Last Month’s Highlights We did it! - Visa-Free Travel for Ukrainians to the Schengen Area Finally, starting on the 11th of June, 2017, Ukrainian citizens holding biometric passports can travel to the Schengen Zone without a visa for a 90 day period within any 180-day period for purposes other than work. Additionally, a visa is no longer required for travel to Cyprus, Romania, Bulgaria, and Croatia which are about to join Schengen Area. The main requirement for Ukrainians willing to travel to the Schengen area visa-free is a valid biometric passport; additionally, border guards may require documents supporting the nature of the

Kiev and Lviv as well as Eurowings and Pegasus Airlines who both hope to start flying to Ukraine soon.

On June 18, at 8 o’clock in the morning, the large-scale Marathon Without Rush took place on Khreshchatyk Street. Held in honor for the International Day of Yoga, annually celebrated worldwide sponsored by United Nations. The Marathon was initiated by the Embassy of India in Ukraine and the India Club to mark the 25th anniversary of the friendly relationship between our two countries. As expected, it was the biggest yoga session ever held in Ukraine. Representatives from Ukraine’s National Register of Records estimated that 4,052 people simultaneously performed this ancient Indian practice on Khreshchatyk Street!

On the 12th of June, the Radisson Blu and Park Inn by Radisson Ukraine together with Ukraine’s official importers of e-cars have organized “E-car Hub II. Gala” event as part of “Blu Planet For Meetings” program. The event was held in a beautiful newly renovated conference hall at the Radisson Blu in Yaroslaviv Val which included welcoming cocktails and networking, presentations of top e-car models including the BMW i3, the Renault Kangoo Z.E., and the Hyundai IONIQ. The event then proceeded to a more official capacity when

visit, accommodation proof, sufficient funds for the planned duration of stay, and proof of the return date to Ukraine such as a return ticket. Note that these new rules do not apply to the UK and Ireland, where national laws govern visa requirements. Also, any stay in the Schengen area for longer than 90 days within any 180-day period will require a visa. Although this visa-waiver does not allow Ukrainians to live, study, or work in the EU, it is a huge step toward the strengthening of EU-Ukraine relations. Another good sign which will make international travels to and from Ukraine cheaper and easier are low-cost airlines entering the Ukrainian market: Ryanair plans to start flights this autumn from

“Bez Mezh” Rope jumping project The name of the project, “Bez Mezh,” “Without limits” in Ukrainian, says it all. DRESS TO IMPRESS! You know that clothes don’t make the man, but not in this case actually. The doors of the club are usually opened for stylish, confident and attractive people. Imagine you are going to the theatre, how will you look? Women, don’t be too lazy to spend half an hour on your smoky eyes and curling your hair. You’ve probably heard that the «uniform» of the club lioness is fresh suntan and minimum clothes whether it is summer or winter. However, this is an outdated concept. You’d better choose a cocktail dress, but not too long and try to focus on your accessories - large earrings, fancy glasses or an unusual belt. It is not obligatory, but it will complement your image if you wear high heels. Men, you don’t need to do a piercing especially for the party, but you have to be elaborately dressed. A win-win variant is a shirt (with a jacket), trousers or jeans, and clean (!!!) shoes. If the beard is not an integral part of your style, don’t forget to shave. Don’t start the party in the queue! Keep calm for a few minutes and once inside you’ll be able to let your hair down as long as you wish. Therefore, if you are a student, sometimes you are unlikely to be allowed to enter such a fancy place, even if you are dressed properly. Don’t despair! Just choose the club according to your age and status. Good luck!

SMALL GROUPS If you decided to take a football team with you, divide into several groups (and don’t forget to change shoes, read above). Honestly, I don’t know why big groups scare the muscular face-control men, but from my experience, there are little chances for you to get in if you arrive with a big crowd of friends. Separate into couples (one guy and two girls – it works well too!). And, just my personal advice, choose your group carefully: leave the drunk girl and the loud guy with the other group!

COME EARLIER It doesn’t mean that you have to line up at dawn, but the face-control is more

loyal at the beginning of the party. In Kiev clubs, the fun doesn’t really start till way past midnight – but that also means less competition before then. First come, first served! Do you agree?

