Mattanu Private Game Reserve


Kriek Family | Profile Dr Johan Kriek, wildlife veterinarian and until recently, commercial helicopter pilot, moved to SA in 1980 from Zimbabwe. Started a mixed veterinary practise and soon after started importing wildlife from Africa to realise his dream of one day owning his own game farm.

In 1991 this dream was realised and the breeding of rare Roan and Sable antelope started, soon followed by the first private disease free Buffalo breeding project. His wife, Daleen Kriek, a qualified Physiotherapist assisted from the small vet practise days, through all the wildlife importation operations until now where she is still very much involved in the hospitality of Mattanu Private Game Reserve. Their eldest son Johann Kriek was born in 1980, followed by Jacques Kriek in 1982 and daughter Heleen Kriek in 1986. Son Johann qualified as an IT technician during 2001 and developed the Kriek Helicopters & Kriek Wildlife websites with electronic marketing platforms. He obtained his commercial helicopter license during 2006 & was instrumental in the certification of Kriek Helicopters as a commercial helicopter service. Jacques finished his degree in Tourism management/ marketing and development and in 2006 actively started developing and marketing the breeding farm as a eco tourism destination evolving into the award winning Mattanu Private Game Reserve. He now also chairs the WRSA Roan and Sable advisory committee. Sister Heleen, qualified somatologist, is in the process of establishing a wellness spa at Mattanu. The whole Kriek Family also qualified as estate agents with Daleen and Johan being the principals. Along with their sons, under the Kriek Wildlife Group brand, they now specialise in the game breeding/capture/immobilisation, translocation, marketing of wildlife/farms as well as consulting and mentoring current and future game breeders. As professional hunters Dr Johan, Johann and Jacques also assists with all trophy and biltong hunts at Mattanu. They were recently joined by son-in-law, Burger Schoeman, whom will further diversify the KWG into the meat production industry. Burger is involved in all facets of the KWG with main responsibilities being farm management, maintenance and labour relations. Other family members include Johann’s wife, Dominique, pregnant and 3rd child due in July 2018, with children Tiaan and Mine as well as Jacques’s wife, Stephné and children Stephan, Jane and Mienke born Dec 2017. Heleen and Burger recently had their first son Pierre.

Met `n passie vir die natuur en wild, het ek die voorreg om met Bastergemsbokke te begin boer in 2009.

Thembi Wildlife is op die plaas Brakdam in die Boshof distrik geleë.

Die plaas Clievden is 15km buite Douglas, net aan die oorkant van waar die Riet en die Vaalrivier bymekaar kom wat n baie geskikte en geskiedkundige area is vir die Bastergemsbok wat in 1850 reeds hier deur Gordon Cumming beskryf is.

Ons is nou in ons vierde jaar waar ons intensief selektief met Njala boer.

Vroulike diere van regoor die land is van bekende telers soos Dreyer van Zyl, Greeff Wildlife en Stud Game Breeder bekom om diverse genetika te verseker. Twee van ons teëlbulle, Juba en Samson is onderskeidelik 29 en 30 duim, met Mbani ons jong bul van Tembani Wildlife, wat volgende jaar deel van ons teelprogram word. Dag tot dag bestuur met voeding, lam-intervalle en DNA versameling maak ‘n belangrike deel uit van ons data basis. Kupel Wild Breeders – ‘’Meer as Genetika’’, teel skaars wild in een van die oudste meteorietkraters ter wêreld, die Vredefort Koepel, ‘n UNESCO wêrelderfenisgebied. Beukes Wildlife & Roan Breeders het ontstaan in 2010 op ñ familie plaas van sowat 10 000ha in Vanzylsrus omgewing. Die vennote in die boerdery is broers Johannes en Dirk Beukes SNR en die 2 broers Kobus en Dirk Beukes Jnr. Die boerdery bestaan hoofsaaklik uit gemengde boerdery, maar het die mark betree toe ons eerste Bastergemsbokke aangekoop is in 2010. Sedertdien kan ons spog met ons eie aanteel soos “Emma”, wat op die 2016 Kalahari veiling verkoop is. Ons passie vir die wildboerdery het begin met Bastergemsbokke. Ons het daarna begin uitbrei na Swartwitpense, Springbokke (damara en kleur variante) asook, Njalas, Koedoes, Rooibokke en Gemsbokke. Ons het in 2016 ons Bastergemsbokkudde uitgebrei met ñ Tosca seun van Beyers Gerber Boerdery, wat tans saam van ons top vroulike diere loop. Die Bastergemsbokbul wat op die veiling aangebied word, kom uit Piet du Toit Wildbedryf bloedlyn.

Kleinveeboer vanaf 1999 in die Noordkaap en die Vrystaat. Het in 2011 op klein maat begin met n buffel boerdery asook ander wildsoorte soos: Nyalas, Roans, Sables, Bontebokke, Koper Springbokke en nog ander klein wild. Is n Beroepsjagter met buitelandse jagters vanaf 2001. Het n passie vir die boerdery van na skool af en probeer om altyd n positiewe bydrae tot die bevordering van goeie bestuurspraktyke in sy boerdery toe te pas en die uitdagings in sy boerdery te oorkom met innoverende besluite en harde werk.

