On March 11,2021,President Joe Biden signed the American Rescue Plan Act,a $1.9 trillion stimulusbill to aid publichealth and economicrecoveryduring the CoronavirusDisease 2019 ("COVID-19") pandemic.The plan included $350 billion in emergency funding for states,territories,and tribal governments:
- to respond to the publichealth emergencywith respect to the COVID-19 or itsnegative economicimpacts,including assistance to households,small businesses,and nonprofits,or aid to impacted industriessuch astourism,travel and hospitality.
- to respond to workersperforming essential work during the COVID-19 public health emergency byproviding premium pay to eligible workersof the State,territory,or Tribal government that are performing such essential work;
- for the provision of government servicesto the extent of the reduction in revenue of such State,territory,or Tribal government due to the COVID-19 public health emergency relative to revenuescollected in the most recent full fiscal year of the State,territory,or Tribal government prior to the emergency; or
- to make necessaryinvestmentsin water,sewer,or broadband infrastructure.
On May24,2021,Governor Ralph DLG.Torresannounced at the Judiciary'sLaw DayProclamation Signing Ceremonyhis commitment to give the Judiciary$10 million in ARPAfundsand potentiallyanother $10 million in March 2022.
The Judiciary'stop prioritiesto respond to COVID-19 include sustaining judicial serviceson Saipan,Tinian,and Rota; retrofitting and improving facilitiesand infrastructure to prevent the spread of COVID-19 and allow for social distancing,and enhancing technologyfor remote hearingsand services.
Thisreport outlinesthe expendituresand activitiesunder ARPAfor the month of September.Historical data and information can be found in the Appendix.
Revised SpendingPlan No. 4
On September 7,2022,the ARPAcommittee finalized Spending Plan No.4 in the amount of $13,160,703,and transmitted it to the Department of Finance on September 12,2022.The plan isin line with the U.S.Department of the Treasury'sFinal Rule issued on January6,2022.
The Judiciarywill continue to use ARPAfundsto respond to the COVID-19 pandemic,including sustaining judicial serviceson Rota,Tinian and Saipan,and building,retrofitting and improving infrastructure.
The Plan includesreprogramming of fundsfor Personnel and All OthersExpendituresincluding Professional Services, Repair and Maintenance,Cleaning Services,Licensesand FeesTechnology.The Plan estimatesexpendituresof $5.1 million in Personnel and $8 million in All Others.
Asreported in the Judiciary?spreviousspending plans,asubstantial amount of the fundsisallocated to the Judiciary Data Center/Guma?Hustisia Annex.The Data Center,which isnow at the A&Econceptual planning phase with consultantson board,will provide a secure environment for the Information SystemsOffice,including the Judiciary?s telecommunicationsand computer systems.The Judiciarymayfind it necessaryto request additional funding for the projects.
Arevised Spending Plan No.5 isforthcoming to reflect changes,aswell asto make adjustmentsin other sub-accounts. See Exhibit Bfor09/07/22 SpendingPlanNo.4.
The Committee continuesto meet biweekly to addressany developing needs,discussfinancials,and provide updates for anyongoing projects.Meetingsare continuouslyconducted in-person at the assembly hall at the Guma' Hustisia while staff from Kotten Tinian and Rota Centron Hustisia and teleworkerscontinue to participate remotelyvia MS Teams.In September 2022,there were three committee meetingsand four leadership meetings.The Capital Improvement ProjectsCommittee meet biweeklyeveryother Thursday.The sub-committee did not hold any committee meetingsbut instead,a kickoff meeting washeld for the On-Call Architectural and Engineering ("A&E") Consulting Serviceson September 23,2022.See page 20 for moredetailsregardingtheOn-Call A&Econtract.

In September, the Judiciary completed a series of Enterprise Asset Management ("EAM") trainings conducted by Tyler Technologies Implementation Consultatnt Kimberly Murdock. On September 23, 2022, the Judiciary was authorized to proceed with EAM's Go-Live.
However, before proceeding with the use of the systems, an internal EAM training is scheduled for October 3, 2022, for all Judiciary staff involved with EAM.
What is EAM?
*Enterprise Asset Management ("EAM") is an enterprise solution by Tyler Technologies designed to help public sector organizations achieve both tactical, short-term and strategic, long-term goals by leveraging connections to financial, planning, incident management, and customer-based data to streamline work processes and quantify the asset value.

