Foreword Happy 2010! iProperty.com started with a bang in 2010 as we spent the first three days of the year running the iProperty.com EXPO property exhibition at Mid Valley Megamall. If the event is to be used as an indication of things to come, then things are certainly looking bright for the property market as the show drew more than 50,000 visitors. There are more property launches lined up this year and we have some of them covered in our special focus on page 40. RPGT blues The recent RPGT announcement in Budget 2010 is confusing. At one moment, every property will be taxed and now it seems that it has changed due to public pressure. What is the real story? - Jenny Wong Currently, the Real Property Gains Tax (RPGT) has been amended to be only applicable to properties that are sold within five years of its purchase. Furthermore, the RPGT will only be applied on real profit gained from the sale. Exemptions from RPGT are given for certain circumstances and they are: 1. Disposal of a residential property once in a lifetime. 2. Transfer of property as gifts between parent and child, husband and wife, grandparent and grandchild; and 3. Exemption of RM10,000 or 10 percent of the chargeable gain, whichever is greater for each disposal of property. Hope this helps shed some light into the RPGT.

Faster website I am a user of www.iProperty.com.my for about six months. Established developer The Dergahayu Group of Companies which was incorporated in 1975, is certainly no stranger to the property development industry. iProperty: Please share with us the ongoing developments that E&O has and what are your expectations on these projects? Lim: E&O’s recent rights issue of irredeemable convertible secured loan stocks (ICSLS) received overwhelming response, achieving an oversubscription of 2.9 times above the minimum subscription level. A total of RM236 million was raised from this exercise. Gateway cities in Asia such as Hong Kong, Tokyo and Singapore should see prices spiralling upwards as well as launch units getting smaller in size with launch per square foot prices not abating. Malaysia especially Kuala Lumpur as the capital city provides excellent investment opportunities as prices will still be below peak as compared to the region and the exchange rate will be the key deciding factors for overseas buyers to park their money in Kuala Lumpur. Mendoza: Overall, the Asia Pacific market climate is very positive. There are nearly three billion people and several million home sales annually in the region. Specifically in Hong Kong, the housing price index rose over 13% this year and sales numbers have steadily increased. The country has benefitted from an influx in buyers and investors from mainland China, a series of stimulus packages from the government and relatively low interest rates which all have contributed to the rise in prices. The housing market in Hong Kong took a hit during the global financial crisis, but after falling 17% from June-December 2008, the residential price index


Featured Interview The Intero rebounded and rose by 20% from the previous year’s bottom, according to the Ratings and Valuation Department (RVD). Singapore, also a central gateway for the region, ranks as the number two investment in 2009 and has experienced a complete turnaround from reports and prospects earlier this year. New developments are selling as fast as they hit the market and property prices have continued on an upward trend, expected to close 2009 on a strong note. According to PropertyWire, private sector developers launched 2,878 new flats in July 2009, an all time high, and 2,767 of them were sold out within a month. Further, sales of new luxury developments in Singapore’s reclaimed areas on the offshore island of Sentosa, where prices average SGD2,000-SGD3,500 per square foot, are reported to be steady. For Malaysia, investors and expatriates have been flocking there due to a low cost of living and mild weather. Federal incentives designed to draw foreigners have been beneficial for investors in recent months, and while other countries in the region have experienced price declines as a result of the financial crisis, Malaysia’s properties have remained steady. Malaysia’s advantage is that current interest rates are at a 25 year low and developers of new buildings have been more flexible and willing to throw in incentives at no additional cost.

Hong Kong’s housing price index rose over 13% in 2009

Mendoza: Hong Kong’s growth areas would be in the luxury markets, where foreign investors, particularly from mainland China buy with cash, and across rental properties, which have enjoyed a good margin with rental income for investors. So, for Hong Kong I feel there would be a strong showing across residential and commercial properties.

Malaysia is still on a push to promote itself as an international retirement destination, is likely to revamp its Malaysia My Second Home (MM2H) program. The MM2H program, which attracted over USD1 Billion to the property sector in total, is now looking beyond the average retiree or international property buyer, and is going after high net-worth individuals who may be willing to invest large amounts of capital into the economy. I would see the primary growth area here to be residential.

iProperty: What are the good habits that real estate buyers must have and why? Mendoza: Real estate buyers need to be savvier than ever, and use all of the tools at their disposal. With increased globalisation, buying properties overseas (for personal use or investment) is becoming commonplace. Gone are the days where buyers had to fly somewhere and spend days searching through paper listings and following real estate agents around to countless properties. The Internet has enabled everything from direct access to Multiple Listing Services (MLS) to virtual home tours and detailed photos. Working virtually with a broker is becoming accepted practice, and things like digital signatures have made the paperwork process more seamless. The Intero strategy syndicates listings to search engines like Trulia, Zillow, Google Maps Real Estate, and Yahoo Real Estate, and has pulled out of all print advertising and featured listings. Since syndication, Intero has created an online footprint that draws more traffic than any newspaper/print advertisement while experiencing no dip in traffic. This marks a fundamental shift in the way real estate services are delivered, and it puts our franchisees ahead of the curve.

iProperty: Where would the key real estate growth areas? How about for Malaysia, Singapore and Hong Kong?

