Too close for comfort?

RACHAEL WILLIAMS & IAN ADAMS RachaelWilliams@metroland.com iadams@simcoe.com A culture of secrecy exists among major rail carriers and the federal government regarding the transportation of hazardous materials, despite widespread demand for greater transparency. “There have been incremental changes along the way, but railways largely set the rules for themselves,� said Mark Winfield, York University professor and rail safety expert.

With the public bearing the risk of any potential disaster, that’s a huge problem, he noted.

That risk was never more evident than the 1979 Mississauga train derailment, where a CP Rail train skidded off the tracks on Mavis Road, causing the release of deadly chlorine gas, and forcing the evacuation of 250,000 residents.

Emergency responders determined there were hazardous materials on the train after the derailment occurred, but the cars were piled on top of each other and the identification placards were not visible. “They just saw the whole thing burning,� said Willson McTavish, lead counsel for the Grange Inquiry, which was formed under Ontario Appeal Court Justice Samuel Grange to investigate the derailment.

It brought to light the lack of knowledge about deadly chemicals passing through municipalities and the inadequacy of rail safety regulations.

The results of the Grange Commission were increased emergency management procedures, detailed chemical cleanup plans and improved safety of rail cars.

Fast-forward 34 years, when an unattended 74-car freight train carrying crude oil derailed in Lac-MĂŠgantic, Quebec, leaving 47 people dead and half of downtown destroyed.

This propelled a flurry of reaction from municipalities and the province calling for increased transparency on the shipment of dangerous goods. The Federation of Canadian Municipalities (FCM) rail safety advisory panel demanded the federal government equip and support local first responders and keep them informed of the type of dangerous goods being shipped through their communities. “Railways, transportation companies and federal, provincial and territorial agencies cannot plan for emergencies alone,� said FCM president Clark Somerville. “Municipalities play a key role as well.�

The only people in possession of the information are the municipality’s emergency responders, who are trained to look for the placard and identify the hazardous materials, then deploy a HAZMAT team if required.

Mark Ormond, assistant chief operations and communications for the City of Mississauga, said informa-

tion is more transparent now than in the past. Resources such as AskRail, a Smartphone app that provides first responders access to timely data about what type of hazardous materials a railcar is carrying, and CANUTES, the Canadian Transport Emergency Centre, have been steps in the right direction. “But the bottom line is trains loaded with dangerous goods still travel through the heart of the most densely populated communities in Canada,� said Mississauga Mayor Bonnie Crombie, who is fighting to divert freight traffic off the Milton GO Line and free up space for commuter rail.

In 2015, 144 rail-related accidents occurred involving dangerous goods in Canada. The five-year-average is 140.

Transport Canada, Ottawa’s transportation regulator, mandated rail companies to post the top 10 dangerous goods transported across each province.

Petroleum crude oil topped the list in 2015 for CN and CP, reporting shipments of 28 per cent and 29.2 per cent respectively. Other items included sulphuric acid, sodium hydroxide and ethanol-gasoline mixture.

Real-time data raises legitimate security concerns, Winfield noted, but more detailed aggregate data on a quarterly basis would give the public a better sense of what is crossing through their communities. “It’s a culture of nontransparency. They (rail companies) don’t want to panic the public. Yet, it’s the public being exposed to the risk by the movement of materials.�

Rail remains the preferred method to transport dangerous goods for this very reason - lack of oversight, critics argue. “Trucks, on the other hand, get stopped all the time,� Winfield said, including at inspection sites on the highway and at the border.

The most recent available data was from a 2012 Statistics Canada survey which found over 107 million tonnes of goods moved by truck that year were dangerous materials. “With four million more people coming to the Greater Toronto Area (GTA) in the next 25 years, the situation will grow more urgent,� noted Crombie.

And with Canada’s transportation network the backbone of the national economy, appropriate policies with improved safety measures regarding the movement of hazardous goods are critical.

York Regional Police announced they have not only recovered the remains of Markham’s Ying Chun (Annie) Li, but have also seen the main suspect plead guilty to manslaughter.

