Common Real Estate Mistake I spoke with local California Licensed Professional Fiduciary, Laura Benintend, who specializes in Real Estate Investment and Management, about this issue. “Yes, it’s a common mistake with refinanced real estate. Ideally, a good loan officer would make sure the property is returned to the trust, but ultimately, it’s the homeowner’s responsibility to make sure they do it. Keeping property in a trust is the main point of having a trust in the first place. I have had cases where this happened and wasn’t discovered until they passed away. It’s difficult and time-consuming problem to unravel, especially if the refinance was done many years in the past. It can be undone but it’s more work and will prolong the distribution of trust.”

Peace of Mind Tracy’s tale is a great reminder to homeowners who took advantage of ultra-low rates last year by refinancing their mortgage – and there were many. According to PRWire News, 1.69 million refinance mortgages secured by residential properties (1 to 4 units) were originated in the second quarter of 2020 in the United States. That figure was up almost 50 percent from the prior quarter and more than 100 percent from the same period in 2019, to the highest level in seven years. (ATTOM Data Solutions). Cautionary Tale: Recently, our own publisher, Tracy Pendergast, experienced an unsettling event when she received an alert from her LifeLock account informing her that the deed to her home had been changed. “I had heard some talk about a Title Scam, where thieves were changing titles and selling homes out from under the resident. I immediately called one of our PREMIER agents who assured me my title was safe.” After doing some research, Tracy discovered that her home was taken out of her Living Trust during her refinance in October and was not returned to her Living Trust after the loan had closed.

Protecting Your Biggest Asset For many Californians real estate represents a sizeable portion of an individual’s assets. Keeping real estate in a living trust is a common way to avoid substantial probate costs for your family/beneficiaries, so not holding property in the trust defeats the purpose of the trust.

Why is a home removed from the trust? It’s not always required to remove a home from the trust in order to

a copy of the latest deed at the San Diego County Registrar’s Office or call the title company you used when you refinanced your loan and have them look. If your home is not held in your trust anymore, you will need to record a deed transferring it back. A real estate attorney or title officer can do this for you. If you are planning to refinance in the future make sure you ask your title company prior to signing the paperwork. There is a form they can use to keep it in your trust, but for some reason this isn’t always done unless you ask. If you don’t ask, it can just slip through the cracks.

Additional items to know about Real Estate held in your living trust: • Property tax reassessment: If you designate yourself as the trustee, many states, including California, will NOT require a tax reassessment when you transfer property into your trust • You can still deduct mortgage interest from your income taxes for real estate held in a trust • Tax breaks for the sale of a home: You can exclude up to $250,000 of profit from your taxable income when you sell your principal home, even if the trust owns the home. If there are co-owners, such as spouses, this exclusion is doubled to $500,000 (Real Estate Placed in a Living Trust, Legalzoom.com)

Historically spring is the hottest time to buy and sell real estate. As we head into this spring season with an already booming market, we don’t see this year being any different. The only major headwind is a lack of inventory. California Home Sales Rise Solidly in February: California Association of Realtors (C.A.R.) released its official statistics for statewide prices and sales for the month of February. Existing, single-family home sales totaled 462,720 in February on a seasonally adjusted annualized rate, up 9.7 percent from February 2020.
