“The world of education is like an island where people, cut off from the world, are prepared for life by exclusion from it.”

If we take Montessori’s statement as true, this is the time of year when students go forth from our “island.”

They graduate, leaving the College of Law for lives in the law (or in other ventures). They could be other students testing new experiences through our summer externship programs (for work with governmental agencies, judges or nonprofit organizations), work as summer associates or in other cultures through our summer program in Arcachon, France. In every case, education continues either through successes or disappointments.

While there is something true in this notion of educational separation from the real world, I do not think this leads to the deep and rich training required of lawyers. As Oliver Wendell Holmes, Jr. so famously wrote in 1880, “The life of the law has not been logic: it has been experience.”

I’m very proud of our faculty who help us understand the lived experiences of our fellow citizens. It is impossible to list every contribution, but it is worth highlighting some of these efforts.

Katherine Porter examines the world of debtors passing through the bankruptcy system. David Baldus is nationally known for his empirical work on race and the death penalty. This issue examines the law reform activities of Arthur Bonfield and Sheldon Kurtz. James Tomkovicz is working on a major revision of Iowa’s Criminal Code.

It is my hope that our students’ pro bono and public service work, whether they are in New Orleans, India, Iowa City or at the Mitchellville women’s correctional facility, will provide “real world” perspectives that will inform choices about curriculum and career.

The real “life” that Montessori’s 1949 quote refers to, is not an unchanging landscape.

For those of us who are baby boomers, Bill Bryson’s account of growing up in the 1950’s in Des Moines - The Life and Times of the Thunderbolt Kid - resonates in memories of Younker’s Tea Room or Dahl’s supermarket, but it is quite unrecognizable as today’s capital city.

We boomers will continue to learn, work and require loads of societal resources. The world we live and work in is changing fast - an “island” of constant, non-dynamic assumptions will not keep pace generationally and globally.

Our recent graduates, Generation X and Millenials have and will change our institutions.

For a book that speaks to the Midwest, particularly (and briefly) I recommend Rebecca Ryan’s Live First, Work Second: Getting Inside the Head of the Next Generation. Law schools are, mostly, quite appropriately, work-centered institutions. Ryan’s book includes the finding that “Three out of four Americans under the age of 28 said a cool city is more important than a good job.”

This is quite a remarkable shift away from the days of William Whyte’s The Organization Man. Newsweek‘s May 12 issue features an article by Fareed Zakaria on “The Rise of the Rest.”

The terrific growth experienced in emerging markets will alter the future and change our graduates’ and America’s role in the world at large. This holds both peril and promise.

The Iowa College of Law must continue in its teaching, scholarship and service to enable people, communities and civic organizations to be a part of this dramatically altering “real world.”

Meet a few of the Class of 2010

While the first year has drawn to a close, the Class of 2010 still needs an introduction.

While the numbers indicate that this class is similar to the classes who have proceded them, this class individually and collectively is completely original. During the fall of 2007, 212 JD candidates commenced their studies, coming to The University of Iowa College of Law from 99 different undergraduate institutions and representing 32 different states and foreign countries. Besides, Adam says, despite his family’s writing heritage, he’s aware that very few people are able to make a living as writers. In the creative writing world, it’s difficult to get ahead because unless someone else has taken a risk on you, no one else is going to even look, he says.

“I was warned by friends that the things I learned about writing in my creative writing classes don’t have much application to legal writing. The purposes and styles of legal and creative writing are very different. I have had to learn a new style.”

And there’s more than just words in Adam’s blood connecting him with the study of law. His ancestry is part Cherokee.

“I have always been intrigued by events such as the Trail of Tears. My ancestors were there, forced out of Georgia. The Cherokees did it right. They took their case to the Supreme Court and eventually won, but President Andrew Jackson refused to enforce the ruling,” Adam says.

“When the U.S Government wants something, the treaties are enforced. When the Native Americans want something, the treaties are put on the back burner. You can’t tell whether the U.S. views Native Americans as a conquered people or a sovereign people. The government doesn’t want that question

answered. Right now, I am interested in Native American law and intellectual property law.

“Being a creative writer at heart leads me to an interest in the question of who owns ideas. Especially with the rapid developments in technology, what seems to be a more important question is at what point does an idea become property? As long as that idea remains in your head, it’s clearly yours, but once you share it, it is in the heads of the person who heard it and then the person who heard it from someone who heard it from someone who heard it. You hear an idea and as you think about it, it grows and changes.

“At some point, society wants that idea to be attributed and owned. Where is that exact moment? And when does the ownership end? It seems ridiculous to me that the copyright law is extended every time Mickey Mouse is about to become eminent domain.”

Iowa seemed a natural choice to Witosky for law school. He grew up in Des Moines and went to Knox College in Galesburg, Illinois.

“Coming from that small town to Iowa City is a huge change,” Adam says. “For most Iowans, at least for those who did not grow up in Des Moines, Iowa City is big, and there are lots more choices to be made here.

Not that law school leaves a lot of free time.”

“I might have gone to school in Des Moines, but if I were there, I’d know where

all my friends were when I was studying and there was always the risk that I would get tired of studying, find my friends, and then not be as well prepared for class the next day,” he says, only half-joking.

“In truth, I chose Iowa because of its excellence. If there was one ranking that made up my mind, it was the law school ranking by library done by former Michigan Supreme Court Chief Justice Thomas E. Brennan,” Adam says.

Brennan ranks Iowa’s library third behind only Harvard and Yale.

“He does his own rankings of American law schools, trying to avoid subjective criteria,” Adam says. “Iowa ranks high in most of his measure of the top 20 law schools in the country.”

n Amanda Bahena Amanda Bahena has lived and studied in Canada, Mexico, England, and the United States, and her abiding interest is in international trade and economics. It’s hard to imagine an educational path less likely to lead a young person back to Iowa, but it has.

Amanda grew up in Sioux Center, Iowa and attended Iowa State University as a National Merit Scholar. In her junior year, she took a semester’s exchange trip to Mexico that grew into a yearlong stay.

“I took Spanish for two years in high school thinking I wouldn’t have to take it in college. I hated it, but I got it done,” Amanda says. When she got to Iowa State, she found that she needed three years of Spanish to graduate.

For most of her academic career, Amanda has allowed her intellectual interests to guide her career path. If she wasn’t interested in a subject or she encountered something more interesting, she took a new path. Interestingly, here she made a life-changing decision to continue with the study she most disliked.

“I took Spanish for one more year. My teacher in that class was putting together a semester-long exchange program in Cuernavaca, Mexico.

I’d always wanted to study abroad, but never thought of Mexico as a possibility.

I decided to go on this exchange and at the end of three months, I was conversational in Spanish, but not fluent.

The more I studied Spanish, the more I loved it. I loved it so much that I decided to stay another semester. I took classes and I volunteered in the Mexican state’s human rights department in Cuernavaca. It was very interesting.

Amanda had originally wanted to be a teacher when she went off to Iowa State, but she was pulled toward journalism and politics.

“While writing about politics, I was drawn to the legal side of things. In Mexico, I became interested in international business, economics, and trade,”

After graduation, Amanda worked on the trade floor of Conagra Foods, Inc. in Omaha in part because she was fluent in Spanish. There, she learned more about the business side of economics and trade. After studying for three months in Prince George, British Columbia, Canada, she spent a year assisting commodity trade merchants and working with railroads.

After that experience, Amanda became a trader in her father’s small business in Sioux Center, which trades with Canada.

“The experience strengthened my interest in international trade, so I went to the University of Warwick in Coventry, England to get my masters in international political economics. I just finished that degree in 2007. Studying in these fields, I became very interested in what drives the development of rules of international trade and economics in the real world.

“Many of my friends from Warwick went into consulting or to the World Bank, but that wasn’t for me,” Amanda says. “I’m not interested in the bureaucratic side of things, and I wasn’t getting the kind of job offers that interested me, so I decided in January to go to law school.

I took the LSAT last February, applied here and was accepted. I have a full resident tuition scholarship from the University.”

Rankings definitely played a role in Amanda’s choice of Iowa, she says, and she’s here because she sees it as a place where she can acquire the marketable skills that can win her a job.

“It’s important to have graduated from a ranked institution. But saying that, Iowa is the only law school I applied to. I wanted to go to Iowa or I didn’t want to go to law school at all. I decided that if it worked out, then law school is where I should be. If it did not, I had other options.

“And when I talk about marketable skills, I’m not talking about money. I mean that when I find the job I am interested in, I want to be the top candidate for that job.”

Amanda says. “I am not as

interested in making money as I am in doing something I am interested in doing.

“That’s one of the key reasons why I said Iowa or nothing. I don’t want to have to work 80-hour weeks just to pay off loans. I want to be able to have a job where I feel fulfilled and where I feel like I’m contributing to the community. I could see myself doing public service, but I’m also interested in jobs in firms specializing in immigration law, any job that allows me to use my immigration and international experience. I’m sure I will use my background in international economics, because the world has become

so closely interconnected that almost every area of law includes international aspects.”

“But that specialization is not why I’m interested,” Amada says. “I’m interested because of my connections with Mexico.

“My husband is Mexican and his background is in international relations. He got his master’s in politics from the University of Warwick when I did. He’s been terrifically supportive of my pursuit of a law degree.

“I have met a lot of interesting people here. I expected everyone to be from Iowa, but they’re not. And some of my classmates have done amaz-

ing things. Everyone is very friendly and we help each other. Not altogether what I expected. Very nice.”

As a member of the Iowa Campaign for Human Rights, Amanda volunteered in November to provide assistance in improving the interview skills of entry-level job seekers at the Building Blocks to Employment Job Fair in Iowa City. She says she can’t do as much volunteer work as she’d like because law school keeps her so busy, but the Iowa Campaign for Human Rights does give her a chance to do some work for immigrants. She also volunteers for the Iowa Coalition Against Domestic Violence, assisting immigrant women who are victims of domestic violence, helping them apply for a special visa that allows them to obtain permanent residency and permission to work in the U.S. “I am very interested in immigration right now, and I have dealt with a lot of people in that area. I’m considering that, but I don’t know exactly what’s out there. I like working in a smaller community like Omaha, working with the kind of people I grew up with, farmers and small town businesses. I like that.” She will work this summer as an associate in a law firm in Omaha, and says she is very excited for the opportunity.

“Yesterday was my favorite day of law school. I don’t know what it was, but I realized I am learning things I am actually going to be able to use when I go to work. I like learning practical things

and the theories behind them.

After studying the more theoretical aspects of international economics and politics, it is nice to be learning how I can put that knowledge to work.”

n Jerome Coenic-Taylor When Jerome CoenicTaylor was two years old, his father was murdered.

Jerome, then growing up in low-income housing on the south side of Chicago, reacted to his father’s death in a very uncommon way. At the age of five, when he understood that his father was not coming back, Jerome began telling people, “I want to be a judge.”

“I wanted to put the bad guys in jail,” Jerome says. “I knew that judges put people away, and so I said, when I get big, I’m going to put the people in jail who hurt my daddy.”

Jerome is grown now.

He’d say he’s “matured.”

“Instead of becoming a product of my environment,” Jerome says, “I vowed that I would make for myself a brighter future and better life.”

An imposing but softspoken and gentle young man in his first year of law school at Iowa, he chooses his words carefully and has nurtured the skill of repeating significant words and phrases as he talks, savoring their meanings and underlining them for you.

“Matured,” he would say.

Supported by a prestigious scholarship and a fellowship that promises him a good job even before he graduates, Jerome is looking at a promising career in the law.

He still sees himself possibly as a judge one day, but his immediate goals have a different focus. Jerome has matured since he was five, and his goals and sense of obligation have matured with him.

“I want to work in a corporate law firm, work hard and make money and gain some experience. I plan to be very active in my community.

I want to help build up and enhance inner city programs for African American youths who have the drive to excel but are struggling financially.

For myself, I believe that if I work hard and put together the right strategies, I can do everything I want to do.

I want to help people like me believe the same thing, to help people who’ve faced the same obstacles.

Jerome was the second oldest of eight children, a position that came with serious obligations.

“It was like being a parent,” he says. “My older sister and I helped my Mom with the younger ones.”

The elementary school in the projects was somewhere short of ideal, especially for a bright child who wanted to be a judge.

“There were books but some of them we couldn’t take home,” he says, so all the work and reading had to be done at school. At the same time, he wasn’t getting along

with his mother’s boyfriend.

Nonetheless, Jerome graduated at the top of his class from Carver Middle School in Altgeld Gardens, but he wanted something better than the neighborhood high school would have offered. With the help of his grandmother, he applied for Morgan Park High School, which at the time was one of the top five high schools in the city, a target school where tests determined admittance.

To escape the conflicts with his mother’s boyfriend and to be closer to Morgan Park, Jerome moved in with his grandmother.

“Through it all, my grandmother has been there for me, reliable, caring, understanding . But if there is one word to describe my grandmother, it is ‘loving.’ She helped me mature as a man.” Jerome’s older sister played a role in his maturity too, as a sisterly mentor and as a good example, making straight A’s at Illinois State University.

“When we were little, she would come home and teach me everything she had learned. She now teaches fifth grade in Houston, Texas.

My sister has been where I have been and has overcome the same obstacles. Through it all, she kept a smile on her face and pushed me to do even better than she did.

“It was hard growing up as a black male without a father, because the male figures that are in your life in the projects are not good for you. My grandmother and my sister combined to fill that void for me.”

Even though he’d done well in elementary school, the lack of adequate preparation put Jerome behind when he got to Morgan Park.

