Deed Theft Bill is Now Law

overn o r Cuomo signed the “Deed Theft Bill” (S1688 – Montgomery/ A5615 – Weinstein) into State Senator law. This legisVelmanette lation provides Montgomery greater protections for owners of homes that are in default or foreclosure. It also strengthens laws regulating distressed property “consultants” who provide services to prevent property loss. It will go into effect immediately.

Fraudulent companies target seniors, homeowners struggling financially, and persons for whom English is not their first language. The companies often offer unsolicited assistance with foreclosure or modifications, sometimes claiming that the victim’s home is already up for auction. They are sophisticated operators who take advantage of loopholes in the law by associating themselves with law firms that allow them to avoid legal repercussions.

The “Deed Theft Bill” addresses these issues by: Prohibiting abusive and deceptive behaviors such as pretending to be law enforcement or government representatives, taking temporary ownership of a deed, or engaging in harassment of the homeowner or the homeowner’s family.

Eliminating the requirement that a homeowner post a bond in order to file a lawsuit to stop a deed transfer.

Prohibiting loan modification consultants from requiring up-front fees for services.

distressed property consultants from 5 days to 14 days.

Providing a clear legal path to restore the title of a property when there has been a criminal conviction based on fraudulent actions concerning a property transfer.

“Passing the Deed Theft Bill is a major step forward in addressing one of the most pressing issues among homeowners, especially in communities of color. Thieves target our most vulnerable homeowners and snatch generations of wealth from our families.

For everyone that thinks to call their elected officials or speak out, a dozen more do not know where to turn,” said state Senator Ve l m a n e t t e Montgomery. «I thank the governor for signing this legislation.

“The bill has a simple point. A District Attorney can bring an action and find fraud but there’s not been a way to get the homeowner’s home back. This allows the DA to get into court and have the illegal deed thrown out, and have the house restored to the owner. As it stands now, there’s no simple way to get it back,” said Assembly Member Helene Weinstein. “While it’s clearly good to lock somebody up, this voids the illegal transfer and Assembly member allows the owner Helene E. Weinstein to get their home back.”

New York State Attorney General Letitia James has indicated that her office receives more deed theft complaints from Brooklyn than the four other boroughs combined, and deed fraud scams disproportionately impact homeowners of color. They are highly concentrated in the rapidly gentrifying areas of Bedford-Stuyvesant, Crown Heights, Flatbush and Brownsville.

“People work hard to achieve a vital piece of the American Dream, but that dream can quickly turn into a nightmare when that home is stolen out from under them,” said Attorney General James. “Deed theft has become a common tool used by scammers to illegally obtain real estate in prominent housing markets like Brooklyn, greatly harming senior citizens and destabilizing communities. I thank Senator Montgomery, Assembly member Weinstein and Governor Cuomo for their support, advancement and enactment of this important law.”

Clarke Holds Town Hall on Immigration and Census Issues

M

ake sure to fill out the 2020 census forms, but beware of scammers who prey on uninformed immigrants.

Those were the two main messages delivered last night at U.S. Rep. Yvette Clarke’s (D- Brownsville, Crown Heights, East Flatbush, Flatbush, Kensington, Midwood, Prospect Heights, Prospect Lefferts Gardens, Park Slope) town hall on issues related to the 2020 Census and immigrant affairs at Brooklyn College.

Other topics of importance discussed included accessing government resources, and the new federal public charge rule the Trump Administration put in effect, which limits legal immigrants in the country from obtaining permanent residency (getting a green card) if they are on social services.

A number of elected officials were in attendance, including State Senators Zellnor Myrie and Kevin Parker, Assemblywoman Diane Richardson, City Councilman Brad Lander and Comptroller Scott Stringer.

As 2020’s census reaches closer, panelists urged the importance of filling out the census forms as the

census determines redistricting and allocation of over $675 billion in funds.

Yet in the past, many residents have failed to respond.

Nationwide, the rate of respondents for the 2010 census was 75.8%. In New York City, that number was 61.9%.

In parts of Brooklyn, the number goes down to 37%.

ttorney General Letitia James today announced a lawsuit against the Trump Administration’s Public Charge Rule, a new rule that aims to deny green cards and visas to immigrants that use or have used government assistance programs.

