and Maintenance,Cleaning Services,Licensesand FeesTechnology.The Plan estimates expendituresof $5.1 million in Personnel and $8 million in All Others.
Asreported in the Judiciary?spreviousspending plans,asubstantial amount of the fundsisallocated to the Judiciary Data Center/Guma?Hustisia Annex.The Data Center,which isnow at the A&Econceptual planning phase with consultantson board,will provide a secure environment for the Information SystemsOffice,including the Judiciary?s telecommunicationsand computer systems.The Judiciarymayfind it necessaryto request additional funding for the projects.See Table 1 for the plan comparisonsand Table 2 for expendituresasof November 31,2022.

The Committee continuesto meet biweeklyto addressanydeveloping needs,discussfinancials,and provide updatesfor anyongoing projects.Meetingsare continuouslyconducted in-person at the assemblyhall at the Guma' Hustisia while staff from Kotten Tinian and Rota Centron Hustisia and teleworkerscontinue to participate remotelyvia MSTeams.In November 2022,there wasone committee meeting and three leadership meetings.The Capital Improvement ProjectsCommittee meet biweekly everyother Thursday.The sub-committee held one meeting in November.

On June 4, 2021, the Office of the Governor awarded $13,160,703.00 in ARPA funds to the Judiciary. By December 31, 2021, the allotment was received in full.
The total expenses obligated in Fiscal Year ("FY") 2021 amounted to $458,496.00:
- $449,636.00 in Actual Expenditures (meaning service was completed, invoice was received, and payment was made) and - $8,860.00 in Encumbrances (meaning the contract and/or purchase order was processed but either the service,invoice, or check is pending.
The total expenses obligated in FY 2022 totaled $4,331,464.44:
- $3,732,036.44 in Actual Expenditures and - $599,428.00 in Encumbrances.
In FY 2023, the total expenses obligated as of November 30,2022, were $394,978.09: - $201,024.28 in Actual Expenditures and - $193,953.81 in Encumbrances.
To date, the Judiciary has expended $1,913,999.74 in Personnel and $3,270,938.79 in All Others totaling $5,184,938.53.
The fund status as of November 30, 2022 was $7,975,764.47.

On October 17, 2022,the Judiciary received additional ARPA funding in the amount of $873,485.40 under Sub-Award No. CNMI22047.
The total expenses encumbered in FY 2023 as of November 30, 2022,was $873,485.40. The total liquidated amount is $414,950.00. There are no amendments to be reported at this time.

For November 2022,the Judiciarycontinued to re-announce the FamilyCourt ServicesSpecialist Job Vacancy Announcement (JVA); processed 63 Noticesof Personnel Action (NOPAs) for amendmentsthat reflected a changeofpercentageofaccount chargeablefroma percentageofARPAandLocal fundsto100%Local funds; renewed seven contracts; and hired one new employee.For audit purposes,personnel who hold ARPApositionsare required to submit a DailyWork Summary outlining the tasksperformed.

On November 7,2022,the Special Projectsand Infrastructure Coordinator position,which is 100%ARPA-funded,wasfilled internallyby Bryan S.Bocago.The position servesunder the direct supervision of the Chief Justice or hisdesignee and will provide support and project coordination to ensure the Judiciary?sSpecial Projectsand Infrastructure plans,related to the expenditure of ARPAfunds,are consistent with the Judiciary?sgoalsand objectives.Other duties and responsibilitiesinclude: communicating with variousdepartmentsto plan meetingsand keep all relevant staff,stakeholders,and partnersapprised and updated on project activities,as well asfoster and maintain a professional network; organizing,producing,maintaining,and submitting reports; serving asthe Point of Contact for and coordinating with the On-Call A&E Consultant regarding project schedulesand monitoring; reviewing change ordersand assisting in drafting the scope of work or related procurement documentsfor projectsunder the ARPA; and performing other dutiesasassigned.
The MarshalsService Division ("MSD") continuesto enforce COVID-19 protocolsthroughout the three courthouses. MSD'ssafetyprotocolsrequire an accounting of the number of patronsentering Judiciaryfacilities.Recorded entries,which includespatrons,vendors,and employees,for the period of November 1-30,2022 show:
- Guma' Hustisia had 3,012 entriesat the courthouse including the alternate worksite.
- Kotten Tinian had 128 entriesat the courthouse.
- Rota Centron Hustisia had 259 entries,including itstenants.

