The Iowa College of Law has existed in some form or another since 1865 but has never had an official history, until now. In this issue, we shine a light on that history through the lens of The History of the Iowa Law School, 1865-2010, a new book edited by Professor and Dean Emeritus N. William Hines. As you look through our story, you’ll notice that in so many ways, the more things change the more things stay the same.

The foundation of an Iowa legal education has always been our outstanding faculty, and last year brought some changes that reinforced what an outstanding faculty we have, and will continue to have. Professor Angela Onwuachi-Willig, now in her sixth year on our faculty, has been named to the Charles (’62) and Marion Kierscht Professorship. Professor Larry Ward officially retired from our faculty, but after one semester away from the classroom, was persuaded to teach a course in the summer session. We welcomed home Professors Carolyn Jones, from her post-deanship administrative leave, and Jonathan Carlson from his service as senior associate to the president, University of Iowa. We also welcomed four new faculty members who are profiled in this issue.

Sadly, we also bid heartbreaking farewells to our beloved friends and colleagues, David Baldus, the Joseph B. Tye Professor of Law, who died on June 13, 2011 and Professor Emeritus Charles Davidson who died on August 31, 2011.

Looking back in our history, students have always been the lifeblood of the institution and last year, our students continued to excel in and outside the classroom, studying and debating cutting-edge legal issues. They wrote award-winning papers, and showcased their advocacy skills at Supreme Court Day and in interschool moot court competitions. They looked at the re-regulation of American business and industry and the reform of the nation’s health care payment system. The students on the Journal of Transnational and Contemporary Problems took a look back at terrorism in the years since 9/11, and an Iowa Law Review symposium considered the future of legal education.

It was this symposium that showed us that we are at another crucial moment in the history of the Iowa College of Law, and legal education in general. Nationally, this past year has brought highly publicized challenges to the legal profession and criticisms of legal education. The Class of 2011 faces a job market that bears more than passing similarity to that confronted by the students of Dean Eugene Gilmore in the Great Depression. But the College of Law has made several changes with the intention of helping our students become even more competitive.

As first- and second-year summer associate positions declined, we expanded our externship program and relied on our clinics and innovative Citizen Lawyer Program to create opportunities for students to gain practical experience. The Career Services Office has expanded the services it provides to students and graduates. And, while state support has declined and the costs of a first-rate legal education have increased, we continue to provide substantial scholarship support to help our students manage their debt burden. But, as this first volume of The History of the Iowa Law School makes clear, we have endured difficult times in the past and thrived, and with the commitment of our extraordinary faculty and staff and your help, the Iowa College of Law will have a strong and promising future.

Intellectual Property: Where Creativity and Law Meet

Think all the great ideas are taken? Think again.

According to the agencies’ websites, the US Patent and Trademark office received more than 500,000 patent applications in 2010, nearly 400,000 trademark applications in fiscal year (FY) 2010, and the US Copyright Office received more than 350,000 registration requests in FY 2009.

While not all of these applications are successful, the statistics show that each year thousands of useful inventions are created, remarkable books and movies are written and filmed, and brilliant works of art are conceived. Of the applications that are successful, these are protected by intellectual property (IP) law.

“I love intellectual property law’s subject matter—art, music, and movies—these copyrighted works support a free culture and freedom of speech. They shape people and how they think about the world,” explains Christina Bohannan, Professor, University of Iowa College of Law. Bohannan’s interest in IP law began while she was attending law school at the University of Florida. There, she had a great law professor who really stimulated her interest in the subject.

At the University of Iowa she is one of nine professors who are part of the Innovation, Business, and Law Center.

The Center offers a diverse perspective for students by bringing a group of interdisciplinary faculty together who teach and study problems of business, technology, innovation, regulation, and legal policy.

Bohannan also shares her enthusiasm for IP law by teaching an Intellectual Property Advocacy Tutorial course, which offers students more hands-on projects.

“Students enrolled in the tutorial learn IP advocacy by preparing to participate in moot court competitions in the areas of patent, trademark, and copyright law,” says Bohannan. “Discussing the issues surrounding these areas, writing briefs, and practicing oral argument for competition are the cornerstones of the course. It’s wonderful to work more closely with the students. I like that it’s one-on-one.”

The tutorial completely prepares the College’s moot court teams for competition by enlisting the help of lawyers from many Iowa firms. It gives students the opportunity to tackle the challenges of developing succinct oral arguments, polishing their delivery, and it increases their knowledge of IP law by honing in on issues like infringement.

The College’s students have had incredible success at moot court competitions. In February, two teams represented the

UI College of Law at the Saul Lefkowitz Trademark Moot Court competition in Chicago. One of the teams received the top award for Best Oral Argument, besting 25 other teams.

Damon Andrews (’11), a member of the trademark moot court team who won Best Oral Argument, feels the moot court program provides real-life courtroom experience. “It’s given me the opportunity to understand how to advocate for a client through brief writing and oral argument that I did not think was possible while still in law school. Professor Bohannan has been instrumental in developing a curriculum that engages and challenges students, while fostering a collaborative working environment for IP-savvy students and those who have a curiosity about the world of intellectual property alike,” says Andrews.

The College also sent teams to the Giles Sutherland Rich Patent Law competition in Chicago and the BMI/Cardozo Copyright Moot Court competition in New York. The copyright team placed third for Best Brief.

This summer, two of the IBL Center’s students completed externships, Mattie Clay (’13) for the United States Patent and Trademark Office in Alexandria, Virginia, and Joseph Fraioli (’13) for the World Health Organization in Geneva, Switzerland.

“Through the panels, classes, and mentorship offered through IBL, I’ve acquired a strong foundation of knowledge

about all areas of intellectual property and how they work to protect inventors and creators. I feel this will give me an advantage over externs who come in with limited, uni-layered knowledge of patents alone,” said Clay. “The IBL program grounded my plans for a career in intellectual property by providing step-by-step support to achieve my goals.”

Fraioli feels the program has broadened his future career interests. “I am very thankful for the IBL program’s support for my externship this summer. The program’s interdisciplinary approach to law encourages students to explore legal opportunities outside of the typical firm or government experience, such as policy and legislation.”

Some students also have attended the Iowa Intellectual Property Law Association annual meeting giving them an opportunity to learn about the latest in IP law practice and meet alumni from the College.

