For the fourth year in a row, this special day unites all runners to celebrate the Independence Day of Ukraine. This event is possible due to the idea of the inspirer of Vyshyvanka run and Master of Sports, International Class, Alexander Kuzin and the president of NGO "Sports fans federation" Natalia Galatsan. On Rusanivska Quay, professional athletes, amateur runners, children of preschool and school age, dressed in Vyshyvanka T-shirts will overcome the chosen distance (from 100 m for the youngest runners to 10 km for experienced athletes). The Association Agreement between Ukraine and the European Union was approved!

On July 11, 2017, the European Council completed the ratification of the Association Agreement with Ukraine, a fundamental step towards reinforcing the EU-Ukraine partnership that will now provide new impetus to the cooperation in areas such as foreign and security policy, justice, freedom and security (including migration) taxation, public finance management, science and technology, education and information society. The full implementation of the agreement between Ukraine and the European Union will begin on September 1, 2017.

Successful launching of Promenade performance “Time”/ “Vremya” Starting in July, Kiev citizens and visitors of the city can participate in the creative theatrical performance “Vremya” organized by U!ZAHVATI team. It is a really new and unusual show, as well as an amazing opportunity to stay alone with yourself and your thoughts for 90 minutes while taking a fresh look at already familiar places, streets, and the city. Instead of the traditional sitting and watching a performance on the stage, a group of 33 people moves around the city following instructions of a voice speaking through headphones that immerse you in the world of time. Note, that all performances are conducted only in Russian. The performance starts on the Pedestrian Bridge and is conducted from July until the end of September at 7 pm on Tuesday, Wednesday, Thursday and at 11 am, 13 pm, 15 pm, 17 pm on weekends.

A BRIEF HISTORY OF UKRAINE SINCE INDEPENDENCE

Introduction Ukraine is the largest European country located in Eastern Europe. Archaeological excavations prove that the region of present day Ukraine has been inhabited since 32,000 BC. In the Middle Ages, the territory of Ukraine was a center of Slavic culture, with the powerful state of Kievan Rus based on Ukrainian identity. Modern Ukraine only gained its independence in 1991. A young country with deep cultural roots and a diverse history has experienced explosive, rapid changes and challenges since its sovereignty. The world’s best known newspapers frequently put Ukraine on their front pages. Due to its geopolitical location, large economic market, human and natural resources, Ukraine has always attracted the attention of foreign countries and corporations alike. 10 Kiev Check-In

Independence of Ukraine 16 July 1990 is one of the most critically important days for Ukraine as the day when the “Declaration of State Sovereignty of Ukraine” came into force. This document stated the dominance of Ukrainian law over Soviet law in the country’s borders, it also promoted democratic principles, independence, and personal freedoms. On August 24, 1991, the Ukrainian Government adopted the “Act of Independence.” When the Soviet Union (USSR) collapsed, Ukraine was one of the most prosperous post-soviet countries in terms of education, scientific, and industrial enterprises. What’s more, Ukraine had a well-developed agricultural sector, as well as a powerful military-industrial complex, including several of the USSR’s leading ventures, like missile munitions, heavy aircraft, and tanks. Ukraine also had a large pool of scientists, engineers, and managerial human resources. At the beginning of 1992, nearly 1,240 nuclear warheads and 3,000 units of tactical nuclear weapons were stored throughout Ukraine. Later, in 1994, Ukraine agreed to join the Treaty on the Non-Proliferation of Nuclear Weapons and signed the socalled Budapest Memorandum. Under the conditions of mentioned agreements, all weapons were dismantled and taken from Ukraine to Russia; whereas Russia, Great Britain and the United States agreed to respect the independence, sovereignty, and existing borders of Ukraine and reaffirmed their obligation to refrain from the threat or use of force against the territorial integrity or political independence of Ukraine. However, there were a number of weaknesses in the Ukrainian economy: - When Ukraine gained its independence, it did not have its own monetary system or gold and foreign exchange reserves. USSR republics did not have the necessary experience in foreign markets, which is important for any country with a market economy. - Ukraine gained independence and almost immediately suffered a crisis throughout all sectors of the economy, culture, science and so on. This crisis significantly complicated solutions for its two major problems: the construction of Ukraine’s own state and transformation to a market economy. - Goods produced in the USSR (and in particular, in Ukraine) were not competitive in foreign markets. - Chernobyl accident still required large material outlays. These factors made it more complicated to overcome the crisis during www.kievcheckin.com

independence. During the depression in the 1990s, Ukraine suffered from hyperinflation and a significant fall in economic output. In 1996, the new Government adopted the Constitution of Ukraine, which stabilized the political system. In September of the same year, a monetary reform was implemented and a new currency (hryvnia) was introduced.