Being in the retail industry for 19 years and looking for diversification opportunities, Rare Game Breeding seemed to be the obvious choice. Mnr Jan Weenink het in 1986 die plaas Longfield, 30 km Noord van Kimberley gekoop en aanvanklik met bees geboer. Hy en sy twee seuns, Willem en Leon, het ‘n liefde vir wild gehad en het mettertyd wild op die plaas begin vestig. Aanvanklik is gemsbokke, blesbokke en springbokke gevestig en later het bastergemsbokke, swartwitpense en buffels vanaf Dr Johan Kriek bygekom. Vandag word daar op bykans 2600 Ha semi intensief met verskeie wildsoorte geboer en word daar voortdurend gefokus om vir die beste genetiese materiaal te selekteer en vir teling te gebruik. Op die plaas Lorraine, Plooysburg distrik, is daar byvoorbeeld al verskeie bastergemsbokbulle van oor die 30 duim geteel. Egerton Game het sy ontstaan gehad in 1998 op die plaas Grasfontein, Philipstown distrik met die vestiging van gewone vlakte wild spesies. ‘n Paar jaar later het ons uitgebrei met die eerste aankope van Nyala’s , Buffels, Swartwitpense en bastergemsbokke. Tans is ons gevestig op die plaas Egerton op die oewer van die Oranjerivier naby Hopetown. Meeste van die oorspronklike kuddes bestaan uit die genetika van ons plaaslike tellers. Egerton Game streef daarna om goeie genetika met bekostigbare pryse te versoen, met die langtermyn visie om ‘n bydrae te lewer tot die volhoudbaarheid van die wildbedryf in Suid Afrika. Gamka Wildlife was born from the passion for the Karoo, nature, wildlife and conservation. We are situated in Matjiesvlei, a picturesque valley at the foot of the Swartberg Mountains next to the Gamka River, approximately 70 kilometers west of Oudtshoorn in the Klein Karoo. The farm consists of 3 200ha of which 600ha is fenced as camps for the breeding of various wildlife species. STS-Meletse is a renowned, extensive game breeding and hunting farm situated in the heart of the picturesque Kalahari. Covering some 22 000 hectares and set within the typical rolling red sand dunes of the area, extensive herds of oryx, springbok, buffalo, rhino, and other indigenous species roam the plains. Meletse Breeders has distinguished itself as a respected high-end breeder. For example, a large breeding herd of exceptional Kalahari oryx has been established. This carefully selected herd is one of the biggest and most diverse oryx herds in South Africa and Namibia. More than 200 breeding cows in excess of 40" are at the heart of the herd. In addition Meletse Breeders owns a hardened Damara springbok herd that hails directly from various parts of Damaraland, Namibia. Buffels In 2007 het ek met buffels begin boer, my eerste 10 vroulike diere het ek by John Hume gekoop, daarna het ek my kudde aangevul by Buffels wat ek by Julius Gers aangekoop het, die laaste buffel aankope was gedoen vanaf Rubin Saaiman. Die verskeie buffel bloedlyne van kwaliteit telers, was die gevolg van kwaliteit geteelde buffels, waaronder meeste van my koeie 30 duim plus meet. Uit die aanteel het ek ‘n buffel bul geteel van 47 duim en dit aan Ikey van Wyk van Matopi Wild verkoop. Baster Gemsbokke In 2012 het ek begin om met baster gemsbokke te teel, my eerste bokke het ek by Julius Gers aangekoop, waarna ek my bokke aangevul het met bokke vanaf Riaan Badenhorst, MW de Jager, Jaco du Toit, Rubin Saaaiman en ‘n bul van 31 7/8 duim vanaf Soetvelde Farms. My eerste teelbul wat ek in 2012 aangekoop het en vir 2 jaar as teelbul gebruik het, het 32 6/8 gemeet. Die bul het ek in 2014 aan Golden Breeders verkoop. My hoof fokus in die wildsbedryf is om top kwaliteit baster gemsbokke te teel, die rede hiervoor is dat ek glo dat daar nog ‘n groot gaping in die mark bestaan. My kudde bestaan reeds uit ‘n 100 plus diere. Omdat daar baie inteling by baster gemsbokke voorkom, het ek gekies om bokke by soveel moontlike telers aan te vul, die gevolg hiervan is dat my kudde uit 9 verskillende bloedlyne bestaan. My fokus vir die toekoms is om met al my wild net die beste kwaliteit te teel. Onlangse projekte waarmee ek begin het bestaan uit ‘n waterbok kudde met ‘n teelbul van 32 ¼ duim, blou wilde beeste – 2 bulle van 30 duim plus en ‘n rooi hartebees van 27 duim. Breeding and developing a Wagyu herd

Wagyu were originally draught animals used in cultivating rice paddies so they were selected for physical endurance. Over centuries this natural selection process favored animals with more intra muscular fat cells – marbling – which provided a readily available energy source to complete the task. Definition of Wagyu: means cattle.

