Impact of the Affordable Care Act

Q

Questions about the Affordable Care Act continue as we approach open enrollment (Nov.-Jan.) for those purchasing individual health insurance or small business group plans. ACA proponents point to the reduction of uninsured Americans as proof the law is working. This reduction is largely due to substantial increases in people covered by Medicaid. The federal government will fund this increase through 2016, after which states will assume partial responsibility. However, the Wall Street Journal reports the cost of covering new individual Medicaid recipients has exceeded expectations by 19%, or $1000/person. The number of new Medicaid enrollees also greatly exceeded projections. This will translate to higher state costs once the federal subsidy is reduced. When our nation finally decides to face its long term structural deficit, it will be tempting to further reduce Medicaid subsidies, potentially crushing state budgets. Over 11 million Americans purchased 2015 coverage on exchanges with a majority receiving premium support via refundable tax credits. This number declined to 9.9 million last month, due to people not paying their premium share or being unable to prove subsidy eligibility. Few barriers exist when people sign up on exchanges, leading to some fraudulent enrollments. For example 700,000 people claiming tax credits didn’t file 2014 tax returns, potentially costing taxpayers billions in bogus payments. Prior to the ACA’s implementation in 2014, 27 million Americans purchased individual health plans. However, some were denied coverage due to serious pre-existing conditions, forcing them to purchase expensive High Risk Pool coverage or remain uninsured. The ACA changed this, making insurance accessible to all regardless of health history. However, ACA mandates and new taxes have increased premiums as opposed to promised decreases. For example, additional preventive services were mandated without any patient co-pay. Rules developed by Health and Human Services also increases costs; an example is the clarification of ACA Section 1557 concerning “discrimination against transgender patients,” prohibiting insurers from categorically denying coverage of care related to gender transition. While this may be politically correct, it represents a new financial cost to insurers and increases premiums for all. While ACA proponents point to low premiums for those receiving large tax credits, others have seen premiums double since 2014. For example, one client of mine is a 39 year old couple with three children. They were perfectly happy with their pre-ACA, Health Savings Account compatible plan that cost $520/month for a family $5,000 deductible. Their new plan has a $7,300 deductible and $937 premium. This $5,000/year premium increase hurt their ability to save for their children’s college education. Others who receive tax credits are worse off than they were prior to 2014. A small business client of mine saw her plan go from a $5,000 family deductible to $12,600. Even after qualifying for a $400/month tax credit, her net premium increase was $120/month. Carriers are requesting big premium increases for 2016 individual plans, though some may be denied. Hallmark Services Corporation, which operates Blue Cross Blue Shield in five states, requested a 52% hike in its New Mexico plans due to rapidly escalating claims. New Mexico’s Department of Insurance rejected this request, leading BCBS to eliminate its PPO (Preferred Provider Network) and replace it with a lower cost HMO network. They plan the same for Texas, replacing the PPO network with an “improved” new HMO network. Humana is reducing its Texas PPO plans from five to one. As feared, networks are shrinking, which means fewer patient choices. Small businesses also face challenges in controlling premiums. Many are raising deductibles and employee contributions which ultimately hurt workers’ paychecks. An estimated quarter of all businesses will pay the “Cadillac Tax” starting in 2018, severely penalizing those offering rich benefits. Most will likely increase deductible and reduce