ARPAScanning Clerkscontinue their tasksof scanning documentsdailyusing the scannerstheyreceived and maintain with the help of the Document Digitization Internal Operation Procedure which isdesigned to establish guidelinesfor digitization.
During the month of November 2022,ARPAScanning Clerksscanned and audited voluminousfiles:
- Tracy D. Limes and Leonora T. Vergara of Guma' Hustisia scanned a total number of 66 filesequaling 3,363 pagesand audited 272 files.
- Jan Christin S. Cabrera of Kotten Tinian scanned a total number of 237 filesequaling 3,033 pagesand audited 340 filesequaling 4,035 pages.
- Elvira M. Mangloña and Micca B. King of Rota Centron Hustisia scanned a total number of 118 files equaling 8,537 pages.
In addition to scanning and auditing,disposition of filesisalso in progress.Once enough filesare collected and approved for disposal,they are scheduled for disposition.
The Commonwealth Recorder'sOffice, Administrative Specialist I HollyC.Camacho e-filed 130 filesthat consisted of land instruments,marriage license,and UCCforms.
Similarly,for the Office of the Superior Court,Data SystemsAnalyst | Mark G.Hidalgo provided the following statistics:
- Mark G. Hidalgo of Guma' Hustisia scanned a total number of 99 filesequaling 386 pages,audited 2,743 filesequaling 40,566 pages,and digitized 35 cassette tapes.

GRAPH 9 GRAPH 8Due to unforeseen shipping delaysof micro cement,plumbing fixtures,and toilet partitions,the project timeline wassignificantly impacted and asa result,the project wasnot completed on time. Moreover,renovation activitiesthroughout the duration of the contract had to be segmented based on the availability of needed suppliesand materials.
On October 25,2022,a contract extension request wasonce again submitted byHBRInternational,Inc.,which included an updated project schedule reflecting a new project completion date of December 31,2022.The expiration of Contract Number 32200276 occurred on November 04,2022.

1. Completed the application of microcement and the installation of toilet fixturesand accessoriesin the following areas:

So asto ensure no delayin service,the contract extension requested byHBRInternational,Inc.,on October 25,2022,wasgranted and a Notice to Proceed wasissued on November 11,2022,for Sole Source Contract Number 32300167/JUD-OC-2023-3,to commence on November 05,2022,up until January 31,2023.In addition,November 05,2022,saw the arrival of the toilet partitions.
Throughout the month of November,HBRInternational,Inc.,was able to:
1. Complete the application of microcement and the installation of toilet fixturesand accessoriesin the following areas:

During the month of November 2022,the On-Call A&E Consultant,Mr.Samuel M.McPhetres,Jr.of GUMA Architects,LLC(?GUMA?) presented several A&E schematicsand illustrationsduring the 30%Schematic Design meeting.In addition,GUMAalso accommodated several revisionsto the design layout,aswell as responded to any inquiriesor feedback provided bythe committee.