Bohannan also led a project with the University of Iowa Art Museum and the Office of General Counsel focused on researching the copyright status of a number of the Museum’s pieces. Six of her research assistants worked on the project.

Phillip Goter (’11) who was a part of the project explains.

“We researched and cataloged the copyright ownership status of the Museum’s most famous works, including Pollock, Picasso, and Hartley. This has been a very challenging and rewarding experience as it involves research into foreign copyright law, two different United States Copyright Acts, and several international treaties.”

The many different areas of study of IP law has Bohannan continuously researching and keeping tabs on current issues in the field. She states that one of the most prominent issues today is the overbreadth of protection in IP law.

“It’s gotten to a point where the amount of protection for art, music, etc., is much broader in scope than it needs to be,” said Bohannan. “This overprotection can hurt free speech, cultural development, and individual liberties.”

“Often when patents are granted for a specific invention it can impede the development of future products. Patents contain broad and abstract claims covering technology in one industry, and developers in other industries have no notice that the patent applies to them. They can be caught unaware by infringement claims,” she explains.

She is co-authoring a book with Herbert Hovenkamp, Professor and Ben and Dorothy Willie Chair of the University of Iowa College of Law, entitled, Creation Without Restraint: Promoting Liberty and Rivalry in Innovation, that addresses the need to develop a theory of harm in copyright and patent law.

Hovenkamp also teaches IP courses.

IP law continues to grow and has increased in its complexity. Some of the other areas seeing a high-level of activity are patent applications for information and health technology, the

The College is increasing the number of faculty members who focus on the study of IP law. In July, Jason Rantanen joined the College from the University of California, Hastings College of Law as an associate professor (see Rantanen’s bio on page 42). Recently, he has published articles on federal circuit cases and is a contributing author to Patently-O Patent Blog (http://www.patentlyo.com), a primary source for current patent law news and information. His scholarship focuses on the legal system and technological innovation.

publishes its first history book

The UI College of Law has existed at least in theory since before Iowa was even a state. In its 1845 legislation creating the University of Iowa, the territorial legislature said the institution should also include a law school at some point.

No complete history of the law school’s first 140-plus years has been undertaken, though, until now. The book, The History of the Iowa Law School: 1865-2010, is a detailed academic history of the school dating back to its earliest days.

“The Iowa law school has had a long history during which a talented faculty and a challenging curriculum produced outstanding lawyers and leaders for the state of Iowa and around the country.

We want to tell those stories about the law school that are both informative and inspirational,” said N. William Hines, law professor and dean emeritus who edited the book and wrote one third of the chapters.

Though imagined in 1845, the University didn’t actually have a law school until 1868, when it absorbed the independent Iowa Law School that had been operating in Des Moines for three years. Originally a one-year undergraduate program (as all law schools were at the time), it became a two-year program in 1884 and a three-year graduate-level program in 1901.

From its earliest days, the law school played a significant role in the life of the university, the state and the nation.

Mary Beth Hickey became the first woman law graduate west of the Mississippi when she received her Iowa law degree in 1873. The school graduated UI’s first African-American student in 1879, when Alexander Clark, Jr. received his

Iowa law degree and became the second African–American to graduate from a public law school in the U.S. The Iowa law school produced many UI leaders, faculty-turned-presidents, Eugene Gilmore, and Willard “Sandy” Boyd, and law alumnus president Virgil Hancher. It was also led by such legendary deans as William G. Hammond, Emlin McClain, Henry Craig Jones, Mason Ladd, and Wiley Rutledge, who went on to become an associate justice of the United States Supreme Court.

“The law school has always played an outsized role in university leadership.

It is unusual for a law school to have that kind of an influence on a university campus for so many years,” said Hines.

The history project was begun by law professor Alan Widiss in 1995, who shepherded it until his death in 2001.

Hines took over the project from there and brought it to completion. The book’s 15 chapters are divided chronologically and by program, with different authors writing different sections.

Among its authors are law professors Hines, Boyd, Randall Bezanson and the late Sam Fahr. Clinical Professor Emeritus Patricia Acton and her husband, the late Richard, Lord Acton, an historian and member of the British House of Lords, wrote about the school’s first 75 years. John Ferren, a judge and Rutledge biographer, wrote about the law school under Rutledge’s deanship.

Two chapters are written by law school administrators, and two chapters are based on seminar papers written by the authors when they were law students.

“It’s an eclectic group of writers who bring unique perspectives to their work,” Hines said. “The diversity of the chapter authors says a lot about what is special about the institution.”

He said one theme throughout the book is the law school’s consistent reputation as a national leader in legal education, which goes back well into the nineteenth century, as well as its insistence on doing things the “Iowa way.”

“The Iowa law school has always been very conscious about being true to our Iowa heritage,” he said. “We are always well informed about what other schools are doing, and about current educational fads. But we’ve always had this firm belief that we know how to provide a superior legal education, and don’t need to copy what others are doing, if we think what we are doing works better for our students.”

Board of Directors, confirming his daughter’s right to attend public school in Muscatine.

new building is a tribute to the persistence of Dean Gregory who lobbied for it for nine years. When the new building opened there were 245 students, 5 faculty members (including new Professor Percy Bordwell), and the law library held 10,000 volumes.

who is Iowa’s most prominent law faculty member in the first half of the twentieth century. Gilmore was a leading figure in the “Wisconsin Idea,” an innovative form of jurisprudence based on social realism.

GILMORE,

Rutledge is nevertheless a respected and, for many, a beloved constitutional law teacher and dean. In 1937 Rutledge authored a national report recommending government sponsored legal assistance for indigent persons, anticipating JFK’s Legal Services Program by 25 years. He also championed the Roosevelt “CourtPacking” plan. Rutledge left Iowa in 1939 to become law dean at Wash. U., and later was a US Circuit Judge before he was appointed to the US Supreme Court in 1943.

1930 – 1935 – DEAN GILMORE PRESIDES GREAT DEPRESSION. As still happens, the demand for graduate and professional education actually rises during economic hard times. The law school enrollment at Iowa rose to 250 students, but supporting resources declined dramatically.

Not only were there no funds to hire more faculty members, but salaries of the existing faculty were regularly cut, as much as 30 percent.

