For the past 60 years, Kappa has devoted all its efforts to improving the lives of motorcyclists with roads, open spaces and horizons becoming the central characters. Our history, and that of our products, are merely a backdrop to each individual motorcyclist located around the World. Kappa choose to express and share its passion for two wheels by working relentlessly day after day, trip after trip for every product created and with every material used, devoting all our endeavours to those who live their lives on their motorcycle.

The passion, the attention to detail, and the precision that our team adopts in the creation of every single Kappa product is precisely the same procedure that a biker would adopt when choosing the finest accessories and products for their motorcycle. K¡LAB is the location where Kappa tests and analyses its products taking them to the limit, whilst seeking valuable information to improve, innovate, rethink and continually suggest new ideas. The combination between K¡LAB, with its modern crash test equipment and the co-operation of external laboratories, equipped with optical benches and spectrophotometers for the control of the Homologation of visors, enables Kappa to play a prominent role in the arena of research and the avant-garde world of security and comfort on two wheels.

Engineers and technicians analyse every driving situation, in every weather condition, for every kind of impact on a helmet, in order to obtain a level of absolute safety on the end product.

Young testers live the city, connecting their smart phones, filling and emptying their hard bags commuting to their places of study or work and having used and tested our products in their daily life, the products are returned to our lab where feedback and suggestions regarding the products are given to the Kappa Engineers with a view to further improving existing products and developing new ones. Thanks to the suitability of machinery and the high competence of its team, Kappa obtained the self-declaration in accordance with Regulation ECE/ONU 22-05, which enables them to perform internal inspections on production, distinguishing itself in its sector for the attention and passion dedicated to the optimal performance of their products. The experience and accuracy of a competent team, combined with the use of high quality materials, offers the biker an unequalled guarantee of safety, allowing them to disregard practical aspects and to fully enjoy the sensations that their passion provides

The Jet Junior model has been developed on the basis of the demi Jet helmets, with spectacle-shaped visor, hypoallergenic and removable interiors and micro-ratchet strap closure. Made entirely from thermoplastic material, thus achieving a considerable weight reduction and furnished with a doubly-resistant anti-scratch visor.

The BABY model design has been developed in young colours such as pink and fluorescent red and the Jet Junior can be personalised with optional stickers.

GENERAL CONDITIONS OF SALE 1. Scope 1.1 The conditions below apply to the supply of goods and other services by GIVI S.P.A. 1.2 These terms of business apply exclusively; any buyer conditions that conflict with or differ from these terms of business will not be recognized unless GIVI S.P.A. has specifically agreed to this in writing.

2. Orders and Specifications 2.1 The range shown on KAPPA’s web-site, web-order system and KAPPA’s printed catalogue does not represent a legally binding offer but a non-binding online catalogue or printed catalogue.

2.2 The buyer will order the goods or services required by accessing the reserved web-order area or via fax / E-Mail. No order submitted by the buyer shall be deemed to be accepted by GIVI S.P.A. unless and until confirmed in writing

by GIVI S.P.A..

2.3 Any purchase order placed by the buyer shall be intended as full and complete acceptance of the present Terms and Conditions of Sale that the customer declares to have read and understood.

2.4 GIVI S.P.A. reserves the right to refuse an order fully or partially according to stock availability, production capability and delivery date required by the customer.

3. Price, Invoice, payment, 3.1 All prices are in euro (VAT is not due, therefore not included) and can be subject to alteration with 15 days prior notice from GIVI S.P.A.. All prices are intended for goods delivered EX-WORKS “Incoterms® ICC 2010 (from our warehouse in Barbariga).

3.2 Invoices must be paid within their expiry date.

In case one or more invoices are expired and unpaid, or the maximum exposure limit is reached or exceeded, GIVI S.P.A. shall be entitled to suspend any further deliveries to the buyer until the overdue payment is received in full (payments received need to be confirmed by GIVI S.P.A.’s Bank, when credited on GIVI S.P.A.’s bank account).

3.3 In case of delayed payment or non-payment, GIVI S.P.A. is entitled to apply commercial interest on arrears as per “Decreto legislativo 231/2002” (Legislative Decree 231/2002 as per the Italian law) and expenses at the bank rates in-force from time to time.

4. Packaging and shipment 4.1 A packaging cost contribution is charged by GIVI S.P.A. in each invoice and calculated based on the number of cartons needed to contain and protect the goods during the transportation.

4.2 Shipments are not prepared on pallets unless specifically requested by the buyer. The cost of the pallets, if used, is charged by GIVI S.P.A. on the invoice to the buyer.

5. Transportation 5.1 Buyer and GIVI S.P.A. agree and acknowledge that the place of delivery of the goods is at the GIVI S.P.A. logistic centre in Barbariga (BS), Italy 5.2 No claim for missing or damaged goods can be accepted by GIVI S.P.A. past eight days after the delivery of the goods 6. Custom Duties 6.1 The buyer will be liable for import custom duties if applicable in its country.