Human Capital Management ("HCM") isa module within Munisthat streamlinesthe entire employee life cycle from job vacancyannouncement,to hiring and retirement.HCM automatesthe hiring process,streamlinesemployee information management, allows accessibilityto a centralized view of employee data,managescareer tracks, automatesemployee expense reimbursements,managesrisksbefore it becomesa crisis,and simplifiesdata analyticand reporting.HCM replacesJD Edwardsasthe CNMI'sHRsystem.All personnel actionsand payroll will be processed through Munis.

Timekeepersbegan entering data in Munisfor PayPeriod 20 ("PP"),beginning September 11,2022,through September 24,2022,and completed bySeptember 29,2022.Paychecksfor thisPPwill be processed on October 7,2022.
The HCM portal isscheduled to go live on September 26,2022.See Exhibit A.4 for details.
The Judiciary,in collaboration with the Department of Finance ("DOF"),conducted a mandatoryMunisEmployee Self Service ("ESS") Training at the Guma' Hustisia Assembly Hall.Two sessionswere offered to accommodate variousschedules.The DOF'sOffice of Information Technology's("OIT") Enterprise Software Engineer Henry Z.Cepeda led both trainings.Eighty-three employees attended both sessionscombined.
The ESSportal allowseach employee to update personal details,review company policies,document absence and manual leave, and retrieve payroll,timetablesand benefitsinformation.It also allowsmanagersto keep track of employee leave and attendance, progressand daysoff.
Ausername and temporarypassword wasprovided to each employee for the initial log-in.Once logged in,the employee is prompted to change his/her password.For securitypurposes,passwordsare changed everythree months.
OITheld Government-wide ESStrainingseveryThursday throughout the month of September.
The ESSportal went live on August 1,2022.See Exhibit A.4 for details.
On September 19,2022,Commonwealth Recorder Kelsey G.Aldan conducted a training on indexing data aspart of the E-Recording Project.Data indexing involvesauditing file information,such asfiling date,grantor,grantee,lot number,village,island,and instrument type.The information will be imported to the new electronic recording system which isset to launch on October 27, 2022.

On June 4,2021,the Office of the Governor awarded $13,160,703.00 in ARPAfundsto the Judiciary.ByDecember 31, 2021,the allotment wasreceived in full.
The total expensesobligated in Fiscal Year ("FY") 2021 amounted to $459,521.00. In FY2022,the total expenses obligated asof September 30,2022,were $3,949,921.98:
- $2,932,578.25 in Actual Expenditures(meaning service wascompleted,invoice wasreceived,and payment was made) and
- $1,017,343.73 in Encumbrances(meaning the contract and/or purchase order wasprocessed but either the service,invoice,or check ispending.
The fund statusasof September 30,2022 was $8,751,260.02.

Implementation of a NewFinancial Management System
On October 1,2021,the Department of Finance ("DOF") implemented Munis,a new financial management system by Tyler Technologies. Operational costsare processed on Munisasof thisdate.Personnel costscontinue to be processed on the JDEdwardsSystem ("JDE") while payroll and related employee information are migrated to Munis.It is anticipated that personnel costswill be fullyprocessed on MunisbySeptember 2022.
JDEwill be phased out assoon asall the information istransferred to Munis.Asof September 30,2022,one payperiod remainspending to be inputted on Munis.Currently,DOFinputspayroll data,but beginning October 1,2022,Muniswill launch it'sHuman Capital Management platform.Each branch,department,agencyand division will be responsible for managing employee data including contracts,Notice of Personnel Actions,and time and attendance.
In September,Budget and Finance Director John T.Villagomezinformed the DOFthat several per payperiod expenses did not match the Notice of Personnel Actions.ARPAwasnot being charged accurately,and instead chargeswere being made to local accounts.Thus,Mr.Villagomezsubmitted a Journal Voucher Request Letter for DOFto make the necessary adjustments.The adjustmentswere made and reflected in the narrative above and tablesbelow.