Such a rule would have short- and long-term impacts on public health and the economy. The suit, filed in the Southern District of New York and joined by the States of Connecticut and Vermont and the City of New York, challenges the Trump Administration’s attempt to specifically target immigrants of color while putting these communities at risk.

“Generations of citizens landed on the welcoming shores of Ellis Island with nothing more than a dream in their pockets,” said Attorney General Letitia James. “The Trump Administration’s thinly veiled efforts to only allow those who meet their narrow ethnic, racial and economic criteria to gain a NYS Attorney path to citizenship is a clear General Letitia violation of our laws and our James values. Quite simply, under this rule, more children will go hungry, more families will go without medical care and more people will be living in the shadows and on the streets. We cannot and we will not let that happen.”

“The ultimate city of immigrants will never stop fighting President Trump’s xenophobic policies,” said Mayor de Blasio. “We are proud to join the Attorney General and let our immigrant brothers and sisters know that New York stands united behind them. When you mess with our neighbors, you mess with all of us. To the president, we’ll see you in court.”

“The new ‘public charge’ rule creates fear, confusion and distress for our immigrant communities,” said NYC Corporation Counsel Zachary Carter. “The new rule broadens the definition of a public charge, increasing the number of noncitizens who may be found inadmissible, denied a green card, or denied a visa on public charge grounds. As a result of this new rule, families may forego benefits and services to which they are legally entitled because they fear that accepting those benefits or services may jeopardize their ability or the ability of family members to stay in the United States.

In this lawsuit, the city will challenge the new rule on the grounds that it violates the federal Administrative Procedure Act and the Constitution. The city will defend immigrant New Yorkers from this unlawful expansion of the public charge rule.”

In the suit, the coalition argues that the Department of Homeland Security’s (DHS) new public charge definition disregards clear congressional intent and a century’s worth of case law holding that immigrants who use basic, noncash benefits are not considered public charges because they are not primarily dependent on the government. Additionally, the public charge rule weaponizes the public charge inquiry to specifically target immigrants of color, immigrants with disabilities and low-income immigrants. Finally, the rule fundamentally misunderstands that these noncash programs are designed to help immigrants who arrive in this country with limited means move out of poverty and achieve upward mobility.

The overall health and well-being of New York’s immigrant communities that use vital public benefit programs will be negatively impacted by the new rule.

Additionally, with the anticipated decline in Medicaid enrollment, individuals who would have otherwise had access to health care are at risk of living with undiagnosed and untreated conditions. Economically, impacted communities can be expected to experience increased poverty rates, housing instability, a reduced workforce and an overall decrease in total economic productivity.

A Stranglehold on Justice: Retired Det. Graham Weatherspoon on the Eric Garner Case and Pantaleo’s Firing Five Years Later

n the aftermath of the firing of police officer Daniel Pantaleo, we speak with retired Detective Graham Weatherspoon. He is a member of One Hundred Blacks in Law Enforcement, a justice and reform organization, and sits on the board of the Amadou Diallo Foundation. His insight, perspective and inside knowledge of the issues surrounding the Eric Garner case were invaluable in his 2014 article in Our Time Press, and equally valuable now.

Five years after the murder of an unarmed Garner, by police officer Daniel Pantaleo, captured on camera for the world to see, Weatherspoon adheres to his initial criticism of the handling of this case and now of its outcome. In doing so, he reacquaints us with the law enforcement regulations and judicial statutes that were violated in both the internal investigation and the court hearings that resulted in no charges.

Some NYPD officers, as well as PBA head Pat Lynch, decry Police Commissioner James O’Neill’s decision to follow Judge Rosemarie Maldonado’s recommendation that Pantaleo be fired. But former officer (and former Grand Jury foreman) Weatherspoon, prioritizes the life that was taken, the crimes he feels were committed by law enforcement, and the failure of the judicial system to hold Pantaleo accountable.

Weatherspoon enumerates the charges and counts he believes Panteleo should have faced and why. They include Murder in the Second Degree, Murder in the First Degree, Manslaughter, Criminally Negligent Homicide, Reckless Endangerment in the First Degree, Strangulation in the Second Degree and more. Yes, more.