benefits to eliminate this 40% tax on any amount paid by employers over an ACA-determined annual contribution/ employee. Another trend is the increased merger of insurance carriers. Aetna has purchased Humana, and Anthem is consolidating with CIGNA. The battle between payers and providers has increased; providers demand adequate reimbursement to remain profitable and be able to stay in carriers’ networks, while payers are attempting to lower costs. These scenarios lead to fewer consumer choices. Many physicians are opening “concierge” practices where existing and new patients pay a monthly fee that circumvents the insurance process. While this works for wealthier patients or physicians tired of the insurance rat race, it reduces access for low income individuals, the very people ACA was designed to help. Those with HMO plans already find it difficult to access doctors who accept their insurance. People may be insured, but that doesn’t mean they have easy access to doctors. Other physicians are choosing to leave medicine altogether. What can small businesses do to deal with this new reality? Many small business owners who purchase individual plans face the loss of their PPO and do not want HMO options. They should reconsider small group plans that have a nice selection of PPO options. While it is true they would incur the cost of offering this benefit to all full time workers, it is an excellent recruiting and employee retention tool. In Kendall County, many employers find it difficult to attract good help, so offering benefits can be a game changer for prospective employees. A client who owns four fast food restaurants realized the need to increase his workers’ hourly wage to remain competitive in the market; he also considered health insurance that would cost about $2000/year per employee. He asked key employees if they preferred an increase in wages by $1/hour with no benefits, or a smaller wage increase with benefits. They chose a smaller increase with benefits. Over 96% of his workers are now insured, and he reports that employee satisfaction is very high. Small business owners should also consider lower premium Health Savings Account plans as well as some of the more creative options carriers are developing. Navigating the complexity of health insurance is undoubtedly challenging. However, with the proper guidance and direction a business can juggle this balancing act in a cost effective and morale building way. Art Competition Beautifies Boerne

Joe Barrington is an amazing sculptor, one of those rare persons who can grab something plain and ordinary – like a distressed light pole or a twisted oil field pipe – and breathe new life into it, transforming it into a stunning, larger-than-life sculpture. One of his latest creations – Comet and Raven: Messenger from Afar – is on display now through September 2016 in Boerne at the city’s 1st Annual Art al Fresco Public Art Exhibition. Made from powder coated scrap metal, it stands 20 feet tall and features an iridescent, bluish-purple raven riding a comet. “The comet turns on an axis,” says Barrington. “So whatever way the wind blows, it points that way.” Barrington, from Throckmorton, Texas, has long used the raven image in his creations. He adopted the idea of ravens as messengers from the spirit world from Native American Indian lore. His sculptures are bold, noticeable, and deliver a message. Yet, Barrington believes people can come away with whatever interpretation they want. “It’s also supposed to be entertaining. If you don’t see a message in it, that’s fine. And if it makes you smile, that’s fine, too,” he confides, laughing. In all, eight artists, including Barrington, are participating in the exhibition. The Boerne Public Art Competition Committee, comprised of representatives from the five city council districts and three representatives from the art community, chose the pieces, which were crafted from such diverse materials as bronze, stucco, concrete, and welded steel. The finalists for the first annual Art al Fresco Public Art Competition are: • Andrew Arvanetes – “Urban Moai Figure” • John Banks – “Stars on Parade” and “Thought of a Treble Clef” • Joe Barrington – “Comet and Raven: Messenger from Afar” • Jeffie Brewer – “Yves Klein Blue Heron” and “Bunny” • Russ Connell – “Red Pony” • Jerry Daniel – “Dancer 2015” • Rollin Karg – “Mongo” • Craig Gray – “Slices of Heaven” Origin of Art al Fresco The idea for Art al Fresco (an outdoor or “fresh air” exhibit of public art) grew out of years of collaboration between the City of Boerne and the local arts community. Paul Barwick, Boerne’s Special Projects Director, explains: “In 2008, we requested assistance from the American Institute of Architects to help us with some urban issues and to develop a vision for a better future for our community. So AIA sent its Regional/Urban Design Assistance Team (R/UDAT) here. “R/UDAT looked at a wide variety of issues downtown, such as how do we grow

downtown and what do we need to change or expand. Their report indicated there was a strong desire in the community to make public art available in public places. “That led us to work with a local arts group, the Hill Country Council for the Arts. They made arrangements to have a Dallas foundation lease us some bronze longhorns on exhibit there. “After being on display for a year and receiving considerable public interest, the longhorns were returned; however, their presence here started an earnest dialogue about public art. Later, the city purchased and was gifted additional sculptures, including the Wild Bill Hickok bronze at Main Plaza, the Land of the Cheyenne on the Cibolo Trail, and Father Gander in River Road Park, bringing our

This helped prompt the city to establish the current public art exhibition and competition, the first of its kind in Boerne. It instantly adds 10 more sculptures – all on loan for a year. They’re all for sale, and the city has the option to purchase one or more pieces, if it chooses, after the exhibit ends. “We are very fortunate to have the support of City Council for this initiative. Without their vision and backing to move public art forward, this project would not have been possible,” states Barwick. “It’s a way for us to rapidly build a collection and create some excitement about public art,” adds Mary Woods, Boerne Special Projects Manager. “Art al Fresco helps us engage the local community and drive cultural tourism. We’re always

