T

he Brihanmumbai Municipal Corporation (BMC) suffers a loss of Rs.50 crore every year due to the number of cases pending with its legal department. This fact emerged during the standing committee meeting held last week, when the civic law department informed the members about the status of its pending cases, numbering around 75,000. The cases pertain to various civic issues in the city and most are those that the civic body has filed in the Metropolitan Magistrate Courts. If statistics are to be believed, after the state government, the BMC has the second highest number of litigations against it in courts. A total of 74,100 cases are pending in various courts in the city, of which 37,000 are pending

in the Magistrate Courts. 13,000 are pending in the Sessions Court and 9,000 litigations are still pending in the Bombay High Court, including cases on property tax, illegal construction and property related issues. These also include public interest litigations (PIL) filed by citizens in which the civic body is a party. Around 2,248 cases are pending in the Labour Court, while 5,316 cases are pending in the Civil and Sessions Court (Sub-

urbs). The industrial court has 270 matters yet to be disposed. According to sources, most of the cases were disposed against the BMC, causing a loss of Rs. 50 crore to the civic exchequer. “This is because the civic body has to pay for the legal fees and other legal expenses. Sometimes, the court disposes the matter with a heavy fine. Also, the legal department is grossly understaffed and each lawyer attends to over 10 -15 cases a day,” sources said.

NSEL has been facing problems in settling Rs 5,600 crore dues of 148 members/brokers, representing 13,000 investor-clients, after it suspended trade on July 31 on government's direction. Last week, Mumbai police had arrested two persons in connection with the scam. On October 9, police arrested Amit Mukherjee, assistant vicepresident of the exchange and next day arrested Jay Bahukhundi, a former assistant vice-president and incharge of know your customer (KYC) department that is tasked with verification of borrowing companies and investors etc at NSEL.

So low?

EVEN for India, and we say this in a considered fashion, this is low. We refer to the story appearing in at least one newspaper that says policemen on the bridge leading to the temple in Datia district actually picked up dead and seriously injured people and threw them off the bridge. A 55-year-old woman is quoted as saying so and she even puts a figure to the number she saw being tossed over the side into the river below – 25. Then a 15-year-old boy says his little brother who died was wrenched out of his arms and thrown over. Then the policemen threw him over too, saying now that his brother was dead, there was no reason for him to live. Even by Bollywood standards of good and evil, this is pretty black. These are absolute horror stories, the kind that paint policemen in states like MP, UP, Bihar and West Bengal as pure personifications of evil. If we are to believe the sources for this story, the policemen were also rifling through the dead pilgrims clothes before throwing them over. And yet, we’ll offer odds on there being real follow-ups to this part of the stampede story. After giving us such a horrendous view of the forces of law and order, there will be no follow-up of the details that would make it easy to believe the policemen started it all. Heck, in that case we are willing to believe that they planned the whole thing in the first place! Most sobering of all is that these stories are so easily passed around, probably because they are so believable!

and that too in considerable state. What do we like about him? The fact that he was once a journalist and tends to understand the constraints under which we work. The fact that he seems unaffected by the fact that he occupies Mumbai’s most prime piece of real estate, much more prime, say, than Antilla, where the richest man in India lives. We like the fact that one-on-one, he can get almost chatty, and that he always has time for young people.

We like his practicality and his simplicity and that he talks of his home state, Kerala, with so much affection. So, today being his 82nd birthday, it gives us great pleasure to say “Happy Birthday” to him. And may he have a great one!

WE sympathise with the world’s greatest batsman who is wondering what he will do now. “Cricket has been my life”, he says simply, and to tell the truth, we are wondering too. Pakistan to promote peace between the two counties. (We doubt even he would make a difference). As both Australia and England admire him, he can be our High Commissioner to either UK or Australia. He can be made the BCCI President to end the current impasse. (Sorry, we cannot see this happening!) As the ICC Chief, he will ensure justice and fairness hitherto conspicuously missing when Indian or Asian cricketers are involved. He can become a UN envoy promoting children’s interest around the world. As the CEO of IPL 7 he will work for a scandal-free tournament and take it to greater heights. (We can hope. Some things are even bigger than Sachin). Like Steve Waugh promoting Australian tourism, Sachin can promote Indian tourism by being a Brand Ambassador for India’s tourism. Like Saurav Ganguly and Sanjay Manjrekar, Sachin can become a cricket commentator. (Honestly, this is a bit farfetched. Sachin is a “byte man” not a commentary man or a speeches man. Like Srinivas Venkataraghavan, he can become an umpire and officiate in ICC matches. (And that would be a come-down for the man regularly referred to by us as “God”). He can be selected as a permanent coach for the Indian Cricket Team. (Ditto) He can be made our Sports

A

delegation of residents from the beleagured Campa Cola compound in Worli met Chief Minister Prithviraj Chavan on Monday morning, hoping he would intervene and save their homes. They were accompanied by Anil Desai, the Rajya Sabha member of the Shiv Sena and Mangal Prabhat Lodha, MLA of the BJP. After silently listening to the delegation, Chavan assured them that he would seek legal opinion on the Supreme Court’s order to demolish the illegal floors of their buildings. He said he would take a decision only after consulting legal experts. Though the CM was noncommittal during the meeting, the residents see a ray of hope. Over 200 of them, dressed in black and holding placards demanding justice, had gathered yesterday morning near the Hanging Garden at Malabar Hill. They then marched towards the Chief Minister’s official residence, Varsha, but were stopped by the police as they were shouting slogans in a prohibited area. Speaking to ADC, Desai said, “The CM should consider sparing the homes of Campa Cola compound residents from the BMC’s hammers on humanitarian grounds. They are middleclass people. he Maharashtra government on Monday informed the Bombay High Court that it had moved the bench headed by Chief Justice to club two civil petitions with a similar criminal PIL challenging illegal multiple or double allotment of flats from Chief Minister's discretionary quota. The petitioner, Ketan Tirodkar, opposed the clubbing of his criminal PIL with the two civil petitions pending before the High Court, reports PTI. However, Justices P V Hardas and P N Deshmukh, who are hearing criminal PIL of Tirodkar, said their bench would wait for the decision of another bench in regard to clubbing of two civil petitions. Accordingly, they posted the matter for

hearing on October 23. Earlier, the court had directed the state to furnish a list of those who have been allotted houses from Chief Minister's discretionary quota for more than once or to other members of their family. The government has not yet furnished the list but informed yesterday that it had moved another bench for clubbing civil and criminal matters on the same issue. The petitioner alleged that there were several cases where a second allotment was made to the same allottee or to the allottees' spouses or their family members. The PIL alleged that politicians and journalists were main beneficiaries of such allotments and that

