Kashmiri native was intercepted by personnel of the Central Industrial Reserve Force (CISF), who nabbed him from within a restricted area after he entered from Orange Gate and was about to exit from the New Yellow Gate, which is the entry point to the city. He was handed over to Yellow Gate police station for further investigations on Thursday evening. Mohamad Jamid Malik (30)

claims he is teacher in a government school in Kashmir, and his father Ibrahim Malik is a government servant. The Anti Terrorism Squad is also investigating and interrogating Malik. The police officials said that Malik was intercepted while he was trying to exit from the New Yellow Gate which is completely restricted, and not allowed for civilians. Shockingly, no one intercepted him at the Orange Gate and therefore he proceeded fur-

ther ahead, said the cops. Malik claimed he had mistakenly entered the area and he was heading towards a masjid in Dongri where he has been keeping his luggage. He told police that someone misguided him saying there was a shortcut to Dongri from Orange Gate. Malik is resident of Ahlam Patry in Kashmir which comes under Alham Gadol police station over there. The CISF handed him over to Yellow Gate police who jointly grilled him with the ATS.

The other proposals approved by the Centre for the city are providing nutritional supplements to people suffering from drug resistant TB, getting private practitioners to make their TB patients be a part of the Revised National Tuberculosis Control Programme (RNTCP) while retaining the patients with them so that the ill-affording patients can avail of free medications under the RNTCP, giving individualised treatment to drug resistant TB patients and setting up a respiratory Intensive Care Unit (ICU) at the Sewri TB hospital. Also, five more GeneXperts would be set up in Mumbai in year 2014.

I

t looks like the recent visit by a team from the Central Government has given the tuberculosis control and detection programme of the BMC, a boost. The centre has approved certain proposals put forth by the BMC which the BMC feels will better its TB control programme. One of the several approvals is allowing second line TB testing for any patient suffering from TB and not responding to the first line treatment. “The algorithm that is being currently followed takes anywhere between nine months to an year for a person to be diagnosed with drug resistant TB because after being out on category I and then on category II treatment and being unresponsive to them, the sputum is sent to GeneXpert and the individual is put on category IV of treatment if required. And after a follow up after six months, either category IV treatment is continued if the person is responding to it or else he is given a category V treatment, depending upon the results of the second line testing for sensitivity for drugs. This process takes anywhere between eight to nine months and a year causing loss of

precious time leading to prevention of early detection of drug resistant TB and treatment. So, we had proposed that when an individual shows resistance to first line treatment for TB itself, the sputum sample should be sent to GeneXpert and also for second line testing. And this has been approved by the Centre”, said Manisha Mhaiskar, Addiotnal Commissioner (West), BMC. The BMC is now preparing to increase its capacity to conduct second line testing for drug resistant

TB by getting the required infrastructure in BMC-run Sewri TB Hospital, at state-run JJ Hospital and working with Hinduja Hospital which has recently got accreditation for conducting second line tests. Within a year, we will be able to conduct 2,000 tests in a year. The requirement is of 4,000 as on an average, 3,000 to 4,000 people annually suffer from drug resistant TB in the city. We are working towards increasing the testing capacity”, said Mhaiskar.

Statistics by the BMC:

Every year, on an average 30,000 people suffer from TB in Mumbai. There were 31,000 cases in 2013, 30,000 in 2012 and 29,212 cases in 2011. There were 53 cases of multidrug resistant TB in 2010, 181 cases in 2011, 2429 cases in 2012 and 2903 cases in 2013. There were no cases of Extensively Drug Resistant TB (XDR TB) in 2010 and 2011, in year 2012, 32 people were on treatment for XDR TB and in 2013, 90 were being treated for XDR TB.

MUMBAI | SATURDAY, FEBRUARY 1, 2014

I

n the early morning hours of January 5, Esther Anuhya, a software engineer from Andhra Pradesh, working for Tata Consultancy Services (TCS) at Goregaon, was returning to the city from her home in Hyderabad, and had disembarked at Lokmanya Tilak Terminus (LTT), situated in the Tilak Nagar area of Chembur. The train, the VishakapatnamLTT Express, which she had boarded from Vijayawada at 8 am on January 4, entered LTT station at 4.52 am and by 4.57 am, Anuhya had alighted. At the same time, Anuhya had checked her WhatsApp messages on her cellphone, and as per her copassengers who were questioned by the police, she started walking towards the only entry-exit point of the station, looking for transport to take her to the YWCA Hostel at Andheri, where she was staying.

approach the Tilak Nagar police, as the LTT station falls under their jurisdiction. The Tilak Nagar police informed the relatives that they would search the Tilak Nagar area, but asked them to approach the Kurla police station, as some part of Tilak Nagar comes under the latter's jurisdiction. The Kurla police then collected all of Anuhya's relevant details and started the probe. Considering the gravity of the case, Addl. CP (Central Region) Praveen Salunke on January 8, sent three police officers – two sub-inspectors and an assistant inspector – with Anuhya’s relatives while they were looking for her in the city. “The three officers from Kurla police station were with Anuhya's relatives 24 hours of the day, inclding January 16, when her body was found,” said Salunke. However, Anuhya’s uncle Ramanna said, “It’s true that three officers had accompanied the relatives, but on January 16, when Anuhya’s brother Deepak found the body, these officers were looking for it in a differ-

Is Mumbai safe for women? This is, perhaps, the question on any everyone's mind after the recent incident where 23-year-old techie, Esther Anuhya, was kidnapped and brutally killed by unidentified persons. The murder also brought to light how the police – the city police, crime branch and the railway police – did not take appropriate action and measures, which would have atleast led to the discovery of the girl's body much earlier. Neel Shah takes a look into the incident, as well as the roles of those concerned – particularly the police from the various departments.

However, before Anuhya managed to find transport, her co-passengers had already left the station, said police personnel from the Kurla railway police, who are probing the case. According to Anuhya’s mobile location, which was tracked by the city’s crime branch, as well as by the railway police, the girl was at the railway station till 5.35 am. At 6.08 am however, her mobile location was between Kanjurmarg and Bhandup in the Eastern suburbs of Mumbai. This is considered to be her last location according to the surveillance team of the crime branch, as the latter – after receiving the complaint of her disappearance – started tracking her mobile network signal right fromVijaywada railway station. Due to her mobile being switched off after a couple of hours of showing her last location on January 5, her last location stayed the same till her body was found on the afternoon of January 16. plained investigators. “On various ocassions, police officials had accompanied the relatives in looking for Anuhya. However, this initiative was not as strong as it should have been, as the cops were