The story stumped many when it first occurred, after yorkregion.com published texts between Li and her father detailing the moments leading up to her disappearance. Li, 36, was last seen June 12 at 6 p.m. near Denison Street and Markham Road, with surveillance images showing her departing the Yu Garden restaurant at Bayview Avenue and Hwy. 7, followed by an unidentified

male.

At 11 p.m. that same day, Li wrote her father the following text: "Papa, I will be back home tomorrow morning, you and mom have a nice sleep." Eight minutes later, her father replied: "Good, I just came home from exercise."

He writes to her the following day just after noon: "When will you come home?" and then, two hours later, he wrote: "Why haven’t you replied? Because you are at a construction site is the signal that poor?"

Li’s brother, Jeff, explained how worried their family was, noting he couldn’t focus on work knowing his sister’s whereabouts were unaccounted for.

Jeff added that his senior citizen father was spending part of his time riding his bicycle around

the city looking for his daughter.

Li’s family members also suggest at 5 a.m. on June 14, the family used the tracking device on Li’s iPhone to discover the phone was at Sheppard Avenue and Don Mills Road and, by 8 a.m., it was at Fairview Mall, before finally it went dead.

On Sept. 1, Jiarui (Jerry) Tang, 21, from Toronto, was arrested and charged with manslaughter.

Then, on Jan. 6, police found Li’s remains near Yonge Street and Sheppard, in Toronto.

Tang, who pleaded guilty that same day, is to be sentenced Feb. 1.

Information, funding needed for rail safety Rail carriers are working under a shroud of secrecy, putting Ontarians at risk every day.

Information regarding what hazardous materials are shipped through our communities remains elusive. At any given moment, emergency responders and local governments have no idea what, exactly, is being transported through municipalities across the province. Yet they are the ones tasked with keeping the populace safe in the event of a disaster.

The continued secrecy is putting the public at unnecessary risk and it is not a theoretical risk. The danger is very real.

In 2015, 144 rail-related accidents occurred involving dangerous goods in Canada. The five-year-average is 140.

One need only look to the disaster at Lac-Megantic to see how very real and devastating such disasters can be. When the unattended freight train derailed, it left 47 people dead and half of the community’s downtown destroyed.

That train had previously passed through the densely populated GTA. The disaster prompted renewed calls from municipalities and the province for increased transparency on the shipment of dangerous goods.

There have since been improvements to informationsharing, but has it gone far enough?

Emergency responders in municipalities have access to historic data of what has come through their community.

From that they can undertake disaster planning.

The burden - and cost - of preparing for these potential disasters falls squarely on the shoulders of municipalities.

Not only must our towns and cities prepare without knowing when, how often and what materials companies are transporting, they must also find a way to pay for managing the dangers these private rail carriers pose.

For security reasons, real-time information is not available. And what information is shared with select municipal officials is not intended to be shared with the public. No one wants to tip off a potential terrorist about the exact location of specific chemicals. And the rail carriers don’t want to panic the public.

Not only are emergency responders faced with a lack of information, the public remains largely in the dark about what dangerous goods are rolling through their communities.

This culture of secrecy does not allow residents to make informed decisions or adequately prepare for possible disaster scenarios.

More information is needed. The public needs to have general data regarding what is regularly transported through their backyards. Municipalities need more up-to-date information about what dangers their first responders might have to battle. And those first responders need adequate funding to defend against the worst case scenarios.

Rail lines are an important part of this country’s economy, but the dangers they pose need to be better managed. It shouldn’t take another Lac-Megantic to bring about these much-needed reforms.

More action needed to prevent cold, flu Re: Flu cases rising as virus moves cross-country, Jan. 13.

It’s once again cold and flu season across Canada, and viruses are spreading quickly. While flu shots and proper handwashing are important, it appears that more needs to be done by residents and public health agencies.

As one of the most diverse municipalities in the country, there is no shortage of Asian restaurants in Markham serving delicious foods. With the use of chopsticks and communal food, this creates the perfect environment for viruses and bacteria to thrive and spread.

Often, people carry viruses without knowing it.

MPP’s gas tax comments questioned After reading MPP Chris Ballard’s comments regarding the $15.3 million the region is to receive from the provincial gas tax, "Better transit helps improve the region’s economy" and "We appreciate every dollar we get from the province

and the feds and we need more for us to enhance our transit system", I have a few questions.

