PM writes letter to students who won national title TIM KELLY tkelly@yrmg.com Four students from Markham’s Pierre Elliott Trudeau High School became the first York Region school to win the York University Cup as Canada’s top programming team in the country. Not only that, but they received a letter from the son of their school’s namesake too. Prime Minister Justin Trudeau sent Jason Yuen, William Wen, Nathan Lo and Kevan Pan, coached and supervised by teacher Jordan Cohen, a personal letter congratulating them for solving four complex programming problems in under three hours. "Your success is not only a reflection of your hard work and programming skill, but is also illustrative of your dedication to team

Ombudsman’s recommendations require response

The last place in the world you ever want to see a loved one is in the hospital. Nobody likes being there, but we’re ever so grateful we have use of them. We all would hope a hospital stay would be short, that what ails you would be fixed, that you would be on the mend and on your way with nothing but positive thoughts about your care. But that’s not always the outcome. Some patients leave hospital with less than stellar reviews of the care they received. That’s why the patient ombudsman role was created by the provincial government in Dec. 2015. Christine Elliott earned the job so she would act as a bridge, connecting and working with patients, caregivers and health-sector organizations to improve care and the patient experience. It would also help bring the patient voice to the attention of public policy and decision-makers. To say Elliott is busy would be an understatement. To date, her office has received nearly 1,500 complaints from various geographic locations and across each of the different health sectors. Elliott said her staff strives to respond to each and every complaint. "By the time people come to our office, they’re pretty angry. "They’re frustrated; they feel as if nobody’s been listening to them, that they haven’t had an opportunity to tell their true story and they want to connect with someone who can help process their complaint." One of the biggest complaints Elliott’s come across is the inability to discharge patients into long-term care because there aren’t enough spaces. As the population ages, this problem will only become worse unless more long-term care homes come on stream. As part of Elliott’s mandate, it’s within her purview to investigate a health-sector organization and make recommendations. Elliott’s first report to the minister of health and long-term care will be released in September. We hope the provincial government takes Elliott’s recommendations seriously and acts upon them. Elliott was put into this critical role because she’s shown herself to be a tireless advocate for people. Given the number of complaints her office has dealt with so far, she’s been kept very busy. It will be in the province’s best interest that Elliott not remain this busy. The government has a duty to act on her recommendations, whatever they may be, and to fix what’s wrong. It will be interesting to hear what Elliott has to say in September, but also how the province responds to what she says.

• LETTERS & COMMENTARY • Train schedule disappoints Re: All-day GO train service extended to Unionville on Stouffville line, June 7. I read with excitement the news about additional trains being added on the Stouffville GO line in both directions to and from Toronto, but today I took a look at what the schedule is going to look like and I’m very disappointed. Markham currently has a robust GO bus schedule, with buses going to and from Toronto very frequently throughout the day. Right now I can catch a GO bus at the Centennial stop approximately every 30 minutes and buses back from downtown run even more frequently. With the new "improvements" I will be able to catch

a bus at Centennial once an hour - and have to transfer to a train at Unionville. Needless to say I’m very disappointed that the one transit system that was efficient and convenient in Markham is now going to become as useless as the regional transit systems already in place. How anyone thought replacing frequent bus service with infrequent train service was an improvement I will never understand. Beth Sheridan Markham

ing of Kennedy Road to solve congestion issues that will come from the York Downs development. For my undergraduate thesis, I studied various solutions to traffic congestion. In theory and in practice, widening roads has never been a good solution to traffic congestion. It may be a short-term fix, but in the long term it just encourages more driving to the point where the road is congested once more. Widening the road is also not the best solution because it ruins the atmosphere for pedestrians. Wider roads make pedestrians feel less safe and the additional sound doesn’t make for a nice environment. It is good that the developers are acknowledging the impact on traffic, but they are passing off the responsibility for solving it to

the city. To me, it seems simple: either the development should be more sustainable in itself and somehow encourage less driving (possibly by creating a transitcentred design), OR this development should not occur at all. If it has been shown that the area cannot support the number of residents, then how is the city approving this? Residents are, and have been experiencing the effects of decades of irresponsible residential development, notably in terms of congestion. It is time to make smarter, sustainable decisions for the City of Markham. We should be building innovative, mixeduse developments that have minimal impacts on the environment. V. Rudiak Markham