Orange Revolution In the autumn of 2004 in Kiev, the Ukrainian capital, as well as in many other Ukrainian cities, thousands of protesters took to the streets to demonstrate against massive corruption, voting falsification, and electoral fraud during the 2004 Ukrainian presidential election. The so-called Orange Ukrainian Revolution succeeded when the results of the original election were declared VOID by Ukraine’s Supreme Court decision as of December 3, 2004. Such Supreme Court decision simultaneously ordered a redo of the presidential election. On December 26, 2004, under the close inspection of both Ukrainian

Euromaidan In 2013, the “Euromaidan” revolution opened a new chapter in Ukrainian history. Euromaidan started as a protest against sudden decision of Victor Yanukovich,

and international observers, this new presidential election was recognized as "fair and free." The final results showed a clear victory for Victor Yushchenko with 52% of votes against 48 % of votes of Victor Yanukovich. Victor Yushchenko became the third Ukrainian president after his inauguration on January 23, 2005. Despite a number of reforms made by Government of Victor Yushchenko and economic growth in the time of his presidency, people were mostly disappointed by his rule. The main negative factors were constant disagreements within Victor Yushchenko’s party as well as contradictions with Yulia Timoshenko who was appointed as Prime Minister by Victor Yushchenko on February 5, 2005, and dismissed in September of the same year. Later, under Yushchenko’s rule, the 2008 world crisis shook Ukraine’s economy which increased Ukrainians’ dissatisfaction. Victor Yanukovich was dismissed. At the next presidential election, May 25, 2014, Petro Poroshenko won the election with more than 50% of Ukrainians voting for him. His policy focused on a creation of a strong relationship with Europe. The Russian Federation was displeased with the election results. Pro-Russian propaganda in the Crimea and East Ukrainian regions (which were traditionally close to Russia) lead to an escalation of conflict in the Eastern Ukraine which started an armed conflict between the self-declared Donetsk and Lugansk People’s Republics and the new Ukrainian Government. In addition, Russian troops entered the Crimea and captured strategic state institutions. Soon, referendums of unrecognized status were held on the occupied territories. Russia declared that Crimea joined the Russian Federation in accordance with such a referendum decision. The results of such referendums, as well as the reunion of Crimea with the Russian Federation, is not recognized either by Ukrainian Government nor by international society. Ukraine recognized Crimea and part of Eastern Ukraine as occupied territory. Since 2014, officials from the EU, Ukraine, Russia, and United States have held a number of meetings to establish a dialogue that could de-escalate the conflict. In the Eastern Ukraine, at present, there is a constant confrontation between Ukrainian army and pro-Russian anti-government groups supported by the Russian army. Political instability and loss of control over large parts of Ukrainian territory caused significant economic losses for Ukraine as well as for Ukrainian businesses.

Lasting armed conflict in Eastern Ukraine, increased unemployment and depreciation of national currency Hryvna (from 8 to 25 Hryvna per 1 USD) significantly reduced the Ukrainian quality of life. On January 1, 2016, Ukraine joined The Deep and Comprehensive Free Trade Areas (DCFTA) with the European Union. Starting in June 2017, there is a visa liberalization for Ukrainian citizens who were granted visa free travel to the Schengen area. Then, on July 11 2017, the European Council approved a decision to conclude the Association Agreement with Ukraine that is the final step of the ratification process through which the EU and Ukraine commit to a close, long-term relationship in all main policy areas. Integration with Europe is a priority for Ukrainian Government. There are constant changes in the governmental structures and legislation with the purpose of simplifying doing business in Ukraine and reaching European standards. Many European Non-Governmental organizations such as OSCE are present in Ukraine and helping Ukraine to achieve their mission of closer integration with

Europe. With international support, Ukraine is working towards resolving the conflict in the eastern territories. In order to raise public knowledge and awareness about the importance of English as the language of business and globalization, the Ukrainian government is promoting the language through establishing English as a mandatory subject beginning in the 1st grade of primary school. Additionally, starting from 2015 free of charge courses of English for country officials, police officers, and ordinary Ukrainians were organized. Key Ukrainian universities tend to invite foreign professors to teach courses for their students in English as well as many international student-exchange programs are organized. Also, in contemporary Ukraine, there are many private language schools with increasing number enrollment every year.

