anta Maria has already earned its reputation as a thriving city that attracts business and growth, but there’s more on the way.

The city may lack some of the aesthetic qualities compared to cities immediately to the north and south, but it has its own ad-

vantages when it comes to adding more opportunities for housing and jobs.

Last year during her state of the city address, Mayor Alice Patino called Santa Maria a “hidden gem.”

A 2018 report released by the Santa Barbara County Workforce Development Board showed that while the central and southern

portions of the county had higher overall wages, North County showed the highest rate of job growth at 13 percent between 2010 and 2017. Last year, according to Patino, between 600 to 700 jobs were created in the city.

And with a little more than a month left of summer, development throughout Santa Maria is ramping up.

“We are growing in population, and the need for living wage jobs, housing, lifestyle and quality of life comes along with business development, it all works together to make this a vibrant and strong economic community,” said Suzanne Singh, economic development director for the Santa Maria Please see GROWTH, Page 4

Completion of two new buildings in the Crossroads shopping center just south of Betteravia Road is “right around the corner,” said Chuen Ng, community development director for Santa Maria. One of those buildings will be a Shell gas station. The other will contain a Krispy Kreme donut shop and another tenant is still to be determined, Ng said. Then there’s the 113-acre Enos Ranch.

More than three years after its approval, a portion of the former open area known as Enos Ranch that immediately abuts Betteravia to the north now contains a thriving shopping center complete with a Costco, Dick’s Sporting Goods, Habit Burger, Lowe’s, and more.

Grading for a new auto mall is underway and soon a new Toyota dealership will occupy that space. Its current dealership, which sits a few hundred yards to the south, will be taken over by KIA, Ng said.

The development will also include housing. Grading for the housing project was delayed for several years after it was sold by The Towbes Group, which was the original developer. The new developer is MBK Homes, Ng said.

Santa Maria will also get postgraduate education — the Coast Hills building, sitting directly on the corner of Betteravia and Highway 101, will include a branch of Arizona-based A.T. Still University on the second floor. Specifically it will be a physicians assistant school offering a master’s degree level medical education, that hopes to enroll about 100 students, Ng said.

“It’s great for community because it’s postgraduate education and it will lead to more,” Ng said.

Meanwhile, on the north end of town near Preisker Park, a Hampton Inn hotel is completing construction. A Wendy’s will open nearby, too.

Beyond that, Ng added, there are not very many parcels left to develop, despite the open space on the east and west sides of town. While the city isn’t geographically bounded by hills, agricultural space effectively limits development in these two directions.

“We want growth to occur responsibly,” Ng said. “We’re dependent on agriculture.”

The unincorporated area of Orcutt may seem like an opportunity to expand the city, but Ng said no because of the fiscal considerations. For one, he said, the mostly residential area of the county isn’t enough to support the tax base needed to support city services, like public safety.

In the coming months, Ng said, the city will be embarking on a general plan update. The document will effectively spell out the vision for the city and will define how the city will be planned for the next 20 to 30 years, Ng said.

Downtown is about to change, Ng added, saying that the city is looking to fill in the gaps. It may not seem obvious, he said, but there are several vacant cityowned parking areas that are underutilized. Ng said these are seen

Several groups have shown interest, he said, adding that officials are flexible and open as to what development looks like.

But the mall is here to stay, he said. Besides being a “centerpiece” of downtown and a unique indoor shopping experience, Ng said, it’s a large structure and would be difficult to remove.

There’s still lots of opportunity to make the most of the mall, he added.

“We want there to be a sense of vibrancy,” Ng said. “Santa Maria is a well-rounded community for the Central Coast.

The housing is relatively affordable here and people can find work in the region. It’s a highly desirable place to be.”

Recent CA Supreme Court decision puts many employers at high risk H ‌ ave you been paying attention to the turmoil surrounding independent contractors since the 2018 California Supreme Court decision in Dynamex Operations West, Inc.?

If you are using independent contractors and have not reviewed them in light of this decision, you may be creating significant risk for your business.

The Dynamex decision created a new “ABC” test to determine independent contractor status: (A) that the worker is free from the control and direction of the hiring entity in connection with the performance of the work, both under the contract for the performance of the work and in fact; and (B) that the worker performs work that is outside the usual course of the hiring entity’s business; and (C) that the worker is customarily engaged in an independently established trade, occupation, or business of the same nature as the

The B part of the test has been of most concern, since it can be very difficult to identify how services provided by many IC’s is not within the “usual course” of business. For example, a film company cannot claim that editors, graphics specialists and others commonly hired as IC’s are not performing work that is within the usual

course of producing films.