"resourceful" people were allotted flats at concessional rates from the Chief Minister's discretionary quota while the needy and common people are ignored. Tirodkar gave examples of journalist couples who had been allotted adjacent flats and also cited names of some politicians and their kin who were allotted flats from the CM's quota. The petitioner had annexed to the public interest litigation (PIL) a reply received under the Right To Information (RTI) Act, which he received from the Maharashtra state government which included names of allottees from 1989 to 2010. However, it did not contain names of double or multiple allottees.

n elderly couple, with hands tied and ropes wound around their neck, and their 30-yearold son, were found dead under mysterious circumstances at their Kalyan residence late on Sunday evening. However, the police strongly suspect that the son murdered his parents before taking his own life. It is revealed that the son sent frantic text messages to his friends about the house being attacked by robbers, and this information was relayed to the police control room. Subhash Ambadas Wankhede (65), his wife Pramodini (55) and son Dnyaneshwar, lived in their 1 BHK flat on the third floor of Mayuresh Apartments on the Agra Road at Kalyan (West). According to the police, Dnyaneshwar, a lab technician with the IIT Powai, first sent around 10 messages to his friends asking for immediate help saying robbers had entered the house and were assaulting him, at around 8:15 pm. he driver of an Indica Vista who gave a lift to three unidentified men near Hotel Fountain on the Mumbai-Ahmedabad National Highway on Sunday, was not only robbed him of his valuables, but also of his vehicle. According to the police, the driver, Pappu Saroj (23) was returning home to Silvasa after dropping some guests of his employer in Andheri on Sunday night, when three unidentified men stopped the car asking for a lift upto Bhilad, near Vapi, at about 8 pm. An unsuspecting Saroj took them in his car, and had driven for about five kilometres, when one of the accused whipped out a weapon and forced him to stop the car near an isolated area near Virar. The trio then assaulted Saroj and robbed him of his mobile phone and cash. They tied up his hands and legs and tore off his clothes. Later, the miscreants pushed him out of the vehicle and sped away. wo weeks after the Bombay High Court asked former Miss World Yukta Mookhey and her estranged husband Prince Tuli to attempt to find a way to resolve their disputes, the couple informed the court through their lawyers that an amicable settlement to the matrimonial dispute was not possible between them. In the last hearing, Justice Sadhna Jadhav of the Bombay High Court had met Mookhey and Nagpur-based businessman Tuli separately in her chamber and had later held discussions with their lawyers. Justice Jadhav had then asked both sides to sit and attempt to reconcile the differences. The HC initiative came on an anticipatory bail application filed by Tuli, seeking protection from arrest in a criminal case lodged by Mookhey. In July, Mookhey had lodged an FIR accusing Tuli of unnatural sex and had alleged that Tuli and her in-laws had subjected her to cruelty and a criminal breach of trust. The trial court had initially remarked that no case of harassment and cruelty under Section 498-A of the IPC had been made out. However, the HC did not agree to the view and said that the trial judge did not seem to have considered the 15 non-cognizable offences, proceedings under the Domestic Violence Act and two other complaints filed by Mookhey. Subsequently, on August 31, a trial court granted anticipa-

he Maharashtra government has floated a primary website to invite suggestions from the general public on its proposed memorial for Chhatrapati Shivaji Maharaj off the coast of Girgaum Chowpatty. Speaking to newspersons here yesterday additional chief secretary, general administration department, Dr P.S. Meena stated that at present sketchy details of the location of the site and outline of the memorial have been put up. Giving further details of the proposed memorial, he said that the site is located on a basalt rocky out crop of elliptical or egg shape place having approximate size of 650 meters by 325 meters at lowest tide level. This out crop measures about 15.96 hectares and is surrounded by additional 17.67 hectares shallow Bank all around. This rocky out crop is situated about 1.2 km SouthSouth West of Raj Bhavan, 3.6 km in South-West direction form H2O Jetty at Girgaum and 2.6 km from West of Nariman Point, he added Dr Meena disclosed that a state of the art museum is proposed to be built at the site of the monument containing some of artifacts used by Chhatrapati Shivaji Maharaj and extracts of his inspirational writings. It is proposed to have an amphitheatre and auditoria of various sizes as per requirement with back stage facilities. It is proposed to have an exhibition gallery in which life panorama of Chhatrapti Shivaji Maharaj will be displayed by artistic murals. This proposal will have marine aquarium, water adventure sports with sound and light shows. t was the seething rage of the frustrated young Shiv Sainiks that forced senior Shiv Sena leader Manohar Joshi to make an unceremonious exit from Sunday’s annual Dussehra rally at Shivaji Park, Dadar. It is not him alone who had to face the wrath of the party cadres, not to speak of the electorate which is rooting for new faces. That is not without any reason as the latest data of age composition and percentage of voter population in the state points that nearly 28.10 per cent out of the total 64.77 per cent of electorate across various age groups ranges from 18 years to 80 plus years. As per the Election Commission of India (ECI) data, out of the total voter population of 7.62 crores (64.77 per cent) in the state, the voter population between the age group of 18 to 39 accounts for 3.30 lakhs (28.10 per cent). As per the data, the voter population in the age group of 18-19 years accounts for 8.77 lakhs (0.75 per cent), between 20-29 years accounts for

1.18 crores (10.09 per cent) and between 30-39 years accounts for 2.03 crores (17.26 per cent). The rest of the voter population’s age group is as follows: 40-49 years (14.72 per cent), 50-59 years (10.03 per cent), 60-69 years (6.8 per cent), 70-79 years (3.76 per cent) and 80 plus years (1.99 per cent). It was not that Joshi (75 years) was seeking re-election for the first time, after having been defeated in the 2004 Lok Sabha polls, he was nominated to the Rajya Sabha in 2006. Before that he was MLC between 1972 and 1989 and was the Lok Sabha Speaker between 2002 and 2004. The same holds true for senior BJP leader Ram Naik (79 years) who recently announced that he would not contest Lok Sabha elections anymore. Naik too for close to four decades between 1978 and 2004 had been an MLA and MP. Another veteran politician who is still active is Congress MP from Rajasthan and union minister for Labour, Sis Ram Ola (86 years). While veteran BJP leader L.K. Advani (85 years old) has been in active electoral politics since 1962.