Singapore continues to experience record sell-outs of new properties and units are sold before the ink has dried on their listings. I predict that foreign investors in commercial properties, as well as a new, young generation purchasing residential units and homes will keep the market steady, if not drive it up. Singapore is facing another record year of sales volume, and this goes across residential, commercial and industrial.

he Penang State Government is gearing up with a bang to draw more visitors to Penang, with a campaign running not one, but three years. VisitPenang Year 2010-2012 is a three-year campaign pooling the efforts of tourism industrial players, hotels, travel agents and more. “A year is too short a time to promote Penang to all the other countries, therefore three years is an ideal period to create more attractive packages and to effectively allow better response in tourist visits to Penang,” said State Executive Councillor for Tourism Development & Culture, Danny Law Heng Kiang.

Launching a Host of Good Times The campaign was soft launched with monthlong festivities held in conjunction with George Town’s UNESCO Celebration Month in July 2009, celebrating the first anniversary of George Town’s being accorded UNESCO World Cultural Heritage Site status. The Dragon Boat Festival in December 2009 also saw a whopping 27 teams, closing off 2009 with a bang and heralding exciting times to come. The State Government’s New Year’s Eve festivities, aimed at ‘officially launching’ VisitPenang Year 2010-2012, combines classicism with a rocking good time, with captivating multi-ethnic cultural performances by Seni Mutiara, The Spring Productions and Temple of Fine Arts, followed by live bands at Gurney Plaza – all in all, quite a party!

Institutionalising For Better Results VisitPenang Year 2010-2012 marks the State Government’s realisation that a coordinated

effort is needed to synergise the energies of different players in the tourism industry. As observed by Penang Chief Minster Lim Guan Eng: “There is a need to institutionalise the tourism sector to ensure a sustained effort to develop tourism as one of the main engine of economic growth.” And in fact, there is potential for economic growth aplenty in the tourism sector. Penang hosted 6.3 million tourist arrivals in 2008 and intends to increase this to 10 million tourists by 2014. Mr Lim pointed out that, of USD14 billion (about RM48 billion) in Malaysia’s overall tourism receipts in 2008, Penang has been estimated by some reports as earning only USD400 million (about RM1.376 billion). Penang, he said, needs to upgrade and innovate, giving investors a ‘unique and unforgettable experience’ to get at least USD1 billion of the country’s USD14 billion tourism receipts. “There is a need to institutionalise the tourism sector to ensure a sustained effort to develop tourism as one of the main engine of economic growth,” he said, pointing out that in 2008, the services sector contributed to 56 percent of Penang’s GDP. “If we are to fulfil the Industrial Master Plan 3 (IMP) target of 75% of GNP for Penang in 2020, it is critical there is an organised and systematic effort combined with a high degree of public and private sector cooperation,” said Mr Lim.

Galvanising the Young The State Government is also reaching out to more youth, as tourists as well as in the form of resources to tap for ideas and energy. Thus, events like the Pesta Pulau Pinang are being upgraded and ‘internationalized’ (but with affordable entrance fees) to attract more youth and generate more revenue for traders. This annual year-end event ran for 41 days in 2009, and featured stalls exhibiting and selling a wide range of items; booths by government

agencies, as well as exciting activities such as a badminton competition, Combat Sport Festival, silat demonstration, silambam, arm wrestling, kabbadi exhibition, the Scooter Fest 2009 and Penang International Muay Thai Tournament 2009. VisitPenang Year 2010-2012 also saw the organisation of the inaugural Penang Postcard Competition, jointly organized by the Penang State Tourism Development & Culture and KDU College (Penang Campus). Open to all Malaysians and foreigners, the competition running from June to August 2009 invited participants who live in or have visited Penang to send in photographs of what they love about Penang and what they would proudly show to the world. “In the highly competitive tourism industry, every country on the planet is trying to identify unique selling points that will make them stand out from the crowd and help them attract tourists. Here in Penang, we are blessed with more than our fair share of desirable tourism products and attractions,” said the Chief Minister, gratified that the 750 entries reflected residents’ and visitors’ love and appreciation of Penang’s Culture, Heritage, Food and Flora and Fauna in their photographs. Now to spread the good news (and beautiful images) to the rest of the world!

skandar Malaysia’s wooing of knowledge workers continues unabated. Fresh incentives from the Government from the recently announced Budget, as well as the confirmed participation of a major international film studio, are set to propel the economic region into a bumper 2010.