In the meantime, Weatherspoon notes that the Garner family is not done pursuing justice and says that Pantaleo’s firing is

Which means, that the gun you’re carrying – even if, at the time, if it’s not used in the commission of the crime – you are illegally in possession of a weapon. Because you’re not a police officer, you’re a criminal.”

There have been instances, says Weatherspoon, where police officers committing a crime – whether on-duty or off – were charged with possession of a weapon.

And Pantaleo, with his arm around Garner’s neck and surrounded by fellow officers, was not in danger, despite his citing of Garner’s large size. So, Weatherspoon concludes that Pantaleo was acting outside the scope of the law, with no legal or moral right to take Garner’s life. He says that this could have been addressed in court if only the DA advocated for the victim – which is his job – and not the police officers.

Brooks was a Harlem-born African-American soldier and war hero who fought with the segregated 369th Infantry Regiment in France during WWI and died there shortly before the war ended.

Paule Marshall Her fiction works, beginning with “Brown Girl, Brownstones,” were first published in the 50s.

Black scholars concur that Marshall was the bridge between Zora Neal Hurston and Gwendolyn Brooks fiction writers and the Toni Morrison, Alice Walker and Jamaica Kincaid.

Marshall was also one of the preeminent feminist fiction writers.

Most of her stories referenced her Barbadian heritage. Other Marshall titles include, “The Chosen Place, The Timeless People” and “Praisesong For the Widow.” A graduate of Brooklyn College, Marshall taught literature at Yale, Columbia and NYU. My favorite Marshall story is the one by a Chicago-born librarian friend who arrived in NY in the 60s, met and married a Jamerican dentist who always considered her lavish wedding a Black version of a Jewish wedding. Ms. Chicago read Marshall’s “The Chosen Place” many years later after the divorce, realizing that her nuptials were actually a big West Indian wedding. Twice married, her

400 Years A Slave ■■

T

his past Sunday, The New York Times published the “1619 Project,” an amazing collection of essays and photos that dissects virtually every aspect of America, drawing it all back to the origins of America’s oldest and most vicious sin, slavery. It is the most fundamental aspect of the creation of this nation, the inheritance and acceptance of slave labor based solely on race, the wicked practice of breaking the body, the will and the spirit of African people in this so-called New World in such a systematic way that the African would be reduced to existing in absolute fear and terror no matter where he found himself in this nation, knowing that the potential of having to confront such a terror would always apply, even if he has run thousands of miles to escape it.

This is the nature of America. It is in the country’s DNA. pancakes taste so good, but they wouldn’t taste the same without the eggs. The same holds true for America. America is an amazing place indeed, but it wouldn’t taste the same without the ingredients of slavery, which was added to the batter back in 1619.

I watched the news this morning while writing this. The lead stories were the following: Police Officer Daniel Pantaleo has been fired from the NYPD for his role in choking and killing Eric Garner back in 2014. The police union (PBA), in response to the firing, suggested that a work slowdown in the department might be appropriate. Also, Patrick Lynch, who is the head of the PBA, states that Pantaleo will appeal the firing. A 25-year-old Black man was killed in front of his home in Jamaica, Queens. His mother is distraught. Trump backs the NRA, stating that guns don’t kill people, people kill people.

These were the lead stories in the news this morning, each of them rooted in America’s fundamental practice of slavery and the side effects therein. The relationship with the police and Black men has been well-documented. My father told me a long time ago that white cops don’t get convicted and sentenced for killing Black boys. He retired from the NYPD in 1993, and every

time an NYPD cop killed a Black man, he reminded me that they don’t get convicted for those kinds of murders. Alas, the potential of having to confront such a terror will always apply. My father knew this, and his father, too.

The fact that it took five years for Pantaleo to be fired for killing an unarmed man who these cops were trying to arrest because he was selling cigarettes is repulsive and can only be explained in the context of America, a place where the value of the life of a Black man is known to be intrinsically less than that of a white man. If I call out of my job for three days straight, I might be fired. He killed a man and kept collecting checks for five years. Ridiculous! And the response of the police union doubles down on the systemic nature of America. How can any moral human support what is evident on the video? Did you see it? Do you believe

that Pantaleo was in fear of his life while he choked Garner to death? Of course, he wasn’t. So, how can you support him and even fight for him to keep his job? This attitude comes from the root!