1941 – 1945 – STUDENT ENROLLMENT

1939 – THE LEGENDARY MASON LADD WAS NAMED DEAN, and began a 27-year tenure, which was interrupted for five years by his public service in Washington DC during World War II. At the time Ladd became Dean the enrollment stood at 272, there were nine faculty members, and the law library held 52,000 volumes. Ladd was clearly the most nationally prominent member of the Iowa faculty during the middle of the twentieth century, serving on many national commissions, authoring books on Evidence, and becoming the primary drafter of the original Federal Rules of Evidence.

Nearly 500 students were enrolled in 1947 and the school adopted special acceleration programs to move the bulge through as quickly as possible.

By 1950, enrollments had stabilized at around 400 and the school had adopted a sevensemester program requirement that meant most students had to attend two summer sessions to graduate. This student boom created an opportunity to replenish and expand the law faculty with Professors Vestal, Levin, Fahr, Davidson, and O’Byrne.

1952 – THE IOWA LAW SCHOOL FOUNDATION WAS ESTABLISHED BY MEMBERS OF THE CLASS OF 1952,

with initial assets of roughly $1,000.

1953 – AGRICULTURAL LAW CENTER ESTABLISHED. The Center was to last for 20 years and attract national and international attention to Iowa for its research publications and overseas programs.

1961 – THE NEW BUILDING, CALLED THE LAW CENTER, IS OPENED AND DEDICATED by Chief Justice Earl Warren. Dean Ladd waged a long campaign to secure better housing for the law college, but a totally new building was precluded by a shortage of capital funding. The college’s new home was created by attaching a major library and classroom addition to the Law Commons.

Although relatively spacious at first, it soon filled up with students, faculty, and books.

1964 – SELECTIVE ADMISSION STARTED.

New admission rules required a minimum 2.3 GPA and completion of the LSAT. 1964 – WILLARD L. BOYD IS APPOINTED UNIVERSITY’S FIRST VICE PRESIDENT FOR ACADEMIC AFFAIRS.

Boyd was thought by many to be Ladd’s likely successor as law dean. Instead, Boyd began an administrative odyssey that included five years as vice president under President Howard Bowen, 12 years as UI president, followed by 15 years as president of the Field Museum in Chicago. Boyd returned to the law faculty in 1996.

1966 – MASON LADD RETIRES TO FSU, AND DAVID H. VERNON BECOMES DEAN. Ladd left Iowa to become the founding dean of a new law school at Florida State University. Vernon stirred things up at Iowa. He stimulated the faculty to make major reforms in the curriculum, some of them lasting (The first-year Small Section Program and a more “grad school” style of legal education), and some of them not (Conflict Resolution and International Law in the first year). He doubled the faculty

size from 14 to 28, invested heavily in the law library and in student recruitment, began placing greater attention on attracting private support, but somehow he managed to alienate a substantial segment of the Iowa bar. When Vernon became dean the student enrollment was 500, and the library contained 200,000 volumes.

1967 – FIRST-YEAR SMALL SECTION PROGRAM STARTED. At the time, only Iowa and Yale offered first-year classes in small sections. Over the years many law schools followed suit, although not all followed Iowa’s lead in committing full-time faculty to the instruction in basic skills in analysis, research, and legal writing.

1967 – IOWA BEGINS AGGRESSIVE RECRUITMENT OF STUDENTS AND FACULTY WHO WILL BRING GREATER DIVERSITY TO THE LAW SCHOOL. This early commitment to the positive educational benefits of a diverse law school community continued

unabated throughout the next four decades.

1969 – WILLARD L. (SANDY) BOYD IS NAMED UI PRESIDENT,

a position he would hold for 12 years during a critical era of growth for both the University and the College of Law.

1971 – DEAN VERNON RESIGNS AND IS REPLACED BY DEAN LAWRENCE E. BLADES. Blades came to Iowa from the deanship at the University of Kansas School of Law. Blades’s five years as dean saw almost as many changes as the preceding five years. Some of the changes were counter reforms, but many represented new directions, such as invigorating the Moot Court program, expanding the size of the student body, placing heavier emphasis on CLE and getting serious about private fundraising. The ILSF endowment stood at $170,000 when Blades took office. When he left it was more than $1 million thanks to the Second Century Campaign that he engineered.

Blades also made great strides in regaining the loyalty and support of Iowa law grads and the Iowa bar generally.

1972 – THE SUMMER ENTRANT – ACCELLERATED PROGRAM IS BEGUN, as a mechanism to increase the student body by starting 45 students in May, many of whom to graduate in 27 months by attending law school straight through. This change raised the expected entering class from 180 to 225 students, and the total student body to 650.

1973 – PROFESSOR JOSEPHINE GITTLER IS APPOINTED,

making her the first woman law professor at the Iowa Law School.

1974 – PROFESSOR BARRY MATSUMOTO IS APPOINTED,

making him (an Asian-American) the first minority law professor at the Iowa Law School.

1975 – THE JOURNAL OF CORPORATION

as the law school’s second student-edited law journal. Professor David Bayne was the moving force behind the creation of the JCL, but soon withdrew his support over a dispute about the student board of editors’ editorial freedom.

(Over the years he had hired a total of 65 faculty), the student body remained stable at 650, the law library collection exceeded one million and ranked second in the nation, behind only Harvard, and the ILSF endowment stood at $66 million, thanks largely to a highly successful “Twenty-First Century” capital campaign ending in 2003 that raised more than $35 million.

Iowa law graduate, Thomas Waterman joins Iowa Supreme Court Newly-appointed Iowa Supreme Court Justice Thomas D. Waterman (’84) is a fourth-generation Iowa lawyer.

He caught his father’s contagious enthusiasm for practicing law as a child hanging out at his father’s law practice.

Never really considering another career, Waterman completed his bachelor’s degree at Dartmouth College and then enrolled at the University of Iowa College of Law to pursue a career as an attorney.

After graduation, he joined the family law firm, Lane & Waterman LLP, in Davenport, Iowa. For the past 27 years, he’s represented businesses and individuals in class-action lawsuits, product liability, wrongful death and catastrophic injury cases, and insurance coverage disputes.

In February 2011, he was appointed to the Iowa Supreme Court by Iowa Governor Terry Branstad. His initial term of office is one year, however, Iowans will see Waterman on the November 2012 ballot for election to a term of eight years.

