In the official annals of the Land Transportation Office, the first formal traffic law in the Philippines was enacted in 1912 by the Automotive Section of what was then known as the Bureau of Public Works and it is only in 1964 that the Philippine Congress passed Republic Act 4136 otherwise known as the Land Transportation and Traffic Code of the Philippines. Amendments to R.A. 4136 were implemented thru the years but R.A. 4136 remains as the basic law of Land Transportation.

After the change of leadership of LTO on November 2013, the new management team of Assistant Secretary Alfonso V. Tan Jr. and OIC-Executive Director and concurrent NCR Regional Director Emiliano T. Bantog Jr. vigorously pursued the review of the core processes of the LTO on Drivers License Process, Registration Process, and Law Enforcement and Adjudication Process.

Based on the Review Committee’s report and recommendations, reforms were introduced in the registration process. The Stock Reporting of Manufacturers, Assemblers, Importers, Rebuilders, Dealers and Other Entities (MAIRDOEs), was made a Do-It-Yourself, where the uploading of the motor vehicle data is done by the MAIRDOEs themselves. Now, the LTO can no longer be blamed if there is a delay in stock reporting and printing of the Certificate of Stock Report. Stock Reporting is the initial phases of motor vehicle registration. The succeeding sales reporting and actual registration of motor vehicle is now done in the Regional Office. The objective is to reduce the processing time by integrating sales reporting and registration. Unlike before where the dealer can sales report anywhere and register anywhere. The motor vehicle inspection for roadworthiness is also being strengthened. Corollary, the Plate Standardization program was implemented.

Under law enforcement and Adjudication, the Joint Administrative Order on the Revised Schedules of Fines and Penalties of Violations of Laws, rules and regulations covering Land Transportation was implemented.

Anticipated to follow are the reforms and enhancements of the Drivers Licensing Processes, starting from student permit, the lecture and examination, the actual driving test and the validity of the drivers license including the continuing education for public utility drivers. Provisions of R.A. 4136 which remained unimplemented like the five (5) years validity of drivers’ license are expected to be put to practice.

From 1964 to date, different officials had held the helm of the LTO. Some stayed for years and some stayed only for a while. Each leader had instituted programs/reforms that were intended to further the objectives of the agency. The former officials have left their own legacy for the LTO and they have their own style of management. It was however the impression of LTO insiders specifically in region 1, that the present leadership hit the ground running with the various programs being implemented in a very short period of time. The sweeping change occurring within the LTO deserve the unstinting support and full cooperation of all LTO officials and the rank and file in region 1.

By: Manilyn D. Milanes In March 10, 2014, the New Registration Office of Land Transportation Office Region 1 started to register all types of new motor vehicles.

Motor Vehicles as defined under RA 4136 section 3, shall mean any vehicle propelled by any power other than muscular power using the public highways, but excepting road rollers, trolley cars, street-sweepers, sprinklers, lawn mowers, bulldozers, graders, fork-lifts, amphibian trucks, and cranes if not used on public highways, vehicles which run only on rails or tracks, and tractors, trailers and traction engines of all kinds used exclusively for agricultural purposes.

Trailers having any number of wheels, when propelled or intended to be propelled by attachment to a motor vehicle, shall be classified SUV as separate motor vehicle with no power rating.

INNOVATIONS&DEVELOPMENT

Candon DO, is the entry of the LTO Region 1 from the recently conducted search for CY 2013 Outstanding District Office on the occasion of LTO’s 102nd Anniversary Celebration.

The nomination was supported by the PRAISE Committee Report with the following excerpts.

The metamorphosis of LTO Candon District Office from an obscure deficient operator to a competent frontline service provider is thoroughly presented in the foregoing manuscript, paving the way for this nomination.

“Making a Difference” was the initial battlecry of Candon District Office upon the leadership turnover at the Regional and District Office levels in December 2012. At the close of CY 2013, the battlecry became a reality with the unfolding of a totally transformed LTO Candon DO inside and out.

Overall, there was management commitment in terms of infrastructure project which includes office building renovation, perimeter development and facilities -utilities-equipment provision. These rekindled the spirit

among its employees. These resource provisions produced a “ripple effect”, regaining and restoring trust and confidence of stakeholders and the public clientele, and ultimate leading to the overwhelming attainment of its performance targets for the year and exceeding previous year’s accomplishments.