n an order that would bring cheer to environmentalists and birdlovers, the Bombay High Court yesterday asked the government to ban construction on all wetlands in Maharashtra which figure in the map prepared by the Central government. The division bench headed by Justice V.M. Kanade directed the Urban Development Department's secretary to issue a necessary circular and ensure that civic bodies stop ongoing construction on wetlands. The court also directed the Forests and Environment Department to inform whether the state government would accept the wetland atlas map of the Centre, or if would prepare its own map. In the latter case, the state should come up with its map within a certain timeframe, the judges said, ad-

Indian Scientific Research Organisation (ISRO) has carried out a mapping of wetlands across the country, but this map has not been recognised by Maharashtra government, nor has it prepared its own map, the petition says.

Temple tragedy in Madhya Pradesh W

HAT happened on the bridge which leads to the temple in Madhya Pradesh was a tragedy which could have been avoided. It is not the chief minister of Madhya Pradesh but the local authorities who are responsible for the stampede that occurred there. It is their failure to regulate the movement of pilgrims on the bridge. An arrangement in this regard should have been put in place. This was not the first time a stampede occurred on the bridge: Seven years ago a stampede occurred there and some 50 persons lost their lives. Evidently no lesson was learnt and no arrangement was made to regulate the movement of pilgrims. What was a horrible happening on the bridge was the lathi charge by the police on the pilgrims who were desperately trying to escape. It is clear the police had a big hand in making things worse on the bridge. A judicial inquiry has been ordered by the chief minister and this will establish the role played by the police. It is unfortunate that the incident is being politicised by the Congress party. An election will take place in Madhya Pradesh next month and the Congress has gleefully seized the opportunity to target the chief minister. The party is clearly exploiting the tragic situation and including it in its poll campaign. It has already demanded the resignation of the chief minister. Lakhs of pilgrims visit several important places of worship across the country every year. It is important that necessary safety arrangements must be made in them. The temples themselves must be involved – along with the concerned local authorities – in ensuring that the pilgrims go back with their body and soul intact.

PPARENTLY, Congress president Sonia Gandhi, who okayed the creation of Telangana for formal decision by the cabinet, did not anticipate the angry reaction of the rest of Andhra, called Seemandhra. When there is a blackout, no water supply, no transport, no fuel and powerless mobiles, the mood in Seemandhra is that of now or never. The centre could have gauged the sentiment by proceeding with what the constitution says. It is laid down that the state assembly should be consulted. True, in the house of 294, Seemandhra’s 179 members would have stalled a resolution on the creation of Telangana. But then the constitution says that there should be consultation, not concurrence. The exercise would have enabled to foresee the extent of aggressiveness which even intelligence agencies failed to report. Probably, the anger in Telangana was no less when it was up in arms. Yet the centre had resisted the state’s bifurcation although the agitation was at its fieriest during the days of Chenna Reddy, once the state’s chief minister. Then the Congress president, K. Kamaraj, from the South had his ears to the ground. Sonia Gandhi, sitting in New Delhi, is not familiar with the ground realities of the state.

Kiran Kumar Reddy has not resigned even when he is for a united Andhra Pradesh. Had he resigned it would have come as a jolt to the Congress high command and probably things would have taken a different turn. Indeed, the Congress has in mind the next elections where it expects to sweep Telangana. It is tragic that politics has held its sway over the interest of the people of Andhra Pradesh. Its bifurcation would create problems for both the states like water disputes because River Krishna flows into both the proposed states. It is still not late to annul the decision. Probably, the services of Congress-vicepresident Rahul Gandhi would have to be harnessed. If he could undo the ordinance to

Was it necessary to divide Andhra Pradesh? This was the first linguistic state. The States’ Reorganization Commission that followed the creation of Andhra Pradesh recommended the creation of Telangana. Yet the centre stuck to a united Andhra Pradesh in the larger interest. The Telugus enthusiastically welcomed the creation of Andhra Pradesh because the Telugu-speaking areas were retrieved from the Madras Presidency and amalgamated with Andhra Pradesh. The question that remains unanswered is why so much hostility has come to surface when Telangana is constituted. After all, it is going to be part of India. Ambitious politicians are responsible for cultivating hostility. There can be fear that Telangana is more or less the old state of Nizam where razakars (armed men) were ruling the roost. But the state is strong enough to curb such a tendency. Also the Nizams encouraged razakars and dreamt of joining Pakistan. Politicians eye the loaves of office that a new state would create. That greed may be the reason why state chief minister

HERE is a seed of anger in every one of us. In Buddhist psychology, this bit of consciousness is in terms of seeds, like a seed of corn. There are many kinds of seeds that lie deep in our consciousness, a seed of anger, a seed of violence, a seed of fear, a seed of jealousy, a seed of full despair, a seed of miscommunication, a seed of hate. They’re all there and, when they sleep, we are okay. But if someone comes and waters these seeds, they will manifest into energy and they will make us suffer. We also have wholesome seeds in us, namely the seeds of understanding, of awakening, of compassion, of nonviolence, of nondiscrimination, a seed of joy and forgiveness. They are also there. If you don’t practice, if you do not live in a good environment, then these wholesome seeds will have no chance to be watered. That is why it is very important to select a right environment to where the wholesome seeds in us could be watered every day, a kind of environment where the negative

The state governments are helpless when the centre announces Telangana without bothering about repercussions. It is not understandable why New Delhi has created another problem when it is already reeling under deteriorating economic conditions on the one hand and uneasy burdens with China and Pakistan on the other. Maybe, the announcement of Telangana is meant to divert attention from other pressing problems the country is facing today. This is perhaps the Congress way of tackling them. The government has done well in resisting the demand for the appointment of another States Reorganization Commission. It would have opened Pandora’s Box. I recall the passions aroused when the commission was appointed. There were so many claims which were equally conflicting that it was difficult to arrive at any decision which ultimately the commission made. The commission made two points as back as in 1985 when it submitted its report. Both points are as truer today as they were then. One, whether the states are reorganized or not they will continue to be an integral part of the Union which is the real political entity and the basis of our nationhood. Two, the constitution recognises only one citizenship for the entire people of India, with equal rights and opportunities throughout the union. The proposed state of Telangana is, no doubt, a wrong decision. Yet the 28th state, if constituted, will keep in mind that the citizenship is one, with equal rights.