Best of the Best From the Silver Screen The recent announcement of Pinewood Studios’ entry into Iskandar Malaysia set off a palpable buzz of excitement, not just in the South but nationwide and perhaps in the region as well. And for good reason – Pinewood Studios is responsible for some of the best moments in film history, including movies such as Superman, James Bond, Batman, and Tomb Raider, as well as television dramas, commercials, animation and more. Pinewood is now entering Iskandar Malaysia in a RM400 million joint venture with Khazanah Nasional Bhd. The move is seen as the Government’s upping the ante in boosting Iskandar Malaysia’s appeal as a global creative hub. The product, Pinewood Iskandar Malaysia Studio (PIMS) is scheduled to open by early 2013. It will be located on a 32-ha site next to Medini (the Gulf-backed urban development area). The project is already off to a good start with Astro signing up as an anchor tenant, using PIMS to produce its local language content programmes. PIMS will remain an independent studio, with Pinewood’s global pull geared to attract big-budget movie producers in Europe and the United States to use the facilities here. According to Khazanah managing director Tan Sri Azman Mokhtar, PIMS is ‘conservatively’ projected to generate about RM1 billion in direct and spinoff business over the next eight years and ‘will create 3,000 direct jobs and

potentially an additional 5,000 indirect jobs a year’. Other sectors which should benefit from spillover effects include tourism, finance and highvalue manufacturing.

Overcoming Setbacks Part of the Game Tan Sri Azman admitted to the media in December that Iskandar Malaysia did suffer a dip in new investment. The economic recession greatly affected the Gulf region, particularly Dubai, from which came some of Iskandar Malaysia’s major investors. Thankfully, however, the management did not put all their eggs in one basket, and as a result, said Tan Sri Azman, the special economic corridor’s exposure to Dubai investors was considered ‘very small’. Wooing More Creative Knowledge Workers The Government is also looking at other means to attract and keep knowledge workers here. The recently announced Budget, for example, announced a 15 percent income tax rate specially for knowledge workers in Iskandar Malaysia. The Government is now embarking on an in-depth study to work out how best to implement this, with decision-makers from the Finance Ministry, Economic Planning Unit and Inland Revenue Board. The results of the study should be ready for tabling in Parliament in the first quarter of 2010, said Iskandar Regional Development Authority (Irda) chief executive officer Harun Johari. Parliament will then need to pass a new Bill before this preferential tax rate can be implemented – proving that talk is far from cheap, indeed!

Under the proposal, Malaysian and foreign knowledge workers residing and working in qualifying activities in Iskandar would enjoy the tax regime of 15 percent. It applies to those engaged in qualifying activities – green technology, biotechnology, educational services, healthcare, creative industry, financial advisory, consultancy services, logistic services and tourism, who apply for and begin employment in Iskandar between Oct 24, 2009 and Dec 31, 2015. The study, then, will look at the definition of knowledge workers, income bracket and implementation once the Bill is passed, said Harun, adding: “We, the stakeholders of Iskandar are not involved in the study and we are not the decision makers but we do give our views when asked.” Irda is the regulatory authority involves in planning, promoting and facilitating the development of Iskandar; other stakeholders include Johor government, Iskandar Investment Bhd, UEM Land Holdings Bhd and Iskandar Waterfront Development Sdn Bhd.

No property is truly safe from pests, even for high-rise buildings. The most common pests that we encounter here in the country are cockroaches, ants, rodents and termites. Mosquitoes are also pests that we are familiar with, being in a tropical country. “Termites are the number one pests in Malaysia as they can cause damage to all types of properties, residential, commercial and industrial included,” said Carol Lam, managing director of Rentokil Initial (M) Sdn Bhd. She elaborated that termites are the most destructive, which is why pest control services offered by Rentokil Initial is split into two categories – general pests and termites. She further added that pest control is also important for goodwill, especially important for restaurants and to a certain extent, businesses too, as employees will feel good that their wellbeing is taken care off. “In Selangor, there is a regulation that is fixed by Majlis Perbandaran Subang Jaya (MPSJ) that requires all food-related businesses to have a pest control contract with any pest control companies. These are for general pests like cockroaches, rats, flies and such,” said Lam. In the past, there was some hoo-hah that food related businesses must only engage licensed pest control companies

recognised by MPSJ. This decision was since overturned and now operators are free to engage any pest control services. That said, the pest control operators and their technicians are required to have a Pest Control Operator License and Pesticide Applicator License (PAL). SF Yoong, general manager of AntiPest Management Services Sdn Bhd also opined that termites are the number one pests in Malaysia. He said, “Termites attacks the structure of a building and potentially cause serious damage. Other pests like cockroaches, rodents and mosquitoes attack the health and safety of the public as they can spread diseases. Meanwhile for restaurants, pests cause a hygiene problem and they may lose their operating licenses.” Yoong shared that in AntiPest’s past experiences; they have seen roofs that are so badly damaged that they are almost in the state of collapse. Furthermore, the homes that are most susceptible to pest invasion are the ones left vacant for a long period of time.

