By Yvette Tello Mental Health Awareness Month is observed every May to raise awareness about mental health, reduce stigma, encourage conversations about emotional well-being, and promote access to support and treatment. It began in 1949 through Mental Health America and is now recognized by many organizations, schools, workplaces, healthcare providers, and communities across the United States. During May, people often share personal mental health stories, educate others about anxiety, depression, trauma, and other conditions, promote self-care and wellness, and encourage people to seek help. Many organizations also host campaigns, walks, workshops, and online discussions throughout the month. What are the best things for mental health you have found effective? Maybe it’s therapy.

Maybe it’s medication. Maybe it’s prayer, music, exercise, boundaries, journaling, sleep, nature, supportive people, or simply slowing down. What genuinely helps you feel grounded, safe, peaceful, or emotionally healthy? Let’s talk about it… #letstalkaboutit Z Z: “Staying OFF all and any antidepressants and benzodiazepines…I am, in no way, offering medical advice, but, these drugs are a PROBLEM, IN AND OF THEMSELVES, and I want others to AVOID my experience with them. This is an attempt to raise awareness. Nearly 30 years ago, after I experienced the sudden and severely traumatic loss of a fiance, I was almost immediately prescribed antidepressants…within two months. That death was on October 9, 1995. No one told me that there is NO plan in place to EVER be off these drugs. This journey never ends because, in my case, I am left in theworst depression I can imagine and the physical withdrawals are NEVER mentioned. Doctors simply swap one drug for another, time after time. Unless the dis-EASE is untreatable in any other ways, please THOROUGHLY consider

non-drug options. I will never know how I would have functioned if I had been given time to grieve for a year. What resulted is that I am STILL clinically depressed and have NEVER been without one of the scads of drugs PHARMA pushes. These drugs have EXTREME side effects and take months to have any impact, if that can be measured. It’s about finding a drug whose side effects ONE CAN TOLERATE. EXTRAORDINARILY VARIABLE. THEY CHANGE THE BRAIN, and my brain isn’t the same and this is not fixable. Life is a series of traumas.

Antidepressants stole my opportunity to know if I WOULD HAVE BEEN ABLE TO RECOVER with grief counseling and TIME. I can’t go back. Please be FEARFUL of these drugs leaving you with only more problems. That’s my experience.

Chris Wojcik:“A regular exercise routine. You should be exercising in some capacity every single day. As much as a hard workout in the weight room after Jiu-Jitsu practice or as little as a walk.

Move your body every day. A fairly healthy diet. If you have a donut (sugar) for breakfast, fast food for lunch, and a bunch of alcohol with dinner, it’s no wonder you feel like shit. Take it from someone who used to take a bunch of antidepressants: before you get on a bunch of antidepressants, try eating better 85–90% of the time. Whole foods (not the store).

Vegetables, meat, fruit. Good sleep habits. In recent years, my mental health has been very good with few exceptions.

The few exceptions are pretty much always related to stress and poor sleep.

Often both. Get good sleep.Good stress management skills. You cannot remove stress from your life. You will sometimes have stressful days. Do you want to be a person who crumbles under stress and starts screaming at cars in traffic, or do you want to become a person who can deal with the stress of life and keep moving forward? Stress will always be there, might as well get stronger. Don’t have too much caffeine. I’m an avid coffee person.

I drink a whole pot in the morning while I work before I go to my noon Jiu-Jitsu practice. One thing I do in the afternoon is avoid caffeine unless I have something physically demanding that evening. Caffeine impacts sleep which impacts stress.

Write. I’ve been a writer for a few years now, but before that, I was a journaler (I started my first journal in 2015). The physical act of writing helps you organize your thoughts, manage anxiety, and problem-solve. Every person should write at least a little bit — especially if you struggle with depression or anxiety. Spend time with loved ones. I recently moved my whole life to Austin, Texas, to train Brazilian Jiu-Jitsu. I’m away from my

family and the friends that I had for years before I moved. This has been tough. I now cherish the time I have with my girlfriend, parents, and old friends more than ever. If you have the ability to, make sure you spend as much time as you can with your loved ones. Do selfless things. This could be as organized as volunteering at a homeless shelter or as small as being a good friend. Either way, selfless behavior makes you feel better about yourself.

