Man confesses to Bluebell Park attack

By KEVIN GRASHA

kgrasha@lsj.com

Freddie Goss told a judge Dec. 1 that he was drunk when he jumped a fence into a 57-year-old man’s backyard, knocked the man down with a punch to the jaw and then kicked him. It was “done out of just stupidity,” Goss, 42, told Ingham County Circuit Judge Rosemarie Aquilina, as he pleaded guilty to a felony assault charge. “And anger?” Aquilina asked. Goss replied: “And anger — yes.” The May 22 attack, near a basketball court at Lansing’s Bluebell Park, sent Larry Ruble to the hospital with cuts, bruises and his jaw out of alignment. Ruble testified earlier this year at a preliminary hearing that he had asked Goss to stop yelling obscenities. Community outrage over the incident led the city to tear down the basketball hoops. Goss faces up to 10 years in prison. A sentence hearing is set for Dec. 22. Goss, who was on parole at the time of the incident, admitted he was intoxicated. He said he drank a case of beer with a friend. It was the first time since the 1980s he’d consumed alcohol, he told Aquilina. Goss’ co-defendant, 35-year-old Kimberly Hood of Lansing, tried to plead guilty to a misdemeanor assault charge, but Aquilina refused to accept the plea. Hood’s descriptions of

what happened, Aquilina said, did not rise to the level of an assault. “It seems to me she’s pleading guilty to get this matter over with,” Aquilina said. “I don’t let anybody do (that) in my court.” Hood said she was walking her dog that day, saw the men fighting and broke it up. Under questioning from her attorney, Patrick Crowley, Hood said she approached Ruble aggressively and made him think she intended to hurt him. After further questioning by Aquilina, Hood said she wanted to scare Ruble so he’d stop fighting. “That’s not assault, ma’am,” Aquilina said. Under Michigan law, someone can be charged with assault if that person commits an act that causes someone to “reasonably fear an immediate battery.” A trial was set to start Dec. 3. Hood, who is charged with assault with intent to do great bodily harm, faces up to 10 years in prison. If Hood’s plea had been accepted, she likely would not have faced jail time. Hood spent about one-and-ahalf months in jail after being charged and has been on electronic monitoring for about four months.

EAST LANSING, MI | Some things in life have easy solutions. Hungry? Eat. Tired? Sleep. Bored? Gosh, who could be bored?! Lose something? …Now that can be tougher. Any kind of loss can cause frustration, or regret, or pain. But some types of loss impact our lives profoundly--like the loss of a loved one, the loss of your health, or the loss of one of your senses-your hearing, for instance. With the holiday season approaching, why not do something about that loss? Consider it a holiday gift to yourself. Imagine hearing your children, grandchildren, or great grandchildren without constantly asking them to repeat something. Think about hearing the sounds of the holidays again—the oven timer when the cookies or turkey are done, the carolers at the door, TV specials, and don’t forget the wonderful sounds of holiday music! 2<9 :57G =F& <95E=A; ?BFF 75A 69 8=:,7H?G to face. Audit credits rate hikes for most of revenue rebound By DEREK MELOT dmelot@lsj.com

What a difference a year makes. Entering winter 2009, the Lansing Board of Water & Light faced a $13 million shortfall, new demands from the state on energy efficiency, rising costs and a sputtering local economy that affected demand for its key commodity — electricity. Twelve months later, BWL’s financial situation has changed dramatically. In an independent audit of its fiscal year July 1, 2009, to June 30, 2010, the utility saw a remarkable bounce-back in revenue. It generated $273.9 million, a nearly 5 percent increase from the year before and a near record for the utility. The audit, performed by the firm Plante & Moran, notes that

most of the revenue came from electricity sales and that the “electric revenue increase was primarily due to rate increases, including the implementation of the renewable energy and energy optimization surcharges.” The rate increases in question were adopted for electric and water services last January and went into effect March 1. At the time of their adoption, BWL officials said they would generate a combined $12.3 million annually. “Revenues were higher in FY 2010 as compared to FY 2009. The increased revenues can be attributed to several things,” said BWL spokesman Mark Nixon. “There were significant additions to revenue for state-mandated programs… During fiscal year 2010, the BWL recorded $1.8 million of revenue associated with the renewable energy program and $2.0 million of revenue for our energy optimization program.” Nixon added, “The BWL does not expect to collect more, on an annualized basis, than the $12 million referred to, as a result of the rate increase implemented March 1, 2010.

furlough days for all employees. Operating expenses for the year ended June 30 were $260.3 million, essentially flat to the year before. And for the current budget year, BWL commissioners approved a spending plan of $261 million. The changes helped BWL absorb a $2.1 million required contribution to its defined benefit pension plan. BWL also had to increase its contribution to its retiree medical benefit plan by $3.5 million between its 2009 and 2010 budget years.

by nearly 50 percent between 2008 and 2010, the audit shows. Jim Weeks, executive director of the Michigan Municipal Electric Association, said that utility sales are rising, but tough decisions will remain on the table for some time to come: “Even with an increase in sales, utilities will need to continue to implement cost-cutting measures and request small but steady rate increases. The Environmental Protection Agency and the Federal Energy Regulatory Commission are, and will continue promulgating new rules and regulations. … The cost of compliance for these new regulations is the No. 1 driver of increased utility costs.”

“However, there is always the possibility that expected revenue generation of rate increases can be impacted by the weather. Increased sales volumes due to weather would increase the value of a rate increase, while decreased volumes would decrease the value of a rate increase.’’ “Especially in these hard eco- Retiree health costs nomic times, when oversight is BWL contributed more than $21 crucial, the governing body of BWL million to retiree health costs in needs to be cognizant of the wag- fiscal 2010 alone.
