From a Royal Commission to the High Court – The impact of abuse claims and their future insurability

Since the Royal Commission into Institutional Responses to Child Sexual Abuse concluded in 2017, there has been a significant number of claims arising from molestation. There has been a near complete retraction of insurance providers offering cover for such losses, and the creation of Government schemes to fill that void. However, have recent downward claims trends and guidance from a number of High Court decisions meant that there is now scope for insurers to consider offering certain organisation cover for such losses, on the basis it poses an ‘acceptable risk’? And if so, what checks and balances ought to be considered and implemented to ensure the risk is deemed acceptable?