“I had to work twice as hard to excel now, because I was competing with students from across the city who had attended excellent grammar schools.” Four years later, he graduated fourth of five hundred students, based on grades.

For college, Jerome chose the University of Illinois Champaign-Urbana, where he definitely was not behind, thanks to the preparation that Morgan Park had given him.

“I got straight A’s my first semester and I was on top of the world.” He started the Hip-Notic dance team at the University of Illinois, a club with more than 30 members that’s still going strong, performing jazz, modern, and hip-hop dance and competing in dance contests. It was a lot of work and there’s no time for that at Iowa, Jerome says, but he’s interested in taking some dance classes.

Another person might have slowed down, taken a much-needed break from the hard work he’d had to put in just to get to this point. Not Jerome. He graduated magna cum laude from Illinois. A bright, successful man of color with a college degree, Jerome had many options for law school. He received a Lloyd M. Johnson scholarship from the Minority Corporate Counsel Association (MCCA) as a 2007 Vault Inc. Fellow.

and Vault, an employment firm, promises to help him find a summer position with a corporate law firm after his first year of law school. The focus of MCCA is to diversify the legal profession.

With those credentials, Jerome might have gone almost anywhere, but he limited his choices to schools in the Midwest because he wants to practice in Chicago.

“There are a lot of opportunities there and I want to give back to the community where I grew up,” he says.

He might have chosen an Illinois school. He might have chosen a school in Chicago.

He chose Iowa.

“It’s a top school and great law program,” Jerome says. “I have a mentor in Chicago who stressed to me the importance of attending a top-ranked school, there are doors that open to you and opportunities that are there because of that ranking.

“I like the Iowa law school environment because it’s very competitive, but it’s not cutthroat. We help each other.

It’s cool. I know that Cornell or Northwestern aren’t like that.”

Jerome also had a previous connection with Iowa City. His aunt and her husband live here and provide family support that is important to Jerome.

“Whenever I need to take a break, or have a good home cooked meal, I go to my aunt’s house. The warmth and love there revitalizes my strength to persevere through this intense first year of law school.”

“I had been here a few times in my childhood and always liked it. Iowa City is not busy like Chicago. It’s just the right pace to be able to focus on school.”

Since his first year of college he’s spent the summers as an intern doing clerical work in the Chicago law firm of Winston & Strawn, LLP as part of another yet another scholarship program, College Bound Chicago.

“My experience at Winston & Strawn was invaluable. I learned a lot about firm culture and what steps I needed to take in order to become a successful law student and future attorney. Through mentoring and professional development programs, I learned a great deal about the legal profession and this ultimately increased my desire to become a lawyer.”

Over the summer of 2007, Jerome did motivational speaking to young people in grammar schools about how important it is to have a vision of success for their future.

“So many children are left without parents or mentors to help guide their thoughts about having a successful and prosperous future. Some people get so bogged down in their current predicaments that they can’t see beyond their present circumstances.

This mentality has created a cycle of poverty within the black community, and I knew that it had to stop with me.”

“When I was growing up in the projects, there were very few programs to guide me. I decided I wanted better for myself, but for people who can’t make that decision by themselves, I want to be there for them.”

“It’s just as important for me to be successful as it is for me to have a positive impact on others’ lives. My success is not just for me. I didn’t get here by myself.”

“I’ve been through a lot and my life experiences have definitely shaped how I feel about what success is,”

Jerome says. “I have a serious girlfriend now and when we get married, I want my kids to have a good life and to grow up on a level playing field where they don’t have to work as hard as I did, harder than everybody else. My life today is not just for me, it’s for my future family as well as empowering the African American community around me.”

“The more I learn and the more I mature, I see how the world works, how everything that I do needs to be building toward that vision of my future. When you’re struggling financially and having family issues, your vision of success is the one thing that you can hold onto. If you can’t have anything else, you can have your drive, persistence, diligence, and the ability to succeed. That’s why my education is so important.

A lot of people seem to go into law for the prestige.

That’s not for me. The law is a tool that can help me toward my life-long career goals.”

n Kym Auge You might say that Kym Auge is on the fast track to a career in law. She’ll finish law school in two years rather than three. She’ll attend commencement in May 2009, take the bar in July, and get her diploma in August. But it does not seem much like a smooth ride to Kym, who’s traveled a long and very

rough road to get this far. She likes to compare herself to the “Little Engine That Could.”

She always thought she could, but it was never easy.

After high school, Kym got her associate’s degree from Southeastern Community College in West Burlington, Iowa, married her high school boyfriend, and started having children and planning her further education.

It’s the American dream for many American girls, but for Kym, it quickly became a nightmare. Her overprotective husband turned abusive and—telling her she’d never go to school again—grew more and more violent, to the point of dragging her from a speeding car and holding a loaded gun to her head. After years of abuse, her parents, from whom she’d hidden any evidence of her plight, helped rescue her, and for many more months she was forced to hide with her newborn son out of fear of retaliation while her divorce was finalized.

Despite everything that had happened to her, Kym still thought she could. She never gave up her dream of becoming a lawyer, even though trying to coordinate being a single mother with school and work was extremely difficult. At one point, a community college staff member looking at her circumstances told Kym she should go on welfare, but Kym didn’t want that.

“I was able-bodied, so I found a job at a paper company making hamburger wrappers and boxes. Now, making boxes is good work,

somebody has to do it, but it wasn’t for me in the long run.

I need more stimulation.”

After she got married again, Kym began driving ten hours a week to classes at Western Illinois University.

Eventually, she found an opening as a secretary with a law firm in Fort Madison.

“After my interview for the secretary position, a friend told me I’d never get the job because I’d told them I wanted to go to law school. But I did get the job and I stayed there for seven years. It was a fantastic experience, seeing the hands-on practical side of law--the side that you don’t get in the classroom--that was invaluable,” Kym says.

“Now, I understand the dynamics between clients, attorneys and staff in a way that many attorneys might not.

There’s a lot of work, and everyone in the office, including the staff, has to cooperate and understand what’s going on. I know there are firms that are very hierarchical, where the staff may have little or no connection to the cases or the clients, but this firm was the opposite.”

“We all worked very closely together and I believe that involvement is very beneficial. It certainly was for me going to the courthouse and seeing the mechanics of filing cases. Now, in classes, I understand the importance of good relationships with courthouse personnel.

Because I have done everything from filing cases to tracking the progression of a lawsuit, a lot of the material we discuss in classes make

sense to me. I have been there, done that. The concepts are not so abstract.

Kym will go back to work at the firm during break, and when she graduates, she’ll have a job in her hometown at a place that has supported her from the beginning.

When the acceptance letter arrived, Kym’s husband brought it to the office. They had talked about how to handle it when it came, and agreed that she was going to open it, but when it came, her husband couldn’t wait.

“I was on the phone with a client and I saw the letter in his hand, the university’s letterhead on it, and I started shaking, but I had to finish that conversation. After I’d opened the letter, everyone in the office came around, and they were crying for me.

It was wonderful.”

“It will be nice to be back in that office. It’s a very nice place, very supportive.”

Her family, including three children now, has been supportive too.

“I call my five-year-old daughter a ‘little homework Nazi.’ I come home and am fixing dinner and she says, ‘Now Mommy, don’t you have homework you’re supposed to be doing?’”

“When I told my oldest daughter I’d gotten into law school, she wasn’t all that excited. I told her she ought to be excited because it meant we wouldn’t be roommates in college. She finally gave me the reaction I was looking for. I’m a cool mom, but roommates?”

I’ll be honored to counsel the public and help them navigate the often murky waters that we refer to as “law.” Practicing law in a small town will give me a unique chance to be able to assist people with their wide variety of legal needs. It will be

a very challenging and exciting opportunity for me to give back to my community.

Kym chose Iowa in part because she was in an upward bound program at the University while in high school.

“I knew the University and always loved it. Since I’ve been here, I’ve noticed a serious desire on the part of the faculty to see me succeed.

I think that’s amazing. I know that some law schools get the reputation of being cutthroat, students plotting against one another, ripping pages out of books in the library. It’s not like that here. I think that’s a real advantage.”

Kym wants to be in general practice, but has a fondness for family law, and wants to experience the full

range of legal work when she begins practice.

“Law touches every aspect of people’s lives--from marriage, the birth of babies, adoptions, divorce, personal injury actions, real estate, estate planning, probate, and yes, taxes.”

“I’ll be honored to counsel the public and help them navigate the often murky waters that we refer to as “law” Practicing law in a small town will give me a unique chance to be able to assist people with their wide variety of legal needs. It will be a very challenging and exciting opportunity for me to give

With the unwavering support of my family, my friends, and the University of Iowa community, I will succeed, Kym says. If there is one message that someone might take away from my story, I hope that it will be to never give up on your dreams. If you think you can, you can– just make it happen.

Shaping Iowa Law Reform Iowa’s Law Faculty help the State Legislature make better laws

And sometime in the next two or three years, the legislature might look at a proposal for a new criminal code. n

All three were or will be shaped in part by University of Iowa law professors, one way that faculty in the College of Law help ensure better laws for Iowans.

“The University of Iowa College of Law is a great resource with so many distinguished faculty who have expertise that can help state officials make dramatic improvements in Iowa’s laws,” said James Tomkovicz, who was appointed in 2007 to a 15-member panel that will review the state’s criminal code and recommend changes to the legislature.

Helping Iowa and other governments reform their laws is a proud tradition of faculty at the College of Law. For years, law faculty have helped governments in Iowa and around the world create better laws and better ways to administer them.

In recent years, John Reitz has worked with the United Nations to reform Vietnam’s administrative law system and Mark Sidel has helped governments around the world develop stronger laws

to prevent human trafficking. Mark Osiel has trained judges in Bosnia and Adrien Wing has served as a constitutional advisor to South Africa, Rwanda and the Palestinian Authority, and also advised the Eritrean government. David Baldus has also worked with states to review racial dimensions of their capital punishment laws.

And back home, Tomkovicz, Arthur Bonfield and Sheldon Kurtz have all earned kudos for lending their expertise and time to the arduous process of making sure Iowa has the best laws possible.

“By nature, legal reform work at the legislative level is a very difficult political process that requires give and take,” said Arthur Bonfield, the law school’s veteran legal reformer. During the last 46 years, Bonfield has been involved in more than a dozen major Iowa law reform initia-

tives and many similar initiatives relating to the reform of the administrative processes of the federal government and other states.

Bonfield’s most recent work was to propose and draft major amendments to the Iowa Public Records and Open Meetings laws, including the creation of a new agency to enforce them more effectively. Acting as counsel to the House-Senate Interim Study Committee that proposed the bill containing recommendations, Bonfield watched as the legislature as a whole considered them in light of pressures supporting and opposing various provisions this past spring.

In the end, during the legislative session that just ended, the Senate enacted the bill and the House did not; so the bill will be reintroduced at the start of the next legislative session. It is not unusual

for legislative law reform on a particular subject to take several legislative sessions, Bonfield said, because “law reform is the art of the possible.” “You start with the theoretically best solutions, realizing it has to run through a political process that makes whatever amendments are necessary. You measure your progress by increments.”

“If you take the approach of the ideal way or no way, then you are bound to fail in securing any reform,” Bonfield said.

Sometimes, that means a bill is so heavily re-written that the finished product looks nothing like the original proposal. But other times, a proposal is hardly changed at all. In 2007, state legislatures across the country considered a new Uniform Anatomical Gift Act,

written largely by Professor Sheldon Kurtz. In most every state, the approved law was left mostly intact from Kurtz’s original proposal.

Kurtz, who has been Iowa’s representative to the National Conference of Commissioners on Uniform State Laws since 1999, said the law was badly needed because the old law hadn’t been amended since 1987 and had become grossly inadequate because of subsequent advances in health care technology.

Kurtz said the updated law differs from its predecessor in some important respects. For instance, the new law puts a priority on the use of an organ for transplantation or therapy and allows its use for research or education only if permitted by the donor or the donor’s family when not otherwise suitable for transplantation.

The revised law also makes it impossible for a donor’s family to prevent the donor’s organs from being used for transplant if the donor had made an anatomical gift during his or her lifetime.

Under the old law, a family member could stop the donation process.

“My bias in drafting this law was to make it as easy as possible for people to donate their organs and tissue after they’ve died,” said Kurtz. “It’s too important for the 95,000 people who are on the waiting lists and we wanted a law to streamline the process.”

Kurtz helped shepherd the law through the Iowa legislature last year and it was signed into law by Governor Culver in spring 2007. It has been approved by 21 other legislatures as well, and is being considered by 20 others this year.

While Kurtz and Bonfield have seen their recent work successfully enacted into law, Tomkovicz’s reform work is only just beginning. The criminal code revision, the first since 1978, is designed to make the code more modern and comprehensive.

“The Iowa code lacks coherence, and we aren’t going to fix the problems by

just making isolated changes here and there,” said Tomkovicz. “The incoherence is in part due to the many piecemeal modifications and additions made by the state legislature over the past 30 years. There are also many ambiguities and gaps in the code that create difficult problems of interpretation for lawyers and courts. I hope that we can formulate and propose a thorough and thoughtful revision that addresses and resolves most of the deficiencies.”

Kurtz, one of the leading experts in anatomical gift law in the United States, said his interest in reforming the law began mostly through serendipity, when he taught a class in 1992 that wrote a model organ donation law as an exercise.