Good Governance in the District Office is evident in the top regional rankings attained in Reports Preparation. Financial and MIS reports were accurately prepared and submitted on time. The imposition of correct MV & DL fees, and law enforcement fines and penalties, the timely remittance of the collected fees speak of the District Office’ adherence to office policies giving a high regard for accountability having incurred no losses of accountable forms nor cash shortages. Personnel welfare and holistic development were further enhanced through capability-building seminars/trainings in all aspects, not to mention the conduct of activities such as Mabuhay Pasasalamat Programs for its retiring employees.

The District Office activity OPISMO, HAWS MO paved the way for the removal of unnecessary items in the District Office, further resulting to an effective and efficient PROPERTY & RECORDS MANAGEMENT of the office. Painstaking efforts were made in conducting an inventory of equipment, accountable forms, storage plates, obsolete tags and stickers and recommending these unserviceable items for disposal. These efforts translated to easy updating and inventory of equipment and accountable forms, plates and stickers.

The de-clogging of transaction records in motor vehicle registration and the provision of fabricated steel filing racks led to a secured Records Room and an or-

Innovations & Development in full gear through dissemination of office policies in broadcast media, a PERIODIC COLUMN in a LOCAL PUBLICATION dubbed as LTO BOSINA :SALUDSOD ken SUNGBAT (Question and Answer in local dialect), speaking engagements in schools, continuing meetings/dialogue/consultation with motor vehicle dealers and local officials and active participation in crafting of several local ordinances relative to land transportation.

The newly constructed landscape and signage of LTO Candon DO. derly filing system, the end-result of which is the easy retrieval of transaction files.

The QUALITY OF WORKPLACE was greatly improved foremost through the infra-project of the local government of Candon, i.e. the riprapping of the retaining walls of the office as part of the LGU’s flood control project thus preventing further soil erosion and ensuring safety of government property. Consequently, the office perimeter was further developed, providing for a more spacious motor vehicle inspection area, parking area and a Customers’ Waiting Area with new airport chairs, queuing system and paging/audio-visual equipment.

The transformations, so passionately worked for by the District Office workforce, truly “made a difference” not only in making an edifice come alive but more importantly, a continuing “difference” in the delivery of frontline services which the customers so rightfully deserve.

Employees’ working area and comfort rooms were renovated, a pantry and eco-garden were likewise constructed to enhance quality of workplace for internal customers.

Along with these physical enhancements, the Quality Management System for Driver’s License Processing was continuously implemented and Good Housekeeping Practice is sustained.

On CUSTOMER FEEDBACK, a good rapport with stakeholders, the transacting public and local counterparts made no room for any negative customer feedback during the year. Information campaign efforts were

By: Eric C. Suriben Lingayen ------ The newly renovated office of LTO Lingayen District Office (DO), a structure of style in the center of the province of Pangasinan is now fully equipped in dealing with the registration of roadworthy motor vehicles and license quality drivers.

The renovated facilities include: Lecture Room for drivers license applicants, Registration Section, Client’s Waiting Area, Records Room, Supply Room and a more conducive and spacious workplace for the employees. With the renovated facilities are the new and upgraded equipment like the queuing system, computers, computer tables, chairs, steel cabinets, ventilation system and the newly constructed drainage system. The DO is manned by the highly motivated employees operating beyond its normal clientele.

With the renovated waiting area installed with proper ventilation and comfortable chairs, clients will be relaxed while waiting until their transaction (MV Registration or Driver’s License Application) is completed. In addition to the different equipment installed in the waiting area, the DO also installed WIFI connection so that clients can surf the internet while waiting for their transaction to be done.

Currently with the leadership of its new District Head, Engr. Eric C. Suriben, the office is committed to give quality service to the public guided by LTO’s Vision, Mission and Quality Policy.

The increased revenue collection of the DO early this year is because of the accomplishments of the DO together with the dedication and hard work of its employees. It is also expected that in the coming months revenue collection will continue to rise.

Fourteen of the 16 district/extension offices of the Land Transportation Office of Region 1 have been installed with the new virtual lecture.