simply relying on surveilance trackers and thought that the girl, in a bid to prevent the cops from tracing her location, must have thrown her cellphone in the Kanjur-Bhandup area and must have eloped,” explained a highly placed police official in the Mumbai police while requesting anonymity. In this regard, Anuhya's relatives say that the bone of contention lies with the police's lackadaisical approach towards taking appropriate action. “Considering Anuhya's mobile constantly showing her location to be between the Kanjur-Bhandup area, it becomes logical for police officials, from any department, to initiate a combing operation in the area,” said a relative, adding that this didn't take place, as a repeated request asking the police to initiate a search operation, was put-off by the cops who siad that they would do it in a day or two. Finally, on the morning of January 16, at around 8 am, two of Anuhya's cousins, her aunt's driver, and few locals started a search in the areas of Kanjurmarg and Bhandup. In addition, two among the three police officials, who were assigned to be with the relatives during the search, had also accompanied the relatives, said the police, as well as Prasad. The Anuhya's relatives were also helped and, at times, were properly guided by a former state Director General of Police (DGP), who happens to be a family friend, said sources. This former DGP, whose name has been witheld, also spoke to a high ranking crime branch official, in which he requested the officer to personally look into the matter, added the sources. Considering this, was the probe in the 10 days from the abduction to the discovery of the body handled haphazardly? Does this incident highlight the careless attitude of the police towards taking the cognizance of such incidents seriously? These questions still remain unanswered by the police. Further investigations As soon as the body was discovered, the city as well as the crime branch swooped into action and started questioning and introgating taxi and rickshaw drivers – more than 100 of them – who usually conduct their business at LTT. The police also interrogated drivers with criminal anticidents, under the suspicion that they might be involved in the crime. Two weeks have passed after the body was discovered, but the postmortem and the chemical reports are yet to arrive. The latest development in the case is that investigators have learnt from the CCTV footage at LTT railway station, that Anuhya, after alighting from the train, was sitting in a waiting room when a man in his 30's had approached her.

‘Sunder not in musth’, PETA gives new evidences to HC CITY

MUMBAI | SATURDAY, FEBRUARY 1, 2014

By Philip Varghese

A

lmost a month after the Forest Department officials told the Bombay High Court that the 14-yearold elephant Sunder was in a musth (period of heightened sexual urge which can make captive bull elephants aggressive from frustration) condition and had, therefore, been behaving aggressively and was refusing to be moved, the People for the Ethical Treatment of Animals (PETA) on Friday presented an evidence to the court proving that 14-year-old elephant Sunder is tortured and is not in musth. The lawyer representing PETA told the court that the elephant was not in musth as had been claimed by member of legislative assembly Vinay Kore and the Kolhapur division of the forest department. PETA’s lawyer said, “This was an excuse for failing to implement the High Court’s

order to move Sunder to a sanctuary and to avoid contempt of court. Sunder is at the centre of a case in which PETA is calling for his release to a sanctuary. Kore donated Sunder to the Jyotiba temple in 2007, and the elephant has been kept chained and inside dark sheds for most of that time. In December 2013, PETA obtained video footage showing Sunder’s mahout violently beating him with a pole near a poultry shed where he had been moved at the behest of Kore. That same month, the High Court ordered Sunder’s transfer to a sanctuary, but he has

yet to be released by the Principal Chief Conservator of Forests”. PETA Director of Veterinary Affairs Dr. Manilal Valliyate said, “Vinay Kore and the Kolhapur forest department had been claiming since December 2013 that Sunder is aggressive due to musth and that they are therefore having a difficult time moving him to a sanctuary. Pre-musth lasts for approximate three weeks, musth for about one month with a post-musth condition for approximately another month. During musth, there would be swelling of the temporal gland on elephant’s forehead. A smelly and bitter

secretion dribbles from the gland, often reaching the elephant’s mouth”. PETA’s lawyer pointed out a report from Dr. T.S. Rajeev of the Centre for Elephant Studies, College of Veterinary and Animal Sciences in Mannuthy, and Dr. Sasindra Dev, Forest Veterinary Officer, Konni – two independent elephant experts from Kerala who examined Sunder on December 20, 2013 and were authorised by the Animal Welfare Board of India a statutory body operating under the Ministry of Environment and Forests to do so – states that Sunder is neither in musth nor showing physi-

According to the police, a team of revenue officials had halted two sand laden trucks at Bolinj Village, and were checking the permission documents required to ferry sand, when the miscreants mounted a violent assualt on them. Three people, identified as Jeetendra Kushwaha, Chetan Vaze and Virendra Kushwaha, have been arrested and booked under the relevant sections of the Indian Penal Code. The accused have been remanded to four days of police custody when they were produced before the Sessions Court. Further investigations are on.

n the continuing spate of robberies at mobile stores in the Vasai-Virar region, a break-in was reported at Rambhiya MobileZone, a mobile shop near Parvati Talkies in Vasai (West). Unidentified thieves entered the store by removing an air-conditioner from the window and decamped with high end cellphones and accessories worth more than Rs.30 lakh in the wee hours of Friday. The CCTV camera installed inside the shop has captured the footage of the miscreants stealing the goods. The constantly increasing instances of thefts and break-ins have been giving local residents and shopkeepers sleepless nights, both of whom are now questioning the efficiency of the Thane (Rural) police. The Manekpur police are investigating the case.

cal or behavioural signs of pre-musth and is generally apathetic, not aggressive, in nature. PETA’s lawyer also pointed to a video telecasted by a new channel on January 23, 2014 and another new channel the same date which shows Kore and other people standing right in front of Sunder making the point that if Sunder would have been in musth, nobody would have dared stand so close to him as it would have been dangerous. PETA pointed out that the temple management holds the ownership certificate for Sunder, not MLA Vinay Kore, and that the temple manage-

05 ment has recently written to the forest department stating that it can no longer take responsibility of the elephant. It pointed out that there is therefore no reason for the forest department to fail to implement the court’s order to move Sunder to a sanctuary. PETA’s rejoinder which has been filed with the court also states that Sunder has been under the unlawful custody of MLA Vinay Kore since October 2012 and its offer to move Sunder to a sanctuary for the forest department has been ignored. In its petition, PETA has sought intervention of the Maharashtra forest department to implement its own order – as well as the recommendation from Project Elephant under the Ministry of Environment and Forests – and retire Sunder to a sanctuary. Based on the hearing, the court posted the matter for further hearing till February 12. philip.varghese@afternoondc.in

Pawar meeting Modi is baseless report: NCP (Hydraulic Engineering Department)

By A Special Correspondent

T

he NCP yesterday has denied a news report that its party president Sharad Pawar held a secret meeting with BJP’s prime ministerial candidate Narendra Modi, last week. The front-page report in a Marathi daily yesterday stated that the two leaders had met for nearly 30 minutes in Delhi on January 17. So secret was the meeting, the report alleged, that even senior leaders of the NCP and the BJP were not aware of it. It hinted at a growing closeness between the two parties. Yesterday, state NCP president Bhaskar Jadhav at a press conference said, “It is totally baseless report. Pawar was not even in Delhi on the day when the meeting was supposed to have taken place. He was in Sangli on that particular day. He has never met Modi barring the official meetings and conferences”.