“I knew only a little about anatomical gift laws at the time but the experience in the class made me interested intellectually in the topic,” he said. Later, he worked with the Iowa Donor Network on a statewide survey that polled Iowans about their understanding and concerns about organ donations.

His work in drafting the uniform act came after he was appointed one of Iowa’s representatives to the Commission on Uniform State laws in 1999 and he was appointed to head the 10-member committee to draft the model uniform anatomical gift act.

“It made sense for me to work on the act because of all my research and past work in the area,” said Kurtz.

Tomkovicz said his motivation to participate in the reform of the Iowa Criminal Code is personal.

“I owe this state,” said Tomkovicz, a Los Angeles native who started teaching at Iowa in 1982 and whose three children were raised and educated in Iowa City. “Iowa has provided a very good quality of life and I have enjoyed the incredibly rewarding career here for more than 25 years. Both the university and the state of Iowa have afforded a wonderfully supportive environment for me and my family. Assisting in criminal code reform is something I can to do repay some of my debt to our state.”

Professor Arthur Bonfield: 46 Years of Law Reform

When Arthur Bonfield was a student at Yale Law School during the late 1950s he saw two possible careers for himself - to teach in a university law school or in a political science department.

“My principal mentor, Professor Alexander Bickel, told me if you want your scholarly work to be read and possibly admired by a few scholars and that is all, teach in a political science department, but if you want your work to be read by people who have power and influence and who could, if persuaded, change the legal system as a result of your work, teach in a law school,” Bonfield said. After considering Bickel’s comments it was an easy choice. He wanted his scholarship to make a difference in the real world.

Bonfield has made good on that goal by participating in more than a dozen major law reform initiatives in Iowa and many more such efforts in relation to the federal government and other states since joining the faculty in 1962.

“My scholarship, law reform activities, and teaching are highly related. All of them have always been closely connected to each other.”

He notes, “most of my scholarship has focused on administrative procedure reform and was written either before or after my involvement in real world efforts to accomplish those reforms.”

His law reform activities also relate to his teaching because, he says, “the way I see it, I can’t be a really good professor at a professional school unless I have one foot in the academic theoretical world and one foot in the real professional world. I need to be actively involved in both worlds to successfully give my students the understandings they need about our legal system to successfully operate in it.”

Bonfield, one of the leading experts in the United States on state administrative procedure, has become one of the principal people that Iowa government leaders call when laws related to the state administrative processes need to be reformed. Sometimes it’s a governor or some

part of the executive branch, and sometimes it’s the legislature asking for his help. Sometimes it’s a Democrat, sometimes it’s a Republican.

His first law reform work for state government involved the drafting of a 1964 gubernatorial executive order prohibiting discrimination in state government employment. A year later, he was the principal draftsman of the 1965 Iowa Civil Rights Act creating the Iowa Civil Rights Commission and prohibiting discrimination in employment and public accommodations.

Two years later Bonfield drafted the Iowa Fair Housing Act for the General Assembly which was followed in 1978 with a statute he drafted improving the procedures of the Iowa Civil Rights Commission.

In 1978 Bonfield drafted the Iowa Open Meetings law and in 1984 major amendments to the Public Records law. During this last year he proposed and drafted, for an interim study committee of the General Assembly, major revisions to both of these laws and provisions creating a new agency to enforce them more effectively. Because they were controversial, these revisions and additions to Iowa’s sunshine laws did not become law this year and will be reintroduced into the General Assembly in January 2009.

During his 46 years at the Iowa Law School, Bonfield also worked on the drafting of several gubernatorial executive orders seeking to improve the administration and rulemaking of Iowa state agencies, drafted Uniform Rules of State Agency Procedure as Chair of an Iowa Governor’s Taskforce, and for 16 years chaired the Iowa Commission on Uniform State Laws, an official state body dedicated to law reform.

But Bonfield considers his drafting of the Iowa Administrative Procedure Act to be his most significant law reform accomplishment. Bonfield drafted that statute in 1973 in consultation with a State Bar Association Committee and then acted as general counsel to the joint HouseSenate committee of the Iowa General Assembly

that ultimately secured its enactment in 1974.

The IAPA required, for the first time, uniform state agency procedures and procedures for the judicial review of state agency action. It set out a detailed agency rulemaking and adjudication scheme as well as a comprehensive scheme for the judicial review of such state agency action.

Major improvements to the 1974 Iowa APA, also drafted by Bonfield, were enacted by the General Assembly in 1998.

In the 1980s Bonfield successfully exported to other states some of the improvements he made by securing the enactment of the 1974 Iowa Administrative Procedure Act. He did so by including many of those improvements in the 1981 Model State APA he drafted for the National Conference of Commissioners on Uniform State Laws which was subsequently relied on by other states when they revised their own APAs. In the course of his law reform efforts in other states Bonfield also assisted more than a dozen different states by helping them formulate, draft, and adopt various state administrative procedure improvements. He was also successfully involved in a number of federal administrative procedure reforms through reports and recommendations he wrote in the 1970s for the Administrative Conference of the United States.

Bonfield notes that he has refrained from participating in partisan political activity since he joined the faculty. “It’s been a conscious effort on my part so that I could work with leaders in both parties and share my administrative law expertise with them without any suggestion of partisanship” Bonfield said.

Law research finds U.S. farm workers hurt by guest worker visa process Research by a University of Iowa law student has found domestic farm workers in the United States frequently face low wages and poor working conditions because of federal mismanagement of a guest worker visa program and inattention by farm worker advocate groups.

“As the regular use of guest workers has spread across the country, the Department of Labor has failed to ensure the importation of foreign workers does not adversely affect the wages and working

conditions of the domestic workforce,” said Alison K. Guernsey, a third-year law student, whose research was recently published in the Iowa Law Review.

“These adverse effects have intensified as farm worker unions have begun to sidestep their traditional domestic constituencies in order to represent the increasing number of guest workers in the country,” she said.

Guernsey said her research has found the Department of Labor is approving H-2A applications for guest farm workers that do not comply with federal law.

Specifically, she said the applications do not meet the federal requirement that employers must demonstrate a shortage of farm labor in a community, making foreign-born guest workers necessary.

The applications also fail to demonstrate that the addition of the guest workers to the local labor force will not hurt local workers, as required by law.

Guernsey said the Department of Labor is approving the non-compliant applications because farm management companies increasingly need labor, and foreign-born migrant workers can be paid less money than local workers.

“Pressure from the agricultural

industry to provide growers with quick resolutions to perceived labor problems causes the Labor Department to overlook many deficiencies in the applications,” she said.

At the same time, Guernsey said farm worker unions are putting more effort into organizing these migrant workers instead of the domestic workforce because the guest workers form a large and easily accessible membership pool.

As a result, domestic workers have less representation in a process that often results in wages sinking and working conditions worsening.

To address the problem, Guernsey said that the Department of Labor should give more scrutiny to guest worker applications to make sure the information presented by the employer is accurate and honest, and establish a more transparent application process.

In addition, she said local workers should be given an avenue for appealing approved applications for foreign-born guest workers in their communities.

Guernsey said local workers could use this process to provide information to the Labor Department that reveals faulty applications.

The life and accomplishments of the late Judge Donald P. Lay, a University of Iowa graduate who went on to become one of the youngest federal appeals court judges in U.S. history, is memorialized in a recent issue of the Iowa Law Review.

Lay died in April 2007 at his home in suburban St. Paul, Minnesota, at the age of 80. He had received his bachelor’s degree from UI in 1949 and his law degree from the UI College of Law in 1951.

Lay was appointed to the Eighth Circuit Court of Appeals in 1966 by President Lyndon Johnson. He served as chief judge from 1980 until his retirement in 1992, and continued to serve as senior judge until his death.

The issue features 10 tributes from Lay’s friends, colleagues and former clerks. Among them is John Paul Stevens, associate justice of the U.S. Supreme Court; William Webster, former director of the CIA and FBI; Gerald Heaney, retired federal appeals court judge and one-time colleague of Lay’s on the Eighth Circuit Court of Appeals; and N. William Hines, professor and dean emeritus of the UI College of Law. Contributors praised Lay’s passionate defense of individual rights and liberties throughout his 40-year career as a judge. Among the noteworthy cases they cite in their accolades that he participated in as an appeals court judge are: n Jenson v. Eveleth Taconite Mining, one of the first federal cases to recognize that harassment of female employees was unconstitutional, and a case that was the basis for the movie “North Country.” n McDonnell Douglas Corp. v. Green, which laid out the first federal standards for racial discrimination in employment. n Bishop v. Colaw, which made it illegal for school dress codes to stipulate the length of a student’s hair.

They also commented on Lay’s love of outdoors and sports.

“As a judge, Don Lay was once one of the youngest, once one of the most-senior, and always one of the most respected by his colleagues in the federal judiciary,” Stevens, the U.S. Supreme Court justice, writes in his tribute.

“As a friend, he was always excellent company and tolerant of less skilled golfers.”

TLCP ‘Climate Change and Human Rights’ symposium

just for their liveli hoods, but for their very survival. Many environmental experts believe that worldwide, the number of severe storms, the incidence of drought and the melting of glaciers will only increase as time goes on, impacting more people around the globe.

Experts from across the country gathered at The University of Iowa on February 15, to discuss climate change and its devastating impact on human rights during the “Climate Change and Human Rights Symposium.”

Joseph Michaels, editor-in-chief of the Transnational Law and Contemporary Problems Journal and a third-year law student, said this topic was chosen in collaboration with journal members because of its relevance to human rights.

“We need to fix things now as opposed to later; later will be too late,” Michaels said. “We’re not just talking about the current climate but how climate change will affect people and their children in the future. It applies to all of us with no consideration to sex, gender, race or class.”

The symposium featured climate change’s impact on indigenous persons, the greening of energy policies, and the legal issues and options affecting future generations.

Highlights included a keynote presentation by Jerald L. Schnoor, Allen S. Henry Chair Professor of Environ-

mental Engineering in the UI College of Engineering and Center for Global and Regional Environmental Research (CGRER) co-director, titled “Future Climate Change: Mitigation and Adaptation.” He presented options so that future generations will know how to adapt to this warmer climate. He also discussed how the planet is warmer by 0.8 degrees Celsius than it was 100 years ago, with most of the warming occurring in the last few decades.

Schnoor recently was appointed by Gov. Chet Culver to chair the new Iowa Climate Change Advisory Council. He also has a long history of involvement in environmental causes, focusing on such research studies as groundwater contamination and hazardous waste remediation, global change, water quality modeling, and carbon sequestration.

Other symposium speakers included: Carolyn Raffensperger from the Science & Environmental Health Network; Laura Westra from the University of Ottawa; Eileen Gauna from the University of New Mexico; and Brian Hook (’99), counselor to the U.S. ambassador to the United Nations.

The UI College of Law’s Journal of Transnational Law and Contemporary Problems, CGRER, the International Law Society, and the UI Center for Human Rights sponsored the symposium.

Trial Advocacy The Trial Team enjoyed a very successful regional competition sponsored by UMKC at the Jackson County Courthouse in Kansas City in February. The College of Law took two teams selected through the Stephenson Competition during fall 2007: 1) Paul Morris (’08), Emily Sieber (’08), and Nathan Roberts (’08) and 2) Ben Long (’09), Zachary Olson (’08) and Meghan Maher (’08). Nine schools from Iowa, Missouri, Wisconsin, and Minnesota participated, each bringing two teams. Both College of Law teams did very well in the two preliminary rounds and advanced to the semi-finals.

Only Iowa and Washington University had both teams go on to the eight team semis.

In that round, Iowa’s second team defeated Washington University. Our first team defeated a team from Minnesota. Thus two out of the four final teams were from Iowa, something The College of Law has only accomplished once before. Both teams lost split decisions by a couple of points to teams from Washington University and UMKC and just missed out on the opportunity to represent the law school at the National Finals in Austin, TX.

The 25th Annual Stephenson Annual Banquet Competition concluded with the was held annual Banquet on November 17, November 17, 2007.

2007. Because of increased interest

among third year students, the field for the Competition was expanded this year to 36 students who participated in the preliminary rounds in October. Fifteen state district court judges presided over the trials of a simulated civil case involving a school bus traffic accident. The twelve best advocates then tried the case again on the morning of November 17 before US District Judge Jarvey, US Magistate Judges Bremer and Scoles, US Bankruptcy Judge Kilburg, Clinical Professor Allen, and Adjunct Professor Patrick Ingram.

The banquet featured the award of the annual Glovka Scholarship by John A. Roberts (’93) of the Wildman Harrold firm of Chicago. The recipient of this year’s scholarship was Shayla Kasel of Iowa City. Judge Jarvey was the main speaker at the banquet emphasizing the ethical dimensions of practicing as a trial lawyer in a time when the number of civil jury trials is decreasing. Professor Whiston announced the six winners of the final rounds who participated in the regional competition in Kansas City in February. They are Paul Morris (best advocate), Benjamin Long, Meghan Maher, Nathan Roberts, Emily Sieber, and Zachary Olson.

Defense Fund, dis cussed race in America when he spoke at the College of Law on Wednesday, February 20. Shaw’s lecture was entitled, “Reflections on Race in a ‘Post-Racial’ Society.” Shaw, who joined LDF in 1982, was lead counsel in a coalition that represented

African-American and Latino students in the University of Michigan undergraduate affirmative action admissions case. In 2003, the U.S. Supreme Court heard that case, along with one challenging the use of affirmative action at the University of Michigan Law School.