The new virtual lecture contains the provisions of R.A. 4136 or the Land Transportation and Traffic Code of the Philippines, driving techniques, driving safety tips and other related rules and regulations and special laws regarding road safety such as laws for senior citizens, pregnant women and persons with disabilities, R.A. 10586 or Anti-drunk and Drugged Driving, and R.A. 8749 or the Clean Air Act. “All offices of LTO Region 1 shall be installed with the new lecture, not only in the lecture rooms but shall be displayed in the queuing system monitors and even on the social networking sites of the office. Maximizing the visibility of this lecture will help to educate all clients especially drivers,� Assistant Regional Director Francis Ray A. Almora announced.

He said that the new lecture is an enhancement of the existing lecture video created by the Central Office .

This will reduce the job of a lecturer while maximizing the skill of clients in road safety.

Region 1 is the first LTO office nationwide to produce a comprehensive virtual lecture and information drive campaign in English and Filipino language.

A two-day briefing was conducted by the Land Transportation Office Region 1 to all Manufacturers, Assemblers, Importers, Rebuilders, Dealers and Other Entities (MAIRDOEs) to discuss the implementation of LTO Administrative Order No. AVT-2014-024, and other concerned memoranda related to the creation of New Registration Office held at the Star Plaza Hotel, Dagupan City and Hotel Ariana, Bauang, La Union last March 14 and 15, respectively.

Assistant Regional Director Francis Ray A. Almora discussed the provision of Administrative Order No. AVT-2014-024 or the Revised Rules and Regulations Governing Sales Reporting and Initial Registration of

Brand New and Other Motor Vehicles. This Administrative Order shall govern the sales reporting and new or initial registration of all types of motor vehicles, including the subsequent miscellaneous and renewal transactions.

Memorandum Circular No. AVT-2014-1828 or the Revised Rules and Regulations on the Accreditation and Stock Reporting of MAIRDOEs authorized to import motor vehicles and/or its components were also tackled.

ments; Approval and Disapproval of Application; Duties and Responsibilities of LTO Operations Divisions of Regional Office; monitoring of MAIRDOEs to ensure compliance with the Order and other related laws, rules and requirements pertinent to accreditation including the applicable administrative penalties for those who will commit violations.

Also, ARD Almora emphasized that the new process of registration of a new motor vehicle (MV) is different from what was practiced. He said that prior practice allows the registration of Regional Director Atty. Teofilo E. Guadiz III welcomes all the participants for the briefing of MV even the Sales Report the newly implemented Administrative Order No. AVT-2014-024. was transacted anywhere in the country and register in the District Offices of LTO. The new process provides that the Sales Reporting and Registration is a one-way process to be done only at the Regional Offices where the accredited MAIRDOEs are located.

He added that AVT 2014-023 reiterates the mandatory application of MAIRDOEs and its branches for accreditation.

The Infrastructure of the New Registration Office was presented and an open forum where the procedure of New Registration and accreditation of MAIRDOEs were discussed and clarified with the participants.

It is the policy of the office to determine, provide and maintain the work environment in order to promote a positive influence on motivation of employees and to achieve customers’ satisfaction both external and internal.

Review ofi areas for improvement is conducted through Monthly Management Review and Regional Monthly Conference. Continuous monitoring of the customers’ feedback, the quality workplace, the human resource management, infrastructure management and compliance of office policies and procedures are the concerns during the monthly meetings.

“If you focus on results, youwill neverchange.If you focus on change, you will get results..” - Jack Dixon The institution of change is the basic requirement of management towards the desired level of performance.

Focus of change is the total customer satisfaction.. The traditional type of government service had been totally changed to quality public service.

As President Aquino’s statement in his first State Of the Nation Address (SONA) “ Kayo ang Boss Ko”, the office has been serious in adopting this statement in the delivery of public service. Attitude of everyone is the key to change. LTO employees are determined to accept change with dedication and without hesitation in their respective work assignment.

Change is evident by various awards received by the Office for the last three (3) rating period wherein LTO Region 1 consistently landed in the top 5 for the Best Regional Performance. In CY 2012 during the occasion of LTO’s centennial foundation anniversary, this office was adjudged as 2nd Best Regional Office for CY 2011 Regional performance tied with Region IVA. On

the following year, Region 1 was ranked as the 4th Most Outstanding Regional Office for CY 2012 performance.

For CY 2013 performance, this Office regained its status as the 2nd Outstanding Regional Office. With these accomplishments, LTO Region 1 gears towards excellent performance. Management is not just optimistic but determined to attain the most coveted level of recognition as the BEST PERFORMING REGION among the regions.