‘Wa’ simply means Japanese style and ‘gyu’

Japanese Wagyu derived from native Asian cattle which were infused with British and European breeds in the late 1800’s. Although the breed was closed to outside bloodlines in 1910, regional isolation has produced a number of different lines with varying conformations. Tajima – originating from the Hyogo prefecture. These black cattle were used to pull carts and ploughs so they developed larger forequarters and lighter hindquarters. They are generally smaller-framed with slower growth rates but produce excellent meat quality with large eye muscle and superior marbling. They are thought to be ideal for the production of F1 cattle for slaughter. The Tajima bloodlines are generally regarded as producing the best quality meat in all of Japan. Kedaka or Tottori – These were pack animals in the grain industry so they are larger animals with straight, strong backlines and generally good growth rates but sometimes variable meat quality. Fujiyoshi or Shimane – These are medium framed cattle with average growth rate and good quality meat and are well suited to cross with Angus. The Wagyu population outside Japan is derived from fewer than 200 exports to USA that arrived between 1993 and 1997 after the first 2 arrivals in 1976. Four bulls were sent from Japan by Morris Whitney in 1976. Colorado University took semen collections then they were bought by Wagyu Breeders Inc. There were no Wagyu females in America so the original two Japanese BlackWagyu (Mazda from Tottori and Mt Fuji from Hyogo) and two Wagyu Red bulls (Rueshaw and Judo from Kumamoto) were joined to Angus, Holstein, Hereford and Brangus cows in Texas.

There are many producers who have used Wagyu bulls or who have Artificially Inseminated (AI) many of their commercial animals with Fullblood or Purebred Wagyu semen and are looking at the opportunity to grade up over time to become a purebred herd or to remain a commercial herd but command a premium price for their cattle that then may have a higher than 50% Wagyu content. This article describes the process that producers can follow to either breed to a Fullblood or Purebred Wagyu herd, remain a commercial producer, or probably both. Difference between Fullblood and Purebred Fullblood animals trace their lineage, uninterrupted, through their pedigrees directly back to an ancestor in Japan. They are thus 100% pure Wagyu genetics and are thus considered to be part of “the original stock”. In the Wagyu seedstock industry there is still a significant monetary value associated with being a breeder of Fullblood Wagyu cattle. This was also the case when all British and European breeds were exported out of Britain and Europe at the turn of the previous century. Aberdeen Angus, for example, was exported from Scotland to the USA and Simmental into Africa. Australia is the largest source of Fullblood Wagyu outside of Japan while the USA has the largest population of Purebred Wagyu. A total of 100 000 cattle is joined annually to Wagyu sires in Australia, 1) Starting a Fullblood herd A Fullblood herd is bred by: •

Purchasing Fullblood Wagyu bulls or semen and using them on Fullblood cows. Fullblood cows can be purchased at many of the production sales being held across the country or at the Society’s annual National Sale.

With an embryo transfer program using normal commercial cows as recipients and Fullblood cows inseminated with the semen of Fullblood bulls as donors.

There are three AI/Embryo stations in South Africa that are partners of the Society. These are: Embryo Plus In Vitro Africa Ramsem:

Fullblood Embryos can either be sourced from an Embryo station or imported directly from countries such as the USA and Australia. Wagyu Classification Definition

The Animal Improvement Act (Act Nr. 62 of 1998) determines that Seedstock(stud) animals can only be bred through registering / recording such animals through the official body designated for that purpose by the Act. In the case of Wagyu cattle that body is the Wagyu Society of South Africa. The task of the Society is to look after the interests of the breed, the breeders and to collectively promote the breed. The South African Wagyu Society received official recognition in 2014.

Wagyu Fullblood 100% The offspring of a Wagyu Fullblood sire and a Wagyu Fullblood dam whose forebears originate from Japan and whose pedigree shows no evidence of any crossbreeding.

Crossbred Wagyu F2 75% Has greater than 75% (±5%) Wagyu genetic content. For example, the result of at least two generations of upgrading using a

The first option for starting a Purebred herd is to purchase Purebred females from other breeders. These females are often in calf from a Purebred or Fullblood bull. The advantage of this option is that you start breeding Purebred Wagyu’s from the first calf crop.

Purebred Wagyu F4 93+% Has greater than 93% (±5%) Wagyu genetic content. For example, the result of at least four generations of upgrading using a Wagyu Fullblood or Purebred sire – the progeny of a Fullblood or Purebred Wagyu bull and a Wagyu F3 dam. Crossbred Wagyu F3 87+% Has greater than 87% (±5%) Wagyu genetic content. For example, the result of at least three generations of upgrading using a Wagyu Fullblood or Purebred sire – the progeny of a Fullblood or Purebred Wagyu bull and a Wagyu F2 dam.

Wagyu Fullblood or Purebred sire – the progeny of a Fullblood or Purebred Wagyu bull and a Wagyu F1 dam. Crossbred Wagyu F1 50% Has 50% (±5%) or higher Wagyu genetic content. For example, the first generation of upgrading using a Wagyu Fullblood or Purebred sire and the dam of another breed.

