Two settlement routes are available for workers’ compensation claims:
When an injured worker settles a claim with a Compromise and Release agreement, they receive a single lump sum payment. This amount, negotiated by the parties’ legal representatives, usually includes unpaid permanent and temporary disability benefits, plus compensation for giving up rights to future benefits like medical care, case reopening, penalties, and interest.
When parties settle a claim through Stipulations with Request for Award, they agree on the worker’s permanent disability percentage based on medical evidence, resulting in weekly indemnity payments (no lump sum). The worker retains the right to ongoing treatment and can reopen the case for new or increased disability within a set period if supported by new medical evidence—these preserved rights are often very valuable.
Different hearings address different disputes. A trial is held when issues like permanent disability or future medical care can't be resolved without a Workers’ Compensation Judge. The judge hears testimony, reviews evidence, and issues a decision called “Findings and Awards,” resulting in formal orders.