It improves confidence, happiness, and overall well-being. Face your fears. I get it, this is corny and I’m writing a generic self-help list. Whatever. If you want to improve your mental health, one thing you absolutely have to do is “things that scare you”. Constantly test yourself. Challenge yourself. It will make you stronger. Seek help. If you’re reading all these points and getting mad because none of them work for you, I get it. Not every mental ailment can be treated with good, healthy habits.

If that’s you, go find a therapist, a psychiatrist, or a doctor. Mental illness is real, and it really sucks if you don’t treat it.”

Here are some I use:Physical activity releases endorphins, which are natural mood lifters. Aim for at least 30 minutes of exercise most days of the week. A balanced diet rich in fruits, vegetables, whole grains, lean proteins, and healthy fats provides essential nutrients that support brain function and mood regulation. Prioritize getting 7-9 hours of quality sleep each night. Poor sleep can negatively impact mood, cognitive function, and overall mental well-being. Practice relaxation techniques such as deep breathing, meditation, yoga, or progressive muscle relaxation to reduce stress levels and promote mental calmness. Maintain meaningful relationships with friends, family, and supportive communities. Regular social interaction can provide emotional support and a sense of belonging. Cultivate mindfulness through activities like meditation, mindfulness-based stress reduction (MBSR), or simply being present in the moment. Mindfulness can help reduce anxiety, depression, and rumination. If you’re struggling with mental health issues, don’t hesitate to seek support from a therapist, counselor, or mental health professional. Therapy can provide valuable tools, coping strategies, and emotional support. Establish healthy boundaries in your relationships and commitments to prevent burnout and maintain emotional well-being. Participate in activities that bring you joy and fulfillment, whether it’s art, music, sports, gardening, or any other hobby that interests you. Reduce excessive screen time, especially on social media and news platforms, as it can contribute to stress, anxiety, and negative emotions. Remember that mental health is a journey, and it’s okay to seek help and support when needed. Incorporating these practices into your routine can contribute to improved mental well-being over time.“

About the Artist: George Bedoy George Bedoy is a 17-year-old artist hailing from San Antonio, Texas.

He is currently a student at Sandra Day O’Connor High School in Helotes, actively participating in the Art Program and ranking among the top students in his class. From an early age, George exhibited a strong drive to excel, but it was the arts that truly captured his heart. His artistic journey began in childhood, gaining significant momentum in middle school around 2020. Faced with the choice of electives such as Band, Orchestra, and Art, George chose art, a decision that would profoundly shape his future. This pivotal moment marked the beginning of his exploration into the world of creativity. As he has matured as an artist, George’s style has developed into a unique blend of illustrative works. His pieces are

known for their dynamic use of color and a combination of rough and defined pen strokes, resulting in expressive creations that embody Semi-Surrealist Expressionism and Contemporary Realism. His art delves into serious psychological themes related to the human mind and nature, inviting viewers to engage in thoughtful interpretation.

Recently, he has also begun to explore painting, particularly enjoying the medium of acrylics. George has participated in various art competitions, earning multiple regional-level medals in the Visual Arts Scholastic Event (VASE). This year, he has experienced significant growth through mentorship with Donald Darst, curator and partial owner of the Helotes Gallery. This opportunity has allowed him to collaborate with other

artists and gain insights into the local art community and the business side of art. On May 9th and 10th, 2026, George showcased his work in a personal gallery exhibit at the Helotes Gallery, featuring a series that depicted the gallery itself along with nine additional pieces. This mentorship has been a crucial step t oward his aspirations as an artist, and he is eager to see where this journey takes him. George plans to major in Studio and Fine Arts in college while also studying Mathematics and Architectural/Interior Design, with the goal of becoming a Concept Artist in the future.