Apart from termites, Yoong said that ants are also a common pest in the country but they are generally more of a nuisance rather than are destructive. He further shared that most of the cockroaches in homes are of the American species and they reside mostly in septic tanks and damp humid areas.

Engaging pest control services While there are many companies out in the market offering pest control services, consumers need to ensure that they engage a licensed company. Consumers have a right to see the PAL license of the pesticide applicators. This is to ensure that they are trained and authorised in the safe-handling of pesticides, its application, usage of machinery and proper usage of pesticides to control infestations. To engage pest control services, house owners will just need to call licensed pest control operators. Consumers can get a quotation over the phone, but in some cases, pest control operators can send a surveyor over to the property to evaluate the problem. Depending on the operator’s coverage area, this preliminary evaluation can be free without any obligations. That said, this is usually a visual examination. There might be a fee should there be a need for detailed written reports. “The recommended frequency for pest control is bi-monthly and contrary to popular belief, it does not actually cost a lot,” said Lam. Lam shared that for general pest contracts with Rentokil, it only costs from RM360 per annum for residential properties and from RM400 for commercial properties. This contract keeps cockroaches, rodents and ants in check, with professional visits from licensed technicians to the property once every two months. Meanwhile, a one-off termite treatment will cost from RM2,500. Quoted prices are only for indoor areas and do not include gardens.

“Every pest control company must be licensed by the Ministry of Agriculture under the Pesticides Board. Each applicator must be holding a license and property owners should look out for that,” said Yoong. He added that it also helps that if the pest control company is a member of the Pest Control Association of Malaysia (PCAM). “Members of PCAM have a code of ethics. Furthermore, consumers have an association to turn to should there be any feedback on pest control companies that are members of the PCAM,” added Yoong. “Antipest can send surveyors within certain coverage areas free-or-charge to evaluate infestations and the controls needed. We have operations in the Klang Valley and Johor. Engaging pest control services (with Antipest) can range from RM60 to RM150 per hour, depending on the distance and level of infestation,” said Yoong. Apart from general pests (cockroaches, ants and rodents), Antipest also deals with incidental pests like bed bugs, fleas, bees, hornets and even birds. Yoong pointed out that not all pest control methods use chemicals and there are other methods such as sealing, sticky pads and such.

iExpert Tenancy agreements Q: I hope to rent out my property but I am not too sure about tenancy agreements. Are there standard-type agreements or can I add some terms like ‘do not nail on the wall’ or ‘repair it before moving out’ or other responsibilities? My previous tenancy experience was not a pleasant one as the tenant who wanted to move out just told me to deduct the rent from the deposit they paid during the start of the tenancy. When they moved out, I found that my house was seriously damaged. I could not help but think that if I did not deduct the rent from the deposit, I could have used the money to cover repair cost and to reduce my losses. How do I protect myself? Can I reject the request to deduct the final rent from the deposit? Can I request the previous tenant to foot the cost of the repairs? Please advice. A: Tenancy agreements are tailor made. In actual fact, even tenants can requests for some terms to be placed into the agreement, and it is entirely up to both parties (the landlord and tenant) to agree on it. Should the terms not be agreeable on either side, then the deal should not even go through. A2: There are no such things as standard tenancy agreements and clauses can be added from either side. It is only when both parties agree on the set clauses then should the property be let out. As for the deposit, the money is normally used to offset the cost of agreeable repairs or maybe even unpaid utility bills that the tenant might have not paid. The balance from the deposit is then returned to the client. Putting in a clause in your tenancy agreement can restrict the use of the deposit to pay for the final rent. Remember, it is always better to protect yourself.

Subsale valuation Q: An agent told me that I might not be able to always obtain 90% loan for subsale properties. His reason given was that banks have property valuers that will evaluate the market value of properties and then only decide on a maximum allowable loan amount based on their perceived valuation. Is this the case? A: Yes, this is true. Subsale properties in the market are driven by supply and demand, and can be priced above their maximum valuation by banks. It is usually in this case that the approved loan will be less than 90% of the subsale purchase price. Therefore, it is always advisable to have at least 2066 |

Changing to gated and guarded Q: Recently my neighbourhood residential committee has been urging us houseowners to convert our old residential area into a gated and guarded one by installing barriers and guardhouses. I am not too sure if this is a good idea as I have read from newspaper reports that some guards are untrained and do not do much to improve security. Furthermore, I am concerned that installing these barriers in my housing area will actually restrict movement and create unnecessary congestion at entry/exit points. What should I do to address my concerns? A: Every houseowner has a right to voice out their concerns on matters that happen in their neighbourhood. The best way to deal with your concerns is to engage in a dialogue with your neighbourhood residential committee members and attend their residents meetings to discuss what is best for the community.

