Ilford's First Annual Awards Dinner

Mr Arnold Cohen presenting an award to Mr J Gitlin n Sunday evening 8th March 1998, the Ilford Torah Outreach C entre held its first Annual Awards Dinner at the King David Suite.

The centre runs its events under the name o f ‘Achdut’ and this was singularly ap­ propriate for the atm osphere o f this unique event, which was attended by peo­ ple from all parts of London - North East, North and North West as well as from further afield. In fact, two askonim who had both lived in the Ilford area for 30 years, and never met, were brought to­ gether at the dinner!

About 400 people attended the dinner, which was hosted by Mr and Mrs Arnold Cohen and Mr and Mrs Ervin Landau.

Mr Cohen presented the Com m unal Achievement Awards to members of each of the local communities. Mr J Gitlin of Ilford Federation Synagogue, Mr M Shear o f Ilford U nited Synagogue, Mr P Groman-Marks of Chigwell and Hainault U nited Synagogue, Mr P Sheer o f Newbury Park United Synagogue, Mrs R Roche of Ilford Federation Shteibel the home of Ilford Torah Outreach Centre - a n d Mr A Spectorm an o f Wanstead and Woodford United Synagogue. Mr Groman-Marks responded on behalf of the awardees. The Rabbinical Leadership Award was presented to Dayan Y Y L ich ten stein , Av B eis Din o f the Federation Beis Din, by Mr Landau, in recognition o f his skilful guidance of Anglo-Jewry towards the support o f positive Torah programmes, such as the Ilford C entre. The R abbinical Achievement Award was presented to Rabbi Aryeh Sufrin, Rov o f Clayhall United Synagogue and Director o f the local Chabad Centre. In his response, Rabbi Sufrin stressed the relaxed relationship between the Outreach Centre

and the local kehillos and how the centre com plem ented the work o f all other rabbonim, past and present.

The Amud HaChessed Award was pre­ sented to the Sassover Rebbe, shlitoh, who was unable to attend due to ill health.

Tribute was paid to the Rebbe, in whose house the first meeting to plan the Ilford Torah Centre was held and who has al­ ways been a strong supporter o f the Centre’s activities. The evening was sup­ ported by members o f his family and congregation, in his absence.

The dinner was chaired by Rabbi H B elovski, Rov o f the Loughton and Chigwell Federation Synagogue, and a m em ber o f the Ilford K ollel. Rabbi Belovski started the evening by introduc­ ing Mr Jack Godfrey, who has lived in the area for many years, and who pre­ sented an interesting historical overview of the Ilford and North East London com­ munities including the recent work of the Centre. He described how the Centre pro­ vides all sorts of learning programmes for all ages including lunch time business­ m en's shiurim and youth and ladies' programmes. The impact of the Kollel families living in the area has changed the face of Ilford. Whereas once it was the exception for young people to go to Yeshiva or Sem, not it is not only accept­ able, but almost expected.

Dayan and Mrs Ch Ehrentreu were G uests o f Honour. Dayan Ehrentreu spoke most inspiringly about the origins of the Ilford Torah Centre at a time when Jewish education in what was then the Soviet Union was severely limited by the

au th o rities. He and several other marbitzei Torah realised that there was a large Jewish population virtually on their doorstep in North East London whose Jewish education was similarly limited.

“We, who live in established Torah com­ munities have an obligation to extend ourselves to support the activities of Rabbi and Rebbetzin Godlewsky and the other families who have left their famil­ iar surroundings to live and work in the up and coming communities of North East London." he concluded.

The guest speaker, Rabbi David Goldwasser, principal o f Beis Yaacov of Midwood Seminary in Brooklyn, told some fascinating stories of handicapped baalei teshuva in America and their ea­ gerness to learn. If people with multiple disabilities are prepared to be moser nefesh for Torah, then we, who are fortu­ nate in this respect, should consider our obligations to reach out to the wider com­ munity. Rabbi Goldwasser, together with all other speakers, expressed his personal adm iration for Rabbi Rephoel Zev Godlewsky, the founder and head of the Ilford Torah Centre.

Rabbi Godlewsky, in his concluding speech paid tribute to the late Rabbi Salzman, previous Rov of the Ilford Fed­ eration Shtiebel and spoke with great admiration towards the generosity of the hosts of the Torah Centre, the Honorary Officers of the Federation of Synagogues, for their constant, whole hearted support for the growth of Torah and Yiddishkeit in the area. He compared the atmosphere of the evening to that of Neiloh in terms of the feel­ ing of harmony which prevailed between all the various communities present and their rabbonim. He expressed his desire that this wonderful situation would continue to the great benefit of the whole area and Klal Yisroel in general.

NEW Y O U TH CLUB AT ILFORD FEDERATION SY N A G O G U E new Youth Club will be starting at the Ilford Federation A JLSynagogue which will include S' many leisure facilities including tabletennis, pool tables, air hockey and several com puter systems which have been generously donated.

This new project has been spear­ headed by the efforts of a dedicated committee which includes the youth, so as to incorporate their ideas.

The Club which will meet once a week each Wednesday night, is aimed at the 1 4 -1 8 age group and is open to all Jew­ ish youth in the area.

Melave Malka to celebrate the / \ fifth anniversary o f the Beth A \jV Iedrash at 65 Watford Way took place on Motzei Shabbat 21st March 1998 in the shul.

The event was also an opportunity for the congregants to show their appreciation for five years o f Dayan Lichtenstein’s leadership and teaching and his work in developing the Beth Medrash into a working and vibrant Minyan. He was presented with a lap-top computer by Mr Zvi Shenkin who acted as Master of Ceremonies for the evening.

Rabbi A Goldblatt, Head Master of Menorah Grammar School, was the guest speaker and gave a hum orous and interesting Dvar Torah on the ParshaVayakel-Pekudey.

The fifty congregants were treated to a fish and chip dinner organised by Paul and Janine Ellerman. Special thanks also went to Jack Samad, the Gabbai, for helping to make the evening such an enjoyable evening.

Two hundred children from the Edgware Yeshurun Bnei Akiva sat down to dinner in the Shul both on Friday night and Shabbat morning after Tefillot.

Dayan and Mrs Lichtenstein who were the guests of honour, had the opportunity to meet m em bers o f the com m unity. In his address, Dayan L ichtenstein, made mention of the fact that the community is prepared to innovate new progress and is not afraid of positive change.

A very enjoyable evening was en­ hanced by the guest chazan from Barnet Shul, Mr David Burns, who contributed a wide repertoire of inspiring Jewish songs.

The recent annual Youth Shabbat proved once again to be a great success and credit for this is due to Phillip Brandon and Andrew Grunfield of the education committee. The youth received all the Aliyos and Kibbudim, did the leining and even took over the roles of the Gabbaim. At the Kiddush which fol­ lowed the service in Shul, some of the girls gave Divrei Torah. It was a very satisfying feeling for the adults to see the extra effort made by the youth to be involved in O

Tu B'Shevat was marked in the He­ brew Classes with a Tu B’Shevat quiz attended by parents of the pupils. Each class specialised in learning a particular topic such as Brachot or the land o f Is­ rael to compete against one another, and were motivated sufficiently to learn their material extremely well. This was fol­ lowed by the usual sampling of 15 fruits by all the children present.

The Purim festivities at the Shul this year comprised many innovative and exciting programmes, including a PreMegilla programme for the youth of the community, who were entertained with a magician.

After the Megilla, the whole commu­ nity took part in a Purim celebration with live music, a Purim song presentation by children of the Hebrew Classes and a fancy dress parade with prizes. Due to this major programme, more children than usual came to Shul in the evening.

