Fitness Center News

On Feb. 11, our LOWA Fitness Center team held an open house for all Lake of the Woods members. We had 78 members come out and join us at the center where staff, instructors, trainers, and a nutritionist were on hand to meet and greet, give tours of the center, and do demonstrations. The Fitness Center Committee was also on hand to answer questions on what they do and how to become a volunteer.

Our Fitness Center Specialist Jeremy Jefferson gave a very informative demonstration on Kettlebells and showed the community how to use the different pieces of equipment and the different types of workouts they can be used for. We gave away 19 door prizes, ranging from tumbler cups to free fitness classes, yoga therapy sessions, 3-day passes, and a free trial membership.

Now is a great time to check out the Fitness Center. Come by for a tour, buy a daily member pass to see if you like it, or purchase a half-price membership good through April 30. For more information, please contact communityactivities@ lowa.org or call Member Services at 540972-2237.

If you were not able to come out on Feb.11, stay tuned, because community activities is looking to do another open house sometime in the fall. Treasurer’s Report by Walt Diercks, Treasurer, LOWA Board of Directors

It’s been three months since my last Treasurer’s Report. We are now only three months from the end of LOWA’s current fiscal year, which will end April 30. Inflation and staffing issues have continued to have adverse effects on LOWA’s finances and its ability to provide services to its members. This means continued challenges both for this fiscal year and for the next fiscal year beginning May 1. Inflation from April 2021 through January 2023, as measured by the Consumer Price Index, is up over 12 %, while the member assessment in this fiscal year’s budget (FY22/23) increased 6.2%. This means that our member assessment income is lagging almost 6% behind inflation with three months of the fiscal year remaining. This lag not only has made keeping on budget this fiscal year difficult, it means that next fiscal year’s budget reflects some of the cost increases which occurred during the present fiscal year. I will first address third quarter results and then provide some additional information on next fiscal year’s budget and assessment.

The bottom line of the third quarter results is that, despite inflation and staffing challenges, LOWA is still projected to finish at break even. Our amenities as a group (the Equestrian Center, the Pools, the Fitness Center, Communications, Community Activities, and Golf Operations) are performing close to budget expectations. However, the Clubhouse and Fareways continue to have significant negative variances from budget. This is consistent with national trends showing that restaurants are being challenged by rising costs, staffing issues and consumers reducing their discretionary spending. The restaurant negative variances have begun to narrow, and an aggressive plan is being implemented to improve the financial performance of both restaurants. It appears that staffing is beginning to return to past norms and an expansion of operating hours at both restaurants should occur as we move into longer daylight hours and spring.

New Construction & Renovation Fees collected through January 2023 this fiscal year amount to $353,116 and as of Jan. 31, 2023, the NC&R balance of uncommitted funds is $320,370. $300,000 of the NC&R fees collected this year have been allocated to provide support for next fiscal year’s budget, leaving a modest uncommitted balance going forward. As I cautioned in my last Treasurer’ Report, LOWA is approaching “build out” of the relatively few remaining undeveloped lots and we realistically cannot continue to expect in future years that NC&R Fees will provide the level of funds they have in the past. President’s Letter

The budget for the fiscal year 2023–2024 has finally been approved! The assessment has been set at $1,970 per lot, a $124 (6.7%) increase over this year’s assessment. The Finance Department will begin preparing assessment letters, which you will receive in the mail sometime in late March. Early boat registration will begin March 13. You can pay your 2023-2024 assessment, along with the annual fees for any amenities that you use, beginning April 1. All assessments are due by May 1. If you cannot pay your assessment in full by then, please contact the Finance Department and they will set you up with a financing plan that works for you. Again, my thanks to everyone who participated in this process, including all LOWA staff, all Directors, all committee volunteers, and all members who provided comments and suggestions. We can’t please everyone, but we did our best to consider everyone in our efforts to make decisions that we believe are best for our members and our community.

Many of you have probably heard of FiberLync by now. If not, FiberLync is Orange County’s fiber optic network. That means that FiberLync can be an alternative to your current internet provider. Initially, the Board signed an agreement to allow FiberLync to lay cable in portions of Sections 7, 9 and 10. To date, the Board has voted to allow FiberLync to lay cable in all of Sections 6 through 12. LOWA is currently working with FiberLync to finalize the details that will allow FiberLync to lay cable throughout the rest of Lake of the Woods. LOWA has assigned a special project inspector to work with FiberLync to ensure that any problems are resolved immediately. If you notice something wrong or have a concern, you can contact LOWA’s Maintenance Department at 540-9722211. You can also send a Maintenance Inquiry – the form can be found on the LOWA website (www.LOWA.org) under the “Contact Us” tab on the front page. I’m sure many people are curious about how well FiberLync works, so please read the article on page 11 where a member in Section 7 is interviewed about his experience switching to FiberLync. If you want to pre-register for FiberLync’s fiber optic internet service, with no commitment on your part to subscribe, you can do that on their website at www.fiberlync.net under “Check Availability.” FiberLync does not provide cable TV service but, if you want, they can help you to “cut the cord” and watch TV by streaming. Their website describes package options and walks you through how to select a streaming package that works best for your needs and watching preferences (under “Streaming TV”). You can also call FiberLync at 540-360-0585 if you have any questions and you can call 540-346-4188 if you need technical support.