day after the shooting incident at Kalina, the investigating officers of the Vakola Police have found some more facts about the past of victim Ramchadra Pal, who was shot by Izhar Khan on Thursday morning near the Noori Masjid. Sources from Vakola Police revealed on condition of anonymity that around four to five years back, Pal was attacked by one of his neighbours who came to know about Pal’s relationship with his wife. The accused in that case left the locality after he was released on bail. According to Senior Police Inspector from Vakola Police Vinayak Mulay, Nazir Khan, a nephew of Izhar who had arranged for the revolver used in the crime is still absconding though a manhunt has been launched to nab him. “We have formed a special detection team which is on the lookout for Nazir and he will be caught soon,” Mulay

Saddiq Sheikh (23), a deaf and dumb man, who witnessed the shooting, and handed over to two traffic cops who were on duty. Meanwhile, Pal is recuperating in hospital. Izhar and his niece Saba were produced before the court and sent to police custody till Feruary 4.

RISING RAPES IN INDIA By Dr. Mukund Aparajit

P

O O R TEACHER QUALITY in India is the fundamental reason behind the huge rise in violence a g a i n s t women, including Rape. Rapes are rising mainly because just 40 % of teachers have studied beyond Xii. This situation is radically different, in terms of teacher quality, from that, which existed just 25 – 30 years back. Today, the worst qualified, with nowhere else to go are becoming teachers. It follows therefore that Poor Teacher Quality will have a devastating impact, on social values (respect for women) , Attacks against women are a global phenomenon but the recent surge in brutal crime against women in India is very different from global experience on two specific parameters: 1 ) its scale and 2) its brutality The steep rise in the number of rape cases in recent times indicates that it is a systemic problem. The brutality that we are seeing also appears to be systemic but the reasons for this“ scale “ and “

brutality “ each , are very different. It is therefore extremely important to first understand the causes for rising rape in India before we even attempt to solve the problem. Understanding must come first, the remedies will follow. Let us first examine the “Scale “issue and why crime in general is rising so rapidly in India. . It was known and forecasted that the fact that we would soon have the largest percentage of the worlds young population.,, that by 2018, some 200 million young people would enter the job going age group in India in addition to over 1oo million that are unemployed today, and as a result on every street across India you find young men in the age groups 15 – 22 just sitting around with nothing to do. Their parents do not want them inside the house and so they play cricket on the streets and they stare at you as you go by. Their parents will soon tell them to generate their own cash and they are currently wondering what they will do. Look outside your gate anywhere in India and you will see these young men. This is why crime of all kinds ( theft, extortion , kidnappings etc ) is rising and may well triple by 2018 if we

This illegal structure stood for four years before being noticed. a demolition squad led by in-charge, Srikrishna Mohite, started knocking down the interior walls in the units of a seven storey tower in the Pleasant Park area of Mira Road. All the seven floors had been illegally constructed by Chavhan Builders (Survey Number: 469 Old, 143 New) in total defiance of the law more than four years ago. “The structure is totally illegal. The builder had managed to procure a stay which had been recently vacated,” said Mohite. While civic personnel were deployed for a manual

Another law, the Maharashtra Municipal Corporations and Councils Act, allows the prosecution of ward officers under whose jurisdiction the illegal constructions take place. Ironically, there has not been a single prosecution till date, nor is anyone aware of action been taken against the concerned architects who are allowed to go scot-free for their brazen defiance and utter disregard for the model town planning rules.

Besides a compulsorily camp per week, the empanelled hospitals have to bear carriage charges for the body in the event of a patient’s death. Initially, hospitals, despite the low rates, had shown keen interest in participation for a social cause, but the red-tapism leading to undue delays seems to have posed has a dampener, taking out the fizzle from the much-hyped health scheme.

Munde dismisses alliance with NCP, keeps people guessing about Satyapal Singh

enior BJP leader and deputy leader of opposition in Lok Sabha, Gopinath Munde yesterday, dismissed all talks of an alliance with the Nationalist Congress Party (NCP). However, on the issue of whether Mumbai Police Commissioner Dr. Satyapal Singh – who quit recently – was in touch with the party leadership, Munde pleaded ignorance. Party sources however, indicated that Singh is keen on contesting the Lok Sabha polls from either Meerut or Baghpat in Uttar Pradesh. In

Later in the day while talking to the electronic media, Singh remarked that his inner voice had said to him and that he wanted to serve the country and work in an organisation. He denied that he quit the police force as he was overlooked for the post of state Director General of Police post. When asked which party he was likely to join, Singh remarked that he had offers from several political parties. But as yet he has not decided as to whether he would join the BJP or Aam Aadmi Party (AAP). When asked to comment upon the reported Pawar-

a major indication, Munde argued that Singh was ideologically close to the BJP as he was a staunch Arya Samaji. Replying to queries over Singh, he said that the party’s central leadership has not communicated or asked the state leadership about its feedback. Munde added that Singh belongs to the Jat community which is strong in UP. Replying to further queries he remarked, “Let him first approach the party with a formal proposal. So far he has not communicated anything to us. Let his resignation be first accepted. The party did not extend any invitation to Singh”.

Modi meet, Munde welcomed NCP leader and union Heavy Industries minister Praful Patel’s statement on the Supreme Court clearing Modi’s name in the 2002 Gujarat riots. He, however, pleaded ignorance about whether the meeting did indeed take place. Munde was quick to point out that the NCP chief had clarified on his Twitter handle that reports of the meeting were baseless. He added that there was no scope for the NCP to join the BJP-led Mahayuti or NDA alliance. Munde even speculated that it could be the ploy of the NCP to put pressure on the Congress, which is refusing to

Will he govern Delhi I or keep dealing with lawsuits? T

HE primary duty of a chief minister is to ensure governance in his own state. It is a wholesome job. In the case of Aam Aadmi Party's (AAP) chief and Delhi Chief Minister Arvind Kejriwal, he has to work overtime. He cannot possibly have time for any work beyond the boundaries of his own state. He has kept several portfolios with himself and that means he has to do more work. But it looks like Kejriwal has forgotten all about Delhi and is attending to extra work. For instance, he is fighting in a big way the Lok Sabha elections which are only a few weeks away. He is planning to put up his party candidates for the Lok Sabha poll. In addition to all this work, Kejriwal has started identifying corrupt rulers across the state. He has already prepared a list of them and disclosed the names to the press. The list includes ministers of the central government, leaders of political parties and top politicians. He must have done a lot of research to identify the corrupt folks. He must have collected all details about the cases against them and maybe some evidence too. How can he have time to prove they are corrupt? He will definitely have to face some action on the part of the corrupt man and woman he has named. BJP's Gadkari has already told him that unless he proves his (Gadkari's) guilt within three days, he will file a suit against him. Many others whom he has included in his list of corrupt leaders, are also likely not to take his charges lying down. A startling accusation made by him is that the Congress party vice-president is corrupt. Will the Congress ignore his remark and decide to take action? The big, pertinent question is whether he will govern Delhi or face numerous lawsuits against him?