Summary Ukraine is a promising, up-and-coming, developing country that hopes to become a member of the European Union in the future. Interview with Ambassador of Pakistan in Ukraine H.E. Athar Abbas, a two-star general and a former military spokesperson for the Pakistan Defence Forces, is a diplomat and military expert who serves as the Ambassador of Pakistan in Kiev since 2015. As Pakistan and Ukraine are celebrating Silver Jubilee of Bilateral Relations (1992-2017) with their Independence Day in August, H.E. Your Excellency, is Ukraine an attractive destination for Pakistani students for international education? What challenges currently exist in this space?

Your Excellency, we greatly appreciate you taking the time from your busy schedule for this interview. Since your appointment as the Ambassador of Pakistan in Ukraine, how do you find the Ukrainian nation and its people? I have a great respect and appreciation for Ukrainian people and the nation. I truly admire their resilience and courage to face various challenges during present times. Despite an economic crunch, I found Ukrainian people very resilient and dedicated to their work. Ukraine is also rich in ancient art and with a unique culture. The street art and handicrafts here are innovative and amazing. We have been able to collect quite a few pieces to carry home. We think we are very fortunate to have been posted here.

This interview coincides with the Independence Day of Pakistan and Independence Day of Ukraine in the month of August. What are the major areas of trade between the two countries? Are you satisfied with the current volume of trade? What measures do you feel should be taken to increase this? The major areas of trade between Ukraine and Pakistan are agricultural products, sports and surgical instruments. There is a great desire to increase the volume of trade in textile products, leather goods, fruits (particularly oranges), surgical instruments, metal scrap, and IT industry. We have been able to connect and organize the meetings between two

Ukraine is a very attractive destination for Pakistani students in many disciplines. Around 500 Pakistani students are studying in various universities both private and public in Ukraine. Pakistani students find medical education an attractive discipline. There are many students in Kharkiv medical university and Ternopil medical university. Our effort is to connect the universities of both countries in exchange programs as well. In this regard, International Relations Department of Taras Shevchenko University has been connected with International Relations Department of Quaid-i-Azam University. A seminar on Skype was also held this year with participation of both country’s ambassadors followed by a visit from the Head of International Relations Department, T.S. University to Quaid-i-Azam University, Islamabad. We have more such projects in pipeline. The main challenges in education sector are language, diploma/ degree equivalence system, and lack of awareness about existing quality of education in both the countries.

What is the current level of tourism between the two nations and what steps is the Embassy taking to promote this? Do you see a big potential in this field? The current state of tourism is not satisfactory. We are trying our best to promote this area. I have held several meetings with concerned tourism organizations. The key challenges: how to overcome the barriers of language and distance? а) Liberalize visa process. b) Increase the volume of civilian 0 business and trade like the trade and cooperation in defence sector, is on the right trajectory. c) Enhance socio-cultural exchanges 0 between the art/cultural/musical groups and organizations of both the countries. d) Publicize the tourism potential of 0 Pakistan appealing Ukrainian audience. e) Facilitate the sports teams of both the countries to participate in each others’ sports competitions and learn from each other. f ) To promote military ties focusing on training the counter terrorism as Pakistan has acquired rich experience in this field during operations on Pak-Afghan border and a successful handling of internal security situation.

What are your recommendations for Ukrainian businesses that wish to explore the market of Pakistan and Pakistani businesses that are interested in Ukraine? a)_Ukrainian businesses: Please visit Pakistan to explore the Pakistani market for importing raw cotton, cotton bales, textile fabrics, surgical instruments, fruits like oranges, apples, leather goods, high quality rice, lentils and see the feasibility and opportunities to participate in the China-Pakistan Economic Corridor (CPEC) and its related projects, like infrastructure development requiring massive quantities of imported steel. b)_Pakistani businesses: Please visit Ukraine to import metal scrap, IT equipment, machinery, telecommunication equipment, sunflower oil and seeds, wheat, material related to shipping industry and mining industry, equipment related to defence industries. Import material required for CPEC projects.

