ASSUMPTION OF THE RISK AND WAIVER OF LIABILITY RELATING TO CORONA VIRUS/ COVID-19
The novel corona virus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. Los Gatos-Saratoga Community Education and Recreation (“LGS Recreation”) has created new protocols and put in place preventative measures to reduce the spread of COVID-19; however, LGS Recreation cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending any program may increase your child(ren)s risk of contracting COVID-19. LGS Recreation’s programs by nature involve interaction between and among participants and agency staff, as well as potential interaction between and among parents who are dropping off their children and/or observing the program. By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to, or infected by COVID-19 by attending, and/or transporting my children to, LGS Recreation programs, activities, or events, and of the named perils listed below. I understand that the risk of becoming exposed to or infected by COVID-19 at LGS Recreation programs, activities, or events may result from the actions, omissions, or negligence of myself and others, including, but not limited to, LGS Recreation employees, volunteers, and program participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any and all named perils and/or injury to my child(ren) or myself, including, but not limited to, personal injury, disability, and death, illness, damage, loss, claim, liability, or expense, of any kind, that I, my child(ren), or others, may experience or incur in connection with my child(ren)’s attendance at LGS Recreation programs. On my behalf, and on behalf of my child(ren), I hereby release, covenant not to sue, discharge, and hold harmless LGS Recreation, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating to the above named perils in connection with my child(ren)’s attendance at LGS Recreation programs. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of LGS Recreation, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any LGS Recreation program.

55 Plus Program Donation

Help Support Our Community of Vibrant Older Adults

55 Plus Program is dedicated to ensuring free or low-cost access to recreation, education, socialization, and wellness opportunities for older adults. We create a sense of belonging through connections in the community and meaningful recreation programs that address social, psychological, physical, and cognitive needs of older adults. Our Senior Center also acts as a Hub of information to connect older adults or caregivers with services and resources.
Did you know? Programs are funded by fee-based services and modest grants, not tax dollars or subsidy. Your contribution will help to ensure long-term uninterrupted service of this vital program area.
