Special Master’s decision on water war may come this winter By Jane Harrison Water law experts expect Special Master Paul J. Kelly, Jr., will be quick to render his opinions in a six-year Florida/Georgia dispute over water in the ApalachicolaChattahoochee-Flint river basin. The Supreme Court appointee, known for timely case management, might possibly have recommendations out in early winter after questioning attorneys during oral arguments Nov. 7. At stake is potential courtmandated allocation of water in the river system where Lake Lanier is the largest reservoir. The special master’s recommendations are likely to influence a Supreme Court decision that could enforce water policy and affect long term relationships between the states for generations. Kelly granted Florida’s request for a face-to-face hearing in July and originally set the date for Dec. 16, then without explanation moved it to Oct. 17, before changing it to this month after Florida noted a date conflict. Oral argument was set to commence at 10 a.m. Nov. 7, at the U.S. District Courthouse for the District of New Mexico, in Albuquerque. Kelly allotted 45 minutes for each party, with Florida granted

extra time for rebuttal. Kevin Jeselnik, chief legal counsel for Chattahoochee Riverkeeper, expected Kelly would drill lawyers after their presentations to get specific information he needs. “Typically there’s a lot of Q&A in appellate level oral arguments,” he said, speculating that Kelly would run the hearing like those often heard in the U.S. 10th Circuit Court of Appeals, where Kelly is a senior judge. “Each side will answer directly to the story they want to tell,” Jeselnik said. Georgia’s storyline asserts it is not to blame for Florida’s water woes and that there is enough water in the basin to reasonably serve its needs. The Peach State also argues that water use restrictions could choke economic development. Florida contends Georgia has been irresponsibly consuming water for years, causing economic and ecological harm downstream in Apalachicola Bay. Jeselnik also guessed that Kelly may have already formulated an opinion and allowed the hearing so he could “dial it in.” Each side will aim “to create shreds of doubt in any previously formulated opinion,” said Chris Manganiello, CRK Water Policy

He speculated the brief court session would not “change hearts and minds in the last minute … There’s not going to be a Perry Mason moment with a 180-degree change in the path of the overall case,” he said. New Mexico attorney John B. Draper, who has extensive experience arguing water cases in front of special masters, said that by granting the hearing Kelly “obviously decided having access to the attorneys would be helpful.” He expected Kelly would direct a lot of questions to each side to ensure he’s understanding their positions correctly. Draper’s familiarity with special masters includes his current connection with Kelly in the Santa Fe legal community and his past acquaintance with the initial special master in the case, the late Ralph I. Lancaster. Draper’s office is practically across the street from Kelly’s. He also knew the former special master, whom he described as a very experienced special master and a “really great guy, smart and very able.” Draper said special masters carry a huge responsibility for future relationships between the contending states and thus desire a thorough understanding of both

sides. Kelly deliberated months before deciding to grant Florida’s March request for oral arguments. “Even for an experienced judge like Kelly, there’s a lot of (evidence) to go through, even to determine that he needs oral arguments,” Draper said. He speculated that after getting the answers he needs, Kelly will complete his recommendations “in a matter of months.” Jeselnik and Manganiello also think Kelly’s opinion will come in early winter or spring. Then it would be up to Supreme Court justices to put it on their calendar for another hearing. The legal matter centers on Florida’s claim that Georgia consumes more than its share of water from the Chattahoochee and Flint rivers, causing depleted flow on the Apalachicola and devastation to the downstream ecosystem on the Panhandle, where a fishing-dependent economy needs fresh water to nourish oyster beds. West Bank Park repairs under way

Repairs have begun at West Bank Park and the popular Lake Lanier destination should reopen in March, according to the U.S. Army Corps of Engineers. The park was temporarily closed in February 2019 due to safety hazards after flooding. “Conditions at the park are now favorable for repairs,” said Tim Rainey, operations project manager for Lake Lanier Project Office. “While you may see the barricades moved and the gate open, please do not enter the park. This is only for the entering and exiting of work crews.” Visitors of Lake Lanier should not park outside of the gate as this could interfere with maintenance operations. Unauthorized vehicles parked in this area are subject to being towed. Repairs will be ongoing throughout the fall and winter seasons and include: • Installation of concrete walls to replace worn-out and hazardous wooden retaining walls • Restoration of picnic site areas from erosion • Removal of dead, hazardous trees • Installation of shoreline stabilization, and • Repairing of pump and controls for septic systems, sink holes, and handicap access. “We appreciate the public’s patience and anticipate West Bank Park will fully reopen no later than March 29, 2020,”