A grading-up program is also a commonly accepted way to “breed up” to a Purebred herd.

This process will take four generations of breeding if starting from scratch with commercial cattle. Only registered (by the Society) Fullblood or Purebred bulls can be used for breeding, either via natural mating or via the use of semen of approved bulls on cows in the upgrading program. The progeny of such bulls on commercial cows are eligible to become first generation (F1) animals; the progeny of qualifying bulls on first generation (F1) heifers and cows are eligible to become second generation (F2) animals; similarly, the progeny of qualifying bulls on second generation (F2) females are eligible to become third generation (F3) animals; and finally the progeny of third generation (F3) females can be used to breed what is known as Purebred animals (in theory F4’s). As per the illustration below and by definition, a Purebred Wagyu can never be a 100% Fullblood, but will be breeding 93+% purebred Wagyu’s by the fourth generation.

Breeding a commercial Wagyu herd A significant proportion of producers simply want to breed commercial animals and reap the benefits of breeding with Wagyu’s without the additional effort to register the animals through the Society. To breed a commercial herd requires a Fullblood or Purebred bull (or semen of such bulls) to obtain the F1 progeny. Commercial producers can then decide themselves if they want to breed F2 and F3 animals for the feedlot market. Note that all commercial producers will be strongly encouraged to be part of the Society’s Wagyu Quality Assurance program (WQA). The definition of a WQA-animal is any animal sired by a WSA registered sire ( Fullblood or Purebred and see Wagyu Classification Description above), thus an animal with at least 50% Wagyu breed content (maximum variation of 5%), a minimum Marbling Score of 3, hormone free, all males castrated prior to 5 months of age and ethically produced as per the Society’s protocol.

Rules of Auction (As auction house, herein after referred to as the “Auctioneer" and the person conducting the auction referred to as the “auctioneer") 1. All goods sold by auction will be subject to a reserve price, unless specifically stated otherwise by the auctioneer at the start of the auction. 2. Unless where notice is given, it is not allowed that the Owner / Seller, his agent or the Auctioneer may bid on any of the Owner’s / Seller’s goods sold by auction. However, individual Sellers may bid on other Sellers’ animals. 3. These Rules of Auction comply with Section 45 of the Consumer Protection Act, Act 68 of 2008 (“the Act”) and the Regulations of the Act as applicable, which read as follows: Section 45: “Auctions” 1) In this section, ‘‘auction’’ includes a sale in execution of or pursuant to a court order, to the extent that the order contemplates that the sale is to be conducted by an auction. 2) When goods are put up for sale by auction in lots, each lot is, unless there is evidence to the contrary, regarded to be the subject of a separate transaction. 3) A sale by auction is complete when the auctioneer announces its completion by the fall of the hammer, or in any other customary manner, and until that announcement is made, a bid may be retracted. 4) Notice must be given in advance that a sale by auction is subject to— a) a reserved or upset price; or

b) a right to bid by or on behalf of the owner or auctioneer, in which case the owner or auctioneer, or any one person on behalf of the owner or auctioneer, as the case may be, may bid at the auction. 5) Unless notice is given in advance that a sale by auction is subject to a right to bid by or on behalf of the owner or auctioneer— a) the owner or auctioneer must not bid or employ any person to bid at the sale; b) the auctioneer must not knowingly accept any bid from a person contemplated in paragraph (a); and c) the consumer may approach a court to declare the transaction fraudulent, if this subsection has been violated. 6) The Minister may prescribe requirements to be complied with by an auctioneer, or different categories of auctioneer, in respect of— a) the conduct of an auction; b) the records to be maintained with respect to property placed for auction; and c) the sale of any such property by auction.

4. The auction is conducted for the normal and voluntary disposal of the Owner’s / Seller’s goods. 5. Buyers are bidding per piece to take the lot, unless where explicitly stated by the Auctioneer or in the Auction Catalogue. 6. The auction will start at the published time. The auction will not

be delayed to allow any specific person or more persons to take part in the auction. 7. All goods sold at the auction are sold by the Auctioneer as agent on behalf of the Owner / Seller. The Owner / Seller hereby authorises the Auctioneer to issue invoices, credit and debit notes as applicable on its behalf and agrees not to issue the aforementioned for the same supply. The Owner/Seller also hereby authorises the Auctioneer to collect the purchase price from the Buyer and the Owner / Seller do hereby cede to the Auctioneer all the Owner / Seller’s rights, title and interest in and to its claim for payment of the purchase price against the purchaser, which session the Auctioneer do hereby accept. 8. The purchase price of the goods sold by auction specifically excludes VAT and VAT must be added to the purchase price and paid by the Buyer unless specifically indicated otherwise. Declaration and compliance related to all applicable taxes is the responsibility of the Owner/Seller and Buyer as relevant. 9. Transfer of risk: 9.1 Risk in respect of profit and loss in the goods sold per catalogue shall pass to the Buyer upon the fall of the hammer and upon acceptance of the bid by the Owner/Seller. Save for where boma animals are auctioned, such risk will specifically exclude mortality of the goods. The risk in mortality of the goods will remain with the Owner / Seller until safet step-off at the Buyer’s address. 9.2 In the event where boma animals are auctioned, risk in respect of profit and loss in the goods sold will pass to the Buyer upon the fall of the hammer, which risk include mortality.

