Hello and a warm welcome to our February magazine. It’s one of my favourite times of the year when it’s no longer complete darkness when you leave the office at 5 and we finally feel we are heading towards the Spring! We received an extremely positive response from the business community following last month’s magazine with the focus on Net Zero and carbon reduction. We highlighted the steps a number of businesses are taking and this prompted several businesses to get in touch to share actions they are taking with other businesses. You can expect to see an ongoing focus on this area where we will be really encouraging businesses to commit to Net Zero and we’ll be offering tools and resources to help you with this. We’ve started this with the launch of a range of Net Zero tools and information on our website and you can see this in the Business Support section. I’d also like to say a very big

thank you to Blue Sky Financial Planning for supporting us as our Net Zero sponsor. Blue Sky are absolutely committed to this agenda and Founder and MD Gary Neild is passionate about this. If you’d like any help or support on your journey to Net Zero, please don’t hesitate to get in touch. So the work from home guidance has finally changed and Boris is encouraging us to get back to the office. Personally I was very pleased to hear this. Whilst businesses have adapted well and we have learned so much about how we can work in different ways, I have missed the buzz and energy in the office and the creativity and camaraderie that comes from this. I certainly

want to hang on to the positives that came through the pandemic but I’m also delighted to welcome my team back. So hopefully this year will be a better year for us all. It feels like we’ve turned a corner with Covid and my firm belief is that we really need to get on with life and business. We have much to look forward to this year.

Sunseeker full speed ahead with an expansive new product development plan In many ways, 2021 was a record-breaking year for global luxury yacht manufacturer, Sunseeker. The exponential growth of demand for yachts, both in the charter and ownership market, has seen a boom in the industry and Sunseeker has remained adaptive to the market trends shaping the everyday lives of its customers. Strong forward orders were made following the return of international boat shows, building on an order book worth nearly £500 million.

The emergence of new lifestyle trends and a continuing demand for innovation saw Sunseeker continue with its three year £35 million investment programme to accelerate new product development as well as a significant recruitment drive for expert and trainee tradespeople and a record intake of new apprentices and graduates required for 2022 and beyond. Tendering for new suppliers in stainless steel, aluminium, glass, GRP, marine upholstery, white goods and interior fit-out furniture are in progress, building on its established supply chain of which 70 per cent are UK-based. Sunseeker remains focused on building partnerships with local and national businesses, supporting a further 10,000 indirect jobs in the supply chain. Last year saw Sunseeker launch seven new models, ranging from the Sunseeker ‘Famous Five’ including the dynamic Predator 55 EVO™ to the truly innovative 90 Ocean and two special edition 74-foot XPS models benefitting from enhanced interior styling. How are you progressing with your Race to Net Zero plan? When you start looking into the requirements to achieve Net Zero within your business, it can seem like a mind-boggling minefield. The Government’s first target date of 2030 aims to halve the country’s carbon footprint, followed by the big push to achieve Net Zero emissions by 2050. This means that now is the time for action and it’s essential that you start to really embrace New Zero and begin to take the steps you need to reduce the carbon footprint your business is creating. This forms part of the wider ESG agenda, referring to Environmental, Social and Governance practices. More customers, shareholders, employees, and investment institutions are making their buying, investment and indeed employment decisions based on these ESG factors. Where do you start? Start with the Environmental aspect of ESG. Dorset Chamber is building a library of online resources available to all and we’ll also be sharing examples of practical steps 6

the positive changes you are making. Bear in mind some changes will soon be forced upon you, as the Government progress their 10-step plan, part of their Green Industrial Revolution. For example: Gas Boilers will be banned from new builds from 2025 and you will no longer be able to buy a new gas boiler from 2035. Most current gas boilers only have a useable life of 10 years. From 2030 you will be unable to buy a new petrol or diesel car and hybrids will be banned from 2035. Be mindful, taxes will be increased to make owning any of these cars more uncomfortable. Currently, there is no fixed date for the phasing out of diesel HGV’s. While the beneficial effects of culture on mental well-being is well known, the social and economic impacts of a welldeveloped cultural and creative sector are also powerful. Like many businesses, the venue-based sectors - such as museums, performing arts, live music, festivals, cinema etc - have been hit hard by lockdown and the social distancing measures of the pandemic. Similarly, artists, technical and specialist freelancers and independent creative organisations who are a critical part of the cultural and creative supply chain, have also experienced considerable hardship. But a report commissioned by the Arts Council of England found that the sector’s Gross Value Added (GVA)* could return to its pre-lockdown level of £13.5bn by the end of 2022. The research also shows the sector is set to be worth £15.2 billion to the economy by 2025.