RESERVE A TABLE Yes, that’s the most profitable variant. If you think about your night ahead of time, you won’t have any problems at the entrance of the club, almost any problems. The managers of CHI club admit: «Ordering the table will give you an advantage at the entrance and more comfortable pastime. However, if you do not pass face control, you can be refused and will have to come back home with your deposit.»

If you are asked whether you made a reservation and you actually didn’t, be smart and answer something witty, like: «Oh, I forgot to make it today, but I am a regular customer.»

Now that you’ve got the basics down, you’re ready for passing the face-control test. As usual, there are some exceptions to those rules. For example, clubs are fond of conducting theme parties. Find out in advance in order not to be refused because of an inappropriate outfit. There are some cases when the security dislikes you personally and doesn’t let you get in, that’s all. No explanations, no excuses. It is useless to persuade or pick a fight, you should either wait for another guard or choose another club. It is a well-known fact that Ukrainians are fond of holidays, tumultuous festivals, or big celebrations. One might ask if anyone dislikes holidays. However, Ukrainian people respect their customs and traditions so much, it’s why most of their holidays are celebrated according to their ancestors who created and cherished them over many years. While we think of holiday as one word, it’s really a combination of the words «holy» and «day.» Holidays were first religious festivals, but now many of them have little to do with their religious origins. Now we look forward to holidays to enjoy ourselves. Summer is already a holiday all its own. When the sun is shining brightly inspiring us to perform little stunts, we are already in a better mood. Actually, I mentioned the sun for a reason. On July 7, Ukrainians celebrate the Summer Solstice, which is called Ivana Kupala Day or Kupala Night. This is not like Independence Day with salutes or fireworks, but with bonfires, mysteries and other interesting rituals. I am sure you have already heard something about magical plants and leaps over the bonfire, but let’s delve into this holiday’s exciting traditions and secrets. The holiday has very ancient pagan roots. The celebration in honor of the Sun was held on the day of Summer Solstice. Originally, it was a joyful festival honoring the light energy of the sun that was believed to provide people with good harvest, beauty, love, and healing powers. Our ancestors knew and felt those strong magical powers of nature, especially the Sun’s enormous energy. It’s no wonder then the word «Kupalo» meant «wrathful»

scorching» «blistering» – all words our ancestors used to describe the sun and its properties. After the establishment of Christianity, Summer Solstice was combined with the Nativity of John the Baptist (24th of June according to the Old Calendar), accepted by the Orthodox Christian Church and included in the Church Calendar. As the words «Kupalo» and «kupaty» («to bathe») sounded similar, they were combined to give the holiday a new name – Ivana Kupala. Now the holiday is celebrated on the 7th of July, no longer connected to the actual Summer Solstice day. Still, people feel a strong connection to nature during this time and thank and honor the powers of nature with numerous Pagan rituals connected with water, fire, and plants: romantic jumping over a bonfire, beautiful wreaths from flowers, the search of magical fern-flower and a lot of other mysterious rites.

TRADITIONS WITH FIRE In the evening, young people organize entertainment around the fire. It is believed that the act of leaping over bonfires purifies people from sickness and bad luck. The guys usually compete among themselves and it is believed that the one who jumps above all will be the happiest. After the fire

One more purifying aspect of Ivanа Kupala Day is connected with water, a traditional symbol of healing powers. People bathe in rivers, ponds, or lakes in order to clean themselves from negative energy. It was believed that on this day river water has the ability not only to purify the body but also the soul. A number of ancient water rituals and games are also related to attracting love and happy marriage. There is a legend that rusalkas (mermaid-like figures) and mavkas (longhaired figures, sometimes naked) go out from their shelters on this day. Some Ukrainian girls even try to look like rusalkas or mavkas during this holiday, as these mystical figures are also an integral part of Ivana Kupala Holiday. Morning dew also has some medical properties. You can wash your face with it to preserve and prolong beauty and health. Another symbol of the celebration of Ivanа Kupala Holiday is a flower wreath with a lit candle placed on a body of water to tell fortunes about a potential relationship. Girls weave several wreaths for themselves, but one was made especially for a certain love interest. While making it, the girl dreams of a guy she likes and wanted to marry. During the holiday, she tries to put the wreath on his head and in the evening she places it on water. Men may also attempt to capture the wreaths, trying to capture the interest of the woman who floated it.