On November 3,2022,a 30%SchematicDesign Meeting with the committee and the On-Call A&EConsultant,Mr. Samuel M.McPhetres,Jr.of GUMAArchitects,LLC(?GUMA?) wasconducted at the Guma?Hustisia Assembly Hall. During the meeting,the committee reviewed several technical A&Eschematicsand illustrated layout options provided byGUMA.All four (4) layout optionswere designed to best accentuate and compliment the overall facade of the Guma?Hustisia; ultimately,the committee selected layout option 2,which providesthe following floor space: Data Center ? 1,348 square feet; Annex ? 1,596 square feet; View Deck ? 1,029 square feet; and covered parking for four (4) car spaces,asper regulations under the CNMI Zoning Office.
Throughout the rest of the month of November,updated and revised A&Eschematicsand renderings,aswell as, additional requests,feedback,and clarificationswere exchanged between the committee and GUMAvia email. Moreover,project statusupdateswere provided and discussed internallyduring ARPALeadership,Committee, and Capital Improvement Projectsmeetings.
AStatusmeeting isset for December 5,2022,and a 60% SchematicDesign meeting isscheduled for January5, 2023.
Contract Progress as of 11/30/22: 8%
On October 7,2022,a Notice to Proceed wasissued to Oceania Elevator Company,LLC,("Oceania") for Sole Source Contract Number 32201300/JUD-OC-2022-15,Elevator Modernization Project.A kick-off meeting was conducted on November 9,2022 at the Guma' Hustisia Training Room,with representatives from Oceania Elevator Company, LLC,and Judiciarypersonnel.
During the kick-off meeting, there was discussion on the contract and Oceania's proposal, project timeline, ordering and shipping of needed mechanical components and parts,as well as the walk-through inspection and mobilization schedule.
On March 7, 2022, the Judiciary issued Sole Source Contract No. 32200818/JUD-OC-2022-5 to Docomo Pacific for the Fiber Optic Cable Installation and Configuration.The procured servicesare:
1. Two-year subscription to Fiber Internet 200 Mbpswith:
a. All glassfiber solution;
b. Symmetricspeeds; and
c. 200Mbpsdownload speed and 200 Mbpsupload speed.
2. Fixed BusinessStaticIP.
3. Fiber opticcabling installation and equipment configuration.
A kickoff meeting was held with the vendor on March 17,followed by an initial site assessment. Two additional site assessments were conducted on April 21st and April 25th.The modem switch was installed at the Information Systems Office on April 27,and then did the line work on April 28 and April 29 to prepare for the installation of the new fiber cables.
On May18-19,Docomo Pacificperformed the trench work and installed the fiber cables.It activated serviceson May20th.
The total contract price is $48,000.00. Now that installation and configuration are complete, the Judiciary will make monthly payments of $2,000.00 based on the invoices received.The contract will remain in effect for two years and three months from the issuance of the Notice to Proceed.
On November 3,2022,the Commonwealth Recorder'sOffice held it'sofficial launch of the E-Recording system.See Page 36 for moredetails.
In the month of November,the committee conducted two external meetingswith the contractor.At itsNovember 16, 2022 meeting,it wasdecided that the external meetingswill be conducted monthlyinstead of weekly.

On July25,2022,the Judiciary held itsfirst committee meeting in planning for the Annual Professional Development Conference.The committee waschaired byAssociate Justice PerryB.Inos.Alist of committee memberscan be found on Table21,page31.The committee met biweeklyto discussevent logistics,budgeting and agenda.SeeTable22 for meetinglisting.The Kensington Hotel on Saipan was selected asthe conference venue.On November 17,2022,the committee conducted a site visit to get a better ideaof the planning for the layout.
On November 7,2022,Chief Justice Castro and Presiding Judge Roberto C.Naraja issued a memorandum and PublicNotice No.22-004 regarding the Professional Development and Thanksgiving week schedule.An updated publicnotice (PublicNotice No.22-005) amending the work week schedule was issued on November 18,2022.
The ARPAteam prepared conference gift bagscontaining one hand sanitizer,ten disposable masks, and one reusable Judiciarymask,or one hand sanitizer and twentydisposable masks.Atotal of 140 gift bagswere prepared for the event.Scanning ClerksTracyD.Limesand Leonora T.Vergara and LEP Coordinator Lana C.Togawa provided assistance on November 10,2022 to gather and prepare these giveawaysfor distribution on the first dayof the conference. At the conference, ARPAalso provided hand sanitizerson each table aswell astwo hand sanitizer dispensersthat were placed at each entrance to the venue.