“I feel my appointment has rebalanced the court. Before my appointment, there wasn’t a justice from the east side of the state. Right now, I divide my time between Davenport and Des Moines. I believe it helps to have a justice go back and reconnect with what’s going on locally,” said Waterman. Currently he is the only University of Iowa College of Law graduate on the Court.

Though it’s been tough to leave his clients and partners, he’s received continuous support from both the Des Moines and Davenport communities, enabling him to make a rapid transition.

“The other six justices are great people. I’m finding my new position to be quite interesting. Many of the cases are criminal cases, which I haven’t handled before, so I’ve received a crash course in criminal law,” said Waterman.

Waterman selected Timothy Hasken (’10) as his law clerk for the initial year of his appointment. Hasken was previously law clerk to Iowa Supreme Court Justice David Baker, whose term expired in December 2010.

As Waterman’s law clerk, Hasken spends the majority of his time analyzing records, examining legal briefs, performing legal research, and thinking through all sides of complex issues.

“As a young lawyer, it has been a fantastic educational experience serving as a law clerk with the Iowa Supreme Court.

Working closely with Justice Waterman allows me to learn from his experience, and his guidance really benefits my legal reasoning and writing skills,” explained Hasken.

Just as Waterman is a mentor to Hasken, he credits the UI College of Law’s Arthur Bonfield, the Allan D. Vestal Chair and Associate Dean for Research, for coaching him to his success. Waterman fondly recalls Socratic dialogue with Professor Bonfield while a student at Iowa.

“Some of the other things that I remember most are the camaraderie of my classmates, teaching introduction to law to undergraduate students, and law night at the Airliner.”

While in private practice, Waterman enjoyed the challenges of extreme sport competitions. He’s completed seven Ironman triathlons, and several ultramarathons, including the grueling Leadville Trail 100-mile run in Colorado.

“I find training for a competition is a stress reliever. I’m more productive when I have training runs to clear my head and think through the challenges I’m confronting,” he said.

“One thing I’ve learned from competing in these races is that you can accomplish more than you think if you set realistic goals and have support from family and friends. That very same theory can be applied to your professional life too.”

You will be charged to protect the liberties and rights we prize and to pursue justice.

Even in my short time here, I have come to know how well prepared you are for this great privilege—this awesome responsibility. Jennifer Wang (’11) was presented with the 2011 Philip G. Hubbard Human Rights Award in May. The award is presented by the UI Human Rights Committee to a student who has made the most outstanding contribution to the advancement of human rights. It is named after the University of Iowa’s first tenured African-American professor, a member of the first Human Rights Committee and former vice president for UI Student Services. Throughout Wang’s time at the UI, she showed a passion and commitment to securing and maintaining human rights. She was active in numerous human rights-related organizations, including serving as president of Law Students for Reproductive Justice, an advisory board member of the Women’s Resource and Action Center (WRAC), and a member of the UI Council on the Status of Women. She has made significant contributions to the law school’s efforts to strengthen its commitment to diversity, and was selected as the Iowa Student Bar Association’s Diversity Chair. She completed several internships, including one with the Iowa City Human Rights Commission.

Sir Geoffrey Palmer delivers Levitt Lecture at College of Law Former New Zealand prime minster and University of Iowa law professor Sir Geoffrey Palmer discussed the difficult process of legal reform when he delivered the Levitt Lecture at the UI College of Law in March.

Palmer discussed his experiences as president of New Zealand’s Law Reform Commission, a term of which he completed recently, and offered a comparative look at how other law reform agencies operate around the English-speaking world.

Palmer also chairs a United Nations inquiry investigating a fatal Israeli raid on a Turkish aid flotilla headed for Gaza in May 2010.

Palmer was a UI law faculty member from 1969 to 1974 and has returned to teach frequently since then. He was prime minister of New Zealand from 1989 to 1990.

In January 2011, Guest Lecturer Chancellor Dennis J. Shields (’82) from University of Wisconsin-Platteville delivered the Martin Luther King, Jr., Human Rights Week keynote address entitled, “A Personal Journey: The past as prologue to the shifting dynamics and challenges of diversity in higher education – the University of Iowa College of Law and beyond.”

Chancellor Shields returned to the College of Law to describe how his experiences here helped shaped his career, including many observations about the challenges that confront higher education as it strives to create a vibrantly diverse environment for students, faculty, and staff. The following is an excerpt from his speech.

“The single most effective way for our colleges and universities to contribute in positive ways to civil discourse is to teach our students how to disagree passionately but not be disagreeable in the process. If we fail to instill this fundamental lesson in our students, then we will have failed our nation. A framework of discussion and debate produces understanding and compromise in a diverse and pluralistic society.

I believe in Dr. King’s dream. And because of what has been given me, I have an optimistic belief in a better tomorrow. I know there is work to be done, but I also believe we can do better … I have a fundamental faith in our better Angels, but I know we must fend off that part of our human nature which seeks to impede our progress …”

Len Sandler, clinical professor of law in the University of Iowa College of Law, was named the school’s chief diversity officer.

In his role, Sandler will enhance the diversity efforts within the law school and coordinate with UI campus leaders to support the University’s diversity goals. He will also establish an Advisory Council on Diversity (see sidebar) for the law school to include alumni, students, staff, and faculty.

Sandler represents individuals and organizations and advises lawmakers, companies, and community organizations about issues related to diversity and improving access for disabled persons. His work has led to the development of reforms and legislative initiatives that increase mainstream housing opportunities for persons with disabilities and promote universal design and sustainable housing of all types.

He also recently oversaw the development of the law school’s mission statement on diversity.

College of Law N e w s Agriprocessors interpreter speaks at Journal of Gender, Race, and Justice symposium A court interpreter who has spoken out against the legal proceedings against Latino workers arrested during the Agriprocessors raid in Postville, Iowa three years ago spoke at the Journal of Gender, Race, and Justice symposium at the UI College of Law this spring.

Erik Camayd-Freixas, professor of Hispanic studies at Florida International University, discussed “The Wars on Terror and Illegal Immigration.”

Camayd-Freixa’s lecture was the keynote address at the law school’s symposium “War On….the Fallout of Declaring War on Social Issues,” which was held in March 2011 in the Boyd Law Building. The symposium looked at whether fighting wars against poverty, drugs, crime, and other social issues is the best way to solve them.

