NOTICE TO PURCHASERS

Business trading terms and settlement of purchases

Payment due on Day of Purchase

Interest chargeable from date of purchase at 7% over Bank of Scotland base rate at the time, for accounts in default

Purchase shall be governed by and construed in accordance with the law in England and Scotland

Direct Bank Transfer; Debit Card; Cheque – known customers only; Bankers Draft Business Debit/Credit Cards are now subject to 1.5% charge (from August 2022)

If payment is made by credit card, it must be linked to a business account

Completion of a Buyers Slip (where applicable) essential for parties who have not dealt with the company before No Lots can leave the market without a ‘Pass Slip’ being issued by the main office

New customers and/or agents wishing to purchase on behalf of another party must contact the company’s main office at Lanark at least 48 hours prior to sale, to provide full details and references for authorisation

CONDITIONS OF SALE & PHONE/ONLINE BIDDING

1. All entries will be sold in catalogue order

2. All lots will be sold in guineas and payment to vendor will be in pounds.

3. If there are any injuries to the sheep caused by the dog it will be the owners responsibly

4. Dogs will be shown working on the day there will be no warranty that any dog will give equal preference for new owner. All dogs sold on a non-returnable basis

5. Dogs which persistently grip the demo sheep will not be offered for sale by the auction. They maybe offered for sale in a small pen at the discretion of the Auctioneers

6. Vendors giving eye test warranties must hand in authenticated registration certificates with Auctioneers 1 hour before the sale. No representation in respect of this condition will be made unless documentation is received. Purchasers are advised that eye test certificates, if available may be inspected at the office prior to dogs being offered for sale.

7. Bitches must be clear of pup unless stated. Complaints by the purchaser after the sale must be accompanied by a vets certificate stating the animal was in pup at time of the sale.

8. Unsoundness – Unless stated to the contrary in the catalogue or at the time of sale, dogs are warranted by the vendor to be sound in respect of teeth, legs, and feet. In all other respect except in the case of bitches proving in pup the warranty allows 5 days for lodge of complaint and 5 days for supply of a vet certificate by the purchaser. Vet certificate must verify that dogs was unsound at time of sale. This also applies to castrated dogs, spayed bitches and dogs with one testicle or any know breeding defect. Purchasers satisfying these requirements will be entitled to return the animal with reimbursement along with associated expenses.

9. If the vendor disputes the purchasers claim for breach warranty, the claim will be referred for decision by the auctioneers or a referee. The referee will be will be an independent expect who will carry out an investigation at their discretion to determine the dispute.

10. Vendors must not pass dogs over to purchasers without permission & pass from the auctioneers

11. Vendors of registered dogs or bitches must pass certificates to the Auctioneers at time of sale.

12. Vendors must declare if VAT registered or not at time of sale.

13. Under certain circumstances and at the Auctioneers discretion vendors will be allowed to sell a registered dog without the registration document. Payment to the vendor will be withheld until the registration document is received.

14. If a dog is purchased for export to the EU, Northern Ireland or any other country they will need to meet certain export requirements. Normally a dog will be required to be micro chipped, have a valid rabies vaccination certificate and an animal health certificate or pet passport for certain countries. Additionally some countries require a dog to be certified that they have been treated for tapeworms within a prescribed period prior to sale. Cost of microchip and rabies vaccination is at the cost of the vendor for overseas sales

15. IMPORTANT NOTICE TO BUYERS AND VENDORS Buyers travel long distances to the sale and the office accepts commission bids for entries prior to the sale. Mindful of this the Auctioneers reserve the right to exclude from the sale and future sales any person who privately sells or buys a broken dog (field dog) without booking the transaction through the office. Reserve Prices - The vendor should advise the auctioneer in writing of any reserve price at the time of sale. Provisional Sales - The Auctioneers reserve the right to accept a ‘provisional’ bid from a bidder which is below the reserve price if the vendor is out of contact with the auctioneer (eg working dog in field and out of hearing). Such a bid will be described at the fall of the hammer as ‘provisional or subject to approval’ and is only binding if accepted by the vendor. Provisional bidders should attend the office at the fall of the hammer to register their bid and vendors should make every attempt to allow a provisional bidder to increase his or her bid. In the event of a third party bidding at a lot sold ‘provisionally or subject to approval’ after the fall of the hammer then the vendor should request the auctioneer to put the lot up again without retrial and subject again to the vendor’s revised instructions within 30 minutes of the original offer for sale. The auctioneers reserve the right to exclude from the sale and future sales any person who in their opinion is in breach of these rules or the due process involved in conducting a public auction