So, how can the cultural sector help Dorset’s recovery? Culture helps to attract visitors to the county, providing opportunities to explore and discover more about Dorset as a destination. The BCP Council is supporting our neighbouring City, Southampton’s bid to become UK City of Culture in 2025. The example of cities that have had this status – such as Hull – demonstrates that winning UK City of Culture can really boost the local economy, in the short term and longer term by attracting new businesses and investment opportunities across the region. When Hull was UK City of Culture in 2017, it added £300 million to their tourism market and up to £17 million gross value added to their local economy. The bid for Southampton to become UK City of Culture is an opportunity to build on the existing strong arts and culture sector and showcase the South coast and region as a great place to live and work and I truly believe that culture is a vital part to the recovery in the context of COVID and it’s vital we embrace this. 11

What to do if you receive a data breach notice Receiving a breach notification doesn’t mean you’re doomed – here’s what you should consider doing in the hours and days after learning that your personal data has been exposed. Data breaches occur when an unauthorised third party accesses a business’s private information. Often, they involve theft of customers’ and/or employees’ personal data. GDPR was designed to force a business to improve the security and handling of this data. As well as opening the door to fines, the law also mandates notification of any breach within 72 hours of discovery. The result has been to improve transparency of data breach incidents among customers and the public. Records reveal that they’re continuing to grow in number, despite the best efforts of EU regulators. In the UK, nearly two-thirds of medium and large businesses admitted suffering a breach over the past year. However, receiving a breach notification letter or email doesn’t mean you’re doomed. What you do in the succeeding hours and days can have a major impact on whether the initial incident leads to identity fraud or not. Here are a few key things you should do following a breach notification: Stay calm and read the notification carefully A knee-jerk reaction might end up making things unnecessarily worse. So don’t immediately close your online accounts and/ or cancel all your cards. Instead, pay attention to what happened. Read through the details of the incident until they make sense, and you understand what was stolen and the implications of this theft. It’s also worth keeping the letter/ email in case you need to prove in the future that the breach was no fault of your own. Make sure the notification is legitimate Sometimes fraudulent phishing emails and

texts are designed in order to trick you into clicking through on a malicious link or divulging more personal information. One way to grab your attention is by claiming your data has been involved in a breach. These messages are getting harder to differentiate from the real thing. That’s why you should contact the business direct, using its official website or social media accounts. Their team will be able to explain if you have been impacted and what should happen next. If it’s a scam, report it and/or delete the message. Be on guard for follow-on fraud The hackers responsible for breaching your data in the first place are likely to then sell it on specialised criminal sites, hidden on the dark web. Fraudsters buy this and then try to target you with phishing messages designed to elicit further info, like logins and card details, which they can monetise. That’s why you must be on the lookout for any official-looking correspondence following a data breach. It may be disguised to appear as if sent from the breached company itself, or another source. Tell-tale signs of phishing emails are grammatical and spelling mistakes, sender email addresses different from the company, and the creation of a sense of urgency, to trick you into acting without thinking first. Change your password(s) Even if your logins haven’t been compromised in the breach, it may be a good idea to change them anyway. Also change the passwords on any other accounts you use the same logins for. This is because hackers have access

to automated software which can try large numbers of stolen logins on multiple sites across the web until they get lucky. In the longer term, consider switching on multi-factor authentication on your online accounts, and/ or using a password manager, to store and recall strong and unique passwords for each site. Check your banking and other online accounts If the notification warns that logins have been stolen, and you use those same logins for other accounts, then change them immediately. It’s also worth checking banking accounts for any suspicious activity. Sometimes, if fraudsters get access to enough personal information, they can trick staff working in banks, mobile operators, and other businesses into resetting details or providing new passwords. Cancel or freeze your cards It goes without saying that if you’ve been notified of a serious breach of financial information, you should inform your bank immediately, cancel or freeze your cards and change any passwords. If personal details have been stolen in a breach, fraudsters may use it to try to take out lines of credit in your name, before running up a huge debt and then disappearing. That could impact your credit rating for months and take many hours to resolve. A good way to head off this risk is to ask credit ratings firms to put a security freeze on their credit files. That means no lender can view your reports—and therefore can’t open any new accounts in your name. Breaches are becoming so common today that there’s a danger we become desensitised to them. That will only play even more into the hands of fraudsters and cybercriminals. By staying alert and understanding your risk exposure, there’s a good chance that you’ll be able to manage the impact of an incident without creating too much disruption to your digital world. www.eset.com/uk