Hijacked parking at condominium Q: The condominium unit I purchased comes with two allocated side-byside car parks. So far, I have been only using one of the car parks and left the other one empty. Recently though, I found out that the building management have given my unused lot to another resident without notifying me. What should I do? A: Contact your condominium management and show them your signed documents that the car park lots belong to your condominium unit. It is their responsibility to rectify the situation and inform the other resident of their mistake.

Your Money Personality During the course of my seminars and personal financial consultations, I have come across many people who have different attitudes towards money. All of us have unique personalities - some characteristics are inborn and some learnt along life’s journey. Likewise, when it comes to money and real estate investments, we too possess various money personalities. Here they are:

yourself how much that purchase is going to mean to you in a year. If the answer is “not much”, forgo the purchase. This way, you can limit your spending to things you’ll actually use. If possible, draw up a budget of how much you are going to spend every month and stick to it. In case you over-spend in one month, make sure you have the discipline to cut back the following month.

In order to clear up the credit card debts and begin their investment journey, I strongly suggested that they sell off their two cars which were around a year old and downgrade to a three year old Proton or Perodua car which costs around RM35,000 each. Straight away, they would be able to settle their credit cards debts and have sufficient start-up capital of around RM50,000 to begin investing.

1. Spenders / Shoppers

Another suggestion is to cut up any extra credit cards you may have and lower the credit limit on the ones you use regularly. Give standing instructions to auto-debit your bank account on the due date with the full amount for all your credit cards. This way you will not be tempted to over-spend.

Unfortunately, it was easier said than done. Towards the end of our consultation, the husband blurted out that they had just placed a deposit for a new car for himself worth RM85,000 to lock-in the current low interest rates. Since both had the Debtor personality, I really had a tough time convincing them to change their spending habits. If one of them had a different money personality, perhaps I could have had an easier time to get one spouse to convince and force the other to change their ways. Finally, all I could do was wished them good luck. Personally, there is no way they will go far in life unless they made drastic changes to their behavior.

These personalities derive great emotional satisfaction from spending money. They need instant gratification and can’t resist spending money. Spenders often shop to entertain themselves, even if the items they buy go unused. A sale is simply an excuse for them to spend money on the pretext of getting a good deal on things they do not need at the moment. A well-to-do good friend of mine was shocked one day to discover during his house moving that his wife owned more than 100 pairs of shoes and over 30 handbags! Like most guys, he couldn’t see the need for his wife to have so many pairs of shoes and handbags. As money was not an issue, he didn’t mind his wife buying more new shoes or handbags provided she gave her old ones away. He was concerned that his new house was quickly running out of closet space to store things his wife bought. Unfortunately, his wife besides being a shopper was also a hoarder. She didn’t have the heart to give away things that were still fairly new and seldom used. This lead to frequent quarrels and my friend decided the only way out was to build more closet space in his current house and to move to a bigger house a few years later to accommodate his wife’s impulsive shopping habit. It was a small price that he could afford to pay to keep his wife happy. Advice for Spenders/Shoppers: Shop a Lot Less, Save a Lot More If you love to spend, it’s very likely that you are going to continue doing it. When shopping, try to seek long-term value, not just short-term satisfaction. Before making purchases, ask 68 |

2. Debtors Debtors are similar to Spenders/Shoppers. The only difference is that they are spending money that they don’t have and are living beyond their means. They are deeply in debt and often are not in a position to do much investing. Debtors will typically Live Rich but Die Poor! A few months ago, a newly married young couple in their late twenties came to see me for a personal financial consultation. They were keen on investing in properties and stocks. Their combined gross income was RM15,000 per month but their net worth was less than RM100,000! They had RM20,000 in credit card debts, less than RM5,000 in savings and they both drove brand new Japanese cars worth around RM70,000 each. Their logic of purchasing new cars was that they didn’t want any problems associated with buying cheaper second hand cars. In my opinion, both fell into the Debtor personality. While they were earning well for their age bracket, they were mismanaging their money by accumulating credit card debts and over-spending. Since both were desk bound employees, there was no need for them to make a good impression by driving new cars. In fact, they could ill-afford to drive new cars at this stage of their lives given their current financial situation.