Another aspect of the celebration is decorating the «kupaily», a cherry tree or willow branch, with candles, flowers, and ribbons. All the village’s girls dance in a circle around it with a traditional «horovod» dance and sing about their loved ones. At the end of the night, «kupail» is broken into pieces and every girl keeps a piece so that she will be able to marry a good, hard-working guy. There is also a custom to go to the bathhouse and take a steam bath with fresh birch twigs, which have magical powers on this day. Fern-flower is one of the main symbols of the holiday, with many magical legends and mystical rites associated with it.

According to different folklore stories, the fern-flower blossoms for a few seconds only on Ivana Kupala Night. The lucky ones who see this miracle should tear the flower and run away from the forest without looking back. Hostile powers will try to get it in every possible way. The owner of the fern-flower will have the ability to understand the language of nature, animals, easily find treasures, and realize all his wishes. Nowadays, this tradition is still alive and actual and there are those who go to the forest at midnight and look for a fernflower and luck at the same time. Such holidays as Ivana Kupala are a great opportunity to dive into Ukrainian traditions and culture and even become a part of it. It will be an excellent choice to attend any of the events held on this day to fully experience our national spirit.

Cossack girls and Sloboda Cossacks will recreate the ancient bathing traditions. Before the traditional bonfire, there will be dances, festivities, songs, and horovods. The bonfire will only be lit once the sun sits over the horizon. Suggested dress for the event: embroidered or any traditional Ukrainian clothing.

HOLOSIIVSKYI DISTRICT Starting from the very center of the city, Khreschatyk Street, Holosiivskyi District occupies Southwest of Kiev. Known as an area for students, Holosiivskyi district received a new life once several subway stations were opened there. After that, new fascinating houses were built, that greatly changed the general view of the district. The main benefit of the district is huge green spaces such as beautiful Holosiivsky Park and Park Feofania.

Why should I live here? • The immense and nearby Holosiivskyi Park is what you’ll love most. The park encompasses a huge area, most district inhabitants can access within minutes. This park is perfect for any outdoor activity you can imagine: picnics, long romantic walks, and even off road bike rides. • Park Feofania is another wonderful place to visit and rest: in addition to beautiful green areas, it also has ancient monasteries and healing springs. • Since Holosiivskiy district is rather new as are its wide roads, traffic jams occur infrequently. Add a perfect infrastructure – and you can be sure you will get to work on time. • This district is not noisy: only a few nightclubs are situated there and mostly are far from neighborhood houses.

What should be considered: • Some parts of Holosiivskiy District are located a little far from city center. Getting there will take 10-20 minutes by metro. • Keep in mind that Soviet-era buildings are still part of the local architecture and contrast with more modern structures.

Since undergoing major renovation, Vozdvizhenka has become the place for photo shoots. Unlike the rest of Podil, Vozdvizhenka is a relatively new area. As Vozdvizhenka is a heavily populated area, during the week, cars occupy its streets nearby offices, cafes, and boutiques,

The best time to visit the garden is early in the morning around 8 a.m. on business days. Although botanical gardens are usually full of locals during the weekends, this one is actually emptier on Saturday and Sunday. Several universities and colleges are located near the garden and between classes, students chill in the park, so making photoshoots is difficult on weekdays.

Address: Hrushevsky Str. Nearest metro station: Maidan Nezalezhnosti, Arsenalna Mariyinsky is a marvelous park right in the center of the city. It has picturesque alleys, observation decks, and simply wonderful panoramic views on the left bank of Kiev you would love to depict in your photos. This park is beautiful any time of day. In the evening, it’s lit by hundreds of lanterns. Also in Mariinsky Park, there is a recently built doll theater which resembles a fairytale castle. If your photoshoot is romantic, you should visit a park bridge called Lovers’ Bridge. As with previous options, Mariinsky Park is popular with visitors all day long. Consider visiting the park during sunrise when it is almost empty and the rising sun can add unusual tones to your photos. Seize the opportunity to make scenic shots