Dorset Green H2 – the South West’s first green hydrogen production facility The hydrogen economy in the South West has taken a huge step forward with the completion of a £6.5 million funding package that will enable Dorset-based Canford Renewable Energy Ltd to deliver its Dorset Green H2 facility, the first of its kind in the region. Unlike many other hydrogen projects which may use fossil fuels to produce the fuel, the Dorset Green H2 facility will use only renewable energy generated by onsite solar and landfill gases to make green hydrogen, a clean, zero-emission fuel. The site, previously used for landfill, has been used to generate electricity by harnessing naturally occurring methane gases from landfill since 1996. This legacy will be continued through this exciting Dorset Green H2 project. Green hydrogen power will play an important role in moving polluting, energy-intensive industries and heavy transport such as shipping, HGV lorries and trains, away from fossil fuels. It is recognised by the government as an emissionfree fuel for use in vehicles, homes and much more. Producing only water vapour and oxygen as by-products, green hydrogen is a central part of the UK government’s plan to reach net zero. Published in August 2021, the UK Hydrogen Strategy states an ambition to have a worldleading hydrogen economy and identifies hydrogen as having the potential to provide a third of the UK’s energy in the future. Housing Minister, Eddie Hughes, Department for Levelling Up, Housing & Communities said: “I am delighted to see funding go towards such a positive development in the South West, a real catalyst for a green hydrogen economy in Dorset. It is a priority of this

Government to level up opportunities and create a greener, more sustainable future”. The facility at Canford Resource Park, Poole, is expected to be operational later this year and is being funded via £3 million from Dorset Local Enterprise Partnership (LEP)’s Growing Places Fund loan scheme, a £1.5 million grant from Low Carbon Dorset, a £1.7m loan from NatWest and equity funding from Canford Renewable Energy. Cecilia Bufton, Dorset LEP Chair, said: “The UK needs green hydrogen to meet its future energy requirements and we are delighted to award funding to the Dorset Green H2 project, the first of its kind in the South West of England. “Our recently published Dorset Low Carbon Opportunities document, which maps out options for Dorset to become net zero by 2050, identifies hydrogen as a major investment opportunity and key contributor to Dorset’s clean growth, alongside activities such as decarbonising the grid network, transport and heat. This project will be a springboard to stimulate hydrogen production in Dorset, taking us a step closer towards our net zero goal for the county.” Dorset Green H2 will see the installation of a 5-Megawatt (MW) ground-mounted array of solar panels at the site, which on overcast days and overnight will be supplemented by electricity produced from the site’s existing landfill gas. Low Carbon Dorset Programme Manager, Heather Kiel, said: “Dorset Green H2 is a truly innovative project that really showcases a determination in Dorset to invest in renewable and cutting-edge energy. We are thrilled to support Canford Renewable Energy to jumpstart the local hydrogen economy and drive

the county forward on its path to net zero.” Energy generated by renewable sources at the site, will consistently power a 0.87MW electrolyser, producing up to 120,000kg of green hydrogen fuel each year to be compressed, stored, and sold for local and regional use as a carbon free fuel. Hydrogen fuel is recognised as being superior to battery-electric power when it comes to large vehicles, particularly in terms of range and time to re-charge and re-fuel, which takes minutes rather than hours. Fire warning b4b marketing name after Covid Dorset Mind as their Businesses are being advised to have their fire alarm systems checked because many were untested last year due to the pandemic and lockdowns. Aaron Keith from Poole-headquartered fire and security company Sentinel said that some equipment will have gone out of date, meaning in the event of a fire insurers might not pay out. With more heating, lights and possibly open fires and candles being used during the winter months a fire is more likely. Companies should also ensure their fire extinguishers are checked, as they too might have gone a year without being assessed. Aaron said: “In 2021 during the pandemic the testing of fire systems was not a priority for obvious reasons. “It was not deemed a critical service because reducing the spread of Covid was considered more important. “So, this year many businesses have systems that might be out of date or aren’t working and do not meet compliance rules and regulations. “We have very strict standards here and fire systems should be checked twice a year to be compliant. “Fire extinguishers should also be tested every year and re-filled every five years. “It might be that everything is fine, but in the event of a fire you want to know that your systems will work, and that your insurance won’t be invalidated. “For a small outlay businesses can feel safer, be compliant and keep their insurance valid. “By doing so they will help keep neighbouring businesses and properties safe. “People should also check their smoke alarms at home to make sure they are in good working order. “When our engineers do go and check alarms and systems – which they do right across the south – people are grateful and very reassured.” www.sentinelfs.co

Charity of the Year Poole-based software, web and marketing agency, b4b, named Dorset Mind as their fundraising partner for 2022, pledging to create a calendar of events to raise money for the mental health charity. Every member of the b4b team was asked to vote for the charity they wanted to support. It quickly became clear that mental health is a subject that’s close to a lot of people’s hearts. Melissa Boyle, b4b’s Marketing Manager, is leading the Charity of the Year initiative. She says, “Mental health is such an important issue, especially during these uncertain and difficult times. I am thrilled that we are supporting a charity that does such worthwhile work tackling the stigma surrounding mental illness, while providing valuable education and support to those who are struggling.” In her spare time, Melissa writes about mental health and shares her own lived experience of OCD. She says that she finds it inspiring that so many of her colleagues are eager to support Dorset Mind. During 2022, b4b will hold monthly fundraising events both internally and with the involvement of clients. In keeping with the theme of mental wellness, some of these will be activities designed to promote mindfulness, such as crafting and yoga sessions. Dorset Mind challenges mental health stigma and encourages recovery by empowering individuals to develop resilience. The charity’s one-to-one and group support includes counselling, mentoring, support groups, active monitoring, and a befriending service. These help people regain social skills