Advice for Debtors: Start Savings, Investing & Don’t Spend Money You Don’t Have! If you are already in debt, you first need to get your debts sorted out before you can begin investing. If you are not be able to do it alone, get some professional financial help like what the couple did when they saw me. Also analyze what caused you to get into trouble. If it was easy access to credit cards, then the solution would be cut up all “temptation” cards and stick to debit cards instead. If spending was something you used to compensate for other areas of your life that you feel were lacking, think about what these might be and work on changing them. If your house and cars were purchased because of the need to look good, then you may even need to downgrade your lifestyle by moving to a small house, driving an older car, etc. Next focus your efforts on diligently saving money. Pay yourself first by setting aside a certain portion of your take-home income that automatically goes into a special bank account

3. Savers Savers are the exact opposite of Spenders/ Shoppers and Debtors. They only shop when absolutely necessary and never accumulate credit cards debts. They generally have no debts and are often viewed as cheapskates. Savers are not concerned about keeping up with the Joneses or following the latest trends. They are happy driving 20 year old cars and they derive great satisfaction from seeing the interest earned every month on their bank statements. Due to their conservative nature, they don’t take big risks with their investments. They prefer fixed deposits instead of other more riskier investments where there is a possibility of a loss. Extreme Savers unfortunately will Live Poor but Die Rich! Most of our parents who had lived through the Second World War and experienced hard times where they didn’t have the luxury of 3 meals a day will fall into this money personality type. I have met many people who live in old houses that were last renovated 20 years ago and drive well maintained cars that are more than 15 years old. And these people are the ones who have more than RM5 million in fixed deposits! At the current fixed deposit rate of 2.5% pa, their interest income alone is over RM10,000 per month which is more than sufficient to fund their no frills lifestyle. Advice for Savers: Practice Moderation + Take A Little More Investment Risk Savers shouldn’t let all of the fun parts of life pass by just to save a few cents. To achieve some sort of balance, it’s advisable for Savers to allocate a small sum of “Play Money” where they nourish their inner child by treating themselves and living like a King for just a few hours every month. For example, they could go for a massage or have coffee in a 5 star hotel once a month. Spending a bit of money on having fun isn’t going to bankrupt them. Once you have tasted the good life, would you want more? The answer is a definite Yes. In fact, you will be motivated to challenge yourself to make more money so that you can have more of the good life.

4. The Avoiders / Money Monks These people are not comfortable on the subject of money due to lack of interest or they feel that that are other more important issues. Often, they will try their level best to avoid the subject completely. Money Monks are happy go lucky and strongly belief that God will take care of them. At the extreme end, they may not even know whether they are rich or broke. If you are married to an Avoider or a Money Monk, you will have to shoulder the responsibility of managing money and investing for your family. The big advantage is that you will have little or no arguments on any money matters with them. Advice for Avoiders / Money Monks: Make Sure You Don’t Marry Your Own Kind! Alternatively find a Trusted Professional Financial Planner. It’s a sad fact that people typically will not change even when they know they need to. Hence, it’s extremely tough to suggest to Avoiders and Money Monks that they should have an interest in knowing how money works. It’s like bring a horse to water, but you can’t force it to drink water. An easier alternative for them is to make sure they don’t marry their own kind or they should seek professional help when it comes to managing their money.

5. Investors Investors are consciously aware how money works. They know where they are financially today and try to put as much of their money to work. All investors tend to seek a day when their passive income from their investments will provide sufficient income to cover all their expenses. Their actions are driven by careful decision making, and they are comfortable with the need to take a certain amount of risk in pursuit of their goals. Advice for Investors: Keep It Up! Congratulations! Financially speaking, you are on the right path and doing great! Keep doing what you are doing, and continue to educate yourself. It’s extremely important to know which money personality you fall into as each has its own strengths and weaknesses. Understanding your unique money personality will help you shape your approach to spending, saving and investing. Revival of Failed and Abandoned Projects Protection for Property Purchaser? (Part three of three)