The court ruled in favor of diversity as a compelling state interest. Shaw’s lecture was part of the law school’s commemoration of Black History Month.

Harold See (’73), a justice on the Alabama Supreme Court and University of Iowa law alumnus, discussed judicial integrity and serving on the court during a time of controversy during his presentation at the UI College of Law on Thursday, February 14.

See was elected an associate justice on the court in 1997 and served during the tenure of Chief Justice Roy Moore, who generated controversy when he refused a federal judge’s order to remove a granite carving of the Ten Commandments from the state’s judicial building. The Alabama judicial ethics panel eventually removed Moore from the court for his refusal in 2003. See discussed the issue, and how the state’s Supreme Court went about its business in the midst of the controversy.

Robert F. Kennedy, Jr.

Environmental Law On September 12, 2007 Robert F. Kennedy, Jr. provided a discussion on the public interest practice of environmental law to the law school community.

Kennedy is a senior attorney with the Natural Resources Defense Council, the author of numerous books and articles on environmental preservation, and Professor of Environmental Law and Co-Director of the Environmental Litigation Clinic at Pace Law School.

That evening Kennedy presented a lecture on “Our Environmental Destiny,” in the Main Lounge of the Iowa Memorial Union. Kennedy’s visit was made possible in part by the support of the University of Iowa College of Law and the University of Iowa Office of the Vice President for Research.

Legal scholar Chemerinsky previews Supreme Court term in law school lecture Legal scholar Erwin Chemerinsky kicked off the U.S. Supreme Court’s new term when he previewed the court’s upcoming docket in a lecture Monday, October 15.

The lecture was also Chemerinsky’s first public speaking engagement since his controversial re-hiring as the founding dean of the new law school at the University of California-Irvine. The lecture was sponsored by the UI chapter of the American Constitutional Society.

Chemerinsky’s lecture was entitled, “The Roberts Court: Review and Preview.”

“We feel lucky to have such an intellectual heavyweight visiting the law school and are excited about the opportunity to hear his thoughts on what we can expect for the coming Supreme Court term,” said Michael Pratt, a UI law student and spokesman for the American Constitution Society prior to the lecture.

As is its tradition, the Supreme Court begins its 2007-08 term this week, open-

ing on the first Monday in October.

Chemerinsky, an outspoken advocate for liberal causes, is one of the country’s leading constitutional scholars and has authored a treatise on constitutional law widely used by law students around the country. An expert in the First Amendment, civil rights and liberties, hate crimes and legal ethics, Chemerinsky is a frequently quoted media analyst and contributor to op-ed pages at many newspapers. He has also litigated many high-profile legal cases.

Chemerinsky was hired earlier this year as the founding dean of the Donald Bren School of Law at UC-Irvine, which is scheduled to open in Fall 2009. However, the university rescinded the offer Sept. 11 under what was perceived to be pressure from prominent Republicans in California to block the appointment because of his liberal views.

UC-Irvine faculty objected to the firing on academic freedom grounds, and after several days of vocal protests, the university rehired Chemerinsky Sept. 17.

Civil rights leader McDew speaks at Law School Charles McDew, one of the founders of the 1960s civil rights group Student Nonviolent Coordinating Committee (SNCC), discussed what lawyers can do for social justice on October 24 at the College of Law. An Ohio native, McDew helped found SNCC in 1960 when he was a student at South Carolina State University. He chaired the organization from 1961 to 1963, initiating a series of events that helped to desegregate the South. Among the events he helped organize were the Freedom Rides of 1961, the March on Washington in 1963, and the Mississippi Freedom Summer in 1964.

McDew recently retired from teaching at Metropolitan State University in Minneapolis, Minn.

Hawkeyes in the Hub January 8-10, 2008 the Boston-area College of Law alumni and Career Services piloted a program to help students explore legal careers and establish professional relationships in Boston.

This program is called Hawkeyes in the Hub and is part of the LEAP: Legal Experiences and Practice Program. This program is designed to help students learn more about what it means to use your JD in Boston, create new networks for summer and full-time work, and explore life in the city.

The 2009 program will provide options for students to participate in Des Moines, Cedar Rapids, Iowa City and other Iowa locations as well as New York City, Chicago, Minneapolis, and Kansas City.

A new program from the University of Iowa College of Law provides career counseling services to alumni in the comfort of their own hometowns.

Steve Langerud, the law school’s associate dean for career services, meets faceto-face with law graduates across Iowa and around the country, helping those who want to re-assess their careers and need help figuring out what to do next.

Since the program began last spring, Langerud has met with about 100 alumni around Iowa, as well as such major cities as Phoenix, Denver, Washington, D.C., and Salt Lake City. Langerud believes it’s the only program of its kind offered by any U.S. law school.

“Many law schools offer similar career services for alumni, but none that I know of are as comprehensive as ours,” said Langerud, who started a similar program at Grinnell College, where he was employed before coming to the University of Iowa.

Carolyn Jones, dean of the law school, said the program was started as a way to create an important connection between the law school and its alumni.

“This is a way we can provide our alumni with a real, tangible benefit for years after they graduate,” said Jones.

“Many of these people are experiencing vulnerable times and it’s a leap of faith for them to pick up the phone and call Steve. It’s a good sign that they do because it shows they have a good feeling about us and continue to have a strong relationship with their law school.”

The law school’s alumni career counseling service offers the more traditional services as well, but with 65 percent of the school’s alumni living outside of

Iowa, Langerud said it’s important for him to travel in order to provide the fullest counseling service possible.

“Many of my clients are what you’d expect from a program like this, recent graduates still struggling to find their way, or associate partners about to become full partner but wanting to talk it through before making the commitment,” said Langerud. “Some are also on the verge of retirement and need help mapping out what to do with the next stage of their lives.”

Surprisingly, though, Langerud has found many clients who are in the prime of their careers, partners in their firms with 10 or 20 years experience who are re-assessing their goals.

“Some have decided they want to continue doing legal work but in a different capacity and some just need help taking a thoughtful look to review what they’re doing with their lives,” said Langerud, who is trained as a counselor, not an attorney. “Others are looking for a new profession entirely.”

His clients are more than just attorneys, however. He’s worked with law alumni who have gone into business, government, journalism, education and nongovernmental organizations, as well, and are looking for something new.

“It’s a sign of the work-life balance issues that so many people are trying to deal with in so many professions, as well as the law,” said Langerud, pointing to the high turn-over rate among young attorneys working at law firms as evidence of people who no longer want to give their lives completely over to their jobs.

He said he expects to counsel 200 to 250 alumni a year when the program is fully implemented.

Iowa Court of Appeals hears cases at law school The Iowa Court of Appeals held its three-day March session at the University of Iowa College of Law. The session marks the first time the Court of Appeals has convened at the law school.

Three separate three-judge panels heard the appeals of 18 cases from Iowa district trial courts during the three days of oral arguments. In a rare occurrence, the Tuesday morning appeals are being heard by a panel of three judges who are all women: Chief Judge Rosemary Shaw Sackett, Gayle Nelson Vogel and Anuradha Vaitheswaran (’84). The court normally meets in Des Moines but occasionally meets in other courtrooms across the state.

Professor Bezanson considers art and the Constitution in Presidential Lecture The guarantee of free speech has historically been interpreted to protect only reasoned and cognitive forms of expression, but art is frequently neither of those.

Many an argument has begun with the question “what is art?” So fraught can it be, in fact, that the greatest legal minds in American history have essentially taken a pass on it.

“There is little legal framework to protect art or artistic expression,” said Randall Bezanson, a UI professor of law and First Amendment expert. “There’s no mention of it in the Constitution, and generally, the Supreme Court has not attempted to take up the question.

As a result, it’s up in the air as to whether many forms of art have any substantial constitutional protection.”

Bezanson filled in the vacuum and laid out a method to extend Constitutional protections to artistic expression in his delivery of the University of Iowa’s 2008 Presidential Lecture, “Art and the Constitution,” on Sunday, February 24 in the Levitt Center for University Advancement.

Bezanson said artistic expression is tricky from a legal perspective because, unlike speech and press, it’s not specifically protected by the First Amendment.

“The guarantee of free speech has historically been interpreted to protect only reasoned and cognitive forms of expression,” Bezanson said. “But art is frequently neither of those. It is often emotional and sensual, and does not simply make an appeal to our reason.

As Plato put it, art is dangerous because it loses emotion and imagination in unpredictable ways.”

Bezanson said few legal cases of artistic expression have made it to the Supreme Court, and in those that have the court has “managed to avoid the issue” of constitutional protection for art.

But art deserves legal protection, he said, and not just as a form of speech but as a form of expression in and of itself. In his lecture, Bezanson laid out a legal framework the Supreme Court can use to protect art as art, and not as speech.

Bezanson also explores the issue in more depth in his new book, Art and the First Amendment, which will be published next winter by the University of Illinois Press.

Bezanson is the David H. Vernon Professor of Law in the UI College of Law. Following his graduation from the UI law school, he served as a clerk to the United States Court of Appeals for the D.C. Circuit and as a clerk to U.S. Supreme Court Justice Harry A. Blackmun. Bezanson joined the faculty of the UI Law School in 1973, where he remained until 1988, serving also as a vice president of the university from 1979 to 1984. From 1988 to 1994, Bezanson served as dean of the Washington & Lee University School of Law in Virginia. He returned to the Iowa faculty in 1996.

Bezanson’s teaching centers on constitutional law, freedom of speech and press, and mass communication law, but he also teaches in the fields of administrative law, law and medicine, law and journalism, and torts. He was given the UI’s Burlington Northern Award for Outstanding Teaching in 1987.

Bezanson’s scholarship spans the fields of administrative law, constitutional law, first amendment theory, defamation and privacy law, law and medicine, and the history of freedom of the press. He has

published in many law reviews and journals. In 1987 his book, co-authored by Gilbert Cranberg and John Soloski, Libel Law and the Press: Myth and Reality, was given the National Distinguished Service Award for Research in Journalism by the Society of Professional Journalists, Sigma Delta Chi. His 1992 book Reforming Libel Law, co-edited with Soloski, is used in undergraduate and graduate journalism programs throughout the country.

His other books include Taxes on Knowledge in America: Exactions on the Press from Colonial Times to the Present (1994); Speech Stories: How Free Can Speech Be? (1988); Taking Stock: Journalism and the Publicly Traded Newspaper Company (2001) co-authored with Cranberg and Soloski; How Free Can the Press Be? (2003); and How Free Can Religion Be? (2006). His most recent book is Art and Freedom of Speech, which is forthcoming from the University of Illinois Press.

Bezanson is a member of the Iowa Bar and has been a member of the American Law Institute (ex officio) and the National Conference of Commissioners on Uniform State Laws (NCCUSL). He has drafted legislation on a broad range of topics, including civil commitment of the mentally ill, treatment of the terminally ill, surrogacy and assisted conception, and defamation and invasion of privacy.

The Presidential Lecture series provides an opportunity for distinguished faculty to present significant aspects of their work to members of the university community and to the general public.

The university established this annual series to encourage intellectual communication among academic disciplines, and to provide a public forum for university scholarship, research, and creative achievement.

Ellsberg participates in ‘Top Secret’ Pentagon Papers events at the UI

Government secrecy is a burning issue today as it was during the Vietnam War, and once again the country is vigorously debating whether national security can trump the public’s right to know what the government is doing.

In the midst of that debate, the University of Iowa presented a play, lecture and discussions January 25-30 on the occasion of a visit by Daniel Ellsberg, a central figure in the Pentagon Papers controversy that pitted the New York Times and the Washington Post against the Nixon administration.

The events included several involving the law school community incuding: New York Times Co. v United States: A Re-enactment, featuring UI College of Law Emeritus Dean N. William Hines and retired UI General Council Mark Schantz, on Tuesday, Jan. 29, in Levitt Auditorium of the Law Building.

Ellsberg participated in a discussion following the re-enactment, also featuring Unger and law faculty member Tung Yin. The documents that became known as the Pentagon Papers were commissioned by Defense Secretary Robert McNamara in 1967 to gain an understanding of the origins and decisionmaking processes of the Vietnam War. The Defense Department completed a 47-volume, 7,000-page study in 1969, shortly after Richard Nixon became president.

Ellsberg, a former Defense Department employee and RAND Corporation economics analyst, was a one-time hawk who had come to believe that the war was a tragic mistake. He became convinced that the American people should be informed about the series of mistakes and deceptions that led to and perpetuated American involvement in Vietnam.

The New York Times began a series of stories, based on the Pentagon Papers, in the summer of 1971, and Nixon ordered the Attorney General to ask the courts to block further stories. After the district court issued an injunction against the Times, Ellsberg gave a set of the documents to the Washington Post, which was not covered by the order. Publication of information from the Pentagon Papers led to a constitutional showdown at the Supreme Court.

Ellsberg received the UI Lecture Committee’s Distinguished Lecture Award during his appearance at the university.

Since the Vietnam War, Ellsberg has been a lecturer, writer and activist on the dangers of the nuclear era and government wrongdoing. To encourage national security whistle-blowing, he launched the Truth-Telling Project in 2004. In addition to his new book, Secrets: A Memoir of Vietnam and the Pentagon Papers,” Ellsberg is the author of “Risk, Ambiguity, and Decision. Faculty N o t e s Eric Andersen was on a development leave this past fall. He presented a paper at a conference on “Religion and the Rule of Law” in Hanoi, Vietnam in November 2007. His paper concerned the Charitable Choice Doctrine in the U.S., which refers to legislation and policy under which overtly religious groups become eligible for federal grants to engage in the delivery of social services.