Sachin touched the landmark of 99 centuries in March 2011 and took a long time to complete his 100th hundred. It is indeed an ordeal for his fans and Tendulkar himself. We need not wait for a long time to achieve landmarks if they are not easily achievable. In case of Rahul Dravid, the stumps were flying all the time and the wall had cracks. In case of Laxman, Australia was not Calcutta. Ganguly quit due to a lack of physical fitness and could not be cordial with the team coach. With pitches turning square and umpires helping out the cause of the home team, we scored double hundreds and saved matches from the jaws of defeat. With neutral umpires in action and the ICC to monitor wickets, the writing is on the wall for the likes of Tendulkar. With retirement, the merry-go-round for seniors is as good as over.

I AM shocked to read about the death of 150 pilgrims including women and children and the fact that more than 200 were injured in the stampede on a bridge leading to the historic Ratangarh temple at a celebration of Dassera in Datia, Madhya Pradesh. But, why doesn’t it happen to the rest of your body? Researchers have determined that wrinkly fingers and toes don’t occur when there is nerve damage in the fingers, which means that the nervous system controls this change. Since wrinkled fingers have better grip in wet conditions, they’ve come to the conclusion that our ancestors needed them to get better footing and gather food in the rains!

In fact, if you smell food, there’s a chance your tummy will growl even more. The reason this happens is because when you smell food, your digestive system gets ready for intake, releasing fluids

Well, it isn’t ‘no reason.’ There is always some reason or the other, you probably just don’t know it. The most common reason is a change in body temperature. To warm your body, your brain makes your muscles suddenly tighten and release, leading to the shiver. At other times, it is nervousness or a feeling of fear, which leads to the release of adrenalin, which has a similar effect. There’s also an emotional connection; when you come across a deeply emotional stimuli — a song you love, a beautiful picture, or even a person — your brain releases dopamine (the ‘happy’ hormone) which again makes your muscles contract and release, leading to that shiver down your spine.

Believe it or not, there’s actually research done on this subject and scientists have found that your brain has the power to anticipate certain movements and their responses. This means that when you try tickling yourself, your brain is prepared for the subsequent reaction that you should have and so, you don’t feel the ‘tickle.’ So, the surprise of a tickle is quite important when you get tickled. Want to test this out? Ask someone to tickle you and watch their every movement. Since you know you are about to be tickled, your brain behaves in the same way and you won’t end up laughing as much.

It is common knowledge that pleasant smells can put you in a good mood, but smells can actually influence your mood to a larger extent. It’s a good idea to know how and why, so you can use this knowledge intelligently to control your mood swings.

You may think it’s insignificant, but blinking is crucial for your eye health. When you’re staring at a screen all day, it’s easy to actually forget to blink. You should ideally blink 10 times per minute. Blinking is your body’s way of refreshing your eyes with a natural lubricant. So, blink away!

At the same time, they were also made to smell certain odours (the logic is that our memories of emotions and feelings are strongly related to smells. See page 18 for more on smells and memories). The second part of the research involved participants sleeping, while researchers introduced a variety of smells which included the fear-linked ones that they smelt while watching those scary images. Researchers observed that skin conductance (which is an indication of your body’s emotional response) rose first, but on repeated exposure to the smells, it gradually declined. When the participants were made to watch the scary images again after they woke up, it was observed that they were less likely to flinch. The conclusion the researchers arrived at was that the participants were less afraid of the images after sleeping.

WhaT happened? So, what happened that reduced the fear response? This particular study doesn’t give an in-depth explanation but researchers can give hints based on what we know about sleep so far. One of the main functions of sleep is to store your memories in your brain and make space for new ones (interestingly, dreams might be replaying these memories in your head, making you feel like you’re dreaming about something that has already happened). However, while these memories are being stored, it is believed that they undergo slight modifications, especially when it comes to an emotional connect. This basically means that during the process of storing your memories, the emotional intensity of that particular memory might be reduced. That’s what could’ve happened in this case. When the memories were brought up during sleep (because of the smells), the brain started the process of storing them away and in the end, the participant’s emotional connection with that memory, in this case, fear, was reduced.

New research shows that it is actually possible to sleep your fears away. Dev Goswami finds out more about the study and tells you how it works to rid you of that uncomfortable feeling

leep lessens our worries. You might not have read scientific articles on it, but we’re sure you agree with the statement. Going to sleep with the weight of the world on your shoulders and waking up the next morning less worried is a common

occurrence which we’ve all experienced. And, new research led by postdoctoral student Katherina Hauner from the Feinberg School of Medicine at Northwestern University in Chicago, takes this further by showing how sleep can reduce your fear of certain things.

But, one of the ways this can help you is with exposure therapy. Exposure therapy is the go to treatment for treating phobias and is also used in treating Post Traumatic Stress Disorder (PTSD). The treatment can be uncomfortable and quite stressful for patients as it involves them coming face to face with their fear. But, if the patients are made to undergo exposure therapy while they’re sleeping, the treatment becomes much more manageable. And if nothing else, this study gives us more proof of the importance of sleep.

