PRESIDENT’S MESSAGE Goodbye 2020, Hello 2021!

It is hard to believe that 2020 is coming to an end and certainly, many people will be glad to ring in 2021. After what can only be characterized as a very demanding year, I propose that instead of focusing on the trials of 2020, that we celebrate what good has come during this year and look forward to growth in the coming year! There is hope on the horizon! As of press time, not only has a vaccine for Covid-19 been developed at a record pace but vaccines have arrived in Knoxville and will continue to be dispersed in the coming months. The KAM leadership is committed to assisting our members by providing current information about vaccine distribution plans and helping those physicians who are not hospital-based find resources to immunize not only themselves but their critical staff. Additionally, please know that your Knoxville Academy of Medicine stands ready to support the membership in any way possible during the coming months. We continue to offer counseling services in conjunction with the Tennessee Medical Foundation and to provide completely anonymous resources to help members during these emotionally trying times. If you are experiencing burnout, let me encourage you to visit https://etmf.org/tnpsq/ for access to free, voluntary services. Furthermore, we remain hopefully optimistic that we will be able to host our Vitality Initiative Project, the KAM VIP Conference, with Dr. Wayne Sotile on May 7-8, 2021. We were so excited to host an event of this magnitude and unfortunately had to postpone it several times due to the pandemic. However, everything happens for a reason and given the events of 2020, I believe that even more physicians will receive value from this experience in 2021! While some may remember 2020 as a year of division, I would like to pay tribute to the medical community who came together in unity and faced head-on what is likely to be the worst

pandemic during our lifetime. KAM physicians have been on the front lines of battling this disease. They have played a pivotal part in advising our elected officials on the best course of action towards the mitigation of this virus in our communities. Thank you to those colleagues who continue to serve affected patients and those who have promoted best practices to the public to slow the spread of Covid-19. As we near 2021, let’s focus on continuing to build on the unity that we, as physicians, have developed in 2020. Even in the year of Covid, KAM saw an unprecedented growth among our membership adding almost 100 new dues paying members to its ranks. In an effort to further expand our membership, the KAM and TMA are offering special new member discounts for 2021. Physicians who have never been members of the Knoxville Academy of Medicine can now join at a 75% savings for the first year, followed by additional discounts of 50% during their second year and 25% discount during their third year. Please encourage your colleagues who are not members to take advantage of this exceptional offer! ACADEMY NEWS KAPA Update

By: Danielle Sims 2020 has been hard to say the least. Many of our KAPA patients, like many in the community, have lost jobs and are uncertain about how they will be able to afford their daily necessities. Our healthcare providers are working day in and out to take care of those in the community who have become ill. With all the uncertainties, our KAPA program has remained constant. Our KAPA staff has continued to assist the uninsured in our area but we are most thankful for those physicians and physician-extenders who remain dedicated KAPA volunteers. Even in the midst of a pandemic, KAPA physicians still find the time to care for the underserved in our community. We are forever grateful for their kindness and generosity. The below is a note from one of our patients which perfectly articulates how blessed we are to have a provider network committed to helping those who are underserved in our community.

“I wanted to reach out to you all and personally thank your organization and staff for helping me find the critical care I so desperately needed during these difficult times in my life! The passion and caring you display to your patients is clearly evident and sometimes I think people forget to say ‘Thank You!’ My surgery went very well and because of your help, I am on the way to a full recovery. By: Carolyn Cates, KAMA President As we all have prepared for the holidays, KAMA’s Community Health Promotions committee chaired by Juliann Chavez made the holidays a little more special for school children and their families at New Hopewell Elementary School. KAMA members contributed to Thanksgiving baskets and Blessing boxes, which supported both the teachers and students with needed gift items. In addition to the holidays, KAMA members deliver food packages to virtual students at New Hopewell throughout the year. KAMA once again delivered our Holiday Sharing Card. KAMA initiated our Holiday Sharing Card in 2016 to benefit the KAMA medical and nursing scholarship endowments. KAMA recognized our donors in the Holiday greeting card mailed to the local medical community. At our November meeting, Captain Dan Nelson and Major Sarah Nelson enlightened our KAMA members. Their presentation gave an overview of The Salvation Army of Knoxville, and volunteer opportunities with Angel Tree Knoxville and Red Kettle Bell Ringing themed