The paper will be published in Religious Studies Review (in English) and Tap chi Nghien cuu Ton giao (in Vietnamese), the publication of the Institute of Religious Students, Vietnamese Academy of Social Sciences, which cosponsored the conference. Additionally, Andersen will be publishing in the Utah Law Review an article entitled “Protecting Religious Liberty Through the Establishment Clause: The Case of the United Effort Plan Trust Litigation.” As of January 1, he stepped back into his role of nearly a decade as Associate Dean for Academic Affairs since Jon Carlson has joined central administration.

David Baldus , was honored for his advocacy work in maintaining Iowa’s position as a non-death penalty state by Iowans Against the Death Penalty. He received the organization’s Governor Harold E. Hughes Award on October 27th. During the summer of 2007, Baldus worked on several projects. “Race and Proportionality since McCleskey v.

Kemp: Different Actors with Different Strategies of Denial and Avoidance” will appear in the Columbia Human Rights Law Review. A second project was “Empirical Studies of Race and Geographic Discrimination in the Administration of the Death Penalty: A Primer on the Key Methodological Issues.” It will appear as a chapter in a 2008 Carolina Academic Press book The Next Generation of Research on Capital Punishment.

Baldus presented a paper on the story of McCleskey at a November conference held at the University of Texas Law School. It will be a chapter in a 2009

Foundation Press book entitled Law Stories.

He will submit to a peer review journal “Racial Discrimination in the Administration of the Death Penalty: The Experience of the United States Armed Forces (1984-2004).” won the 2007 Collegiate Teaching Award. Last fall, he made a presentation on “Iowa Foreclosure Law’s Role in National Adjustments of Subprime Mortgage Problems” at an Iowa Law School CLE program on Iowa Subprime Mortgage Foreclosures, and this summer will be making a presentation on “What Judges Need to Know About Default Judgments” at the 2008 Iowa Judicial Institute in Iowa City.

During the current session of the Iowa Legislature, he has participated in working groups considering the participation of abstractors and attorneys in the state’s Title Guaranty program, the effects of tax sale deeds, and adjustments of mortgage foreclosure procedures. He is chairing the search committee charged with hiring a new director of the law school’s Academic Achievement program.

Randy Bezanson spent much of the 2007 summer finishing his University of Illinois Press book, currently titled The Arts and Freedom of Speech. Additionally, he completed work on the chapter of the Law School history that he and Sandy Boyd are writing. Bezanson also delivered the Presidential Lecture in February. The topic was “Art and the Constitution.”

In the course of preparing the draft of the Lecture, he has also been putting together materials for a longer version that will be published this summer in the Iowa Law Review.

Bezanson did two pieces with Gil Cranberg for the Nieman Reports at Harvard, published in late June and November (on the web). The first is a commentary on the then-impending sale of the Wall Street Journal to Rupert Murdoch, titled “What Nelson Poynter

Christina Bohannan did a faculty seminar on her forthcoming article “Copyright Harm and Fair Use.” It will be published in the Washington University Law Review. She was a nominee for the 2007 Collegiate Teaching Award.

Arthur Bonfield presented a faculty seminar on “An Agenda for Revising Iowa’s Public Records and Open Meetings Laws.” He has been involved with law reform in the state for forty-six years. He most recently served as general counsel to a joint committee of the Iowa General Assembly considering revisions to the Iowa Public Records law and the Iowa Open Meetings law and in that capacity has drafted major proposed amendments to both acts as well as a proposed new state agency to more effectively enforce those acts.

Sandy Boyd was honored in September at the University of Iowa Sixth Annual Recognition Luncheon for named Deanships, Chairs, and Professorships.

David and Audrey Hammer donated the Willard L. “Sandy” Boyd Chair. Boyd, who is the Rawlings-Miller Professor of Law, joins Bill Hines as the only two current law colleagues with Chairs or professorships in their names. A total of 20 colleagues hold Chair or professorship positions at present.

Steve Burton is very close to completing two books. One is Elements of Contract Interpretation, which will be published by Oxford University Press in late 2008 or early 2009. The other, for which he is a co-editor, is American Arbitration Practice, to be published by the Practising Law Institute in 2008.

He also is contributing a chapter for the arbitration book on The Legal Environment. In March, he gave a talk to the Iowa International Law Society on “Current Developments in International Commercial Arbitration.”

Jonathan Carlson was named Senior Associate to UI President Sally Mason, effective January 1, 2008 for two years. He has stepped down as Associate Dean for Academic Affairs. His replacement is his predecessor Eric Andersen.

In his new position, Carlson advises the President on general issues relating to the university and higher education; coordinates special projects on behalf of the President’s office; schedules monthly Presidential forums; works with groups to present initiatives to the President’s office; and develops initiatives to advance the President’s mission.

His prior administrative experience has included Associate Dean of law school admissions in 1993-94, UI Faculty Senate President 1999-2000, and 2002 Chair of the UI Presidential Search committee. He is a past recipient of the Michael J. Brody Award for Faculty Excellence in Service to the University and the State.

During the summer of 2007, he completed the 13th annual update of volumes 4 and 5 of Weston & Carlson, International Law & World Order: Basic Documents (Martinus Nijhoff ).

They have sent the paper to various journals and are awaiting a reply.

Lois Cox became the University Ombudsperson on a half-time basis starting in February. She previously held the position in 1997-1999. As Ombudsperson, she meets with and advises any member of the university community, broadly defined, who wishes to discuss a problem or concern. At the College of Law, she continues to work with students in the Legal Clinic representing victims of domestic violence. In the spring , she co-taught a seminar on Poverty Law with Professor John Allen.

Josephine Gittler ’s teaching, scholarship and public service has been centered on issues and problems related to health law and policy. She continues to serve as Director of the National Health Law and Policy (NHLP) Resource Center and as Director of Policy for the Hartford Center of Geriatric Nursing Excellence (HCGNE) at the University of Iowa.

Professor Gittler co-edited a new book Geocoding Health Data: The Use Of Geographic Codes In Cancer Prevention And Control Research, And Practice (CRC Press 2007). Her co-editors include Gerald Rushton, Dale Zimmerman, Marc Armstrong, Claire Pavlik, Barry Greene and Michele West. She

contributed the chapter entitled “Cancer Registry Data and Geocoding: Privacy, Confidentiality, and Security Issues” and the appendix, “Cancer Reporting and Registry Statutes and Regulations” to the book. This book is the outgrowth of an externally funded project conducted by the College of Public Health in which the NHLP Resource Center participated.

Gittler is currently principal investigator of an externally funded Resource Center project dealing with legal requirements with respect to nursing home staffing and the relationship between these requirements and the quality of nursing home care. One product of this project is a two part article entitled “Nursing Staffing and Training Recommendations for the Quality of Care and Life” in Research in Gerontological Research, a peer review journal.

Gittler co-authored the article with Meridean Maas, Janet Specht, Kathleen Buckwalter and Kate Bechen.

In her capacity as Director of the NHLP Resource Center and Director of Policy for the HCGNE, Gittler is part of externally funded project to develop the Nursing Home Collaborative (NHC), the mission of which is to improve the quality of care provided in nursing homes to frail elders with

Faculty N o t e s complex health care needs. The NHC is comprised of five Hartford Centers in Arkansas, California, Oregon and Pennsylvania as well as Iowa and the NHLP Resource Center. The NHLP is responsible for the examination of the legal framework within which nursing homes must operate, which is a major focus of the current project. Gittler authored a report for the NHC entitled “The Legal Framework for Nursing Home Regulation: Improving Quality of Care for the Elderly and Protecting the Elderly from Mistreatment.”

Bill Hines has completed the first year of a five-year phased retirement plan.

He was a nominee for the Collegiate Teaching Award. He wrote an essay for a memorial issue of the Iowa Law Review honoring the late Eighth Circuit federal judge and UI alumnus Donald P. Lay, class of 1951. Justice Stevens was another contributor to the issue. He also recently completed writing two additional chapters for the book he is editing on the History of the Iowa Law School. The new chapters are on “Diversity within the College” and “Instruction in Professional Skills.” The next step is final editing of the 14 chapters in the book (seven straight history and seven highlighting specific program elements), and selecting

50-100 archival photos to be inserted at appropriate locations in the manuscript.

He expects to have the completed manuscript ready for submission to potential publishers soon. He is also writing an article, co-authored with his daughter, Professor Laura Hines, tentatively titled, “The Emerging Federal Common Law of Punitive Damages,” to be submitted for publication at the end of this summer.

Herbert Hovenkamp worked this past summer on what he hopes will be a book on The Dominant Firm, Innovation, And Competition Policy. He finished a chapter entitled “Restraints on Innovation” and he has drafts completed of two additional chapters. One is entitled “The Legal Periphery of Dominant Firm Conduct,” which he presented as a lecture in October to the EU Competition Commission in Lisbon, Portugal. The other one is entitled “The Harvard and Chicago Schools and the Dominant Firm: Where Do We Stand?” which he presented to a conference on conservative influences on antitrust policy at Georgetown Law School. He has recently completed three volumes of the Antitrust Law treatise, devoted entirely to monopolization. These volumes, which have been heavily cited by the Supreme Court and the lower federal courts, are the most comprehensive treatment ever of the law of monopolization. Finally, his recent book The Antitrust Enterprise: Principle and Execution (Harvard Press, 2006), is now available in paperback.

Mark Janis ,

along with the American Farm Bureau Federation, developed a plain language question and answer guide on intellectual property law tailored to plant agriculture. The document will be sent to all state farm bureaus across the country.

He published two articles in the Iowa Law Review on the topic of trademark use (co-authored with Graeme Dinwoodie). The law review published one article as the main article in a colloquy. Professors Mark Lemley and Stacey Dogan wrote a response article, and Dinwoodie and Janis wrote a reply article. The Innovation, Business and Law Program hosted a trademark scholars roundtable in April extending the debate. About a dozen leading trademark scholars participated, addressing both domestic and international/comparative aspects of the trademark use issue.

The Innovation, Business and Law Program launched a practitioner-inresidence series. Four practitioners and a district court judge visited the law school in the fall, speaking in a number of classes, delivering public lectures, and meeting with various student groups.

Several more practitioners visited in Spring 2008.

Janis published the second edition of the casebook Trademarks and Unfair Competition: Law and Policy

(co-authored with Graeme Dinwoodie).

He also completed editing of a book, Trademark Law And Theory: A Handbook Of Contemporary Research (with Dinwoodie), a scholarly collection of twenty original articles by leading trademark law scholars from the US and abroad. It was published this spring by Edward Elgar Publishers (London). Additionally, he published a law review article, “Technological Change and the Design of Plant Variety Protection Regimes” in the Chicago Kent Law Review (with Stephen Smith, a plant biotechnology researcher at Pioneer Hi-Bred). He completed a book chapter, “Patent Pools,” for an ABA book, Issues In Competition Law And Policy (due out in 2008).

Finally, Janis taught a short course in Trade Dress and Design Law in January at the Munich Intellectual Property Center. The course materials are excerpted from a casebook manuscript, Trade Dress And Design Law (with Dinwoodie). She actively participated in the committee’s two projects for this year: a meeting with the National Conference of Bar Examiners to further the discussion begun at the 2004 Joint Conference concerning the relationship between academic preparation and bar exam passage. The second activity was a program at the 2008 Annual Meeting titled “Truth or Dare: The Responsibilities of Law Schools and Bar Examiners for Lawyers’ Character and Fitness.” The panel’s presentation prompted a lively discussion regarding ways in which law faculty could more directly identify and address problematic student behavior that may predict lawyer misconduct.

The title for the show was “The Jena Six and the Question of Justice.” In September, Onwuachi-Willig presented a draft article “Lakisha and Jamal Go to Work: Analyzing Workplace Appearance and Grooming Standards as Racial Stereotyping” (co-authored with Mario Barnes of the University of Miami School of Law) at a faculty workshop at the University of North Carolina-Chapel Hill School of Law. She also presented her essay “A Beautiful Lie: Exploring Rhinelander v. Rhinelander, as a Formative Lesson on Race, Marriage, Identity, and Family” on September 17, as part of Northwestern University School of Law’s Critical Race Theory Faculty Speakers Colloquium. This essay was published in the December 2007 issue of the California Law Review. Onwuachi-Willig also served as a speaker for a roundtable and as a commentator for a junior scholar’s work-in-progress at the Latina/o Critical Theory Conference at Florida International University in Miami, Florida from October 4-7.

In August, she gave testimony before the U.S. House Subcommittee on Financial Institutions and Consumer Credit on the subject of older Americans and credit cards. She has authored a review of Ronald Mann’s book on credit cards, Charging Ahead, that is forthcoming in the 2008 Michigan Law Review Annual Survey of Books.

Porter continues her empirical research on the longitudinal effects of bankruptcy. Her article, “Bankrupt Profits: The Credit Industry’s Business Model for Postbankruptcy Lending,” is a study of how creditors solicit recent bankruptcy filers. The findings in “Bankrupt Profits” were featured in several newspapers, including the New York Times, San Francisco Chronicle, and on several web sites such as salon.com and forbes.com.

The paper was selected by peer reviewers for presentation at the Conference on Empirical Legal Studies in November at NYU Law School. It is forthcoming in the Iowa Law Review. By invitation, she presented a follow-up piece, Borrowing After Bankruptcy, at the Harvard-University of Texas Conference on Commercial Law Realities and at the BigTen Aspiring Scholars Conference. The research is the first comprehensive examination of how people who have filed bankruptcy use credit since the late 1960s.