A sampling of fishing information and tips from area experts

Bass fishing Bass fishing is very good. The cool down has really helped the fishing. Rocky areas at the mouths of creeks as well as main river points are holding fish, and at daylight these fish are up and chasing bait. Moving baits is the ticket on bass. We are also catching spots on points and humps in 15 to 25 feet of water, more toward the mouths of the creeks. The top water and swimbait bite has been strong recently. Note that with cloud cover, the fish will tend to be shallower and roaming more. With the sun up, the fish seem to concentrate more around the brush on structure as the day goes on. We are seeing some good schooling activity from daylight until around 10 in the mornings. During cold fronts like we had recently, make sure to change your approach to match the mood of the fish. Typically the fish are not as aggressive post front.

Striper fishing Stripers have been biting well, although a little more scattered as we are seeing fish on top, in deeper water in pockets and drains, and of course plenty of fish on top are chasing bait. On top of that, fish are showing up in the middle parts of the lake as well so your search area will be bigger than it has been in recent weeks. With that being said, we have several good techniques that should get you hooked up! The topwater bite is very good, with two components to this pattern. The first, is chasing down the schoolers. They are showing up fairly consistently, and may be anywhere, but look for the greatest activity in the major creek arms or over the river channel. They are showing in big groups, pretty easy to see, but up and down quickly. I think the best bait to cast at the schoolers is a buck tail or lead head tipped with a Fluke. Why? It

casts well, even in the wind, it is easy to get the fish off the hook and the bait back in the water. Other baits that are effective are topwaters, swim baits Steelshads, and small spoons. You have to be pretty aggressive when you see these fish, they will occasionally stay up for extended periods, which should become more frequent as the water cools, but many are only on top for a short period of time. When you see them, assuming there are no other boats on them, run right up to the fish, within a cast, and get a bait to ‘em. If you get to them before the sound you should get the bite. The second pattern is blind casting to humps and points. There are plenty of fish on this pattern so it is not necessary to see fish to catch them on the top waters. Target main lake humps and points 15 to 30 feet, if brush is present it is a plus. Many of your favorite baits will be effective, Zara Spooks, Chug Bugs, Surge Shad, etc. Go bigger and nosier in the wind, a little more subtle if it slacks off. Live bait is producing some

nice catches, on down lines, free lines and planers. I think the down line is still probably the biggest producer, but don’t rule out the free lines/planers, especially weighting the bait down with a split or small weight. You may have success in a variety of places, drains, pockets or in the backs of the major creeks. That creek back pattern seems to be especially strong in the morning hours. If you only see a few fish drop the baits, they will come to that activity if there are numbers of fish in the area. Trolling is still a very strong technique, with pulling Mini Mack’s on mono or lead core, depending on the depth you are targeting, or pulling the full size rigs over the humps. With plenty of fish on the shallower humps and points, contour trolling the Mini on mono(17 to 25 pound test) 150 feet behind the boat has been a very good pattern, especially for numbers. If you are targeting deeper fish, put the Mini on the lead core or the down rigger to get the needed depth. On the deeper humps, 20 to 35 feet, use the full

size Capt Mack’s’ 9 bait buck tail rig 120 to 140 feet behind the boat to get the bite. Typical, on those deeper humps, that bite will not be effectively until later in the morning and improves as the day goes on. By Pamela A. Keene It’s back and they say it is bigger than ever. License to Chill Snow Island returns to Margaritaville at Lanier Islands on November 22, bringing with it snow, winter fun and Santa. From a longer, faster, higher Parrot Mountain snow slide to holiday traditions including Magical Nights of Lights, Margaritaville becomes a winter wonderland this month. “Parrot Mountain snow slide has been extended up by almost one-third,” said Bucky Perry, vice president of operations at Margaritaville. “It’s now 575 feet long and stands eight stories tall, giving riders an even more adventurous and invigorating ride than ever before. That’s almost two lengths of a football field.” Guests travel to the top of Parrot Mountain via a conveyor-belt people mover to maximize their time on the ride. The ride finishes above the wave pool, which for winter has been converted to a snow-filled winter playland. “Kids of all ages can enjoy making snowmen and playing in the snow,” Perry said. “Plus all the traditional holiday activities