On November 22-23,2022 the Judiciaryheld its Professional Development Conference at the Kensington Hotel on Saipan.The Mental Health Court Docket ("MHCD") team kicked of the conference with an introduction and overview of their docket and how theyprovide communitybased treatment programs with the supervision of the Judiciary.Afterwards,MHCD led the team building exercise.The conference also consisted of a full day breakout session with seven different topicsthat will help benefit the NMI Judiciary in the next five yearsand more.The topicsfor the groupswere Accessto Justice,Capital Improvements, CommunityOutreach Programs,Court Technology and Data Systems,Human Resourcesand Professional Workplace,Maintaining Fair and Efficient Case Flow and Time Standards,and Treatment Courts.These topicswill not onlybenefit for future purposes,but it will also tell uswhere we are now in the present and how we can improve what we have already established.
On the second dayof the Professional Development the conference began itsdaywith four breakout sessionsin the morning.The categorieswere Public Speaking,Mindfulness,Court Branding and Self-Defense.After the break out sessionsended,the Judiciarystaffsassembled in the main hall for the first of two plenarysession of the day.
Emotional Quotient presented byCarmen Ulloa-Kasperbauer,PhDand Suki Lau Santos,Mental Health Counselor.The NMI Judiciaryjoined the PacificJudicial Council program titled "Focuson Emotional Quotient." Developing your EQwill help you learn how to understand,use,and manage emotionsin a positive way. Their are five basiccomponentsin EQ: (1) Self-Awareness,(2) Self-Control,(3) Empathy,(4)Social Intelligence, (5) and Motivation.
The next plenarysession wason Cybersecuritypresented byShawn Quimby,former Chief Information Officer ("CIO") of Cimarex Energy.The basicdefinition of Cybersecurityisthe processof protecting computer systems, networksand data against cyber criminals.There are numerousamount of waysto protect personal and important information.Such ascreating strong passwords,using antivirussoftware,data back up,keeping your software up to date,etc.

The new platform providestitle companies,banks,attorneys,and membersof the publicto record land documents,marriages,and contractsaswell asresearch recorded documents,data,and images.It is user-friendlyand available in multiple languages.The E-Recording Platform isreadilyavailable to customersto record documentsanytime and make paymentsonline,even from the comfort of their home.
The Judiciaryhosted two (2) Adult,Child,and Infant CardiopulmonaryResuscitation ("CPR") Automated External Defibrillator ("AED") First Aid Certification Training sessionson November 18,2022,at the Guma' Hustisia AssemblyHall.
The Judiciarycontracted the servicesof Western PacificTraining Solutionsto conduct the certification training for twenty-three (23) JudiciaryLaw Enforcement personnel.Thisexpenditure and training isdeemed necessaryin ensuring JudiciaryLaw Enforcement personnel are knowledgeable and well-prepared to handle first-response situations when aid isneeded.
The certification training wasa blend of American Red Crosslearning courses and hands-on skills sessionsthat provided the participantswith the latest, up-to-date lifesaving skillsand certification in the following areas:
- Proper techniquesin administering CPR;
- Proper utilization of an AED; and
- Administering basicFirst Aid.
Both sessionsincluded JudiciaryLaw Enforcement personnel from:
1. MarshalsService Division;
2. Drug Court Docket;
3. Mental Health Court Docket; and
4. Office of Adult Probation Supervision.
There isanother Adult,Child,and Infant CPRAED First Aid Certification Training session set for December 2, 2022,which will also be held at the Guma' Hustisia AssemblyHall.

The Pro Se Center ismeant to assist those without attorneyswith E-Filing court cases.The area wascompleted on October 31,2022 with a total of three laptopsand a desk scanner. One of the three laptopsinstalled is dedicated for review and research of case fileswhile the remaining two laptopswill be used for electronicfiling. Most recently,File and ServExpressprovided for a PublicAccessTerminal (PAT) for Pro-Se usersto enable the electronicfilingsof pleadings.
Aspreviouslyreported,the Commonwealth Healthcare Corporation ("CHCC") put a pause on the weeklyCOVID-19 publicreportsafter the September 26,2022 update.Updateswill be provided should anysignificant developmentsoccur.
On November 17,2022,CHCCposted on their Facebook page that if anyperson suspectsthat theyhave COVID-19 and wantsto get tested, free testing isavailable at the Koberville CommunityCenter.Registration,dates,and hoursare available online at https://covidtesting.chcc.health.