I mentioned fences in my Jan. 27 letter. ECC representatives attended the Feb. 15 Board meeting and explained their various proposed amendments to Regulations V and XVI, including the proposal to expand the current dog pen to a dog run/play area. The discussion was long but very productive. The Board will consider whether to send all or portions of the proposed amendments to the Rules Committee and legal counsel at the March 8 Board meeting. To repeat what I’ve said before, I encourage all members who have an interest in the topic of fences, pro or con, to send an email to the Board at Board@LOWA.org, talk to a Board member or attend the March 8 Board meeting. It is also likely that we will open a member comment period to provide another means for members to voice their opinion on this sensitive subject.

Main Gate Project Moves Ahead

I hope you are enjoying this early spring weather. We took a big step forward on the Main Gate Project designed to help alleviate inbound traffic congestion, especially during evenings and weekends.

On Feb. 15, the LOWA Board of Directors approved the Alternative 2B Option of the A. Morton Thomas Main Gate/ Third Gate Traffic Study, to add an additional lane for visitors into the Main Gate. Alternative 2B provides congestion relief through at least 2028, according to the AMT Study.

The Board also authorized signing an agreement with AMT to develop detailed design and construction documents. The schedule is to bid the project in early 2024 and construct it during fall 2024 after the summer crush of traffic. We plan to keep the gate open for entry and exit during construction, although we will encourage member use of the Back Gate to avoid construction congestion. The Board based its decisions on input from a Working Group that spent weeks discussing the options put forward in the AMT Study, including a Main Gate roundabout, an additional lane (recommended), and a third gate entrance.

The GM and the Working Group hosted a Town Hall on Jan. 11 and solicited member comments between Jan. 12 and Feb. 8. We received comments from 34 members with 181 distinct ideas, of which 47 pertained to the Main Gate design. We passed on the main gate design comments to our AMT engineers. LOWA has not given up on the idea of constructing a third gate at the Shoosmith area in some future year to spread the traffic load. However, the third gate is a more expensive option, and requires VDOT involvement for the new connection to Route 3.

The new budget approved by the Board on Feb. 15 includes $100,000 for design services. Once AMT engineers advance the design to the 30% level this summer, we will be able to narrow the projected construction cost. For now, we have estimated a range of $600,000 to $800,000 (which includes a healthy contingency factor), to be funded through a loan from a bank or from a LOWA reserve account.

AllBox. On a related note, the deployment of the AllBox for guests arriving after hours has been delayed until at least March 15. We are awaiting delivery of the gate openers. I will keep you updated on the progress.

Treasurer's Report from p. 1

Committee on Future Financial Challenges and Funding Sources has been asked by the Board to identify and develop additional revenue sources.

On Feb. 15, the Board adopted the budget for the fiscal year beginning May 1. The budgeting process began in earnest last September and is the result of the hard work of the staff, members of a number of committees, and the Board. The budget is a realistic one which includes a number of significant fee increases. The annual assessment has been set at $1,970,which is an increase of $124 (6.7%) over last year. The assessment increase over the past two fiscal years is consistent with the rate of inflation and the budget for the fiscal year starting May 1 is premised on inflation cooling.

There is still much work to be done between now and April 30 to manage LOWA’s operations so that LOWA meets its many responsibilities while finishing the current fiscal year on budget. I encourage all members to help us meet those goals by patronizing our restaurants and other great amenities. The menus at the Clubhouse and Fareways have been freshened and the golf course beckons.

Board Seeks Member Input on Amending Regulation X, Use of Lakes, Regarding Watercraft Liability Insurance

The Board of Directors is seeking member comment regarding proposed amendments to Regulation X.B.2.e, Use of Lakes, regarding Watercraft Liability Insurance. Members who wish to provide commentor feedback should email the Board at Board@LOWA.org by March 10.

What is proposed? Increase the amount of insurance required for private owners of non-motorized watercraft and motorized watercraft of 25 horsepower or less, from $100,000 to at least $300,000 per accident.