Another manifestation of this change is the seal of excellence awarded by the CSC to Urdaneta District Office in CY 2013, which our Region is very proud of.

This was followed by another special award received during the LTO Anniversary in recognition of Urdaneta District Office as the only recipient of seal of excellence for the Land Transportation Office nationwide.

Teamwork . . . . .better for all.

These various awards cannot be realized without the initiative and good teamwork of the present administration and of course the positive reception of every employee towards change.

“The only way to do great work is to love what you do.” - Steve Jobs LTO Region 1, working as one family, is motivated in serving the public with beyond established standards. Motivation is sourced from external and internal factors. The external source is the management who never ceases to encourage the employees to change the perception towards work in order to attain the very purpose of the office. Whereas, the internal source are the employees’ attitude to adopt change and their dedication towards their work.

Excellent performance in public service is the ultimate goal of LTO Region 1 where officials and employees are motivated to adopt change and to love serving the public through the leadership and team-

Motor Vehicle Inspection Committee Regional Conference in Cape Town, South Africa which aims to present and showcase best practices of companies for roadworthiness inspection.

Among the topics discussed were 1) The Value of Technology in Roadworthiness Inspection; 2) AntiCorruption Measures within the Vehicle Testing Environment; 3) Quality Management System; 4) Case Studies from Different Countries Demonstrating Best Practices.

CITA is an international not-for-profit organization based in Bruzzels, Belgium. It represents all types of organization and stakeholders (government, private sector, dedicated inspection centres, garage-based test centres, and test equipment manufacturers) who share a common interest in exchanging information, developing best practices and draft international standards in the field of road vehicle inspection.

Its work focuses on improving transport sustainability with particular emphasis on road safety and environmental protection.

CITA is recognized by the Commission of the European Union and the United Nations Economic Commission for Europe (particularly “The World Forum for the Harmonization of Vehicle Regulation – WP-29”) for its expertise in relation to roadworthiness inspections. CITA currently has about 120 members worldwide, representing over 50 countries and covering more than 250 million vehicle inspections a year.

By actively participating with conferences inside and out of the country, the Land Transportation Office will be able to adopt and recommend innovations and practices which will eventually lead to a better and convenient delivery of service to the public and register roadworthy motor vehicles in the Philippines.

The Land Transportation Office Regional Office 1 was awarded 2nd Place Outstanding Regional Office for the year 2013 during the celebration of 102nd LTO Founding Anniversary and LTO National Team Building and Work Effectiveness Development Program last April 23-25, 2014 on Clark Air Base, Pampanga.

LTO National Capital Region (NCR) and Region 6 bagged the 1st place, and Region 5 was awarded 3rd place.

The awardees were chosen based on the improvements of implemented programs and projects in relation to LTO mandates, service satisfaction delivered to clients.

The awards annual aim to recognize the efforts, performance and achievements of regional offices.

For C.Y. 2012, Region 1 was awarded 4th Most Outstanding Regional Office and raised to 2nd Most Outstanding Regional Office for the year 2013.

LTO Region 1 is maintaining its good standing and determined to strive more in delivering effective and enhanced services for the clients satisfaction for the upcoming years.

Officials and staff of LTO region 1 are abuzz with activities nowadays. The office will be hosting the 2014 3rd quarter Directors’ Conference come September 3 -5 2014 at Thunderbird Resorts and Hotel at Poro Point, San Fernando City, La Union.

The Conference is a quarterly event participated in by the Executive Committee of LTO headed by LTO Assistant Secretary Alfonso V. Tan Jr., Regional Directors, and Assistant Regional Directors to discuss issues, concerns developments, operations and management matters.

One of the planned events prior to the commencement of the conference is the blessing and inauguration of the new LTO San Carlos building which will be attended by LTO officials who will be coming from the Central Office. Local Officials are likewise invited who will recognize for the lot donation in favor of LTO. The

building will be officiated by Parish Priest Alberto T. Areno.

The 2nd day will be the conference proper. On the third day, LTO Region 1 shall showcase places and practices which are usually permanently offered to visitors. One would be a golf tournament which shall be at the golf course of Thunderbird Resort and Hotel.

An invitational shoot fest will also be offered for gun enthusiast while those who prefer to have a trip with nature could visit the Surfing Capital of the North, for well, surfing and kayaking activities. Other could tour the neighboring towns of Bauang, Bangar and Luna.