Registration open for Holiday Boat Parade of Lights November 2019

Keene With a goal of making this year’s Holiday Boat Parade of Lights on December 14 the biggest yet, organizer Richard Pickering challenges participants to step up their game. “We’re changing things up a bit and asking our captains to solicit sponsorships for their boats, based on the number of lights they’ll be displaying on December 14, parade day,” Pickering said. “The parade will benefit two great organizations and we want everyone to come out and support the parade this year, so the biggest thing is to line up sponsors for your boat.” The event’s nominating committee has chosen the Georgia Sheriff’s Youth Home and the Hall County Marine Dive and Rescue Team as recipients of the parade funds. “Our goal is to raise $20,000 through entry fees and sponsors.” On the parade’s Facebook page, he gives an example of how the sponsorships can work: “For instance, you might ask sponsors to pledge 10-cents apiece for each bulb on your boat to support these two charities. So if you have 2000

bulbs on your boat, that would be a $200 pledge from each sponsor that you get, which would be $100 for each organization. “Then invite those sponsors to come down to Margaritaville to watch the boats come into the marina and join in on the fun. There will be great food and music to enjoy. And of course Santa will be there, plus we’ll have a raffle with all kinds of lake-related products and services and gift certificates to restaurants.” Boats will be staged by marina, according to a schedule

posted on Facebook, and will gather in the middle of the lake before parading into Margaritaville. Awards will given for the marina with the most boats, the marina with the most money raised and the Best-Decorated Boats by Class, for decoration, spirit and theme. The parade is open to all boats, from sailboats and cruisers to houseboats and pontoons. “We hope people will really get into the spirit this year and start decorating their boats early,” he said. “We also have planned to have December 15 as the inclement weather date, so if the weather is bad on Saturday, you still have Sunday to show off your boat and holiday spirit.” Two charity recipients The Georgia Sheriff’s Youth Homes and the Hall County Sheriff’s Marine Rescue and Dive Team will receive the benefits of this year’s parade. Here’s my best forecast for winter

I always keep my eye on the Gulf of Mexico in October. Last month I was actually hoping for a tropical system to develop and move our way. I was not hoping for a strong one, just one that would give us the potential of a good soaking rain. Tropical Storm Nestor filled the bill quite nicely, giving much of north Georgia 2-3 inches of rain. With a 6-inch rainfall deficit for the year, we made a pretty good dent in our ongong drought. We still have a way to go, but I think during November we should see a pretty good uptick in rainfall with each passing cold front. November is that transition month going from fall into winter. It can be beautiful with cobalt blue skies and mild temperatures. It can also be a time for strong and severe storms. November it a very volatile month in North Georgia. High temperatures average in the 60s with low temperatures in the 40s. I have also seen some signals in the atmosphere that would suggest above average rainfall! Winter, as we all know begins next month. The Winter Solstice is Saturday, December 21st. I have, as usual, been getting many emails from viewers wanting to know what I expect this winter to be like. As we remember, last year was abnormally warm without a flake of snow. I have been looking at the science and have also been looking in my own backyard, to see how

However, Lanier in looking at the sciOutlook ence, there’s a contradiction. El Nino ended months ago. We no longer have El Nino nor do we have a La Nina. We have what are called Neutral Conditions. The Climate Prediction Center says there is an 85 percent chance we will stay neutral as we move into winter. Without an El Nino and without La Nina, what kind of winter will we likely have during neutral conditions? I am glad you asked! I went through our climatology over the past 30 years. During the times when we have had no El Nino or La Nina, the coldest winter air has stayed well to our north with brief surges from time to time. I did not see any extremely cold weather for north Georgia that lasted more than a couple of days. What about snow? Last year we did not see any. I am not sure we will this year. I cannot say for sure but over the past 30 years during neutral conditions, it has been too warm for snow and it has been rain. Lots and lots of rain, as the southern branch of the jet stream unloads tons of moisture from the Pacific and the Gulf of Mexico. I did a lot of research on this and this is the best prediction I have for the upcom-

Keene On Saturday, November 9, downtown Sugar Hill will be the site of the “Veterans’ Day 5K,” a walk/run to benefit two veterans groups. “We looked around and saw that there wasn’t an event on Veterans’ Day to honor veterans, so two years ago we started this walk/run,” said Sawyer Regnier, organizer of the event. “It started out small, but it’s growing every

year. Our goal is to have at least 120 participants this year.” The event will raise money for The American Legion Post 127 in Buford, and Pets for Vets. “Both groups serve veterans in different ways, and both are invaluable,” said Regnier, a Marine who served two tours in Iraq. “And this is just one way that we can support them and the important work they do.” The $25 entry fee includes an