Camayd-Freixas worked as an interpreter for workers who were charged with various immigration crimes following the raids. After the trials, he publicly criticized the government for the rapid pace of the proceedings and the pressure put on defendants and their lawyers in cases where the defendants often didn’t understand legal procedures or the charges against them.

Iowa Law Review symposium looks at the future of legal education A story in the New York Times recently asked if law school was a “losing game.” Given the shaky economy and an even more troubled job outlook in the legal profession, are student loans no longer a value?

The University of Iowa College of Law examined that question during a two-day symposium, hosted by the Iowa Law Review, about the future of law schools. “The Future of Legal Education” was held in February.

Participants included scholars and law deans, as well as practitioners and judges, who discussed what sorts of changes they would like to see in law school curriculum and methods.

Speakers included such prominent law school deans as Erwin Chemerinsky of University of California-Irvine, who recently built the law school from scratch, and Kent D. Syverud of Washington University in St. Louis.

Discussion topics included the economic viability of a law degree, re-creating the ideal law school, the perspective from the bench of law schools, and whether law schools or employers are more responsible for preparing lawyers.

Transnational Law and Contemporary Problems Human rights expert speaks at TLCP Symposium Richard Falk, special rapporteur for the United Nations on Palestinian Human Rights, spoke at the University of Iowa this spring.

The University Lecture Committee in conjunction with the Transnational Law and Contemporary Problems journal of the UI College of Law sponsored his lecture, “Countering Terrorism and Achieving Justice in the 21st Century.”

Falk is Albert G. Milbank Professor Emeritus of International Law at Princeton University and Visiting Distinguished Professor in Global and International Studies at the University of California, Santa Barbara.

His most recent book, The Great Terror War (2003), considers the American response to the September 11, 2001 terrorist attacks, including its relationship to the patriotic duties of American citizens. He is the author and coauthor of numerous books, including Religion and Humane Global Governance, Human Rights Horizons, On Humane Governance: Toward a New Global Politics, and Explorations at the Edge of Time.

Transnational Law and Contemporary Problems journal celebrated twentieth anniversary Transnational Law and Contemporary Problems (TLCP), a multidisciplinary academic journal published by the University of Iowa College of Law, marked its twentieth anniversary with a celebration this year.

Peer Zumbansen, a law professor at York University in Toronto, Canada, presented “The Parameters of Transnational Law: Global Governance and Legal Theory.” Opening remarks were made by Gail Agrawal, dean of the UI College of Law, and David Alberts, the first editor-in-chief of the journal and a partner at Mayer Brown in New York, N.Y. TLCP is a student-edited journal that publishes three issues per year. It addresses issues and problems that transcend national political boundaries, presenting to the international and comparative law communities matters not commonly found in other journals.

Journal of Corporation Law symposium examined reregulation of American economy JCL discussed how businesses have been re-regulated in the last two years at a symposium this past February.

“Re-regulation & The Business Firm” examined how 30 years of government deregulation of the economy came to an end with the 2008 financial collapse, and its transition to the new period of re-regulation.

Speakers examined how re-regulation has affected three major sectors of the economy: health care, telecommunications, and financial institutions.

The symposium papers were recently published in the law school’s Journal of Corporation Law in July 2011.

Professor VanderVelde studies lawsuits that paved road to Civil War The Civil War started more than 150 years ago, and a University of Iowa law professor has worked to bring back many of the voices of the slaves the war later freed.

Lea VanderVelde researches freedom suits, legal actions largely lost to history that were brought by slaves against their masters in hopes of gaining their freedom. She has visited dozens of county court houses throughout the Midwest during the last decade looking for records of the suits that were filed between the 1830s and 1858.

VanderVelde said the suits show that slaves attempted to use the courts to legally escape slavery to an extent people never knew before. “Our conception is that slaves either suffered or tried to escape,” she said. “What we never knew was how many sought their freedom in court, and how many received it.

When you read these lawsuits, you hear the voices of people rising up against enslavement in a way that’s not heard

by Americans today.”

She said slaves who sued for their freedom generally argued that either they always were free and were being enslaved illegally, their master had died and they had been promised freedom upon his death, they attempted to buy their freedom but their master reneged on the deal, or they had visited a free state, which meant they were now free.

The most famous of these suits was brought by Dred Scott, a St. Louis slave who accompanied his master on trips to Illinois and parts of Wisconsin Territory that are today Minnesota. Since Illinois and Wisconsin Territory were free, Scott

argued that he was no longer a slave, even after his return to slave territory.

The suit and its appeals led to the infamous 1858 Supreme Court decision that denied Scott and all blacks the rights of citizenship, prohibited the federal government from banning slavery, and set the stage for the Civil War. The Dred Scott Decision also said that blacks don’t have access to the court system to seek their freedom, thus shutting off all future freedom suits. Before it, though, thousands of slaves filed suit in state and territorial courts to win their freedom.

VanderVelde’s research has taken her to courthouses across the Midwest, looking in dusty basements for papers that haven’t been touched since the 1850s.

Her biggest cache was discovered at the courthouse in St. Louis where she discovered about 190 freedom suit files in 2002 (about 250 suits were filed in the state). Stored for more than a century in the courthouse’s gritty, cobwebbed basement, the papers she discovered were yellowed and crumbling, some so badly they were sent to a specialist for preservation. Since the typewriter had not yet been invented, the motions, depositions, jury instructions, and verdicts are all handwritten, often in an illegible scrawl.

In the process of her research, VanderVelde has brought back many of the voices of the slaves the war was fought to free. Marie, in her suit, says

“What we never knew was how many [slaves] sought their freedom in court, and how many received it. When you read these lawsuits, you hear the voices of people rising up against enslavement in a way that’s not heard by Americans today.” she was “assaulted, beaten, bruised, illtreated and faces imprisonment.” John Singleton, born a free man in Illinois, was kidnapped as a teenager and sold into slavery in the South. Leman Dutton was born of a free woman, making her free, too, but her mother’s former owner refused to grant the child freedom and kept her as a slave.

There was Hannah, who says she was “treated with great cruelty and oppression by John Pitcher,” her owner, after she had the temerity to sue Pitcher for her freedom. James Wilkinson was not only enslaved but a victim of fraud after his owner, Aaron Young, reneged on an agreement to let Wilkinson buy his freedom for $200. Four years after the last payment was made, Young still had not freed Wilkinson.