9.3 Notwithstanding the passing of risk, ownership shall remain vested in the Owner / Seller until such time as the full purchase price has been paid to the Owner / Seller. 9.4 Notwithstanding par 9.1 to 9.3 above, all risk will transfer from the Owner/Seller to the Buyer 30 days after the auction, alternatively after the goods has become available, at the discretion of and upon advice from the Owner / Seller. 10. Delivery of the goods sold at the auction, shall only be given to the Buyer upon the Buyer fully performing its payment obligations in accordance with these conditions of sale. The Owner / Seller shall be responsible for costs incurred to deliver the goods on the Buyer’s transport. The Buyer shall be responsible for procuring and paying for transport of the goods from the Owner / Seller’s property. 11. The parties specifically agree that no bid may be retracted after the bid has been knocked down (fall of the hammer) and accepted by the Owner / Seller, unless the Owner / Seller consents thereto in writing. 12. Subject to any reserve price placed on any of the goods by the Owner / Seller, and the provisions of clause 13 and 14 below, the Buyer at any sale by auction shall be the highest bidder indicated by the auctioneer by the fall of the hammer or by such other means as the auctioneer may select. 13. The auction shall take place under the direct and exclusive control of the auctioneer. The auctioneer reserves the right, in its sole discretion, to refuse the bid of any person, to regulate the bidding and to indicate the highest bidder. If the auctioneer

suspects that a bidder has not made a bona fide bid, or is unable to pay the purchase price or has not made satisfactory arrangements for payment of the purchase price, he may refuse to accept the bid of such bidder or accept it provisionally until the bidder has satisfied him that he is in a position to pay the purchase price or that he has made satisfactory arrangements for payment thereof. On refusal of a bid under such circumstances the goods may immediately be re-auctioned. 14. In the event of a dispute arising amongst the bidders and / or the Auctioneer, the goods in dispute shall, at the sole discretion of the Auctioneer, be re-auctioned. 15. Any error by the auctioneer shall be entitled to be corrected by him or her immediately upon discovery. 16. Should any contractor remove any goods from the sale venue on instruction of the Auctioneer, acting on behalf of the Buyer, the contractor will be deemed to be the contractor of the Buyer who accepts all costs and risks connected with such removal. 17. The Owner / Seller warrants that there are no encumbrances on such goods, that the said goods are the property of the Owner / Seller, and that the Owner / Seller is competent and legally entitled to dispose of the goods. 18. The Owner / Seller, who offers the goods for sale, accepts all liability regarding the information furnished as to pedigrees, ages, dates of service, state of health or gestation or any other particulars which might be incorrect. In the event of any dispute the Buyer shall only have a claim against the Owner / Seller and not against the Auctioneer. The Owner / Seller and Buyer

indemnify the Auctioneer against any claim(s) regarding the information furnished as to pedigrees, ages, dates of service, state of health or gestation or any other particulars which might be incorrect. 19. Should any animal auctioned by catalogue be sold as pregnant, pregnancy will be confirmed upon capture for loading, costs of which are for the Owner’s / Seller’s account. Boma animals sold as pregnant was confirmed as pregnant prior to the auction. A veterinarian’s report confirming pregnancy will be regarded as final. Furthermore, where an animal is sold as pregnant, pregnancy upon loading is guaranteed, but no calf or lamb is guaranteed. Once safely loaded onto the Buyer’s transport, the risk of the animal’s pregnancy transfers to the Buyer. 20. Where goods are put up for auction the following conditions apply to such goods: 20.1 Where the age of the animals are not specified, the animals will be regarded not to be older than 5 years and in a good and healthy condition. 20.2 All animals put up for auction must, where applicable, be visibly marked with ear tags and / or microchips. 20.3 Where available, DNA information of the animals must be provided to the Auctioneer in order for the Auctioneer to include such information in the Auction Catalogue. 20.4 In the event where the photos and specifications are not animal specific; the Buyer has the right to choose a similar animal, as described, from the herd concerned, and presented in the Auction Catalogue.

20.5 In the event where the Owner/Seller acted bona fide and the animals put up for auction did not meet the specifications as described in the Auction Catalogue (i.e. pregnancy, age horn length, etc.), the Buyer has the right to cancel the transaction or to negotiate new terms and conditions. The commission shall be payable on the new terms as agreed upon between the Owner/Seller and Buyer and approved by the Auctioneer.

via electronic transfer (“EFT”) on the date of sale (“the payment date”) unless other payment terms and or means are agreed between the Auctioneer and the Buyer. The Auctioneer reserves the right to refuse any other method or means as payment. Payment by way of EFT will only be regarded as done as soon as the funds transferred reflects and are available in the Auctioneer’s bank account.

