The Elephant in the Room On December 1, a new Department of Labor rule will go into effect, a rule that will have a huge impact on how almost every business operates. The rule regards the minimum salary required for an employee to be considered exempt from overtime pay.

This new rule changes the salary exemption level from the current $23,660 annually ($455 weekly) to $47,476 annually ($913 weekly). This doubling of the minimum exempt salary has a huge impact on both your business and on employees. Now, there are numerous lawsuits filed against this new rule by many businesses and Rob O’Brian, President not-for-profit organizations. Regardless, those suits will take time to make their way through the system, which means in one month, on December 1, employers of all sizes will need to comply.

So what does this rule impact? First, it is stringent that an employee who works more than 40 hours a week be paid overtime, at time and one-half, for those extra hours. This includes work that an employee does from home as well as at the job site. Second, an employee must sign in and out of his or her worktime, in order to track those hours worked. The employer must make sure employees do this because the employer is required to track hours, in detail, for every employee. Basically, if you cannot provide evidence of how many hours each of your employees work and what they are compensated, then you are subject to big fines.

Period.

For the employees who are currently considered overtime exempt, it is a new world. Her or his job needs to be carefully assessed to see how many hours are currently worked, then hours and pay adjusted around the new rule that it is now an hourly job. For an employee who can, right now, take off some time to see the doctor, go watch his or her child’s school play, or leave early to talk with an elderly parent’s care provider and then make up the time later, those days are over December 1. After that date, that employee must put in the 40 hours a week to be fully paid. If the schedule says that employee must be on the job certain hours, they must take time off to do the above or they won’t get paid for it. Or, they take that time from any Personal Time Off plan the employer has in place.

This new rule, then, increases restrictions and decreases flexibility for both the employee and the employer.

There is a lot more to this new rule, and the penalties for failing to comply are high. It impacts employers large and small, profit and not-for-profit. If you are an employer or an employee reading this, you need to learn more now. That’s why your Chamber has been conducting workshops on this new rule and has a number more set up. Learn about the new rule; be prepared by attending one of the sessions noted below.

Message to the Network from Chairman Brent Baker Election Time!

As we near Election Day, I think most of us are ready to get this season past us. The most obvious theme of this election has been conflict. It has definitely shown us one way to handle conflict. It is too easy to highlight differences, which may be necessary at election time, but I want to encourage you to think differently. While it may be necessary during election season, we all operate in a different environment. Most of us will have to work with each other for many years to come. We have to strive to look for opportunities to come together, to find ways we agree and arrive at a consensus as often as possible. The best way to do this is to communicate early and often.

When dealing with difficult situations, it is even more critical that the quality and quantity of communication increase. Additionally, the differences we bring to the table often serve to improve the quality of the work we do. The hard work is in seeing the value in the different opinions when we are certain of our ideas being best. I hope this election season will serve as a reminder how not to handle differences. Our obligation is to handle situations with professionalism so we can see our community grow together.

One more thing about the election: We will give away a $50 gift card to one YPN member November 9. The City of Joplin Fire Department recently underwent a hazard risk analysis conducted by the Insurance Services Office (ISO) and was rated a “2,” which is one point better than previous years. Increasing Sales Through Exporting

By Karen Bradshaw, Director of the Center for Entrepreneurship at Missouri Southern State University Albert Einstein once said, “Imagination is more important than knowledge. Knowledge is limited. Imagination encircles the world.”

Most business managers have to use their imagination in order to devise methods to increase their sales revenue and obtain profit. Considering the multitude of potential customers around the world, you may imagine your company as a worldclass exporter someday.

If your firm produces some type of product and is trying to increase sales, you may want to consider exporting. This may be a feasible alternative, considering that 96 percent of the world’s consumers live outside the U.S., and that two-thirds of the world’s purchasing power resides outside the U.S. According to Export.gov, more than 300,000 small and medium-sized U.S. companies exported to at least one international market in 2013. In 2014, U.S. companies exported $2.34 trillion of goods, up from $2.28 trillion in 2013.

Missouri businesses exported $12.9 billion in goods in 2013.

What type of companies are ready to start exporting?

Companies that have a management commitment to grow their firms by expanding sales, have sold their products domestically, have adequate cash flow, and the capacity and capability to produce exportable products, are most likely to succeed at exporting.

Many small and medium-sized companies now have increased access to worldwide markets because of improvements in trade finance, the development of the internet, and trade agreements between countries. Exporting can be profitable for many businesses. According to the U.S. Department of Commerce, on average, exporting companies tend to have faster-growing sales, create more jobs, and employees that earn more than in non-exporting firms. America is known for high quality, innovative goods and services, and sound business practices.

If you want to be successful in exporting to other countries, your company will need to understand which international markets will be the most profitable for your firm and where you can find this information. You will need to identify your international target markets. You will also need to understand what type of products can be sold in other countries, and how products will be insured and transported. Most importantly, you will need to be certain that you will get paid in a timely manner. You can save time and money by getting some good advice and assistance with each of these areas of concern.

U.S. Commercial Service trade professionals operate in over 100 U.S. cities and in more than 75 countries help U.S. companies get started in exporting or increase sales to new global markets. They offer trade counseling in finance,

legal and regulatory issues, documentation and product requirements. They provide trade missions, business contact lists and partner searches. In addition, they offer market intelligence, marketing research, commercial diplomacy and help companies with trade finance and insurance strategies. http://ExportMissouri.mo.gov Missouri International Trade & Investment Office offers export assistance in Missouri. It also has foreign offices that provide foreign direct investment lead generation in Brazil, Canada, China, Europe, Hong Kong, India, Japan, Mexico, Republic of Korea, Singapore and Taiwan. This office provides trade counseling, agent/distributor searches, customized market research, business protocol advice, export finance counseling, international trade shows, catalogue shows, trade leads, export due diligence support, and certificate of free sale/export documents. http://agriculture.mo.gov/abd/intmkt/ Missouri Department of Agriculture International Exporting Assistance program serves Missouri farmers, food processors, agricultural businesses and forest product companies. The office promotes Missouri agricultural products in foreign markets, provides export consultation, Certificates of Free Sales, offers trade leads and shows, sponsors trade missions, and brings international buyers to Missouri to show them Missouri producers and products. https://www.sba.gov/ U.S. Small Business Administration offers several loan programs designed to help small businesses that want to export. These include the Export Express Loan Program, the Export Working Capital Program, and the International Trade Loan Program. http://www.mssutraining.com The Missouri Southern Small Business and Technology Development Center offers consulting services to Southwest Missouri businesses desiring to export. Companies can receive assistance with developing an export strategy to increase their sales and profitability. The MSSU SBTDC is offering an exporting training event at MSSU that provides insight and information on actions your business can take to successfully identify, research and enter new international markets in Great Britain.

Engaging Future Community Leaders Leadership Joplin is a program developed by the Joplin Area Chamber of Commerce and sponsored by community businesses to identify, cultivate and motivate future community leaders. Leadership Joplin is in its 34th year with more than 850 graduates. This informative and thought-provoking program introduces participants to the community, exposes them to its challenges and requires them to fully participate in the 12-session curriculum. In addition, Leadership Joplin provides a strategic curriculum to enhance participants’ leadership skills and creates a dialogue for discussion on relevant topics and assessment of case studies, ultimately supporting the Chamber’s strategic initiatives and goals. Anyone who has a genuine interest in community leadership and wants to broaden their scope of knowledge beyond their current level is encouraged to apply to Leadership Joplin.