7. Order cancellation 7.1 No order which has been accepted and confirmed by GIVI S.P.A. may be cancelled by the buyer except with the agreement in writing of GIVI S.P.A. and on terms that the request of order cancellation from the buyer is received before the start of the shipment preparation. In case the order is cancelled after the shipment preparation has started, GIVI S.P.A. will be entitled to invoice to the buyer the costs incurred by GIVI S.P.A..

8. Property 8.1 Notwithstanding delivery and the passing of risk in the goods, the property in the goods shall not pass to the buyer until GIVI S.P.A. has received payment in full of the price of the goods and the buyer has fully performed all of the terms and conditions hereof.

8.2 Before transfer of ownership, the buyer will only be entitled to these goods with the prior written approval of GIVI S.P.A. If a third party seizes the goods, particularly if the goods are impounded, the buyer must inform GIVI S.P.A. immediately in writing and also point out to the third party immediately that GIVI S.P.A. have proprietary rights.

9. Returns 9.1 No goods will be accepted for credit when returned without written permission from GIVI S.P.A. No goods will be accepted for credit after one year from date of shipment.

10. Warranties and liability 10.1 The warranty period is 24 months and begins when the goods are handed over to the final user. Defects in the goods will be corrected by GIVI S.P.A. after being informed of this by the buyer within this warranty period. GIVI S.P.A. will decide whether to replace or repair the goods and inform the buyer accordingly but GIVI S.P.A. shall have no further liability to the buyer.

10.2 Every claim must be notified by the buyer to GIVI S.P.A. using the Warranty Claim Form provided by GIVI S.P.A., with description of the fault and pictures showing and proving the claimed defect.

10.3 GIVI S.P.A. shall be under no liability in respect of any defect arising from fair wear and tear, willful damage, negligence, abnormal working conditions, failure to follow GIVI S.P.A.’s instructions, whether oral or in writing, misuse or alteration of the goods without GIVI S.P.A.’s approval.

10.4 If the complaint is unfounded GIVI S.P.A. reserves the right to claim reimbursement of the costs incurred from the buyer, if any.

10.5 GIVI S.P.A. shall be under no liability under the above warranty (or any other warranty, condition or guarantee) if the total price for the goods has not been paid by the due date for payment.

10.6 Except in respect of death or personal injury caused by GIVI S.P.A.’s negligence, GIVI S.P.A. shall not be liable to the buyer by reason of any representation, unless fraudulent, or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the present Terms and Conditions of sale, for any indirect, special or consequential loss or damage, whether for loss of profit or otherwise, costs, expenses or other claims for compensation whatsoever (whether caused by the negligence of GIVI S.P.A., its employees or agents or otherwise) which arise out of or in connection with the supply of the goods or their use or resale by the buyer, and the entire liability of GIVI S.P.A. under or in connection with the sale of the goods shall not exceed the price of the goods, except as expressly provided in these Terms and Conditions.

10.7 GIVI S.P.A. shall not be liable to the buyer or be deemed to be in breach of these Terms and Conditions of Sale by reason of any delay in performing, or any failure to perform, any of GIVI S.P.A.’s obligations in relation to the goods, if the delay or failure was due to any cause beyond GIVI S.P.A.’s reasonable control.

11. Data protection 11.1 If it has not been agreed to the contrary, GIVI S.P.A. will only use the buyer’s data in order to carry out the sale contract. The buyer‘s permission is required to use this information for market and opinion research and for advertising.

12. General 12.1 Changes and amendments to these Terms and Conditions of Sale must be in writing to be effective. There are no verbal secondary agreements.

12.2 If it has not been agreed to the contrary, the buyer may not transfer rights and obligations derived from the sale contract to a third party without GIVI S.P.A.‘s prior written agreement.

12.3 If any provision of these Terms and Conditions of Sale is or becomes invalid or unenforceable in whole or in part, the other provisions and the remainder of the provision in question shall not be affected. The contractual partners will agree to replace the invalid provision with a valid one that best corresponds to the economic aims of the contractual parties.

12.4 The present contract is governed by the laws of Italy.

12.5 The competent law courts of the place where GIVI S.P.A. has his reg­istered office (Brescia, Italy) shall have exclusive jurisdiction in any action arising out of or in connection with this contract. How­ever, as an exception to the principle here above, GIVI S.P.A. is in any case entitled to bring his action before the competent court of the place where the Distributor has his registered of­fice. Should the Distributor has his seat out of EU, all dispute arising out of or in connection with the present General Conditions shall be finally settled under the Rules of Arbitration National and International Chamber of Milan by one or more arbitrators appointed in accordance with the said Rules.