Several of the artists were on hand to meet with residents and discuss their entries. “Continuous improvement is the name of the game in Boerne, so we are about to unveil the next big reason to spend time here,” said Mayor Schultz. The city’s historic downtown – known as Boerne’s Hill Country Mile – and Boerne’s Trail System will showcase the sculptures. Residents and visitors can navigate the exhibit with the aid of complimentary walking tour brochures available at the Patrick Heath Public Library, the Boerne Convention and Visitors Bureau, the Greater Boerne Chamber of Commerce, and at downtown retailers. Or, they can take a free, self-guided walking tour available via download through the free mobile app, Otocast. Just download the app on any smartphone or app-enabled device to explore Art al Fresco and hear the artists talk about themselves, their sculptures, and creative inspiration. Residents are invited to vote for their favorite sculpture. They can vote at www.ArtalFresco. com, the free mobile app Otocast, or by downloading the QR code printed in the walking tour

brochure. Voting will be open until mid-August 2016. The City will recognize the artist receiving the most votes as “Boerne’s Choice” at the close of the year-long competition. The City of Boerne and Boerne’s Hill Country Mile, in partnership with The Boerne Convention and Visitors Bureau, are sponsors of the Art al Fresco Public Art Competition. A Big Challenge “This being the first art installation was a big challenge,” Barwick exclaims. “There are so many things to consider to make this happen. Setting up the program, getting insurance, finding artists who know what they’re doing, choosing the pieces, making sure the art is placed where there’s no conflict with all the city public right of ways and utilities, and a thousand other details.” “The thing that’s been very gratifying for us has been working with the artists and others in the creative community. They’ve been very sharing, very giving,” adds Woods. The city currently owns five sculptures with two more soon to being gifted to Boerne by Majestic Ranch Arts Foundation. Along with the 10 pieces on loan, residents will be able to view 17

works of art over the next year. The City Council committed to the public art program for five years. After five years, it will decide whether or not to continue with it in its present format. Art & Community “The tagline for this program is ‘Art & Community,’ says Barwick. “A big part of this is to have that community conversation about public art. We know people are going to be rather passionate about art. They know whether they like it or not. “I’m excited to have this dialogue and see people’s reactions. Public art raises the public spirit, gives us something visual and tangible that speaks to the heart and soul. And, it’s going to be a monumental part of what makes Boerne a beautiful place to live, work, and visit,” he enthuses. BBM

Empowering Today’s Youth to Become Tomorrow’s Entrepreneurs

Did you ever have a lemonade stand as a kid? If so you probably remember how fun it was to be able to create a product, design a stand, make some posters, and don’t forget the best part – earn some money! However, what you probably didn’t realize when you were younger is that your lemonade stand was your very first attempt at starting your own business and trying out your entrepreneurial skills. Lemonade Day began in 2007 as a result of founder Michael Holthouse’s vision to empower today’s youth to become tomorrow’s entrepreneurs through helping them start, own and operate their very own business…a lemonade stand. Lemonade Day is a strategic 14-step process that walks youth from a dream to a business plan, while teaching them the same principles required to start any larger company. Inspiring kids to work hard and make a profit, they are also taught to spend some, save some and share some by giving back to their community. Since it’s launch in 2007 in Houston, Texas, Lemonade Day has grown from serving 2,700

kids in one city to over 800,000 children across North America. Boerne hosted its very first Lemonade Day this year on May 3rd, 2015 and is already gearing up for their second one on May 1st, 2016. Lemonade Day Boerne is currently being made possible by the donations of its Presenting Sponsors, Texas Heritage Bank, Carol and Michael Bertuzzi, and Ron Warden – Edward Jones, as well as additional sponsorships from Anytime Fitness, Hill Country Memorial Hospital, Just Between Friends and its Community Partners, which include the City of Boerne, Boerne Independent School District and the Greater Boerne Chamber of Commerce. Children of all ages, from pre-K through high school, can begin registering for Lemonade Day beginning in January of 2016. Those who register will receive a backpack with an informational workbook that outlines the steps needed to start and run a business. Optional classes will be held in the spring for students to have a chance to learn more about creating and operating their