MEETING THE NEEDS AND EXPECTIONS OF HOUSE BUYERS One such system is the ‘Built-Then-Sell Variant 10-90’ mode, a hybrid between STB and absolute “Built-Then-Sell” (BTS). The buyer pays 10% as deposit whilst the balance of 90% is paid after when the completed product is ready for delivery with ownership papers, permanent CFO, water and electricity available for tapping and running as well as vacant possession with keys. The BTS concept and its variant 10:90 will also put an end to a host of other lesser but nevertheless serious problems faced by house buyers. These include shoddy workmanship, CF problem, individual and strata titles problem and the reluctance of developers to pay late delivery penalties (LAD). It will also compel developers to build quality homes commensurate with their prices and not resort to unethical and even dishonest cost-cutting measures using sub-standard material and employment of cheap, unskilled labourers. Errant developers are fully aware and promptly exploit the fact that house buyers do not have a way out without incurring heavy losses. Within broader scheme of things, it would also curb overzealous and reckless building and reduce the number of ‘overhang’ and unsold properties. The requirement for governmental policing and enforcement of the Act 318 will be greatly reduced as the system will be largely self-regulating. The key factor to this situation is that developers are not paid before they deliver their products in its entirety. We back this statement on the fact that currently houses with CFOs may be sold without being subjected to the Act. Again, we are glad that we have made some headway in that direction with the recent inclusion of Schedule I & J to the HD Regulation which are the standard Sale & Purchase Agreements equivalent to BTS 10:90 concept. Though it presently remains an option to co-exist with the long- practiced but seriously flawed Sell-Then-Build system, it is in the making to have the system of BTS 10:90 made compulsory. Only time will tell when it is becomes mandatory. We had the opportunity to explain that it is no use having to revive abandoned housing projects and with millions of tax payers’ money when the flood gate is not shut. Government with the related players. We hope that the introduction of the interim BTS 10:90 system shall be the beginning of a road map to compel developers to adopt this system mandatory with a long term view towards the absolute “Built -Then –Sell” mode. Let us all work together to bring about the long awaited and badly needed reform for the housing industry.

SAFETY NETS Safety nets are presently place to pre-empt problematic projects. This is the requisite Form 7f which developers are required to submit bi-annually to the Controller of Housing. The Controller in exercising his powers may direct the frequency of this submission as may be determined by the Controller from time to time. This requirement shall now be made quarterly instead of bi-annually and the improved version is comprehensive for obvious reasons, that is to diagnose signs of possible problematic projects. Annexed is a copy of the newly proposed version of Perakuan Pemaju Perumahan (Borang 7f). This form is to be sworn and declared before a Commissioner of Oaths. Any false statement in the declaration would be an offence punishable under the Penal Code and shall be punished in the same manner as if one gives false evidence in a Court of Law under oath. Penal Code (Sec 193 - Punishment for false evidence.) Whoever intentionally gives false evidence in any stage of a judicial proceeding, or fabricates false evidence for the purpose of being used in any stage of a judicial proceeding, shall be punished with imprisonment for a term which may extend to seven years, and shall also be liable to fine; and whoever intentionally gives or fabricates false evidence in any other case, shall be punished with imprisonment for a term which may extend to three years, and shall also be liable to fine.” The Ministry of Housing’s Bahagian Perlesenan, has also a system of blacklisting of wayward developers, their subsidiaries and associated companies as well as to capture the names of all the directors. Developers who fail to comply with the Tribunal for Homebuyer’s Awards, too, will not be issued with new project licences. There are a lot more of our proposals towards improvements and for the casting-out of the safety nets that the working committees have accepted, although at this stage I am not at liberty to reveal. These improvements

to the administrative systems and the up-coming amendments to the legislation will be announced by the Minister of Housing at the appropriate time. . The current team of officials in Ministry of Housing headed by YBhg Dato Ahmad b Hj Kabit, KSU of KPKT, the Controller of Housing, directors and technical staffs as well as the Tribunal for House Buyers Committee members - they mean business and have been adequately knowledge in their respective role and we can say they have done a fine job and hopefully shall continue to do so. They take serious recognition of HBA’s role as the ‘watch dog’ for house buyers. We recognize that the team at the Ministry of Housing has to tackle old problems as well as to continuously prevent the escalation of new problems with on-going projects – it is indeed not an easy task. Due appreciation must be accorded to them for the hard work they are doing in line with the aims of the housing laws in protecting house buyers.

DANAHARTA EQUIVALENT LEGISLATION TO SALVAGE ABANDONED HOUSING PROJECTS HBA is glad that the Ministry of Housing & Local Government has heeded our call to have a Special Task Force to tackle abandoned housing projects. Early this year, a special division named: ‘Bahagian Pemulihan Projek Terbengkalai’ was established, spearheaded by Mr Jana Santhiran. From our working relationship, Mr Jana has proven to be an energetic, pro-active and motivated person. It is high time to have a special vehicle to deal with stalled or abandoned projects. In the public interest, a special purpose vehicle (SPV) is needed. Essentially, special law and a revolving fund is needed to establish the SPV. Like Danaharta that was established with special law ie. the Danaharta Act, the SPV will have a special legislation ie the Dana Projek Terbangkalai Act or call it by whatever name. The SPV that we suggest is solely intended to take over all abandoned projects and to promote the revival of these projects by injecting liquidity into them. These goals are to be achieved through the acquisition, management, financing and disposition of assets and liabilities of the project.

The Minister of Housing & Local Government, YB Dato Seri Kong Cho Ha has on 11.9.2009 launched The Ministry’s Housing Revival Initiatives and has invited major real estate companies to exercise their Corporate Social Responsibilities (CSR) to undertake the revival of the current crop of abandoned housing projects.

