BACKGROUND
On March 11,2021,President Joe Biden signed the American Rescue Plan Act,a $1.9 trillion stimulusbill to aid publichealth and economicrecoveryduring the CoronavirusDisease 2019 ("COVID-19") pandemic.The plan included $350 billion in emergency funding for states,territories,and tribal governments:
- to respond to the publichealth emergencywith respect to the COVID-19 or itsnegative economicimpacts,including assistance to households,small businesses,and nonprofits,or aid to impacted industriessuch astourism,travel and hospitality.
- to respond to workersperforming essential work during the COVID-19 public health emergency byproviding premium pay to eligible workersof the State,territory,or Tribal government that are performing such essential work;
- for the provision of government servicesto the extent of the reduction in revenue of such State,territory,or Tribal government due to the COVID-19 public health emergency relative to revenuescollected in the most recent full fiscal year of the State,territory,or Tribal government prior to the emergency; or
- to make necessaryinvestmentsin water,sewer,or broadband infrastructure.
On May24,2021,Governor Ralph DLG.Torresannounced at the Judiciary'sLaw DayProclamation Signing Ceremonyhis commitment to give the Judiciary$10 million in ARPAfundsand potentiallyanother $10 million in March 2022.
The Judiciary'stop prioritiesto respond to COVID-19 include sustaining judicial serviceson Saipan,Tinian,and Rota; retrofitting and improving facilitiesand infrastructure to prevent the spread of COVID-19 and allow for social distancing,and enhancing technologyfor remote hearingsand services.

Revised SpendingPlan No. 4
In December,the ARPAteam followed up with the Budget and Finance Office ("BAFO") to provide guidance and feedback in determining how to adjust itsplan to better respond to the Judiciary'sFY2023 Budget Appropriation under PublicLaw 22-22 and current conditionsunder the pandemic.Currently,the biggest barrier to service isthe lack of funding under All Othersfor Judiciaryoperations.ARPAintendsto develop a revised plan that will support the continuance of judicial servicesincluding travel expenses(i.e.inner island travel for court proceedings),personnel training,professional servicesexpensesfor court interpretersand court-appointed counsels, jurytrial expenses,and repair and maintenance,to name a few.
Asreported in the Judiciary?spreviousspending plans,asubstantial amount of the fundsisallocated to the ARPA Hall/Data Center.The Data Center project,now at the 30%A&Ephase with consultantson board,will provide a secure environment for the Information SystemsOffice,including telecommunicationsand computer systems.The Judiciary mayfind it necessaryto request additional funding for the projects.
Asof December 31,2022,under Spending Plan No.4,the Personnel balance is$3,151,029.99,and All Othersbalance is $4,639,602.20.

The Committee continuesto meet biweeklyto addressanydeveloping needs,discussfinancial reports,and provide updatesof ongoing projects.Meetingsare conducted in-person at the AssemblyHall while staff from Kotten Tinian and Rota Centron Hustisia and teleworkerscontinue to participate remotelyvia MSTeams.In December 2022,there wasone committee meeting and four leadership meetings.The Capital Improvement ProjectsCommittee met biweekly everyother Thursday.The sub-committee held one meeting in December.

TRAINING| Enterprise Asset Management
The Judiciary held one internal Enterprise Asset Management ("EAM") training on December 20, 2022. The team continues to work on migrating assets into the EAM platform. What is EAM?

On June 4,2021,the Office of the Governor awarded $13,160,703.00 in ARPAfundsto the Judiciary.ByDecember 31,2021,the allotment wasreceived in full.
The total expensesobligated in Fiscal Year ("FY") 2021 amounted to $458,496.00:
- $449,636.00 in Actual Expenditures(meaning service wascompleted,invoice wasreceived,and payment wasmade) and - $8,860.00 in Encumbrances(meaning the contract and/or purchase order wasprocessed but either the service,invoice,or check ispending.
The total expensesobligated in FY2022 asof December 31,2022,totaled $4,378,965.40:
- $3,795,013.64 in Actual Expendituresand - $588,951.76 in Encumbrances.
In FY2023,the total expensesobligated asof December 31,2022,were $532,609.41:
- $380,915.16 in Actual Expendituresand - $151,694.25 in Encumbrances.
To date,the Judiciaryhasexpended $1,958,463.55 in Personnel and $3411,607.26 in All Otherstotaling $5,370,070.81.
The fund statusasof December 31,2022,was $7,790,632.19

On October 17,2022,the Judiciaryreceived additional ARPAfunding in the amount of $873,485.40 under Sub-Award No. CNMI22047.
The total actual expensesin FY2023 asof December 31,2022,was $873,485.40
In December,the Judiciarymade several attemptsin acquiring the remaining ARPAfundsto be deposited to itsbank account.On December 23,2022,in a letter to Acting Secretaryof Finance Margaret C.Torres,the Judiciaryformallyrequested the deposit of the remaining JudiciaryARPAfundsdirectlyto itschecking account to facilitate the processof making timelypaymentsto itsvendors for servicesrendered.Thisrequest remainspending asof December 31,2022.See Exhibit E.8 for copyoftheletter. There are no amendmentsto be reported at thistime.

