When I was a young girl I once nearly drowned. It was terrifying.

lthough I was a strong swimmer I misscalculated the enormity of an approaching wave. I was engulfed by the water mass and I remember the weight of the water pushing me down into the depth of the ocean. I fought and

struggled to find my way up through the water towards the light and most importantly the air that could fill my aching lungs. I remember the anxiety as I felt my lungs releasing the bit of air that was still within.

The average person can hold their breath for 30 to 60 seconds, and once you run out of breath under water, your chance for survival is slim. I was running out of air. I tried to look up to see sunlight, and then suddenly the weight of the water subsided and for some seemingly inexplicable reason (or so it seemed in the moment), I suddenly had a huge burst of energy, and the will to get out of the predicament emerged. I could feel myself going up faster and with more force. Maybe I could make it. Perhaps I would make it. Clinging to the hope that I would make it! Breaking through the water-ceiling, I at once filled my aching lungs with the gift of air! This event of near drowning made me reflect on the magic of hope. I realised that hope is to the soul what air is to the lungs. Without hope, the soul dies a slow and painful death. When people lose hope, they lose their ability to dream for the future. Despair replaces joy. Fear replaces faith. Anxiety replaces peace. Insecurity replaces confidence. Tomorrow’s dreams are replaced by nightmares. Without hope, life becomes meaningless. When spouses lose hope, they give up on their marriage. Parents give up on their teens. People give up on their leaders. Healthy emotions like contentment and peace are replaced with the toxic emotions of confusion, shame, worry, and disappointment. HOPE is important! The soul needs hope to survive! When you have lost hope, you have lost everything. And when you think all is lost, when all is dire and bleak, there is always hope. Twenty six years ago I gave birth to twins, two months premature. My baby daughter and baby son weighed a mere 1.5kg and 1.6kg respectively and their chances of survival were

slim. Three days after their birth my precious son passed away. I was devastated. Yet despite the enormity of my loss and sadness, I started focusing on my baby girl. My whole being became focused on the hope of keeping her alive. The challenges of pumping breast milk, feeding her through a tube, making sure she was warm in order not to lose energy and weight as a result of this, bathing her small fragile body, holding her for hours on end while sitting in a hospital ward from 5am to 11pm at night…. everything I did was in the spirit of hope. Hope that she will survive and that I will be able to keep her and guide her through life. Victor E. Today my daughter is a beautiful strong young woman, a lawyer and a light to all who meet her and a great blessing to her family.

In the times that we are living we need hope-givers more than ever before. As South Africans we need to speak of hope and possibilities and then we need to get up and make it work. “Our human compassion binds us the one to the other - not in pity or patronizingly, but as human beings who have learnt how to turn our common suffering into hope for the future.” Nelson Mandela I am reminded of the words of Desmond Tutu: “Hope is being able to see that there is light despite all of the darkness.” Let us choose to be the light in order to kill the darkness. Let us start breathing hope and start living in the possibility of a great future.

If Durban is able to offer the best lifestyle in South Africa and the best returns on investment, then it is not surprising that the local property market has continued to exhibit such resilience despite facing volatile political headwinds.”

esidential property is unique in that it comprises both “lifestyle” value which speaks to the emotional factors affiliated with property as a “home”; but also “investment” value which is attached to the clinical and economic viability of property as an asset class. Buyers generally fall into either the end-user category, seeking lifestyle ahead of long-term investment value; or the investor category, where returns and capital appreciation are paramount. Some properties are able to tick both boxes, and some areas are well-positioned to keep both end-users and investors equally satisfied. Against this backdrop, I was delighted to stumble upon some international research that held Durban in high esteem on both counts. Indeed, Durban has been ranked number one in South Africa for its lifestyle offering as well as its rental returns, ahead of both Cape Town and Johannesburg. I thought it would be useful to explore these findings in greater detail. Sandra Gordon, our Pam Golding Research Analyst, recently shared the results of a survey conducted by a London-based online estate agency, namely, Nested. Nested created the 2017 Property ROI Index to gain a better understanding of global variations in real estate prices from an investment perspective. Their survey included thousands of properties, either recently sold or currently listed, across 75 global cities in order to calculate the average price of a three-bedroom property. The company then calculated how long it would take for an investor in each city to recoup the property value using Airbnb and the traditional rental market. According to the index, investors in Durban can recoup the value of their property in 167 months using the traditional rental market and just 18 months via Airbnb – the shortest time period worldwide. Thus, Durban was ranked number one globally for its property rental returns. A significant finding that should bring comfort to our local investor market. Lagos was ranked second (at 22 months via Airbnb), followed by Cairo (at 23 months). Johannesburg was ranked fifth, with a repayment period of 180mnths in the traditional rental market and 33 months using Airbnb. Cape Town was ranked in 12th position – taking 205 months to recoup the property value using old school rental markets and 50 months using Airbnb.

