CUSTOMER VEHICLES – DRIVER RISK Customer's Vehicles can be Insured under a "Composite" (Part A] and B]) Policy or under a Public Liability (Drivers Risk Extension) only. rd A composite policy covers the Vehicle as well as Road Risk (3 party) Liability whereas the Drivers Risk extension under Public Liability only covers Damage to the Customers Vehicle by your "Negligence" which may create goodwill problems for the rd customer. Further "Drivers Risk" extension may not include Road Risk (3 party) exposures ie. Damage to other Property when you are test driving a customer’s vehicle (check the schedule of cover). FAULTY WORKMANSHIP Policies do not cover that part of the work you have done, only the Resultant Damage to other property. The cost of rectifying your work ie, "warranty" is excluded unless expressly noted to be covered. Property of the Clients, can be insured under 1. Asset Cover under ie., Fire and Perils or Burglary, and Composite whilst test driving Driven/Delivered, provided it is nominated and sufficient sum Insured. 2. Liability Sections only such as CCC (Storage) and Drivers Risk. However the insurer will only respond for Losses caused by Legal Liability of Negligence and not for Goodwill to the Customer. This is same principle as a “cartage” that has your cargo (see cartage in this directory). The correct architecture of civil matters is for the client to insure their goods and you to insure your liability.

SPECIAL NOTES: Liability: Boat/Vehicle Liability is attached to a Boat or Vehicle policy so it only applies if the damage/injury physically is caused by the Boat/Vehicle (there are some exceptions). 9 You will need a General Public Liability policy when the Patrons are not in the Boat/Vehicle. Liability – Duty of care. 9 The legal obligation is proportionate to the degree of hazard of the event and the degree of control you have over the activity ie., a booking agent is not as obligated as the host of the activity. 9 A specific service carries more obligation than a general service ie., a tour/charter driver as opposed to a taxi. The tour operator would have more knowledge of and about the dangers of a specific location or activity than a general service. 9 Should have patrons sign a waiver of liability disclaimer form (we have samples available) 04/04/06 DOMESTIC WAGE/SALARY CLIENTS STATIC/MOBILE Min prem † DOMESTIC RISKS † Boat - Hull/Motor/Sails/Accessories Liability for Hull/Aquaplaning/Passenger/Food and Drink $250 † Caravan - Mobile or Fixed site - Van, Annex, Contents $200 † Disability – Work and Private or Leisure time only (Accident/Lump Sum/Illness) $250 † Home Pack † Building/s† Contents † Multi Risks † Specified † Unspecified $250 † Motor Vehicle - Cars/Trailers $400 † Workers Compensation - Domestic Workers only $200 † Health Insurance - Private for extra benefits † Life/Trauma, †Superannuation

Other comments Most policies are offered on 12 mth period so start cover now, in case people are the site before works actually begin. Most insurers will not consider the risk if the works have already commenced. Why… Their concern is that there may already be damage. If you are renovating you need to make provision for existing buildings as it MAY NOT be protected by a standard home policy. If you are an Owner Builder the Liability section of this policy will not respond if you damage your existing property! (Liability is to 3rd parties). Customers Goods are not covered under the "CCC” extension of a Public Liability policy. Why? because there is a dedicated policy for Cargo, the risk is to be secured under "Carriers Liability" or “carriers Cargo” policy. Note:‰ “Carriers Liability” only covers loss/damage through your "Negligence" if you are legally Liable. The insurer will expect you to operate with a consignment note” (this liability disclaimer forewarns the client that you deny liability). ‰ “Carriers Cargo” policy only covers loss/damage through defined events (usually restricted to “silver” = defined events). The Liability is cheaper but only for negligence so it may create a goodwill problem to your client so consider a “cargo” policy… but then again shouldn’t the client be insuring their own goods? ‰ The purchaser or seller can arranger their own “Gold” level cover (you should have Liability cover in case the clients insurer tries to recover against you. This is same principle as a “Garage” that has your vehicle for repairs (see auto trade in this directory). The correct architecture of civil matters is for the client to insure their goods and you to insure your liability. MV Road Risk Liability – Non Owned Trailer Liability. A serious exposure. If the insurer of the trailer can demonstrate Damage attributed by your Negligence they will subrogate (attempt to recover from you). Some Insurers offer Composite cover – chec ktheri wording rd rd A Public Liability exposure is separate and distinct from the 3 party Liability included in a Motor a Vehicle policy. The 3 party Liability attached to the Vehicle policy covers damage caused by the truck. The General Liability policy covers all other aspects of your business other than those involving the truck.

The courts have returned a variety if different interoperations of "IT" losses and it is not known if existing stand alone "Public" or "PI" policies cover the gaps and therefore it is prudent to take the new "hybrid" policy to address the fast changing Technology market. 04/04/06 DOMESTIC WAGE/SALARY CLIENTS STATIC/MOBILE Min prem † DOMESTIC RISKS † Boat - Hull/Motor/Sails/Accessories Liability for Hull/Aquaplaning/Passenger/Food and Drink $250 † Caravan - Mobile or Fixed site - Van, Annex, Contents $200 † Disability – Work and Private or Leisure time only (Accident/Lump Sum/Illness) $250 † Home Pack † Building/s† Contents † Multi Risks † Specified † Unspecified $250 † Motor Vehicle - Cars/Trailers $400 † Workers Compensation - Domestic Workers only $200 † Health Insurance - Private for extra benefits † Life/Trauma, †Superannuation

SPECIAL NOTES: 1. A Public Liability policy is not designed to cover watercraft use/activities. It’s limited to 5 to 8 mtrs, thereafter restrictions apply (legal control, possession, use). It’s not as dynamic as cover under a ship repairers policy (specially designed to address exposures of Maritime Laws) see next notation. The decision to have more covers is a balance of economical and the extensive nature of your work ie., commercial structural work of vessel. 2. "Ship Repairers" Liability is only for "Boat work", where your work effects the structural / mechanics of the vessel (ability to float) you also need to continue with a "General Public" Liability policy to address the "General (land) and Administration” activities of the business. 3. "Boat Builders Risk" is used to insure the Vessel during construction and Trialing including Liability from the activity (similar to a Land Based Construction Policy). For more information refer to our “Client product Library” (website) or call to discuss. Note – we have a special FAQ listing on this topic in our Public Liability faq’s “Marine Tradespeople what is proper cover” 04/04/06 DOMESTIC WAGE/SALARY CLIENTS STATIC/MOBILE Min prem † DOMESTIC RISKS † Boat - Hull/Motor/Sails/Accessories Liability for Hull/Aquaplaning/Passenger/Food and Drink $250 † Caravan - Mobile or Fixed site - Van, Annex, Contents $200 † Disability – Work and Private or Leisure time only (Accident/Lump Sum/Illness) $250 † Home Pack † Building/s † Contents † Multi Risks † Specified † Unspecified $250 † Motor Vehicle - Cars/Trailers $400 † Workers Compensation - Domestic Workers only $200 † Health Insurance - Private for extra benefits † Life/Trauma, †Superannuation