Why? LOWA’s Insurance Agent, Bankers Insurance, has determined the private owner watercraft liability insurance requirement for non-motorized watercraft and motorized watercraft of 25 horsepower engines or less is too low. The norm for homeowners’ policies that cover this liability is now $300,000.

Who proposed it? The General Manager proposed these amendments. The Rules Committee recommended approval of the amendment. The LOWA Attorney agreed.

What is the effect? The amendment will increase the amount of insurance needed for private owners of non-motorized watercraft and motorized watercraft of 25 horsepower engines, to at least $300,000-per accident.

X. USE OF THE LAKES (6/29/2022)

B. WATERCRAFT REGISTRATION AND SLIP/RACK RENTAL REQUIREMENTS.

1. DECALS. All watercraft must be registered with LOWA. Each fiscal year, LOWA registration decals must be purchased. Two decals will be issued and must be attached on the port and starboard sides of the hull at the forward end of the watercraft so that the decal is clearly visible. The decals must be placed within six (6) inches from the Commonwealth assigned watercraft number, if displayed. Decals must be affixed to watercraft in the water, on canoes and kayaks on LOWA racks or in the designated Dry Sail Parking area by 11:59 pm on May 1 each year.

2. REGISTRATION REQUIREMENTS. Watercraft registrants must present the following documentation at the time of initial registration:

a. Current LOWA membership or registered tenant/authorized occupant ID.

b. Evidence of ownership of watercraft or lease agreement.

c. Evidence of the horsepower of the motor and length of watercraft.

d. Registrants of motorized watercraft of over 25 horsepower must carry watercraft liability of no less than $500,000 per accident or show proof of homeowner or renter personal liability insurance of no less than $500,000 per accident. So long as Registrants show written proof of watercraft liability coverage satisfactory to the Board, umbrella insurance policies may be used by Registrants towards meeting the $500,000 requirement. Registrants must certify that the required limits of insurance will be maintained and in effect for the entire fiscal year.

Traffic/Speed Limit Radar Signs

Hope everyone is enjoying all the nice weather, but don’t forget it is still winter and weather is always subject to change at any time. So, let’s continue to obey all posted speed limit signs and keep our family and visitors safe.

Radar Signs – As you are probably aware, we have a speed awareness sign heading north towards the compactor. We have installed another speed awareness sign heading south toward Spotswood Park. These speed radar signs are there to help ensure and keep you aware of your speed while commuting through LOW from work to home, or vice versa. It helps everyone get in the habit of slowing down and maintaining the correct speed due to coming off Route 3 and being used to running 55 or 60 mph for however long it takes you to come home.

In the future, there will be at least one more radar speed sign, and we will relocate them from time to time to speeding hot spots in areas where potential speeding is taking place throughout LOW.

e. Registrants of non-motorized watercraft and motorized watercraft of 25 horsepower or less must carry homeowner or renter personal liability insurance of at least $100,000 $300,000 per accident. So long as Registrants show written proof of watercraft liability coverage satisfactory to the Board, umbrella insurance policies may be used by Registrants towards meeting the $300,000 requirement. Registrants must certify that the required limits of insurance will be maintained and in effect for the entire fiscal year.

f. For subsequent annual registrations of the same watercraft, the owner must bring a current LOWA membership or registered tenant/ authorized occupant ID and must execute an affidavit that none of the specific information about the watercraft has changed from the prior registration, and that the required limits of insurance will be maintained and in effect for the entire fiscal year. If there are any changes, the registration process must be completed in accordance with Subsection 2.

g. Watercraft registered in accordance with above Regulations will not be subleased or rented for use at LOW.

h. An individual sale of a watercraft does not transfer a vested right of operation for that watercraft on LOW water.

i. Prior to initial registration or watercraft testing, every prospective registrant must certify that he/she has read and agrees to abide by all the Lake Regulations set forth herein, and to any other Regulations as may be adopted by the LOWA Board of Directors.

j. No watercraft will be placed or operated on the lakes unless it displays current LOWA registration decals. Invited guests participating in a Sailing Regatta sponsored by the LOW Sailing Club are exempt from this requirement.

k. The Commonwealth of Virginia and LOWA may stop and cite watercraft operators and owners for infractions of their respective Regulations.

The LOWA budget for FY2023-2024 has been finalized after a great deal of work by staff, the Board, and the Committees. Once again, the process required resolving some difficult trade-offs. LOWA continues to face significant cost pressures in materials and utilities, and the local labor market remains tight. The Finance Committee held three days of budget hearings jointly with the Planning Committee in December; we went through the entire budget in great detail. The group concluded that the budget presented was prudent and well thought out. Given the price and cost pressures, we thought it would be difficult to significantly reduce projected spending without negatively impacting the amenities and upkeep for the community. We also supported the proposed expenditure for a new patio for Fareways. That new addition will pay for itself in a few years through increased revenue, and we expect it will be very popular with the community.