Coffee can be extremely beneficial for your skin. Priyanka Singh brings you five different coffee scrubs for your beauty blues problem #1: Cellulite make it: Stir together coffee grounds (1 cup) and sea salt (1/4 cup) until it’s well mixed. Add olive oil (enough to make a paste) and stir it into the dry mixture. Store this mix in a dark container. use it: While in the shower and after you have already soaped and washed the area, scrub this mixture into your skin for a few minutes and then let it sit. After 10 minutes, simply rinse the mixture with warm water, pat dry and apply moisturiser. how it works: The coffee grounds will stimulate surface blood flow to the affected area, which enables the fatty deposits to circulate and diminish over a period of time. ATIA/BHOPAL: As the death toll in the stampede during Navratri festivities near a temple in Madhya Pradesh’s Datia district climbed to 115 on Monday, Congress has targeted Madhya Pradesh Chief Minister Shivraj Singh Chouhan demanding his resignation for the ‘man-made’ tragedy. The stampede, which also left over 100 injured, was triggered by rumours on Sunday that a river bridge the devotees were crossing was about to collapse, reports PTI. “So far, we have received reports of 115 deaths in the stampede,” Deputy Inspector General (DIG) D K Arya told PTI from Ratangarh. The DIG said a number of people, who had carried away the bodies of their near and dear ones, are now turning up for autopsy, which is

mandatory for seeking compensation. An inquiry commission would be set up within the next two days to probe the stampede near the Ratangarh temple, Chouhan said after meeting injured persons at a hospital in Datia. The state government had ordered a judicial inquiry into the mishap which was a shocking rerun of the tragedy at the same site in 2006 when over 56 pilgrims were washed away after water was released in the Sindh river from upstream. After the 2006 tragedy, the state government had constructed a bridge over the river but mishap took place on it allegedly due to poor mismanagement of the crowd that gathered in lakhs from the nearby districts and neighbouring

Uttar Pradesh. Accusing the state government of “misgovernance” for the stampede, opposition Congress demanded that the chief minister step down. In Delhi, party spokesperson Ajay Maken said the tragedy was ‘manmade’ which could have been stopped. “A stampede had happened over five years ago at a similar place which left many people injured. The MP government learnt no lessons from it. Its misgovernance and rampant corruption lies at the roots of the tragedy. It should take moral responsibility and the CM should resign,” Maken said. Datia district’s Chief Medical Officer (CMO) R S Gupta said that autopsies on 111 bodies were conducted till Monday morning.

HUBANESWAR/ VISAKAPATNAM: Heavy rains in the aftermath of Cyclone Phailin triggered floods in Odisha on Monday with over 2.5 lakh people being marooned in Balasore—one of the two worst hit districts along with Mayurbanj— and several rivers were in spate. As massive relief works moved into top gear after the storm that hit the eastern coast in Odisha and Andhra Pradesh on Saturday night left a trail of destruction, mainly in the eastern state, the situation due to floods caused by cyclone induced rainfall in the two districts was described by an official as critical. A cargo ship was also presumed sunk in rough seas caused by the cyclone off the coast of West Bengal but its crew of 17 Chinese nationals and an Indonesian were rescued today, Coast Guard sources said in Kolkata.

Major rivers like Budhabalanga and Subarnarekha are in spate following sudden inflow of water, according to Odisha Special Relief Commissioner P K Mohapatra. Bhadrak district was also affected while flood fury loomed large over Ganjam district, the worst hit by the cyclone. Teams from Army, Navy and IAF besides NDRF and ODRAF were deployed for rescue and relief operations in the flood-affected areas in Odisha. The death toll in the impact of the cyclone rose to 27 with four people being killed in the floods in Mayurbanj and Bhadrak districts. Phailin has dissipated but the heavy rains and floods in its aftermath is a cause of concern, a minister said. “We are air-dropping food packets in Balasore ... The flood situation is a cause of concern,” state Revenue Minister S N Patro said.

EW DELHI: The Finance Ministry has detected customs and excise duty evasion of at least Rs 1,000 crore between January and July. As many as 229 cases of customs duty evasion and 255 cases of excise duty evasion were detected by economic intelligence officials during the period. The amount of excise duty evasion was about Rs 982 crore and that of customs was at least Rs 100 crore, a Finance Ministry official said. A scrutiny of customs duty evasion cases revealed that mis-declaration and undervaluation of imported goods were the common modus operandi followed by fraudsters in order to cheat the exchequer, the official told PTI. REVIEW OF THE PREVIOUS DAY: The Nifty rose marginally on Monday (October 07, 2013) a net 16.50 points (0.27%) and closed at the 6112 point level. The market opened down at the 6093 points level. It then declined further and registered the day’s low at the 6082 points level at 9.16 a.m. The index then rose sharply into the green and registered the day’s high at the 6124 points level at 10.00 a.m. It then declined and turned into a range bound movement until closing at the day. The Nifty witnessed a volatile session and moved in a range of 41 points.

Technical Analysis: Volume: Volume (Qty shares) decreased 12.04%. This change is moderate and indicates a moderate participation by investors.

Market Breadth: Overall Market Breadth on the NSE was neutral. Amongst all the traded stocks, 708 were gainers, 664 were losers and 67 remained unchanged.

Slow Stochastic Indicator: The Slow Stochastic Oscillator has risen and has entered the over-bought zone. The Slow K line in the Stochastic Oscillator is above the slow D line (positive if it continues).

On Japanese candlestick patterns the index af ter having formed a Dragon fly doji ( indic ating inde cisiveness amongst investors) has formed a small white body candle. Thi s is positive and i ndicates that the bias has shif ted towards the buy side of the market. Further, the index is above the 5, 15, 25 and 200 days moving averages and all the four averages are rising and also positively trended. Moreover, the velocity parameters too are positively trended. All these indicate a positive bias and the pos sibi lity of a further up move unfolding. Incidentally, the index is approaching a major resistance level at the 6123 points level. There is a possibility that it could find some resistance there. However, if it crosses above it then a further rise can be expected. Investors are advised to hold long positions.