She continues her involvement with the Consumer Bankruptcy Project, which launched a new study in 2007.

She presented the first data from the project at a special meeting of the American Association of Law Schools’ DebtorCreditor section this fall. She also organized and moderated the DebtorCreditor section presentation, Broke But Not Bankrupt, at the American Associa-

He invited former LL.M. student Patrick Patelin to address his Arcachon course. Patrick is a native of this small French town and is responsible for suggesting that Iowa establish its summer program there. He is currently a partner in the Buenos Aires office of a multinational law firm.

Reitz’s major project this past summer was a nine country, hundred page survey of judicial review of administrative action. The countries covered are France, Germany, Indonesia, Japan, Russia, Sweden, the United Kingdom, the United States, and Vietnam. The original John Reitz

impetus for the study was a contract with the United Nations Development Project for Vietnam. His conclusion was that the Vietnamese administrative review system needs to be much more independent from the government and the ruling Communist Party in order to have credibility and legitimacy.

Reitz intends to do a substantial rewrite of the report under the title “Prolegomenon to the Comparative Study of Judicial Review of Administrative Action” as an article that will lay the basis for a book. This field is a major hole in the body of comparative scholarship. He has discovered a framework to contrast systems that other scholars have found too disparate to compare. Other scholarly projects include “Law without Borders: The Indubitable Relevance of Comparative Law” and “Why the United States Has So Many Tort Suits: Political Economy and Civil Procedure.” published a chapter “Caremark, Disney, and Stone – A Good-Faith Trilogy” in Macey’s Iconic Cases in Corporate Law (West, Jonathan Macey ed.) She is participating in a symposium in honor of the SEC’s 75th anniversary to be held at the University of Virginia in the fall, and her article, “Monitoring Caremark’s Good Faith,” based on her Pileggi Lecture, was published in the Delaware Journal of Corporate Law and reprinted at 40 Bank and Corporate Governance Law Reporter 147 (2008). L.L.C. v. Scientific-Atlanta, Inc. Sale gave talks at Columbia, Fordham, the University of British Columbia, and Kentucky. She is also the Program Chair and a member of the Steering Committee of the DirectWomen Institute, a program designed to train and work with senior women lawyers who want to achieve positions with public company boards of directors.

The Second Annual Institute was held in Feburary of 2008 in New York City. She continues her work with the ABA Committee on Corporate Laws, attended meetings in Chicago, New York, Dallas, and Healdsburg, CA, and was a panelist at the Spring meeting of the Business Law Section on director primacy.

Mark Schantz co-presented a Legal Ethics CLE workshop entitled “Challenging Problems in Legal Ethics” for the faculty in December with Randy Bezanson. He also worked on the academic content of AAI this semester with Jon Carlson as well as served as Moot Court Faculty Adviser. He taught Law and Popular Culture.

Barbara Schwartz presented “What Every Lawyer Should Know About Immigration Law” to the Scott County Bar on Martin Luther King, Jr. Day. In February, she presented on Immigration Policy to the Iowa City Senior Citizens’ Center as part of the Center’s series on issues relating to diversity. This past fall Schwartz moderated a panel on the “Carnegie Report On Educating Lawyers” at the Midwest Clinical Conference at Drake. She has been given a Career Development Award to take one semester leave during the next academic year.

Lillich Memorial Lecture at FSU in the fall on New Directions in the Struggle Against Human Trafficking, and a paper on the impact of counter-terrorism law and policy on the American nonprofit sector at the Conference on Aid, Security and Civil Society in the post-9/11 Context, which was convened by the London School of Economics in June 2007 in London.

Sidel has completed most of a book contracted with Routledge on Regulation Of The Voluntary Sector: Freedom And Security in an Age Of Uncertainty. The book explores the impact of counterterrorism policy on the nonprofit sector and civil society in the United States, United Kingdom, India, Canada, and Australia and will be published in 2009.

He is finishing The Constitution of Vietnam: A Contextual Analysis, which will be published by Hart (Oxford), a leading British scholarly law publisher, in 2009.

Sidel also wrote and delivered a paper on constitutional debate and dialogue in Vietnam at the Conference on New Courts in the Asia-Pacific Region, which met at the University of Victoria in June 2007. He then stayed on to teach in the summer Asian law program at Victoria for a week with colleagues from Asia and Canada.

He obtained external grant funding from the Asia Foundation chaired a workshop on Philanthropy and Law in South Asia, which met in New Delhi, India in August 2007. This was a followup workshop to the book he edited, Philanthropy and Law in South Asia (2004), and the lengthy workshop report serves as a supplement to that volume. During the fall of 2007, Sidel also testified at the Canadian anti-terrorism commission hearings in Ottawa on charities and terrorist finance; and delivered a paper and chaired a panel at the Association for Research on Nonprofit Organizations and Voluntary Action (Arnova) annual meetings in Atlanta.

Sidel will serve as President of the International Society for Third Sector Research beginning in 2009. ISTR is the international scholarly association that works to strengthen and promote research and teaching on the nonprofit sector, philanthropy, and civil society, with membership in dozens of countries around the world. He will also serve as Chair of the American Association of Law Schools Section on Nonprofit and Philanthropic Law in 2009-10. was invited to join the Labor Law Group, an international association of legal scholars dedicated to advancing scholarship and pedagogy on labor and employment law. In June 2007, she attended the Group’s conference in St. Charles, Illinois. In July 2007, she presented a paper on the labor implications of consumer-directed home care at the 2007 International Conference on Law and Society held in Berlin, Germany. The paper discussed the workplace implications of the growing trend among states to deliver publicly-funded care via a model of consumer-directed care as opposed to traditional agency-based care. The paper was published as “Home Sweet Home? Workplace Casualties of Consumer-Directed Home Care for the Elderly” in the Notre Dame Journal of Law, Ethics & Public Policy.

Last summer, Smith taught a class on employment discrimination law to the participants of the 2007 Philip G. Hubbard Law School Preparation Program.

During the summer, Smith also gave a number of media interviews on the Supreme Court’s decision in Long Island Care at Home & Osborne v. Coke.

In the fall semester, Smith served on a faculty panel for incoming minority law students. In the fall, she also participated in the inaugural Cmiel Collaborative Semester. Named in honor of Kenneth Cmiel, the semester brought together faculty from various disciplines to study a common research area. The inaugural semester focused on “Global Perspectives on Under-regulated Labor.” In November 2007, the semester hosted several renowned scholars and advocates whose work relates to under-regulated and undocumented labor including Harold Craig Becker who represented the respondent in the aforementioned Supreme Court case of Long Island Care at Home.

In October 2007, Smith served as a commentator for a work-in-progress at the LatCrit XII conference. In November 2007, she presented a paper at the LowWage Worker: Legal Rights-Legal Realities conference held at the University of Minnesota School of Law. Her paper for the conference, “The Publicization of Home-Based Care Work in State Labor Law,” is forthcoming in the Minnesota Law Review. The paper examines the labor movement’s campaign to unionize home-based care workers, deemed independent contractors, in both the child-care and home-care sectors.

In January 2008, Smith delivered a paper at the AALS Annual Meeting in New York. The paper, which was part of the “Work and Care” panel sponsored by the Section on Women in Legal Education, discussed the evolving legal status of home care workers in employment law.

Smith was a nominee for the Collegiate Teaching Award as well.

Alexander “Sascha” Somek is a Fellow in the Institute for Advanced Study Berlin for the academic year 2007-08.

Before temporarily moving to Berlin, he presented two papers at other places in Germany last June. In the first, he offered a critique of one-sided conceptions of deliberative democracy, in the second a historical perspective on legality.

Last summer he finished the final draft of his book Individualism: An Essay On The Authority Of The European Union, which appeared in print in March 2008. By the end of 2007, he completed a first draft of a critical analysis of (European) anti-discrimination law, which is called Neoliberalism with a Human Face: On the Significance and Place of Antidiscrimination Law. Somek recently presented papers in Germany, Austria, Australia and the United Kingdom on various topics. For example, at the Free University Berlin he gave a talk about the equality principle and in Vienna on the most recent Reform Treaty of the European Union.

Tomkovicz participated in the Iowa Law Review’s Spring 2008 Symposium on Hudson v. Michigan, writing an article about the case and making an oral presentation at the Symposium in late February. The Hudson panel consisted of Tomkovicz, two other distinguished scholars (Professor Albert Alschuler and Professor David Moran), and one federal appellate judge (the Honorable Steven Colloton of the Eighth Circuit).

Last summer, Tomkovicz drafted and submitted a book proposal to academic publishers which entails comprehensive treatment of constitutionally-based “exclusionary rules.” Oxford University Press has agreed to publish the text, which is tentatively entitled Constitutional Exclusion: The Rules, Rights, And Remedies That Strike The Balance Between Freedom And Order.

Tomkovicz is the College of Law’s representative on the fifteen-member Iowa Criminal Code Reorganization Committee, which is undertaking the first comprehensive revision of Iowa’s Criminal Law in thirty years. This assignment is contemplated to be a two- to four-year commitment. The two academics on the committee (Tomkovicz and Professor Robert Rigg from the Drake Law School) are expected to be heavily involved in drafting revision proposals. State Senator Keith Kreiman (‘78) and State Representative Kurt Swaim (’75) are the co-chairs of the committee.

Tomkovicz was a nominee for the Collegiate Teaching Award this fall. He served as a Visiting Professor once again during the spring 2008 semester at the UCLA School of Law, teaching three courses. In April, he presented a CLE lecture on recent Supreme Court developments to a large gathering of public defenders from across the nation in Las Vegas. In June, he will participate in the AALS New Law Teachers’ Workshop in Washington, D.C. And, in August, he is scheduled to deliver a CLE lecture at the

Iowa Judicial Institute. Finally, Professor Tomkovicz has authored an amicus curiae brief for the American Civil Liberties Union in Arizona v. Gant, a case currently pending before the United States Supreme Court and to be argued next fall.

Gant raises issues concerning the scope of officers’ authority to search vehicles following the arrest of an occupant. is completing the publication process of Mrs. Dred Scott with Oxford University Press, which should be available in bookstores in January 2009. Using newly discovered evidence, this book reveals an untold story of Harriet Scott, one of the litigants in the most infamous U.S. Supreme Court decisions, Dred Scott v. Sanford.

It is also the story of how law evolves in the antebellum frontier in the context of building states out of the Northwest Territory and the Missouri Compromise lands. The lengthy study is the fruit of more than a decade of research into the circumstance of a slavewoman’s life in the upper Mississippi valley where the Dakota and Ojibwa battled for control of the area, and the Indian Agency, Fort, and American Fur Company represented settlement interests. The second half of the book centers upon St. Louis which as the steamboat hub, was also the legal

forum for frontier disputes including slaves suits for freedom.

VanderVelde has been very active as a liason between the Labor Law Group of leading employment law scholars and academics and the ALI in its project on the Restatement of Employment Law. She recently spoke for the LLG at the ALI meeting in Washington, D.C. She has also been busy giving talks at law schools around the country on a variety of topics having to do with the link between the American tradition of free labor and the current state of employment law.

This fall she taught a capstone course in Land Use for students seeking to integrate different subjects that they had learned in property and land use related subjects before going into practice.

Larry D. Ward , the Orville L. and Ermina D. Dykstra Professor of Federal Tax Law, was a nominee for the Collegiate Teaching Award. His most recent publication is Problems and Solutions for Basic Federal Income Taxation (ThomsonWest, 2007).

Burns H. Weston , Bessie Dutton Murray Distinguished Professor of Law Emeritus, has spent most of the past year working as Project Director of the externally-funded Climate Legacy Initiative (CLI), a $750,000 joint project

of the UI Center for Human Rights (where Weston is lifetime Senior Scholar) and the Environmental Law Center of Vermont Law School (where he has been teaching each Fall since 2004). Involving the coordination of a team of mostly legal scholars from the UI (including Jonathan Carlson), Vermont Law School, and others from across the country and Europe, the CLI (www.vermontlaw.edu/ cli) seeks to clarify the extent to which US, foreign, indigenous, and international law safeguard present and especially future generations from harms resulting from climate change. Phase One of the CLI, principally legal and scientific research activity, will culminate in the public release in fall 2008 of a “Green Paper” (a policy paper more commonly called a “white paper”) tentatively titled “Climate Change and Intergenerational Justice” and detailing the CLI’s findings.

Intended primarily for public and private sector policy-makers, educators, and civil society activists, it will elaborate, in addition, a series of precedent-setting legal measures designed to enhance the prospects of intergenerational eco-justice at the local, state, federal, and international levels, particularly in the context of the dire threats posed by climate change. It is hoped that these and other such measures can be the focus of the CLI’s planned Phase Two. One consequence of Weston’s CLI work is an article titled “Climate Change and Intergenerational Justice: Foundational Reflections.” Forthcoming in the Spring Issue of the Vermont Journal of Environmental Law (Vol. 9, No. 3), it will serve as the theoretical backbone of the CLI Green Paper scheduled for fall 2008. Partly as a result of this scholarship, Weston has accepted to serve on the Editorial Board of a newly developed peer-review journal, the German-based Intergenerational Justice Review (IGJR), which aims to publish current research and thinking from political science, law, ethics, and other disciplines bearing on matters of importance to the well-being

of future generations of the human family.