MUMBAI | SATURDAY, FEBRUARY 1, 2014

T would be a dereliction of my duties as a political columnist if in the week that Rahul Gandhi chose to give his first interview ever on national television I chose to write about something else. This interview is the biggest political story in India whether you are a Congress supporter or not because Rahul speaks so rarely to us hacks. The man who has inherited the legacy of Jawaharlal Nehru and Indira Gandhi has never before in the ten years that he has been a politician deigned to give a formal interview. He has preferred in his relations with the media to take the shoot and scoot route perfected by his mother. What this involves is making a prepared statement and then departing before anyone can ask the first question. You can count on the fingers of one hand the interviews that Sonia Gandhi has chosen to give in the decade she has been India’s de facto prime minister. And, she has personally selected the interviewer and arranged in advance that certain questions be avoided. It appears that Rahul Gandhi may have come to some similar agreement because Arnab stayed away from asking him tough questions about his economic vision, his ideas on foreign policy and avoided probing him deeper on the limited political views he expressed.

with the largest majority in the Lok Sabha. Perhaps, Rahul has not been informed that there is nobody in the Congress Party who does not know for sure that he will be prime minister if Congress is in a position to choose after the next general election. When P. Chidambaram was asked by the editor of the ‘Financial Times’, Lionel Barber, recently if he was a candidate for this job he said that the party had decided that this job belonged to Rahul. In fairness to Arnab he did try to corner

Many pertinent questions avoided

Rahul on the Congress Party’s constant charge that Narendra Modi does not qualify for the prime minister’s job because of what happened in Gujarat in 2002. He repeatedly asked Rahul why Congress should not be similarly held responsible for the violence that happened within days of his father becoming prime minister in 1984. His persistence paid and Rahul admitted that some Congress politicians could have been involved in the pogroms against the Sikhs (or the seekhs as he called them) but said the difference between 1984 and 2002 was that the government had tried to stop the violence in 1984 while the government had perpetrated the violence in 2002. At this point Arnab could have reminded Rahul of his father’s justification of the violence but chose not to. What intrigued me most about the views expressed by Rahul was his repeated condemnation of ‘the system’. It was this system, according to him, that had killed his grandmother and father and it was this same system that prevented ordinary people from entering politics because the political parties chose candidates behind closed doors after consulting no more than

So when he repeated more than once that he wanted to ‘empower’ women and young people Arnab never asked him how he planned to do this. Did he believe that it was something that could happen only when women and young people have access to halfway decent government schools or did he have some alternative idea in mind? Could he explain why none of the prime ministers from his illustrious family had built the quality state schools India so desperately needs for Indian women and her young people to be given the smallest chance of becoming ‘empowered’? These were obvious follow-up questions that Rahul should have been asked when he rambled on and on about empowerment but Arnab did not get around to asking them and it is this that left me with the clear impression that he was chosen for this ‘scoop’ of an interview on the understanding that he would not harass the Congress Party’s candidate for prime minister. He let Rahul off the hook even on this by allowing him to babble on about how the prime minister is chosen by the party

Rahul needs lessons on politics

A Small Cricket Bat..! A

SMALL table in my living room displays my very modest collection of trophies: A few for writing, one for oratory, some from Rotary Clubs for addressing their meetings, and even one from the Indian Navy for compeering the Navy Week for them. But among all these rather elite dignitaries stands upright, a small wooden cricket bat, on whose broad surface different players have signed. Visitors glance at it, look quizzically at me, and look away. I don’t look a cricketer to them, nor does the bat explain a tale, but a tale there is and such tale will I tell today: Of a tournament called the MTPL, the brain child of an airline’s flight steward, who dreamed a dream of seeing his whole colony forming bonds of friendship through cricket. ‘Bob Uncle you are playing!’ said the boys of the colony, and before I could say ‘Sachin

500 people. For Rahul to have said this indicates that he has learned almost nothing in the ten years that he has been a politician or he should have discovered long, long ago that ‘the system’ currently is his mother. Nobody can get a Congress ticket unless she personally approves and this has been the system since the time Indira Gandhi decided to raise the interests of her family above those of the Congress Party. Those who dissented with this were forced out of Congress and it was renamed Congress (I) for Indira to make things brutally clear to those who wanted to join the party.

Tendulkar,’ there was I on the field playing under a delightfully inspiring captain. “Open the batting!” he told me, “Play your game!” Who was I to tell him the only game I knew was of seeing myself clean bowled every time

BOB’S BANTER Robert Clements I batted. But with fear in my heart and trepidation in my walk I stumbled to the crease lifted the ball, and found it traveling by some God given wind to the boundary for four. ‘Didn’t know you play cricket uncle!’ they said later. I didn’t too. But it was not technique that helped me in my small skirmishes, it was love, the camaraderie, encouragement

After listening to the entire interview more than once what became painfully clear to me was that Rahul had not been taught the history of the Congress Party. What little of it he knows he has picked up from his own life so he sees himself as a sort of poor little political heir who never had any choice but to become a politician because of having been forced to inherit the mantle handed down to him. This is quite simply not true and someone needs to tell him this so that if he is serious about rebuilding the ‘structure’ of the Congress Party he can do it keeping in mind that in imitation of the example set by his family nearly all of the party’s younger MPs have inherited their seats from their daddies and mummies. Has he not noticed this? The other thing that Rahul made painfully clear by giving his interview was that he has become singularly adept at picking up buzzwords like empowerment without fully understanding what these words mean. So the only economic idea he expressed was about India’s failure to build a strong manufacturing sector and admitted that he had heard about this from visitors who came from abroad. If he had paid more attention to this failure he may have noticed that it is the ‘socialist’ policies followed by his own government that have made it impossible for India’s manufacturing sector to acquire the muscle that communist China has been so skillful at building. Before giving his next interview Rahul Gandhi would be well advised to take a few lessons on politics, economics and most importantly history. He may discover that he is not indispensable to the Congress Party and certainly not indispensable to India. So there is no harm in giving up the ‘poison’ of power. and fellowship that egged me on. We won, yes a team called the Model Town Royals, fancy name: Adorned in blue, we played our hearts out for our captain and after two days of grueling sometimes back to back matches, lifted the trophy, and with it a small wooden bat to each member. I look at the bat; it is not about the victory I think, nor the fours I hit or missed, or bowlers who petrified me; all I remember is a tournament that cast its net of joy around a colony of different caste creed and cultures and drew everyone into its embrace. All I remember is a thaal dinner organized by Mazhar the captain, with players sitting around a huge plate, tearing into the most delicious food. All I remember is tens of thousands of rupees being gathered overnight by players for a poor watchman sick in hospital. All I recall are new friendships and smiles twixt players; strangers no more. It’s a small cricket bat, but a big thank you I silently say each time I look at it..! — bobsbanter@gmail.com