Her assignment: learn about these rangers’ duties, how they balance their work to serve the public while protecting the shorelines of Lake Lanier; and tell the story of these rangers’ daily jobs. Millwood served in the Air Force and as a federal employee working at the Federal Law Enforcement Academy before joining the Corps. “Since the dock fee increase was announced, that’s been the biggest source of calls and emails,” Millwood said. “Aside from shifting the fees from our line-item budget, the amount basically costs about as much as five years’ worth of Netflix service. I had a caller on the line a couple of weeks ago, and once I compared the two – five years to five years – he got it.” Millwood triages emails and phone calls, assigning them to the proper shoreline ranger. He also initiates any paperwork associated with dock renewals and property modifications. The lake is currently divided into four areas; two more shoreline rangers were recently added, and the lake is being separated into six. “This will help us be more responsive to homeowners because we’ll each be covering a smaller area,” he said. “Right now, each of our four shoreline rangers is responsible for managing about 2,500 dock permits. This might include renewals, request for dock modifications such as larger docks or major repairs, plus changes to the Corps-managed shoreline adjacent to their property, such as installing steps or walkways.” Timber trespass a major issue Martin said that timber trespass – people cutting down trees, clearing underbrush or limbing trees on public lands – is where most of the shoreline rangers spend their time. Although the boundaries of the Corps-managed lands are clearly marked, it seems some homeowners sometimes think that they are allowed to do certain things on those adjacent lands. To non-schooled observers, Corps’ boundaries may look to be random, but they are not. The goal was to purchase land at 1085 feet above mean sea level, so in the late 1940s and early 1950s, aerial surveys were used to identify tracts of land to purchase. When the actual purchases took place, some of the tracts were below 1085 and others were partially above 1085. The laws about timber trespass and property modifications are clear. First and foremost, anyone

considering any modification on Corps-managed property must contact the Corps and have a site visit. When dock permits are renewed or a change of ownership is executed, the permittees sign agreements that they acknowledge the rules, regulations and policies of the Corps. Here’s an example: Martin went out to meet with a homeowner who wants to build a larger dock. As they walked together toward the lake, the homeowner pointed out some earlier modifications from a previous visit. The person’s deck encroached partially across the boundary and had been adjusted property. They also talked about a couple of trees – one that had fallen on Corps-managed land and another that was leaning toward the house. The fallen tree needed to be laid down flat; the homeowner agreed. As for the leaning tree, Martin made notes to issue a permit for it to be removed by the homeowner. “If you’re in doubt, contact us,” Martin said. “We’ll come out and meet with the homeowner and, if needed, may issue a permit.” Here’s what happens when a property owner proceeds on his own, removing trees on Corpsmanaged land. “This may result in fines, restitution and possible legal action,” Martin said. “We go out to the site, evaluate the damages, calculate the restitution, and determine what is required to restore the area. owner has two years to complete the restoration.” Restoration involves replacing trees that were removed. The trees must be at least two inches in diameter and must be native species. “Planting the replacement trees may reduce the restitution,” Martin said. “Removing trees jeopardizes the health and future of the lake and we take timber trespasses very seriously.” Technology replaces long-form paperwork As one of the largest Corps projects in the nation, Lanier often leads the way for changes that have saved taxpayer dollars, improved processes and addressed safety issues. As with the elimination of cash at Corps’ parks, a pilot program developed by Park Operations, and the establishment of the Volunteer Village by the late Corps Project Operations Manager Erwin Topper, shoreline operations staff at Lanier piloted digitizing their work flow. “In September 2017, our shoreline management program

By Jane Harrison The mention of “let’s go hiking” often conjures up thoughts of stuffing a day pack and loading into the car for an hour’s drive to the mountains. However, dirt trails practically just outside the door in the counties surrounding Lake Lanier offer nearby options for trekking through the woods and experiencing the great outdoors. Trails at county and city parks, a national recreation area, private non-profit science center, plus footpaths maintained by the state and Corps of Engineers on the north and south ends of the lake beckon nature lovers to get out there without having to go far. On National Take a Hike Day, Nov. 17, the American Hiking Society urges folks to hit a trail and feel the benefits of hiking. The recently released master plan for Hall County Parks cites national studies that found contact with nature improves physical and emotional health by providing exercise and decreasing stress. The park department’s survey of park users found that 62 percent visit for foot travel. To accommodate a growing interest in trails, the county will consider building more natural surface trails by

Known as Six-pack Sally because of her reputed purchase price of a six-pack of beer, a sunken 40-foot steelhulled houseboat was removed from Lake Lanier in mid-October. “Whether the story about her purchase price is true, we understand that she was dragged across the lake and began to sank,� said Jennifer Flowers, executive director of the Lake Lanier Association, which is removing the vessel through its Abandoned Boats and Derelict Docks program. “This will be the first boat we’ve removed since receiving the current year’s appropriation from the Georgia General Assembly on July 1, but we’re certain it won’t be the last.� The association turned the removal into a media event to draw attention to the issue. Port Royale through its Paradise Boat Rentals provided its 40-foot Island Voyager pontoon boat to shuttle the news media to the location in Orr Creek/Chattahoochee Bay near lake marker 4 OC. “Our program has been successful through the statewide attention that it has received,�

