Section 1782 discovery permits US federal courts to order individuals or entities within their jurisdiction to documentary or oral provide (deposition) evidence in connection with proceedings before a “foreign or international tribunal”.

It is unsettled whether a private seated international arbitration outside of the US qualifies as a “foreign or international tribunal”. 2020 showed the US federal appellate courts to be split on this question.

Until the US Supreme Court decides whether a foreign-seated private international arbitration falls within the scope of a “foreign or international tribunal”, section 1782 discovery remains an option concerning obtaining evidence from people or entities in certain US jurisdictions. SWIPE


The Federal Courts generally and more readily agree that Investor-State arbitrations satisfy the “foreign or international tribunal” test because they are not mere private arrangements but rather are sanctioned by States.
