Bajo las leyes federales, y en la mayoría de los estados, aunque usted sea un trabajador indocumentado, su empleador no puede despedirlo, no contratarlo o proceder en su contra por causa de su raza, sexo, nacionalidad de origen, orientación sexual, identificación de género, religión, edad o incapacidad, o en el caso de mujeres, por embarazo. Sin embargo, usted debe considerar que, bajo el Acta de Reforma y Control de Inmigración de 1986 [Immigration Reform and Control Act of 1986 (IRCA)], está prohibido que un empleador le de empleo o continúe empleando a un trabajador indocumentado si sabe que dicho trabajador no posee los documentos necesarios para vivir y/o trabajar en Estados Unidos. Bajo esta ley, el gobierno federal creó un formulario llamado I-9, que el empleador debe completar para cada uno de los empleados que contrate. Para estos efectos, cada trabajador debe mostrar diferentes tipos de identificación (documentos) para comprobar que tiene el derecho legal para trabajar en Estados Unidos. Si la persona no cuenta con

estos documentos, el empleador no debiera contratarlo. Debido a inquietudes de que este proceso pudiera resultar en conductas discriminatorias, parte de las leyes se hicieron justamente para proteger a las personas que sí tienen autorización legal para trabajar en Estados Unidos, contra la discriminación en base a su nacionalidad de origen o estatus migratorio. Los empleadores tampoco pueden utilizar esta ley para despedir ilegalmente a trabajadores. Esto ocurre cuando un trabajador es despedido porque trata de hacer cumplir con una ley existente que pudiera ayudar a otros trabajadores.