Rescue Christmas. KAMA member Tina Callicutt serves on the board of The Salvation Army in Knoxville. An exciting virtual cooking class led by our own KAMA member, Chef “Tom” Arpakon Walker, was a fun event for our December 3rd, 2020 meeting. She presented a couple of dishes for each member to prepare or to follow along. Chef Walker is the owner/baker at Rice Catering and Personal Chef. With the approaching of the new year, our membership drive will begin in January. COVID-19 Moving Into 2021: A Healthcare Lawyer’s View By Ian P. Hennessey

2020. There’s no simple way to adequately sum up this past year – from a legal, medical, or humanitarian standpoint. As this article goes to print, the first Pfizer vaccines have been delivered to UT Medical Center and administered to frontline healthcare workers, with still more vaccines promised over the coming weeks. At the same time, Tennessee has emerged as a “hot spot” for COVID-19, both nationally and perhaps even globally. As the calendar moves to 2021, however, it is worth reviewing some of the key developments in healthcare law and to look forward to what may lie ahead in the coming year at both the national and state level. • Federal Relief Programs – In response to the thenemerging threat of the global COVID-19 pandemic, the federal government passed a series of relief packages for ailing businesses, including the healthcare sector. Relief programs such as FFCRA, the Paycheck Protection Program, and the HHS Provider Relief Funds provided a combination of forgivable loans, direct funding, and payroll tax credits. Each of these packages delivered significant aid to hospitals and medical practices, despite their often cumbersome and frequently changing regulations and other “strings attached.” One other thing that these various relief programs shared in common, however, was the underlying assumption that the COVID-19 pandemic would subside within a few months and, in any event, no later than December 31, 2020. Unfortunately, this has not come to pass. As this article goes to print, Congress is negotiating another round of stimulus. Beginning on January 20, 2021, a new administration will take on the responsibility of fighting the pandemic and is likely to adopt some different approaches. Bottom line: do not be surprised to see extensions of the current relief programs and perhaps the establishment of new relief programs as we head into 2021. • Telemedicine – In the early days of the pandemic, changes to telemedicine rules were widely seen as temporary measures to help providers and patients. In March, CMS broadened access to Medicare telehealth services to allow Medicare beneficiaries to receive services from their physicians without having to travel to a healthcare facility. In a related change, the HHS Office for Civil Rights (OCR) waived applicable HIPAA prohibitions to allow health care providers to serve patients in good faith through everyday communications technologies, such as FaceTime or Skype. As the pandemic continued and showed lit-

tle sign of easing, there was increasing momentum toward making these temporary changes more permanent. In May, the FTC wrote a 19-page letter urging CMS to continue expansion of telehealth after the pandemic subsides, including supervision requirements under Medicare’s “Incident To” billing rules. In late June, CMS issued a proposed rule to make certain temporary, COVID-19 related changes to the use of telehealth in home health services permanent beginning January 1, 2021. At the state level, the Tennessee General Assembly passed new telehealth legislation during its special legislative session which expanded both telehealth flexibility and payment parity for Tennessee providers and patients. As 2020 comes to a close, it looks increasingly likely that telemedicine is here to stay as part of a “new normal.” If that is the case, it will be interesting to see whether OCR will maintain its “loosened” guidelines for telemedicine technology security or return to a stricter standard. • Independent Practice – Over the past few years, there has been a strong legislative push led by the Tennessee Nurses Association to allow independent practice for advanced practice registered nurses and remove the requirement of physician oversight. Proposed legislation was defeated in committee during the 2020 legislative session. In the early days of the pandemic, however, Governor Bill Lee issued an executive order temporarily permitting advanced practice registered nurses and physician assistants to practice without the requirement of filing a notice and formulary, having charts reviewed, or having remote sites visited by collaborating physicians every thirty days. Although this measure expired on May 18, 2020, it will not be surprising to see it used to validate and support independent practice in the next legislative session.