AVISO DE LA SOLICITUD Y DECISIÓN PRELIMINAR PARA EL PERMISO DEL SISTEMA DE ELIMINACION DE DESCARGAS DE CONTAMINANTES DE TEXAS (TPDES) PARA AGUAS RESIDUALES INDUSTRIALES RENOVACIÓN PERMISO NO. WQ0003955000 SOLICITUD Y DECISIÓN PRELIMINAR. Después del cierre de todos los períodos de comentarios y de petición que aplican, el Director Ejecutivo enviará la solicitud y cualquier petición para reconsideración o para una audiencia de caso impugnado a los Comisionados de la TCEQ para su consideración durante una reunión programada de la Comisión.

La Comisión sólo puede conceder una solicitud de una audiencia de caso impugnado sobre los temas que el solicitante haya presentado en sus comentarios oportunos que no fueron retirados posteriormente. Si se concede una audiencia, el tema de la audiencia estará limitado a cuestiones de hecho en disputa o cuestiones mixtas de hecho y de derecho relacionadas a intereses pertinentes y materiales de calidad del agua que se hayan presentado durante el período de comentarios. El Director Ejecutivo puede emitir la aprobación final de la solicitud a menos que se presente una solicitud de audiencia de caso impugnado oportunamente o una solicitud de reconsideración. Si se presenta una solicitud de audiencia oportuna o una solicitud de reconsideración, el Director Ejecutivo no emitirá la aprobación final del permiso y enviará la solicitud y la petición a los Comisionados de la TCEQ para su consideración en una reunión programada de la Comisión.

Reflecting and Remembering My Marianist Experience By: J. Gilberto Quezada

My Marianist journey began during my senior year (1965) at St. Augustine School in Laredo, Texas, when I made the decision to continue my education at St. Mary’s University in San Antonio after finishing my two years at Laredo Jr. College. It was a choice rooted not only in academic ambition but also in a lifelong devotion to Our Blessed Mother, instilled in me by my mother when I was just three years old in our beloved Barrio El Azteca. From those early days of praying to La Virgencita de Guadalupe and the Virgencita de San Juan, my faith became the foundation upon which my educational and personal life would be built. At St. Mary’s University, my devotion to Our Blessed Mother deepened through the Marianist teachings, philosophy, and charisma that permeated campus life.

These values became my stronghold, guiding me in both my professional career and personal life. Living on campus further enriched this experience.

During my first two days at St. Mary’s University, an unforgettable journey began when I wandered into Reinbolt Hall looking for the bookstore and stumbled upon Assumption Chapel.

Built alongside Reinbolt Hall in 1908, this serene and inviting chapel soon became my haven for peace and tranquility. Amid the busy schedule of attending classes and working on campus, I found solace in the quiet sanctuary of Assumption Chapel, a place where time seemed to pause and my mind could rest. This discovery transformed my university experience, becoming a cornerstone of my spiritual growth and

personal reflection. My first dorm was Chaminade Hall, named after Blessed William Joseph Chaminade, S.M., the founder of the Society of Mary. Chaminade dedicated his life to rebuilding the Catholic faith in France after the Revolution, emphasizing community and devotion to Mary. Later, I moved to Charles Francis Hall, named after Father Charles Francis, S.M., a devoted Marianist educator remembered for his commitment to teaching and service. These dorms were more than buildings; they were symbols of the Marianist spirit that shaped my daily life. The professors at St. Mary’s were instrumental in shaping my intellectual and spiritual growth. Lay professors such as Dr. Félix D. Almaraz, Jr., Dr. Hubert J. Miller, and Dr. Gary Gordon provided rigorous academic training and inspired me to pursue excellence in history. Equally influential were the Marianist professors, whose teachings carried the weight of faith and philosophy. Their dedication to both scholarship and the Marianist mission left an indelible mark on my education. I vividly recall the courses taught by these remarkable men of the Society of Mary. Rev. Willis Langlinais, S.M. guided me through History of Philosophy and Faith Today, while Rev. Adolf Windisch, S.M. opened my mind to Social Philosophy. Dr. John T. Donohoo, S.M. taught Anatomy and Physiology, and Dr. Paul Metzger, S.M. led me through Education classes. Brother Ralph Thayer, S.M. brought history alive with The Westward Movement, Dr. Rev. Gabriel Franks challenged me with Logic, and Rev. John G. Leies enriched my understanding with the