However, returns are not the only factor that investors take into consideration. Durban does exceptionally well when taking returns into account, because the ticket price of properties in Durban is lower than that of Cape Town. Indeed, the Cape Town market has seen tremendous growth in the past few years, resulting in returns worsening relative to ticket price. Durban has been slower to grow, but annual price inflation has still been positive when compared to the national average. Cape Town has seen growth of north of 10% per annum for the past three years, with Durban’s growth coming in at around 6%. Umhlanga has enjoyed growth of over 9% per annum and Johannesburg prices have grown at a rate of 4.5% per annum. The national average has been sitting at approximately 4.8%. Durban’s rental returns supersede the other cities with averages of 8% per annum being achieved in the main metro suburbs as compared with the KZN average of 6%. Cape Town’s returns were 9% in recent years, but are now closer to 7% and Johannesburg’s returns are around 5.5%. The national average for rental returns according to the TPN/FNB index is 5.85%. This means that investors seeking the best ROI would be wise to consider the Durban property market. Thus, we have established that property in Durban ticks the investor box, but how does it fair from a lifestyle perspective? Mercer conducts an annual

survey each year in which it ranks cities across the globe according to the quality of life that their residents enjoy (the Mercer Quality of Living Index). In 2016 Mercer ranked Durban as the top South African city, for the third consecutive year, ahead of both Cape Town and Johannesburg. Internationally, the survey ranked Durban 87th in the world, Cape Town followed behind in 94th place and Johannesburg was ranked 96th. Again, Durban’s climate, coastline and convenience, have resulted in the city achieving international acclaim. This global recognition has put Durban on the map, which has also sparked interest from a property perspective. It is indeed encouraging to see KZN coming to the fore, not only as a great place to live, but also because it offers a fertile investment market with excellent rental returns. Our recently launched developments in Umhlanga and Sibaya have attracted foreign investors from Dubai, the UK and Germany. If one applies a longitudinal lens, this could be the beginning of KZN’s season in the sun, where the gap between prices in Cape Town and KZN begins to close. Finally, it seems that foreign investors and locals alike have discovered the city in South Africa that keeps coming up trumps!

It’s certainly been a very exciting period for retirement on the North Coast of KwaZulu-Natal (KZN).

T

he Retire KZN campaign, initiated by Tongaat Hulett Developments, has highlighted the benefits of retiring within KZN, as well as emphasised the similarities that the region shares with Florida, where 19.1% of the population is over the age of 65, and boasts similar facilities and attributes.

The result is that many of the largest developers in the country are now in the process of developing, or planning, retirement opportunities within KZN, particularly between Umhlanga and Ballito, which is significantly different from years gone by. The new decision makers in the retirement space are the Baby Boomers (born between 1946 and 1964). This generation is very specific about what they want, which is resulting in a real evolution from retirement as we have always known it, and creating a shift in the aging paradigm based on people living and working for longer than they did before. Whereas the generation before, known as the Silent Generation, was accepting of traditional retirement homes. The Baby Boomers are independent thinkers who want to do things on their own terms and who are generally a lot more skeptical about the holistic concept of retirement. The true challenge for developers, and marketers, is to help Baby Boomers understand the need for retirement planning, and to then give them what they are looking for, at the right price. Many Baby Boomers understand that retirement is an unavoidable reality, but the general mindset is that they would still try and avoid making the decision for as long as they can, which is potentially a fundamental oversight in a very key phase of retirement / annuity planning.