Among others, the SPV: a) will be funded through a revolving fund just like the TPPT in the early 1990’s; b) may establish its own rules and procedures; c) has the power to acquire, manage and finance the project until completion; d) all assets in the project including the land is vested in the SPV; e) may engage special project managers and independent consultants to administer and manage the project until completion; f) may transfer titles to the house buyers; g) The land authorities are authorised to register the transfers of the titles; h) Interest in the progressive installments will stop until the project is revived and completed; i) is empowered to carry out investigations including perusing the records, books and accounts of the developer; j) the Public Prosecutor may prosecute the developer for offences committed under existing laws; k) Directors or officers of the developer can be penalised; l) Buyers are entitled to seek compensation from the developer. Special law is the only means by which the acquisition, management, financing and completion of stalled or abandoned projects can be implemented promptly, efficiently and economically for the good of the public. Special law is the only means by which special project managers may be appointed expeditiously to administer and manage these projects. The SPV would serve its objective for a certain period as in the case of DanaHarta Act.

Annexed herewith is a list of abandoned housing projects identified by the Ministry of Housing as economically feasible for revival. Developers here, who are interested, please contact REHDA or the Ministry of Housing directly.

NLC - FORFEITURE & EFFECTS- STATE LEVEL Land is ‘State matter’. That being so, the problem of ‘idle’ land is only being handled at State level. To my knowledge, no comprehensive plan has been designed at national level to handle the issue or fix problems that arises. What do you tell the abandoned project ‘victims’? ‘Sabar’? Sorry, ‘our’ role is only as mediator; It is not ‘govt fault’ ? This is not correct at all. ‘Rampas tanah’? That’s more likely. Land ownership in Peninsular Malaysia is governed by the National Land Code, 1965 (Act 56) in force since January 1966. The NLC recognizes two types of land ownership. The first type is ‘land held in perpetuity’ commonly referred to as ‘freehold land’. The second is ‘land held for a term of years’ commonly referred to ‘leasehold land’. The maximum term of the latter is 99 years. Land ownership carries with it certain duties, briefly, these are (a) paying the annual quit rent to the State Authority (in default of which the land can be forfeited by the State Authority); and (b) complying with all the express and implied conditions affecting the land.

HOUSING REVIVAL INITIATIVE

‘Express conditions’ are those specially endorsed or expressed on the land title while the implied conditions are those stated in Sec 115 (for agricultural land), Sec 116 (for building land) and Sec 117 (for industrial land) of the NLC.

We must acknowledge the fact that the current President of REHDA, YBhg Dato Ng Sieng Liong has taken great efforts to participate in the revival of abandoned housing projects. He has infact garnered members of REHDA to take up some of abandoned projects that are economically still feasible to revive. HBA is able to work with him despite being perceived to be at opposing ends.

Breach of any of these conditions, if not remedied in time, can result in FORFEITURE. If a land is endorsed with the implied condition of ‘building’ category and such land is left idle or the housing project has been abandoned with half built houses beyond the ‘permitted period’ can they not be forfeited by a State Authority on grounds of breach

of the ‘implied conditions’ set under Sec 116? Sec. 116 sub-section (1) (a) ‘there shall within 2 years of that date be erected thereon a building suitable for use for one or more of the purposes specified or referred to in sub-section (4). Sub section (4)(a) relates to various purposes including ‘residential’. Of course this Section has to be read with Uniform Building By-Laws. The Selangor State government has thus far exercised this FORFEITURE Chapter in two (2) instances.

CONCLUSION HBA fully understands and appreciates the vital role played by the housing industry in the nation’s social and economic development. It is precisely for this very reason that we have been critical of the weaknesses that are prevalent in the industry. We believe that sustainable growth for the industry can only flourish in an environment of orderliness and good governance. On this aspect, all players in the industry have a role to play. From the highest regulatory government body right down the line to the professionals, each must play their part. Regulatory bodies should exhibit neither fear nor favour. The three (3) prongs of a comprehensive approach to compliance with laws and regulations are “Education”, ‘Enforcement’ and ‘Legislation’. Where there is a weak governance and limited capacity for monitoring and enforcement, how do we go about building a culture of compliance with laws? Development enterprises should have some humanitarian feelings and social corporate obligations to serve the people and the nation. Loans should be given to developers so that they can build houses. House buyers’ loan should only come in to pay for the completed houses. Architects, engineers, lawyers and all the professionals related to the building industry should be conscience-driven and display true professionalism of their trade and not to succumb to some unscrupulous and greedy paymasters who are bent on amassing quick wealth. Our views are based on solid facts and genuine cases of house buyers’ woes. They deserve adequate protection under the Law and not just sympathy or empathy. For house buyers, potential, future and present, HBA can only tell them to Invest in Knowledge before they invest their time and money in a property purchase.