Is Pakistan a safe country to visit? What would be your advice to Ukrainians who are interested in such a trip? Pakistan is a nation of 200 million people. It has fought a war against violent extremism and has cleared a vast territory occupied by terrorists at its border with Afghanistan. It has paid a heavy toll. Over 60,000 people have been killed, including 6,000 armed forces officers and soldiers. It has brought peace and order to the area. It is very safe to visit Pakistan and travel around the country. Every year hundreds of tourist around the world travel to Pakistan and share their experiences, on social media. It is safe and very economical to travel and move around in Pakistan.

Tell us about your favourite place in Kiev and why.

Our favourite place in Kiev is Andriyivskyy Descent. On weekends, we find the street full of art and crafts, different kinds of beautiful paintings. We enjoy the hustle–bustle of the street full of locals and foreigners. We appreciate the local artists for their skills and aesthetic sense to represent Ukrainian art and culture. We make it a point that none of our personal and official guests leave Kiev without visiting Andriyivskyy Descent.

Dr. Olena Bordilovska, a professor in the Department of International Relations at Kyiv Taras Shevchenko National University, visited Pakistan on a lecture tour in May 2017. Among other things, Dr. Bordilovska contributed to the signing of Memorandum

Pakistan hosted leading European and Asian skiers from 12 countries in a Ski competition at Malam Jabba, Swat from January 24 – February 3, 2017. Ukraine also participated with four members team in the event. The Ukrainian skiers outclassed their rivals in both men and women categories. In Men’s Giant Slalom category, Ukraine’s Ivan Kovasnkyuk and Vasyle Telychuk placed first and third position respectively while the second spot was secured by Slovakia’s Jan Jakooba. In Women’s Giant Slalom category, Ukraine athletes Tetyana Tikun and Anastasia Gorbunova placed first and second respectively.

UKRAINIAN CYCLIST IN PAKISTAN

Ruslan Verin, a resident of Odessa, traveled to Pakistan as a cyclist crossing through Turkey and Iran, entering Pakistan in December 2016. He appreciated the Pakistani people’s hospitality, delicious food, and rich traditional values. After cycling through Iran, I entered Pakistan and found myself in Balochistan province that has some dangerous areas, so the government allocates armed escorts to every foreigner who travels here! However, once I started exploring different cities and meeting local people, everything became brighter for me! I truly enjoyed the beautiful

scenery and landscapes here. I even got caught in a small sandstorm. People are the main attraction of every country and Pakistan is no exception! From three weeks in Pakistan, I never slept in a tent! I spent a couple of nights in a hotel, a few nights in police stations (in Pakistan, you can ask for absolutely free accommodation for a night at the police station and can even be treated to dinner and breakfast), a few nights at the Ukrainian Embassy where people also greeted me with warmth and hospitality but mostly at houses of locals. I was also invited to two weddings. I remember during one of them, they turned on a Ukrainian song and all the guests (more than thousand people) welcomed me with applause. The special attention should be paid to Pakistani food I miss so much, it’s really exotic for us!!! It seems that food here is either spicy (fiery !!!! extremely hot !!) or sweet (so much that sugar seems not sweet by comparison! I have no idea how they make it). But somehow it is very delicious! And it’s hard to stop eating it! Overall, I am just really happy and satisfied with my trip to Pakistan. So many stories and truly unforgettable adventures, I definitely wish to come again!”

I knew this country’s image suffers from stereotypes, accusals of terrorism, and human rights violations. This makes our two countries quite similar as Ukraine also suffers from many of the same issues. I hoped to see the “real” Pakistan as it is. Thankfully, my hopes were not just realized - the country I had been dreaming to visit for some time turned out to be amazingly hospitable with sincere, welcoming people. My talks with colleagues and students were very intense and professional. So, you should not be afraid and biased. I did not see any fundamentalists and terrorists (maybe I didn’t get chance to). Although according to local customs, a woman doesn’t walk the streets alone, it is also more comfortable to be in a company of men. I also realized how beautiful Pakistani women are! I was amazed by their authentic fashion that is traditional but with regular modifications, bright colors, and different ornaments presented everywhere as well as perfumes, jewelry, accessories! The accomplishments of such beauties are very reasonable!”