On the revenue side, the Committee’s view has been and remains that increases in costs for the amenities should be paid by the users of those amenities to the extent possible, thus minimizing the effect on the general assessment. We therefore made a number of recommendations for increases in amenity fees relative to the initial proposed budget. I am happy to report that the final budget incorporated many of our suggestions. The budget still includes an increase of 6.7% in the assessment, which is in line with current inflation rates, although obviously higher than any of us would like.

Recent statistics suggest that inflation may have peaked. Hopefully cost pressures will decline going forward, making future budgeting decisions less painful. For now, we believe this is a responsible budget that will allow LOWA to operate our many high-quality amenities while also providing services to members and performing the maintenance that will allow our community to continue to grow and thrive.

Equestrian of the Quarter

We are proud to announce the winner of the Equestrian of the Third Quarter, Lexie Keller!

Lexie started her journey into riding through Summer Pony Camp, as so many children in Lake of the Woods do. Lexie was bitten HARD by the horse bug over the summer of 2022; so much so that she’s been a fixture in the Equestrian Center ever since, helping with horse shows, winter camp, or even with day-to-day lessons and pony rides. When prompted to pick a favorite horse, Lexie cannot! She loves all of them so much that she made friendship bracelets for each horse as their Christmas gift.

Congratulations, Lexie! We love having you in the barn! Each winner receives a Certificate of Excellence and a gift card to use to purchase a desired equestrian item of her choice. Golf Club News

The LOW Golf Club is holding basic golf rules clinics for golfers on the following dates: Feb. 20, March 3, 6, 20 and April 3. Each class will start at 10 AM and last for approximately 90 minutes. The clinic will be held in the Trophy Room at the Woods Center. The clinic is free for all LOW Annual Golf Members and $5 for all others. The clinic is designed to review the basic rules of golf so you can apply them on the course to play by the rules and in the spirit of the game. The clinic will focus on golf definitions, 2023 rule changes, LOW local rules, LGA rules reminders and situational application of the rules of golf. Sign-up sheets are posted at the LOW Golf Club Pro Shop.

The 2023 LOW Golf Club calendar has been updated for the golf club events scheduled for 2023. The golf calendar can be found on the LOWA.org website. Treadmill Safety

We would like to outline a few treadmill safety tips. It is important to be mindful of the safest way to use it. The U.S. Consumer Product Safety Commission tells us that, on average, there are 24,000 injuries on treadmills each year. Many can be avoided; here are some precautions when using our treadmills.

• Wear the right clothing. Baggy/loose clothing or clothing that is too long, hanging over your shoes when you are working out, can potentially cause you to trip and fall.

• Wearing flip flops or barefoot while working out on a treadmill is not recommended (and is against Fitness Center Regulations). Running shoes, with laces firmly tied, should always be worn; they protect your feet, ankles, and knees from injury and provide the necessary cushioning and support.

• Familiarize yourself with the machine. Just like driving a new car, if this is your first time on a machine you have not used before, take a moment to see what features it has and where. Are there stop buttons, rings, or tags that attach to the runner?

• Always clip in! Ensure the automatic-off safety clip is attached to you. The emergency stop button can be used to pause or stop the machine. If you are ever in a situation where the treadmill belt is moving faster than you can run, this immediately stops the movement.

• Stand straddling the deck with one foot on each of the rails before beginning your workout. Before you begin entering the program and settings you want, hold onto one of the rails to maintain your balance When the treadmill display starts to roll and counts down, carefully step onto the moving belt. Never just jump on to a moving treadmill. Start slow; you can increase your speed later.

• Increase speed or incline, one at a time, but not both together.

• Avoid distractions, such as talking to friends or on your cell phone (this is also a part of gym etiquette).

• While using the treadmill, do not look at your feet! Look forward or on the displays. When looking down you may forget where you are on the belt; You run the risk of falling if you are too far back, or you could lose your balance if you are too close to one side.

• Do not push yourself too hard. Know your limits. Keeping track of your heart rate during a workout is important. You do not need to get near your target heart rate to have a good workout. Even 50% of your target heart rate will burn fat, while more serious health issues can happen as you get closer to your target rate. Keeping below 80% of your individual target rate will provide you a great fat burning exercise without increasing your chances of heart attack or stroke.