Proactive planning and a few quick fixes around the home can prevent damage and save you a lot of money. Follow these simple steps to make sure your home stays warm and your wallet stays safe from unforeseen costs. Step One: Prevent water damage. As water freezes it expands, and this scientific fact can be the cause of catastrophic damage to your home if proper steps are not taken to prevent it. Pipes can burst when water freezes inside them, or if pressure builds behind a chunk of ice. If you sense any issues with your system contact your security provider and have them inspect the system. Step Six: Find and fix any potential exterior hazards. As leaves start to fall and the weather gets cold and wet, broken driveways and walkways can become a hazard. Leaves and water can gather in cracks and crevices and create hidden slip or trip hazards. Inspect the walkways around your house, as well as your driveway. Repair or replace any cracks or broken pavers you see. If the damage is beyond repair, consider replacing the driveway or walkway. There are many things you can do to prep for colder weather this fall. All these steps are generally quick fixes and will give you peace of mind to enjoy time with family and friends this winter, rather than worry about your home. Lake Lanier boat ramps in Forsyth County. Forsyth County Parks & Recreation recently installed the automated payment machines at Charleston Park (5850 Charleston Park Rd.), Six Mile Creek Park (6020 Browns Bridge Rd.), and Young Deer Creek Park (7300 Heard Rd.). Daily users will now pay by credit/debit card and are offered the option to purchase an annual pass onsite through the machines. Park fees will remain the same: $5 per boat launch; and $40 per annual pass (50 percent senior discount for ages 55-plus). A partnership between the state Department of Driver Services (DDS) and the Department of Natural Resources (DNR) is making it easier for boaters to show they have the required boater education. A boating indicator – a small anchor – may be added to the front of a driver’s license or ID card to eliminate the need to have a boating safety education card with them when boating. While all Georgia boaters do not need to complete training, many are required to complete a state-approved education program before operating a boat – including anyone born on and after January 1, 1998. The advantage to this program is that you will no longer need to carry your boating safety education card with you when boating, provided you have your driver’s license/ID with you. “Once the boater education completion indicator is placed on your DDS record, it will automatically be printed on your license or ID each time it is re-

newed. We are excited to partner with DNR on this customer-focused initiative,� said DDS Commissioner Spencer R. Moore. “As time moves forward, more and more Georgians will be required to complete a boater education course if they want to operate a boat on state waters,� said Georgia DNR Commissioner Mark Williams. “To be able to show that you have completed boater ed on your driver’s license will eliminate the need to carry a separate card, which is much more convenient.� Those without the boater education completion indicator printed on their driver’s license or ID card must continue to carry their proof of completion of the boater education course (if required in Georgia), along with proof of identity. Boat operators can enroll in a certified boater education course either online or through a classroombased program to receive the necessary certification.

Little Ocmulgee State Park is a hidden gem in Middle Georgia

Just 30 miles south of I-16 near Dublin, Ga. is a natural oasis in the middle of farm country that can be enjoyed by everyone. Little Ocmulgee State Park is a secluded 1,360-acre Georgia State Park located two miles north of McRae-Helena on the Little Ocmulgee River. The park’s origins date back to the 1930s, when it was first constructed by the Civilian Conservation Corps (CCC), which created the lake around a natural oxbow of the Little Ocmulgee River. This 256-acre lake has a white sandy beach, fishing docks, a visitor’s center, camping and RV sites, rental cabins and a boat ramp. The most unforgettable part of Little Ocmulgee State Park is the Wallace Adams Golf Course that is surrounded by loblolly pines, willows, magnolias and small lakes in a picturesque but secluded setting. Be sure to bring a camera to capture the beautiful scenes complete with Spanish moss and plenty of wildlife. Starting with the first hole, which is breathtaking, golfers quickly learn that accurate shots are paramount to making a good score on this course. Most of the front nine is designed for the best shotmakers. The back nine opens up ... but continues to present challenges with smaller, sloped greens and doglegs on the fairways. All 18 holes feature Bermuda fairways and greens. The full-service pro shop at Wallace Adams also offers all golf accessories and a snack bar. The entire staff is friendly and helpful at all times. One of the distinctive features of the park is the soil, which, like the Ocmulgee River and the Little Ocmulgee River, is a fine white sand.
