Lercari has been present in Italy for more than 130 years in the insurance market and its consolidated experience ensures consistency and quality of service backed by an internal workforce of around 250 in-house professionals, centrally coordinated by our headquar ters based in Genoa and Milan.

GENERAL INFORMATION General liability issues are constantly changing due to the rapid evolution of the legal and operational context. In order to respond to existing and emerging challenges, CLL have developed a policy of continuous upgrading of human and technical resources as well as of IT facilities. Bespoke standard of services require that the loss adjusting structure should be able to effectively liaise with policy holders with a view to establishing appropriate information flow char ts and make available to our customers an adequate team of exper ts suppor ted by extensive territorial networks and state of the ar t IT facilities.

IT SYSTEM Every application for the losses management is built on the basis of the client’s needs: • Lotus Domino IBM technology. • Web access to the system with safe connection SSL by the CLL por tal. • Interconnection (inbound – outbound) to clients’ application, oriented systems through file flat (ftp, mail server) or through web service. • Paper documentation electronic database ( also accessible through web). • Web por tal implementation on php – Sql Server technology CLL and SIRCUS have a modern server farm provided with the newest technology: • Fibre broadband connection between the main office and the branch offices. • Mpls system for the remote offices connection. • Vpn server for external access to intranet area. • Daily backup of the data • Last generation Server Hp

REPORTING Reports on losses as well as updates on the legal proceedings will be submitted in English in compliance with Insurers’ guidelines.

BORDEREAUX

CLL Italy can rely also on a team formed by exper t lawyers and technicians in the insurance field, of Lercari Group Liability Division to provide loss adjusting and consultancy ser vices for all Liability branches, in relation to frequent and substantial losses.

A dedicated qualified paralegal will update the bordereaux and manage the accounting aspects under the supervision of the team leader and the loss adjusters.

Therefore CLL and Lercari Group Liability Division offers a full range of management and loss adjusting ser vices including Professional Indemnity, Professional Liability & Medical Malpractice, TPL, D&O, Employer’s Liability, Product Liability and PI claims.

Our extensive technical resources and longstanding experience of the market also enable our Group to effectively address the PI field in technical sectors (Engineers, Architects, General Adjusters’ Liability) and in professional ones as Lawyers, Medical Doctors, Accountants, Notary , Software Designers etc.

Cunningham Lindsey Lercari, the international arm of Lercari Group and a specialist organisation in the management of international programmes, makes available to its customer the access to local expertise and in depth knowledge of legal backgrounds and jurisdictions, through one of the widest worldwide network and its own Italian network. Our offer incorporates different business solutions covering severity and frequency losses, bordereaux preparation, the issuing of reports in foreign languages to the benefit of direct carriers and reinsurance companies.

Up to date our staff is composed by a team of more than 40 persons (excluded management team) in our offices in Milan and Genoa.

MEDICAL MALPRACTICE

OUR UNIQUE SELLING POINT

Our staff is skilled in handling Med-Mal losses of all types: Hospitals, Healthcare Entity, Clinics and Doctor Professional policies.

Our loss adjusters working on these type of losses have all a legal background. We are currently handling Med-Mal binders for Lloyd’s Syndicates. We receive directly notification of new losses from the London Broker or the local broker and then carry out the following activities: • Documents examination in order to: - Evaluate the Insurance validity period (claims made, retroactive date- discovery period) - Evaluate of the Insured liability - Evaluate the possible Cour t of Settlement in case of Civil Proceeding pending • Fur ther documentation request; • Monitoring the Civil and Criminal proceedings and appointment of Lawyers to defend Insurers interests in case of Lloyd’s call in the action; • Appointment of a Medical exper t; • Issuing of monthly bordereaux with the details of all the new notifications received and updates on the other losses; • Individual repor ting for losses over € 25,000, for losses with civil or criminal case pending or for “death cases”; We have a Medical exper t network throughout Italy.

TECHNICAL COMMITTEE Central Medical Advisors Central Insurance Advisor Legal exper ts: • In-house lawyers, who provide legal opinions and handle the settlement activities of out of Cour t losses. • Network of skilled Legal Consultants and economical agreements with major Law Firms based in Genoa, Milan, Rome, Naples, Torino and others, who can also defend Underwriters’ interests in Court. In case Underwriters have already instructed their Lawyers for the litigation aspects our staff can monitor the pending legal proceedings by providing regular updates and by checking the congruity of the appointed law firm legal fees.

In 1999 the founding members, CLI and Lercari , formed a new company incorporating a wealth of existing experience and traditions. Afterwards CLL has begun to grow up independently, but never alone. The CLL key factor in terms of successful claims management largely depends on the par tnership with the Lercari Group companies which ensures solid professional competence and qualifies the exper tise and technical skills of our staff, with a workforce of around 250 in-house professionals, centrally coordinated by our headquar ter based in Milan and Genoa. The Group has been active for more than 130 years in the Italian insurance market and its business model is based on process segmentation between exper ts and supervisors prior to the delivery the repor ts. For each case the necessary skills are identified in a targeted way according to the characteristics of the claim to manage. Whenever possible, internal resources are employed and the bulk of preparatory work is done in advance of resor ting to external consultancy with a view to keeping costs to a minimum. Our internal staff is complemented by a large network of external consultants that covers any possible business line (medical, legal, commercial, accountants, engineers, company law, D & O, Liability, BBB, etc). Accurate selection of service providers incorporates such features as proved competence, reputation for integrity and the ability to offer a wide range of professional and economic solutions at competitive terms. Selection is operated by our specialist depar tment taking all the above fully into account so enabling us to submit to our Principals attractive and economical packages. As a result of the above: • we provide the added value of the sum of two capabilities , claims management and Surveying; • we offer tailor-made claims management schemes of high quality which compare favourably with those available from most of our competitors covering all lines of direct and reinsurance business. We do not consider ourselves infallible but we will do our utmost l to minimize any margin of error. We do not think we are necessarily better than others, but we trust in our capability, and in all of those who work with us.