Malala Yousafzai born on July 12, 1997, is a Pakistani activist for female education and the youngest-ever Nobel Prize laureate. She is known for human rights advocacy, especially the right to education of women in her native Swat Valley in Khyber Pakhtunkhwa, northwest Pakistan, where the local Taliban banned girls from attending school at times. Since then her advocacy has grown into an international movement. On October 9, 2012, in the afternoon, Yousafzai was injured after a Taliban gunman had attempted to murder her. Yousafzai remained unconscious, in a critical state at the Rawalpindi Institute of Cardiology, but later her physical condition improved enough to send her to the Queen Elizabeth Hospital in Birmingham, the UK. Since recovering, Yousafzai has become a prominent education activist and co-founder of the Malala Fund with her father Ziauddin and in 2013 co-author of I am Malala, an international bestseller. In 2015, Yousafzai was a subject of the Oscar-shortlisted documentary He Named Me Malala. The 2013, 2014 and 2015 issues of Time magazine featured her as

one of the most Influential people all over the world. In 2012, she was the recipient of Pakistan’s first National Youth Peace Prize and in the 2013 of Sakharov Prize. In 2014, she was announced as the co-recipient of the 2014 Nobel Peace Prize, together with Kailash Satyarthi, for her struggle against the suppression of children and young people and for the right to education of all children.

The EU is the single largest trading partner of Pakistan absorbing over one-third of the Pakistani exports. In 2016, the volume of trade between Ukraine and Pakistan amounted to approximately 162 million US dollars which points to a large untapped potential of economic cooperation between the two countries. According to the Ukrainian Ambassador to Pakistan, Volodymyr Lakomov, the two countries intend to raise it to US$ 1 billion during the next five years. Main Industries Textile The textile and apparel sector continues to be the driving force for economic growth in Pakistan. During 2015-2016, it contributed $10.395 billion to the national economy comprising 57% of Pakistan’s total export revenues. Cotton is the largest segment of textile production. Other fibers produced include synthetic fiber, filament yarn, art silk, wool, and jute. Cotton industry in Pakistan mainly specializes in intermediate goods (yarn and grey fabric), as well as towels and bed linen. RECENT EVENTS ORGANIZED BY EMBASSY OF PAKISTAN PAKISTAN DAY RECEPTION The Embassy organized a Reception on 23rd March at Hilton Kyiv to celebrate National Day of Pakistan. Minister on European Integration, Mrs. Olga Trofimtseva, was the chief guest. Around 300 people attended the ceremony including members of Ukrainian Parliament, high-level government officials, Ambassadors and

diplomats, media personnel, prominent Ukrainians and Pakistanis. The venue was decorated with traditional handicraft

of Pakistan, banners, and poster stands depicting Pakistan’s soft image. Ms. Kamalia, the Ukrainian star singer sung the national anthem of Ukraine and famous Pakistani songs. The guests were also entertained by performance of Taras Shevchenko University students wearing traditional Pakistani dresses projecting traditional marriage ceremony. The guests were served with variety of Pakistani cuisine.

SPOUSE CLUB EVENT “TIE & DYE” Mrs. Seema Athar, the spouse of Ambassador H.E. Athar Abbas, hosted lunch on 19th April 2017 for spouses of diplomatic corps in Kiev. A number of traditional Pakistani dishes were served and enjoyed by the participants. Besides lunch, Mrs. Seema also introduced and demonstrated the art of tie & dye of fabrics being accepted as one of the contemporary garment embellishment techniques, which was practiced and highly appreciated by all. The spouses made their individual stoles and scarfs during the demonstration.

CITY COUNCIL EVENT PARTICIPATION In June 2016, a very colourful event was planned by the City Council in which all the countries got the opportunity to present their culture and traditions. The Pakistan Embassy took an active part on this occasion. In the reception area, a documentary film was played which portrayed all aspects about the country. The main hall of the City Council was decorated by the committee with flowers and other decor which included the giant size flags of the different countries. An attractive display of crafts including the wood and silverware, handmade multi coloured pottery, hand painted items and embroideries were nicely arranged in a walk-in stall of Pakistan. A very famous sweet dish “Gulab Jamun” was one of the main attraction as it was being offered to all those who were visiting the stall. “Henna” application was also one of the favourite of all ladies and the stall had long queues in waiting.