We have been cautious on Tata Steel given our concerns that weak cash flow visibility coupled with firm capex needs would lead to a further increase in balance sheet gearing. The stock has relatively underperformed its regional and global peers over the past year by 32%. However, early signs of a demand rebound in Europe, flexibility in India capex plans (Odisha Phase-II), strategic stake sales of non-core assets, and improving volume growth visibility in the India business make us positive on the stock. We upgrade to OW (from EW) with a revised PT of Rs358 (from Rs264) and Tata Steel becomes our top pick amongst steel producers in the Asia ex Japan region. Intent to de-leverage the balance sheet is a positive: We sense an increasing willingness by the company to look at strategic options to reduce leverage and improve balance sheet health. It has recently sold various noncore assets and, more importantly, is displaying increasing flexibility in its capex programme (particularly for Odisha Phase-II). We continue to expect negative FCF over FY13-15E but increasing visibility on debt peaking by FY15E is a positive. Besides, there are other options that the company could consider to reduce leverage as highlighted in Figure 20. Losses in Europe appear to be hitting a trough: Macroeconomic indicators in Europe are showing signs of recovery. Also, Tata Steel’s initiatives, such as reducing headcount, shutting down high-cost facilities, and rebuilding the Port Talbot blast furnace have started to yield results. Given its high operating leverage (high fixed cost), even a marginal recovery in volumes/margins could be a significant positive for the stock price (our sensitivity analysis shows a US$10/t EBITDA increase could lead to c17% upside). While we are not forecasting a sharp turnaround in European profitability, our estimate of US$24 EBITDA/t (vs. US$29/t average since GFC) appears to have limited downside. Project execution risks reducing: Tata Steel’s Odisha Phase-I (3mt) is tracking its execution timelines and is expected to commission by 4QCY14. Timely execution would improve volume growth visibility beyond FY15. We now assign a US$1bn value for Odisha Phase-I (vs. US$4bn project cost) given reducing project execution risks. Concerns priced in; upgrade to OW: We upgrade to OW with a revised PT of Rs358 (based on 6x FY15E EV/EBITDA; methodology unchanged) and raise FY15E EPS by 7% (updated currency assumptions).

All other US-FDA facilities viz Paonta Sahib, Dewas and Mohali are still under import alert and consent decree. The possibilities of pending FTFs like Diovan, Valcyte and Nexium getting monetized remains alive but is contingent on the timely approvals of site transfers from the USFDA. Although we expect FTFs to be monetized we would like to highlight that with Ohm Labs being the only US FDA approved facility and it being run at full capacity today, incremental launches from this facility might lead to slowdown / decline in base business for the company. We would also like to highlight that a clearance of this facility is in line with our expectations and is henced priced into our Target price. However, it being a sentimental boost to the stock we advise long-term investors to use this as an exit opportunity on rally. Hanmi expects the drug to generate sales of ~$15mn for them in CY13. We believe Hanmi’s drug might be able to take upto 10% of Nexium share in the market. Hanmi is marketing the product under the brand of “Esomeprazole strontium delayed release capsule” with a local partner, Amneal Pharmaceuticals Our Take: We reiterate that our Target Price of Rs308 is based on an assumption that Ranbaxy would be able to monetize all key FTFs in CY14E. n September, WPI Inflation rose to 6.5% from 6.1% in August. WPI inflation has surged in the last four months from 4.6% in May, due to rising inflation in primary articles and fuels. Core inflation – measured by both non-food manufacturing inflation and CRISIL Core Inflation Indicator (CCII) - continued to remain weak at 2.1% and 2.7%, respectively in September, says Crisil in its report It said primary articles and fuels have a nearly one-third weightage in the WPI. While good monsoons this year, both spatially and temporally, will result in an above average

growth in agriculture GDP of around 4.5%, high agricultural growth is unlikely to help tame food inflation. Food-grains only have a 4.1% weightage in the WPI. In August and September food inflation was driven largely by around 80 to 90% rise in prices of vegetables (year-on-year).Inflation in primary non-food articles also rose sharply to above 5% in September from 1.1% in the previous month. “Another driver of WPI inflation is high inflation in administered fuels. For example, diesel prices have risen over 20% compared to the last year as weak rupee has made subsidy burden unsustainable. Although the rupee has recovered to nearly 61-62

per US$ from lows of over 68 per US$ in August, it had averaged mere 54.6 per US$ last September. Political uncertainty in the Middle East has also kept oil prices higher than what we anticipated earlier. If political tensions in the Middle East worsen further, global crude oil prices can touch last year’s highs, driving up fuel inflation including prices of market-linked fuels further. In his maiden policy review, the Reserve Bank of India’s governor Dr Raghuram Rajan stressed on inflation control as his priority. With inflation now out of RBI’s comfort zone for four months in a row, we expect a 25 bps repo rate hike on October 29, 2013,” the report said.

Indian Cos Garner Rs 1,050 Crore Via IPOs In H1 Of FY’14 By A Business Reporter

ndian companies mopped up a total Rs 1,050 crore through initial public offers (IPOs) in the first half of 2013-14, sharply up by 36% over the same period of the last fiscal. According to Prime Database, leading database on primary capital market, 16 firms collectively raised Rs 1,050 crore via IPO route in the six months ended September 30, 2013. In the first half of 2012-13, as many as 13 companies had raked in 772 crore capital through initial share sales. Interestingly, of the 16 IPOs, which hit the capital market in the first half of the current fiscal, 15 were from the Small and Medium Enterprise (SME) sector.

There was only one non-SME IPO, (Just Dial that garnered Rs 919 crore), which accounted for 87% of the total mobilisation. Among sectors, information technology space dominated with three firms mopping up Rs 1,927 crore, which is 29% of the total amount garnered. Market experts attributed the reason for big companies avoiding the IPO route to rake in funds to an uncertain and volatile equity markets, coupled with a lack of appetite among retail investors. “With the secondary market still being extremely volatile and overall lack of confidence, no immediate revival of the primary market is seen in balance part of the year... The biggest disappointment for the primary market has again been the

lack of divestments by the Government,” Prime Database Managing Director Pranav Haldea said. “In the six-month period, 14 companies, intending to raise Rs 4,500 crore, which had obtained approval from Sebi allowed it to lapse. At present, only 16 companies planning to raise Rs 3,800 crore are holding Sebi approval and another 10 companies intending to raise Rs 3,100 crore have filed with Sebi and are awaiting approval,” he added. In terms of the method of offering, only 1 of the 16 IPOs of the period, were through the book-building route, with balance 15 SME issues through the fixed price method. The facility of anchor investors was used by one company.

OW does one explain the phenomenon called Lata Mangeshkar? This is a question with which music lovers and analysts have obsessed for decades on end. One of the obvious factors that have shaped the musical persona of Lata Mangeshkar is her training as a classical singer. Lata first trained under her illustrious father Diananath Mangeshkar who was an accomplished singer and a stage actor. She also learned from Aman Ali Khan of the Bhendibazar gharana for a few years. Later Tulsidas Sharma, who was a regular broadcaster singer and a pupil of Bade Ghulam Ali Khan, also gave her some instructions. Over the last few years an audio visual clip of her rendering of the Raga Malkauns is being circulated on the internet. It shows sarangi maestro Ramnarayan giving her melodic support and on the tabla it is Shripad Nageshkar. The clip gives ample proof of Lata’s training and her mastery of raga music. ARLIER we have watched in many films the chaos due to doubles roles or when two people with similar looks come face to face. But in Dhamdhoom we will get to watch what kind hilarious confusion can take place when many people share the same name. It is easier to portray the confusion created by the similar looking individuals but essaying the commotion created by people sharing the same name is a bit challenging and director Devendra Pem has won the challenge successfully.