• Turn off the treadmill before getting off. To ensure your safety, do not jump off the machine without turning off the belt. When you are ready, you can resume your workout by pressing the pause or green button. These tips will help ensure you have the safest workout possible on our treadmills. Tennis Connection

Due to your quick responses regarding the LOW Tennis Directory, 20 members have now submitted their information, which is a great start to expanding our tennis program and getting the word out for Spring Socials, Pickleball/Tennis Committee meetings and other tennis related news. The directory will be issued mid-March, so there is still plenty of time to submit your name and email address to me. We do not have a tennis pro for those wanting lessons, but we have members who would be happy to get on the courts and practice!

In addition to the directory, updates from Pickleball/Tennis Committee meetings will be provided, as well as information regarding upcoming Spring Tennis Socials on our new Facebook Tennis Connection site. The FiberLync Experience –New Customer

My neighbors, Gary and Susan, recently signed on with FiberLync for their internet service. They chose the Bronze package to support two TVS, two desktop computers, two wireless printers and two Wi-Fi connected cellphones and a Kindle. They also decided to move to streaming, and selected HULU as their main streaming service for TV programming. They canceled their previous provider and described that experience as well. I met with Gary and asked him questions about the process and experience. His answers appear below.

1. How was the FiberLync office experience? They were fantastic. Very patient, courteous, explained the process and billing in detail, easy to understand. They helped him decide which streaming service would be best suited to match most of his favorite programs.

2. How was the outside line installation experience? After signing up, the various utilities marked their lines. He met a FiberLync crew member to show them where he would like the line to run from the vault at the road to his house. The installation was minimally disruptive to the landscaping as the work was done by hand. A crew of five people used very heavy weight spades shoved into the ground and wiggled them back and forth to create a very narrow trench into which the line was buried about eight inches underground. The ground was then tamped back together to make the work virtually undetectable.

3. How was the inside work experience? We were given a two-hour window the day after the outside line was installed. The inside installer connected the line at the vault, then attached the outside box (OONT – Outside Optical Network Terminal) where it was requested. He then attached the inside box (Adtran box) to the wall near an electrical outlet. This was where Gary had his other provider’s equipment, on the wall just above the baseboard. The last step was connecting the router to the Adtran box, each of which uses the above-mentioned power outlet. The technician wore booties in the house. The whole process took 1 hour and 45 minutes.

4. Did you have an onsite tutorial? Yes. Once hooked up, the service was live. The installer helped set up the name and password for the router. (Gary kept his old ones for convenience) His main TV is a newer smart TV that picked up all the main streaming services available on the home screen. The technician also helped set up the other TVs with their already in use Amazon Firesticks. The technician was very patient and courteous. They will assist to the level needed by the customer.

5. How was the streaming learning curve? It was a bit frustrating the first two days. After just playing with the remote, it all made sense and became very easy to use. Gary uses an Amazon Firestick remote. FiberLync has a “My Bundle” tab on their website that was helpful in selecting HULU. There are many other providers from which to choose. Streaming services have no contracts and can be cancelled and switched at any time. Many TV Stations have streaming apps as well.

6. How was the cancellation process with your previous provider? It was a few steps. All are under contract. He went online to his account and found he was close to the end of his contract. There is a declining cancellation fee. It was easy by phone. One may call to cancel or go to the Comcast store in Central Park. You will need to drop off or ship back their equipment.

7. How satisfied are you with your FiberLync experience on a scale of 1-10? Clearly a 10. All persons are well trained and professional. The service works great.

8. Would you recommend FiberLync? Absolutely “Yes.”

We thank Gary for sharing his experience. He recommends that people go online or talk to FiberLync to get comfortable with the options possible. Many of our residents may wish to upgrade their internet capacity with Fiberlync but retain their current TV provider through cable. That will work just fine. 4.2 Report from the General Manager, Phil Rodenberg

A. January 2023 Financials

In January, we collected $275,524 in FY2022/23 lot assessments for a total of $7,402,860, or 94.1% of total lot assessments billed. As of January 31, the Preliminary Unaudited Income Statement Budget-to-Actual Comparison Summary showed a favorable variance of $271,847, primarily due to unbudgeted NCR receipts, and offset by unfavorable restaurant sales and cost of sales variances. Delinquency rate was 3.2%.

Finance Director Charles Maneval updated the Board on the year-end forecast. LOWA’s financial results through the end of the third quarter of FY2022/23 came in better than budget by $271,847. However, revenue set aside for specific projects and interest expense impacted the bottom line leaving an unfavorable-to-budget variance of $43,077. This variance is primarily driven by the performance of restaurant operations. Outlook for the rest of the year remains cautious, although our overall financial condition remains solid. Staff will be focused on achieving overall budget goals for the year.

It is currently forecast we will end the year with a net operating surplus of $4,617.

B. Clubhouse and Fareways Revenues and Expenditures

Financial details of our restaurant operations were provided, along with steps being taken now or planned for financial improvements to increase revenues and reduce costs.