and develop confidence. Dorset Mind also delivers educational wellbeing programmes for schools and workplaces and provides volunteer opportunities across all areas of the organisation. Dee Swinton, Income Generation and Marketing Manager at Dorset Mind, says she is delighted that Dorset Mind has been chosen as b4b’s charity partner. She adds: “As an independent charity, the support of our community is hugely important to us, and for local people’s mental health. b4b’s fundraising will help us continue to support adults and young people across Dorset. Design company Design Pit celebrates a decade of creativity with limited edition book for charity Design, branding, print and digital company Design Pit is celebrating a decade of creativity in 2022. Founded in 2012 by Gareth Robertson, Design Pit has worked with 100s of clients over its 10 years in business, creating bespoke print, digital and web assets for many satisfied customers. To mark his 10th anniversary in business, Gareth has created a limited-edition, high-end book charting his business journey – and he’s selling copies to raise money for Parkinson’s UK. Dolphin Centre charity partnership raises a total of nearly £33,000 for local hospice A two-year charity partnership between The Dolphin Shopping Centre and Forest Holme Hospice in Poole has raised a total of nearly £33,000 to help fund and support local people across Poole, Wimborne and the Isle of Purbeck facing a life-limiting illness. The Dolphin Shopping Centre choose to support Forest Holme as its Charity of the Year during 2020 but due to the Covid-19 pandemic and subsequent lockdowns, extended it for a further year, helping the hospice to raise an extra £14,282 in 2021. During the past two years the hospice has been fundraising through its Remembrance Tree and Christmas Pop-Up Shop at Christmas, Spooky Scavenger Hunts at Halloween, as well as various awareness raising stalls and street entertainment bucket collections during the year. The Centre also generously sponsored the charity’s Dance Through the Decade event at the end of 2021. Kirsty Perks, Fundraiser at Forest Holme, said, “We have really enjoyed working with The Dolphin Shopping Centre over the past two years and are very grateful that they extended our partnership because of Covid to help boost fundraising, which has been hugely affected by the pandemic. John Grinnell, Lisa King and all the staff have been absolutely fantastic and we must also give a special mention to Suzy Wheeler at

Strawberry Fields RePresents for organising all the Street Theatre. What is a decibel (dB)? A dB is the unit used to measure the intensity of a sound – 85dB and above is the level at which noise becomes unsafe without the use of hearing protection. Although if you work in a noisy environment, of up to 80dB, you should be trained and educated to understand the risks and hearing protection should be made available. For 85dB and over, hearing protection should be provided. These rules do not relate to social noise, and that’s where you need to make sure you protect yourself. 24-hour treadmill climb to raise money for children’s hospice Big-hearted colleagues at a south coast property finance specialist organised an ambitious 24-hour treadmill climb to raise nearly £4,500 for a children’s hospice. A team of 21 walkers from MSP Capital each completed sections of a continuous hike at a 15% incline on a machine in the staff room of their Poole office. The original aim was to reach a height of 17,460m, equivalent to Mount Everest and K2 – the world’s highest and second highest mountains – but in the end the climb surpassed that and reached more than 21,100m. Rebecca Lewis, Marketing Co-ordinator, said: “We were a little worried beforehand that the challenge was going to be unachievable, but we managed to do the combined heights of Everest and K2 in 19 hours and 36 minutes, so we decided to add the equivalent of the UK’s Three Peaks Challenge too, a further ascent of around 3,500m. “We just kept going – imagining Ben Nevis, Scafell Pike and Snowdon – until the 24 hours were up. “As one of the organisers, I got to witness the team coming together to support one another. It was a struggle fighting the tiredness and exhaustion through the night. That tested everyone’s commitment but team spirit, energy drinks, snacks and music helped us all make it through.” The hike was the latest in a series of MSP Capital initiatives in aid of Julia’s House, a Dorset-based hospice charity that provides practical and emotional support for children with life-limiting or life-