Professor Bezanson looks for middle ground in corporate campaign donation decision

Thanks to a Supreme Court ruling earlier last year, the 2010 elections were awash in millions of dollars that came from publicly held corporations previously prohibited from donating money to political campaigns.

But University of Iowa law professor and First Amendment expert Randall Bezanson said the decision in Citizens United v. FEC may be open to later challenges that could restrict corporate spending in election campaigns (though unfortunately, probably not soon enough to prevent Americans from being relentlessly bombarded with still more campaign commercials, robo-calls, and junk mail in 2012).

The Citizens United case was handed down in January 2010 and struck down earlier legal precedents that prevented corporations from donating money to election campaigns. In a 5-4 decision, the Court held that corporations enjoy the same First Amendment protections of freedom of speech as any individual citizen.

In a paper published in the Iowa Law Review, Bezanson acknowledges that Justice Anthony Kennedy’s opinion is “take no prisoners,” boldly attempting to make a broad and definitive statement. In it, Kennedy disposes of the previous idea that corporations could not give money to political campaigns because individual shareholders did not invest in the company with the belief that their money would be used to fund a candidate they may not support.

“There is reason to believe that more remains to be said in the future, about traceability, representativeness, individual freedom of speech and about different levels of First Amendment protection for a corporation’s speech.”

It also tossed out the idea that freedom of speech only applies to speech that can be traced to an individual. This ruled out corporate donations to political campaigns because those donations could not be traced in such a way.

Bezanson said Kennedy’s language in dismissing those notions is definite and attempts to leave no room to maneuver or find middle ground for restricting corporate campaign donations to politicians. But he said the opinion is muddled and poorly argued. Its language and reach are over broad and Kennedy makes disputable assumptions about earlier Court decisions. Plus, he was the only justice who signed on fully to his opinion -— three of the other four justices in the majority wrote concurring or separate opinions, which dilutes the strength of his arguments.

Bezanson said that it’s those opinions, especially one written by Justice Antonin Scalia, that could provide the middle ground Kennedy tried so hard to eliminate. Scalia’s opinion, he said, argues that corporate free speech rights are more limited than the sweeping rights that Kennedy gives them, and is also

built on more solid legal ground.

In Scalia’s view, a corporation does have free speech rights and cannot be denied First Amendment rights simply because it is a corporation, thus joining with Kennedy in overturning previous legal decisions. But he said that at the same time, simply being a corporation does not automatically guarantee it has free speech rights. Bezanson said something more is needed to justify a corporation donating money to a political campaign, and while Scalia does not go into what that something more might be, the opinion leaves room for future Courts to find a middle ground that would limit corporate influence in political campaigns.

“There is reason to believe that more remains to be said in the future, about traceability, representativeness, individual freedom of speech and about different levels of First Amendment protection for a corporation’s speech,” Bezanson said.

“I hope so, anyway.”

Law professor Reitz helps guide Nepal to new constitution “I was very encouraged by the process and by their reaction to the ideas we presented.

There’s a high level of involvement by the Nepalese people in this process and good knowledge of international models.”

John Reitz, Edward Carmody Professor of Law and Director of LLM Programs and Visiting Scholars, was part of a 10-member international team of constitutional and comparative legal scholars who provided advice and counsel to negotiators in Nepal who are in the final stages of drafting a new constitution for their country.

Reitz participated in the Conference on the Emerging New Constitution of Nepal in May 2011 in Kathmandu. The panel, which included scholars from the United States, Australia, India, Spain and South Africa, heard papers and presentations by the Nepalese about their ideas on what should be in the constitution and the issues they face.

He said the Nepalese were eager to hear an outside perspective and analysis of the issues, and for the panel’s advice.

“I was very encouraged by the process and by their reaction to the ideas we presented,” said Reitz. “There’s a high level of involvement by the Nepalese people in this process and good knowledge of international models.”

The Nepalese have been negotiating a new constitution since 2008 as part of the peace process meant to end a brutal insurrection by a Maoist political faction. The first product of that process was to unify the political forces in the country, leading to the deposition of the previous constitutional monarchy and abdication of the royal family.

Reitz said one significant challenge negotiators face in writing a new constitution is Nepal’s immense ethnic diversity.

“It’s a country of stunning diversity, with more than 60 ethnic and caste groups and up to 100 languages,” Reitz said. “One of the ideas they presented at the conference was that Nepal should

have a federal form of government in order to protect minority ethnic interests.

We tried to tell them that federalism is not a way to protect ethnic minorities.

What you need is strong human rights laws and an independent court system to enforce them.”

One of the other main issues concerns the choice between parliamentary or presidential forms of government.

Nepal had been operating since the late 1950s with a parliamentary government on the British model, but a large number of political parties led to instability and frequent changes of government. Reitz said that this was one of the most contentious issues in the conference, with the Maoists promoting a strong president and the liberal parties preferring to find ways to stabilize the parliamentary system in Nepal.

He said protecting human rights, especially for women, and keeping a president from becoming a dictator were some of the other topics discussed at the conference. Panelists also discussed how the court system should be set up and how to keep it from becoming corrupt.

Reitz thinks the conference made an impact on the constitutional negotiations because several of those who attended were members of the assembly drafting the new constitution.

The group also met with the country’s president, Ram Baran Yadav. While he is only head of state under Nepal’s current interim constitution and not the head of government, Reitz said he was interested in what the international team had to say and provided thoughtful feedback.

Clinic helps organizations comply with Americans with Disabilities Act The Americans with Disabilities Act was signed into law 20 years ago, and the University of Iowa College of Law has helped dozens of Iowa businesses, organizations, and government agencies comply with the law that mandates the elimination of discrimination against persons with disabilities.

“The ADA has expanded opportunities in the Hawkeye State and across the country by reducing barriers, changing perceptions, and promoting full participation in every aspect of community life,” said Leonard Sandler, clinical professor in the law school’s legal clinic. He said the clinical law program has partnered with grassroots community organizations, government officials and other groups and individuals to help fulfill the promise of the ADA and other non-discrimination laws.

