The first shots have been fired in the North Gauteng High Court in what is now referred to by informed local political observers as ”the beginning of the GTM’s season of trouble”. The court ruled for the well-known Mac P Construction (Pty) Ltd of Tzaneen, the applicant, in an interdict against the GTM and Makgetsi Construction Enterprises CC in an application regarding a tender by the GTM (Greater Tzaneen Municipality) for the construction of the road between Sasekani and Nkowankowa (known as the D3763). The court has also ruled that the respondents, the GTM and Makgetsi, who opposed the application, have to pay the applicant’s cost. ling the court found that there was a strong prima facie possibility of serious irregularities in the tender process. The members of Makgetsi are Reginah Sekibela Mahalefa and Makgetsi Lordwick Samson Manthatha. Mahalefa’s address is 33 Aqua Lane, Aqua Park, Tzaneen, whilst Manthatha’s address is 1357 Industrial Street, Lenyenye. The CC’s registered address is Tloung Village, Magogwe, Mafikeng, and the entity’s accounting officer is one M B Mhangwana from Chloorkop. The tender to the amount of R33 223 649,84

was awarded to Makgetsi. Rumour has it that there is a link between Makgetsi and Selby Construction, one of the GTM’s seemingly preferred civil construction companies. Mr Louis Erasmus of Thomas & Swanepoel Attorneys in Tzaneen is Mac P’s attorney and Advocate Dawie Fourie SC was commissioned to appear for the applicant. Mr Makapane Colin Modipa and his wife, Ms MM Modipa, are the directors of Mac P. The Bulletin has information indicating that a number of claims are on the cards for the GTM. One developer who has asked not to be identified at this stage is busy with litigation to slam the GTM with a R20 million claim, whilst another developer is also contemplating a substantial claim against the GTM. A number of other claims and/or other forms of legal action are also being considered, according to our information.

The Greater Letaba Municipality is badly in the red after receiving an adverse report from the auditor general (AG) on its performance during the past financial year. The report, questioning the disappearance or records of more than R135 million, accused the GLM of unauthorised, irregular and wasteful expenditure – thus deciding on an adverse opinion. The AG lashed out against the GLM’s audit committee, who did not function as required by the municipal finance management act. The committee did not review the annual financial statements and did not meet at least four times a year. Another body functioning as the performance audit committee did not perform as required by municipal planning and performance management to meet at least twice

during the financial year, or review the quarterly reports of the internal auditors. It also failed to submit an auditor’s report to the council regarding the performance management system, which should be done at least twice during the financial year. The internal audit unit did not function as required by the financial management act and the GLM failed to develop mechanisms, systems and processes for auditing the results of performance measurement as required. The report added that the management of the GLM did not monitor the effectiveness of the audit committee, while the accounting officer failed to exercise oversight responsibility over financial reporting. “The chief financial officer (CFO) did not ensure that amounts disclosed in the financial statements agree to supporting schedules and documents. Accounting standards were incorrectly applied.” This report is bad news for the GLM after it received a qualified report for the previous financial year.