own business. Kids learn to set goals, develop a business plan, establish a budget, seek investors, provide customer service, save for the future and give back to the community. Lemonade Day Boerne is the perfect opportunity for our community to train the next generation of entrepreneurs through a free, fun, engaging, and empowering activity. “Our first year was a phenomenal success with over 300 children signing up to participate in Lemonade Day,” said Ariel Brooks-Stevens, Co-City Director of the Lemonade Day Boerne Board of Directors. “Approximately 1/3 of the children set up booths on May 3rd (Lemonade Day 2015) and we had 24 registrants for the Best Tasting Lemonade Contest and 22 registrants for the Best Marketing/ Store Front Contest.” In order for Lemonade Day Boerne to be a success, local businesses are being asked to participate by providing sponsorships, offering location sites for Lemonade Day booths, becoming investors, mentoring, and of course buying lemonade from these budding entrepreneurs! Sponsorship are available at three different levels: You have the Main Squeeze sponsorship for $2500, the Fresh Squeeze sponsorship for $1,000 and the Lemon Drop sponsorship for $500, all of which offer great recognition and go towards the goal of making Lemonade Day Boerne great! Monies in excess of Lemonade

Day’s expenses will go towards college scholarships to be awarded to Lemonade Day Boerne’s Entrepreneur of the Year and the Winner of the Best Tasting Lemonade contest. Lemonade Day Boerne Co-City Director, Kirsten Cohoon added, “Our first year we were able to award $1600 in scholarship money, for 2016 we would like to raise enough money to distribute $3,000 in scholarship funds.” Sponsorship commitments are needed by December 15th, 2015. The Lemonade Day Boerne Board of Directors consists of Kirsten Cohoon, Ariel BrooksStevens, Chris Christianson, Beya Jouini-Otieno, Stephanie Fox, Nikki Miller, Crisanne Zamponi, Heather Dickens, Lissette Jimenez, Jennifer Hudson, Ed Puente and Danny Zincke, all of which are committed to providing local youth with the life skills, mentorship and real-world experience necessary to be successful. Lemonade Day Boerne is much broader than just one individual child selling lemonade from his or her stand. It’s a process that gets the whole community focused long term on investing in our youth and teaching them about business. It invests in the future of our youth by teaching them how to create their own jobs instead of just looking for employment. In the July issue, BBM profiled the newly formed Boerne Community Coalition, whose goal is to ensure meals are provided to local children suffering from food insecurity during the summer months when school is not in session. These are children who depend on the Federal Meal Program during the school year for their breakfast and lunch each weekday. Unfortunately, even during the school year, many also suffer from hunger on the weekends. That’s when an organization called Blessings in a Backpack (BIB) steps in to bridge the gap. BIB provides food for the weekend throughout the school year to help lessen the effects of food insecurity on our community’s most vulnerable citizens. Blessings in a Backpack is a national nonprofit with chapters in forty-four states, including