20.6 Horn lengths provided by the Owner/Seller or its duly authorised representative, of animals put up for auction, are warranted by the Owner / Seller.

26. In the event that the Auctioneer agrees to facilitate the purchase of the goods by paying an amount equal to the purchase price to the Owner / Seller before the Buyer makes payment to the Auctioneer (“the Payment Terms Agreement”), then the following shall apply:

21. All delayed deliveries due to an additional pregnancy is at the Buyer’s risk, including calves. The period required for an animal to be certified pregnant will be determined by the Owner/Seller. The Buyer is advised to take out insurance cover on animals remaining on the Owner / Seller(s) farms where risk has passed to the Buyer.

26.1 The election to make any payment to the Owner / Seller shall be in the sole and absolute discretion of the Auctioneer, which discretion may be exercised separately with regards to each transaction entered into by the Buyer.

22. The Owner / Seller warrants that the goods sold are free of any known patent and latent defects and that any right or claim ceded to the Auctioneer in terms of these Rules of Auction is free of any defect or right of deduction or set-off, and that the said right or claim is fully and immediately enforceable against the Buyer.

26.2 Upon payment of the amount referred to in 26.1 above the Owner / Seller's right, title and interest in and to any claims and other rights against the Buyer in terms of or connected with the sale of the goods shall forthwith be ceded and transferred to the Auctioneer, which session the Auctioneer hereby accepts.

23. The Buyer shall, prior to the sale, ascertain whether there are any defects in the goods and any bid by a Buyer shall be considered as acceptance of the goods with any patent or latent defects in their condition at the time of sale.

27. In the event of any Payment Terms Agreement between the Auctioneer and the Buyer, the following shall apply;

The Buyer shall not be entitled to withhold payment of the purchase price to the Auctioneer as a result of any possible or pending claim that he may have against the Owner / Seller on the grounds of misrepresentation or for any other reason whatsoever. 25. The purchase price is payable by the Buyer to the Auctioneer

27.1 No Payment Terms Agreement shall be valid unless reduced to writing and duly signed on behalf of the Auctioneer. The facilitation of any sale by the Auctioneer as referred to in this paragraph 27 shall be strictly subject to the terms and conditions of the Payment Terms Agreement. 27.2 In the event of any conflict between the contents of this document and the Payment Terms Agreement, the provisions

of the Payment Terms Agreement shall prevail. 27.3 No application for credit as defined in section 8 of the National Credit Act, Act 34 of 2005, will be received or considered by the Auctioneer. 28. Anyone that intends to bid at the auction (Buyer) must register his or her identity on the bidder’s record prior to the commencement of the auction and such registration must meet the requirements of the FICA (Financial Intelligence Centre Act, 2001) in respect of the establishment and verification of identity of the person. The prospective Buyer must sign the registration entry and furnish the Auctioneer with a copy of his/her identity document and proof of residence (not older than 3 months). 29. Any person who purchases on behalf of a Principal (i.e. natural person) must furnish the Auctioneer with a written signed Power of Attorney, prior to the commencement of the auction, failing which he/she will be personally liable for payment of any purchases made by him/her. The person bidding on behalf of or signing any document on behalf of the purchaser pursuant to a successful bid hereby binds himself/herself personally as coprincipal debtor with the Buyer for payment of the purchase price and personally guarantees all the obligations of the Buyer under these Rules of Auction. This paragraph 29 specifically excludes where a Wildswinkel employee enters bids on behalf of a Buyer, who gives instructions telephonically or otherwise, and any and all Wildswinkel employees are hereby indemnified by a Buyer who gives instructions telephonically or otherwise on the Buyer’s behalf and the Wildswinkel’s employee who signs any document on behalf of a Buyer is indemnified by the Buyer and duly authorises the Wildswinkel employee to sign the vendu roll or any other document with regards to the purchase of a lot.

30. A person who attends the auction, to bid and to sign the bidder’s record, on behalf of another person (i.e. on behalf of a company or legal entity) must produce a signed letter of authority that expressly authorises him or her to bid or sign the bidder’s record on behalf of that person. Where a person is bidding on behalf of another entity the letter of authority must appear on the letterhead of the entity and must be accompanied by a certified copy of the resolution, if required, authorising him or her to bid on behalf of the entity. The person bidding on behalf of or signing any document on behalf of the Buyer pursuant to a successful bid hereby binds himself personally as co-principal debtor with the Buyer for payment of the purchase price and personally guarantees all the obligations of the Buyer under these Rules of Auction. 31. In the event where a Buyer allows another person to purchase on his or her Buyer’s number, the registered Buyer shall be liable for payment of such purchases. No bid by an unregistered Buyer will be accepted by the Auctioneer and the Buyer will have no claim to any of the goods allegedly purchased by him. 32. Until all amounts owing by the Buyer have been paid in full, the Buyer hereby: 32.1 irrevocably undertake to identify the purchased goods in such a manner that he can at any time identify and indicate the goods deemed to be the property of, and pledged to, the Auctioneer. 32.2 grants the Auctioneer at all reasonable times access to the premises where the goods are stored or kept for the purposes of perfecting its pledge and exercising any other rights in terms of these Rules of Auction. 33. The Owner / Seller, Buyer and Auctioneer herewith confirm that any action instituted by the Auctioneer against the Owner /