The developers who can overcome this are those who can place less emphasis on “retirement” and expand more on the lifestyle and hospitality benefits, focusing on health and wellness, incorporating technology, prioritising outdoor spacing, creating multigenerational living and pushing smart, contemporary architecture. It’s no coincidence that the new surge of retirement developments are being led by developers of significant substance, such as the likes of Collins Residential and CenProp. These developers understand that it’s not a simple market and that success is driven by a commitment to putting in the right infrastructure upfront. Most traditional residential apartments, homes or land are comfortably sold off-plan, but in the retirement space there is a much greater need to “touch-and-feel” the product, which means that there is generally a significant increase in sales once homes are complete for prospective buyers to view first-hand. One of the most interesting shifts in the world of trends over the last few years has been a renewed focus on emotional and mental wellbeing.

F

or a long time, people were expected to act supremely rationally in the public sphere. In business, particularly, professionalism is equated with a certain emotional stoicism. But increasingly what we’re seeing is an understanding that emotional health isn’t about suppressing feelings, it’s about owning and validating them. That’s why it’s a major theme in the ITI Macro Trend Review this year. This shift in consciousness is changing the way we engage with each other and our world, and it’s rewriting the rules in all kinds of interesting ways. The first thing we’re seeing is people really celebrating emotions rather than trying to avoid them. At a very conceptual level, for example, a designer named Yi-Fei Chen developed a gun that freezes the user’s tears and then allows them to shoot the person who emotionally wounded them in the first place. But people are celebrating positive emotions too – happiness is increasingly on trend as we’ve seen in the so-called “Dopamine Dressing” movement. This comes from the insight that, for many people, clothing can make you happy. So what designers are doing is celebrating the bizarre and outlandish with bright colours and crazy patterns. It’s a reaction against minimalism – where everyone is ultimately the same – and gives people the chance to express themselves and their feelings through their wardrobe. We’re also seeing emotions being explored in the world of technology too. These two seem like strange bedfellows, but ultimately it’s another way that tech is increasingly seeping into our lives. Emotional wearables, for example, are a growing industry at the moment. Unlike traditional wearables like Fitbits and the like, which measure things like movement and heart-rate, emotional wearables allow you to track your feelings and then understand what triggers them. The idea is that you can become more emotionally

literate by connecting the physical reality to the emotional experience, and as a result, improve your performance. At a more conceptual level we’re also seeing tech designers looking at investing their products with “emotional intelligence.” Honda’s new NeuV concept car, for example, has an emotional intelligence engine to understand how the driver is feeling – and theoretically nudge you towards being a better driver as a result. One of the more heartening spin offs of this trend is people increasingly talking about mental health and wellbeing. Ruby Wax, for example, partnered with Marks and Spencer to make use of their in-store restaurants to hold “Frazzled Cafés.” Here, people could come together and just discuss the things that were stressing them out. It wasn’t seen a substitute for formal therapy, but just an acknowledgment that life can be stressful and sometimes it helps to talk about it. On the other side of the world, we’ve also seen “Friendship Benches” in Zimbabwe. This is a grassroots intervention where people who suffer from conditions like depression can meet community mental health workers in a nonthreatening outdoor environment and talk about their situation. It’s about making therapy accessible to everyone and acknowledging that mental health is an issue that affects us all. The big issue under all of this emotional exploration is the idea of empathy. It’s easy to disregard the lives of migrants and refugees, for example, when you can’t conceive of where they come from. And in this country, it’s often difficult for groups to understand why others are so angry, frustrated or emotional about certain issues. It’s a lack of connection that means we’re not able to resolve things as a society, and it’s only if we manage to overcome this that we can move forward together.

The house stands proud on its steep site and is a progressive cantilever form arranged over three cascading levels that proclaims its presence and pioneers a paradigm shift in the architectural design language of its contexts. The entrance façade is intentionally low slung, minimalist and austere and hard up against the western site boundary, resulting in an architecture that visually engages with the street. A linear plan form stretching across the entire width of the site is set back from the street by the width of a double garage structure. This allows for maximum open and sheltered private space

FINANCIAL INTELLIGENCE CENTRE ACT

Will the revised Act still be a four letter word?