While B is much of the focus, we often find clients that fail the C prong. That great employee you had that is moving out of state (or retired) and you decided to keep as a “consultant” is highly unlikely to have an independent business that meets the requirements.

While the Dynamex decision is applicable to wage/hour claims including those for minimum wage, overtime and/or meal and rest period violations, AB 5 has been moving quickly through the legislature and would expand the ABC test to all Labor Code and

Unemployment Insurance Code provisions. There is significant lobbying effort occurring to limit AB 5 or expand the current exceptions provided for in the bill, but it appears likely to be enacted.

If you have not conducted a review of your IC’s in view of the ABC test, you should do that now and develop a plan to convert those that do not meet this new test. While there are costs associated with converting them to employees, the cost of being audited and penalized can be much greater.

New California laws in response to the

‘ME TOO MOVEMENT’

T ‌

he Me Too Movement, which began in 2006 and gained widespread support in 2017 after the Harvey Weinstein scandal, raised awareness of sexual harassment and sexual assault in the workplace. In response to the public outcry inspired by the Me Too Movement, California Legislators passed several new laws aimed to protect employees.

In particular, lawmakers began to scrutinize the practice of mandating confidentiality clauses in settlement agreements, which prevented victims of sexual harassment or sexual violence from talking about their experiences after settling their cases. A trilogy of California laws addressed this issue and became effective as of January this year.

The first law, promoted as protecting free speech and free petition, makes any agreement void that prohibits the victim from testifying in court or a judicial proceeding, if he or she has been compelled to testify by a court order, subpoena, or written request from an administrative agency.

Candidly, this law appears to be an overreaction. As a general practice, employers do not prohibit employees from testifying in court or cooperating with governmental agencies. One notable

exception is McKayla Maroney, an Olympic gymnast, who testified against the team doctor at his criminal trial.

She had signed an agreement with the United States Gymnastic Association (USGA), which prohibited her from talking about the sex abuse in public. After testifying against her abuser, she was fined $100,000 for breaching the agreement. The public backlash eventually pressured the USGA to waive the confidentiality clause and the fine. This new law is aimed at preventing such gag orders in the future.

The second new law, California’s Stand Together Against Nondisclosure (STAND) Act, applies to settlement agreements

reached after a lawsuit has been filed. STAND renders any such agreement void if it attempts to silence victims from talking about the sexual abuse or sexual harassment. The amount of the settlement may still remain confidential. The plaintiff can also request that his or her identity not be disclosed to the public or made a part of the public record, except in cases involving a government entity.

The third new law amends the Fair Employment and Housing Act (FEHA) to make it an unlawful employment practice for an employer to require an employee to release a claim under the FEHA in exchange for a raise or bonus, or as a condition of

employment or continued employment. This new law does not apply to negotiated settlements if the employee has already filed a lawsuit in court or a claim with a government body.

In other words, and using the example of a bonus, an employer cannot inoculate itself from unknown claims by forcing its employees to surrender their rights, in exchange for what they have already earned. This same law also prohibits employers from forcing employees to sign nondisparagement agreements that block an employee from disclosing illegal acts in the workplace, including sexual harassment.

Although non-disparagement and non-disclosure provisions have earned the ire of the public and politicians, such provisions are not without their merit, because they encourage early settlement. Resolving workplace disputes early allows companies to address problems and implement necessary changes without fear of litigation. When cases do not resolve, the stress of litigation can further victimize an employee that an early settlement could have prevented. Thus, there needs to be a balance reached so that victims are protected, while also continuing to encourage early resolution.

Chamber Focused on Building Emerging Leaders One of the things that I love about working for a Chamber of Commerce is the variety of issues that we get involved in each day. Because we’re committed to ensuring that the businesses in our community have every chance for success, we regularly find ourselves involved in finding solutions to challenges both large and small. Not surprisingly, the majority of these challenges are time-sensitive and need solutions now, if not yesterday.

At the same time, we know it’s important for us to keep our eyes on the horizon and be working on long-term solutions that may not come to fruition anytime soon, but will ultimately have lasting and significant impacts on the vitality of our community. Because we know that the health of the business community and the larger community in which it operates are inextricable, we try to identify ways to impact change at the community level in addition to serving one business at a time.