C. Clubhouse Pool and Fitness Center Complex Concrete Issue

Low spots at the entrance to the Fitness Center are subject to pooling water. The Director of Facilities is exploring long-term options for eliminating the pooling, which includes possibly installing drains or repairing the concrete work. The GM will present final options for Board consideration at the March 8 meeting.

D. Other Business

The AllBox installation has been delayed a bit, but is expected to be operational by March 15. Yesterday the Orange County Board of Supervisors approved sending to the Planning Commission a change in set-back requirements along Route 3 from 100 feet to 50 feet. The proposed ordinance amendment will now be sent to the Orange County Planning Commission. This change will require an amendment to LOWA Regulation XVI.D.4.6.3, but clears the way to allow a couple of unimproved lots on Chesterfield Court to be buildable.

The Maintenance Department has assigned Roads Crew member Bill Belt as a special project inspector to begin daily monitoring and inspecting of fiber installation work by contractor FiberLync. David Jones is our new full-time Erosion and Sediment Inspector.

4.3 Committee Liaison Reports

Director Olson reported that at their recent meeting the Pools and Community Activities Committee made a point that it is important for management to look at something similar to having a membership card proximity reader like at the Fitness Center, as they are losing revenue by families and members just dropping in.

5.1 Consideration of Adopting the FY2023/24 budget and Setting the Annual Member Assessment. (Resolution 2023-2) (D-23-19)

(D-23-20)

Motion by Rappoport, passed unanimously, that the Board approve publication in Lake Currents for Member Comment Proposed Amendments to Regulation X.B.2.e: Use of Lakes, Regarding Watercraft Liability Insurance to increase the amount of insurance from $100,000 to $300,000 for Nonmotorized Watercraft and Motorized Watercraft of 25 horsepower or less.

6. NEW BUSINESS

6.1 Discussion of Proposed Amendments to Regulation V:Use of Individually-owned and LOWA-owned Property, and XVI: Environmental Control and Construction Procedures.

ECC Chair Elizabeth Delaney and Vice Chair Charyl Ferguson along with ECC Staff member Matilde Barone responded to questions from the Board on the list of proposed changes and updates to Regulations V and XVI. They will give additional review in response to questions brought up by Board members during discussion. Future action will be considered at the March 8, 2023 Board meeting.

6.2 Consideration of Approving the Main Gate Project and Authorizing A. Morton Thomas and Associates to Prepare Construction Documents. (Resolution 2023-3) (D-23-21)

Allie Felder, a member of the Front Gate/Third Gate Working Group, provided a summary of comments on the project received from members. The Working Group reviewed and evaluated all comments and ideas, and will forward them to AMT as the project progresses to the next stage. The Working Group recommended that the Board approve design Alternate 2B. Motion by Rappoport, passed unanimously, that the Board adopt Resolution 2023-3, a General Resolution, regarding the Main Gate Project, and authorize A. Morton Thomas and Associates to prepare construction documents.

6.3 Consideration of Approving Board Support for Funding and Carryingout the Lakes Management Implementation Plan. (Resolution 2023-4) Postponed to March 8.

6.4 Consideration of Approving Expenditure of $7,000 for an Opinion Letter from Stantec Consulting Services, Inc. Regarding Keatons Lake Water Quality. (Resolution 2023-5) (D-23-22)

Motion by Rappoport, passed unanimously, that the Board adopt Resolution 2023-5, a General Resolution, approving an expenditure of $7000 for an Opinion Letter from Stantec Consulting Services, Inc., regarding Keatons Lake Water Quality.

6.5 Consideration of Authorizing Expenditure for Purchase of a Replacement Annunciator for the Woods Center(for the fire alarm system) in the Amount of $4,310 with Funds from the Repair and Replacement Reserve. (Resolution 2023-6) (D-23-23)

Motion by Olson, passed unanimously, that the Board adopt Resolution 2023-6, a General Resolution, authorizing an expenditure for the purchase of a replacement annunciator for the Woods Center in the amount of $4,310, with funds from the Repair and Replacement Reserve.

6.6 Consideration of Approving Disclosure Package Related Fees at the Level Authorized by the Virginia Department of Professional and Occupational Regulation. (D-23-24)

Motion by Kay, passed unanimously, that the Board declare a continuing violation of the Restrictive Covenants exists on the Lot in Case #23-021501, and authorize management or its agent to enter the lot and clean up the miscellaneous items and perform the necessary work; and the Board suspend the voting rights and the use of the recreational amenities, including the Main and Back automatic gates, until the violation is corrected, in accordance with Section 12.G.b of the Restrictive Covenants, effective February 27, 2023; and further, that the Board authorize Management to send a legal demand letter to bring the lot into compliance.