Also, continuing a long-standing interest in the theoretical as well as operational foundations of international human rights law, Weston also has recently authored an article titled “Human Rights and Nation-Building in Cross-Cultural Settings” to be published in the forthcoming spring 2008 issue of the Maine Law Review as part of a symposium on “Nation-Building: A Legal Architecture?” The purpose of the symposium is to explore, from various perspectives, the hypothesis that there is a normative framework grounded in law to which institutional and individual participants in the nation-building process can and should adhere.

In late 2007, Weston co-authored “Child Labor,” an essay published in the new second edition of the International Encyclopedia of the Social Sciences. Currently, he is completing a manuscript tentatively titled “Child Labor and Human Rights” for publication in 2009 as a chapter in the book Human Rights in Labor and Employment Relations: International and Domestic Perspectives being edited by Cornell University professors Lance Compa and James Gross for the U.S. Labor & Employment Relations Association. He also is helping to complete, with co-authors Jonathan Carlson (as lead author) and Geoffrey Palmer, the third edition of International Environmental Law and World Order: A ProblemOriented Coursebook, scheduled for publication by Thomson-West in 2009. In addition, he is preparing, with third-year law student Suzan Pritchett, an essay tentatively titled “Climate Change, Human Rights, and Intergenerational Justice” for publication in a surprise international law festschrift, scheduled for 2009 as well.

He also has continued, with the help of very able law students, his annual update of International Law and World Order: Basic Documents (1994– ), co-edited each year with Jonathan Carlson; and his “Human Rights Index” series published

three times annually, also with the help of very able law students, in The Iowa Review and, subsequently, on the website of the UI Center for Human Rights (www. uichr.org), which underwrites the series.

Finally, supplementing his scholarly work of the last year, Weston continued to serve as a Counselor to the American Society of International Law, as an Honorary Member of the American Journal of International Law, and as Senior Human Rights Advisor to UNICEF’s Innocenti Research Centre in Florence, Italy. He also participated in several conferences and symposia focused on climate change and the law, both in the United States and abroad. In addition, in fall 2007 at Vermont Law School, he taught a research seminar on Intergenerational Rights and Climate Change and, in Spring 2008 at the UI College of Law, a research seminar on Human Rights Law and Policy. In June 2008, he will teach a course on the Foundational Theory and Practice of International Law as part of the College of Law’s annual summer program in Arcachon, France.

John Whiston spent the summer and fall of 2007 on sabbatical involved in a research project on the post-sentencing obligations of criminal defense lawyers.

He spent the summer working as a Tribal Public Defender for the Confederated Salish and Kootenai Tribes on the Flathead Reservation in Western Montana. The Reservation occupies 1.3 million acres, about 2000 square miles and is the home to about 25,000 inhabitants, a third of whom are Native American. His office and the Tribal Court were located in the small town of Pablo, Montana, about 65 miles north of Missoula and about five miles south of Flathead Lake. Tribal Court has exclusive jurisdiction over misdemeanors and concurrent jurisdiction with state courts over felonies. The Reservation is home to the

Faculty N o t e s Salish and Kootenai, both northwestern tribes culturally similar to the Nez Perce, but the court also has jurisdiction over any offender who is an enrolled member of a federally recognized tribe. So Whiston represented many Blackfeet as well as Pottawattamie, Assiniboine, Sioux, Cherokee and Comanche. He was in court every Monday, Wednesday and Friday afternoon, in front of Tribal Judges, who are non-lawyer Tribal members. The twenty to forty cases called each day were an object documentary of the impact of poverty and substance abuse, even on this relatively prosperous reservation.

While working for the Tribes, he assisted in developing a restorative justice program for offenders, which involves Tribal Probation officers and elders from the Tribal Cultural Committee.

During the fall semester, Whiston returned to Iowa City and focused his attention on the legal issues surrounding Iowa probation system and defense attorneys involvement with the program.

He is currently analyzing several large databases from the Department of Correctional Services to identify patterns of successful and unsuccessful completion of periods of probation. During the fall, he also supervised the 25th Annual Roy L. Stephenson Competition. The six Stephenson winners with Whiston as coach then participated in the Regional Competition in Kansas City in February.

For the first time in the last five years, both teams progressed all the way to the regional finals. Whiston also developed a new advanced trial advocacy course in Deposition Practice and taught it as an intensive intersession class over spring break.

Adrien Wing directed the 2007 summer program in Arcachon, France for the eighth year as well as taught Law in the Muslim World. She was joined by Professor John Reitz, who taught Comparative Constitutional Law. The program was inspected by Washington Justice Depart-

Wing visited the UMKC summer program in Dublin, which sent five students to Arcachon. She also took a dozen person group to Turkey for the post-program tutorial. This was the second year Iowa students visited the capital Ankara and met with members of the Supreme Court and parliamentarians.

They also visited Istanbul and met with officials from the Istanbul Bar Associa-

tion. She returned to Istanbul as an ABA inspector herself for the new program at Koc University run by Santa Clara Law School. She also lectured on women’s rights at the American University in Cairo summer program run by Seton Hall. She spoke on US Constitutional Law at Kalamoon University during her first trip to Syria. She attended the International Law & Society conference in Berlin and presented on “Endangered Black Males.”

Wing researched women’s rights in Tunisia and completed an article entitled “The Future of Palestinian Women’s Rights: Lessons from a Half Century of Tunisian Progress,” which has appeared in the Washington & Lee Law Review. She also did a draft of “A Truth and Reconciliation Commission for Palestine/Israel: Healing Spirit Injuries,” for the TLCP. Finally, she submitted “Equality: Facially Neutral Rules that Disparately Impact Protected Classes,” for an Oxford Press book by Mark Tushnet and Vikram Amar entitled Comparative Constitutional Law. Her publications also include The Law Unbound!: A Richard Delgado Reader (Paradigm Press), which she edited with Jean Stefancic as well as conference proceedings on “Slave Trafficking” for the American Society of International Law Procedeedings.

The final version will be published in the Fordham Law Review. She presented a distinguished lecture at American University Law School on “International Law, Secularism, and the Islamic World,” which will be published in the American University Journal of International Law this spring. Also in November, she did her annual student recruiting at the Pacific pre-law Forum in Los Angeles.

On campus, she continues to serves as Chair of the Gender Equity Task Force, whose recommendations have resulted in automatic tenure extensions for those having/adopting a child. She is enjoying a term on the University Study Abroad committee.

Wing began a two-year term as Vice President of the American Society of International Law as well as serving on the Annual Meeting committee. She is organizing the first joint conference of the Society and the Egyptian Society of

International Law to be held in Cairo in June. She was also named incoming Chair of the AALS Membership Review Committee starting in January 2008. In December, she was a featured panelist in Des Moines for the Black Brown Forum featuring all Democratic Party presidential candidates.

In February, she presented two lectures at Washington University in St Louis. As part of their Katrina week, she did “International and National Implications of Katrina.” She was also the keynote speaker for the BLSA annual banquet. Her speech on “Black Lawyers Commitment to Justice” was also presented for Black History Month at Iowa.

Also for Black History Month, she did a presentation on “Global Social Justice” for the UI Libraries. Wing also was a panelist at Harvard Law School for the 25th BLSA conference. Her talk on “Race and Law Across Boundaries: South Africa Role Models for the US will be published by the Harvard Blackletter Journal.

Tung Yin published “Enemies of the State: Rational Classification in the War on Terrorism,” his contribution to a spring symposium at Lewis & Clark Law School, in the Lewis & Clark Law Review; a review essay of Ben Saul’s Defining Terrorism in International Law for the American Journal of International Law; and “Jack Bauer Syndrome: Hollywood’s Depiction of National Security Law,” in the Southern California Interdisciplinary Law Journal.

During the summer of 2007 Yin gave a presentation for the Linn County Bar Association’s summer CLE program and also appeared on a panel on the ongoing Guantanamo Bay litigation at the Southeastern Association of Law School (SEALS) conference in Amelia Island, Florida. At the beginning of the fall semester, he spoke to the 2Ls about law firm interviewing etiquette (and disasters), and to the 1Ls about the dangers of embarrassing Internet exposure via Facebook, MySpace, and blogs. The Monica Moen approach to social justice Looking at Monica Moen, you might not guess that she has experienced discrimination firsthand. But growing up during the fifties in rural western Iowa, Monica remembers feeling “out of sync” with her community.

Her German parents and grandparents had emigrated to America—her father arrived with his parents and brother shortly after World War I and her mother and maternal grandmother arrived after World War II. Her family was often viewed with suspicion by neighbors who wrongly associated them with the atrocities of the War, while others simply didn’t understand their European ways.

Monica’s childhood gave her an early understanding of prejudice—and helped shape her lifelong efforts to fight it.

Her resolve was galvanized by a surprising (and, at the time,

demoralizing) turn of events in her adult life.

Monica had been married to her college sweetheart, Marc, for 20 years when he came to her with the revelation that he was gay. “It was devastating,” Monica says.

“But what could I do? Marc is who he is, and I had to unlearn my own misconceptions in order to get on with my life and to allow Marc to live the life he was destined to live.”

She and Marc had come to Iowa City as newlyweds in 1976, when he enrolled in law school at Iowa. For Monica, part of the process of moving on was to go to law school herself, forging a new career and beginning the next chapter of her life. In the watershed of a trying emotional time, she resigned a public position as a land use planner and quietly enrolled in the UI College of Law in 1994.

What she didn’t do, however, was cut Marc out of her life. Still dear friends to this day, she and Marc are

partners in the moengroup, a very prominent real estate development firm in Iowa City—working alongside with Marc’s life partner, Bobby Jett, and his brother Mike Moen.

“My experience taught me that there are immutable characteristics we can’t change in people—including race, gender, and sexual orientation—and also made me aware of how insidious and grievous prejudice can be, not just socially or in the community but also in the law and the protections or privileges afforded to some but not to others.”

“Education is the key to fighting prejudice,” Monica says. “And it comes in equal doses of learning and unlearning. Sometimes unlearning is a more valuable life tool—it’s certainly more enlightening.”

That’s why Monica has endowed the Monica B. Moen Race, Sexual Orientation, and Social Justice Chair

in the University of Iowa College of Law. While she freely admits that prejudice will always exist—“It’s human nature,” she acknowledges— she hopes that supporting an emphasis on social justice in the study of law at Iowa will help to make sure that people’s individual prejudices are not allowed to influence government policy or further institutional discrimination.

“I wouldn’t want to live in a world where everyone is the same,” she says. “Law is the arena where we can address and accommodate our differences. There is no better place for fair play.”

The Monica B. Moen Chair will help ensure that the College of Law will be able to hire—and retain— leading faculty members who share her passion for social justice, well into the future.

And it means equal doses of learning and unlearning for Iowa law students for many years to come.

Michael Colin Sandler (’80) Jan. 26, 1955-Feb. 2, 2008 Michael Colin Sandler died at his Beverly Hills home of pancreatic cancer.

Born in South Africa, he immigrated to the United States at the age of 19. He graduated from The University of Iowa several times, receiving a BBA in marketing and management sciences in 1977, a JD degree in 1980, and an MBA degree in 1981.

With Bruce G. Veaco, Sandler cofounded Focused Investors, an investment management firm based in Los Angeles.

Prior to that, he was a senior principal with Pacific Financial Research Inc., former adviser to the Clipper Fund Inc. A great humanitarian, philanthropist, and strong advocate of human rights, he was the founding president and current president of the Global Justice Center, which aims to promote gender equality at all levels of government, beginning with the enforcement of existing rights laws.

Sandler served on the board of the Iowa Law School Foundation since 2000 and was a trustee of the Museum of Contemporary Art in Los Angeles.

Law school gathers to say goodbye to old home

The University of Iowa College of Law visited its old home one last time at an alumni gathering in the former Law Commons/Iowa Law Center on Riverside Drive on Saturday, September 8, 2007. All law alumni who spent time in the building were invited back for a final nostalgic visit, along with many faculty who taught there.

“For decades, the Law Commons and Iowa Law Center played a significant part in the lives of so many law students, so it’s appropriate we say one final farewell to a place that means so much to the College of Law’s history,” said law Dean Carolyn Jones, who attended class in the building as a law student from 1976 to 1979.

The Law Commons, known more recently as the International Center, is due to be demolished sometime next year to make way for a new building for the College of Public Health.

Opened in 1935, the Law Commons first served as a residence

hall for law students while the school itself was located in what is now Gilmore Hall, where it had moved to in 1913 from its first home in Old Capitol.

The building was used for other purposes during its residence hall years, as well; among other uses, the Army housed trainees there during World War II, and it was used as office space for the Department of Continuing Education and as a residence for campus visitors. Eventually it closed completely as a residence hall and-with the construction of a new library tower addition in 1959-became home to the law school itself in 1961 as the re-named Iowa Law Center.

“We loved moving to the Iowa Law Center,” said Willard “Sandy” Boyd, UI law professor and president emeritus, who joined the law faculty in 1954. “Gilmore Hall was so cramped and tight. It had only three classrooms and too few faculty offices, and the library was bursting at the seams. We thought it

was great when we moved to the Law Center.”

The new building debuted with a splash, with Earl Warren, the chief justice of the United States, speaking at the dedication ceremony. But it wasn’t long before the Iowa Law Center was also cramped and tight, so much so that the law school started planning for a new facility by the late 1970s. By 1986, the new building was ready and the law school moved into the Boyd Law Building, where it remains today.