The story of Dhamdhoom revolves around a name (Madhu). It’s a story of a nerdy lawyer guy called Madhukar (Bharat Jadhav) who loves a girl named Madhu (Smita Shevale), the daughter of a naturopath (Anand Abhyankar) and he wants to get married to her. But Madhukar’s father is under the impression that Madhukar’s dream girl is a girl named Madhura (Mrunmayee Deshpande) who is the daughter of a fiery don (Sayaji Shinde) and he starts considering Madhura as his future daughter-in-law. The entry of Madhur (Siddharth Jadhav) creates more confusion, interestingly the chaos is not only limited to the four youngsters but even their families gets involved which creates riotous situations and incidents. Misunderstandings between the four families take place due to the common name ‘Madhu’. The whole film which revolves around the theme of marriage will certainly make the audience enjoy the climax. entertainment as well as examples of Lata’s mastery of ragas. Fans of Lata thronged the venue and there were people not only sitting and standing in the gangway. The structure of the programme was interesting. A classical singer sang alaps or bandish in a classical raga which was received with a thunderous applause by the audiecne. Later, a song sung by Lata in the same raga was played which helped people appreciate the raga element in the song further. Some interesting anecdotes were related by the veteran film music connoisseur Mohan Joshi. ‘Pani Bich Meen Piyasi’, a Kabir poem set to the Raga Kalingada; composed by Gwalior gharana singer Neela Nhagwatset set the tone of the programme. ‘Mohe Bhool Gaye Sanwariya’ from ‘Baiju Bawara’ was played too. The grip that the programme took lasted throughout. Later on, ragas like Ahir Bhairav, Todi, Bhairav, Asavari were played and similar compositions were sung. ‘Alla Tero Naam’ in the raga ‘Gaud Sarang’ transported the listeners to a new spiritual height. A difficult raga like Marwa sung through the song Payaliya Banwaari evoked an overwhelming response.

First look of ‘Vatsalya’

THE first look of Marathi film ‘Vatsalya’ presented by Red Berry Entertainment and directed by Dayanand Rajan was recently unveiled on the occasion of Navratri at Cinemax Versova, Andheri. The cast and crew of the film were present at the event. ‘Vatsalya’ is based on the tender relationship between a father and a daughter. Actor Bharat Jadhav is playing the lead. Though Jadhav has earlier played serious roles, this role is different. His character in the film has many layers and how he faces the challenges of ever changing situations and the kind of mental trauma he goes through is something visible in the first look.

NJALI Institute of Bharata Natyam presented the debut performance by four talented children at the Mysore association auditorium. The performance was noteworthy for the technical quality, fine synchronisation and considerable command over expressional dancing. The talented dancers who performed were Megha Pillai, Alisha Mali, Muveena Kumar and Unnati Aagrwal. These four are the disciples of renowned Bharata Natyam exponent Guru Lata Surendra. It was truly a delight to watch all the dancers dancing to fine co-ordination of music and dance, while maintaining the precision of movements and the quality of expressional dancing. The programme commenced with the traditional invocatory numbers followed with the Alarippu that introduced the basic movements and attributes pertaining to the technique of Bhrata Natyam. The Vasanta Jatiswaram formed a fine synthesis of both music and melody and was sung well by vocalist Shivaprasad. The Kalyani Varnam, the most elaborate item of the Bharata Natyam repertoire, was especially choreographed to suit the age of the young dancers, as most of them were hardly ten or eleven years old, and hence the theme was

ARACHI: The Pakistan Cricket Board (PCB) is all set to push the case of banned pacer Mohammad Amir to at least allow him to resume domestic cricket when the International Cricket Council (ICC) executive board meet in London from October 17 to 19. A source in the board told PTI today that the PCB was hopeful that it would be able to convince the ICC to allow the young left armer to resume training at the National Cricket Academy in Lahore under the supervision of the national coaches. “The PCB had hired a law firm in London to look into Amir’s case and prepare a report which has now been sent to the ICC for consideration and discussion at the board meeting,” the source said. “Sethi on the basis of the legal report would try to convince the board to allow Amir to resume training at the national cricket academy in Lahore under specialised coaches. “PCB’s caretaker chairman Najam Sethi and chief operating officer Subhan Ahmad will be going to London for the meeting and Amir issue is on the top of their list of priorities,” he added. Sethi had also brought up the Amir issue at the last ICC board meeting after which the world body formed a special committee headed by Giles Clarke to look into the matter. “Clarke will also be presenting the committee’s findings at the board meeting,” the source revealed. Amir was banned for five years for spot fixing by the anti-corruption tribunal of the ICC in early 2011 and later also served a jail sentence in the United Kingdom after being found guilty by a crown court. His teammates Salman Butt and Mohammad Asif were also given minimum five year bans by the ICC for spot fixing in the fourth Test against England at Lords in 2010. All three players had admitted to their crime and apologised to the Pakistani fans and the PCB for their actions and have agreed to undergo rehabilitation programs, and cooperate with the ICC anti-corruption and security unit. Amir was pretty optimistic of being granted permission to play domestic cricket. “I am really grateful to the PCB and Sethi Sir for taking up my case with the ICC because staying away from cricket has been the most difficult time in my life,” Amir told Geo super channel. “I have realised the blunder I made and have apologised and accepted the punishment handed out to me. I am also cooperating with the board and undergoing rehabilitation. I just hope that the ICC allows me to play domestic cricket again,” he said. The pacer, whose ban technically ends in September 2015, said he was hopeful the ICC would also look at his case on compassionate grounds given he has already served time in jail.