This would not be the first time for LTO Region 1 to organize and host the said event. This time, it would not only offer a cozy place for the conference but a total package of work and relaxation.

The LTO, Lingayen District Office recently conducted information drive and awareness campaign last June 16 & 17, 2014 in the school campus of Pangasinan State University((PSU) and Pangasinan School of Arts and Trade (PSAT). The purpose of this campaign is to encourage students and school personnel to know the importance of securing student permit/renewal of driver’s license, and renewal of motor vehicle registration on time to avoid penalties.

Information booths were installed in front of the school campus and flyers were distributed. This campaign was initiated by this office in support of the LTO REGION 1 INFORMATION ADVOCACY CAMPAIGN.

SAMU’TSARI Inspired by its theme “A sound mind in a healthy body for a more efficient public service”, the Land Transportation Office Region 1 officials and employees attended the 102nd LTO Founding Anniversary and LTO National Team Building and Work Effectiveness Development Program on April 23-25, 2014 at Clark Air Base, Pampanga upon the leadership of Atty. Teofilo E. Guadiz III and ARD Francis Ray. A. Almora.

The said activity was attended by delegates of all Regional Offices nationwide representing their respective regions.

Assistant Regional Director Francis Ray A. Almora was elected as the president of Association of Regional Government Information Officers (ARGIO) who will lead other information officers as the communication agent of the government in region 1.

As the designated information officer of the Land Transportation Office Region 1, ARD Almora is an advocate of transparency by promoting various medium of communication in the print and broadcast as well as the use of social media.

The activity was culminated by a Thanksgiving Mass; Team Building games such as golf tournament, basketball men, volleyball men and women; Conferment Special Citation to Urdaneta District Office and Roxas District Office; Conferment of Excellence Awards to Outstanding District Office and Outstanding Regional Office of 2013; and Fun Shoot Competition.

In 2012, he pioneered the creation of the first publication of the Land Transportation Office Region 1 which was later named “Transporter”, the first publication among LTO offices nationwide.

With the spread of social media, he pushed the involvement of LTO on various social media such as the Facebook, Twitter, and Youtube which, in 2013, led to the full operation of these social media accounts.

By Charlie AA del Rosario MANILA, Philippines, for two days (June 25-26 2014), three Land Transportation Office-Region 1, officials and employees attended the Emission and Testing Facility Workshop at the BULWAGANG EDU, LTO-CENTRAL OFFICE. For two days representatives from the different LTO offices nationwide discussed the newest approach in furthering the gains in government’s effort in protecting the environment.

The highlight of the two day workshop is the distribution of Refrigerant Identifiers to some of LTO-District Offices nationwide. LTO-Region 1 received a total of four identifiers for LTO-Urdaneta, San Fernando, Dagupan, and Laoag District Offices.

fices to determine the type of refrigerants being used by the motor vehicles (MVs) subject of registration. Existing rules provides that all motor vehicles models 1999 and above, will not be allowed registration unless their MV air-conditioning units uses R134a as refrigerant. This mean that those motor vehicles covered by the rules still using R12 as refrigerants will only be allowed renewal of registration after converting from R12 to R134a.

Pursuant to Civil Service Commission MC No. 07, s. 1998, the adoption of “SalamatPaalam” Program in Honor of Retiring Officials/Employees in the Civil Service, LTO Region 1 gave due recognition to the services of the said retiree.

In advance recognition of her forty-one (41) years of dedicated government service from 1973 to 2014, Ms. Dy was given a Plaque of Recognition signed by Regional Director Teofilo E. Guadiz III, during the LTO Region 1 Regional Monthly Conference and Regional Management Review on May 20, 2014 at the Hotel Ariana, Paringao, Bauang, La Union. Ms. Dy rendered such number of government service at LTO Region 1 alone without any gap, starting from the position of Cashier Aide in 1973 and retiring from the position of TRO II this 2014.

As her services end at the close of office hours on June 20, 2014, and in celebration of her 65th birthday, her officemates at Vigan District Office accorded her with a simple but meaningful ceremony coined as “MabuhayPasasalamat” Program.

Pursuant to Memorandum Circular No. 515-2004 dated 25 May 2004, TOP shall be used in apprehension of all violations and it is strictly required to be issued to the apprehended driver/operator at the site and time of apprehension.