Bruce Payton sees a beaver in a Maple Leafs jerseywearing a Blue Jays hat and holding a goalie stick. Say what? The 57-year-old former Duchess of Markham bartender, now a full-time woodcarver, makes his living turning pieces of wood into art. And his latest masterpiece is a doozy. Carved for the CEO of Weins Canada, who went to Japan to present it there, the wooden sculpture features the Leafs beaver decked out in all its finery. There’s a squirrel wearing a Raptors jersey too. The Markham resident didn’t know he had carving in him until he just began doing it one day a few years ago. "I had been bartending and after my mom passed away, I decided to do a Gandalf carving since she was a big Lord of the Rings fan," he said. It took him 80 hours using a chainsaw and other carving tools to make the beaver carving, which is made of white cedar. He said at 57, "I took a risk and followed my dreams." These come from the mussel farms on the North Coast of P.E.I and are in 2 pound bags. I feel a lot of people don’t know how to handle mussels at home when they are in fact the easiest thing to cook and make for a fun appetizer when serving a crowd. Easy to cook up with your favourite red sauce or with white wine and garlic, but I start mine with taking one of our chorizo sausages out of its casing, sautéing its meat with onion and garlic before adding a cup of a dry white wine, the juice of half a lemon, some parsley and then adding the mussels and letting them steam in all that mouthwatering goodness. WILLS AND ESTATES FREQUENTLY ASKED QUESTIONS The Wills Lawyer 1. Dad died and I am positive that my brother had borrowed money from him and never paid it back. How do I prove it? Is it deducted from his share? Proving that this debt is still outstanding may be difficult, especially if the matter has to go to court. Without hard proof, it will be your word against his. Hopefully, Dad kept a record of the money he lent him, supported by a promissory note or other evidence of debt. If there is evidence of the debt, the court might look to your brother to prove that he paid the money back to your Dad. Generally, debts owing by a beneficiary to the deceased have to be repaid or else they can be deducted from the share of the estate going to that beneficiary. Les Kotzer 2. I am co-executor of Dad’s estate with my uncle. leskotzer.com We cannot agree on what to do with the estate, and in the meantime, the estate assets are declining in value. What do I do? Executors must act together, unless the Will says otherwise. If there truly is a deadlock, you may each need your own lawyer. If the matter is incapable of being resolved and court proceedings are initiated by one or the other of you, the court may have to decide the matter. The court may order that one or both of you be removed and might even order that you or your uncle be replaced by a neutral person or financial institution. 3. My Mom appointed me and my brother as “joint and several” powers of attorney. I don’t trust my brother. How do I make sure that he can’t do something with Mom’s money behind my back? Being appointed “severally” means that each of the “attorneys” appointed in the Power of Attorney can act on his or her own without the consent of the other. It would be a good idea to notify the banks and request that they advise you of any transactions made by your brother. As an “attorney”, you are entitled to have information about the account. Writing to your brother suggesting mutual co-operation is also a good idea. With this documentation, you will be able to show the court that you were trying to be reasonable. 4. Aside from receiving a copy of my sister’s Will, I have not heard what’s happening with the estate. When is it appropriate for me to contact the executor to find out the status of the estate? You have the right to contact the executor at any time. As a beneficiary, you are entitled to know the status of the administration of the estate and your sister’s assets. However, you must be realistic in your expectations. As a rule of thumb, you would be acting reasonably if you asked for a status report every three months or so, unless there is a situation that clearly makes this estate a special case. 5. My Dad left a note to me that he wants me to get his house. Is that valid? If the note was entirely in your Dad’s handwriting, dated and signed by him, it may be valid as a “Holograph” Will. If it was not signed, it is not a valid will. 6. Mom left instructions in her Will that she wanted to be cremated. My brother is the executor and he refuses to cremate her. Can he do that? Funeral or burial directions in a Will are not binding on an executor. As a result, your brother will have the final say on how to deal with Mom’s burial. 7. I am 65 and my new husband is 83. His kids think that I am a gold digger. How do I protect myself from his children when he dies? You better be ready for a fight. Children who are upset at their parent’s subsequent marriage, and whose inheritance may be substantially diminished because of that marriage, will often attack the new spouse on as many fronts as they can. They might even attack the validity of the marriage itself. You should be arming yourself with as much evidence as you can find to confirm that your husband knew what he was doing, including getting a mental capacity assessment, if possible. Documenting your life together is also a good idea. Pictures, cards and other tangible evidence of your relationship may help you. TIM KELLY tkelly@yrmg.com Markham council may have said no to an 11 p.m. GO Train but Transportation Minister Steven Del Duca said yes, and his vote counts far more. Del Duca made a statement in the wake of Markham council’s 12-0 vote to ask the province and Metrolinx to stop the 11 p.m. GO Train from coming through Markham until horns stop blowing next spring. Council voted on the issue Tuesday night deciding to send a letter to the province, Metrolinx and all Markham MPPs with its request today. "I know this (all-day GO Train service) is a big change for residents which can be disruptive at times and I can assure you that Metrolinx will do their very best to mitigate disruption. I also know residents are concerned with noise and we can tell you that Metrolinx is leading a number of proactive noise-mitigation initiatives," Del Duca said Wednesday afternoon in a statement. Del Duca said he also would work with his coun-

terpart in Ottawa, Transport Minister Marc Garneau to try to lessen the impact of train whistles. "In the meantime, we will continue to work closely with the City of Markham on train whistling through their exemption application to the Federal government," his statement concluded. Shanta Sundarason, who has led the group ’Stop the Horns’ to get whistlecessation in Markham, said about Del Duca’s position, "It’s unacceptable to expect the citizens of Markham to accept any more noise pollution than they had to accept before Monday (when the 11 p.m. train began." Several residents, Sundarason included, made brief presentations to council Tuesday night using recordings of train horns to make the point they don’t appreciate the sound waking them up after 11 p.m. "What is happening is unacceptable," said Ioulia Khadiyev of Markham, noting the trains run right by her home. "It is just sad... I have welcomed a new addition to my family and I don’t want to move. I don’t want to be forced to move.