other locations in Texas. The Boerne Chapter was founded three years ago by Kathy Bandujo, who knew from previous volunteer work that Boerne had a significant hunger problem that was under the radar of most residents in our affluent community. She was quickly joined in this effort by good friend and co-chair Karon Shouse. After receiving approval from BISD Superintendent David Stelmazewski, who wholeheartedly supports the program, it was piloted at Cibolo Creek Elementary at the beginning of the 2013-14 school year. Due to the generosity of many groups, organizations and individuals, BIB was able to begin serving the neediest children at Fabra and Curington elementary schools later that same year and then expand to the remaining two elementary schools, Kendall and Fair Oaks, by the second year. The 2015-16 school year will see the program expand even more. “We’ve been very conservative for the past two years with the numbers of children we serve due to funding. We asked the schools for ‘the neediest of the needy’,” said Bandujo. “But this year, we told them to give us every child in need. We’re stepping out in faith that the funds will come.” The chapter is also working on becoming part of a buying cooperative with other backpack programs across the state through a large food distributor. This will enable them to provide milk, which is something they hadn’t been able to afford. “We can get shelf-stable single-serve cartons of milk through this distributor for less than half of what we could otherwise,” said Bandujo. “Most of ‘our’ kids don’t get enough milk. If we can provide two servings each weekend, we can significantly increase their nutrition. It will increase our cost per child, but we think it’s worth it.” Each BIB chapter operates independently and must raise the funds to purchase all the food it provides. The Boerne chapter is all-volunteer; there are no paid staff or offices. “It’s just a couple of moms working out of their homes and a great group of volunteers who show up every week to help pack the food,” said Shouse. PTO volunteers from each school handle bag distribution to the teachers, who slip the food bags into the backpacks of the children when no students are in the classroom. This ensures that no child is singled out or embarrassed. Every penny raised by BIB is used solely to purchase food for the children. All donations are tax-deductible since BIB is an approved 501(3)c non-profit. It costs approximately $150 to support one child for the entire school year. ALERT: Everyone seemed to be scrambling to close on their home or trying to figure out “what’s next” because of the new rules that went into effect on October 1st from the Consumer Finance Protection Bureau. Be sure to get with your knowledgeable Real Estate Agent to find out more. The most important measure is to keep everyone in the “loop” because timelines will be crucial with selling, buying and moving. In local real estate news, there were 419 Active single family homes for sale in Kendall County and reported as of 9/28/15. It is very hard to find anything below $150,000, however the lowest list price was $139,500. The highest list price was $7,950,000.00 as of 9/28/15. From the beginning of the year 2015, there were 465 sold and closed single family homes in Kendall County. The average price was $407,798 and the average days on the market were 152. There were only three single family homes sold that were sold below $100,000 in Kendall County during that same period. The highest “sold” price was $2,090,000 and it was only on the market for 7 days. A recent report from CoreLogic said that five of the 14 most over-valued housing markets in the country are in Texas. But that doesn't mean the Lone Star State is in a housing bubble, says Real Estate Center Chief Economist Dr. Jim Gaines. “We don’t think we are in a price bubble, but we are well aware that home prices have been increasing at almost twice their normal annual rate of increase for the last several years,” Gaines told HousingWire, an online mortgage industry news source. “When you bring people and jobs, that creates a heavy increase in the demand for housing, rental and owned,” Gaines said, alluding to

the jobs created by the state's oil and gas boom. But he added that land development and construction are slowing because of new lending restrictions. “Over the last several years, the demand started going up much faster than the supply could keep pace with,” said Gaines. “For example, all of our housing markets are reporting significantly low volumes of homes being listed for sale relative to the demand. A normal market would have six months of inventory, while we are running at a three-month inventory. “Bottom line, we don’t think there is really a bubble,” he said. BBM

International Homebuyers Add $8.32 Billion to Texas Economy

According to a new report from the Texas Association of Realtors (TAR), Texas homes purchased by international homebuyers added $8.32 billion to the Texas economy between April 2014 and March 2015. Homes purchased by international buyers accounted for 4 percent (209,000 sales) of all U.S. home sales and 8 percent ($104 billion) of total U.S. home sales dollar volume. This is a 10.15 percent decrease in international home sales but an 11.4 percent increase in international home sales dollar volume from the same time last year. Approximately 8 percent (16,720 sales totaling $8.32 billion) of this activity occurred in Texas — a 4 percent decrease from the same time frame last year. For the first time since TAR has been publishing this report, homebuyers from Latin America (including Mexico) were not a clear majority of international homebuyers in Texas, comprising only 41 percent. Meanwhile, homebuyers from Asia/Oceania (including China) doubled from 18 percent from April 2013 to March 2014 to 31 percent from April 2014 to March 2015. Texas homebuying activity among European and African buyers was up from 9 percent to 15 percent and 4 percent to 8 percent, respectively. Meanwhile, Texas home sales to Canadian homebuyers decreased slightly from 5 percent to 4 percent. Naturalized U.S. citizens in Texas continue to be significantly more likely to own a home than their native counterparts. Three in four naturalized U.S. citizens here are homeowners compared with only 63 percent of native citizens in Texas. This trend does not apply nationally, where homeownership rates among naturalized and native U.S. citizens are virtually equal. However, non-U.S. citizens are 11 percent more likely (44.3 percent vs. 33.3 percent) to own a home in Texas versus nationally. BBM