Democratic Club Meeting

The next Democratic Club meeting will be March 8 at the Community Center. We will start with a social half-hour at 1 PM, followed by our speaker, Bryan Nicol, at 1:30. Bryan is the Orange County Planning Commissioner for District 5 (Lake of the Woods). He will speak on the Wilderness Crossing rezoning application pending before the Planning Commission. Bryan will discuss the current status of the application and be available to answer questions concerning the proposed 2,600 acre development. This is an issue of great importance to the LOW community, as it will affect traffic and water use. There are also important environmental issues related to the gold mines which were located there years ago.

Bryan and his wife, Traci, have been homeowners in Lake of the Woods for almost 15 years. He is a former Deputy Attorney General and Commissioner of Transportation for Indiana and currently serves as Chief Strategy Officer for an architecture, engineering, and consulting firm. All are welcome to attend the meeting and presentation.

Book Club

At its Feb. 8 meeting, the LOW Book Club discussed The Professor and the Madman by Simon Winchester. The story of the two most prominent originators of the Oxford English Dictionary was generally viewed favorably, with comments about the seemingly extreme detail and depiction of the laborious task of composing a complete dictionary of the English language.

Virginia Hall, the little-known heroic spy of World War II, is the subject for review at the March 8 meeting. Members will select one of three books for discussion: A Woman of No Importance by Sonia Purnell; The Wolves at the Door by Judith Pearson; and The Lady Is a Spy by Don Mitchell.

The Book Woman’s Daughter by Kim Michele Richardson is the selection for the April 12 meeting.

Fifty talented actors and actresses auditioned for roles in the Lake of Woods Players May production of Into the Woods. The cast was chosen and rehearsals have begun. This eight-Tony-award-winning musical follows a baker and his wife’s quest to have their own child. They must collect items to bring to the witch they have pleaded with to help them. These items are found in some well-known but fractured fairy tales written by the Brothers Grimm.

Production dates are May 5, 6, 12 and 13 at 7 PM; May 7 and 14 at 2 PM; and May 13 at 1 PM. Please note the times as some have changed since our last show. There will be more information on tickets in the next article.

Hawks of Virginia – Part 1 of 2

Six species of hawks nest in Virginia. Identifying them can be challenging. Observe size, color, wing shape, tail shape and length, body shape, and the bird’s shape during flight. Start by determining if the hawk is buteo or accipiter. Buteos, or ‘soaring hawks’, are football shaped birds with long, broad wings and rounded, fan-like tails. Red-tailed and Red-shouldered hawks can be seen soaring high above forests and fields or perched alongside a road or at the edge of a tree line.

The Red-tailed hawk, the most widespread and well-known buteo, is one of North America’s largest birds. Females weigh up to three poundslarge enough to be mistaken for eagles at first glance. They are generally dark brown above and pale below, with brown head and white throat, a streaked belly, dark bars on the leading edge of the wing, and cinnamon-red tail with black bar at the tip. They prey mostly on small mammals, but are opportunistic hunters with variable diets. Easily trained, they are the most commonly captured hawk for falconry in the US. Their distinct call is used for almost all birds of prey in movies.

Red-shouldered hawks are medium sized hawks with dark-andwhite checkered wings and warm reddish barring on the breast. They are noticeably smaller than a Red-tailed hawk and larger than a Broad-winged hawk. They prey mostly on small mammals, snakes, lizards, and amphibians.

Broad-winged hawks are typically found far from human activity and are most easily seen during fall migration, when hundreds of thousands of them travel to South America in huge flocks called “kettles.” Primary prey of the broad-winged hawk are small mammals, amphibians, and insects. They will also prey on invertebrates, reptiles, and nestling or juvenile birds. They mostly snatch their prey from the forest floor, only occasionally hunting “on the wing.”

Preserve Flowers for

Year-Round Garden Fun

We’re in the throes of winter, but that doesn’t mean you can’t enjoy flowers, plants and herbs from your garden. The Garden Club wants you to know that, with just a little planning and preparation, you can create fun winter projects to enjoy all year long.

During colder months you can pick up fresh, inexpensive flowers and greeneries at the florist or grocery store. Select delicate (thinner) blooms, since especially dense flowers do not tend to dry easily. Herbs are fun to use as well!

Two of the most popular ways to preserve your selections are pressing them between sheets of absorbent paper and weighing them down with heavy books, blocks, or whatever you might have. A proper flower press is also a great option; they come in a variety of sizes and prices, and can be purchased online or at crafts stores. However, before buying one, I recommend the old-fashioned book method just to get the hang of the process.