threatening conditions and their families. Care is completely bespoke to each family, giving parents facing unimaginable heartbreak a much-deserved break and helping siblings build resilience and confidence. Rebecca added: “The buzz when we reached the 24 hours was the best feeling, knowing each one of us had contributed to helping the families cared for by Julia’s House.” MSP Capital also held a business networking event with AFC Bournemouth, for whom the company is shirt sponsor, raising £1,300 for Julia’s House. So far, MSP Capital has raised £8,100 for the charity. Caroline Attreed, Corporate Fundraiser for Julia’s House, said: “On behalf of everyone at Julia’s House, and especially the families we support, I would like to say a massive thank you to MSP Capital. Delight as Poole Museum awarded £2.24 million National Lottery funding for major development project Thanks to a £2.24 million grant from The National Lottery Heritage Fund, Poole Museum will be transformed into an outstanding cultural centre and community hub by the Spring of 2024. This award, made possible by National Lottery players, represents a significant part of the total project budget of £4.37million. The ‘Our Museum: Rediscovering Poole’s Maritime Heritage’ project is ambitious and far reaching. It will enable the conservation and restoration of the at-risk Grade I Wool Hall, making this medieval building accessible to the public and interpreting its extraordinary story. Three new galleries developed with the local community will showcase Poole’s significant maritime and pottery collections. New visitor facilities and better access for all are integral to the plans. The project will transform and refresh Poole Museum enabling it to continue to thrive and appeal to a wider audience. The transformed museum will be at the heart of Poole’s Quay Quarter, greatly enriching the experience of Poole Quay and The Old Town for visitors and the community alike. Work on the project will start in early 2022 with the museum expected to close at the end of the year for building and structural work. During this period the museum will take to the road, bringing Poole’s unique stories and heritage to the local community through a vibrant programme of outreach and events, including an oral history project, which will collect personal stories from Poole’s population to feature in the new galleries. The museum team will also work with teachers to develop exciting new hands-on workshops for children. The support of BCP Council has been paramount and the Our Museum project is a live, dynamic part of The Big Plan for the whole conurbation. One strand of this is to rejuvenate historic Poole, delivering a sustainable mix of culture, hospitality, and business to the Old Town, Poole Quay, and its surrounding areas. Ikea cut pay of unvaccinated staff self-isolating Furniture retailer Ikea have cut the sick pay of their unvaccinated staff who are forced to self-isolate due to Covid-19 exposure. Ikea will be paying unvaccinated workers statutory sick pay, which could be as little as £96.35 a week (The Statutory Sick Pay minimum). This is a massive difference from the average £400 a week wage (before tax) for shop floor workers that the company normally pays. Can employers legally cut sick pay for the unvaccinated? - Whether or not employers can cut sick pay easily will depend on the wording of the workers’ contracts. It may be the case that the contracts do allow it, by saying any contractual sick pay, over the statutory amount, is discretionary. However, many contracts simply state a worker will be paid contractual sick pay for a certain time. If this is the case and the employer wants to cut this, then they will have to consult with the workers about the change. Ultimately, though, the employer will be able to cut sick pay if they follow a proper procedure. Should employers implement similar measures to Ikea? Other employers may be looking to do the same as Ikea, likely for financial reasons. The first thing to do is check the contractual wording and, in any event, ensure a proper procedure is undertaken. In the end it will be a balance between the financial savings on the one hand and the potential damage to the morale of, and relations with, the workers on the other. International Trade Updates Incoterms: Dorset Chamber are here to ensure businesses remain in the know When you sell goods to another country, did you know there is more to decide than just the price, delivery terms and transportation also needs to be agreed on. You need to ask yourself, who pays for the shipping? Who completes customs paperwork? Are the goods insured? When do you know who is responsible for the goods if they get lost or destroyed? This is where Incoterms apply. Incoterms are a set of 11 rules which clearly define what is required from both the buyer and the seller. For example, if you want to arrange it so that the seller arranges everything, and the buyer doesn’t need to get involved or perhaps the seller will ship to the port and the buyer will take care of the rest or maybe the buyer wants to pick up goods from the seller’s warehouse, there are specific incoterms for all of these scenarios. Incoterms are universal and therefore when you quote an Incoterm for a shipment, your customer can look up the same information in their country. It does require negotiation when the sales contract is agreed on to make sure that you and your customer are both aware of their responsibilities within the contract. In some cases, buyers or sellers quote an incoterm when they are using a different terms rule, so please ensure you check who is responsible for what before agreeing to an incoterm. The below table clearly shows each term and which part is responsible for each step. Q&A Q: Is the use of Incoterms mandatory or voluntary? A: There’s a misconception that Incoterms are mandatory or legally required. They’re neither. However, they’re highly recommended for use in contracts for the sale of goods to avoid miscommunication. It’s also very important to state the version (year) of the Incoterm in the contract of sale. If you only specify the Incoterm, then by default, the 2020 rules will apply. It’s important to note that if a contract for sale was created prior to Jan. 1, 2020, then the former 2010 rules would apply for any Incoterms mentioned in that contract. Incoterms are updated/changed every 10 years.