I remember being a child and being asked to leave the room while my parents had a discussion about something. I didn’t know what they spoke about, but I do realize that whatever they spoke about affected me in some way because I lived in their house, they provided for me. Because they raised me and provided for me, I did what they said, I acted on their direction, I complied with their wishes, consciously and subconsciously. Even now, as an adult, I call my elders ma’am or sir because of what my parents taught me as a child. My parents’ influence on my life as a child will continue to be evident in me until the day I die, and even then, some of their effects over me will be found in my children. The founders of this nation raised its children under the tenets of slavery. They raised their children with these tenets, and those children did what they said, acted on their direction and complied with their wishes. And even now, 400 years later, the children of those children still exhibit the effects of those tenets, far after the roots of slavery was planted in this land.

have called 192 Greene Avenue home for 31 years. I know the neighborhood as intimately as one knows their childhood neighborhood, and yet on July 17th, I saw something I had never seen before.

Cars along Greene between Cambridge and Grand were being booted and towed away.

There was a new traffic sign sticking out of the ground in front of The Finch. I remember when that storefront belonged to April Walker in the 80’s, and then after that it was a barbershop in the 90’s, and at no time between then and now did that traffic sign exist on that block. The new sign read, “No Parking Monday through Friday 7am-7pm.”

Sharon Holliday and her family own the home next to The Finch. On the morning of July 17th, Sharon’s son saw city workers stabbing that sign into the ground like Armstrong on the moon landing. When he asked the workers, what was with the sign, they gave him the “this is above my pay grade” spiel. By mid-afternoon, the cars that were parked along that block, cars that had been parked there before the sign had been secured in the ground, were being booted.

“And it doesn’t just affect those 20 students who weren’t counted, it affects everyone. So if you choose not to count or your neighbor chooses not to be counted, it will affect you, your community, your city, your state for the next 10 years. So we have to get this right.”

For the first time, the 2020 census will be available online and over the phone.

Bahler added that the bureau hopes to get the number of responses to over 80% in New York City, which would be close to a 20% increase from the 2010 census. He urged community voices to share census information with others and promoted temporary jobs with the Census Bureau, which people can apply for here.

All personal data provided on a census is protected by Title 13, which prohibits the Census Bureau from sharing it with anyone, including other government agencies such as Department of Homeland Security (DHS) or Immigration and Customs Enforcement (ICE).

“We cannot use the information you provide against you for any reason. We are not allowed to release any information that would identify an individual or a household,” Bahler added. “Local, state, federal law enforcement cannot access our data.

Homeland security, ICE, cannot access our data. Any administration cannot access our data. It is protected under Title 13. It would take an act of Congress to change that.”

Panelists and Clarke also warned attendees to avoid scammers who prey on uninformed immigrants.

“I really want to urge our residents to use the offices of elected officials. What we have

found, unfortunately, the whisper campaign takes place. ‘So and so got their papers done by such and such.’ And what we are finding is that these are scam artists,” said Clarke.

“When indeed they could have come to our offices, where they get free information, get legitimate legal advice but oftentimes the rumor tree is what drives people and they end up having their pockets picked and because they’re in-between status, they’re also fearful of speaking about the crime that was committed against them.”

Interiano urged any victim of such a scheme or any crime to call or visit the District Attorney’s Action Center, which is a way to directly report a crime to the DA’s office without having to contact police.

“What we have seen is that immigrants are very routinely preyed upon because of their lack of knowledge and because of the rise in fear,” said Interiano. “When we have instances where there is a new initiative or a new policy being implemented by the federal government, we see a rise in people seeking these [illegitimate] services to obtain a Green Card or citizenship. But I’m here to tell you that the wrong type of help can hurt.”

Policy changes by the administration, such as the recent public charge rule change, often receive much press while not necessarily affecting many groups of immigrants.

“This rule doesn’t affect all immigrants.

It is actually very narrow in its scope,” said Lin. “Only certain categories of immigrants are subject to a public charge test, only certain kinds of immigration applications are attached to them.”

The Mayor’s Action NYC hotline, which can be reached at 1-800-354-0365, can let residents know whether the rule applies to them or not. It is also designed to direct people to immigration attorneys and is city-funded.

I made my flyers, I posted them in the neighborhood and knocked on doors in Clinton Hill in order to make them know what was happening.