Study of Religions. Each professor contributed uniquely to my Marianist experience, blending academic rigor with spiritual depth. Another advantage was that I got to know more about our Society of Mary professors because they too lived on campus, although in a separate facility, nonetheless, I had an opportunity to interact with them outside the classroom in many intellectually stimulating circumstances. Beyond the classroom, the Marianist presence was felt in leadership and service. During my time at St. Mary’s, the Very Reverend Louis J. Blume, S.M. served as President, embodying the Marianist vision for education. My work-study program in the Academic Library placed me under the guidance of Brother Paul Novosal, S.M., whose stewardship of the library reflected the Marianist commitment to knowledge and community.

These experiences reinforced the values of discipline, service, and devotion that continue to guide me today. As I reflect and remember my Marianist experience, I am filled with gratitude for the professors, mentors, and leaders who shaped my journey. Their teachings and example instilled in me a lifelong devotion to Our Blessed Mother and a commitment to living out the Marianist charisma in all aspects of my life. From the dorms named after Marianist pioneers to the classrooms where faith and knowledge intertwined, my years at St. Mary’s University remain a cherished chapter in my life. The Marianist spirit continues to inspire me, reminding me that education is not only about learning but also about living with faith, service, and love.

Carmen Lomas Garza: “Picturing the Familiar” Opening at Arizona State University

By Ricardo Romo, PH.D On May 2, the Arizona State University [ASU] Art Museum opened an exciting exhibit, “Carmen Lomas Garza: Picturing the Familiar, ” the first major retrospective of this pioneering Mexican American artist in more than two decades. Born in Kingsville, Texas, Carmen Lomas Garza is an artist, educator, and illustrator whose depictions of everyday Mexican American life have become deeply embedded in the cultural imagination across generations.

Alana Hernandez, Senior ASU Curator, with Natalie Solis, ASU Latinx Curatorial Fellow, submit that Garza’s work has profoundly shaped how Mexican American histories, traditions and values are seen, remembered, and passed down. Carmen Lomas Garza came of age in Kingsville, Texas, a small, rural town nestled in the heart of South Texas. Kingsville, just a hundred miles from the U.S.-Mexico border, became the emotional and geographical anchor for much of Garza’s artwork. Garza became interested in art at an early age. She wrote that at age thirteen she decided to become a visual artist, adding that “The Chicano Movement of the late 1960s inspired the dedication of my creativity to the depiction of special and everyday events in the lives of Mexican Americans based on my memories and experiences in South Texas.”

Her college art studies led her to recognize a purpose and value for creating art. In her recent Artist Statement, she wrote that she desired “to create images that would elicit recognition and appreciation among Mexican Americans, while at the same time serve as a source of education for others not familiar with our culture.” South Texas was a wellspring of memory and meaning that infuses her intricate and vibrant scenes, noted the ASU curators. Before her relocation to San Francisco in 1976, Garza had critically developed the essence of her creative career, visually capturing the Tejano (Texan Mexican) and Chicano cultural experiences for broader educational purposes. Garza’s most popular books, In My Family / En mi familia, and A Piece of My Heart / Pedacito de mi corazón, have sold a total of 1.1 million copies. In My Family presents childhood memories in Kingsville, Texas, through paintings and short stories. The book, A Piece of My Heart, a long-overdue introduction to an important Chicana artist and the cultural world she depicts. Both books have been used extensively in elementary and middle schools across the Southwest..

Texas. Until recently, many had missed Garza’s prominent role in introducing the iconic Frida Kahlo to the US and much of the rest of the world. After visiting the fabulous Frida show in Houston earlier this year, I wrote an article about Frida, confirming that Garza was a key member of the planning committee when the Galería de la Raza presented Homenaje a Frida Kahlo: El Día de los Muertos in 1978. The year after moving to San Francisco, Garza painted her first works in the South Texas series, Cuarandera, [1977]. Harriett and I met Garza in 1985, shortly after she had completed several of her Sandia [watermelon] paintings. She gave us a tour of her home in the Mission District of San Francisco, and we were able to purchase several of her prints.