On Purim day, a communal Seudat Purim took place and was attended by over one hundred people. The event was organised mainly by Chazan Eli Sufrin and his wife Nechama and proved to be very lively with dancing, and live music provided by Moshe Tamir.

ayan and Mrs Lichtenstein and Rabbi and Mrs Zaiden were guests at a special evening at Cassit Restaurant on 8th January to launch a revolutionary new food concept: fish dishes that taste and look exactly like meat.

They were joined by journalists and re­ porters from Jewish, local and national media as well as other VIPs. After being welcomed by the proprietor of Cassit, Mr Eli Cohen, who gave a brief history of the development of the dishes, they were served dinner enabling them to sample all of the four dishes including the Cassit Stroganofif made from tuna.

What makes these dishes so unique is that they have all the nutritional benefits of fish without the potential hazards of meat but nevertheless, there is no compromise on taste, texture or smell for meat lovers.

Initial reactions to the idea from the guests invited had ranged from great inter­ est to cynicism, but the response all round that evening, was one of amazement and enthusiasm. Some agreed that it was indeed indistinguishable from meat; others felt that it was a far more nutritional and healthy

From East London Central Synagogue to Bournemouth (or ... the Normandie Landings)

by Leon G ayer party o f members and friends from the East London Central Synagogue converged on the Normandie Hotel in Bournemouth for a long weekend at the end of February. It was the first event in a series of celebra­ tions to mark the Synagogue's 75th Anniversary.

Included in the group was the Syna­ gogue's Minister Rev Yitzchak Austin and his wife, accom panied by their four young daughters; the Chairman o f the Synagogue's Board, Mr Lawrence Zysman; the Financial Representative, Mr Leon Silver; the Synagogue's Secretary, Mr Leon Gayer and his wife; the Secre­ tary o f the Synagogue’s Seventy Fifth Anniversary Planning Committee Miss Rita Cooper, and her mother, along with several others. The Jewish Community in Bournemouth was quite amazed to learn that there was still an active shul in Nel­ son Street, in London’s East End.

The group attended the Service in the hotel Synagogue on Friday night which was followed by dinner and a discourse on the Sidra. On Shabbat morning the mem­ bers of East London Central Synagogue were extended courteous respect. Rev Yitzchak Austin and Mr Lawrence Zysman were called to the reading of the Torah with the former being honoured with ‘Shlishi’, Mr Leon Gayer had the privilege of recit­ ing the Haftorah and Mr Leon Silver opened the Ark for Anim Zemirot.

On Motzei Shabbat an attractive birth­ day cake and greetings were extended to Rev Yitzchak Austin for his words of wis­ dom, and to Miss Rita Cooper for organising the event, which all agreed could be the pilot for future similar programmes.

During the passage of years, the follow­ ing Synagogues and congregations have been incorporated into the East London Central Synagogue, formerly known as the Nelson Street Sphardish, and later as the East London Amalgamated Synagogues: Berditchhover Belz, Cannon Street Road, Commercial Road Great, Grove Street, Great Garden Street, Jubilee Street, Little Alie Street, New Road, Rumanian - Buross Street, Sidney Street and the Sons of Britcham.

The East London Central Synagogue as it is now known, will be celebrating its Sev­ enty Fifth Anniversary in September with a Service of Thanksgiving. Members to­ gether with anyone connected with the above Synagogues, including children of past members, who would like to be present at the forthcoming Service, are requested to write to the Synagogue Secretary, at 3040 Nelson Street, London El 2DE for details,

Whilst in London, he and his wife stayed with his daughter and son-in-law, Rabbi Z Telsner - the Rav of the shul. Hot refreshments were pro­ vided by the functions Committee, and both children and parents enjoyed some games of Bingo.

In The Navy

The library at the US Navy base in London borrowed a silver menorah for a special display they exhibited in the library for Chanucah.

In January, the Shul was honoured to have as its guest speaker, Dayan Lichtenstein, the Rosh Beth Din. He spoke o f the problems facing Anglo Jewry today and the unique position that the Federation held in Orthodox Jewry. This was followed by a lively dis­ cussion.

Purim celebrations this year in ­ cluded a fancy dress parade and the annual supper quiz which took place at the end o f March, proved once again to be a great success.

Chased Shcl Ernes which never should have happened n the Pesach 1997 / 5757 edition of H am aor m agazine, Henry Dony w rote an article en titled ‘An Outstretched A rm ' about the tragic case of an elderly lady who lay dead in her flat for nine months. She was only discovered because the shul she belonged to w ere alarm ed when she uncharacteristically failed to show up at the shul office to pay her quarterly bills three tim es in successio n . A fter unanswered phone calls and letters they finally alerted the Local Authority who were unable to gain admission and finally broke down the door to discover the unfortunate lady in an advanced state of decay.

Henry Dony stated in his article: “This should never have h ap p en ed ,” and outlined some suggestions to prevent it ever happening again. Unfortunately, just one year on, the Jewish Tribune of 19th February 1998 reported on another tragic case.

An elderly gentlem an who was a member o f the Fieldgate Street Shul in the East End, died at the Hom erton Hospital in mid-November 1996, his wife having pre-deceased him by some years.

He had booked a burial place next to his late wife, and for many years had paid his subscriptions. Unfortunately, there were no children or close relatives, and it seems that the hospital was unaware of the fact that he was Jewish. Consequently, he was buried - some ten weeks after his death, at the end of January 1997 - in a communal grave in the (Christian) East London cemetery.

As soon as the chevra kadisha of the Federation of Synagogues became aware of this tragic situation, arrangements were put in hand, in co-ordination with the Beis Din, to seek perm ission for an exhumation. Something which is not normally permitted, but in this case is a must.

The process of obtaining the necessary permissions was a very arduous one, particularly in the specific circumstances o f this case, as other persons had subsequently also been buried in the same grave. It was necessary, therefore, to

obtain legal permission from the Home Office for exhumation o f each o f the bodies concerned; form al consent (known as a Faculty), from the Bishop of C helm sford (under whose religious jurisdiction the graveyard falls); and the consent o f the closest surviving relatives o f the other persons concerned, or confirmation that they had no surviving relatives who might object to the process.

Arrangements also had to be made for a Christian cerem ony to take place in respect of the reburial of the other persons exhumed.

A lthough, B aruch H ashem this episode was brought to a satisfactory conclusion, it once again highlights the worrying issue o f the possibility of other elderly people living alone in dwindling Jewish areas, and without support from friends, n eighbours or even acquaintances, in their declining years, or after their death.

Dayan Berkovits said that he was troubled by the fact that a gentleman could be hospitalised, and die, without anyone having visited him, and without anyone even being aware of his identity, and urged, “Active involvement by shuls to visit or call elderly members of their community,” particularly if no one has seen them for a short while. This is an issue which the com m unity at large should be conscious of, and in respect of which whatever steps can be taken should be set in motion.

Subsequent to this case, the chevra kadisha has recently been advised of another, similar case which is presently being looked into.

CHEVRA KADISHA SEUDAH Ihe annual Seudah o f the Chevra Kadisha took place at the Yeshurun S ynagogue, Edgw are on 5th March 1998 (7 Adar).

Hatorah Vayechel for members of the Chevra Kadisha who were fasting - was followed by a Dvar Torah by Dayan G Lopian, Rav of the Yeshurun Synagogue, who discussed the Halachah regarding which Mitzvah would take the priority in the case of Bikkur Cholim and Nichum Aveilim.

Mr Henry Dony, Joint Treasurer of the Federation Burial Society, who acted as Chairman for the evening, paid tribute to his colleague Mr Nathan Bruckheimer, to Mr Moshe Leib Stuart and Mr Zvi Brookes of the Sexton's Department at the Federation of Synagogues and gave thanks to the men and ladies of the Chevra Kadisha. Mr Dony also made mention of the improved security measures to protect Edmonton cemetery.

