ABOUT DAVID REID David Reid is the Chief Executive of Birtenshaw, a company that provides a unique range of services for children and young adults with special educational needs and disability. Birtenshaw operates as a social enterprise – while they are a profit-making organisation, the majority of their profit is reinvested for growth.

Although the organisation was founded in 1956, it was technically bankrupt when David became CEO in 2006. When he took over, it had a maximum of 6 months left of life. If he had not made difficult decisions to restructure the business, changing contracts and the way that they sold their services the company would have folded. After six years of hard work, the business started to turn around and since 2012 has seen growth of circa 400%

My proudest moments at Birtenshaw in recent years. I am absolutely delighted about a number of things that our company has achieved, and the difference we have made in the lives of so many young people. I am delighted to be the person in a privileged position where I am able to employ so many incredible people, who can in turn help hundreds of children with special education needs and disability.

I am happiest about the recent opening of a brandnew special needs school in Liverpool which is a partnership arrangement with the City of Liverpool Council: the only partnership of this type in the UK. Although the school is at the start of its second year it has reached targets predicated for year 5. We’re pleased to be able to support so many families across the Liverpool City Region, however this also demonstrates how great the need is for our services. We plan further developments across Merseyside in the near future.

A significant number of staff across the organisation have won various awards, such as education staff, care and support staff. All have taken on the task of contributing to the success of the company and, as a result, have been rewarded for their work, some of which has been on a national level. It’s wonderful that they have got this level of recognition for their dedication and hard work.

My main objective for Birtenshaw To continue transforming the lives of hundreds, if not thousands of young people, and to meet the demand for the current supply of quality services. Please outline the scope of trademark law in your jurisdiction. How does the legislation differ to that of neighbouring jurisdictions? Trademarks Law is fully harmonized with current laws of other EU countries. It will be amended until 2019 according to the Harmonization Directive.

Please outline the work your firm does and the ways in which you distinguish yourself from your peer firms in the provision of trademark law advice. Perhaps provide a recent case study demonstrating your expertise. Our competitive edge stems from quality of the services. This is acquired by combining elements such as: pro-active approach whenever possible; high level of attention given to each case (customized advice); work in a team for complex cases. For clients with portfolios where we are asked to provide advice as to the new rights, we make complex analysis of the possibilities in connection with Client’s commercial interests and budget.

Recent example:

We acted on behalf of the opponent CROCO SRL, who filed an opposition on the date of 17 December 2016 against some of the goods of European Union trade mark application No 013 200 266 MISS CROCO, namely against all the goods in Class 30 based on earlier trademarks CROCO widely used in many EU countries, where the opponent also acquired reputation. The decision of the opposition division was in favour of the opponent, considering that there is likelihood of confustion including risk of association with earlier marks.

Intellectual property is one of a company’s main assets. How conscious are companies about safeguarding their trademarks in your jurisdiction? To what extent do approaches to trademark protection vary across different industries? Romanian branches of international companies (e.g. GSK, SIEMENS) have little work in this area, as IP is mainly dealt by the mother company, usually limited to detect cases of infringement.

Companies with Romanian capital act in a different manner. Some of them, the oldest and the larges, are conscious about the need to protect IP, whereas new and usually smaller ones, sometimes ignore completely the need to protect until one day they are sued for infringement.

IP/trademark crime is a serious problem that needs to be dealt with effectively. What is the scale of the problem in your jurisdiction, and what actions have been taken to tackle it? Difficult to estimate the scale of trademark crime in the

absence of complete information. One thing is for sure: customs authorities are very active and destruction of infringing goods functions well. What extra complexities are involved in establishing and enforcing IP and trademark rights on a cross-border scale? What can your firm do to assist in overcoming these challenges? Cross-border enforcing is difficult particularly when one of the countries is outside EU. So far we worked only in cooperation with similar IP firms from EU countries in some cross-border cases, with no particular difficulties.

Are there any new pieces of legislation / updates / new trends, in relation to trademark law in your jurisdiction, on the horizon? How might these affect your work in these areas? Trademarks Law must be amended to comply with the new Harmonization Directive. On this occasion many other issues need to be addressed. In my capacity of President of Romanian Chamber of Patent Attorneys I am fully involved in the process of amending the law by leading a working group of the attorneys and doing our best to work together with the Patent Office (the institution in charge with the draft of amendments).

Does your firm’s expertise give you a distinct advantage when working on an international playing field? Yes, our firm is known for two decades for its quality, and myself as well. I am particularly known in Europe.

What are your objectives for the coming 12 months? For instance, do you have any plans to expand or implement any changes in the ways in which you work in order to better serve your clients? Recently we noted a rise of interest of our local Clients in protecting their trademarks abroad, including new litigation cases in other jurisdictions. Therefore the objective is to create more value from services associated with trademark protection in other jurisdictions, be it directly (EUIPO, WIPO) or through other IP counsels if protection or enforcement is needed at local level.

We are a unique niche provider of Forensic Services in the UK, undertaking a limited number of highly specialist cases each year (circa 25), devoting the time needed to fully investigate each case, and including as thorough as possible analysis, consideration, and integration of both the forensic and also the circumstantial evidence.

We take an intense pride, during such a time of uncertainty in the adequate provision of forensic services in the UK, in ensuring that all aspects of each case are fully investigated; even if this requires us to carry out additional pro bono investigations when private or public funds are unable to fully meet the demands of such a painstaking approach (not infrequently 100 hours of requested work having to be “written off” due to the LAA or private individuals simply not being able to provide finance).

Our ability to lead in the interpretation of forensic evidence (continuously innovating and introducing new and highly effective avenues of approach, analysis, and investigation) is especially appreciated by Defence Lawyers and Barristers, Insurance Companies, Prominent International Businesses, and also Private Individuals; who are otherwise faced with the alternative access to only the briefest consideration of their cases by the cheapest, poorly qualified, alternatives.

As a result of this varied experience we operate highly effectively in the fields of explosives (all areas), toxicology (including Insulin, Ricin, thallium, and CW agents), drugs (chemistry, synthesis, purity), DNA, firearms residues, sexual offences, (significance of traces), and a wide range of other applications in forensic chemistry (laboratories, counterfeits etc).

Our approaches, not infrequently, result in even the most experienced, opposition experts having to concur with the defence opinion, due to the presentation of the most up to date research results, (some of which may just have been published only days before the completion of the defence report, as in a firearms residue case in 2018) (presence of tin in shotgun residue)) and also the avoidance of the use of subjective opinion.

The sheer amount of time that we can devote to each case is often the game changer in many cases, and not infrequently allows us to prevail, due simply to our ability to detect and observe facets of evidence that have simply been overlooked (eg intensive inspection of training videos, augmented by our expertise in recognising the critical technical details, eg in a case involving preparation of ricin).

Multi-Disciplinary Forensic Experience is also one of the mainstays of our expertise, and arises as a result of having pioneered and introduced the basis of the analytical techniques and quality control methods still used worldwide in a variety of forensic areas.