On September 1,2022,the Judiciarycontinued to re-announce ten Job VacancyAnnouncements(JVAs)- ARPAInformation Systems Assistant,FamilyCourt ServicesSpecialist,Law Clerk to Chief Justice,Law Clerk to Associate Justice John A.Mangloña,Law Clerk to Associate Justice PerryB.Inos,DeputyClerk I,Probation Officer I,DeputyMarshal I (Tinian),Special Assistant to Presiding Judge,and Administrative Officer.Three of these positionswere filled within the month- Law Clerk to Chief Justice on September 5,2022, Probation Officer I on September 20,2022,and Administrative Officer on September 21,2022.
Three JVAswere internallyannounced- Executive Assistant,DeputyMarshal I and DeputyClerk II. The DeputyClerk II position was announced externallyon September 26,2022,after no internal applicationswere received.See Table 15 for JVAlisting.
During thismonth,the Judiciaryprocessed six Notice of Personnel Action ("NOPA").Thisincludesrenewals,change of account,and new and internal hires.See Table 14 for ARPA-fundedPersonnel ActionListing.
On September 2, 2022,Chief Justice Alexandro C.Castro issued a memorandum designating DeputyGeneral Counsel Matthew J. Brown asActing General Counsel.
Similarly,Presiding Judge Roberto C.Naraja issued three additional memoranda designating the following:
- CommunitySupervision Officer Frankie B.Camacho asActing Drug Court Manager (September 13 - September 15,2022);
- DeputyClerk III Novelyn A.Wania-Tenorio asActing Clerk of Court for the Superior Court (September 18 - September 24, 2022); and
- Chamber Administrator Lynette M.Camacho asSpecial Assistant to the Presiding Judge (September 30,2022 until filled).
ARPAAdministrator Martha M.Standish continued to serve asActing Procurement Officer for the month of September.Although the position wasfilled byJuan D.Cruzon August 8,2022,Ms.Standish will continue to serve asActing Procurement Officer during Mr.Cruz'sprobationaryperiod.
For audit purposes,personnel who hold ARPApositionsare required to submit a DailyWork Summary outlining the tasks performed.See Exhibit F for detailsincludingJVAs,Memoranda,NoticeofPersonnel Actions,Timecards,andDailyWorkSummaries.

On September 5,2022,the Law Clerk to Chief Justice position wasfilled by Patrick C. Quimby. Thisposition is18%ARPA-funded.Hisdutiesinclude assisting in the evaluation of casesfiled with the Supreme Court,which includesreviewing court rules,drafting and editing proposed ordersand opinions,and discussing pending caseswith the Chief Justice.Primary responsibilitiesinclude,but are not limited to:
- Prepare bench memosin advance of oral arguments,including reviewing the case record,conducting legal research,summarizing important factsand arguments,and providing a recommendation on disposition;
- Confer with Chief Justice on pending matterssuch asapplicationsfor leave to appeal, conference items,opinions,and orders;
- Prepare draft opinionsand peer review opinionsand ordersprepared by other clerks; and
- Performing other dutiesasnecessary.
On September 20,2022,the Probation Officer I position wasfilled by Timothy L. Cruz.This position is20%ARPA-Funded and will work under direct supervision of the Chief Probation Officer or his/her designee.The Probation Officer I'sdutiesand responsibilitiesinclude the following:
- Perform all assigned dutiesrelate to court-probation casesunder probation administration and operation assignment;
- Interactswith the court and law enforcement officials,healthcare providers,the probationer'semployersand/or relation,and other pertinent agencies;
- Appears,reports,and articulatesthe probationer's' statusat scheduled court hearings;
- Investigates,and assessesthe probationer's' personal historyand background upon court'sorders;
- Assistsin the conduct of procedure in the courtroom during court sessions; and
- Perform other dutiesasassigned.
On September 21,2022,the Administrative Officer position wasfilled by Shanna W. Flores.This position is100%ARPA-Funded and will work under the direct supervision of the Budget and Finance Director or his/her designee. The Administrative Officer'sdutiesand responsibilities include the following:
- Compilesand monitorsthe list of office equipment,items,and inventorysupplies purchased; and ordering replacement suppliesasneeded;
- Creates,updates,inputs,and maintainsrecordsand databasesrelevant to finance, procurement,personnel,time-keeping,accounting and other administrative items;
- Assistsin coordinating meetings,sending calendar invites,and communicating with Judiciarystaff and other government agenciesasit relatesto Budget and Finance Office;
- Provide standard administrative support for designated projectsasassigned by the Director of Courtsor their designee; and
- Performing other dutiesasnecessary.
The MarshalsService Division ("MSD") continuesto enforce COVID-19 protocolsthroughout the three courthouses.MSD'ssafety protocolsrequire an accounting of the number of patronsentering Judiciaryfacilities. Recorded entriesfor the period of September 1-30,2022 show:
- Guma' Hustisia had 4,129 entriesat the courthouse including the alternate worksite,which include patrons,vendors,and employees.
- Kotten Tinian had 190 entriesat the courthouse which include patrons,vendors,and employees.
- Rota Centron Hustisia had 392 entriesand thisincludespatrons,vendors,employees,and tenants.