IWCK CHARITY BAZAAR The International Women’s Club of Kyiv (IWCK) hosted the 24th Charity Bazaar on December 3, 2016, at Olimpiyskiy National Sports Complex in Kiev. More than forty embassies, international organizations, and representatives from Ukrainian business and cultural centers came together to raise funds for charity to benefit Ukrainian women, children, the disabled, and the elderly. The embassy of Pakistan also participated in the event decorating its pavilion with traditional clothing, handicrafts, and artifacts. Attendees admired traditional artifacts and keenly purchased many from Pakistan pavilion.

BRIDGES I would not be surprised if you already know that watching sunsets and sunrises from bridges is always incredible. At over 700 meters long, the Moskovskyi Bridge is very unique. As the main transportation artery of the Ukrainian capital, it consists of 2 separate parts and connects the banks of the Dnipro and Desenka rivers. Crossing the Moskovskyi bridge will take you to the remote region of Kiev, Troyeshchyna, that’s why locals often jokingly call it “the road of life.” It is also considered one of the best bridges in the city for sunrises and is also a favourite place for photographers and locals to spend time standing and staring. While it is overcrowded with traffic during the day, it will seem peaceful at dawn when you will be rewarded with

a rare Obolon view, a wide panorama of Podil and Petrivka, if you’re not too lazy to get up early in the morning and explore the sights from both sides of the bridge. In order to do that, return to the underground passage in the middle of the bridge. Additionally, you can easily get around the city using metro, which is cheap and covers all the main destinations in Kiev. One way ticket regardless of your destination costs only 4 UAH. Note that during morning and evening rush hours, metro can be quite crowded. For safety, keep your belongings under your watchful eyes in metro and any other crowded places.

Regardless of the still weak political, legal, and financial climate in the country, Ukraine has an excellent geographic location, the largest territory in Europe, rich natural resources, and a low cost but skilled workforce. Ukraine’s confusing regulatory regime, ever-changing regulations and significant red tape can cost foreign investors significant money and time. In our experience, every day we encounter front-facing government staff, bank representatives, private consultants, and notaries who are not aware of the latest changes and provide incorrect information. But these challenges are by no means insurmountable, the savvy entrepreneur can easily find his/her way past to make some great investments. Here’s a list of business tips for any foreign individual exploring doing business or investing in Ukraine. Note that law and regulations change frequently, therefore always consult for the latest updates before making any decisions!

PERSONAL BANK ACCOUNTS As a foreign national (resident or non-resident), you are allowed to open the following types of personal bank accounts in Ukraine: • Regular current and savings accounts in the local currency UAH and selected foreign currencies. • An Investment Account that allows foreigners to make investments into Ukraine and subsequently repatriate profits and capital out of the country. Keep the following points in mind when opening and operating your bank account in Ukraine: • Rules for bank accounts vary depending on the type and are strictly regulated by Ukrainian Banking law. For example, you are not allowed to withdraw cash from your investment bank account (whereas it is possible from a regular current bank account). Therefore, use the type of bank account that corresponds to your planned purpose and transactions.

• While you are free to deposit money into these accounts from overseas and bonafide local payments, cash withdrawals in foreign currency as well as overseas transfers are subject to certain limits at present (depending on types of bank account and transaction). These restrictions are a result of the currency controls imposed by the government mainly because of the political and economic crisis that started in 2013 and still lingers today. They apply both to businesses as well as individuals, although the specific rules may vary. • You can use your debit card (linked to your regular current account) when making purchases overseas as well as withdraw cash, subject to certain limits.