During the superb meal which was ca­ tered by Cassit Restaurant, Dayan Y Y Lichtenstein, Rosh Beth Din gave a speech during which he discussed the need for more women to join the Burial Society. He mentioned that he was “ex­ tremely disturbed” by the fact that whilst many women in Stamford Hill were happy to join the Chevra Kadisha of the Adass, they were reluctant to join the Fed­ eration of Synagogues, considering it to be somehow less religious. He also made mention of the very unfortunate situation that there are still some Jewish people who are being buried in nonJewish cem eteries. He concluded by stressing how great a Mitzvah was the work of the members of the Chevra Kadisha.

The Guest Speaker, Rabbi Jonathan Dove, the London Student Chaplain, thanked the Chevra Kadisha for the work they do and made mention of the awe he felt for them . He discussed how in Judaism, rather than having a “circle of life” we have “a spiral of life” and how the seudah provided a good opportunity for a person to evaluate their position spiritually this year and where they would like to be placed the same time next year.

A vote of thanks was given by the President o f the Federation of Syna­ gogues, Mr Arnold J Cohen.

Also present at the Seudah were Ex­ ecutive Members, Staff and Honorary Officers of the Federation of Synagogues, Honorary Officers of the Yeshurun Syna­ gogue, Rabbis and M inisters o f the Federation Synagogues, Rabbi Katanka of the Golders Green United Synagogue, Rabbi Godlewski of Ilford Kollel, Rabbi E Salasnik and Rev H Daviest.

Sassorrr R ebbetzen m ? ebbetzen Mindel Ossneh (Minna) Rubin o.h. nee Igelfeld, was born in 5676/1916 in Leipzig Germany.

She attended the local school in Leip­ zig, and went on to the Hamburg Girls' Seminary. Rebbetzen Rubin then learnt dressmaking and came to England in 1938 with a domestic work permit.

In 1944, she married Reb Chaim We­ ber z//, an unassuming Talmud Chochom from Reishe, Poland. After several years in the USA, the couple returned to Lon­ don where the Rebbetzen continued to assist her husband with care and devo­ tion, nursing him loyally until his passing in 5722/1962. She then contin­ ued her chassodim w orking in the Satmar nursery.

In 5742/1964, the Rebbetzen merited to becom e the Eshes C havil o f the Sassover Rebbe Shlita.

In line with her caring personality, she was a true partner to the Rebbe in his deeds o f chesed. Her whole house­ hold would revolve around assisting the

The Rebbetzen would regularly cut short any social activities to be readily avail­ able at the Rebbe’s behest. was a know n fact th at the Rebbetzen would squeeze all her belong­ ings into the corner o f her wardrobe to make room for Gemach items in her charge. For years, her Succah was laden with goods for the Kallah Gem ach, which brought such happiness to fami­ lies in need.

She had many people for whom she regularly said tefillos each day for many years.

It can truly be said that all the virtues of an Eshes Chayil, as quoted by Shlomo Hamelech, were embodied in her char­ acter.

She will be sorely missed by her fam­ ily and the Kehillah which she served with such devotion. O f her it can be said, the generations o f tzadikim are their Maasim Tovim.

by M ichael Goldman Rabbi Singer served the Federation of Synagogues as Rav of the Ohel Shem Syna­ gogue in Willesden from 1965 until 1970 and previously as Minister to the Notting Hill Syna­ gogue. He arrived in Britain as a boy shortly before World War II and, later, after several years at Yeshiva, he married a daughter of the late Dayan M Krausz, a senior member of the Federation Rabbinate and Beth Din, and pre­ viously Dayan in Leeds. Rabbi Singer left Ohel Shem on his appointment as Rabbi to Birming­ ham Central Synagogue, where he remained until his retirement.

A friendly and cheerful personality, Rabbi Singer’s disposition endeared him to his congregants, and he was particularly popular amongst children. He endeavoured whenever possible, to include them in shul services and functions, considering this an essential part of their education.

One of his daughters, Mrs Miriam Dansky, is the author of a history of the re­ nowned Gateshead Jewish Community.

Rabbi Singer is survived by his Rebbetzin, daughters, sons-in-law and grandchildren to whom we extend sincere sympathies.

Such tours include abseiling, floating in the Dead Sea, climbing Masada for sunrise, under­ ground cave scrambles, quad biking, historical site visits, barbecues on the beach, challenging hikes through desert and mountainous terrain, and to wrap it up, a little stint at the Golan Vineyard for

a bit of wine tasting. Fellowships man­ ages to pack in just about all the fun you can manage. Aside from the longer trips within the programme, there is ample time given to smaller walks and tours such as an amble round the beautiful Old cities of Jerusalem and Tzefat, walking through the old Temple tunnels under Jerusalem, a visit to see the Dead Sea Scrolls and other museums. continuum hema Yisrael Torah Network, the volunteer led organisation, which specialises in Harbotzas HaTorah using the latest te c h n o lo g ie s, has recen tly launched a w o rld -w id e shidduch cam paign, in order to help reduce the mounting number of singles w ithin O rth o d o x co m m u n ities worldwide.

The project, which is spearheaded by a team o f volunteers from Lakewood, New Jersey, under the guidance of Rabbi Shmuel Fuerst, Dayan o f the Aguda Community of Chicago, Illinois, has just been launched here in the UK, and also been approved by local Rabbonim.

The aim of this project is to create a global database o f the many singles actively looking for a shidduch, which can be accessed by shadchonim from around the w orld using netw orked computers, who are given passwords to enter the database, after having been pre­ screened by the Torah Network Shidduch committee.

Both singles and shadchonim are encouraged to fill in an application form, and are asked to supply details and references. When the application form is processed, a password is issued, allowing them access to the profiles only, of the singles (and not their personal details), thus ensuring the confidentiality o f the applicant at all times.

If a suitable match is found, an inquiry can be submitted to reveal the identity of the match, and the matter is then passed on to a “Shidduch Moderator", who will then start making the normal shidduch inquiries only after having the approval of both the singles concerned.

As one o f the main problems that singles encounter whilst looking for a shidduch is that they are only known by people in their im m ediate circles o f friends and relatives thus limiting their abilities to find a suitable match from further afield. It is the belief of the project organisers, that the creation of a global shidduch database can generate new opportunities for all those concerned.

THE EETti IDIIN 6 CES ON aV arlier this year a report appeared in The Guardian concerning a dis­ pute between a father and son which had reached the London Beth Din (United Synagogue). The persons con­ cerned were Iranian Jews, who had fled the country after the Shah was deposed and replaced by the Khomeini regime.

Naturally, their lives were in danger, and they had no option but to leave.

The problem was that the new regime did not allow them to take any of their assets with them. Consequently, they entered into an arrangement under which the son would return to Iran, and make efforts to sell their assets, which consisted o f Persian carpets, and transfer the proceeds abroad. There was an agreement between the father and son as to the division of the profits between them.

Subsequently, a dispute arose as to the exact division. Dayan Berger, sitting as a single judge, found in favour of the son, and awarded him some £500,000. The father appealed.

One of the issues at stake was whether the arrangement between them could be enforced at all. In English law a contract which is deemed to be “against public policy” cannot be enforced. Since smuggling is illegal, and against public policy, no English court would uphold a contract relating to a sm uggling operation, which is essentially what this was.

However, in Jewish law a different approach is taken. Even if the parties are engaged in a forbidden or illegal activity, that does not mean that they do not need to be paid for their services and time spent. C onsequently, Dayan Berger upheld the validity of the contract. The father subsequently appealed to the Court of Appeal.

The Guardian got hold of the story, and wrote a feature article regarding it. In the context of that article, they also wrote about the operations of the Beth Din in general. Subsequently, Dayan Berkovits was contacted by the BBC, who were intrigued by the story, and wanted to know m ore about how a Beth Din operates.