I would like to know how taking $15.3 million dollars out of the hands of consumers and putting it toward funding the York Region transit system helps improve the region’s economy. Second, why does he appreciate the province for taking disposal income dollars out of the hands of consumers and not the taxpayers who are paying the tax.

Lastly, has anyone ever thought to get money for our transit system from the users of said transit system. I would think that would be the goal of any public transit system, a self-sustaining one.

Councillors get a glimpse of student housing for York U AMANDA PERSICO apersico@yrmg.com Student housing has come up again and again, especially in light of the city’s ongoing basement apartment and rooming house debate.

Markham’s York University Campus committee got a glimpse of what modern student housing looks like - and it’s not an influx of basement apartments.

And gone are the days of a two students sharing a room in a building.

"Talking from personal experience, students today are a lot more sophisticated now in terms of what they are looking for," said Mayor Frank Scarpitti.

Committee members heard from Henry Morton of Campus Suites, a private student living development company.

Campus Suites is working on a student living building, the Quad at York, providing about 2,220 beds in a variety of apartment options and a parking structure, which is set to open in June.

Campus Suites has been in contact with landowners in the downtown Markham area near where the York U. Markham campus will be located.

"We’ve all seen unmanaged student housing, student ghettos," he said. "When done properly and thought out, this

becomes the place to be because the people want to be here."

While shared accommodation makes up between 5 and 10 per cent of units available, the new wave of student housing is more like an apartment, featuring one, two or four bedrooms with one or two bathrooms and a living room and kitchen.

The fully-furnished apartments come complete with high-speed Internet and smartlocks as well as common lounge, study and fitness areas in the building.

"This group of 18- to 26-year-olds have specific ideals of their workliving space," Morton said. "They want to have areas to study and cook, places to meet and workout."

Thinking about student housing this early in the game ensures the right kind of building for both students and the city, Morton said.

Councillors also heard from Angelo Belcastro, executive director of Markham Centre Campus, on the progress of the new Innovation Centre in Markham, located on the second floor of 169 Enterprise Blvd.

The 8,000-square-foot space is expected to be up and running in late spring or early summer and will house entrepreneur training sessions, space for startup companies and a youth area.

Racial slur should be cause for trustee dismissal: parents TERESA LATCHFORD tlatchford@yrmg.com Parents are calling for the resignation of York Region District School Board trustee Nancy Elgie.

The Georgina trustee was recently the subject of an investigation into calling a black mother the Nword. Following the conclusion of the investigation, Elgie emailed apologies to all of the parties involved.

However, a petition of more than 1,000 signatures is calling for her resignation points to parents believing a letter is not enough.

"If YRDSB has a zerotolerance policy for discrimination, how can they allow Ms. Elgie to represent them?" the petition states. "Thus, we are calling for the immediate resignation of Ms. Elgie for her violation of (policy 240), her complete disrespect of a Black parent and our community and her

blatant use of the racist and violent slur ’n-----’."

Newly appointed board chair Loralea Carruthers has heard the parents, but points out YRDSB staff and trustees don’t have the authority to make Elgie resign, not even under the trustee’s code of conduct mandated by the province.

"We are limited because she is an elected official and our code of conduct doesn’t have the teeth to force anyone to resign," she explained. "Basically, people will have their say at the ballot box."

YRDSB Education Director Philip Parappally made the decision to investigate the incident under the respectful workplaces and learning environment policy and not the board’s code of conduct. It couldn’t be both. Carruthers says that, if she had been chair at the time, she would have dealt with things a little differently and in a more transparent manor.

"I have asked her how she wants to proceed because it is now up to her, but I have yet to hear back from her," Carruthers said.

While she agrees there is no excuse for what happened, she also points out Elgie is the longest serving trustee currently on the board and she has a long track record of being a good trustee.

"In my experience working with her, this isn’t indicative of her everyday behaviour," Carruthers said.

In the apology letter, Elgie accepted full responsibility for her slur and stated she will be attending the upcoming equity training the board provides trustees.