Projects the law school has completed in the 20 years since the law was passed include: n Numerous local businesses and organizations worked with the clinic to make their facilities more accessible to persons with disabilities. Organizations include Coral Ridge Mall, New Pioneer Co-op, Herbert Hoover National Historic Site, Cedar Rapids Kernels, and Coe College. n Trails and facilities in Iowa City’s Hickory Hill Park have been made accessible. n Countdown timers have been installed on traffic signals for

pedestrian awareness and safety in downtown Iowa City.

Local banks have installed “talking ATMs” for people with vision or reading impairments. n Insurers and schools provide children and adults with assistive technology equipment for use at school, work, and home with the clinic’s AT Legal Project help. n Cedar Rapids has improved its paratransit and transportation policies in response to mystery rider surveys and input from Peer Action Disability Support. n The Iowa Assistive Devices Warranty Act, a kind of lemon law, was passed by the Iowa legislature to protect consumers with disabilities who use special equipment. n Johnson County SEATS revised its policies and handbook to better serve people with disabilities and other riders. n Iowa incorporates most of the ADA Accessibility Guidelines standards into the state accessibility code to eliminate confusion and ensure access. n The first Universal Design Model Home in the state was built in Iowa City with clinic and community participation in all project phases. n Iowa City adopts the state’s first universal design ordinance with clinic assistance. n

The University of Iowa College of Law’s Legal Clinic has put to good use the lessons it has learned helping homebuilders, developers, local governments, and nonprofits design and evaluate the benefits of sustainable homes and apartments.

The clinic has developed a universal design and green home checklist and survey and handbook for people who

are interested in designing or remodeling a home that is environmentally friendly and accessible to all people.

The checklist recommends options and specifications for all parts of the house. It also makes suggestions for the kinds of small details that a developer might not otherwise think of, like motion sensor lights, no-step entrances, covered entryways, backlit doorbells, and higher

and deeper toe kicks so it’s easier for residents and guests to maneuver in kitchens and bathrooms.

The checklist also identifies suggestions to make the house more environmentally friendly.

Program in Law and History Interdisciplinary initiative ready for second successful year The University of Iowa has a proud tradition of scholarship and teaching in the field of legal history. Among the many legal historians who have taught at the UI are Professors Percy Bordwell (d. 1970), Donald Sutherland (d. 1986), and Henry Horwitz (emeritus 2004).

Building on this tradition, the UI College of Law founded the Program in Law and History in 2010, in order to bring together faculty and students to foster research and teaching at the intersection of law and history.

Five faculty with sustained scholarship in legal history are at the center of the Program. They are: Thomas P. Gallanis, the N. William Hines Chair in Law; Herbert Hovenkamp, the Ben and Dorothy Willie Chair in Law; Carolyn Jones, Dean Emerita and the F. Wendell Miller Professor of Law; Linda Kerber, the May Brodbeck Professor in Liberal Arts and Sciences; and Lea VanderVelde, the Josephine Witte Chair in Law. Gallanis and Hovenkamp have secondary appointments in the Department of History, and Kerber has a secondary appointment in the College of Law. The Program sponsors a series of Legal History Workshops, designed to promote the discussion of scholarship in progress. Each workshop

features a legal historian from Iowa or another university.

The draft of his or her work is circulated in advance, with constructive criticism encouraged. In 2010-11, the workshops featured the work in progress of Alison LaCroix of the University of Chicago; Ahmed Souaiaia of the University of Iowa; Linda Kerber of the University of Iowa; and Amalia Kessler of Stanford University.

The Program also sponsors an annual lecture, the Donald W. Sutherland Memorial Lecture in Legal History. Sutherland taught at Iowa his entire career and was one of the pre-eminent historians of medieval English law.

He was a Rhodes Scholar at Oxford University, where he earned his doctorate in medieval history. He joined the UI Department of History in 1958, becoming full professor in 1967. In 1985, he was appointed Carver Professor of History and Law. Sutherland died unexpectedly of a heart attack in 1986. The annual Sutherland Lecture honors his memory by providing a major public address by an accomplished legal historian, either from the University of Iowa or another university.

In 2011, the Sutherland Lecture was delivered by Thomas Gallanis of the University of Iowa on the topic “The Evolution of the Common Law.” The lecture

was broadcast on the University of Iowa’s cable television station and can be viewed on the Internet at http://podcast. uiowa.edu/law/Sutherland/ Sutherland_Lecture.mp4 The Program is ready to embark on its second successful year. In 2011-12, workshops will feature the work in progress of Richard Helmholz of the University of Chicago; Emily Kadens of the University of Texas; Kristen Stilt of Northwestern University; and William Novak of the University of Michigan. The 2012 Sutherland Lecture will be delivered by one of England’s leading historians: Linda Colley, the Shelby M.C. Davis 1958 Professor of History at Princeton University. She is a Fellow of the British Academy and has been awarded the Wolfson Prize for History. She will deliver the lecture on October 5, 2012, on the topic of Britain and international constitution-making.

The lecture is open to the public. Alumni and friends of the College of Law are warmly encouraged to attend.

Students see success at trial competitions The University of Iowa College of Law had a very successful season of trial advocacy competitions. This year, the College sent students to two separate programs: the Texas Young Lawyers/ American College of Trial Lawyers National Trial Competition and the American Association for Justice (plaintiff trial lawyers) Student Trial Advocacy Competition (STAC). The students were chosen to compete based on their performance in the Advanced Trial Advocacy class and the annual Stephenson Trial Advocacy Competition.

Coached by John Whiston, Herschel G. Langdon Clinical Professor of Law, six students, in two sub-teams, participated in the NTC regional competition in St. Louis in February. They were Hayley Jones (’11), Benjamin Carter (’11), Holly Stott (’11), Thomas Williams (’11), Amy Locher (’11), and Brett Powers (’12). Both went 1-1 in the preliminary rounds but did not

advance to the semi-finals. The Jones/ Stott/Williams team lost a very close 2-1 decision to Hamline, one of the ultimate co-champions. The written feedback from the judges was overwhelmingly positive, “Careful, detailed questioning.”

“Thorough review of evidence.” “Excellent skills.”