ARPAScanning Clerkscontinue their tasksof scanning documentsdailyusing the scannersthey received and maintain with the help of the Document Digitization Internal Operation Procedure which isdesigned to establish guidelinesfor digitization.
During the month of September 2022,ARPAScanning Clerks scanned and audited voluminousfiles:
- Tracy D. Limes and Leonora T. Vergara of Guma' Hustisia scanned 40 files(consisting of 2,716 pages) and audited 748 files.
- Jan Christin S. Cabrera of Kotten Tinian scanned 316 files(3,433 pages) and audited 286 filesequaling 3,165 pages.
- Elvira M. Mangloña and Micca B. King of Rota Centron Hustisia scanned 280 files (12,535 pages) and audited 205 filesequaling 8,460 pages.
In addition to scanning and auditing,disposition of filesis also in progress.Once enough filesare collected and approved for disposal,theyare scheduled for disposition. The Commonwealth Recorder'sOffice,Administrative Specialist I HollyC.Camacho continued to audit in September.However a written report wasnot submitted by September 30,2022.The data will be provided in the next reporting period.
Similarly,for the Office of the Superior Court,Data Systems Analyst | Mark G.Hidalgo provided the following statistics:
- Mark G. Hidalgo of Guma' Hustisia audited 1,683 files (13,457pages) and digitized 73 cassette tapes.
For the month of September,no fileswere disposed.Once a sufficient number of filesare collected and approved for disposal,disposition will be scheduled.

In August,HBRworked on phase one of Room #151 - MensPublicRestroom First Floor and Room #178 - Women'sPublicRestroom First Floor. For the month of September, HBRworked on phase one of Room #203Men'sPublicRestroom Second Floor and Room #218 - Women'sPublic Restroom Second Floor.
Progressreportswere provided throughout the month.And the Judiciary also approved the following submittal:
- JUD_21_012_Scott Control Slimroll ElectronicTowel Dispensers.
The contract expireson November 4,2022. The project isexpected to complete in January2023.

Contract No. 32201275/JUD-OC-2022-13 | GUMA Architects, LLC
On August 8,2022,a Sole Source Request wasapproved bythe Office of Procurement.Then on August 30,2022,a contract wasrouted and awarded to GUMAArchitects,LLC("GUMA") in the amount of $635,000.00.
On September 8,2022,a notice to proceed wasissued.
Data Center and Annex
On September 20,2022,a request for quoteswassolicited for A&Edesign for the construction of a 2,500 sq.ft.Data Center and Annex at the Guma' Hustisia,Iimwal Aweewe,House of Justice in Susupe,Saipan.
The concept for the Data Center and Annex isasfollows:
- 1,500 sq.feet for data center (vault and ITemployee space);
- 1,000 sq.feet annex which includesa bathroom,large windowstowardsthe ocean view,multiple outletsand lights;
- Asmall corridor connecting thisaddition to the Guma' Hustisia;
- Thiswill be on the north side of the existing building and have an approximate areaof +/-3,380 sf which isanticipated to have a net usable space of +/-2,535 sf; and
- The data center and annex 'sstructure will be feasible for constructing a second floor in the future.
The contractor submitted their proposal on September 20,2022.Asa result,task order no.JUD-2022-TAO-001 wastransmitted to GUMAon September 22,2022,and fullyexecuted on September 26,2022.On September 23,2022, a kickoff meeting washeld to discussGUMA's proposal.Astatusmeeting isscheduled for October 14,2022.
In September,the committee conducted four internal meetings and held four external meetingswith the contractor. TriMin held training(s) with subcontractor TurnKey Solutions,LLC,with the intention of TurnKeyconducting trainingslocallywith the Commonwealth Recorder'sOffice.On September 19th and 23rd, TurnKeytrained Commonwealth Recorder KelseyG.Aldan on reviewing,and then approving or rejecting documentsthat are filed for recording and for indexing the documents.Then,on September 27th and 30th,Administrative Specialist I HollyC. Camacho wastrained on similar processesand standard operating proceduresafter documentsare indexed.See Table 14 for meeting dates.
On September 30,2022,a pressrelease wasissued announcing the Judiciarynearing the launch for the E-Recording Servicesfor Land Documents.
Go-Live date for the E-Recording System wasinitiallytargeted for September 27,2022,but isnow set for October 27,2022.
Additional training between the Commonwealth Recorder'sOffice and TurnKey Solutions,LLCisset for October,before the Go-Live date.