BE ACCURATE. KEEP PROOF. When you’re declaring goods, you are making a legal declaration. Therefore, you must provide accurate information. Our top tip is to ensure that the figures you’re quoting on your customs declaration, or the numbers and details you’re instructing your agent to declare, are consistent in all of your documentation. Why? Because HMRC will require paperwork to support what you’re declaring. For example, your goods may attract a documentary check: if you’ve declared that your goods weigh 200 kilos, HMRC will expect to see paperwork that confirms that the weight of the goods is 200 kilos. And if you’ve done some strange calculations, arbitrarily apportioned weights and values, you may struggle to explain it or even remember what you did.

2. BE CAREFUL WITH DISCOUNTS Remember that not all discounts are allowable and just because you’ve received a discount from a trader, it doesn’t mean the value of the goods will be reduced. Remember: the value of the goods is not necessarily the price that you paid for them. For example, you could import goods that you have not paid for because they are free of charge, or they may be a gift. However, if they are worth £10,000 - you will have to pay duty on that value and not on the price paid. What are the essential things to remember when you are exporting goods? 1. PROOF OF EXPORT Make sure that you have proof of export when you are exporting goods. When you’re the trader, and you’re exporting, you’re liable for UK VAT (Value-added tax) unless you can prove that you’ve not sold the goods within the boundaries of the UK. 2. DON’T EXPORT USING INCOTERMS EX-WORKS. Make sure you use at least FCA in your contracts. One of the reasons behind our suggestion is that with Incoterms FCA you retain the export documentation control, ensuring that the goods are being exported properly and are eligible for VAT zero-rating. However, if you leave the responsibility to the seller, as with the EXW Incoterms, you’re effectively trusting a foreign party to comply with UK regulations and provide you with proof of export to support VAT zero-rating.

Swanworth Quarry in Worth Matravers, owned by Suttle Stone Quarries, celebrated its 100th anniversary The quarry currently supplies approximately 50% of Dorset’s required crushed stone to the area, which is used as a sub-base for construction schemes, rock armour on sea defence works, gabions and decorative chippings. Suttle Stone Quarries is a division of the Suttles group of companies, employing some 120 staff locally, with 55 of those employed at Suttle Stone Quarries. Originally, Swanworth Quarry was a two-man underground quarry called ‘Sheepsleights’, operating around the early 1920s. According to a book entitled Swanworth by David Pushman, it was ‘quarried by Billy Brown, and, when the mood took him, Buff Bower!’ The quarry later became ‘Worth Quarries Limited’ in 1923, with its head office in Bournemouth, producing road stone: broken blocks for foundation, crushed and graded chippings, and tarmacadam. One large contract in 1924 was to supply material for the foundation of the lower valley road between Corfe Castle and Coombe Junction, replacing the cart track that was there previously. From 1933, Swanworth Quarries Limited took over the site, at its peak producing 600 tons per day. The quarry changed hands again in 1980 to Tarmac Roadstone Limited, increasing to a peak of 450,000 tonnes per year in 1985. Today, the quarry is run by Suttle Stone Quarries (part of the local Suttles group of companies), who took it over in 2011, supplying around 50% of Dorset’s crushed stone. Although the quarry has changed hands over the years, four generations of the Samways family have been a permanent working fixture at the quarry since 1921. Thomas Samways was the first to work at the site in the early 1920s as a digger; Thomas’s son Pete Samways worked at the quarry for over 40 years as a shovel driver, along with his brothers. Carly (3rd generation) and her daughter Lauren (4th generation) currently work in the quarry’s weighbridge office, selling crushed stone from the quarry to both trade and residential customers for a range of end uses from housing and civil engineering to private garden and driveway projects. Carly said “My family has worked at the quarry for 100 years - the quarry is in our family’s blood! I love working here. It has seen a few changes over the years, although when Suttles took it over in 2011, they woke it up again. It is a real privilege to work here.” The Suttle family has worked in the natural stone and quarrying business on the Isle of

Purbeck since the 1920s, before purchasing the Swanworth Quarry in 2011. Suttles is a familyrun ethical business with sustainability at the core of its values. Suttles is working towards becoming carbon neutral and has already made many investments in the business that reduce its CO2 emissions by around 60 tonnes per year. This includes investing in a growing fleet of 19 electric and hybrid vehicles and plant; upgrading the quarry’s crusher from diesel to an electric-powered engine; and installing a solar panel system that powers the quarry’s workshop and crusher. Suttles has provided crushed stone to many high-profile projects in the area, including Compass Point Housing (Swanage), Pierhead Development (Swanage), Priests’ Way Regeneration (Langton Matravers), Durlston Country Park Learning Centre and Footpath renewal (Swanage), and the Dorset Innovation Park (Winfrith). Suttles’ Director, John Suttle added “As well as supplying around 50% of Dorset’s crushed stone, we are also keen to support community and charity initiatives, too. For example, we donated materials for the extension at Corfe Village Hall, as well as stone sub-base for Dorset Wildlife Trust’s ‘Greengage’ project, too. Suttles also sponsors and helps to organise the annual ‘Big Night Out’, a local night of clubbing for people with learning disabilities, attended by over 400 people from around Dorset.” John goes on to say “The quarry plays an important role locally; it boosts the local economy and employment levels; it significantly minimises the carbon footprint of Dorset’s crushed stone market (compared to bringing in stone from other areas) and keeps aggregate costs lower for local businesses and residents. Global residential investment outstrips offices, but retail may see 2022 return & industrial growth set to continue Research from Savills World Research team suggests that residential and industrial property will be the strongest real estate asset classes globally in 2022, and that total investment volumes bounced back very strongly in 2021 as an increasing number of funds looked to invest into real estate.