One of the long-term, big issues we believe needs attention is ensuring that our businesses and the community have a deep pool of talented leaders who can ensure that the right decisions are being made. That leads us to programming and work designed to seek out and raise up the next generation of local leadership, both within our businesses and in the broader community.

The Santa Maria Valley Chamber is deeply engaged in that work, through programming like Santa Maria Connect and Leadership Santa Maria Valley, but also through our partnerships with the community college and k-12 school districts. Our commitment includes walking the talk by giving emerging professionals serious opportunities to lead on our staff, the Chamber board, and the various committees and task forces which help direct our work.

Taking the Lead: Cultivating the Next Generation of Leadership

W

hen you think about the characteristics of a strong leader, a picture will emerge of how this person behaves and presents themselves to others. As part of this mental image, does age come into play?

For many, the perception of a strong leader is someone with an abundance of experience; an older individual. However many employers, city officials and young professionals in the community believe leadership can (and should) come from people of all ages. For many, cultivating the next generation of leadership in our community has become a major priority.

For the City of Santa Maria, developing emerging leaders is instrumental to their succession plan.

“The next generation can and will make a difference in local government,” explains City Manager Jason Stilwell. “We are all in this together, and encourage our emerging leaders to get involved and help improve

the quality of life in Santa Maria. The next generation should definitely consider a career in public service, as there are always opportunities to make long-lasting impacts on the overall community. The challenges facing Santa Maria are meaningful to all of us. That means we all need to pitch in.”

Stilwell says the City provides a number of opportunities to help their employees with their professional development as emerging leaders.

“We offer internships, team projects, consistent feedback, tuition assistance with professional development education, and promotional opportunities,” Stilwell said. “Further, the City offers all types of trainings, a mentoring program, a Speaker Series providing employees with opportunities to hear from an array of speakers from both the public and private sectors, Speed Coaching, its own Toastmasters club, and an internal professional development association

The City is not alone in seeing the importance of developing leaders from within their own organizations.

“We are always looking at succession planning and our next level of future leaders. It is extremely important that those that want to advance and grow into leadership positions be given that opportunity,” explained Sue Anderson, President & CEO Marian Regional Medical Center.

“We have leadership programs within Dignity Health, where future leaders are educated and attend quarterly professional development programs. Additionally, we give staff opportunities to lead projects so that they get that experience and we are a large enough entity that we encourage staff to look for options in other areas of interest,” Anderson said.

“At our Y, I’m a firm believer in both succession planning and empowering employees to excel, whether it is here or anywhere they may go from here,” said Shannon Seifert, CEO of the Santa Maria

Valley YMCA. “Our younger staff are our future leaders-and they’re amazing in their innovative styles of the work force, progressive thinking and community.”

Seifert says the YMCA invests heavily in training for employees, and are very specific with their SMART GOALS, which provide a clear map for both the employee and the employer when developing career, developmental and monetary goals.

And for those young professionals looking for leadership opportunities, having a work environment supportive of their own professional development is key.

“One of the things I value most about the leadership in the Santa Maria Chamber is their willingness to invest in professional development opportunities,” said Molly Schiff, Marketing and Communications Manager at the Chamber. “For me, this shows that the organization values my goals and development as a leader, and their willingness to invest in me makes me want to invest more of myself back into the organization.”

working for the organization has given him multiple opportunities to develop as a leader. “Developing strong and positive leadership skills at an early age can open up the door to increased self-efficacy, Dougherty said “in return that increased self-efficacy can help with the ability to set goals and achieve them, stress management, and the ability to quickly recover after failures or setbacks.”

In addition to providing professional development for their staff, the Chamber has made it a goal to diversify the leadership within their own organization, and have younger leaders as part of their Board of Directors.

Cameron Stephens, one of the Chamber’s past Board Chairs, brought innovation to the organization as a young professional. While serving as Board Chair, Stephens helped streamline Chamber programming and transition the Chamber to a tiered dues structure to help generate more revenue.

“I feel young leaders are very important because they are tomorrow’s future,” Stephens said. “They are the people who will own, run, manage and prosper in the coming years and decades. I love getting others involved in their 20’s and 30’s so in their 40’s and 50’s when they ultimately have more of “the say” in their business they can positively affect change and hopefully repeat the cycle with the younger generation that will eventually take their place. That’s how we sustain long term success.”