STARTING A COMPANY While there are a number of different business structures available in Ukraine, the most suitable limited liability structure for a small- to mid-sized business in Ukraine is a Limited Liability Company (LLC). Both resident and non-resident foreigners are free to incorporate a LLC and can be 100% shareholders of the company. Points to note when opening a LLC: • The process of incorporating a company is fairly straightforward and can be completed in 1-2 working days after all the necessary documents are ready. • Prior to registration of an LLC, foreign shareholders need to obtain a Ukrainian tax number. • The director of an LLC can be only an individual who has right to reside in Ukraine (a citizen of Ukraine, or a permanent citizen or foreign individual who has obtained a work and residence permit in Ukraine). Corporate directors are not permitted. • A Ukrainian company must have a local registered address. • Foreign entrepreneurs who wish to relocate to Ukraine to operate their company can apply for relocation visa (work permit & residence permit), which is subject to approval by authorities. WORK AND RESIDENCE PERMITS Work permits and residence permits are two different permits issued to foreigners. With the exception of few situations, both permits are required when relocating to operate or work for a company in Ukraine. Keep in mind the following: • Foreign entrepreneurs who have opened their LLC company in Ukraine will need to apply for both permits if they wish to relocate to Ukraine. The same is true when the LLC is hiring other foreign staff. • Certain categories of foreign citizens (such as permanent residents of Ukraine, employees of representative offices and permanent establishments of foreign companies, representatives of foreign mass media, professional athletes, artists and some others) do not need to apply for work permits when working in Ukraine (but they still need to obtain residence permits). However, in most other cases, a valid work permit is required before commencing work. • The processing time for a work permit application is about 1 month. • After the work permit application has been approved, the permit holder must obtain a temporary residence permit if he/she plans to relocate to Ukraine to work. Family members are also eligible to obtain the temporary residence permit. • Obtaining a residence permit takes up to 15 days upon application. • Both work permit and temporary residence permit applications are subject to review and approval by government authorities. Due to attractive prices in the current Ukrainian real-estate market, foreign investors are increasingly interested in purchasing residential property here. However, the real-estate market in Ukraine is not very mature and therefore often fraught with significant difficulties and risks at almost every step of the transaction. It’s extremely important to work with a knowledgeable and trustworthy legal advisor when dealing with real-estate in Ukraine. Here are some basic guidelines: • It is important to perform the deal and payment strictly in accordance with Ukrainian Civil, Banking and Investment law to avoid future difficulties with repatriation of investments and investment income. • Proper due diligence as well as proper legal planning and examination of real-estate transactions are crucial while investing in real-estate in Ukraine due to risk of fraud. • The commission of real-estate agencies is typically around 3–5% from the real-estate purchase price, payable only if the deal is concluded. Real-estate agencies are not regulated and do not require a license to operate. Therefore, we highly recommend that you also use an independent real-estate legal advisor to assist you with proper advice when concluding your transaction.

PAYING FOR INVESTMENTS Foreign nationals are allowed to pay for their investments in Ukraine (opening a business, buying real-estate or other type of investment) in two possible ways: • Directly from their account overseas (in this case, payment is made in foreign currency); -or• By opening an investment bank account in Ukraine. In this case, the foreign national must transfer money in foreign currency to the investment account, convert it to local currency hryvna (UAH), and then pay for the investment in the local currency. Note that an investment account is the only type of bank account in Ukraine for foreign individuals that allows them to make settlements for their investments.

• Social security tax: 22% (applicable as part of payroll tax) • VAT: 20% • Individuals registered as Private Entrepreneur (similar to Sole Proprietorship in other countries) and listed under the Simplified Tax Scheme (3rd Group): 3–5% Note that the Ukrainian tax code defines specific rates for certain types of income or transactions which can be different from the ones mentioned above. In addition, some types of income/transactions are exempt from taxation. Therefore, to define applicable tax rate for each specific case, it is important to get professional advice.

GETTING A UKRAINIAN TAX NUMBER As a foreigner, if you are planning to work, invest, or start a business in Ukraine, most likely you will need to obtain a Ukrainian tax number. Therefore, it’s usually a good idea to get this done as soon as possible. If you are overseas, the application for tax number can be filed by your representative in Ukraine under a Power of Attorney. The application processing time is about 5 working days.

HIRING STAFF In Ukraine, a company can hire people either under labour agreement (i.e. as a salaried employee) or under civil services agreement (i.e. as a freelancer, provided the person being hired is registered as a Private Entrepreneur (PE)). If hired as a salaried employee, the company should assume roughly 40% tax overhead on top of the salary in-hand to the employee. On the other hand, in a freelancing arrangement, the salary tax burden

is approx. 5%. As a result of this anomaly, many companies tend to reduce their costs by arranging staff as a mix of freelancers and full-time staff. However, such a structure requires careful tax and legal planning in order to avoid getting on the wrong side of the law.

MISTAKES IN DOCUMENTATION This is the last tip we have for you today, but it is certainly not the least! Unfortunately in Ukraine, you will often find that important agreements and documents that are prepared for you may contain misprints and errors. This can be caused by a number of reasons including lack of professional quality controls, lack of use of computer technology and automation or overworked staff. What should you do?