Biba Marianas,LLCbegan serviceson April 22,2022,and continue to provide janitorial servicesand all equipment and productsnecessary to complete itsgiven tasksin a timelymanner.Servicesare provided to the following Saipan locations:

2. MarianasBusinessPlaza;
3. Office of Adult Probation Supervision Satellite Office;
4. JCTBuilding II Unit 6;
5. Karidat; and
6. Other alternate sitesfor the Judiciary.
Thisisa one year contract which expiresApril 22,2023.
On September 27,2022,ARPAAdministrator Martha M.Standish, along with Procurement Officer Juan D.Cruz,met with Biba Marianas' Accounting Staff Vann A.San Diego to discussa cleaning approach for the newlyinstalled micro-cement flooring in designated areasof the Guma' Hustisia restrooms.Aneutral soap isrecommended for cleaning micro-cement.After conferring with their supplier,Biba Marianaswill utilize the cleaning product Fabuloso
Contract No. 32201083/JUD-OC-2022-10 | Tano Group, Inc.
In September,Tano Group,Inc.concluded the painting of designated interiors.Ameeting and walk-through was conducted on September 21,2022,to discusspunch-list itemsfor thisproject.Once these itemsare addressed,the project will be complete.

Purchase Order No. 22216659 | HBR International, Inc.
On July7,2022,the Judiciarysolicited quotationsfor the demolition of existing awningsand polesand construction of two new awningsin the secured parking area of the Guma' Hustisia.The scope of work includesthe following:
- Removal of existing awnings;
- Construction of a new typhoon-proof awning:
- Awning shall be white tin with fascia;
- Construction an additional new typhoon-proof awning,with an approximate size of 4x6 feet;
- Disposal of scraps,metals,debris,and any trash in accordance with applicable and local lawsand regulations;
- Completion of the project within 45 daysfrom the date Purchase Order isissued;
- Vendor shall provide anything necessaryand incidental to complete the project,including personnel,tools, safetysensitive gear, materials,and transport;
- Warrant the project to be free from defectsin materialsand worksmanship for at least one year from the date of project acceptance; and
- Demolition work shall be provided between 7:30 a.m.and 4:30 p.m.,Monday through Friday.

On September 8,2022,the Judiciary met with Secretaryof Finance ("SOF") David DLG.Atalig. Itemsdiscussed during the meeting include,but were not limited to, the pending replenishmentsand paymentsfor the Judiciary'sHVACand Mold Remediation Project,funding for the Fire Alarm and Sprinkler System Replacement Project, ARPASpending Plan No.4, aswell asthe ARPAmonthlyreports.SOFAtalig commended the Judiciary and itsARPAteam for timelyand comprehensive reports.The Judiciary highlighted discussionsregarding Spending Plan No.4 where a substantial amount of the fundswill be dedicated to build a new DataCenter Annex to house the Information System Office'stechnologyequipment and servers.

On September 22,2022,Acting Chief Justice John A.Manglona issued a memo regarding Change in Domain Name from .com to .gov.The Judiciaryregistered itsdomain name with the DotGov program where onlyU.S.-based government and publicsector organizationsmayobtain a .govdomain.The domain issponsored bythe Cybersecurityand Infrastructure SecurityAgency. Administered through provisionsof the federal DOTGOVAct of 2020,the domain allowsrecipientsto recognize mail transmissionsand website platformsasofficial.The domain ensuresuse of secure servers,and multifactor authentication is enforced for all accounts.
On October 1,2022,the Judiciary'sdomain name for e-mail accountswill change from NMIJudiciary.com to NMIJudiciary.gov for all registered users.SystemsAdministrator Michael C. Villacrusiswill assist in migrating historical e-mail and forwarding new e-mail to the new domain asa result of the transition.
Staff were instructed to notify all contactsregarding the transition.
Between September 1-26, 2022, there were 24 confirmed positive cases.