The net result was a live interview of Dayan Berkovits by Doire Brehan of BBC 4 ’s “Afternoon Shift”. The interview took place on 8th January 1998. We provide

below a transcript o f the interview (slightly edited), for the benefit of our readers who may be interested in the discussion. * ** Doire Brehan: A fter single-parent benefit cuts, perhaps the next most unpopular reforms that the present Government will introduce will be those needed to reduce the soaring legal aid bill.

A ccess to ju stic e is an essential component of a free democracy, but the cost - in time and money - of actions in our courts is threatening this. As the Chancellor struggles to get his plans for a no-win no-pay scheme implemented, he might like to look at a system of civil law which has been operating efficiently and cost-effectively right under his nose for the past one hundred years.

The Beth Din is one o f the legal world’s best-kept secrets. Governed by Jewish law, this Rabbinical Court was established here by statute in the last century, but of course it dates back much further than that. It deals with all sorts of civil cases, from divorce to defamation, and although it is a Rabbi that presides over the court, gentiles can also have their disputes resolved in the Beth Din. To tell us m ore about this extraordinary institution, I am joined by Dayan Berkovits o f the Federation of Synagogues, who is very welcome. We should explain first of all that Dayan of course is the Hebrew word for Judge.

Doire Brehan: Good afternoon, Dayan Berkovits. I have said that it goes back a long way. How far back are we talking?

Dayan Berkovits: Well, actually we are talking about at least 2000 years. The first real code of Jewish law dates back to the times of the Mishnah, something like 2000 years ago, and in fact the roots were even earlier than that. I often say to people that it is like the pyramids. They are very ancient, but that does not mean that they are no good.

that docum ent is to ensure that our decision can be enforced under the terms of the Arbitration Act. Doire Brehan: Right, so that means that whatever is decided by your court will be binding in the civil law of the land.

Dayan Berkovits: That is exactly the case. Some years ago a disgruntled litigant appealed against our costs, and he took his appeal right the way up to the Court o f Appeal. The Court of Appeal said “w ell, it is clear that it is an arbitration under the Arbitration Acts, and therefore it is binding and enforceable under English law”.

Doire Brehan: That was a terrible waste, wasn’t it? To use one system first, and then the other one as well.

What sort of cases do you have?

Dayan Berkovits: Well, we deal with the entire range of civil law cases. Lots of contract law cases, employment problems (people who have been unfairly dismissed), company law, commercial law disputes, issues o f partnership, professionals suing for their fees, lawyers or accountants or doctors suing for their fees.

Doire Brehan: It is the full range?

Dayan Berkovits: Yes, the full range.

Doire Brehan: Tell us please how it works.

Doire Brehan: So what then is different about it from our civil courts?

Dayan Berkovits: We apply Jewish principles o f law. When parties come before us, they submit voluntarily. They agree to sign a document which is called a Deed of Submission. The purpose of

Dayan Berkovits: Well, one of the issues is what sort of law we apply. Now, there are certain fundam ental differences between the Jewish legal system and the civil legal system. One of them-which IO

think was reported in the papers earlier this week - is about enforcement of illegal contracts. In English law there is a “public p o licy ” co n sid eratio n . If I induce somebody to provide me with a meal in a restaurant or services, without intending to pay for it, that is obtaining property or services by deception ...

Doire Brehan: That is the law, is it not, which most people would understand that you cannot enforce a contract say between a client and a prostitute, because w hat they are doing is illegal, and therefore it could not be enforced.

Dayan Berkovits: Yes, that is the law. It % / is based on an ethical or moral consid­ eration. We do not want to encourage prostitution, we see it as a social evil, and therefore we do not enforce the contract.

Jewish law, however, takes a radically dif­ ferent view - funnily enough - although we strongly disapprove of prostitution ...

Doire Brehan: Yes, this is ju st an example!

Dayan B erk o v its:...p ro b ab ly m ore strongly than English law. But there is also a contrary ethical or moral argument the other way. If I induce a young lady to believe that she is going to be paid for services she offers me, and I enter into a formal contract with her, and she honestly thinks that she is going to get something for it, then there is a kind o f ethical question as to whether I can then simply turn away and say: “awfully sorry, you are not going to get it”.

Doire Brehan: So you will administer the law in some ways in a different way than the law of the land would?

Dayan Berkovits: In certain areas. In som e areas o f law - for exam ple, employment law - we apply pure civil law principles - based on the theory in “internal” Jewish law that matters o f em ploym ent are governed by local custom.

Doire Brehan:... it is governed by the law of the land. But how do you decide which system of law to apply?

Davan Berkovits: Well, it is a kind of conflict of laws” choice, as we call it in legal parlance. We have to choose which system of law we are going to apply. For example, if two Jewish people come to us with a dispute over inheritance. Let us say there was no will. We may well apply - as between them - the pure Jewish law of inheritance, which differs from civil law, on the basis that the parties have

agreed that this is the way they want it to proceed.

Doire Brehan: ...they have agreed in advance that they want that. On the other hand, you will (in some cases) as you said, apply the civil law exactly as it is.

Dayan Berkovits: Yes, that’s right. And som etim es we will apply a kind o f amalgam or mixture; we will incorporate some of the rules of civil law, but not all of them, and some of the rules of Jewish law.

Doire Brehan: And you have explained to me how it is enforced. Obviously once people have signed your Deed, their dispute is “ incorporated” under the Arbitration Acts, since they are signing an agreement that they will abide by your judgment. But you also mentioned there is an area o f conflict, in that there are cases, are there not, w here you are d ecid in g things in a way which is significantly different from the law of the land.

How do you get over these conflicts; how do you get over the sort of problem you have in the case you mentioned earlier —So lei many v. So leimany - where you have a decision o f the civil court which is quite different from the Beth Din, or the Beth D in’s decision is quite different from that of the civil court. How is it eventually resolved?

Dayan Berkovits: Well, that one is going to appeal, I understand, to the Court of Appeal, on precisely that point; which is w hether the courts o f this land will uphold an arbitration, when the choice of law has opted for Jewish law, which has a different rule to English law. And the question will be whether the English courts can enforce it.

We had a similar case once relating to bankruptcy. In Jewish law you do not have a system o f bankruptcy. If I owe you money, I continue to owe you that money Doire Brehan:For ever and ever?

Dayan Berkovits:Well, if I cannot pay you today, maybe I will win the lottery next year, and then I will pay you.

We once had a case of bankruptcy, and we made an order for discovery o f documents, to see whether the person actually had any assets. He did not comply with the order. The plaintiff thereupon applied to the civil courts to have our order enforced. The judge, however, refused to enforce it, on the grounds that as there had been a civil bankruptcy order, there was no financial

obligation in English law. Bankruptcy, he said, “knocks out” the debt, and if there is no obligation, how can you enforce an order for discovery.

I should add that there is a specific provision in the Arbitration Act 1996 (which has just come into force a short while ago) empowering the parties to choose their own system of law.

Doire Brehan: So some of those conflicts will resolve them selves in time, but unfortunately the examples you have given us have resulted in both systems being employed, which is a shame in a way, because one of the great attractions of the Beth Din - is it not? - is that it is faster, it is cheaper, it seems to be a lot more efficient than the civil law. What are you doing that is so right?

Dayan Berkovits: Well, I do not think that the conflict, if you like, between the two d ifferen t system s o f law, is necessarily negative.

I think it may actually be beneficial, because you have two different legal systems “balancing” each other, as it were, which we can operate together.

One reason, I think, why Jewish law w orks perhaps m ore effectively, is because it is much less formal and bound by procedural rules than English law.