On December 5,2022,a statusmeeting wasconducted at the Guma' Hustisia with the committee and the On-Call A&EConsultant,Mr.Samuel M. McPhetres,Jr.of GUMA.In addition, GUMAalso attended a portion of an ARPALeadership meeting held on December 21,2022.During both meetingsand throughout the month of December,the discussion between the committee and GUMAmainlyfocused on the ARPAHall (2nd floor) floor plan layout,which went through several revisions,to addressthe following areas:
- Incorporate 2nd fire exit,asper regulations,in order to accommodate large functions;
- Increase floor plan layout to include 2nd fire exit;
- Reconfigure restroom,kitchenette, partitions,and electrical closet; and
- Redesign main entrance and doorwayto ARPAHall balcony.
Project statusupdateswere provided and discussed internallyduring ARPA Leadership,Committee,and Capital Improvement Projectsmeetings.
On December 21,2022,the Judiciary finalized and approved the design and layout of the proposed ARPAHall/Data Center.Ultimately,thispushed back the 60%SchematicDesign Submittal deadline from January 5,2023,to January27,2023,so asto allow GUMA additional time to complete all the revisions.

On March 7, 2022, the Judiciary issued Sole Source Contract No. 32200818/JUD-OC-2022-5 to Docomo Pacific for the Fiber OpticCable Installation and Configuration.The procured servicesare:
1. Two-year subscription to Fiber Internet 200 Mbpswith:
a. All glassfiber solution;
b. Symmetricspeeds; and
c. 200Mbpsdownload speed and 200 Mbpsupload speed.
2. Fixed BusinessStaticIP.
3. Fiber opticcabling installation and equipment configuration.
A kickoff meeting was held with the vendor on March 17, followed by an initial site assessment. Two additional site assessments were conducted on April 21st and April 25th.The modem switch was installed at the Information Systems Office on April 27,and then did the line work on April 28 and April 29 to prepare for the installation of the new fiber cables.
On May18-19,Docomo Pacificperformed the trench work and installed the fiber cables.It activated serviceson May 20th.
The total contract price is $48,000.00.Now that installation and configuration are complete,the Judiciary will make monthly payments of $2,000.00 based on the invoices received.The contract will remain in effect for two years and three months from the issuance of the Notice to Proceed.

On November 23,2022,the National Center for State Courts("NCSC") emailed FormsCampers(attendeesof the NCSCSummer FormsCamp) exciting newsabout Winter FormsCamp. Winter FormsCamp givesan opportunityfor NCSCstaff to provide intensive training and technical assistance to help courtsrevise one form or a small set of formsto improve plain language and readability.At the end of the camp,the formswill be redesigned,translated into plain language,and user tested.
Courtsfrom 50 U.S.statesand five territorieswere encouraged to submit an application.NCSCselected a small cohort to participate in Winter FormsCamp via a competitive application process.The Judiciarysubmitted itsapplication on December 12,2022.

Bocago attended the FY2023 Administration for Native Americans("ANA") Grant Pre-Application Training held at the Hyatt RegencyHotel.ANAfocuseson building stronger Native American communitiesand supporting communitydevelopment that help these communitiesachieve self-sufficiency,aswell as cultural and language preservation.
ANAprovidesdiscretionarygrant funding for community-based projects,training,and technical assistance in three program areas:
1. Social and Economic Development Strategies;
2. Native Languages; and
3. Environmental RegulatoryEnhancement.
ANAbelievesa community-based planning processshould be used to develop projects.The two-daytraining revolved around the following keypoints:
- Understanding the ANANotice of Funding Opportunity and eligibilityrequirementsfor applying;
- Writing an application narrative;
- Completing required Federal formsand packaging the application; and
- Submitting an application through Grants.gov.

FEATUREI Law and the Freshman Legislator
The Supreme Court announced that it will host the 10th Biennial Law and the Freshman Legislator Seminar in earlyJanuary 2023. Bench memberswill give several presentationsto the newly-elected membersof the Commonwealth Legislature.There are nine newly-elected legislators- one senator and eight representatives- that have been invited to attend the program at the Guma' Hustisia.
The program includesa lecture of the Covenant,the CNMI and U.S Constitutions,an overview of the judicial process,adiscussion of the common law,a presentation on legal research,and a roundtable discussion between newlyelected representative and local and federal judges.