T

he Financial Intelligence Centre Act (FICA) has been operating since 2001 and South African citizens will be happy to note that it has recently been revised to bring it into alignment with global practices, as well as to toughen up its focus of fighting money laundering as well as the financing of terrorism. FICA BEFORE ITS REVISION When FICA first came into play, South Africa opted for a more blanket approach which meant that everyone was subject to FICA, ultimately affecting the entire population. Every time someone opened a new account, took a new insurance policy or entered into any financial based agreement (buying property, bonding, investments, etc), they were obliged to submit FICA documentation, and an identity document as well as proof of residence were required each time. In other countries, we saw a more riskbased approach being taken, in which case the focus was based on the risk involved with that particular client / type of client. In South Africa, there are numerous instances of people having to repeatedly re-submit FICA documentation which has become frustrating for both businesses and their clients.

The FICA process did not allow for any exceptions and if you failed to submit your documents on time, you would not be able to use your bank account or process any financial transaction. THE MAIN CHANGES From June 2017, the revised FICA requires a risk-based approach in order to bring it in line with Global practice. The revisions come into effect in a two-pronged approach, the first being in June and then the balance following on October 2017. Essentially, Financial institutions will need to identify both foreign 'Prominent Public Officials' and domestic 'Prominent Individuals' and Due Diligence will be an ongoing process. 'Know Your Customer' (KYC) now means that officials need to assess the risks involved with the above mentioned customers and not just the individual but also whether they operate via any trusts or other legal entities. There is a list of people who may qualify as domestic Prominent Individuals; such as politicians (both local and national), officers of State Operated Entities, CEOs and finance directors of large companies. Ongoing due diligence will need to be done on these groups of people and the onus is on the financial institution to ensure compliance with FICA. South Africa has signed International agreements and will thus assist the United Nations Convention against corruption; accordingly the Act gives the power to freeze transactions for ten days whilst

investigating potential perpetrators. Perhaps most importantly, it will make things more difficult for money launderers and other fraudsters to commit crimes. The implication of this is that FICA should become relatively straightforward for most people as the previously onerous requirements of FICA should lessen for them. For now, all we can do is wait and see but the idea behind the amendment should make it easier for most businesses and individuals.

Often when we think of saving, it’s for a short- to medium-term goal such as a holiday, or a down payment on a house. But what about thinking further into the future? One of the best ways to do this is to consider saving in a retirement fund.

W

e have found that political uncertainty and market volatility, not to mention the pressure of a shrinking economy, may lead many investors to allocate the bare minimum to retirement funds.

These funds, however, offer many distinct benefits that you may not be aware of, and reducing retirement savings due to shortterm pressures may not be in your long-term best interest. This is even more pertinent as we are living longer, and retirement savings will probably have to be stretched. Therefore, any overall savings plan must take retirement savings into consideration. What counts as a retirement fund? A retirement fund is a pension, provident or retirement annuity fund that is used to house and grow your pre-retirement savings, so that you can generate an income from your investments once you retire. Now I am sure all of us know a relative or friend with a horror experience of contributing for years and years to a retirement annuity only for it to mature with a lot less than they expected; or they signed up for something with excessive fees; or when they tried to pause premiums for affordability reasons were faced with substantial penalties. While unfortunately a variety of those products still exist, modern platforms – such as that offered by PSG – operate at far lower fee structures, do not impose penalties for changes you make, and even offer direct share portfolios within the retirement wrapper. They truly have embraced the flexible needs of today’s savvy investor. However, many people are not aware that retirement funds also allow you to offset contributions that were not previously deducted. They can be used to lower the tax payable on the lump sum cash portion taken at retirement, and even the tax payable on the income from your annuity.

Sound investment principles Retirement funds are regulated by the Registrar of Pension Funds, governed by Boards of Trustees, and must adhere to the asset allocation limits as set out in Regulation 28 of the Pension Funds Act. Regulation 28 aims to protect the investor by encouraging sound asset allocation decisions. By limiting the exposure to certain types of assets, the regulator aims to ensure that investors don’t ‘bet’ all their money on a potentially volatile asset class, putting their ability to retire as planned at risk.

