October in Texas is probably one of the most popular months. The summer has (mostly) broken, and we can all go outside and enjoy ourselves any time of day. The next nine months will be (mostly) great!
As the temperatures begin to dip, the Texas Propane Gas Association wants to share new trends in the outdoor living market. With high interest rates, more and more consumers are not buying new homes, choosing instead to spend big dollars to remodel or add beautiful outdoor spaces to their homes. Explore what's in and what's out in the outdoor living market.
Fall is also the time for predictions to start coming out about winter weather. Turn to page 16 to see what The Old Farmer’s Almanac and the (newer) Farmer’s Almanac have to say on the matter. NOAA’s Climate Prediction Center is pretty certain that we’ll be in an El Niño weather pattern, which typically brings wetter and cooler temperatures to Texas. I guess we’ll see!
If you haven’t ever attended the Propane Emergencies Training in College Station, make sure you consider it this year. The event will take place November 6-7. It’s a great opportunity to forge a working relationship with your local emergency responders before a crisis. It’s important for the communities you live and work in. Maine’s Acadia National Park is known for its spectacular scenery. It’s the “Crown Jewel of the Atlantic Coastline”, and visitors can expect to see all kinds of plant and animal life and ocean views along the park’s 150 miles of hiking, cycling and horse trails.
Propane Education & Research Council (PERC)'s Elena Bennett and her family embarked on an unforgettable Labor Day weekend adventure in 2022, immersing themselves in the natural beauty of Acadia. Nestled near the park, they found their haven at Under Canvas, where a carefully curated tent seamlessly blended the rugged charm of Maine's coastal landscapes with the luxurious comforts of glamping, complete with plush furnishings, modern plumbing conveniences, and tantalizing onsite dining options. Elena fondly reminisced about their stay, declaring it "the best of both worlds." By day, they roamed Acadia, exploring its pristine trails and scenic vistas. As the sun dipped below the horizon, they returned to their cozy tent to unwind and relish delectable meals. Named a 2022 ‘Top 20 Resort in the U.S. – Northeast’ by Condé Nast Traveler, Under Canvas Acadia emerged as the perfect base camp for their ideal New England getaway, elevating their experience to unforgettable heights.
While on the resort property, Bennett noticed that many of the amenities that made their stay enjoyable were powered by propane.
Propane was used for cooking in the main tent, water heating in the guest tents, and fire pits and patio heaters kept guests warm on chilly evenings. She observed that “everywhere you looked, they were using propane in some way. It really warmed my heart to see the comfort that propane can provide, even in remote areas.”
In the park itself, the Island Explorer tour buses have run on propane autogas for over 20 years. The buses are much quieter and emit fewer harmful emissions than diesel buses, providing cleaner air for wildlife, visitors and employees and protecting the park’s ecosystem.

Winter Weather Predictions: A Winter Wonderland?
For more than 230 years, The Old Farmer’s Almanac has been providing weather forecasts. The 2024 Old Farmer’s Almanac predicts snow, seasonable cold, and all of winter’s delights!
"Snowfall will be above normal across most snow-prone areas (except for the Pacific Northwest). Along with abovenormal snow, we’ll see normal to colderthan-normal temperatures in areas that typically receive snow."
"Wetter-than-usual weather is coming to the southern portions of the Deep South, Texas, and California, with potentially drought-quenching rain. As the winter map shows, much of the U.S. coastline, from New England down to Florida across the Gulf Coast to the Pacific Southwest, will experience mild to cool temperatures."
"This is the theme for the coastline of the Pacific Northwest, which will be relatively dry and cold throughout the season. While storm clouds will typically deliver rain, snow is possible for late December and mid-January."
Texas-Oklahoma Forecast
The Almanac divides out regions in its forecast, and Texas/Oklahoma is grouped together. The Almanac predicts that winter will be colder in the north portion of this region (presumable Oklahoma and North Texas) and warmer in the southern portion of the region. “It will be coldest in early and late December, early and late January and late February.”
It additionally says that precipitation and snow will be above normal.
Also, the way they break out the regions, El Paso and far West Texas are part of the “Desert Southwest” zone (with New Mexico and Arizona), and the Panhandle is on the southern edge of the “High Plains.” Both of those regions are also predicted to have colder than average winters, and above average precipitation and snow. (Though it did parse out the High Plains by saying it would be “slightly” above normal.
The Farmers’ Almanac (not to be con-
fused with the Old Farmer’s Almanac), another forecasting publication, has a little more dire prediction for Texas specifically. According to Farmers’ Almanac 2024, “Texans should prepare for an unseasonably cold and stormy winter season ahead.” Specifically, their forecast calls for unseasonably cold weather in Texas in January and February, with a possible major winter storm in mid-January.
El Niño Backs Up Predictions
Recent information from NOAA's Climate Prediction Center says there is a 99 percent chance that El Niño will be active this winter, and a 60 percent chance that it will be a "strong" El Niño. The weather pattern typically bring wetter and cooler weather to Central Texas, which aligns with both of the books' predictions.