“I got involved with the Chamber Board because I saw the importance of local businesses supporting each other and the impact that has on our individual business growth,” Said Edgar Gascon, Chair Elect for the Santa Maria Chamber Board of Directors. “The more our community grows, the more vital it is that we strive to enhance our resources and network to provide better service and products to our consumers; both locally and regionally.”

“An important part of diversity includes mixing the knowledge and opinions of those that have different view points,” Gascon said. “Whether it be a social or business issue, our background and work expertise shape who we are and how we conduct our businesses in our community.

I hope that as a young professional in a leadership position, I can bring some new ideas and a different perspective to the Chamber Board.”

Outside of their own organization, the Chamber is investing in emerging leaders through Santa Maria Connect, a group created specifically for individuals under

40 that provides professional development and networking opportunities.

“I joined Santa Maria Connect to help me develop my professional networking skills,” said Elise Fuentes, who serves on the steering committee for the program.

“It has helped me become more confident approaching new people. Having this confidence will help me develop and grow my personal network.”

The program not only benefits the young professionals who attend, but also the employers these individuals work for.

“At Community Bank of Santa Maria we have long-term business plans that require continuity of leadership.

Although we have a great environment and culture for developing leaders, we look to organizations like Santa Maria Connect to help us supplement that development,” explained Janet Silveria, President/CEO of Community Bank of Santa Maria. “The program provides opportunities for our staff to engage with other industries, observe other leadership and communication styles, and grow their personal network.”

Anderson agrees it is important for emerging leaders to seek out opportunities like Santa Maria Connect, and make their professional development goals clear to their employers.

“Take every opportunity given to you.

Network through organizations. Volunteer if you need to or take a lower level position to get your foot in the door,” Anderson said. “Make it known to your management that your interest is in growing and expanding your responsibility. Show them that you are worth investing in and taking a risk on.”

Leaders in government, local CEO’s, community organizations and young professionals in the community all see the benefit in the continued development of our local emerging leaders.

“Now is the time, at every organization, to set up the next generation of leaders for success,” Stilwell said. “We need to provide interaction and mentoring, network opportunities, internships, and encouragement. Anyone can stand on the sidelines and complain. Others get involved and make a difference. By helping others in need, being a catalyst, this is what instills a sense of pride in your community.”

As I found it extremely difficult to find a place that fit the entire bill I decided I would do it myself, and offer it to everyone in our community. Along the way I’ve found just how difficult it is to accomplish all of these things, but have made them my priority.

Along with learning the in and outs of how to run this business I’ve also picked up on a couple of new trends in the industry.

One, as in most businesses, is the push to improve environmental friendliness. In an industry like mine that must involve the use of

chemicals, it is important to stay focused on this concern. We stay on top of utilizing cutting edge technology such as Exalt waterbased paint to stay green.

Secondly, as with any other industry, there are larger franchises that have moved in buying out some local small business competition and replacing them. This new trend keeps me focused on all the things that differentiate me from them.

I want my strong values to be the face of my company and I try to personalize each one of my customer’s projects and experiences.

I think it’s important they know that I take pride and responsibility with every job, every customer. I have a strong team that I can trust, and I know they offer the same personalization that I would give.

It is my intention that my customers know our business is local and family owned and operated, and we are here to stand behind the quality of our work. I also

He has been working on cars since before he was 15 years old and quickly realized they are his passion. His love for cars started with car modification and restoration. anta María ya se ha ganado su reputación como una ciudad próspera que atrae negocios y crecimiento, pero hay más en camino.

La ciudad puede carecer de algunas de las cualidades estéticas en comparación con las ciudades inmediatamente al norte y al sur, pero tiene sus propias ventajas cuando se trata de agregar más oportunidades de vivienda y empleo.

uando abrí Armando’s Autobody and Paint, mi objetivo era brindar un servicio a la comunidad que yo mismo estaba buscando.

Quería un negocio que cuidara mi automóvil como si fuera suyo, con cuidado y atención especial a cada detalle, extraordinario servicio al cliente, precios honestos y trabajo garantizado.

Como me resultaba extremadamente difícil encontrar un lugar que se ajustara a mis expectativas, decidí abrir un negocio yo mismo para poder ofrecerlo a todos en nuestra comunidad. En el transcurso me he dado cuenta de lo difícil que es cumplir con todas esas expectativas, pero lo he convertido en mi prioridad.