There is no requirement, for example, of formal disclosure of bundles, or advance presentation of documents.

The parties can also opt for a system of equity, which is less bound by civil law rules - form al legal rules - and is therefore both fairer and quicker. It is an “inquisitorial” system; we, as judges, sit there and ask the questions, to try to get to the truth, rather than the parties employing adversarial lawyers, who fight it out at tremendous cost to their clients, and drag everything out...

Doire Brehan: Are you at all worried that by appearing in this programme - by talking about it and letting the world know that not only are you open to business to members of the Jewish community, but also occasionally to gentiles - that with the rising costs, the pressures on the courts, the changes in the legal aid scheme - you are going to be deluged by people trying to use the system?

Dayan Berkovits: Well, that is a point. We are not advertising for business; actually I am afraid we are rather deluged at the moment!

Doire Brehan:You have enough at the moment, but you will not turn anybody

Dayan Berkovits: You have asked a very leading question ....

Dayan Berkovits: I will try to answer it.

There are issues which are complex. For example, company law issues.

We have a case which has been dragging on for some four or five years a massive case, in which all kind of issues are constantly ie-emerging - very very complex. And in cases like that we do have barristers coming along, and arguing points o f English law. We also have experts who are trained in Jewish law, arguing points of Jewish law.

When I started dealing with employment law cases, I had no idea about employment law. I am a trained lawyer myself; I taught criminal law, family law, and torts at university, but not employment law. So I think it may well be that in certain cases there would be a difficulty. I have a slight advantage, because (being familiar with English law) I at least know how to research a subject.

So ultimately I just sat down, went to the library, worked very hard, and mastered employment law. But I can see, yes, there might be certain complex areas of civil law in which a Dayan might find himself somewhat lost without proper advice.

Doire Brehan: Well, you can answer it this not a law court here!

Doire Brehan: Would there be any worry - apart from the overburden of excess

away? Would you be able to cope though, if you got a lot more gentile business?

Dayan Berkovits:Well, there would come a point when we would have to employ further staff, if you like, and there are not very many of us around. There are very few people who are qualified in Jewish law. To become a Dayan, or judge, requires a very extensive period of training, after becoming a Rabbi. There are very few of us around; and very few people who are equipped to deal with some of the issues which come up, if they are complex issues.

Doire Brehan: Ultimately, would it be self-defeating if you were to get more customers, because you would loose the speed, and in many cases the discretion, that you have in the Beth Din? Dayan Berkovits: That is a valid point.

There might well be a problem there.

Doire Brehan: Are there any areas of civil law, do you think, that the Beth Din is less well able to deal with than the civil law courts?

Dayan Berkovits: I suppose in theory that might be the case, but we do not actually have a massive surge of people applying from the gentile world. It happens, for example, when there is a company in which some of the directors are Jewish, and some are not. Or a business dispute of that nature. In such cases, we make it very clear from the outset what system o f law we are applying. We might very well say to the parties - we are going to apply the English system of law. In that case it is fine. But there may be certain areas where we would feel compelled to apply Jewish principles. I will give you an example: we once had a company law dispute, involving questions of duress, and we applied Jewish law principles, and not the civil system.

Doire Brehan: So it can still work, and you are not feeling threatened by it. Well, I hope we have not created too much business for you, but thank you for explaining it to us, Dayan Berkovits.

Dayan Berkovits: Thank you very much.

A REMEMBRANCE OF THE 30s AND 40s he novelty of the change from the camp in Hay (New South Wales) to the camp near Tartura (Victoria) had worn off; the Kosher kitchen was working more or less smoothly, regular daily Shiurim, usually conducted out­ doors, were given by a num ber of Rabbonim, a camp school for those try­ ing to improve their secular knowledge, particularly English, was also well at­ tended. Some poetry was written and circulated. The subject matter was mostly our ironic position in a prisoner of war camp, treated like enemy aliens, while no one could have been more grateful to Britain than us for giving us asylum and wishing the allies every possible success in defeating Nazi Germany. However, with the improvement in living conditions and less worry about the lack of one’s per­ sonal comfort, the monotony of camp life, the grinding daily routine began to affect many of us. After living for more than eighteen months in close proximity we got to know each other so well that most of us could predict the opinions of the other twenty three men sharing the same hut. Even the jokes became stale; the only way to make time pass quickly was to volunteer for jobs and keep oneself busy.

Then, one day we were informed that an “Official Visitor”, sent by the Red Cross, would be visiting us to see whether the Australian army was treating us, the prisoners of war, according to the “Ge­ neva convention”. We were outraged as firstly, we did not regard ourselves as RO.Ws and secondly, those of us who had unfortunately left family or relatives be­ hind in central Europe and whose uncertain fate was always on our minds, knew perfectly well that this great, hu­ manitarian and caring organisation, the Red Cross, had never even protested to the Nazi regime about their anti-Jewish legislation, their concentration camps etc. with the convenient excuse that they could not interfere in the internal affairs of a sovereign state. So we decided to ignore the visit; however the army had to go through the motions and asked us to give reports of our life in the camp to sat­ isfy the protocol. In the event, an amazing thing emerged: the Red Cross man ex­ plained to us that while he personally understood our misgivings, he could not alter our status as the British sent us “down-under” as RO.W s. by Willy Ungar quence, we had the right to write home to Germany or Austria if we still had any relatives there. He saw to it that we re­ ceived a supply of RO.W. letters, even thinner than air mail letters, treated to make it impossible to use invisible ink.

So for the first time since the outbreak of the war I was able to send a letter to my parents and sister in Vienna.

O f course, we were warned to write no words that could be inteipreted in any way as a hidden message as these letters were subject to both Australian as well as German or Austrian censors. After four or five weeks I had a letter from my par­ ents, written on similar paper but many words and even whole lines were care­ fully cut out. It did not matter, I was overjoyed that they were still alive and once a month 1 sent and received a com­ m unication. This went on until the summer of 1942, when my own letters were returned, with an official stamp across the address saying: ‘Return to sender. Addressee emigrated.’ Of course I knew immediately that could only mean deportation as no country at war allows any citizen to “emigrate”. Only at the end of 1946, more than a year after the defeat of the Axis countries did I find out where my family was sent and that they had died in one of the gas chambers. At the time, however, in Australia, I still had hoped that the war would soon end and the camps would be liberated by the Allies.

In the meantime, the war in Europe was turning more and more in favour of the allies, even the shipping lanes had become safer. Convoys, guarded by war­ ships, crossed the oceans. Our continued internment was being brought to the at­ tention in the House of Commons and the press, by influential people, like Sir Wedgwood Benn - father o f the well known Tony - and Mr Herbert Morrison, the Home Secretary, had to admit in the House that “mistakes had been made” re­ garding the internment o f aliens. All efforts would be made to repatriate them as soon as shipping would become avail­ able. This statement was communicated to us and gave us hope; but the weeks and

months passed by and we had to console ourselves with the thought that our back­ ers had won a moral victory for us.

Not long after that, however, release papers began to arrive for men who had left wives and children behind in Eng­ land, as well as people who had held important positions in industry and had jobs waiting for them; particularly those who could make a valuable contribution to the war effort. As far as I was con­ cerned, I knew that no one was waiting for me in London and no one would ap­ ply for my release or find me a job which would be regarded as useful. One day, in the summer of 1943, I also got one of these famous buff coloured envelopes, in­ forming me that through the efforts of the RE.N. Club, (an association of distin­ guished writers, as I found out later), the Home Office had decided to grant me re­ patriatio n at the earliest possible opportunity. This letter was addressed to a Mr Wilhelm Unger, but not to me as I spell my name Ungar. First, I was stunned by the coincidence of having almost a name sake of whom 1 had never heard, nor was I aware of the existence of a RE.N. Club, and thirdly, that it should have been handed to me. So I though let me first think over what to do; let me luxuriate a little in the thought of being famous and so well known that some peo­ ple should be so eager to have me back.