SC’s landmark judgement CONGRATULATIONS to the two Supreme court judges for refusing to reconsider its verdict that affirmed the legality of Section 377 and criminalised gay sex, dealing a severe blow to the government’s attempt to have the law changed through a legal — rather than parliamentary — process. Gay rights activists described the Supreme Court’s decision as disappointing, but the judges will have the blessings of various religious groups and their followers as most religious followers are against the rights of the LGBT Community, also keeping in mind that it is against Indian culture. The decision is wholeheartedly welcomed CURBING FREEDOM: The Supreme Court's recent decision to criminalise homosexuality has met with severe criticism from various sections of the society, by the nation. — Mansoor Umer Darvesh, Jogeshwari even while some have supported the decision.

IT is time that national legislators stooped avoiding the issue of Section 377 of the Indian Penal Code. It is up to them to do away with an archaic colonial law that tends to discriminate against a person on the strength of his sexual orientation. This defiance of the basic principal of natural justice in the modern age, must be overcome with direct legislative action, rather than leaving it to the court to decide whether gay sex should

remain a criminal offense in our book of statutes. The Supreme Court has refused to review the judgement on the subject, overturning the 2009 judgement of the Delhi High Court decriminalized gay sex. It is high time that parliament handles the issue keeping in mind that it is a matter of justice, to enable a human being's choice of sexual orientation. — Bhagwan Thadani, Mumbai

I welcome the Supreme Court’s decision to criminalise gay sex. Homosexuality is a disease and people who practice it need shrinks to knock some sense into their heads. If God had intended the human race to be fulfilled with both heterosexual and homosexual marriages, he would have designed our bodies to allow reproduction through both means and made both means of sexual intercourse healthy and natural. — Jubel D’Cruz, Dombivali

Wednesday's proceedings were particularly under the Arms Act on the aspect of illegal arms while the poaching case under the Wildlife Protection Act is going on separately in the same court. The next hearing is fixed for February 14. It was a day of setbacks for Salman as the court rejected his counsel Hastimal Saraswat's plea to postpone the recording of his statement till the hearing on the parallel case was complete.

we notice how the electricity is wasted in just testing. Even at Wankhede Stadium we notice flood lights used two days before the match just for testing purposes. Some time the lights in Fort area and Nariman point are on up to afternoon. We have also seen that Air Conditioners, fans and lights are on in Mantralayas even if not needed. Special treatment to MPs THE reported advisory of the Ministry of Civil Aviation to all the airlines about special treatment to MPs reminds me of a similar directive issued by the Centre during the dark days of the Emergency. That time, an exhaustive circular was issued to all the government departments across the country about the protocol to be followed during the visit of an MP or an MLA to the premises. All have to stand up and salute the VIP visitor, and everyone has to see to it that no stone was left unturned in showing the utmost courtesy and highest respect to the privileged guest. — Arun Malankar, Santacruz

SIT probe of 1984 riots THE SIT investigation proposed by the AAP to provide justice to the 1984 riots in Delhi as an adverse consequence of assassination of the then PM seems to have been agreed to by the Congress. This is a welcome step. The authorities concerned should initiate an SIT probe immediately to bring the culprits to book within a stipulated timeframe. Some investigation seems to have been going on for 30 years which is a sad commentary on a riot said to have butchered about 3,000 Sikhs for no fault of theirs. They were citizens of Delhi and were entitled to be respected and treated well. Let us

hope that the SIT probeshall be productive and unhindered. — T.M. Uday Shankar, Mumbai

Biased treatment EVEN till last week, for the past three decades, the Thackerays have been marauding, burning and damaging property and human life. From the Governor down to the lowest cop, everyone stands silently in awe. No action is ever taken. At best, it is examined and the results are forgotten to be announced! The AAP, on its first outing, makes a bit of a furore and its not liked by anyone! Strange, isn't it? — Jamshed Irani, Grant Road

AAP's 'achievements' THIS refers to your edit-piece 'Achievements of AAP: Most unimpressive' (ADC, Jan. 30) which is laudable for its objectivity and clarity in calling a spade a spade. The hard truth is that this totally new political outfit never had Delhi in its agenda for doing anything good and in fact, much beyond its expectations, got to ruling the city-state so soon for which it was not at all prepared or equipped. If one looks back, it will be seen that Kejriwal and company rode piggy-back on Anna to build some image as anticorruption activists which they used to the hilt in floating a party much against the wishes of Anna himself with the sole aim of reaching the Lok Sabha and the naive Delhiites fell for their tall but false promises to the extent of giving them 28 seats. And most unexpectedly and entirely unnecessarily, the Congress chose to extend outside support to enable it to form a government just to keep the BJP out of power and that was a big chunk of luck. When the so-called aam aadmi's in the party are all busy preparing for the Lok Sabha polls, nothing better can be expected from the upstarts. — Dr. V. Subramanyan, Thane

Tennis Tantrums TIME and again we come across tennis players from India revolting without much of a high power performance in international games. Earlier, both Ramanathan Krishnan and his son Ramesh Krishnan played with significant success but

never opened their mouth in such a silly manner as Paes did recently. The senior Krishnan was two set down, 2-5 down and 0-40 down but still he could pull out an egg out of the hat of a Mexican player. Leander Paes is trying to blame the Tennis Association and fellow players. If he is so great a player he should behave with poise rather than posing problems all the time. If he cannot win an Olympic Medal as he pointed, it is due to the tough challenge in the World of Tennis and for which the Association should not be blamed. By winning doubles matches, the senior pro is talking this much and had he won singles titles like Sampras or Federrer he would have dictated terms all the time. The truth is out now. — S. Jayanthy Maniam, Sion

Tata Sky is being arbitrary TATA Sky has joined the fray of corruption recently with their unethical and selfish methods. Lately they suddenly disconnect many famous channels and pass instructions and advise that your box does not support these channels and are asked to purchase a new box on payment. Customers thus are forced to pay more and purchase new boxes. This is indeed very unethical and wrong. First of all the question arises as to why certain channels which were shown earlier are suddenly withdrawn and service is discontinued and then forced to purchase a new box. This definitely lowers the prestige and dignity of TATA, which was famous for honesty, sincerity and giving selfless service to all its clients who have total faith and confidence in them. Such policies may add to the profit of Tata Sky but it is only fleeces customers. — S.P. Sharma, Mumbai