Tengo un equipo dedicado en el que puedo confiar, y sé que ofrecen la misma personalización y atención que yo daría. Es mi intención que los clientes sepan que nuestro negocio es de propiedad y operación local y familiar y que estamos aquí para respaldar la calidad de nuestro trabajo.

Cámara enfocada en construir líderes emergentes Una de las cosas que me encanta de trabajar para una Cámara de Comercio es la variedad de asuntos en los que nos involucramos cada día. La reciente decisión de la Corte Suprema de California pone a muchos empleadores en alto riesgo

a estado prestando atención a la agitación que rodea a los Contratistas Independientes desde la decisión de la Corte Suprema de California de 2018 en Dynamex Operations West, Inc.? Si está utilizando contratistas independientes y no ha revisado sus expedientes de contratación desde que se tomo esta decisión, puede estar creando un riesgo significativo para su negocio.

La decisión de Dynamex creó una nueva prueba “ABC” para determinar el estado de contratistas independientes: (A) que el trabajador está libre del control y la dirección de la entidad contratante en relación con el desempeño del trabajo, tanto bajo el contrato para el desempeño del trabajo como en efecto; y (B) que el trabajador realiza una labor que está fuera del curso habitual del negocio de la entidad contratante; y

(C) que el trabajador se dedica habitualmente a un oficio, ocupación o negocio establecido independientemente de la misma naturaleza que el trabajo realizado.

La parte B de la prueba ha sido muy preocupante, ya que puede ser muy difícil identificar cómo los servicios prestados por muchos contratistas independientes no están dentro del “curso habitual” de los negocios. Por ejemplo, una compañía cinematográfica no puede afirmar que los editores, especialistas en gráficos y otros servicios comúnmente contratados como IC no realizan trabajos que están dentro del curso habitual de producción de películas.

Si bien, el punto B es el foco principal, a menudo encontramos clientes que fallan en el punto C. Es muy poco probable que ese gran empleado que tenía que se muda fuera del estado (o se jubila) y que decidió mantener como “consultor” tenga un negocio independiente que cumpla con los requisitos.

Nuevas leyes de California en respuesta al Movimiento Me Too E ‌

l Movimiento Me Too, que comenzó en 2006 y obtuvo un amplio apoyo en 2017 después del escándalo de Harvey Weinstein, creó conciencia sobre el acoso sexual y la agresión sexual en el lugar de trabajo. En respuesta a la protesta pública inspirada por el Movimiento Me Too, los legisladores de California aprobaron varias leyes nuevas destinadas a proteger a los empleados. En particular, los legisladores comenzaron a analizar la práctica de imponer cláusulas de confidencialidad en los acuerdos de conciliación, que impidieron que las víctimas de acoso sexual o violencia sexual hablaran de sus experiencias después de resolver sus casos. Una trilogía de leyes de California abordó este tema y entró en vigencia a partir de enero de este año.

Una excepción notable es McKayla Maroney, una gimnasta olímpica, que testificó contra el médico del equipo en su juicio penal. El monto del acuerdo aún puede permanecer confidencial. El demandante también puede solicitar que su identidad no se divulgue al público ni forme parte del registro público, excepto en los casos que involucren a una entidad gubernamental.

La tercera nueva ley modifica la Ley de Equidad en el Empleo y la Vivienda (FEHA, por sus siglas en inglés) para que sea una práctica de empleo ilegal que un empleador exija a un empleado que presente un reclamo bajo la FEHA a cambio de un aumento o bonifi-

cación, o como una condición de empleo o empleo continuo. Esta nueva ley no se aplica a los acuerdos negociados si el empleado ya ha presentado una demanda en la corte o un reclamo ante un organismo gubernamental. En otras palabras, y utilizando el ejemplo de un bono, un empleador no puede inocularse a sí mismo de reclamos desconocidos al obligar a sus empleados a renunciar a sus derechos, a cambio de lo que ya han ganado. Esta misma ley también prohíbe a los empleadores obligar a los empleados a firmar acuerdos de no menosprecio que impidan a un empleado revelar actos ilegales en el lugar de trabajo, incluido el acoso sexual.

Si bien las disposiciones de no menosprecio y no divulgación se han ganado la ira del público y de los políticos, dichas disposiciones no carecen de mérito, ya que fomentan una solución anticipada.

La resolución temprana de disputas en el lugar de trabajo permite a las empresas abordar problemas e implementar los cambios necesarios sin temor a litigios.