So I thought about it for a good while and finally convinced myself that to do nothing was the best policy. I was also sure that my ‘namesake' would have been told by his sponsors that they had suc­ ceeded in obtaining his release papers.

A few more weeks passed when we heard of the arrival of a certain Major Leyton, a British army officer, who set up an office in the camp with the purpose of interviewing all those who were likely to be allowed back to England on the first available boat. Working in alphabetical order, it took some days before I was called to appear before the Major. He was a kind, Jewish man, sympathetic to our predicam ent but, as expected, he informed me that my papers related to another gentleman. I pretended to be utterly surprised and told him that many distant relatives and friends were awaiting my return, and, exaggerating my disappointment, tried to give a convincing performance. I am not at all sure whether O

I had made any impression on him as he just gave me the bland reply that he would see what he could do for me.

A fter fu rth e r p le a d in g , he fin ally promised me that as my hopes had been raised through a mistake, he would put my name on the list as the first reserve candidate, should one o f the others be unable to travel for any reason. Failing that, he undertook to put me at the top o f the list for the second boat. It was quite some time before anything further was heard regarding the repatriation of the first group; for me it was a time of doubt whether I had done the right thing to push m yself forward in the queue.

True, I was thoroughly fed up with camp life, but would it be better to endure the London Blitz and risk one’s life night after night? After more than two years o f in tern m en t, w hen all decisions had been made for me by civil servants, the police or the army, it became clear to me that from now on it would be my own responsibility to direct my life.

Finally, the day came when the four hundred or so chosen ones were told to be ready the following morning as a boat called the ‘T h e m isto c le s’ had docked in M elbourne and would be ready to sail within twenty-four hours.

There was great excitement in the camp as the names were called out - but mine was not amongst them. Well, I said to myself, “Gam zu Letova, maybe this is for the best." Early next m orning a sergeant came into our hut, calling out my name. “You are on, son!” He barked, “Get ready to line up in ten minutes.”

As I was told later, there was one man on the list who was wanted in London by the police in connection w ith a burglary and Major Leyton had decided that man could stew a little longer and allowed me to take his place. From that m oment on things becam e hectic: a q u ick g a th e rin g up o f the few belongings I had acquired, a hurried goodbye to friends and acquaintances, and an exit through the barbed wire gates at a trot. There was no time to look back at the guards with their guns in their towers, not at the searchlights, a nightly annoyance I could never get used to, just a wave to the forty or so chaps lining the fence.

The jo u rn e y to and th ro u g h Melbourne passed quickly and although in a eu p h o ric m ood, being on the threshold o f freedom , there was the

nagging question o f whether I had made the right choice. We had heard enough from the radio and through reports receiv ed from L o n d o n , ab o u t the bombings, the sleeping in shelters, the rationing o f food, the clothing coupons and the many hardships the Londoners had to endure, that the thought alone made me feel apprehensive, to say the least. But after boarding the boat and having been allocated a small cabin for two men and left to our own devices, the feeling o f freedom gripped me. The army asked for volunteers to help man the crow ’s nest and to act as lookouts for the tell-tale signs o f a periscope of a su b m arin e ch u rn in g thro u g h the w ater. L ike m any o th e rs, I also volunteered and those two hours spent high above the sh ip , in co m p lete solitude were the highlight o f the day for me. To be up there and observe the su n rise or su n se t, or to w atch an albatross follow the boat hour after hour, never tiring, hardly using the pow er o f its vast w ingspan was an education and a pleasure. At night, looking over the railings into the water, one could see thousands o f tiny lights sparking, as if all the glow-worms of the so u th e rn h e m isp h e re w ere assembled round the metal hull. In fact, they w ere o n ly tin y p a rtic le s o f phosphorus being attracted to the ship at water level. At the same time, looking up at the stars, o f which there were infinitely more above the Indian ocean than there are in the northern sky, was an experience I shall never forget.

The return jo u rn ey follow ed the same route we took to Australia: in a straight line towards South Africa, only this time we landed in Durban harbour.

The ship took in fresh water, straight from a hydrant through long hoses and then coal was brought aboard. Not as one would have thought by using a conveyor belt, but by using an unending line o f black men, with a sack o f coal on their backs, walking up a plank and tipping its contents into a hold. Then slowly back again to fill up their sack with another load. It went on hour after hour.

We then sailed round the Cape and northwards all the way: South Atlantic, North Atlantic, Irish Sea and back to Liverpool. There the soldiers separated all those who were in possession o f release papers from the few o f us whose release had not come through yet, or

those, like me, whose release was still dependent on getting a job, which was classed as war-work. The latter group was marched to a different dock where we had to board a ferry going to the Isle o f Man; some of us to be billeted in Douglas, others in Ramsey. For me it meant a cruise from internment to internment, a little vacation travelling the high seas for two or three weeks; only this time it meant living in houses and not in army huts, but the shape of the barbed wire was the same. It took the com bined effo rts o f Rabbi Dr Schonfeld and Ernest Strauss, a friend from the Tartura cam p, about three months to get me a job in the Crown M acaroni Co. The factory produced macaroni for the army and was classed as part of the war effort. The owner was a religious Jew who had set up his plant in Welwyn Garden City, making kosher pasta products. The army was not fussy w hether they bought kosher or not kosher food and Mr Lichtigfeld got the contract to supply as much as possible.

Thus, the factory worked from one hour after Shabbos was out until one hour before the next S habbos cam e in, twenty four hours a day, six days a week. Ernest was already working there and recommended me as an “expert” in food manufacture, whilst the Agudath Yisroel obtained my working permit and release.

While I was still on the Isle of Man, the news got through that the boat which had picked up the second batch o f internees from the Australian camp had taken a different course. They cro ssed the P acific O cean, sailed through the Panama Canal, landed in New York and then continued their journey. Half way across the Atlantic they were torpedoed by a submarine and the ship sank w ithout a single survivor.

For many years I have asked myself: why was I the only one of our family to escape the gas chamber? Why did the torpedo not explode on the way to Australia and we were not pursued and attacked a second time? And why did I get to England on the first ship?

When I sit with my dear wife, my children and their spouses plus many, many grandchildren (Unberufen, bli ay in boraj, round a Yom Tov table in Jerusalem, the answer is fairly obvious: The Al-mighty needed me to continue the line of my ancestors.

When you enter K aifeng, you leave Hendon and enter China to surround yourself with luxury and the ultimate in service. From the moment we arrived, our every need was attended to by waitresses in traditional Chinese dress, who politely welcomed us into the restaurant, showed us to our table and even gracefully placed the napkins onto our laps.

We found the atmosphere to be very warm and intimate with wood panelled ceilings, inconspicuous lighting, Chinese decor and soft candle light glowing on each table. The restaurant which is named after one of the five principal cities in China, was home to a large Jewish population from the tenth century until the end of World War II. A family tree of one of its most prominent families hangs on the wall, a commemoration of this community.

We were personally welcomed by the proprietor Mr Han, who kindly took care o f ordering a varied selection from the menu so as to give us the broadest taste possible of the different dishes available.

There certainly is something to suit eve­ ryone’s taste including vegetarians. There is a very comprehensive wine list includ­ ing Israeli, French, Californian and Italian wines as well as a choice of Champagnes - and even a selection of cigars!

We were very impressed at the effi­ ciency of the restaurant. Our appetiser appeared very promptly and was indeed presented very appetisingly. It consisted

of several samples including fried seaweed, something I have never tasted before and almost certainly would not have ordered had I personally selected from the menu.