Maidan Nezalezhnosti

Situated right along the Dnipro Quay, this square was rebuilt last year and now features lovely fountains and panoramic views of Kiev’s main river. In general, three

main places for photos can be chosen here. The first one is a cute walking alley located along with Quay with flowerbeds and lots of benches as well as the long beautiful ladder rising from the middle of the Quay to the European square. The second place is the square itself with a panoramic view on the Dnipro River, coastline of the city stretching off into the distance and Trukhaniv Island. Finally, the open fountain can be chosen for those who prefer creativity: you can be

shot right in the middle of it, between the fountain’s streams. When the night comes, all these places change their appearance: lanterns along the alley are lit while colorful illumination is turned on in the fountain. To fully catch this atmosphere, stand just behind two streams so that light falls from the side and in front of each person. Start shooting when the water comes. Just be careful it doesn’t get your gear wet.

Nearest metro station: Maidan Nezalezhnosti, Khreshchatyk Maidan, the center of Kiev, is a wellknown among Kiev inhabitants as a walking destination. The best time for shooting here is late evening when the area gets less crowded and lights are turned on everywhere. In case you plan on taking portraits, use the observation deck around the Globus mall. Right behind it a tiny square and a charming little bridge leads to Heaven Hundred Heroes’ Alley. You could also visit Maidan in the early morning when it’s least crowded. Here, if cold tones are applied during the photoshoot, you can achieve a wonderful urban effect. The modern buildings and shop windows would make a suitable background.

There is no better place for a photoshoot that incorporates local culture than Pyrogovo an open-air museum specifically dedicated to the architecture and lifestyle of Ukrainian villages. To begin with, authentic Ukrainian houses, khatas, can be found here in a great variety as well as old wind and watermills. Moreover, you can get as close to them as you wish, there are no specific restrictions and most buildings can be entered without any problems. The village has various natural landscapes, including wide meadows, hills, light groves and forests, orchards and flowers, slopes and lakes. Therefore, even if a Ukrainian theme is not the one you want to portray in your photos, Pyrogovo still has lots of beautiful backgrounds for your special shots. Due to such a variety, Pyrogovo is a popular place for wedding photoshoots. What is the timeframe to file for compensation? It all depends on a country where the compensation is filed. In Ukraine, for instance, it comes down to 2 years. The maximum term of limitations we’ve dealt with is 6 years.

Why do airlines cancel flights and what are their liabilities?

If a charter flight is cancelled, is it possible to get compensation?

“Two years ago I was planning to go back home from London. The flight was cancelled,” recalls Askold Klus, the founder of MyAviaHelp company. “Sitting beside me in the concourse, a girl was crying over a cancelled flight. A police officer was trying to console her, offering her a cup of coffee. Concerned, despair-filled faces, along with the image of the girl crying left a lasting impression on my memory. Every person who has faced such a situation clearly remembers the ensuing problems caused by an airline’s negligence. It is quite discomforting to realize you do not know your own rights in such a predicament.” At the moment, his company is collecting compensations from air carriers and guarantees a 98% collection rate. For this reason, we have decided to interview Askold and find out how to proceed in the event of flight cancellation.

The reasons are numerous, but very often airlines cancel flights in advance due to commercial factors. In such cases, the airline must notify its passengers no later than 2 weeks before the flight. In other situations, a flight delay can gradually turn into its cancellation. Then, a passenger must be transported to the destination point by the air carrier’s next flight or a flight from its partner company. When this is impossible, flight ticket money should be returned within 7 days. The sum of the required compensation ranges between $135 - $650 per passenger.

It does not matter whether you have a regular or a charter flight (or even a lowcost, more affordable carrier). It is essential to understand that when a passenger pays money for a flight, they are in effect signing a contract with the airline company which is obliged to deliver him or her to a specific destination at a specific time. Flight delay, cancellation, or overbooking (a denial of entry on the plane) are all violations of a given agreement by a carrier.

