10. Red flags test applied by Paris Court of Appeal in set aside proceedings although no corrupt scheme had been alleged before the tribunal

The French courts have long held that corruption is an “obvious, effective and concrete” violation of international public policy. As such, an award enforcing a corrupt scheme will not be recognised in France or could be set aside by the courts. See e.g. Paris Court of Appeal, 10 April 2018, Alstom Transports v. The standard of proof applied by the Paris Court of Appeal is the so-called red flags test (“faisceau d’indices”) inspired by US FCPA practice, pursuant to which the party seeking to have the award set aside discharges the burden of proof by relying on “serious, precise and consistent” circumstantial (rather than direct) evidence of the corrupt scheme. In Sorelec, the Paris Court of Appeal applied the same standard of proof consistently with its previous rulings. Here, the following circumstances were considered to amount to red flags: the state of civil war Libya was in at the time, the abnormal procedure followed for concluding the contract, the hastiness of the signing, the unusual terms of the contract.