However, I was extremely surprised at how tasty it was, and would not hesitate to or­ der it again. Shmuel agreed it was “a very novel and exciting way to eat seaweed.” and thought that the spring rolls which accompanied it were “sumptuous!”

Mr Han explained to us: “One of the beauties is that we are an old fashioned restaurant in that we manufacture every­ thing on the premises.” Kaifeng does not use any processed foods - even the sea-

weed is prepared from its raw state. Prob­ ably another reason why their food is of such a high standard is because their chef has over forty years of experience.

The second course which consisted of pancakes filled with crispy aromatic duck and served in a traditional way with plum sauce, was presented in an unusual way by first showing us the whole piece of duck before being removed to be cut up into pieces. There really is an art to the rolling of pancakes which I discovered when we prepared the next ones ourselves. It is not as easy as it looks and Shmuel made a far better job ot it than I did.

We both enjoyed the main course which like the appetiser, was made up of a selec­ tion of samples. Particularly noteworthy was the Four Braised Vegetables which consisted of corn, green beans, mush­ rooms and courgettes. Whilst they were served in a sauce, they were not limp and retained a pleasing texture.

No matter how enthusiastic or how much mess you make of your delicious meal, the table cloth is magically whisked away after the main course to reveal another clean cloth underneath.

The dessert menu is filled with a comprehensive selection o f delicious choices, but for a real spectacle in creative design order the Coupe Kaifeng replete with exotic fresh fruit and ice-cream. A more unusual suggestion is the Red Bean Pancake. Don’t be deceived by the name, it is a red bean paste cooked with sugar and wrapped around with pastry. It rather reminded me of a thin dried-fruit cake.

The prices at Kaifeng are in the class of an exclusive restaurant, and range from approximately £22.00 to £40.00 a head, with set menu options including a gourmet set menu. During the week there is a half price menu for lunch.

Kaifeng is probably one of the most famous Kosher restaurants in the world today and welcomes Jewish people from across the spectrum and all corners of the world. With its warm welcome, delicious food and excellent service - it is not hard to see why.

An Interview with Mrs Hugette Wieselberg

Hugette Wieselberg is a social worker and family therapist for Norwood Ravenswood.

She trained with and works for the family mediation service and acts as a divorce mediator for the Beth Din of the Federation of Synagogues, which is a project of Norwood Ravenswood.

SARAH: How did you first get involved in working with the Beth Din? HUGETTE: About two and a half years ago I had a conversation with Dayan Berkovits and told him that I had started mediation training. I thought that the rea­ son a number of gittin were being refused by the husband was because issues had not been resolved, typically involving the children. I thought I could mediate so there would no longer be a barrier for the get. Dayan Berkovits agreed that the man holds the get as a “gun to her head to break her with”.

SARAH: When are you called to medi­ ate?

HUGETTE: I am called if there is a Din Torah, to mediate between the two par­ ties particularly with regards to the children. I will give my professional view of what needs to happen to them. The Dayanim take the needs of the children into very careful consideration when making their decision. t

SARAH: How do you mediate between the parents?

HUGETTE: I get the parents to focus on needs of their children and to mediate as parents, not as husband and wife. If you get them to be empathetic and think as parents, it can be easier to sort out.

On several occasions, I have met with a mother who has said she does not mind if the children see their father, and a fa­ ther who want to see his children each weekend. I will then meet with the children on their own, specifically to establish their views and what they want.

Any child from the age of eight or nine upwards can tell you what they want, and what they would be happy with. Some­ times they don’t want to stay with their father every weekend because it would mean missing out on birthday parties and so on. The father needs to understand that children need social contact.

SARAH: How has Dayan Berkovits re­ acted to mediation?

HUGETTE: I have found him to be ex­ tremely enthusiastic. He is very au fait with children caught up in a tug of war, and sen­ sitive to the woman’s position. Even though coming to the Beth Din can be a tough or­ deal of many women, the Dayanim try to put them at ease. The Beth Din are very helpful in seeing the children and taking their development needs into question.

SARAH: Has mediation proved to be a success?

HUGETTE: Yes. We have had a number of successful cases of a get being given without any pressure needed.

SARAH: What is the difference between your job as a mediator and a counsellor?

HUGETTE: Initially, there will be distress and whilst I as a mediator have to acknowl­ edge these feelings sufficiently to be contained, I must continue with proposals.

A counsellor, however, remains with these feelings.

A mediator does not have ideas or solutions, it is the couple who come up with them. The mediator just facilitates them.

There is an agenda of items which need to be discussed in mediation - including the get.

Like a counsellor, however, all discus­ sions are confidential and cannot be used against either party.

SARAH: Are you ever affected by the cases you deal with?

H U G ETTE: The most painful cases affect me, especially when the children have suffered a lot. The parents describe the children as having classic symptoms: they don’t like going to school, become aggressive and wet the bed; yet the man will still say: “Over my dead body, you won’t get a penny from me.” Parents just punish each other, not caring for their children.

SARAH: Can children ever get over the ordeal of a divorce?

HUGETTE: I Know from research that children can get over divorce. It is the conflict after divorce that causes the most damage. Parents don't have to love one another, they only have to communicate regarding the children. If they are focused on the children, they can get over it within a year - like a bereavement. Both aca­ demically and socially a child will be at the level of their peer group within a year if the divorce is amicable.

I use data to show parents that the chil­ dren will be O.K if handled correctly. I tell them to speak positively to children about the other parent and not to use chil­ dren as go betweens or spies.

Children do best when they can have a life with both parents. Parents can di­ vorce each other but not their children.

They can still have a life with their chil­ dren. I work hard for children to still be able to see their father.

SARAH: What main aims and ambitions do yQU hope t0 achieve through your work?

L e tte r from H a d a ssa h How We Su rvived th e Ice Sto rm of 1998 t has been the most talked about topic so far this year in Montreal. Only days into the beginning o f 1998 we were in the m iddle o f an ice storm.

Quebec and parts o f the surrounding provinces were under siege by ice. Power pylons, over loaded with ice build-up, collapsed, leaving more than a million homes and businesses with no power.

When it is - IOC outside and everything in your house is powered by electricity, including the heating system, it can be­ come very uncomfortable, very quickly.

The first week, when it was only freez­ ing rain, it was not too bad. We still had power. We just did not make any unnec­ essary trips outside. The roads and pavements were like a huge skating rink.

Emergency rooms were full o f people with broken bones. E ventually they closed all the schools and playgroups because it was simply too dangerous to walk or drive outside.

Then early on Tuesday morning we lost power. No power meant no coffee.

Did 1 miss that coffee! The kids had a lot of fun with the situation. They bundled up in loads of clothes, carted their duvets into the living room, where we “camped” out. This power failure was a challenge to us mothers. How to keep the children entertained and happy with no TV, no ra­ dio, no music, no heat - and no coffee!

The morning dragged on slowly, with the phone ringing non-stop - friends calling to commiserate and complain.

Just as I was about to make the boys some lunch the power came back on. I immediately boiled the kettle and wanned up some noodle soups for the boys. We were finally warm and happy.

That evening we decided to go out to dinner -1 certainly had no energy to cook.

As we were about to leave, the power went off again and we arrived at the restaurant to find that the whole neighborhood had had the same idea. We had a great deal of trouble to find a parking spot, the restau­

rant was packed and tempers were run­ ning high. We waited an hour-and-a-half for our meal, which due to the circum­ stances was not enjoyed. The boys were tired and miserable - it was way past their bedtime - and they were hungry. Thank­ fully, by the time we got home the power was back on again.

On Wednesday my mother-in-law was due to leave for Florida. After a delay of several hours, her flight took off. That was the last flight out of Montreal. (She called us later on that day - it was 85°F and sunny, and she had just been for a walk on the beach. Talk about me being green with envy.)