There are a few small steps to follow to make infant massage successful. Keep interaction the main aim, rather than getting the massage routine right. Keep in mind, touch is natural, and massage is simply stylised touch.

assaging your baby allows for bonding, ensuring extra feel good hormones are released by baby, mum and dad. And if you are lactating, prolactin and oxytocin are released ensuring a plentiful milk supply. Get the room ready. Usually babies are “in the buff ” when getting massaged, so ensure the room is warm, put on a heater and close the windows. If you find a heater too hot and uncomfortable for yourself, then preheat the area with a heating pad under the bed linen, then switch off or onto low once you start. Ensure items like a spare nappy, massage oil and milk are ready. Babies can get thirsty after and during massage. Often it’s giving your baby the comfort of a familiar feed that allows you to continue massage. Just be warned, if your baby does feed in between, no tummy massage. Use cold pressed vegetable oil. You may ask why not just use any oil or lotion? Cold pressed oils retain their natural antioxidant goodness. This means minerals, vitamins and omegas can be absorbed by your baby’s skin. Also, if baby puts her foot/hand into her mouth or eyes, there will most likely be no reaction. Steer clear of nut oils though, until you have established your baby’s unique allergy tolerance. I find

The legs and arms are probably the best place to start massage, whether you have done it many times before or this is your first try. This is because it feels safe for your baby, and it is easier for mums and dads to control a leg or arm. Keep the strokes going in an upward direction towards the chest, this improves blood flow around the whole body. Some babies do not like massage, and so here you have to choose whats best for your baby. Keeping massage sessions to just the legs for a while, and keeping sessions short is one way to ensure success. Under 7 minutes. Increase this time slowly, and suddenly you will have your kids lining up for their daily dose. Babies sometimes love massage and then suddenly not. And it may also indicate that baby has had a stressful day, and so extra cuddles are required.

Keep it fun and light-hearted, a time for bonding, a time to reconnect after being apart and for getting to know one another. Massage can help increase sleep, improve restless sleep, reduce muscle pain for toddlers who are just crawling and walking while improving motor skills, massage can reduce stuffy noses, and can improve digestion. At times babies appreciate songs or rhymes and talking during the massage, simultaneously stimulating language skills. And yet, at other times, a quiet peaceful room, to increase sleeplessness, is most useful.

ne reason, for example, is that prior to 1996 and the introduction of the Constitution the ‘fairness’ of a contract was not generally relevant to its validity.

Our law still follows the legal maxim pacta sunt servanda which translates to “agreements must be kept”. This means that whatever is agreed to in a contract must be upheld. If a party fails to uphold their end of the bargain, they can be forced to do so by a court order and may be ordered to pay damages.

application, is unfair to the point that it offends against public policy, our courts are unlikely to uphold such an agreement. This approach was recently illustrated in a judgment in the Johannesburg High Court in Mohamed’s Leisure Holdings (Pty) Ltd v Southern Sun Hotel Interests (Pty) Ltd.

The basis for the general rule is that when parties knowingly and voluntarily agree to the terms of a contract they should be held to their agreement.

Mohamed’s leased property from Southern Sun. In terms of the lease, rent was due by the seventh day of each month. Due to an error by Mohamed’s bank, payment of one installment was late. On discovery of the late payment, Mohamed’s immediately paid Southern Sun, with interest.

The exceptions to the rule were few and included instances where the provisions of an agreement were illegal, or so offensive as to be against the good morals of society.

However, Southern Sun canceled the lease and claimed damages on the basis of the late payment and they were entitled to do so in terms of the lease.

The benefit of a strict application of the rule is legal certainty. This certainty assures businesses and members of the public that the agreements they lawfully conclude will be carried out and, if not, they can obtain redress in court.

The clause allowing the cancellation was not necessarily unfair (it is a common clause in leases), but the court had to decide whether to allow the application of the clause by strictly applying the general rule, or to relax the rule and refuse the claim on the basis of fairness.

Since the Constitution, our law has been developed by the courts to recognise the imprecise principle of fairness when deciding whether to enforce an agreement. If it can be shown that an agreement, or its