IRS Issues Warning on Employee Retention Credit Claims
The IRS is warning businesses about deceptive marketing tactics related to the Employee Retention Credit (ERC), also known as the Employee Retention Tax Credit (ERTC). Introduced during the pandemic to aid eligible businesses, the ERC has become a target for misleading promotions. Some claim ERC submissions are “risk-free,” but improper claims can result in repayments, penalties, and interest. The IRS has increased audits and investigations, leading to criminal cases and audits of thousands of ERC claims.
Businesses must be cautious and not be lured by promoters who may charge high contingency fees, up to 25%. To qualify for the ERC, businesses must meet specific criteria, such as experiencing a COVID19-related operational suspension or a significant drop in gross receipts between March 13, 2020, and Dec. 31, 2021. Here are some red flags that signal aggressive ERC marketing:
1. Unsolicited Calls or Advertisements: Be wary of unsolicited calls or advertisements promising an “easy application process.”
2. Instant Eligibility Determinations: Promoters claiming to determine ERC eligibility within minutes should be viewed with suspicion.
3. Large Upfront Fees: If you’re asked to pay substantial upfront fees to claim the credit, exercise caution.
4. Fee Based on Refund Amount: Avoid promoters who base their fees on a percentage of the Employee Retention Credit claimed. This is a common warning sign for taxpayers in general.
5. Anonymous Preparers: Promoters who refuse to sign the ERC return filed by your business and provide their identifying information and tax identification number should be avoided.
6. Promoters Jumping to Conclusions: Be cautious of promoters who assert that your business qualifies for the ERC without thoroughly assessing your specific tax situation. The ERC is complex and requires a careful review.
Unscrupulous promoters may also lie
about eligibility requirements and refuse to provide supporting documents for their ERC computations. There’s a risk that such promoters may misuse the ERC as a means to steal your identity or claim a portion of your improperly obtained credit.
Promoters employ various tactics to lure victims:
• Aggressive Marketing: ERC promotions can be found on various platforms, including radio, TV, social media, online, phone calls, and text messages.
• Fake Letters: Some ERC mills send fake letters to taxpayers, often mimicking official IRS correspondence, urging immediate action.
• Omission of Key Details: Promoters may not accurately explain eligibility requirements or the credit’s calculation, potentially causing tax problems for your business.
• Paycheck Protection Program (PPP) Implications: Some promoters fail to mention that the ERC cannot be claimed on wages reported as payroll costs for PPP loan forgiveness.
• Misleading Supply Chain Arguments: Promoters may incorrectly suggest that supply chain disruptions qualify for the ERC, contrary to IRS guidance.
To protect your business, consider the following:
1. Work with a Trusted Tax Professional: Consult a reputable tax professional to help you navigate the ERC application process. Avoid relying on promoters who may have a vested interest in their fees.
2. Request Detailed Information: Ask for a comprehensive worksheet explaining ERC eligibility and calculations.
3. Claim Only If Legitimately Qualified: Don’t apply for the ERC unless you genuinely meet the eligibility criteria. IRS guidelines are available on their website, and a trusted tax professional can provide expert advice.
If you suspect ERC abuse or encounter questionable promotions, report them by submitting IRS Form 14242, “Report Suspected Abusive Tax Promotions or Preparers.”
Mail or fax the completed form and supporting materials to the IRS Lead Development Center in the Office of Promoter Investigations at the provided address or fax number on the form.

2023 Texas Saves with Propane Appliance Rebate Program administered by the Propane Council of Texas (ProCOT) can help propane retailers build gallons and help your customers help offset the cost of purchasing and installing new propane appliances, making it easier for homeowners and businesses to make the switch to propane.
The Texas Saves with Propane Appliance Rebate Program offers rebates for propane furnaces (including backups) and propane water heaters, $300 per appliance, with a $600 cap per household or commercial property.
To qualify for a rebate, applicants must purchase and install a qualifying propane appliance between January 1, 2023, and December 31, 2023, while funds last. The rebates are first come, first served. Propane providers must submit the application on behalf of their propane customers through our rebate portal.

Founded in 1992, Lone Star CASA is a non-profit organization dedicated to advocating for abused and neglected children in Rockwall and Kaufman counties. Trained volunteers gather crucial information to assist judges in determining the best interests of each child, providing them with safe and loving homes.