We wanted to make sure that awareness was the main factor. After we got awareness, we wanted to make sure that the community knew that we needed their participation.”

Sharon echoes Renee’s civic ideals: “It’s very important as a community that we are informed about policy. We are stakeholders in this community. This is our home. So, I think that if DOT wanted to implement a program like this, the proper way to do it would have been to at the very least notify the community about the program before you start booting and towing cars. Everyone should be able to contribute to the policy and rules of the neighborhood--local agencies and community stakeholders alike.”

Coretta Scott King said that the greatness of a community is measured by the compassionate actions of its members. Women like Sharon, and Renee, and Bernice, and guys like Stephen and Ferdinand prove that there is strength in speaking up. Those traffic signs were removed on August 14th. And I guarantee you that they won’t return to our block anytime soon.

edford-Stuyvesant is one of New York City’s first Age-Friendly neighborhoods, having developed the Aging Improvement District, an on-going project to create and support initiatives that enhance the social, physical, and psychological lives of seniors. And now it was announced at the Nazarene United Church of Christ pastored by the Rev. Valerie Anne Ross, that thanks to Council Member Robert E. Cornegy Jr., Brooklyn Neighborhood Services, and the Age Friendly Network, District 36 has been designated a Naturally Occurring Retirement Community (NORC).

Housing is a serious issue through all five boroughs, and it is acutely felt in District 36. In the face of increasing fraud schemes, gentrification, and the lingering effects of the financial crisis, NORC designation provides seniors with the opportunity to age in place with government funding for supportive services. The beautiful brownstones in the district, and other properties, will stay in the hands of seniors and their families who helped build the community, ensuring sustainable wealth building.

The Council secured $3.8 million in the FY2020 budget for senior centers and Naturally Occurring Retirement Communities, to be disbursed by Department for the Aging. Brooklyn

Neighborhood Services will receive $100,000 to support the implementation of programming and resources.

Attaining NORC status for District 36 was one of Council Member Robert E. Cornegy Jr.’s core campaign promises, along with expanding Gifted and Talented program, and creating lactation stations.

eorgene Sheryl Thompson was born on October 3,1959 to the Drs. Thomas Eustace and Marguerite Casanave Thompson. Her rich heritage winds through the continents on North and South America and is rooted in her hometown of Brooklyn, New York. She was the first child of color to be baptized at Fenimore United Methodist Church and later confirmed. Her family instilled in her the importance of faith, service and education.

Schooling for Georgene began at PS 92, Walt Whitman Junior High School and Erasmus Hall High School, where she was the captain of the booster squad and excelled in all areas of learning. Georgene advanced through high school and graduated early with honors at the age of sixteen. After graduating from high school, her pursuit of higher education extended to her ancestral home, the colorful city of New Orleans, Louisiana, where she attended the Historic Dillard University. While there, she excelled in leadership and served as the president of the debate team under the guidance of her mentor and president of the university, Dr. Samuel DuBois Cooke.

Georgene comes with an extensive portfolio that covers much of the diplomatic world. She received a full scholarship to The New School for Social Research, where she received her Master’s in Foreign Policy and was Foreign Service Officer for the United States Diplomatic Corp. Georgene later continued

her education and received her Master of Education Degree and her Doctorate Degree in Psychology.

Many people and leaders of color, some of which include her godfathers Dr. Booker T. Washington III and President Forbes S. Burnham of Guyana, South America, assembled at the Flatbush Mance of the Thompsons. Georgene wore many hats and got her start in leadership and business with her father, the late Dr. Thomas E.L. Thompson. She traveled the world at an early age throughout the Caribbean, South America and Europe with her parents and was responsible for the diplomatic affairs of the family, which included applying for visas and travel documents for their trips abroad and throughout the United States.

The Historic Weeksville Project became a household name as she helped to develop the Weeksville Young Ambassadors Exchange Program in the 1980’s, which exposed children from shore to shore to their global community. Georgene was an intricate part of operations and scheduled travel and lodging for the ambassadors of London, Paris, Panama, Barbados and beyond. Her work touched over two thousand families throughout the United States and abroad.

She continued her legacy of service and became a teacher for the New York City Department of Education where she served New York City’s children and families in various capacities for twenty-seven years. As a leader in her school community, Georgene