We have since donated these works to the McNay Art Museum, the San Antonio Museum of Art, and the San Antonio Public Library so that San Antonio residents, students, and young artists can become familiar with her work.

Garza painted memorable artworks, many of which are collected by the Smithsonian and other major museums, but she was also a trailblazer in promoting Chicano and Mexican art. Alana Hernandez, the Senior Curator of the ASU exhibit, documents Garza’s 50-year contribution by noting that in 1975, Garza and several other artists formed a new artists’ group, Los Quemados, and staged their first exhibition on June 20 at Trinity University in San Antonio,

The ASU curators note that Garza’s work also dwells on quieter domestic rituals: cleaning nopales, slicing open watermelons, or participating in healing ceremonies passed down through generations.

These are acts of cultural endurance, depicted not merely as quaint customs or “relentlessly idyllic” but as profound markers of identity and belonging.

A beautiful catalog produced by the ASU Museum is both highly informative and a visual feast. The catalog included an essay I thoroughly enjoyed by Claudia Zapata. Zapata, the Latinix curator for the UT Austin Blanton Museum, reflected on Garza’s artistic achievements. Zapata wrote in the exhibition catalog: “The artist’s wide success can be attributed to her nostalgic, vibrant scenes, in prints and paintings, which highlight Mexican American cultural

24 de Mayo de 2026 events such as quinceañeras, birthdays, and religious traditions.” Zapata argues that Garza “relied on Texas” to shape her defining artistic career.

According to Zapata, “looking back and recognizing Garza’s formative moments in her artistic development properly contextualizes the foundation of her expansive career.”

Art historians acknowledge that Garza’s transformative college years at Texas A&I in Kingsville, 1964–72, were critical years that defined Garza politically and artistically. While in Kingsville, Garza and many of her fellow students participated in campus events and discussions about the Vietnam War, the United Farm Workers’ boycott of lettuce and grapes, and ways to advance the causes of social justice and equality in American society. Garza recalled that the campus activists recruited art students to create posters and signs for their demonstration and organizing efforts.

La Prensa Texas SAN ANTONIO This book serves as the best primer of this prominent Chicana artist. Cortez combines commanding visual readings of Garza’s well-known paintings with discussions of the artist’s working techniques and analyses of her rich repertoire of artwork.

The UCLA Chicano Studies Press published Cortez’s Carmen Lomas Garza book with the guidance of Professor Chon A.Noriega. Noriega noted that Garza’s “art takes the form of personal memory within a visual “folk” idiom, suggesting a sharp contrast with modern art that is understood as a break with the past, with traditions, and with religion.

At the Galería, despite structural challenges within the organization, Garza carved out a space for herself as a curator, arts administrator, and leading Chicana artist—an experience that equipped her with the skills, networks, and visibility to sustain a full-time artistic practice in San Francisco beginning in 1981. Bringing her South Texas experiences to the Bay Area, Garza cultivated Galería de la Raza’s evolving legacy, particularly in its annual Día de los Muertos programming and community-centered exhibitions. Through this work, Garza positioned herself not only as an artist but also as a cultural organizer and advocate for “Raza arts” on both statewide and national levels.

Carmen Lomas Garza’s art has been widely described as documenting Mexican-American life.

Chon Noriega adds that through her South Texan lens, “Garza challenges mainstream narratives, giving her work specificity and strength and affirming the complexity and dignity of the communities she portrays.” Her children’s books, widely used in schools, have influenced and will continue to influence new generations.

The influence of the Chicano Movement gave Garza both purpose and voice. An example is her wellknown imagery of tamalada scenes: women gathered in kitchens, children nearby, food preparation as both labor and celebration. These works are not just nostalgic—they document cultural practices and encode values of family, cooperation, and continuity. For those wishing to delve deeper into Garza’s art journey, I recommend Constance Cortez’s excellent book Carmen Lomas Garza, published in 2010.