2. What is an IRMV? Answer: IRMV means Impounding Receipt of Motor Vehicle. It is issued if the motor vehicle was impounded. IRMV is accomplished by the apprehending officer and validated by the Motor Vehicle Custodian (MVC) assigned at the impounding area.

3. Can TOP be temporarily used as a driver’s license of the apprehended operator/driver?

Answer: Yes. TOP serves as driver’s temporary license within 72 hours or 3 days only.

4. How long is the validity of the TOP? Answer: 72 hours or 3 days is the validity of the TOP, unless specified for a shorter period of time.

5. Can TOP be extended after 72 hours or 3 days after its validity?

Answer: No. There is no extension of TOP after 72 hours or 3 days.

6. When can an apprehended operator/driver settle his case?

Answer: The apprehended operator/driver can settle his case after 24 hours but shall not exceed 15 days from the date of apprehension .

7. What will happen if the apprehended operator/ driver failed to settle his case within 15 days from the date of apprehension?

Answer: If the apprehended driver/operator failed to settle his case within 15 days from the date of apprehension, it will cause the suspension/revocation of his driver’s license within 30 days.

8. What will I do if I want to contest my apprehension?

Answer: File a written contest within 5 days upon the date

10. What is an Admitted Case?

Answer: An admitted case is a case wherein the apprehended operator/driver admits the violation/s cited in his TOP. 11. Can the apprehended operator/driver protest the violations charged/cited in his TOP to deny the violations and/or to lessen the payment of the fines/ penalties?

Answer: Yes. An apprehended operator/driver may protest the violations specified in the TOP. This is a contested case.

12. What is a Contested Case?

Answer: A contested case is a case wherein the apprehended operator/driver signifies his intension to oppose to the violations indicated in the TOP. It should be acted upon with dispatch by preparing the summons both for the apprehending officer and respondent. The apprehending officer shall have been summoned at least once with proof of service for clarification purposes. Violation/s listed in the TOP and/or encoded in the LTO-IT system shall be dropped/dismissed provided that the apprehended driver/ operator presents sufficient documentary evidence to warrant its dismissal and/or if the violations cited in the TOP are interrelated or common.

By Charlie AA del Rosario MANILA, Philippines on May 27, 2013, President Aquino signed into law Republic Act No. 10586, otherwise known as the Act Penalizing Persons Driving Under the Influence of Alcohol, Dangerous Drugs and Other Similar Substances. However to effectively implement the law the Implementing Rules and Regulations (IRR) will have to be approved.

The Department of Transportation and Communications (DOTC), Department of Health (DOH), National Police Commission (NAPOLCOM), Philippine Drug Enforcement Agency (PDEA), Department of Trade and Industry, and Philippine National Police are tasked to prepare the IRR.

RA 10586 limits the allowable blood alcohol level for drivers of private vehicles below 4,500 kilograms to below 0.05 percent. For drivers of public utility vehicles, trucks, buses and motorcycles, no amount of alcohol is allowed.

"In the case of drivers of buses and other public utility vehicles, however, they cannot have any amount of alcohol in their blood at all, since people's lives are in their hands," DOTC Secretary Jun Abaya said.

When a driver is found to have a higher blood alcohol level than the prescribed limits, he will be arrested, and his vehicle will also be impounded.

After almost a year of waiting, the IRR was finally approved paving the way to its implementation.

Meanwhile, in instances wherein a law enforcer has reasonable grounds to believe that the driver is under the influence of dangerous drugs, the driver shall be brought to the nearest police station where he will be subjected to a drug screening test.

The IRR, provides that an apprehended driver suspected of driving under the influence of alcohol will be subjected to three field sobriety tests: the eye test, walk-and-turn test, and one-leg stand.

The penalties for violations of RA 10586 range from a minimum of a three-month imprisonment plus a P20,000 fine to a maximum of a 20-year imprisonment plus a P500,000 fine.

The eye test requires the driver to follow with his gaze an object that the law enforcer moves horizontally, around one foot away from the driver's face.

It will also entail a 12-month suspension of a non-professional driver's license for the first offense, and perpetual revocation for a second offense. For professional driver's licenses, the first offense alone will result in perpetual revocation.

The walk-and-turn test requires the driver to walk nine steps forward in a straight line, turn, then walk back the same distance without difficulty.

