TERMS OF BUSINESS
Once the client has approved our design estimate and requested that the design process commence, it will be considered that the client agrees to abide by the following terms and conditions.
TERMS
1. Quoted prices for any design task are subject to sighting of the material provided by the client.
2. Lankshear Design is not liable for any delays caused by equipment breakdown, or the failure of the client to comply with negotiated schedules.
3. Ownership of Design Solutions: The Client automatically has rights to use the design solution chosen (as described on the invoice)— but only after full payment is made. Lankshear Design will retain all rights to all design solutions rejected by the Client.
4. Only artwork that is final, with a file name ending in ‘ART.pdf’ is to be sent to print. Draft designs do not include ‘ART’ in the file name and are NOT set up for print.
CLIENT RESPONSIBILITIES
1. Expenses: Client shall reimburse Lankshear Design for all expenses arising from any assignment (i.e. stock image purchases, couriers, etc.).
2. Unusual Time Demands:
Lankshear Design shall not be expected to produce work for regular rates at irregular hours, weekends, or holidays. Rush job/ overtime rates will apply to design work and other services which are produced outside normal working hours when requested/required by the Client.
3. Authors corrections: Author changes will be charged.
4. Proof reading: The client accepts full responsibility for the final proof reading and checking of all copy, artwork, and design. Although every effort is made to avoid any such occurrences, Lankshear Design can accept no responsibility for errors or omissions undetected by the client.
5. Payment: COD for first project, then 14-day account. Invoicing will be on a monthly basis for extended projects.
6. Cancellation: In the event of cancellation of an assignment, ownership of all copyrights and the original artwork (and any electronic copies of artwork) are retained by Lankshear Design and a fee for work completed and expenses already incurred, shall be paid by the Client. The Client waves any rights to the use of design concepts produced up to the point of cancellation.
LD RESPONSIBILITIES
1. Lankshear Design will provide the client with a variety of concepts or design solutions for the consideration of the client. Generating a number of concepts is normally part of the design process, and so this time is charged to the client whether or not the client continues the job to completion.
2. No additional work is undertaken or costs incurred without prior client approval. Jobs costs will vary only when the client brief changes or additional work is required.