The power lasted until early Thursday morning. Once again no coffee! This time Hydro Quebec, the electricity company, said that it could be at least forty-eight hours until the power returned. Fortyeight hours would bring us into Shabbat.

Panic stations! How would we cook for Shabbat? How could we even think o f staying in a cold house over Shabbat, especially w ith two little boys and a pregnant mother to consider? But what could we do? Where could we go?

Shelters were being set up everywhere.

People were leaving their cold homes to bunk in with hundreds o f neighbors and strangers. Meals were provided, as were showers, fresh clothes, support and com­ fort. They laid on activities for the children - TV, videos, storytimes etc.

Shelters had electrical priority, although some were powered by generators. Some shuls were also put into use for this purpose. One evening, in the Shaar Hashomayim Shul, there was a wedding in the main ballroom, while the rooms next door were housing people fleeing their homes. The leftovers from the din­ ner helped to feed those people.

We did not want to have to go to a shel­ ter. With two young toddlers it was not ideal. We had friends who left town for Toronto or New York or wherever there were relatives and heat! However after a short while they closed the border cross­ ing to the States because o f bad weather conditions.

I finally called Shmari at the office,

and we discussed the possibility of book­ ing into a hotel for the weekend. It was futile. E verything in M ontreal was booked solid. However, all the hotels in the region made special deals for people seeking sanctuary. We decided take ad­ vantage of the situation and have a fun weekend away. We booked a chalet in Mont Tremblant, a ski resort that still had power. Shmari left work, ran to the shops to buy everything we needed for Shabbat, came home and off we went. It almost felt as though we were refugees, fleeing under the cover of darkness. The roads were terrible, visibility was practically nil.

The chalet was beautiful, set in the majestic snow capped Tremblant moun­ tains and came complete with a kitchen, spacious bedrooms, and even a Jacuzzi and a fireplace. It was idyllic. We lit a fire and relaxed away from all the doom and gloom in Montreal.

On Friday morning I called a friend only to find out that the power had been restored. Everyone was busy cooking, doing their laundry and bathing for Shabbat. I felt a little foolish, having run away when staying would not have been so bad. Then we heard that they lost power again at 2.00 p.m. I was relieved that we had not decided to return! We had an en­ joyable Friday night meal, after which we all headed straight to bed. At 11.00 p.m.

The aftermath - strewn across the streets off. They came back on again for a halfhour, and then went off again, for good.

We had run away and now it had caught up with us.

We woke up cold, and I was miserable.

We had a perfectly good fireplace, but could not build a fire because it was Shabbat. The kids had a great time run­ ning around with their balaclavas on, looking like a pair of hooligans. Luckily they did not feel the cold. Unlike me. I felt like a huge icicle, and could not do anything about it.

After he had davened, Shmari went down to the central booking office to find out what the situation was. They advised us to vacate the premises as soon as pos­ sible. Shabbat was not out until after 5.00pm, so we had a whole day of mis­ ery to contend with. After 5.00pm we made a quick Havdalah, and an even quicker getaway. We decided to return home - better the devil you know. On our way we called friends and learned that power had been restored in our area at 5.00 p.m. At least the house would have started to warm up by the time we got home.

Thankfully, we have had power ever since. There are those people who suf­

fered at least a month without power.

There were elderly people who refused to leave their cold homes and died of hy­ pothermia. There were those who tried to heat their houses with outdoor barbecues, and ended up in hospital being treated for carbon monoxide inhalation. There were fires and gas explosions: many people used dangerous methods by which to heat their homes.

Everyday in the newspapers there were advisory checklists - how to turn off the water so that the pipes do not freeze whilst you have sought shelter else­ where; how long food takes to spoil; what you can claim from your insurance com­ pany and so on. There were lists of all the shelters in each area. There were pic­ tures of the devastation, broken trees, cars smashed by falling branches. Hydro crews came in from the States and the Maritime Provinces to help with the cleanup operation. Tree trimmers pa­ trolled the streets collecting fallen branches, and cutting off dangerous ones.

The army was called in. They had a multitude of responsibilities. In some ar­ eas they knocked on doors to check on the elderly, and even had the power to force them to leave their homes for a shel­

ter. They helped Hydro crews. They re­ moved tree branches. They coordinated relief efforts at shelters. They were there to do whatever was needed.

It seems like through this entire crisis Quebec pulled together. There was no anglophone/francophone distinction, no separatist comments. Everyone banded together to help their fellow man, regard­ less of race, colour, or origin. If only it could stay like that.

There were many stories of heroism, and selflessness, of help above and be­ yond the call of duty. Landlords bought generators for their tenants and provided three catered meals a day for them.

On the other hand, there was a phone line set up for reporting “gougers” - those who used the situation to profit from it such as raising the prices on batteries, torches and firewood. Anyone who took advantage of this terrible situation was reported and their stores will be boy­ cotted.

That was the storm of 1998. A bleak chapter in the life of Quebecers, a time when we were at the mercy of the ele­ m ents. There is however an upside: hospitals are bracing themselves for a baby boom at the beginning of October.

t was through my mother that I first became interested in dress making. She used to make her own clothes and I would enjoy watching her. Ever since then I have been interested in designing and making clothes. The first outfit I ever made for myself was a two-piece skirt and jacket at the age of sixteen, whilst still at High School.

After High School I went to college in Johannesburg where I received my Diploma in Fashion Design and Pattern Making and since coming to London four years ago, have taken several courses at the London College of Fashion including bridal wear and millinery.

My particular area of interest, and now speciality, is evening and bridal wear because I love the shapes and fabrics which are used in these clothes. The most exciting dress I have ever made was a wedding dress for my first customer which was a straight dress with a lot of beading on the top, puffy sleeves and a train at the back.

Personally, I prefer simple styles which are elegant rather than being over the top such as a dress with a tight bodice, gentle flowing skirt with tulle underneath. My favourite fabrics are silk dupion, crepe and satin - fabrics that do what you want them to do and turn out well. The second wedding dress I made lor someone was my favourite as it was very similar in style to what I like. It was made of satin, with no beading, a flowing

People sometimes ask me where I get my design influences from, but the truth is I don’t. 1 think up my own designs. I may look at bridal magazines for inspiration but never completely copy anything.

The benefit of making clothes or having clothes made for you is that often you cannot find what you like in the shops.

This is particularly true in the case of wedding dresses, since most of them are not suitable to wear for a Jewish bride. Of course it is always more satisfying to have a dress made to one’s own style and taste rather than having to search for it.

With my own customers, I will make an outfit to their own particular design or requirements, but can also offer assistance and ideas on styles as well as suggestions as to what would look good on their figure. I make the outfit in calico first to ensure that it fits perfectly, before I start with the more expensive fabrics.

Turning my hobby into my job means I derive great pleasure from it, but the greatest satisfaction is when a customer is really happy with something I have made for them.

PROTECT THE MEMORY OF A LOVED ONE It is a sad reflection of today’s society that many memorials suffer wanton vandalism, and these attacks are not restricted to grand or elaborate monuments; often the simplest family stones are the target of malicious or accidental damage.

Whilst it is impossible to prevent this happening, STONEGUARD in­ surance can ensure that any damage can be put right very quickly - even to total replacement of the memorial. The cost of this unique insurance is 1% p.a. payable on a renewable 5 year term.

Many insurance policies are limiting in what they will ensure you against.

But STONEGUARD is different. This scheme covers ALL RISKS - acciden­ tal or malicious, including damage by storm. STONEGUARD covers the full value of replacing or repairing the stone and provides third-party liability up to £1,000,000. There is no need to renew the policy every year. Stoneguard cover lasts for five years and can then be renewed each successive five years for as long as you wish. The memorial stone value will be index linked at 5% p.a.