When Carmen Lomas Garza relocated to the San Francisco Bay Area in 1976, she began her professional artistic career at Galería de la Raza (GDLR).

Garza initially volunteered at the Galería, then transitioned into a part-time staff role before securing California Arts Council Artist-in-Residence grants that allowed her to deepen her involvement. She later described her time there as “the best education that I’ve ever gotten.”

Overall, Carmen Lomas Garza stands out as a visual historian of Mexican-American life, using visual stories to preserve cultural memory, foster pride, and expand representation in American art.

Regardless of the medium and the subject matter, Garza remains keenly aware that her art is a dialogue. Chon Noriega observes that, “Like all dialogues, it is a two-way process. Through her art, she conveys to the viewer a message about the past and the present.”

Spain Honors Congressman Joaquin Castro with Prestigious Order of Isabel la Católica

By La Prensa Texas Staff WASHINGTON, D.C. — Congressman Joaquin Castro was honored Monday evening by the Government of Spain with the Order of Isabel la Católica — Commander by Number, one of Spain’s highest civilian distinctions recognizing individuals who strengthen international relations, diplomacy, and service connected to Spain and the Spanishspeaking world. The ceremony took place at the residence of the Ambassador of Spain in Washington, D.C., where Ambassador Ángeles Moreno Bau formally bestowed the honor upon Castro before an audience of diplomats, elected officials, civic leaders, and invited guests.

The recognition places Congressman Castro among a distinguished group of international leaders, scholars, diplomats, and public servants who have contributed to advancing cooperation and friendship with Spain. Established in 1815 by King Ferdinand VII, the Order of Isabel la Católica is awarded for extraordinary civil merit and efforts that strengthen Spain’s international relationships. The rank of Commander by Number is especially significant and reflects a high level of distinction within the order. In honoring Castro, Spain acknowledged not only his leadership in Congress, but also his longstanding commitment to public service, international engagement, democratic values, and the strengthening of ties between the United States, Spain, and the broader Hispanic world. For San Antonio, the recognition carries particular

meaning. Castro, a native son of the city, has long represented a community whose identity is deeply shaped by centuries of Spanish, Mexican, and Indigenous history. The honor also reflects the growing influence of Latino leadership in shaping international dialogue and cultural diplomacy. San Antonio itself maintains deep historic and cultural connections to Spain, making the recognition especially resonant for the city’s Mexican American community. The ceremony also served as a reminder of the enduring cultural bridges that continue to connect Spain and the United States through language, history, education, commerce, and shared democratic values. As one of the nation’s most visible Latino leaders on foreign policy and international affairs, Castro’s recognition highlights the increasingly important role that Hispanic leaders from communities like San Antonio are playing on the global stage. In recent years, Congressman Castro has been active on issues involving international relations, intelligence and foreign affairs, cultural diplomacy, and strengthening engagement across the Americas and Europe. Spain’s decision to bestow this prestigious honor underscores the international respect he has earned through his public service and advocacy. The event drew members of the diplomatic corps and leaders from across the Hispanic community, reflecting both the significance of the award and the strong relationship between Spain and the United States.

Comisión de Calidad Ambiental de Texas

AVISO DE RECIBIMIENTO DE LA SOLICITUD E INTENCIÓN DE OBTENER RENOVACIÓN DEL PERMISO DE AIRE (NORI) NÚMERO DE PERMISO 143519

SOLICITUD. EM Materials, LLC, ha solicitado a la Comisión de Calidad Ambiental de Texas (TCEQ, por su siglas en inglés) la renovación del permiso de calidad del aire número 143519, que autorizaría la continuación del funcionamiento de terminal de distribución de ceniza volante situado en 415 Transport Drive, Baytown, Chambers Condado, Texas 77523. Este enlace a un mapa electrónico de la ubicación general del sitio o de la instalación se ofrece como cortesía pública y no forma parte de la solicitud o del anuncio. Para conocer la ubicación exacta, consulte la solicitud. https://www.tceq.texas.gov/permitting/air/newsourcereview/airpermits-pendingpermit-apps. La instalación existente está autorizada a emitir los siguientes contaminantes atmosféricos: material particulado (PM), PM menor a 10 micrones de diámetro and PM menor a 2.5 micrones de diámetro.