Who wins 2014? I am not bothered about who becomes the next PM after the Lok Sabha polls in April/May 2014. I just know one thing that any man or woman, whether from NDA, UPA or the third front, would certainly do a better job than the kisan leader of 1979. I cannot imagine anybody worse than him, who remained PM only for 21 days and during those three weeks, flatly refused to face the Lok Sabha. — Jorhat Singh, Kandivali

Homage to the Father of the Nation MAHATMA Gandhi did us proud by getting us freedom from the British rule, and we enjoy the freedom of an independent India thanks to his efforts and those of other illustrious leaders, who took active part in the freedom movement. The struggle, the trials, tribulations and the suffering undertaken by them, gave us the much needed impetus to go out and achieve our goals. 66 years have gone by and it is our duty to value the efforts of the great leaders and pay homage not only Martyr's Day but through the year. Instead, we fight over trivial matters and make a mockery of our freedom by attacking each other. It is our duty to maintain the services of Gandhiji and give him due respect and remember him with an aim to achieve more from this day onwards. — C.K. Ramanathan Iyer, Bhandup

teve McQueen’s 12 Years A Slave, coming with several wins and award nominations, reminds America of its shameful slaving past. There have been films about slaves before—the grim Amistad to the comic book Django Unchained, and several Civil War epics too— but McQueen’s film is an unblinking documentary-like look at the human rights horror that caused untold suffering to so many Africans forced into slavery, something that demeaned the victims and dehumanised the perpetrators. Based on a true story, Solomon

Seeing it now, with McQueen’s sock-‘em kind of treatment, the melodrama is as disturbing as the relentless brutality. FILM REVIEW

Down The Drain

R. BEAN has got his share of those who either love him or hate him, but I must say this modern day comedy show, of a modern day Charlie Chaplin promises loads of laughter for the entire family. The DVD also comes with subtitles, which is strange as the show is 99.9 per cent silent, similar to the Chaplin series. This DVD clocking close to one hour shows the best bits of Mr. Bean which many might have already enjoyed watching on Indian TV. But then getting all the episodes from 1 to 14 on one DVD, helps in enjoying Bean’s antics anytime of the day, especially if you want to calm down a wailing toddler. The 9 episodes here are of Bean’s best holiday moments. So you have Bean creating a scene of himself on the beach - where he tries to change into his swimming trunks, and another time when he tries to dive into a swimming pool where his nerves (and his swimming trunks) get the better of him on the top diving board. You then have him packing for a holiday, later he finds himself on a train with someone who is rather loud and does all he can to get a

more peaceful train journey. The best comes while he’s flying for a holiday, where he tries to cheer up a young unaccompanied boy. The bizarre moments carry on to the golf course, to taking a picture with one of the Royal Guards without making them laugh, and Bean trying to take a train without buying a ticket. His last sojourn is when he enters his little pet teddy bear in a dog show. Though most viewers will think Bean is just being stupid, it still makes you laugh every single time you watch him. This is a gentle, delightful comedy with universal appeal, and though a few bits might be objectionable, but on the whole it just good clean fun. — Verus Ferreira

ne By Two must be the only film ever in which the meet cute device is flatulence. Any film that is so obsessed with bowels, is bound to be flushed down the drain. The potty motif –verbal and visual—is relentless, and you want to send digestive pills to the team that came up with this film. Abhay Deol, who had smartly positioned himself as the thinking viewers’ indie film actor, actually co-produced this tedious, trying-so-hard-to-be-cool flick, about today’s youth. And what does it mean to be young? Needless angst, bad behaviour, drinking binges (with bottles in a potty-shaped cooler), skimping on work and, yes, passing wind. And this sterling example of the new urban youth (youth?) is Amit boring (he is!) And what’s with the several police department poetry slams just so that an uncle (Darshan Jariwalla) can spout silly verse? The girl who has a parallel track— which means lots of split screen, passing by each other, sharing adjoining stalls in the loo (yes that potty fetish!)—is Samara Patel (Preeti Desai) from London, who has an alcoholic mom and stuffed shirt dad (Anish Trivedi) who won’t acknowledge her but gives them a palatial apartment in Mumbai; there’s commitment-phobic boyfriend (Yudhishtr Urs) too. Amit and his loser buddies are responsible for Samara and her chatterbox partner, a street dancer called Bunty (Netarpal Singh Heera) getting evicted from the show, because they manipulated the results for a reason too idiotic to go into. The two unhappy bores really deserve each other, but Bhagat, aiming to make a quirky film, never gets them to meet till the audience is half asleep and not really bothered about how this non love story will end. (There was a poignant foreign film about two people perfect for each other, who never meet, but get people rooting for them to connect, the title slips the mind) Amit sings a number that goes, “I am pakaoed”...the audience shares the sentiment.

LEGAL QUERIES

EXPERT SPEAK is a media-legal consultant on Housing, Intellectual Property, Medico-legal, RTI and Consumer Law issues

SALE OF IMMOVABLE PROPERTY BY AN OSTENSIBLE OWNER A TRANSFER by an ostensible owner cannot be avoided on the ground that the transferor was not authorised thereof, according to Section 41 of the Transfer of Property Act. This, however, is subject to the condition the transferee should take reasonable care to ascertain the transferor had the power to make the transfer and to act in good faith before a benefit thereof is claimed by him. This provision is based on the law of estoppel - if a man has represented the transferor consents to an act which has been done and that he would not offer any opposition thereto, although the same could not have been lawfully done without his consent. By that if he induces others to do that from which they would have abstained normally, he cannot question the legality of the act he so sanctioned to the prejudice of those who have so given faith to his works or to the fair inference to be drawn from the conduct. For one to claim benefits of Section 41 of the Act, it must be proved that the transferor is the ostensible owner; he is so by the consent, express or implied, of the real owner; the transfer is for consideration and the transferee has acted in good faith taking reasonable care to ascertain that the transferor had power to transfer. The purchaser must ascertain from the office of the Registrar that the transferor had the power to transfer the property.

