PREFACE2020 The 70th sale of Summer Grazing is upon us. We still have Natural England, DEFRA and RPA but now we are no longer in the European Union. However, neither the European Union nor BREXIT trade deals have not and will not, stop the grass from growing. So just like last year we still have grazing rights to dispose of.

As ever the farming and livestock industry will have to face weather, political and regulatory challenges but the one challenge that the landowners, farmers and graziers will still have to address is the Basic Payment Scheme (BPS) and its rules.

Additionally, we have to think about the new Countryside Stewardship Scheme (CSS) and the fact that some older schemes have or are approaching their end. Whatever happens with the new Environmental Land Management Scheme there will still be support for farmers and the countryside. Lambert & Foster, of course, are uniquely placed to advise and to assist farmers and landowners with the applications and claims regardless of whether or not you have a computer!

As a grazier you will not be able to claim under the BPS on any land you occupy as a licensee.

However, you are bound by ALL the Rules of Cross Compliance whether you like it or not. A grazier’s action can have a significant impact on a farmer’s or landowner’s annual BPS claim. The greatest cause of aggravation and penalties relate to animal movement, tagging, movement records and of course TB testing.

This sale of Summer Grazing Rights here in East Sussex is, we believe, the oldest known such sale. There are similar sales still held in the West Country and North of England but it is a tradition which is fast dying out. Regulation and red tape is usually cited as the reason for the demise of these sales. Nevertheless, it is our intention to keep tradition alive even if some authorities seem hell bent on doing otherwise.

Three houses achieved on farm using 56 day notice

n Bloomfields was contacted after another local planning consultant had failed to get prior notification for the conversion of two agricultural barns to houses. Bloomfields strategically attacked the reasons for refusal in a preliminary application for one dwelling on the site, thus establishing the principal of having a residential unit. Once approved, Bloomfields resubmitted a scheme for three homes, which the Council then considered acceptable. The success coming from Bloomfields’ involvement has given their client an increased site value and several planning options for the redevelopment of this farmyard.

KEY DATES IN 2020 What you should (and should not) do throughout the year to meet the cross compliance rules.

January 1 You must start following the rules in the cross compliance 2020 guide from this date. The Basic Payment Scheme (BPS) 2020 year starts.

1 You can apply organic manure with a high readily available nitrogen content (for example, slurry, poultry manures or liquid digested sewage sludge) to grassland and tillage land on shallow or sandy soils from this date if conditions are suitable and you adhere to the quantity restrictions for application of these manures. (SMR 1) 1 Beginning of the year for assessing the annual amount of livestock manure applied to your land. (SMR 1) 16 You can apply manufactured nitrogen fertilisers to grassland and tillage land from this date if conditions are suitable.

February 1 You can apply organic manure with a high readily available nitrogen content (for example, slurry, poultry manures or liquid digested sewage sludge) to grassland and tillage land on all soil types from this date if conditions are suitable and you adhere to the quantity restrictions for application of these manures. (SMR 1)

August 1 If you have been granted a derogation by RPA, you may be able to cut or trim hedges throughout August, to sow oilseed rape or temporary grassland. (GAEC 7a) 1 Start of closed period for applying organic manure with a high readily available nitrogen content (for example, slurry, poultry manures or liquid digested sewage sludge) to tillage land on shallow or sandy soils except where crops will be sown on or before 15 September. (SMR 1)

September 1 You can cut or trim hedges and trees from this date. (GAEC 7a and 7c) 1 Start of closed period for applying organic manure with a high readily available nitrogen content (for example, slurry, poultry manures or liquid digested sewage sludge) to grassland on shallow or sandy soils. (SMR 1) 1 Start of closed period for applying manufactured nitrogen fertilisers to tillage land. (SMR 1) 15 Start of closed period for applying manufactured nitrogen fertilisers to grassland. Fruit and nut trees in orchards, or trees acting as windbreaks in orchards, vineyards, hop yards or hop gardens are not included in the ban.(GAEC 7a and 7c)

1 You can burn heather, rough grass, bracken, gorse or vaccinium on land in upland areas from this date. (GAEC 6)

31 If you hold a water abstraction licence, expect to receive your annual bill (or first part charge if you hold a two-part tariff agreement) for the forthcoming financial year. (GAEC 2)

15 Start of closed period for applying organic manure with a high readily available nitrogen content (for example, slurry, poultry manures or liquid digested sewage sludge) to grassland on soils which are not shallow or sandy. (SMR 1)

April 1 You must not burn heather, rough grass, bracken, gorse or vaccinium on land, other than in upland areas, from this date. (GAEC 6) 1 If you hold a winter or all year round water abstraction licence (authorising abstraction outside the period April to October), the Environment Agency will make actual abstraction return forms available to you from 1 April. You then have 28 days to send your readings to the Environment Agency. (GAEC 2) 16 You must not burn heather, rough grass, bracken, gorse or vaccinium in upland areas from this date. (GAEC 6) 30 You must have recorded the number of ‘specified’ livestock kept on your farm during the previous calendar year and calculated the amount of nitrogen they produced. You must also record the number and type of livestock in a building or hardstanding during the previous storage period. (SMR1)