EW DELHI: Just days after claiming that Gurunath Meiyappan, who was arrested for his alleged role in the IPL spot-fixing and betting scandal, was actually running the Chennai Super Kings team, Michael Hussey today made a Uturn, saying that he might have written wrongly in his autobiography. In his book — Underneath The Southern Cross — CSK opener and former Australia batsman Hussey has said that the Chennai IPL team owner and BCCI president N Srinivasan had handed the control of the franchise to his son-in-law Gurunath. But, Hussey backtracked his assertion, saying that he was not completely clear about Gurunath’s position in the CSK team, according to a report. “Certainly Guru was around the team a lot. I knew he was talking to Kepler (Wessels, Super Kings’ coach in IPL 2008) and the players, and we saw him at training and at the hotel. I didn’t know what his official title was but he

was around the team quite often. I probably may have written the wrong thing,” Hussey was quoted as saying on the Cricket Couch podcast on ‘ESPNcricinfo’. “I knew he was a close part of the team, no question about that, and I saw him around the team

pretty much every day. (But) I am certainly not going to question the word of Mr Srinivasan. I think he would know a lot better than me about who is running the show. So maybe I got that a little bit wrong,” he insisted. Hussey also said that he has

met Srinivasan, who is the vicechairman and managing director of India Cements which owns CSK, and has apologised. Stating that he has cleared the air with Srinivasan when he met him during a team dinner, Hussey said, “We had a team dinner where Mr Srinivasan came along. I spoke to him very briefly about it and apologised if I caused him any grief. “He was fine and said, ‘No, don’t worry, it is all fine. There is no issue with all you said. It was all written before all the controversies came out, anyway. You don’t have anything to worry about.’” Hussey said he hoped to be associated with the CSK in some capacity even after he stops playing. “I certainly hope not (that the comments in his book would affect his relationship with the franchise). I have a fantastic rapport with everyone at CSK. I get on very well with the coach. I get on very well with the players and have had a lot of success with CSK,” said Hussey.

EIJING: Notwithstanding India’s protest, China today strongly defended its decision to issue stapled visas to two Indian archers from Arunachal Pradesh who could not take part in a world championship. Though it regretted that the two archers could not participate in the Youth World Archery Championship in central China’s Wuxi city, Beijing maintained that the issue of stapled visas was a “flexible move” pending resolution of the boundary dispute. “We noticed the relevant report. The athletes could not come to China for relevant events. We express our regret,” Chinese Foreign Ministry spokesperson Hua Chunying told a media briefing here. Asked about the controversy generated by China’s decision to grant visas on paper to the two archers from Arunachal Pradesh, which China claims as Southern Tibet, Hua said “China’s position on the east end of the boundary between China and India is consistent and clear cut.” “China’s practice with regard to the visa is a flexible move pending the resolution of the boundary question. This shows China’s sincerity and flexibility,” she said.“We hope the Indian side can work with the Chinese side and maintain the sound momentum of personnel exchange and cooperation across the board,” Hua said. India had lodged a protest on Saturday with China on the issue, terming the move as “unsavoury and un-

acceptable”. The protest was lodged two days after Mihu Maselo and Yumi Sorang, the archers from Arunachal Pradesh, were forced to return from New Delhi’s Indira Gandhi International Airport for having been issued stapled visas by the Chinese Embassy. The girls, both 14-years-old, were part of a 24-member Indian squad for the archery championship. They were to board a China Southern Airlines flight to Guangzhou on Thursday night when they were sent back from the airport. The practice by China of issuing stapled visas for residents of Arunachal Pradesh came to light in January, 2011, when two weightlifters from the state were prevented by immigration officials from boarding a flight from New Delhi to Beijing. India objects to the issuance of stapled visas for any of its nationals wanting to proceed to China. China’s stapled visa policy has prevented residents from the border state of Arunachal Pradesh from travelling to that country, making it a contentious issue in bilateral relations. The Chinese move, coming ahead of Prime Minister Manmohan Singh’s visit on October 22 generated considerable controversy. On being quizzed further on the issue of why China is opting to give stapled visas when the two countries are holding a series of talks to resolve the boundary issue and whether it would figure during Singh’s visit, Hua said, “the stapled visa incident is related to the China and India in the East end of the boundary question.”

ARACHI: Pakistan’s discarded Test opener Imran Farhat got a shocker just two days before Eid when the two expensive goats he had bought to sacrifice tomorrow were stolen from his house. A close relative of the batsman said Imran got a shock when he discovered that someone had stolen the goats he had brought to be sacrificed on Eid celebrations. “He bought the goats for Rs 100,000 but now they are nowhere to be found and have probably been stolen by animal thieves who become active before Eid ul Azha,” the relative said.The two animals were strolling outside Imran’s house when they went missing. Imran, a left-handed opener, had withdrawn himself from the national team for the tour to Zimbabwe last month because of the illness of his ailing wife. But this month, the national selectors didn’t consider him for

It is not uncommon for animals to be stolen or go missing in the days leading to Eid and in Pakistan’s biggest city, where extortion is rampant in some areas, people who bring home sacrificial animals even have to pay money to mafia to keep them safe. NEW DELHI: Mizoram’s Government Chawmfianga Middle School of Kolasib won its maiden U-14 boys’ title of the 54th Subroto Cup with a thrilling 2-1 victory over Betkuchi High School from Kamrup, Assam at the Ambedkar Stadium here today. Lallawmsanga (28th minute) and Lalthansanga (47th) scored for the winners while Mizoram defender Lallawmawma (36th) botched up a clearance to reduce the deficit. This is the third time that a team from Mizoram has won the title. Mizoram dominated proceedings and could have scored at least a couple of goals in the opening 15 minutes. Rangaramanujan passes away

NEW DELHI: Former Table Tennis Federation of India (TTFI) president passed away early morning today due to age related ailments. He was 96 and is survived by his wife and five children. An able sports administrator, Rangaramanujan breathed his last at around 12.10 am in the morning at his Hyderabad home. He was suffering from lung related problems and was recently treated at a private hospital, his son Ramdas Ramanujan informed. Rangaramanujan was associated with table tennis for nearly six decades and was the founding President of Commonwealth Table Tennis Federation.

Aussies to keep injuries secret for Ashes - report

SYDNEY: Australia will protect information about player injuries so as not to cede any competitive advantage to England in the coming Ashes series, a report said today. Officials will not divulge the nature of any injuries suffered unless the player is ruled out of a Test match, according to Cricket Australia’s general manager of team performance Pat Howard.