Another option is to preserve them in silicone gel granules. Thoroughly and gently cover everything in an airtight, sealable, lidded bowl or can. This method preserves the colors quite vividly. While not flattened, there are a variety of crafts for which you can use them. I recently dried rose buds to use in a small trinket dish for display. Please be sure to read the directions and cautions on the silica gel bottle, as some people may experience a skin irritation from contact.

There are many craft books available, as well as YouTube videos, that will give you more detailed, step-by-step instructions and demonstrate the process. Watching these now will give you some ideas for later on, when your garden is blooming in spring and summer. You won’t have to rely on store supplies; you can select some colorful flowers, greenery, and herbs while they’re still healthy.

LOWLINC Speaker Series: In the MomentLiving with Dementia

My friend and I go for a ride. We count red cars. We high five when we see one. The grass is green, flowers are in bloom and the sun sparkles on the lake. My friend looks out the window and says “The red buds are on the trees. Winter is almost over.” I comment “it has been a long cold one.” We play cards. We shuffle, deal, pick and throw cards. There are no rules. No strategy. We laugh a lot.

A stage we could embrace and face together. According to the Dementia Society of America, there are more than 9 million Americans diagnosed with some form of dementia. Your family, friends, or neighbors may currently be dealing with dementia in their lives.

LOWLINC is a service organization that enables people to be healthy, happy, and connected on their own terms as they age. The first presentation in our 2023 LOWLINC Speaker Series will focus on understanding dementia. It will be held on Tuesday, March 7, from 1:30 to 3 PM in Meeting Room 2 at the Community Center.

Ellen Phipps, Executive Director of Aging Together, will be our speaker. Before joining Aging Together, Ellen served as Vice President, and later CEO, of the Alzheimer’s Association, Central and Western Virginia Chapter. She is the author of Connections: Engagement in Life for Persons with Dementia, A Complete Activities Guide. Ellen not only has a wealth of knowledge on the subject of dementia, but a passion to enrich the lives of those with the condition and that of their caregivers.

Wilderness Crossing Rezoning Application Update

The Orange County Planning Commission continued its review and examination of the rezoning application at a work session on Feb. 9, looking into the details, and addressing the impacts to the County and to Lake of the Woods residents on the issues of the general development plan, water, transportation, design guidelines, and buffers. The commission scheduled a final work session for Feb. 16. This work session will also be available on the county’s website. At the Feb. 16 work session, the commission was scheduled to review the fiscal impact statement, economic impact statement, and the applicant’s proffer statement submitted by the Wilderness Crossing applicant.

Mark your calendars. Based on the current schedule, the Planning Commission expects to hold a public hearing on the rezoning application on Thursday, March 24. The public hearing is expected to begin at 6 PM at the Locust Grove Middle School, near the LOW back gate entrance. The public hearing will be advertised in advance once details are finalized.

After hearing from the public, the commission, in its advisory capacity, will either recommend approval or recommend denial of the rezoning application to the Orange County Board of Supervisors.

The Board of Supervisors will hold its own public hearing on the Wilderness Crossing rezoning application and has the sole authority to approve or deny the rezoning application.

Orange County Supervisor’s Letter

Homeowners that rent out their homes in Orange County for short term rentals are required to pay the Transient Occupancy Tax of 2% on the charges for the rental. Because of the difficulties in collecting this tax, the Virginia General Assembly recently enacted legislation to amend the Code of Virginia to require an accommodation intermediary, such as Airbnb or Home Away, to collect this tax and remit it to the appropriate locality. The accommodation intermediary is also required to submit to the locality the property address and gross receipts for all rentals in the locality. Licensed real estate agents are not required to collect the taxes or submit this information. They have a stronger lobby. However, the owners of shortterm rentals facilitated through real estate agents are still required to collect the Transient Occupancy Tax and remit it to the Commissioner of Revenue.

The Orange County Code currently does not include language that reflects the amended Code of Virginia. Therefore the county has prepared amendments to our code to enact these provisions. Any changes to the Orange County Code require a Public Hearing; one will be conducted at the Feb. 28 Board of Supervisors meeting to implement these amendments.

You may have noticed some construction on the right side of Route 3 as you approach from Fredericksburg. This is not part of Wilderness Crossing, but is a new entrance sign for the county. There are two different sign configurations. The one shown will be installed at each end of Route 3.

My current term as your District 5 Supervisor ends on Dec. 31 of this year. At the last LOWA Board meeting, I announced that I am not planning to run for another term. I will have completed 16 years by December, and feel that it is time for me personally to make some changes. I am making this announcement early so that anyone who would consider seeking this office has sufficient time to complete the necessary application process. I will continue to remain active as your Supervisor for the rest of this year.