Esta solicitud se presentó a la TCEQ el 1 de mayo de 2026. La solicitud estará disponible para su visualización y copia en la oficina central de la TCEQ, la Houston oficina regional, y la Sam and Carmena Goss Memorial Branch Library, 1 John Hall Road, Mont Belvieu, Chambers Condado, Texas a partir del primer día de la publicación de este aviso. La TCEQ puede actuar sobre esta solicitud sin buscar más comentarios del público o dar la oportunidad de una audiencia de caso impugnado si se cumplen ciertos criterios.

COMENTARIOS DEL PÚBLICO. Puede presentar comentarios públicos a la Oficina del Secretario Oficial en la dirección indicada a continuación. La TCEQ considerará todos los comentarios del público al elaborar una decisión final sobre la solicitud y el director ejecutivo preparará una respuesta a esos comentarios. Cuestiones como el valor de la propiedad, el ruido, la seguridad del tráfico y la zonificación están fuera de la jurisdicción de la TCEQ para ser tratadas en el proceso de permiso.

OPORTUNIDAD DE UNA AUDIENCIA DE CASO IMPUGNADO. Puede solicitar una audiencia de caso impugnado si usted es una persona que puede verse afectada por las emisiones de contaminantes atmosféricos de la instalación tiene derecho a solicitar una audiencia. Si solicita una audiencia de caso impugnado, deberá presentar lo siguiente (1) su nombre (o, en el caso de un grupo o asociación, un representante oficial), dirección postal y número de teléfono durante el día; (2) el nombre del solicitante y el número de permiso; (3) la declaración “[Yo/nosotros] solicito/solicitamos una audiencia de caso impugnado”; (4) una descripción específica de cómo se vería/n afectado/s por la solicitud y las emisiones atmosféricas de la instalación de una manera no común al público en general; (5) la ubicación y la distancia de su propiedad en relación con la instalación; (6) una descripción del uso que usted hace de la propiedad que puede verse afectada por la instalación; y (7) una lista de todas las cuestiones de hecho controvertidas que presente durante el periodo de comentarios. Si la solicitud la realiza un grupo o asociación, deberá identificarse con nombre y dirección física a uno o varios miembros que estén legitimados para solicitar una audiencia.

También puede presentar sus propuestas de ajustes a la solicitud/permiso que satisfagan sus preocupaciones.

El plazo para presentar una solicitud de audiencia de caso impugnado es de 15 días a partir de la publicación del anuncio en el periódico. Si la solicitud se presenta a tiempo, el plazo para solicitar una audiencia de caso impugnado se ampliará a 30 días después del envío de la respuesta a los comentarios.

Si se presenta a tiempo cualquier solicitud de audiencia de caso impugnado, el Director Ejecutivo remitirá la solicitud y cualquier solicitud de audiencia de caso impugnado a los Comisionados para su consideración en una reunión programada de la Comisión. A menos que la solicitud se remita directamente a una audiencia de caso impugnado, el director ejecutivo enviará por correo la respuesta a los comentarios junto con la notificación de la reunión de la Comisión a todas las personas que hayan presentado comentarios o estén en la lista de correo de esta solicitud. La Comisión sólo podrá conceder una solicitud de audiencia de caso impugnado sobre cuestiones que el solicitante haya presentado en sus comentarios a tiempo y que no hayan sido retirados posteriormente. Si se concede una audiencia, el objeto de la misma se limitará a las cuestiones de hecho controvertidas o a las cuestiones mixtas de hecho y de derecho relativas a los problemas de calidad del aire pertinentes y materiales presentados durante el periodo de comentarios. Cuestiones como el valor de la propiedad, el ruido, la seguridad del tráfico y la zonificación quedan fuera de la jurisdicción de la Comisión para ser tratadas en este procedimiento.