“It was hard for many of us to leave the comfort and hominess of our offices of the remodeled Law Commons when the college moved to the ultramodern Boyd Law Building,” said law professor and law school dean emeritus N. William Hines, who joined the Iowa law faculty in 1962 and who, as dean, oversaw the construction of the Boyd Law Building. “Like law graduates who lived in the Law Commons as students, those of us who taught, researched and socialized in the old building will be saddened to see it eliminated from the U of I campus after 72 years of useful service.”

Among the prominent UI law alumni who either lived in Law Commons or attended school at the Iowa Law Center are: Norm Coleman, United States senator from Minnesota; Jerry Larson, associate justice on the Iowa Supreme Court; Fred Hubbell, former president, chairman and CEO of The Equitable insurance company, later executive board member and division chairman of ING insurance and financial services; and Robert Downer, Iowa City attorney and member of the Board of Regents, State of Iowa.

In the Winter 2007 issue of the Iowa Advocate, we ran an article called, “Making Up for Lost Time” about the World War II generation and the College of Law. It was during this time frame that so many of our alumni veterans called the Law Commons home. The article neglected to recognize that this generation was active in the law school community even before the end of the war. Earl R. Shostrom (’47) shared this perspective with us and we are happy to share it with you. ...

The article in the Iowa Advocate contained interviews only with attorneys who had started law school after the end of World War II. The returning veterans who had been law school students prior to the war were completely overlooked.

These men had a special bond and their return to the Iowa law school was similar to a large family reunion, which had not met for three or four years, and had a lot of catching up to do, newswise.

Each of the returnees had lost good law school friends and classmates in the war, which drew the survivors even closer together.

The September class of 1946 was a good class, which did increase enrollment and strengthen the Iowa law school, but the law school had already revived during the three post-war semesters before the September class of 1946 appeared on the scene.

It was hard for many of us to leave the comfort and hominess of our offices of the remodeled Law Commons when the college moved to the ultramodern

When I received your card as to the open house, I told myself that if I possibly can, we were going to see the “Commons” one last time. I had been overseas for just over 3 ½ years and stopped on the way home. (Brisbane, Australia via Los Angeles and then to Jefferson Barracks in St. Louis, then via the Rock Island to Iowa City.) I got off at Iowa City and walked to the Law School in late September 1945. I walked into the Dean’s office and with knees trembling I asked, “I know I am late but I am just getting back home. Could I possibly enter the freshman class?” The wonderful secretary of Dean Ladd told me, “Let me call the registrar’s office.” Soon she turned around and said, “Be here at 8 o’clock Monday morning and I will take you to your first class.”

I took the Rock Island home for Saturday and part of Sunday and back again the same way for Monday morning classes.

I knew I was behind the rest of the students, having been out of school since 1941 so I promised myself that I would catch up by reading all of Black’s dictionary over the Christmas holidays. Truth of the matter is that I never did get that done, it is still on my “to do” list.

Living at the Law Commons, eating at the large tables with fellow law students with all of the camaraderie much akin to the dining area at Oxford in England, and sitting in the Lounge at the South end of the Commons, all are fond memories I have. Seeing the Commons one more time was a treat. Special to me, of course, are my memories of rushing to the mailbox to see if I had a letter from Loanna. That was what was really important to me and this is still true.

E ugen io Mo llo (’06)

An Immigrant’s Attorney Eugenio Mollo sees the frustration every day, the exasperation and the anxiety that so often comes with being an immigrant.

Mollo is an attorney for Advocates for Basic Legal Equality (ABLE), a Toledo, Ohio-based organization that provides legal services for low income individuals.

Mollo’s project works with immigrant workers and detainees, so his clients are people who frequently don’t always understand the situations they’re in.

They can’t understand why they’re being deported even though they’ve lived in the United States for decades and have no place in their home country to return to.

Or why they may be separated from their American-born children. Or why they’re in legal trouble just because they missed a filing deadline by a few days.

Many don’t speak English, many are undocumented, and many are confused by the Byzantine system of U.S. immigration laws.

Mollo sees it, and he can identify with it because they’re living a life similar to his own family’s.

Mollo’s parents moved to Chicago from southern Italy in the early 1970s, settling in the city’s Bridgeport neighborhood. Although long known as an Irish stronghold (it’s the home base of the Daley dynasty), Bridgeport was home to a more varied range of ethnic groups by the time they arrived, mostly Lithuanians and Mexicans. Speaking only Italian when they moved, Mollo said his parents tried to learn English but found it difficult to make the jump

However, they found it less difficult to learn the Spanish spoken by many of their new Bridgeport neighbors, and soon mastered a second Romance language. From there they learned English and are now fully fluent in all three languages.

Italian, though, is still the language they speak first.

“Even today, they speak Italian to me,” said Mollo, also fluent in all three languages. “I always reply in English, but Italian is still the primary language in our house.”

As a result, Mollo has always been comfortable working with immigrant families.

A history and education undergraduate at the University of Illinois, Mollo worked with many immigrant families during his student-teaching experiences in Illinois. At the Iowa College of Law, Mollo worked in the law clinic handling mostly immigrant issues, working closely with John Allen, Barbara Schwartz and Len Sandler. He also explored immigration law issues as editor of the Journal of Gender, Race and Justice, and held summer internships working for immigrant farm worker advocacy groups in Ohio and North Carolina.

“I’ve always been interested in working with an immigrant population and

a law degree was another way for me to help,” he said.

Following graduation in 2006, he became an Equal Justice Works Fellow.

His fellowship project is called the Immigrant Worker and Detainee Advocacy Project, working out of ABLE in Ohio.

He plans to stay on with the group as a full-time staff attorney in the Migrant Farmworker and Immigration Program after his fellowship ends in August.

The work brings him in contact with immigrants from around the world, including South America, Africa and the Middle East. Most cases, though, are undocumented Latino immigrants who are being exploited by their employers, or have questions about their status in the United States.

Mollo said it’s understandable why they react the way they do--the country’s immigration laws are confusing and desperately in need of comprehensive reform.

“There’s a lot of confusion and agitation among immigrants” he said. “The anti-immigrant hysteria in some media isn’t making the situation better. The law needs to better accommodate for families. When you see a mother crying because she and her children haven’t seen her husband in Mexico in five years, it shows the human side of our flawed laws.

“Sometimes, the law forces people into undocumented status, because they’re not allowed to get status in the United States,” he said. “The situation is forcing many immigrants to choose between getting status and supporting their families. It’s a tough choice.”

Defending Securities Law It’s easy to spot the people wearing the black hats in corporate scandals.

They’re the ones who lied, the bad guys who cooked the books and manipulated the numbers, the crooks who fanned the smoke and put the mirrors in place and greedily lined their pockets while others suffered.

Or so the public thinks.

“You will always have good people who make bad judgments,” said Kelly Hnatt, ’89, whose practice in accounting and securities law and litigation with the New York City firm of Willkie Farr & Gallagher LLP has called on her to defend clients caught up in many of the various recent corporate scandals.

“Often, they’re trying to do the right thing, or they’ve convinced themselves they’re doing the right thing. Some of them are pressured by their bosses or the corporate culture.”

Does that make them amoral villains with black hats? No, she said. Beige hats, maybe, but not black. So curse the corporate scandal poster boys, people like Ken Lay, Jeff Skilling or Bernie Ebbers, but in her experience, most of the people put in those situations are not there willingly and don’t like it much.

“What they’re told is to deliver results and to make the quarterly numbers,” she said. “They think of their life and their house and their kids’ college education, and they know they’re in a gray area, but they don’t expect to stay there. Only until things get better, they think, and then they’ll go back and fix it. But they never are able to go back and fix it because it doesn’t get better and then they’re in trouble.”

Her work in securities and accounting irregularities matters has made Hnatt something of an anomaly in today’s legal profession. She’s worked nowhere other than Willkie Farr since graduating in 1989, largely because the firm treats its people well and allows her to indulge work that she finds fascinating everyday.

“Leaving Iowa, I decided I wanted to work for the biggest firm in the biggest city that would hire me, so I interviewed with a few firms in New York and Washington,” said Hnatt, who spent much of her childhood in Des Moines. One of those New York firms was Willkie, which has a long history of hiring Hawkeyes. David Foster ‘52, Harvey Sperry ‘57 and Michael Marks ‘59 were partners there at the time, along with two associates. Today, the firm employs eight UI alumni with two more joining later this year.

“They hired me, and here I am,” she said. “Here” is an office more than 40 floors over Manhattan that overlooks Midtown and the West Side, across the Hudson River to a horizon that’s surprisingly green and hilly for New Jersey, a state generally considered to be as flat as Iowa to people who don’t know better.

She said she had no idea as a UI law student that she would someday practice securities law as a firm partner in the heart of the world’s business and finance capital.

“I didn’t know what kind of law I wanted to practice when I was a student, and that was a good thing because I don’t know how you can when you’re 25 years old,” she said. “I was interested in international law at Iowa and I worked

on some projects with Burns Weston, but I also did not see a particular career path for an international lawyer given my litigation interests. So I decided to see where Willkie would take me. Eventually, I became interested in securities law and financial reporting and made that my career.”

She said the Sarbanes-Oxley Act of 2002, passed by Congress after the various corporate scandals of the previous years, changed her job in some ways.

The law put in place sweeping new reporting requirements and internal controls for corporations making it more difficult for manipulation of the numbers to occur as it did at Enron and WorldCom did.

“Over time, there have been fewer investigations and fewer lawsuits because compliance regimes are more substantive than they used to be,” she said.

On the other hand, she said Sarbanes-Oxley did nothing to change human nature, or the cycle of history.

“There will always be people who make poor judgments no matter what the law says,” she said. “And every ten years or so, there’s a cycle of troubled business, such as the insider trading and savings and loans scandals in the 1980s, the over-inflated dot-coms in the 1990s and sub-prime mortgage crisis now.

Businesses will fail, there will be investigations to figure out what caused it, and litigation to sort it all out.”

A Career at Full Speed For a guy who says he’s the most risk-averse person he knows, Ricardo Contreras has decided to go all-in with his new job.

“I went from a stable job with a big, stable company and the offer of a promotion to associate general counsel to a job with a start-up where I don’t even have a title yet,” said Contreras, who just started his new job with Albuquerquebased Eclipse Aviation in March. “But I thought this was the time to take a risk.

It’s a great company with great backers and it has a great future.”

Eclipse Aviation makes small, personal jets that Contreras says are about the size of a large SUV and hold up to six passengers. They sell for about $1.6 million apiece, dirt cheap for a jet, he said.

The company started about 10 years ago with the financial backing of Microsoft mogul Bill Gates and last year

produced its first plane. It’s delivered about 140 so far and the waiting list to buy one is three years long. He said the primary markets for the planes are air taxi companies that ferry small groups of people who want to avoid the congested commercial airlines, as well as wealthy individuals.

His primary role as Assistant Associate Director of Something or Another is to set up an international distribution network that will expand the company’s sales presence to Canada, India, the Middle East and other spots around the world. The company’s model, he said, is a high-end auto dealership, with big, glassy showrooms and sales lots filled with jets.

“We’ve already had people coming to us asking to become distributors, so there’s a strong market out there,” he said.

Among other tasks, Contreras’ job requires contract negotiation and

finance, calling upon both the legal and financial training he received as a JD/ MBA student at the University of Iowa.

He said his education has helped him make regular career changes since graduating in 1998. Born in Mexico, Contreras grew up in Los Angeles and received his undergraduate degree from UCLA before coming to Iowa. After moving to the state, he made a quick discovery about his car once winter set in and the temperature started to fall. “My heater was broken,” he said. “I’d owned my car for years and I had no idea the heater was broken until I actually needed it.”

He has special fondness for law professors Pat Bauer and David Vernon, “who were so willing to develop a personal relationship with us and see us as more than students. Professor Vernon in particular seemed to have an understanding that being a minority in Iowa wasn’t necessarily easy and went out of his way to help me feel more at home.”

Many of the friends he made at Iowa are still his friends today, and they return every year for a football game, even though he doesn’t like football (he leaves at halftime).

Like many of his classmates who graduated in the middle of the dot-com boom, Contreras went into the tech field as an attorney with a small law firm in Albuquerque. From there he went to a large firm in Dallas focusing on corporate law, and then eventually to his most recent job as senior corporate counsel at Harley Davidson Financial.

Given his risk aversion, he said it’s only a coincidence that he went from a company that sold motorcycles to one that sells jets. But when he looks around his current office and compares it to his past jobs, he wonders what he’s done.

“I work in a cubicle with no assistant, no paralegal, no nothing,” he said. “I make my own coffee and do my own mail. It took me 45 minutes to figure out how to FedEx a package to Chile because I hadn’t done it before. It’s very humbling.”

The book is entitled, Gem to Treasure: Of Seashells and Friends, and was released in connection with the annual Sanibel Shell Fair in Sanibel Island, Florida. He attended the fair and signed the new book for his fans.

This is his third book on this subject.

His first book, The Sanibel Kaleidoscope, published in 1997, is a classic of the genre and is very popular in Southwest Florida. It is in its fourth edition. He and his wife split their time between Algona and Sanibel.

Omaha, Nebraska, has earned a Ph.D. in European law from Erasmus University Rotterdam, the Netherlands. He successfully defended his dissertation on October 19, 2007.

His dissertation was titled “Dividing Lines between the European Union and Its Member States -- Assessing the Impact of the Constitutional Treaty.” It was an analysis of the EU Constitution, which would have superseded

Dr. Sieberson and his wife, Carmelicia, at his dissertation ceremony in Rotterdam. He is holding the diploma he received at the conclusion of his defense.