What should be done right away to prove the fault of an airline? First of all, it is important to get a stamped document which testifies the event of flight cancellation and/or flight substitution. Make sure it contains true and exact reasons of the given force majeure. If this proves impossible, a cancellation stamp on an itinerary receipt will work too, although it won’t specify the reasons. To do this, find your airline representative at one of their podiums, for example, or at the airline ticket desk. If you are in the airport concourse, such representatives can be found at the gate (a place where passengers leave the airport and get on their airplane). In case a representative cannot be found, ask any airport employee where to get the abovementioned document. As a rule, it can be done at the airport information stall. Certainly, you can always call an airline’s customer service and ask for updated flight information (an airline telephone number can be indicated on the airport banner). You could also visit an airline’s website. In any case, save the tickets, boarding pass, and luggage claim tickets. I would also recommend taking a photo of them as a backup. It is also a good idea to take a picture of an airport display board listing departures which shows current time and your flight’s status. Also collect all food, hotel, and taxi (bus, train) receipts related to your flight cancellation to demonstrate financial hardships endured. Remember, you can file for www.kievcheckin.com

compensation if a flight’s cancellation was due to carrier fault, not just because of a force majeure like weather conditions or a strike of airport/airline workers. Please note that a plane breakdown is not considered a force majeure.

What compensation should an airline provide on the spot? It depends on the waiting time for the next flight and the distance of a flight. If you are waiting for the next flight for: • more than 2 hours with a flight distance up to 1500 km (flights around Ukraine, and from Kyiv to Minks, Munich, Sofia, Riga etc.) • more than 3 hours for flights ranging from 1500 km to 3500 km (from Boryspil to London, Barcelona, Brussels, Geneva etc.) • more than 4 hours with a flight over 3500 km (from Kyiv to New York, Beijing, Colombo etc.) then you are entitled to: • refreshments • two free of charge phone calls or text/ fax messages, e-mail (depending on what an airport can offer) • transfers between airport, hotel, and back to airport • a hotel room if you need to wait for the flight for one or more nights

Whom should passengers call or write to get a compensation? Passengers are lawfully entitled to ask an airline for a compensation. For this, a traveler needs to describe the situation and refer to the applicable law that should be invoked in their specific case as well as the specific airline’s transportation rules. Remember that airlines are a huge, powerful organizations. When explaining your situation, be as honest as possible. In addition, when requesting compensation, attach travel documents and collected proof of the airline’s fault. You are also fully entitled to sue the airline at the very beginning or after failed compensation negotiations. Based on our experience, airlines avoid paying compensation whenever possible. That’s why we strongly recommend hiring a professional lawyer who specializes in the sphere of passenger air transportation.

Tips for Foreigners Following the recent reforms and closer ties with West, Ukraine is gradually becoming an attractive, albeit still difficult, place to do business and invest for the foreign business community. Regardless of the still weak political, legal, and financial climate in the country, Ukraine has an excellent geographic location, the largest territory in Europe, rich natural resources, and a low cost but skilled workforce. Ukraine’s confusing regulatory regime, ever-changing regulations and significant red tape can cost foreign investors significant money and time. In our experience, every day we encounter front-facing government staff, bank representatives, private consultants, and notaries who are not aware of the latest changes and provide incorrect information. But these challenges are by no means insurmountable, the savvy entrepreneur can easily find his/her way past to make some great investments. Here’s a list of business tips for any foreign individual exploring doing business or investing in Ukraine. Note that law and regulations change frequently, therefore always consult for the latest updates before making any decisions!

PERSONAL BANK ACCOUNTS As a foreign national (resident or non-resident), you are allowed to open the following types of personal bank accounts in Ukraine: • Regular current and savings accounts in the local currency UAH and selected foreign currencies. • An Investment Account that allows foreigners to make investments into Ukraine and subsequently repatriate profits and capital out of the country. Keep the following points in mind when opening and operating your bank account in Ukraine: • Rules for bank accounts vary depending on the type and are strictly regulated by Ukrainian Banking law. For example, you are not allowed to withdraw cash from your investment bank account (whereas it is possible from a regular current bank account). Therefore, use the type of

STARTING A COMPANY While there are a number of different business structures available in Ukraine, the most suitable limited liability structure for a small- to mid-sized business in Ukraine is a Limited Liability Company (LLC). Both resident and non-resident foreigners are free to incorporate a LLC and can be 100% shareholders of the company. Points to note when opening a LLC: • The process of incorporating a company is fairly straightforward and can be completed in 1-2 working days after all the necessary documents are ready.

