BOTANCIAL RV RESORT INC (the "Company")
RULES AND REGULATIONS
(Pursuant to Part 20 of the Articles of the Company)
1. The directors of the Company shall have authority to take all reasonable measures to enforce these Rules and Regulations and all members of the Company and their guests shall comply with all reasonable requests from the Directors in that regard.
2. Shareholders of corporate members shall nominate, in writing, to the Directors one or more of their members as the "designated member". The designated member may use the campsite in the same manner as any other member. All shareholders of the corporate member, not part of the designated member's family, shall be considered guests as the case may be.
3. Guests of a member will be allowed to occupy the member's campsite provided that on site accommodation will reasonably permit such occupancy. Guests not accompanied by the designated member must provide written permission from the member if so requested by the Directors. This rule will not prevent a member from renting out his designated campsite provided the renter has something in writing from the member showing he has the member's authority to occupy the campsite.
4. Members shall be responsible for their guests, and shall inform them of and insure that they abide by all the Rules and Regulations.
5. A member and his guests may occupy, as their campsite, only that area designated in the membership agreement.
6. Except as provided below, only one recreational one recreational vehicle per site shall be permitted and it must meet the following criteria:
(a) 12 feet wide- tip out included
(b) 40 ft overall length
(c) 16 ft maximum height
(d) 1 story only permitted

7. Space permitting, one only additional RV unit (Lot owner or Visitor) may be placed on a site, provided that it does not encroach on adjoining site or the roadway. No site shall be occupied by more than one RV defined as Trailer (Travel or Park Model), 5th Wheel, Tent Trailer, Camper (on or off a vehicle), for a period longer that 15 aggregate days in any calendar month.

8. In these Rules and Regulations, a motor vehicle is defined as any motorized mode of land transportation. In addition to the primary recreation vehicle, a member is restricted to the following on the campsite at any one time:
Vehicles: 2 (two) Golf Carts: 1 (one) Utility Trailer: 1 (one) Boat Trailer: 1(one) Guest and Visitor parking must be on the member’s campsite only or in designated visitor parking spots is available.

9. No inoperable motorized vehicles shall be kept on a campsite.
10. Fence repairs is to be split 50/50 costing for the parties which share the fences.

11. Sheds, Roofs and Wooden Decks:
(a) All structures must have pre-approval of the Directors, including Costco tent like coverings, storage sheds, roofs, and wooden decks
(b) One shed per lot. It must be 100 sq ft or less wooden building, which includes any upper level. The shed will not have outside stairs, balcony or basement
(c) Maximum height for a shed or roof is 16 feet
(d) Sheds must not be used for habitation
(e) You cannot block anyone’s view when putting up a shed. Sheds should be placed at the back of the property and be finished in cedar or blend in as much as possible
(f) Shed can have a loft for storage, but it must not be used for habitation
(g) Some sheds that are already built (prior to May 21,2006) and do not meet these rules will be allowed. If the building inspector does not approve of the sheds already built it will be up to the owner to remove or modify the shed.
(h) Enclosed structure not to exceed 200 sq ft outside measurement and must be adjoined to the trailer. All structures must be approved by the Board of Directors prior to construction, no grandfathering.

(i) No plumbing or sleeping will be permitted in the storage sheds
12. Only one sewer hook-up will be allowed This regulation will be retroactive and will apply to any installations presently in place.

13. No member will plant trees that will affect the view of his neighbours. No trees over 2 inches in diameter will be removed without the permission of the Directors.
14. No member or his guest shall attempt to discourage any member from using the common property. No fencing, planting of shrubbery or trees or other obstructions will be permitted on common property or on fronts of campsites fronting roadways. Members shall not store or park anything on common property such that it creates an extension of their campsite space, or in particular, use any area of the common property in such manner that it suggests an extension.
15. Every member is responsible for his own garbage and refuse and for keeping garbage cans out of site at the rear of the campsite in a neat an orderly fashion.
16. All members and their guests shall contain their pets on their campsite so that they cannot get loose. All pets shall be kept on a leash when on common ground and members and guests shall immediately clean up after them. Barking dogs or noisy pets will not be permitted on the property. Unattended dogs that bark incessantly will not be tolerated. It is the member’s responsibility to ensure that his pet is a quiet one.
17. No radios, record players, tape machines, parties or other sources of noise shall be audible in the neighbouring campsites after 10:00 pm or before 8:00 am and noise shall be kept at reasonable levels at all other times so as not to disturb other members.
Loud music and/or general rowdiness are not permitted at any time and will result in instant dismissal. This applies to guests and members alike and no refunds will be given. Members are subject to expulsion and cancellation of shares and license for repeated offences.
Where parties or large gatherings are contemplated by a member and where the member feels that such a party or gathering may cause questionable noise levels, then it is recommended that such party or gathering be relocated off the member’s campsite, and onto the common ground where other members will not be affected by the noise. Members must clean up afterwards.
18. No open fires shall be permitted except in approved areas on the common property specifically designated by the membership. Fires will be also permitted on the member’s campsite, however, if this causes an inconvenience or discomfort to his neighbour the fire must be distinguished. Members are to provide their own firewood.
19. Speed limit on all roads is 5 miles per hour, and motor bikes of any kind shall have adequate mufflers and shall not be used on the property except for access to and from site.
20. The property is open at 8:00 am and closed at 10:30 pm. Members and their guests shall keep the gate locked by 10:30 pm each night and not open it until 8:00 am. Members will be given a key and are responsible to see that the gate is kept locked at appropriate times and that no key duplications are given out to anyone other than family members.
21. “Year round” occupancy of the campsite will not be permitted.
22. No member or guest shall alter, amend or add to the existing campsite’s water, septic or electrical connections without first obtaining written permission from the Directors after having submitted a duplicate detailed site plan of changes and having been approved.
23. No member or guest shall redirect or alter drainage water from the natural existing path unless authorized by the Directors.
24. All members will be responsible for the safety of their own family and guests, and if appropriate taken means to insure their safety.
25. It is the responsibility of all members and their guests to maintain the common property and the surrounding environment in its natural state.
EXEMPTIONS
LOTS NUMBER 32, 33,34, AND 35
Since these lots are isolated geographically from the rest of the development certain conditions described below will only apply to these four lots.
1.) Hydro, septic, water and telephone will not be supplied to these lots. The owners of these lots reserve the right to obtain the proper permits to install these services at their own costs.
2.) These lots will be exempt from rule #11, any building larger than 8 feet by 12 feet will need the written permission from the closest neighbour, and the owners will have the right to apply for the legal permits. Any improvements that result in higher taxes, insurance or other costs to the rest of the corporation will be paid by the individual lot owner.