"As soon as my brain registered what I had said, I was overcome with shock and dismay," Elgie wrote in the letter. "I felt heartsick and deeply ashamed to have said something so

To Grant, this is the larger issue. She says that if a student was to utter the same language in a classroom, there would be an automatic suspension or even expulsion.

The proposal, which will have lower densities than approved by the Ontario Municipal Board, also points to a worrisome trend of developers across the region trying to lower intensification targets on their properties, regional senior planner Josh Reis said.

The 47 townhouses proposed by Peak Garden Development range in height from three to five storeys.

They are to be located on

Hwy. 7 west of Village Parkway immediately north of the Markham Centre provincially designated urban growth centre. Reis said the project is too low-density in an area where millions of dollars have been invested in public transit requiring intensification for ridership.

Higher densities are also used to accommodate growth while limiting urban sprawl.

Although the OMB in 2013 approved 228 units for the site, of which no more than 19 could be townhouses, the developer wants to respond to an increased market demand for townhouses, said Chris Pereira, an associate with planning consultant M. Behar Planning and Design Inc. But the development

changing market conditions faced by the developer, Richmond Hill Councillor Vito Spatafora said.

"I’m astonished that we’re now starting to say well, market conditions have changed and we’re willing to reconsider. Well,

that is planning by the seat of your pants and I don’t particularly like that idea," he said.

"To now say that we are going to continually look at changing these policies in reflection of market conditions astounds me . Setting a precedent of (reducing densities) is frightening."

Markham Councillor Jack Heath, the only Markham councillor opposed to the development, applauded Spatafora.

"He’s hitting more home runs than I think (Jose) Bautista is going to hit with the Blue Jays this year," he said, adding putting townhouses on Hwy. 7 has little to do with good planning.

But Markham Mayor Frank Scarpitti said Markham has and will continue to welcome intensification

across the city, especially when Buttonville Airport closes and is developed.

At the same time, he urged councillors to be flexible in accommodating the developer looking to react to a growing demand for townhouses.

Pereira defended the proposal, which he said will be an appropriate level of intensification for the area.

Even though it doesn’t achieve the density approved by the OMB, building townhouses on the site is better than leaving the property vacant for many years, he said.

In the end, only four regional councillors voted against the development at the committee, despite the OMB approving higher densities on the site.

3 quick storage area upgrades Skating season is well underway, but the gear is buried somewhere in the garage. And while the forecast continues to call for freezing temperatures, the extra winter layers are still hidden in one of the bins in the closet.

It’s time to take control and get organized with help from design expert Kimberley Seldon. Working with the Electrical Safety Authority, she offers these tips for creating smart, functional and well-lit storage in the basement.

1. In the zone. Map out storage zones to ensure items are where you would expect them to be. From winter wear to camping gear and books to toys, built-ins and storage benches work well to eliminate visual clutter without taking up too much floor space.

Consider adding shelves at different heights for varied accessibility and use nooks and crannies — think about the space under the stairs or building storage units between rooms.

2. Lighten up. Good lighting is often forgotten when storage spaces are planned. But seeing is believing! A licensed electrical contractor can provide ideas on automated options for closet lights and suggest the best lightbulbs to use.

Motion sensors are another popular choice. Just remember that it’s important to know the rules around the safe distance between ceiling lights and storage items to prevent anything from catching fire.

For example, pot lights must be 150 millimetres away from any stored items or cabinets; while other ceiling lights must be 300 millimetres away.

3. Hidden electrical. Give devices, laptops and gadgets a designated space by adding

charging stations and strategically located outlets. And while we would all like to tuck away the electrical panel, keep in mind that it can’t be located in a closet or bathroom and that the working space in front of it can’t be obstructed.

Last summer, the province revised the Municipal Elections Act to include a ranked ballot option for municipalities.

But Markham councillors said the new system is too confusing.

"I’ve never heard a complaint about our election system," said Coun. Valerie Burke.

"If anything, it should be as simplistic as possible."

If a municipality opted to run ranked ballot election, it would have to be available for every political office, except for school board trustees.

In Markham, that would mean a ranked ballot system for mayor,

regional councillors and ward councillors.