FORCE TO PROTECT PROPERTY TO BE AS MUCH ‘AS NECESSARY’ BY LAW, there is nothing fixed by statute to ascertain the quantum of force that can be used. But, as precedent bears testimony, the force could be to the extent of causing the death of the aggressor. Nevertheless, the issue of force to be used is settled by law that the force used should not be more than what “is necessary”. Also, whether the force used is in excess or not is a question of fact that will be determined by the facts and circumstances of each individual case. There cannot be a generalised solution to the issue of force. Allowances are made by law for the person’s feelings at that point of time which may be incidental to the force needed to protect the property from the aggressor. The law will take into consideration if he is faced with a real apprehension that the aggressor might cause death or grievous hurt or his property is faced with an element of danger. Such apprehensions inevitably create in his mind a sense of excitement and confusion. It is understood that at the opportune moment, the one thought that would be foremost in his mind would be to ward off the imminent danger and save himself or his property. He would be most keen on doing anything possible in exercise of his right. Therefore, while dealing with the issue of whether more force is used than was necessary or justified by the prevailing circumstances, it would be inappropriate to adopt tests of detached objectivity that’s natural in a court room. A transferee pendente lite is bound by the decree just as much as he was a party to the suit. My property is presently under litigation with my sister having moved court over an issue of right to ancestral property and has contested a will drawn up by my father bequeathing the entire property to me. Now, I wish to transfer the property 'as is' to a third party. Can I do it legally or do I need to do it informally? - Gulpreet Kharbanda Section 52 of the Transfer of Property Act (TOPA) is an expression of the principle “pending litigation nothing new should be introduced.” Accordingly, in a litigation concerning property, if any right to such property is a question during the pendency of such litigation, neither party to the litigation can alienate or otherwise deal with such property so as to affect his appointment. This principle specified in Section 53 of TOPA is in accordance with equity, good conscience or justice, because it rest upon an equitable and just foundation that it will be impossible to bring an action or suit to a successful termination. The move is intended to protect the parties to the litigation against alienation by their opponent during the pendency of the suit. A transferee pendente lite is bound by the decree just as much as he was a party to the suit. The principle of lis pendens embodied in the section being a principle of public policy, no question of good faith or bonafide arises, the principle underlying section 52 is that a litigation party is exempted from taking notice of a title acquired during pendency of the litigation. However, mere pendency of a suit does not prevent one if the parties from dealing with the property constituting the subject matter of the suit. The section only postulates a condition that the alienation will in no manner affect the rights of the other party under any decree which may be passed in the suit unless the property was alienated with the permission of the court. To constitute a lis pendens, the following must be present:

Over a period of time, records in a society pile up and it storing these records becomes a problem for societies. The Federation of Cooperative Societies realised this problem and decided to request the Commissioner for Cooperation and Registrar of Cooperative Housing Societies, Pune to prescribe a preservation period for the records maintained by societies so that they could destroy the records after the prescribed period. Accordingly a very exhaustive list of records and various documents to be maintained by societies with varying periods of preservation was prescribed by the Federation. It was referred to the Commissioner for Cooperation and the Registrar of Cooperative societies, Pune who after examining the list accorded his approval to the periods of preservation of the records and documents as suggested by the Federation with slight modifications. Several cooperative housing societies can now take steps to destroy records, which have crossed the preservation periods. TetraVex is a challenging brain teaser. The object of the game is to fill the grid with the tiles so that the patterns on the adjacent edges of each tile match, much like aligning domino tiles. The object of the game is to place all the tiles in the grid so that the figures on the adjacent edges of each tile match. You can place any tile anywhere in the grid, but you cannot place a tile in the grid if its edges do not match all of its neighbors. Find a digit that occurs only once on a given puzzle. You know that this digit must lie along the outer edge of the grid, since there are no other tiles that can match it. You can simplify solving by cutting out the nine squares and juggling them in the grid.

Pawar withdraws transfer application

MUMBAI: Newly-elected Mumbai Cricket Association President Sharad Pawar withdrew his transfer application in the suit filed by senior BJP leader Gopinath Munde. Munde, who had thrown his hat in the ring for MCA president's post, has challenged the rejection of his nomination in the election. Pawar had earlier sought transfer of case to another court. "Pawar's lawyer told the court that they want to withdraw the application with liberty to approach the Bombay High Court," said Munde's lawyer, advocate Vivekanand Gupta. The city civil court allowed the withdrawal. Pawar's transfer application had said that the suit was based upon the interpretation of rules of MCA and the judge had dealt "exhaustively" with them at an earlier stage.

ROSS THE BOSS... New Zealand's Ross Taylor is applauded by India’s MS Dhoni on reaching his century in the fifth and final one-day international cricket match in Wellington. win on the tour, the Men in Blue got off to a disastrously slow start as they needed six overs to get to a double-digit score, losing a wicket in the interim. Rohit Sharma (4) was the first to go, giving slip-catching practice to Taylor in the 5th over bowled by Kyle Mills (2-35). Shikhar Dhawan (9), coming back into the eleven after spending the last match on sidelines, also looked uncomfortable as Henry finally get rid off him, taking this first international wicket. The young pacer wounded up the left-handed batsman in the 10th over of the innings, before inducing an edge which was safely pouched in the slips. India suffer worst defeat in NZ, lose fifth ODI by 87 runs

ELLINGTON: A listless Indian cricket team slumped to its worst ODI series defeat in New Zealand, going down 04, after the Black Caps hammered them by 87 runs in the inconsequential fifth and final one-dayer here. Going into the match trailing 0-3 in the five-match series, the famed India batting came a cropper once again, bundled out for 216 in 49.4 overs by New Zealand, while chasing 304 at Westpac stadium here. Virat Kohli's 82 was the only saving grace as the visitors failed to put up a fight against the Kiwi bowlers, led superbly by debutant Matt Henry (4/38). Earlier, Ross Taylor slammed his second successive hundred to power the hosts to an imposing 303 for five. Besides the tie in the third ODI in Auckland, India had suffered defeats in Napier and Hamilton (twice) and today's defeat continued their disastrous overseas performance as they had lost the ODI series against South Africa before coming here. India had lost 2-5 to New Zealand in a seven-match ODI series in 2002-03. The last time the Indians failed to win even a single match in New Zealand was in 1975-76 and 1980-81, losing 0-2 in both the twomatch series. Put into bat, Taylor (102) shared a 152-run partnership with Kane Williamson (88), who scored his fifth consecutive half-century, for the third wicket to rescue New Zealand from a precarious 41-2 at one stage. Taylor's 106-ball innings was studded with 10 hits to the fence and one six, while Williamson blasted eight fours and one six in his 91-ball innings here. For India, Varun Aaron (2-60) was the most successful bowler, while Bhuvneshwar Kumar (1-48) and Mohammad Shami (1-61) provided decent support. Virat Kohli took the only other wicket to fall, while the spinners, R Ashwin (0-37) and Ravindra Jadeja (0-54) went wicketless. Chasing 304 runs for their first

Afternoon Despatch & Courier

missed a straight delivery from Henry, trying to play it off his legs and was out plumb LBW. India were staring at another massive defeat even as Kohli put up some resistance and finally he found some support in Ambati Rayudu. The latter took his time getting set, hitting two fours off the 40 balls he faced, but he couldn't get past 20 runs. Looking to hit Henry over square on the off-side, Rayudu stepped out and made room only to hit it straight to Williamson. This was a serious blow for India, as the two batsmen had added 48 runs 64 balls, at a decent run-rate of 4.5 per over. Yet again, India were left relying on Dhoni and Kohli and the duo

tried hard, putting up 67 runs for the fifth wicket in 61 balls, stirring some hope for their hapless team. In the 30th over of the innings, Kohli brought up his 30th ODI fifty, off 60 balls with five fours and one six. Immediately thereafter, with the run-rate now climbing past 10-perover, he decided to play big shots and found some success. But he fell in the process, caught at long-on by substitute Peter Young-Husband off Nathan McCullum (1-33) in the 37th over. He scored 82 runs off 78 balls, with seven fours and three sixes. There after, it was another slow procession for the lower-order batsmen as R Ashwin (7) and Ravindra Jadeja (5) failed to provide support to Dhoni.

