FERC Says Rover Pipeline as Planned Negatively Impacts Environment In December 2014 Energy Transfer Partners filed their draft Resource Reports of environmental + Bookmark survey data with the Federal Energy Regulatory Commission (FERC) for the ET Rover pipeline (see ET Rover Pipeline’s 800-Mile Journey Begins with FERC Filing). Rover is an 800-mile, $4.4 billion pipeline that will connect Pennsylvania, West Virginia and Ohio, crossing pretty much the entire state of Ohio heading northwest before entering Michigan and eventually taking a dog-leg into Ontario. In February of 2015, exactly a year ago, ET filed a full application with FERC. Last week FERC responded with a Draft Environmental Impact Statement (DEIS)–and the news was not so good for Rover. FERC found “adverse and significant” impacts from the project as planned and delivered to ET nearly 25 pages of recommendations that ET will need to fix before they get an approval. Is this a fatal blow to Rover? Or just a speed bump? Time will tell…

Here’s the “major conclusions” section in the FERC DEIS–the biggest burrs under the FERC saddle. Things that may stop the project if not addressed: We determined that construction and operation of the Projects would result in limited adverse environmental impacts, with the exception of impacts on forested land. This determination is based on a review of the information provided by the applicants and further developed from environmental information requests; field reconnaissance; scoping; literature research; alternatives analyses; and contacts with federal, state, and local agencies, and other stakeholders. We conclude that approval of the Projects would result in some adverse and significant environmental impacts. Although many factors were considered in this determination, the principal reasons are: • Rover would minimize impacts on natural and cultural resources during construction and operation of its Project by implementing its Plan and Procedures; HDD Contingency Plan; statespecific Agricultural Impact Mitigation Plans; Unanticipated Discovery Plans; Spill Plan for Oil and Hazardous Materials; Blasting Plan; Winter Construction Plan; and Karst Mitigation Plan. • Trunkline and Panhandle would minimize impacts on natural and cultural resources during