To further complicate the issue, both mayor and ward councillors would be single-candidate elections and the regional post would be a multi-candidate election - two different systems.

"My concern is how we would explain this to residents," said regional councillor and deputy mayor Jack Heath.

There was also concern about updating election technology such as tabulators, with municipalities having to look outside Canada for vendors and the costs associated remain unknown.

Not to mention, election results would take longer than the current system - days longer and a recount just as long.

The issue will be finalized at the next council meeting.

Peripheral Neuropathy: A Painful Condition?

If You’re Suffering With Peripheral Neuropathy This Might Be The Most Important Thing You Read All Year However, none of these are the reason neuropathy can be a deadly condition. One big risk from peripheral neuropathy is the balance problems and falls that this condition can cause.

You see, the nerves in your feet help send signals to your brain to maintain proper balance. When the nerves are damaged by neuropathy it is common to feel like you are off balance, or going to fall. In order to effectively treat your neuropathy three factors must be determined 1) What is the underlying cause?

2) How much nerve damage has been sustained?

3) How much treatment will your condition require?

Belczowski plans to attend a public information workshop this month to see if medical marijuana is right for her.

The event is being organized by Sherry Bennett, a Richmond Hill resident and owner of the personal assistance company Bayview Concierge.

Bennett, too, had little exposure to marijuana growing up, but recently tried cannabis to help with her long-term PTSD. The effect was impressive: her nightmares, flashbacks and extreme anxiety disappeared. Now, she wants to share what she has learned about the controversial substance with others through an e-book

she wrote and an event she has planned for later this month.

"There are so many myths out there. Education is crucial," says Bennett, who organized Medical Cannabis: It’s High Time We Learned the Facts to be held at the Richmond Hill Centre for the Performing Arts.

The event, set for Jan. 29, brings together a panel of medical practitioners, patient advocates and researchers to discuss the current and future state of medical cannabis in Canada.

Since first investigating the world of pot, Bennett has discovered many others with health challenges who are interested in its medical benefits - but who are afraid to ask questions because of the stigma.

Belczowski says she has had many health issues over her lifetime including a hip replacement in 2000 that resulted in a "dropped foot" that put her in a wheelchair, insomnia, acid reflux and ongoing pain in

her leg and lower back.

The nine prescription pills she was prescribed caused debilitating side effects.

"I was nauseated and so dizzy it was hard to move from sofa to chair. It felt like I was on a boat. I’ve kind of lost hope in prescription medications. The side effects make life downright miserable."

MSH awarded for work on organ transplants ALI RAZA aliraza@yrmg.com One organ donation can "save up to eight lives," Markham Stouffville Hospital says, while one tissue donation can "enhance up to 75 people."

ICU manager Sevi Cesta focused on the importance of organ donations in light of the hospital’s recent achievement.

MSH, on Friday, Jan. 13, received an achievement award from the Trillium Gift of Life Network (TGLN) for exceeding expected conversion rates on organ donation.

The conversion rate is determined when a patient qualifying for organ or tissue donation leads to a successful organ or tissue transplant. The process involves rigorous di-

agnostic testing, blood work and imaging to determine the health of the organ or tissue and whether the recipient’s body will accept it.

MSH works in partnership with TGLN to manage organ and tissue donations. TGLN gives hospitals a conversion rate target of 54 per cent as a goal.

MSH achieved a conversion rate of 67 per cent; roughly indicating that almost seven out of 10 organ and tissue donations led to successful transplants.

"Regardless of whether you registered (as an organ donor) or not, TGLN will come to the hospital to review if the candidate can become a donor," Cesta explained about patients approaching neurological death or considering withdrawal from life-

support.

TGLN and MSH review the patient and seek consent from the patient’s family for potential organ or tissue donation.

"If consent is given, MSH works with Trillium to get everything required," Cesta explained.

"There’s a magnitude of testing that occurs before consideration.

Blood work, diagnostic imaging, we also maintain and sustain the patient for the purpose of donation."

"If the organ is not functional, they won’t donate it," she added.

The hospital’s operating room team assists the TGLN team in organ retrieval and the transplant operation.

MSH is one of 15 hospitals in Ontario to receive the award.