In an update to Impacts, its global research programme, Savills says that in the 12 months to November 2021 global real estate investment volumes rose 38% on the same period in 2020 to US$1.3 trillion. The number of funds targeting real estate also reached new heights as investors sought to diversify income streams: 1,250 real estate funds targeting $365 billion in capital between them were identified in 2021, according to Preqin data, up from the approximately 1,000 funds that were active in 2020. According to Savills, while global investment in the offices sector remains below pre-pandemic levels, volumes in the highly sought-after industrial sector rose 54%; this is likely to continue throughout 2022. Residential (namely multifamily, but also student and senior housing) became the largest sector for investment globally in 2021, overtaking offices for the first time. The international real estate advisor says that investors are increasingly attracted to residential’s secure, income generating qualities, robust underlying demand, and resilience against technological disintermediation, but while strong activity will continue in 2022 a dearth of standing stock means that development 38

will be the entry point for many. Paul Tostevin, Director in the World Research team, adds: “While the stats show offices were less loved than residential last year, despite the multitude of headlines about ecommerce growth they still made up a greater proportion of the global market than industrial. With cross border investors, particularly in Europe, focusing on ESG strategies in 2022 we’re likely to see opportunities to redevelop, reconfigure and repurpose office stock into high-performing sustainable assets, while in much of Asia and the Middle East the office is still very much the backbone of working life. Retail bricks and mortar, while maligned in some markets, is still at the heart of the consumer experience in China, for example, even with its extremely high online penetration rate, while in the West, pricing of some assets now looks competitive and 2022 may see more opportunistic investment in the sector.” Savills sector themes for global real estate investment in 2022: 2022 will be a turning point for retail, with repricing of recent years making the sector more competitive, at a time when retailers have

The residential sector’s rise will endure, a shortage of suitable stock driving forward funding strategies. There is potential in secondary cities as occupiers seek more affordable, liveable places. Ageing populations and an emphasis on health and wellbeing will support expansion in healthcare and senior housing, benefitting from long-term income potential. Data centres offer opportunity for portfolio diversification and there remains room for growth. Poole BID announces new directors Poole BID has announced six new Directors as it prepares for another five-year term helping to boost business in the town. Levy-payers last year voted for the ‘business improvement district’ to continue and its new board will drive it forward. They join two Directors who are continuing, and Chairman John Grinnell will stay in the role until a replacement from the new intake is elected in his stead. Jacqui Rock, the BID Manager, will be assisted by Wendy King who is the newly appointed Operations Manager. The new team is developing plans for the town as it comes through the pandemic and looks ahead to the summer season. Jacqui said: “The shadow of Covid still hangs over businesses in the town, especially those in retail and hospitality. “As a BID we will continue to work for the business community and the new directors are drawn from a diverse range of sectors. “John Grinnell, manager of the Dolphin Centre, has been Chairman for five years and is staying on until he is replaced in a matter of weeks when he will step down from the board. “His work and tireless efforts for the town have been vital in helping businesses through the pandemic. “Our focus now is to help create the best business environment we can for all our levypayers. “The new directors are full of energy and ideas and our aim is to make Poole as successful as it can be.”

Employment Alert – Dismissal for raising health and safety concerns automatically unfair What’s happening? In the recent case of Preen v Coolink (1) and Mullins (2), the Employment Tribunal found that an employee had been unfairly dismissed after raising health and safety concerns about working during lockdown. Mr Preen was an air conditioning and refrigeration engineer, providing emergency cover and routine servicing to domestic and corporate customers. In a WhatsApp conversation with his manager following the announcement of the first lockdown on 23 March 2020, Mr Preen stated that he was going to follow Government advice to stay at home and would only work if it was an emergency. In later messages, he also confirmed that nonessential work was ‘putting yourself and others at unnecessary risk’. The manager responded to confirm Mr Preen’s dismissal for refusing to work. Mr Preen was successful in his claim for automatic unfair dismissal under section 100(c) of the Employment Rights Act 1996, which states that: “being an employee at a place where there was no representative or safety committee… he brought to his employer’s attention, by reasonable means, circumstances connected with his work which he reasonably believed were

harmful or potentially harmful to health or safety”. It was held that Mr Preen’s WhatsApp messages were sufficient to meet this test and that he was dismissed as a result. Why is this important? The most recent Government guidance in response to the developing impact of coronavirus is to work from home if you can. As a result, employees (particularly those who cannot work from home) may have concerns about going to the workplace. All employers should have in place health and safety precautions and up-to-date risk assessments to respond to the threat of coronavirus. However, this will not automatically absolve an employer of liability if they dismiss or cause an employee to suffer a detriment for refusing to work based on health and safety grounds. Employers need to ensure they are taking adequate steps to address employee concerns before taking action. Depending on the circumstances, getting this wrong could lead to unfair dismissal and/or discrimination claims.

