New U.S. Immigration Law May Affect Chinese People Translated by: Vision Times Staff

Lawyers: New policy to be strictly enforced According to U.S. immigration attorney Ye Ning, the inclusion of “communist inadmissibility” in the Policy Manual of the Immigration and Nationality Act means that it is intended to be a “very specific and technical act at the operational level.” Case 1: Passive resignation doesn’t count Mr. F, an Internet user, recently told us that the first question asked by the interviewer when he applied for the green card was whether he was a CCP member. Mr. F told the interviewer that he hadn’t paid the party fee for a long time, so he had practically resigned. However, the interviewer said that the Immigration Bureau does not accept “passive withdrawal” and that he needed to prove that he had voluntarily withdrawn from the party.
Chinese Communist Party Members Restricted from Immigrating to the U.S. What are some of the problems Chinese people may encounter after the change in regulations? On October 2nd, U.S. Citizenship and Immigration Services (US-CIS) released policy guidance emphasizing that members of the Chinese Communist Party (CCP) and its affiliates who apply for immigration will not be processed, citing that the CCP or any other totalitarian political party is incompatible with the Naturalization Oath of Allegiance to the U.S. Hong Kong pro-democracy activist Nathan Law said the directive would cover not only CCP members, but also children of CCP officials, the Communist Youth League, and overseas Chinese groups that have helped the CCP in its unification
Case 2: U.S. Customs bans CCP members from entering the U.S. Recently, Los Angeles Chinese attorney Cunzhu Zheng received a consultation from a naturalized Chinese American woman whose father ’s immigration application was denied. Her father had a 10-year visitor’s visa but was intercepted at a US airport on September 17th and deported back to China. Zheng said that although her father met the requirement for immigration, he was rejected because he was a CCP member. Case 3: Immigration fraud charges for concealing CCP membership Zheng also said if a person was found to have lied during the naturalization process and retained their party membership, they would be charged with immigration fraud and potentially face deportation, even if they had a green card or citizenship. During the interview, Yang confessed that he had previously concealed his CCP party membership when he applied for a student visa in 1986. His citizenship application was rejected as a result. Attorney Zheng recommends that Chinese people who are worried go to the Global Service Center for ”Quitting the CCP” certificates. He said that with the certificate, several of his clients have successfully entered the U.S., obtained their green cards, and eventually become a naturalized citizen.