Ground-breaking series win for us: Brendon McCullum

WELLINGTON: Delighted after drubbing India 4-0 in the justconcluded ODI series, New Zealand skipper Brendon McCullum called it a ground-breaking triumph for his side and the most satisfying of his career so far. New Zealand dominated the five-match series, the third game of which was a tie, even though India were considered handsdown favourites at the start of it. The Kiwis' fantastic run ended India's reign at the top of the ICC ODI rankings. "From an ODI point of view, this series is the most satisfying I have been a part of," said McCullum after the fifth and final ODI which the Kiwis won by 87 runs. "India arrived here as the number one ODI team in the world and not many expected us to compete with them, let alone get a series white wash. We are delighted with the way we played in this series especially on the back of fine performances from Ross Taylor and Kane Williamson, and also the way our bowlers stepped up. Overall, it was a ground breaking series for us," he added. When asked pertinently if Team India had proven worthy opponents, McCullum said he respected Mahendra Singh Dhoni's men. "We didn't allow them to play to their potential. But they are a very good team. The Indian cricketers all have proven careers and proven statistics over a period of time," he said. "We were very respectful of their standing in the game as the number one team when they arrived on our shores and for us as the number eight team to put in a performance to topple these guys is something that makes this victory even sweeter," he added.

Wasim Jaffer against expulsion of Mumbai coach By Neil Joshi

M

UMBAI: Former Mumbai skipper Wasim Jaffer voiced his support for ousted Mumbai coach Sulakshan Kulkarni after Mumbai got a drubbing in the Ranji Trophy quarter-final match against Maharashtra. Speaking at an event which will see Indian Oil host the 34th Petroleum Sports Promotion Board Inter Unit T20 cricket tournament which is to be held from February 3-7 in Mumbai, Jaffer said the decision by the Mumbai Cricket Association was premature and 'harsh' to the coach and added that the coach should have been allowed to complete the season before assessing his performance. “The Mumbai team had last season lifted the Ranji Trophy title under the same coach and this year were playing without big names like Sachin Tendulkar [retired], Zaheer

Khan, Rohit Sharma and Ajinkya Rahane [India duty] and had to get in fresh talent for the season,” Jaffer said The highest run getter in domestic cricket in India Jaffer said that to expect the same results from the current team to to the team won the

Ranji Trophy title was incorrect. “I kept on saying that to expect the same performances from the younger players [as compared to the seniors] would be hard because we had a different team last year also. So to take out the anger and disappointment on the coach is slightly harsh,” said Jaffer. Mumbai on a whole had a bad season with none of the teams across various age groups making any sort of impact in the national circuit. Jaffer said that Kulkarni was the only coach across all categories that took Mumbai to the knock out stage. “It obviously looks bad because out of all teams across different age groups, the Ranji Trophy team was the only team that got through to the knock out stage and the coach of that team has been sacked. It is not a nice thing. Probably they should have waited for the one day tournament

and the T20 to finish and taken a decision then,” he said. Due to national commitments, the Mumbai team played under various skippers, and hence there must have been different ideas floating about in the dressing room, however, he insisted the it was the skipper who depends on his intuition to take his team through. “The captain has his own ideas, the coach can only give his inputs. The boss is always the captain because he is there to handle the players and he is the one to take the decision. You would take everybody's advice but at the end of the day, it is the captain who delivers and he should get charge. You can say, the captain may not have listened to the coach's advice but whoever is there by the end of the day you have an intuition and you stick to that. I did not have a problem [with Kulkarni],” he added.

NDORE: Yuki Bhambri overcame a mid-match foot injury to down Chinese Taipei's number one player Tsung Hua Yang and give India a 1-0 lead in the Asia/Oceania Group I Davis Cup tie. Yuki was cruising at one stage but a right ankle problem in the third set hampered his progress. However, he battled out pain and his sluggish rival for a 6-2 6-4 6-7 (1) 6-3 win in two hours and 52 minutes. Now, Somdev will lock horns with Ti Chen in the second singles rubber. The battle between the two former junior world number one players was turning out to be quite comfortable

for the Indian but Yuki's injury in the ninth game of the third set almost scuttled the home team's chances in the opening rubber of the first round. It was surprising that Yang could not dictate terms even when Yuki was struggling to serve and his movement was restricted severely. Yang had a fantastic opportunity to push Yuki out of the match but he blew away the chance with his error-prone game. To his credit, Yuki did not give up and kept fighting and his persistence finally paid. At the start, Yuki started dominating the contest with stupendous control over his shots. He kept

‘Last goodbye to 22 yards’ now on social media NEW DELHI: A documentary charting the euphoria around the final days of legendary Indian cricketer Sachin Tendulkar in the game will be available on social media platforms, including Youtube from today. The film brings out people emotions during Tendulkar's last Ranji Trophy encounter in Haryana and the final Test-series against the West Indies in November last year. The documentary, prepared by sports journalist Jasvinder Sidhu, is called "Last Goodbye to 22 yards". "This film is a tribute to the greatest cricketer the world has ever seen. This 38-minute film, subtitled in English, is like a documentary evidence of what exactly Sachin means to India," said Sidhu. "It has been an amazing experience making this film. From a three-year-old girl to a 64year-old retired government official, everyone eagerly wanted to be a part of Sachin's journey," he said.

the ball in and targeted the lines for winners. Yang started to struggle after a disputed call in the fifth game, when he was facing two break points, disturbed his rhythm. Yang thought he had served an ace but the linesman called it out which the umpire did not notice. Yang had no option but to go for a second serve. He somehow saved the first chance but Yuki smashed a forehand winner to convert the breakpoint for a 3-2 lead. The Indian consolidated the lead in the next game, which he served out with his first ace of the match. Yuki set up the points with ease, specially the easy put away volleys and was consistently hitting winners. Yang was struggling to keep the ball in as unforced errors crept into his game. In no time, Yuki was up 5-2 and he served out the set in just 32 minutes. Yuki was running away with the match as he opened up a huge 52 lead in the second set by breaking Yang twice. But suddenly the Indian started to lose control over his shots. He failed to serve out the set as a double fault at 15-30 and the following unforced error put him down by two break points. He hit a backhand long, handing Yang his first break of the match.