There is no value in horns. Horns are not the solution. It is outdated. they have been terrorizing our hundred-plus houses for close to 28 years. We need the solution yesterday." Rosemary Lam, who said she has been in Canada the last 40 years, has been babysitting for her daughter’s five- and sixyear-old children and her son’s one-year-old. "The first time I stayed overnight, I almost fell out of bed because of the 5:30 a.m. horn. Now, 16 hours a day, every 15 minutes is too much to bear," she said. Lam said she was concerned about the thousands of children younger than 14 who she felt would be affected by train horns every day. "Enough time and money has been allocated to this issue... Why does it take so long to take action?" The City of Markham has planned to stop horns from blowing next spring at a cost of $6 million, with $4 million covered by the Region of York and $2 million by the city. Each municipality will pay to upgrade the crossings at roads within its jurisdiction.

ANDERSON, Donald Martin Passed away peacefully at home, on his own terms and surrounded by his family on Saturday, July 1, 2017. He was in his 81st year. He fought his battle with cancer the same way he lived - with courage, strength and dignity. Don was the devoted husband of Maris (MacPherson) for 54 years. Dearly loved father of Elizabeth and Bryan Todd, Michael and Marilena Anderson, Jane and Mark Alden, and Susie and Chris Leonard. Very proud Poppa of Kyle, Bailey and Mackenzie Todd; Lauren, Jack, Brett and Blake Anderson; Ryan, Tyler and Rachel Alden; Taya and Owen Leonard. Beloved brother of Marilyn Summerfeldt and brother-in-law of Jack MacPherson. Uncle of Donna, Greg, Gordon and Andrew. Predeceased by his parents Norm and Aileen Anderson and his grandson Justin Alden. Don was the founder of Don Anderson Haulage Limited and will always be remembered as a passionate, loyal and dedicated member of the trucking industry. Don started Anderson Haulage in 1960 with one truck. Over the next 55+ years his vision and leadership led him from the gravel industry to a company specializing in the movement of over-dimensional loads. Trucking was the love of his life. His employees and colleagues were like family. The continued support and dedication of his employees has been key to the company’s success over the years. In 2006, Don was awarded the Ontario Trucking Association Service to Industry Award, the highest honour bestowed on an executive member of the Ontario trucking industry. His unique character, genuine kindness and generosity will be greatly missed by all whose lives he touched. Don prided himself on being honest and fair to all those he encountered. A special thank you to Dr. Andrew Patterson and the many doctors, nurses and medical professionals who cared for Don during his illness. The family extends their gratitude to Dr. Alan Berger who treated Don’s macular degeneration for the past 12 years. In addition, we would like to thank Kevin, Helen, Stephanie, Dannie, Donna, John, Kathy and Melissa, for all their kindness and compassion in caring for Poppa this past year. Family will receive friends at DIXON GARLAND FUNERAL HOME, 166 Main Street N., Markham, on Thursday, July 6th from 2 to 9 p.m. and Friday, July 7th from 5 to 9 p.m. A Celebration of Don’s Life will be held on Saturday, July 8th at 11 a.m. at LE PARC BANQUET HALL, 8432 Leslie Street, Thornhill. DIVERS, Arthur Joseph July 21, 1947 - June 21, 2017 Passed away peacefully, surrounded by loved ones, after a brave 3.5 year long battle. Beloved husband to Lesley of 44 years and loving father of Michelle-Renee (Demitri). Art was predeceased by parents Rene and Cecile Divers. Brother to Paula (Jack), Lucien (Doreen), Diane (Garry) and Jackie (Sterling). Uncle to many cherished nieces and nephews. Born and raised in Laurier, Manitoba, Art never forgot his roots. He was an avid story teller, with a tale for everything, and relayed many memories of growing up on the family farm. Art graduated from the University of North Dakota in 1970 and joined the Canadian Wheat Board. In 1972 he joined Yamaha Canada Music and had a distinguished career until 2005. Upon retirement he obtained his Real Estate Licence and was one of the top producers in Canada with Royal LePage. Golf was his passion and he was a proud member of Emerald Hills Golf Club in Stouffville and The Club at Renaissance in Fort Myers.
