From the Bar Joseph G. Viacava, Esq. Joe Viacava has never been accused of lacking passion. Dateline NBC’s Dennis Murphy called him “A pit-bull on cross-examination.” His clients, his family and playing his drums are the three areas into which he pours his seemingly endless energy. A big drum set in his home helps him keep a pulse on what he terms the beat to life that swings the rhythm to his practice. And the machine gun patter of his New York accent helps him “hammer the case and take out the people who need to be taken out.” According to the long-time criminal defense attorney, “My whole world moves to this steady and constant beat.” For all his enthusiasm, he shies away from beating his own drum. When asked about the pit bull reference, Viacava guides the conversation toward his clients. Consider his new law office. Just a short walk from the courthouse, it was built from the ground up with his clients’ needs in mind. Private parking and catered food service are among the thoughtful touches that characterize the McGregor Boulevard address, and a private library affords his clients a private, quiet place to work on their own case, rather than merely serving as a detached spectator. Viacava is even developing an encrypted program that will enable clients to access their own files, and grant them total access to their case file. The case file, after all, belongs to the client. Among Viacava’s career highlights was his success at obtaining for his client one of the largest federal sentencing guideline courtordered departures in the history of the Middle District of Florida. As a result, his client received a probationary sentence, rather than the congressionally mandated guideline sentence of 35 years. Viacava’s tenacity carries over to the long hours he puts in at the office. “I am very proud of that fact because it gives my clients what they deserve: the highest level of dedication to their cause, while not allowing them to be defined by the crime of which they have been accused,” he said. “The majority of our cases are just salt of the earth people who flat out need some help on a bad day.”