Continue to communicate with your workforce on the steps taken to protect them against coronavirus. If an employee still refuses to come to work despite the above, do not make a rash decision. Speak with the employee to try to find out the reason why and consider and respond to their concerns taking into account their individual circumstances. We suggest you take legal advice before taking any action against an employee (regardless of their length of service) for refusing to come to work because of coronavirus.

Cryptocurrencies

– the rise of digital assets: What are the UK tax consequences? As is often the case in the world, especially in the technology sectors, things are changing at an alarming rate, such that traditional assets such as gold and silver are being replaced by digital equivalents. I am of course talking about cryptocurrencies, or rather ‘cryptoassets’ (as we also now have Non Fungible Tokens – NFTs) as HMRC prefers to call them. What is a cryptocurrency? The definition according to HMRC is: “Cryptoassets (also referred to as ‘tokens’ or ‘cryptocurrency’) are cryptographically secured digital representations of value or contractual rights that can be: • transferred • stored • traded electronically” Despite them largely being designed for utilisation as a form of digital currency, HMRC does not view them as ‘money’ or ‘currency’ and instead chooses to view them as assets. Trading vs. Investing Transacting in cryptocurrencies is generally referred to as ‘trading’ cryptocurrencies, but this doesn’t automatically make you a trader for tax purposes. In order to fall into the ‘trading’ category, your income generated from the buying and selling of the cryptocurrencies will likely be your primary source of income. This in turn will mean that total profits will be treated as charged to Income Tax, rather than Capital Gains Tax (CGT).

The vast majority of individuals will fall into the ‘investing’ category and as such will be holding an asset with the intention of making a capital gain, thereby being subject to CGT on their gains. As the majority of individuals will be ‘investing’ in crypto, the remainder of this article will focus on the tax implications of this. Capital Gains Tax The amount you pay for cryptocurrency will be your base cost for tax purposes. The world of cryptocurrency is a volatile one, so it is not uncommon to incur losses in a year. These losses can be offset against gains in future years.For tax purposes in the UK, cryptocurrency assets should be treated in the same way as stocks and shares by having their costs pooled together. This means that specific ordering rules must be applied to their purchase and sales. As an example, let’s say that you purchased 10 Bitcoin in 2017 for £10,000 (£1,000 each) and then bought another 5 Bitcoin in 2020 for £35,000 (£7,000 each). This would leave you with a pooled (or average) purchase cost of £3,000 per Bitcoin. If you were to sell 1 of these Bitcoin for £20,000 in 2021, your gain would be £17,000. Allowable fees • There are fees that are tax deductible when calculating the capital gain, such as: • Fees paid for having the transaction included on the distributed ledger, • Exchange fees related to the acquisition or disposal of cryptocurrencies.

Foreign exchange fees for converting to or from, for example, GBP to USD are not allowable for tax purposes. These may be incurred when initially depositing to, or extracting from, an exchange that only operates in USD.

Negligible value claims If you lose or misplace cryptocurrency, this does not trigger a capital loss for CGT purposes. If you hold cryptocurrencies which are now worthless, then a negligible value claim could be made. This will result in a capital loss which can be offset against future gains. However, the cryptocurrencies must have been of value when bought and if during the time of ownership, the cryptocurrency fell in value this must be proved – if HMRC ever queries in the future. Points at which transactions become chargeable events If you use cryptocurrency to buy / sell in other markets, this can trigger a chargeable event. For example: • Exchange one cryptocurrency for another (for example, trading Bitcoin for another cryptocurrency) – you are realising a capital gain for the Bitcoin that you are disposing of, (this is often a point that is missed) • If you make a purchase with cryptocurrency (such as buying a car with some Bitcoin) – again, you are realising a capital gain for the Bitcoin that you are disposing of, • Even being paid in cryptocurrency by an employer instead of in regular currency – you are receiving an asset which has a value which will be the base cost for a future disposal. The proceeds to use in a capital gains calculation is the value of the asset that you are acquiring with your cryptocurrency (which is the deemed disposal). It is therefore recommended to keep detailed records of all the cryptocurrencies you buy or sell. Summary The cryptocurrency sector is an extremely fast-paced one and HMRC is aware of them being more widely used, including as replacements for traditional currencies, so expect close scrutiny in the future.