Seller and / or Buyer may be instituted in any competent Court. This agreement will be governed in accordance with the laws of the Republic of South Africa. 34. A certificate issued by a Manager of the Auctioneer, whose appointment and authority shall not be necessary to prove, shall be prima facie proof of the amount owing by the Buyer to the Owner / Seller or the Auctioneer. 35. Any indulgence granted by the Auctioneer to the Buyer or the Owner / Seller will not prejudice the rights of the Auctioneer in terms of these Rules of Auction and such indulgence will not constitute an amendment or waiver or novation of these Rules of Auction. 36. The entries made in the Auctioneer’s auction roll shall be prima facie evidence of the transaction and shall be binding on the Owner / Seller and the Buyer. 37. The bidder’s record and the vendor or vendu roll will be made available for inspection within reasonable time after the auction at the office of the Auctioneer during normal business hours free of charge. 38. All money will be paid into a trust account for the benefit of the Owner / Seller, minus the agreed commission and additional costs agreed upon by and between the Auctioneer and Owner / Seller. 39. Any goods entered or offered for sale are subject to payment by the Owner / Seller / Buyer of the agreed commission, or in absence of an agreement the usual commission by the Owner / Seller / Buyer to the Auctioneer at the rate customarily charged by the Auctioneer from time to time, whether the goods are sold at the auction or thereafter, or within 30 days thereafter by private treaty. Unless otherwise agreed in writing, commission

shall become due and payable by the Owner / Seller/ Buyer upon the fall of the hammer or upon the entering into of any private treaty involving the Owner / Seller’s said goods, whichever date is the earlier, and notwithstanding any breach on the part of the Owner / Seller / Buyer. 40. Every bid shall constitute an offer to purchase the property or goods for the amount bid, which the Owner / Seller or the Auctioneer may accept or reject in their absolute discretion. The Owner / Seller and Auctioneer are entitled, in their absolute discretion to withdraw the property or goods from the sale prior to acceptance by the Owner / Seller. 41. If no bid equals or exceeds the reserve price, if any, the property or goods may be withdrawn from the auction. 42. The Auctioneer accepts no liability for any withdrawal of goods from sale. 43. The Buyer will be responsible to obtain all permits, certificates and transport documents pertaining to the game purchased at the auction. The Buyer will be liable for the payment of the purchase price even if he is unsuccessful in obtaining the required permits, certificates or transport documents. As such it is specifically stated that no sale on the auction is subject to the Buyer’s successful application for any permit, certificate or transport document. 44. No bid may be withdrawn after the fall of the hammer until the expiry of the confirmation period (if any) that is provided for in the Conditions of Sale, during which time the offer shall be open for acceptance by the Owner / Seller or his agent and if the offer is accepted the sale shall be deemed to be a sale by auction for purposes of the Act.

45. In the event of the sale requiring the consent of any statutory authority or any court of law, then this auction will be subject to the granting of such consent.

49. Default by Buyer: Should the Buyer/Purchaser refuse or otherwise fail to pay the purchase price within 7 days of the due date, the Auctioneer shall be entitled to:

49.5 recover the Auctioneer’s legal costs calculated at the Attorney and own Client tariff as well as collection, tracing, storage and transport costs, and/or

46. The Buyer and the Owner / Seller do hereby consent to the payment of attorney and own client costs in the event of any legal action being instituted against them by the Auctioneer or Owner / Seller.

49.1 claim interest from the Buyer/Purchaser the prescribed mora interest rate calculated from the date of purchase to date of payment, and/or

49.6 retain in pledge any goods or other property in the possession of the Auctioneer belonging to either the Buyer / Purchaser or the Owner / Seller as security for the due fulfilment of any obligation owed to the relevant party or the Auctioneer.

47. Any agreement contrary to these Rules of Auction shall not be binding unless it is confirmed in writing and signed by a manager of the Auctioneer. 48. If any clause or term of these Rules of Auction should be invalid, unenforceable and illegal, then the remaining terms and provisions of these Rules of Auction shall be deemed to be severable therefrom and shall continue in full force and effect unless such invalidity, unenforceable or illegality goes to the root of these Rules of Auction.

49.2 repossess the goods to resell same at the risk of the defaulting Buyer/Purchaser who shall be liable for all costs in connection with the resale and any loss or damage incurred, and will not be entitled to any profit that may arise from the resale, and/or 49.3 institute legal proceedings for the payment of any amount owing or for the return of the goods in which event the provisions of clause 48.2 will apply; and/or 49.4 Claim specific performance and/or claim damages should the Buyer not make payment as and when it comes due; and/or

50. Any dispute between the parties will be governed by the South African legal system and legislation. 51. The Auctioneer reserves the right to amend these Rules of Auction in writing or by announcement at the auction. 52. By entering a bid any prospective Buyer binds himself or herself to these Rules of Auction, as well as any special conditions of sale set forth in the auction catalogue.