The one-leg stand requires the driver to stand on one leg and raise the other around six inches from the ground for about 60 seconds.

If the driver passes these three tests, he will be apprehended for his traffic violation only.

But if he fails any of the tests, he will be subjected to an Alcohol Breath Analyzer (ABA) test, which will determine his blood alcohol level.

The IRR provides for mandatory alcohol and drug testing of drivers involved in motor vehicle accidents which result in death or physical injuries.

It also empowers the Land Transportation Office (LTO) to conduct random testing of public utility drivers at transport terminals nationwide.

The IRR further provides, that Law Enforcement Officers needs to be deputized by the LTO, for this purpose qualified applicants for deputation shall complete the Deputies Training Seminar after which must pass written and other examinations that maybe administered by the LTO. Tan, Jr., Assistant Secretary of the Land Transportation Office called a special meeting with its Regional Directors, Assistant Regional Directors, Chief of Operation Divisions, and Regional Law Enforcement Chiefs discuss the effective implementation of Joint Administrative Order (JAO) No. 2014-01(re: Revised Schedule of Fines and Penalties For Violations of Laws, Rules and Regulations Governing Land Transportation) which will take effect on June 19. 2014.

The JAO contains the new penalties for violators of laws, rules and regulations governing land transportation, with the lowest penalty of One Thousand Pesos (Php 1,000.00) and highest penalty of One Million Pesos (Php1M).

In a related news, an organization of transport operators and drivers failed to get a Temporary Restraining Order (TRO) from the Supreme Court against the implementation of the JAO, instead the court on the same day of the LTO special meeting directed the DOTC, LTO, and LTFRB to file their comment on the petition of Samahan Ng Mga Tsuper at Operator ng Pilipinas (STOP & GO) against the implementation of JAO No. 2014-01.

to block the enforcement of the city’s amended ordinance by arresting motorcycle riders who do not wear their helmets.

“We will penalize motorists in the city who will not wear their helmet while driving a motorcycle as it is against the law”, he said.

Guadiz said his office will not honor the ordinance passed by the Sangguniang Panlungsod (SP) last July 7, because “it is contrary to the national helmet law under section 3 of the republic act 10054” which states: “All motorcycle riders, including drivers and back riders, shall at all times wear standard protective motorcycle helmets while driving, whether long or short drives, in any type of road and highway.

“An ordinance should not supersede a national law”, said Guadiz who was a former member of the SP Dagupan and chairman on the Committee on Laws and Ordinances.

The ordinance entitled an “Ordinance Instituting Certain Security Measures for the Protection of the Lives and Property of Dagupeños,” the measure has four basic components to deter criminals from committing any criminal acts against any person in Dagupan”, authored

by Councilor Jose Netu Tamayo, also a lawyer.

The ordinance was enacted by the SP following the rash of crime incidents in the city involving hitmen and thieves riding in motorcycles who concealed their identities by wearing helmets and bonnets.

Despite the motive of the amendment, Guadiz asserted that “the LTO will not expense the safety of the motorists and their back riders over the isolated cases of robbery and other incidents related to motorcycle riding criminals”.

He said it is the responsibility of the police “To prevent criminal activities in the city...to strengthen police presence and visibility rather than sacrifice the safety of the riding public.”

Councilor Tamayo defended and pointed out that it does not supersede the national law as claimed by Guadiz.

“The ordinance covers only those motorists who are driving at the speed within 15 kilometers per hour in the central business district, those who are in the checkpoint area and during parades”, said Tamayo.

Tamayo reiterated that the ordinance is for purposes of monitoring and identifying motorcycle riders entering the city in order to deter commission of crimes and to help solve crimes that involve motorcycle riders.

Reacting to Guadiz’s call on the SP to coordinate with the LTO before enforcing the ordinance, Tamayo stressed that the SP had invited the LTO Dagupan district office to the public hearings and there was no objection from the LTO about the recommended implementing guidelines.

Guadiz rejected Tamayo’s assertion.

“The LTO representative from Dagupan is not authorized to speak for the whole agency in region one. They (SP) should have directed the invitation to the regional office but even without us, the law is clear about the matter” said Guadiz.

In spite of the LTO’s objection, Tamayo said the city government will assert its right to protect and safe guard the lives and properties of the city’s constituents.

“Any opposition will be answered by the city in the courts”, Tamayo intoned.