WORK AND RESIDENCE PERMITS Work permits and residence permits are two different permits issued to foreigners. With the exception of few situations, both permits are required when relocating to operate or work for a company in Ukraine. Keep in mind the following: • Foreign entrepreneurs who have opened their LLC company in Ukraine will need to apply for both permits if they wish to relocate to Ukraine. The same is true when the LLC is hiring other foreign staff.

• The director of an LLC can be only an individual who has right to reside in Ukraine (a citizen of Ukraine, or a permanent citizen or foreign individual who has obtained a work and residence permit in Ukraine). Corporate directors are not permitted.

• Certain categories of foreign citizens (such as permanent residents of Ukraine, employees of representative offices and permanent establishments of foreign companies, representatives of foreign mass media, professional athletes, artists and some others) do not need to apply for work permits when working in Ukraine (but they still need to obtain residence permits). However, in most other cases, a valid work permit is required before commencing work.

• A Ukrainian company must have a local registered address.

• The processing time for a work permit application is about 1 month.

• Foreign entrepreneurs who wish to relocate to Ukraine to operate their company can apply for relocation visa (work permit & residence permit), which is subject to approval by authorities.

• After the work permit application has been approved, the permit holder must obtain a temporary residence permit if he/she plans to relocate to Ukraine to work. Family members are also eligible to obtain the temporary residence permit.

However, the real-estate market in Ukraine is not very mature and therefore often fraught with significant difficulties and risks at almost every step of the transaction. It’s extremely important to work with a knowledgeable and trustworthy legal advisor when dealing with real-estate in Ukraine. Here are some basic guidelines: • It is important to perform the deal and payment strictly in accordance with Ukrainian Civil, Banking and Investment law to avoid future difficulties with repatriation of investments and investment income. • Proper due diligence as well as proper legal planning and examination of real-estate transactions are crucial while investing in real-estate in Ukraine due to risk of fraud. • The commission of real-estate agencies is typically around 3–5% from the real-estate purchase price, payable only if the deal is concluded. Real-estate agencies are not regulated and do not require a license to operate. Therefore, we highly recommend that you also use an independent real-estate legal advisor to assist you with proper advice when concluding your transaction.

• Individual income tax rate: 18% plus 1.5% military tax • Social security tax: 22% (applicable as part of payroll tax) • VAT: 20% • Individuals registered as Private Entrepreneur (similar to Sole Proprietorship in other countries) and listed under the Simplified Tax Scheme (3rd Group): 3–5% Note that the Ukrainian tax code defines specific rates for certain types of income or transactions which can be different from the ones mentioned above. In addition, some types of income/transactions are exempt from taxation. Therefore, to define applicable tax rate for each specific case, it is important to get professional advice.

GETTING A UKRAINIAN TAX NUMBER As a foreigner, if you are planning to work, invest, or start a business in Ukraine, most likely you will need to obtain a Ukrainian tax number. Therefore, it’s usually a good idea to get this done as soon as possible. If you are overseas, the application for tax number can be filed by your representative in Ukraine under a Power of Attorney. The application processing time is about 5 working days.

HIRING STAFF In Ukraine, a company can hire people either under labour agreement (i.e. as a

salaried employee) or under civil services agreement (i.e. as a freelancer, provided the person being hired is registered as a Private Entrepreneur (PE)). If hired as a salaried employee, the company should assume roughly 40% tax overhead on top of the salary in-hand to the employee. On the other hand, in a freelancing arrangement, the salary tax burden is approx. 5%. PAYING FOR INVESTMENTS Foreign nationals are allowed to pay for their investments in Ukraine (opening a business, buying real-estate or other type of investment) in two possible ways: • Directly from their account overseas (in this case, payment is made in foreign currency); -or• By opening an investment bank account in Ukraine. In this case, the foreign national must transfer money in foreign currency to the investment account, convert it to local currency hryvna (UAH), and then pay for the investment in the local currency.