Special Rules of Auction 1. Wildswinkel’s standard Rules of Auction will apply to all lots, unless in contradiction with any of the terms set out in the Special Rules of Auction, in which case the provisions of the Special Rules of Auction will apply. 2. Transfer of risk: The transaction is finalised at the fall of the hammer, and any other conditions and/or terms not read out by the Auctioneer and stated additionally herein, shall not constitute a novation of transaction and are part of the auction rules, and are without prejudice of to the Seller’s rights. The Seller will have no liability for the health or well-being of any animal, and the Buyer indemnifies and holds the Seller harmless against any is suffered by the Buyer. 3. Animals in Boma’s and Catalogue animals 3.1 The sale with the Buyer is concluded at the fall of the hammer, however the Seller, subject to the paragraphs 4.1 and 5 below, will in the event of a mortality, replace any animal/s or provide a refund subject to the purchase price having been fully paid to date of safe step off at the premises of the Buyer, provided that the Buyer made use of the services of a reputable transporter. Should the Buyer fail to make use of a reputable transporter, all risk transfers on safe step on, unless where otherwise provided for. A refund includes only the purchase price and replacement an animal with the same or similar value as the purchase price paid, and excludes any other loss of whatsoever nature suffered by the Buyer. For the avoidance of doubt, aforesaid losses include, but are not limited to, aborted animals, loss of income, broken legs or horns. Safe step off at the Buyer’s designated suite constitutes complete delivery of the animal/s to the Buyer. 3.2 The above paragraph 3.1 will not apply to any rhino presented on the auction and the Owner/Seller’s obligations in respect of such lots will cease upon safe step on. 4. Transport and delivery In the event where a Buyer purchases a lot (excluding rhinos) for R 200 000.00 or more is delivery included in the bidding price, provided that the delivery address is within the borders of the

All other animals will be delivered at the Buyer’s cost. 4.1 A designated representative of the Kriek Wildlife will control and manage the loading of the Buyer’s purchased animal/s where such animals was purchased from Kriek Wildlife. Guest sellers and Buyers are advised to have representation at the loading of any animals. 4.3 The Buyer, or its representative, entering the pens do so at their own risk, and in all instances, indemnifies and hold the Seller, Mattanu Private Game Reserve, Kriek Wildlife and the Auctioneer harmless for any claim for damages suffered for any injury or death. 4.4 To enable delivery and transport, the Buyer must furnish Kriek Wildlife’s designated contractor with proper directions, maps and all relevant authorisations to facilitate delivery. 4.5 Delivery will take place as soon as reasonably possible and subject to full payment for the purchase price having been received. 4.6 Kriek Wildlife requests all Buyers and Owner/Sellers that it be informed before delivery of any animal is taken by a Buyer. 5. Boma fees 5.1 The Seller will absorb the boma fees for animals in pens for 5 days after the auction date. Once the 5 day period has expired, the boma fees becomes payable by the Buyer to the Seller, on demand, at the following rates: a. Buffalo @ R200 per animal per day; b. All other animals @ R50 per animal per day. 5.2 Boma fees do not include any veterinarian services nor does it establish a duty of care of any animal. 5.3 The Seller does not guarantee the security of any animal and the Seller, Mattanu Private Game Reserve, Kriek Wildlife and the Auctioneer is indemnified and held harmless for any liability and/or damages suffered while in the boma, including loss, injury or damage to any animal as contemplated.

6. Timed Auction: 6.1 No goods sold by auction will be subject to a reserve price, however, goods presented for auction on the ‘Timed Auction,’ will have a minimum starting price. 6.2 In respect of lots auctioned on the timed auction, the following additional terms and conditions will apply: a. Subject to paragraph 6(b) below, lots on the timed auction will close as per the specified date and time per lot as advertised on the online bidding platform. The closing of lots may be staggered. b. A lot will not close if a bid is received on the lot within a period of 2 minutes before the closing time as published. In this event, the closing time on the lot will automatically be extended for a further period of 2 minutes. The lot will only close if a final bid on the lot stands alone for a period of 2 minutes. c. The “fall of the hammer“ on a lot for the purposes of the timed auction is defined as the date and closing time published on the online bidding platform and/or the Seller’s/Auctioneer’s public websites, alternatively at the date and time a final bid on a lot stands alone for a period of 2 minutes, whichever occurs last. d. All lots on sale on the timed auction will have a minimum starting bid price which will be indicated on the online bidding platform. Any bid at or above the minimum starting bid price will be successful. e. The minimum bidding increment may vary per lot but is specified on the online bidding platform. f. Once a bid is made it cannot be withdrawn. g. Neither the Auctioneer, the Sellers’ or the Auctioneer’s representatives will be liable for any failure in connectivity or software while using the online bidding platform. h. Neither the Auctioneer, the Sellers or the Auctioneer or Sellers’ representatives will be liable for software failure of any nature.