Four students participated in the STAC regional competition in Kansas City this spring. They were John Lande (’11), Meghan Corbin (’11), Tyler Buller (’12), and Van Everett (’12) (pictured above). Their coaches were Mark Zaiger (’79, Shuttleworth & Ingersoll) and Megan Dimitt (’10, Lederer Weston Craig) with some assistance from Gail Brashers-Krug. The team went 2-1 in the preliminary rounds, beating Wisconsin which had two members return from their National Championship team last year. The College’s team advanced to the semi-finals where they beat Creighton and then to the finals where they

beat Kentucky. Having won the region, they were one of 14 teams competing in the national finals in Las Vegas.

In Las Vegas, Iowa faced Pepperdine, Campbell University, and University of Colorado in the three first rounds. They met Loyola University and Chicago in semi-finals, and lost to Duquesne University in the final round.

The team worked hard to perfect the direct and cross examinations of the expert witnesses, which gave them an advantage over other teams. All of the students did incredibly well.

Like all the students who participate in law school competitions, these 10 students put a huge amount of effort into the undertaking; perhaps an additional 15 hours a week from the start of the semester forward. Their effort is worth it. They show advanced trial skills, hopefully giving them a significant advantage when they begin trying cases.

Law student awarded Peggy Browning Fellowship University of Iowa law student Leslie Barry (’12) has been awarded a Peggy Browning Fellowship to work in the legal department of the Laborers’ International Union of North America this summer in Washington, DC. The Browning Fund supports nearly 60 public interest labor law fellowships nationwide for law students who have demonstrated a commitment to workers’ rights through educational, work, volunteer, and personal experiences.

Barry previously worked as a paralegal at Covington & Burling in Washington, DC, where she assisted on an asylum case and helped represent a prisoner with a life sentence.

Grant to help UI law student study labor law and the booming Chinese economy Nathan Jackson watched the booming Chinese economy up close while working for four years as a business consultant in Shanghai. Now he’s going back to study the law behind that growth, with the help of a prestigious fellowship.

Jackson (’12) will study Chinese labor law and language this fall at Xiamen University in Xiamen, China, as a National Security Education Program David L. Boren Fellow.

The opportunity comes after he worked in China from 2005 to 2009 for a consulting firm, using his business

degree from the UI to help companies with market research, strategy development and acquisitions. The work put him in the middle of China’s economic explosion and the experience of working with dozens of clients and visiting more than 200 factories helped him gain insight into how it was happening.

“I saw some plants that were in bad shape and poorly run, but most were well-managed operations,” said Jackson, a native of Harlan, Iowa.

The experience also gave him a focus for a law career. While he had always planned to attend law school, Jackson wasn’t sure what sort of law he wanted to pursue until his experience in China inspired an interest in the country’s labor and employment laws. With that motivation, he returned to Iowa in 2009 to attend the UI College of Law. His legal courses at Xiamen this fall will focus on the basics of Chinese labor and employment. He said that despite its reputation as a haven for sweatshops, China has labor laws in place that are in many ways more progressive than America’s and provide workers with more protections.

“Enforcement of those laws is the issue,” Jackson said. “The laws don’t have a lot of teeth, and the inspectors are often young and their training is inadequate. That makes it easy for legal violations to occur.

“There’s so much misunderstanding of China in the West,” said Jackson.

“Westerners often view the legal system solely through political lens. That’s true to an extent, but there’s lots of top notch professionals working to create a professional, independent legal system there.”

Although he’s proficient in Mandarin, Jackson will also learn about Chinese legal language and terminology, “which is almost another language in itself.”

The David L. Boren Fellowship, awarded by the Institute of International Education, was created by the former

Oklahoma senator and provides study abroad opportunities for U.S. students to learn the language and culture of countries that will play a crucial role in America’s future national security.

Walker receives EJW fellowship Commercial sexual exploitation of children is a growing problem in the United States, and Kate Walker (’11) is hoping to help its victims.

“There are so many girls from troubled backgrounds being exploited,” said Walker. “I want to use my legal and advocacy skills to secure the girls the services they need to lead safe, healthy, and productive lives.”

After Walker graduated in May she partnered with the National Center for Youth Law in Oakland, Calif., where she works with under-served, sexually exploited girls in Alameda County. The Des Moines native hopes to provide access to mental health care and support services to many of these girls in need.

“On any given night, between 100,000 and 300,000 children are on America’s streets being sold for sex,” Walker said. “Arrests of minors for soliciting nearly tripled from 2008 to 2009.”

Oakland is one of two major hubs for child sexual exploitation in the United States, she said. To reduce the statistics, Walker plans to improve these girls’ lives by using direct legal representation and community collaboration. She will also partner with the juvenile court, the District Attorney’s office, and other

community and legal advocates to initiate a Girls Court in Alameda County, modeled after similar courts in Honolulu and Orange County, California.

Walker said the Girls Court would address the gender specific needs of girls who have been commercially sexually exploited in Alameda County. Right now, she said many girls who are detained on solicitation charges spend a significant amount of time waiting in juvenile hall. The Girls Court, she said, will holistically address each individual girl’s needs, and link her to community-based mental health and other support services she requires.

She hopes to provide individual advocacy on 30 to 40 cases and encourage community advocates to participate. She also plans to recruit legal advocates and train them about these support services in order to secure long-term tools for future care.

Before coming to the UI College of Law Walker attended Pomona College, one of the Claremont Colleges in southern California, where she studied public policy analysis with a focus in psychology. During her three years as a student at the UI, Walker focused her work on children in California’s foster care system.

“I have worked with disadvantaged people, and specifically children, in many capacities,” she said. “In each role I have used law to defend my clients’ rights and gain access to programs and services that promote fairness and justice.”

Walker has worked with several nonprofit legal organizations, including the National Center for Youth Law (NCYL), the Alliance for Children’s Rights, and Neighborhood Legal Services of Los Angeles.

Walker’s plans to advocate in youth law were made possible last December, when she received an Equal Justice Works (EJW) Fellowship. The EJW

awards fellowships to graduating 3Ls to complete a two-year project providing legal services and advocacy to underserved populations. Walker’s fellowship is sponsored by Pillsbury, Winthrop, Shaw & Pittman, a San Francisco law firm.

“I still can’t believe I got it and I’m really excited for the challenging work ahead,” Walker said. “Without the help of several professors at the law school and encouragement from my loved ones, I would never have had this amazing opportunity.”

Johnny Kastl (’13) has appeared in the summer blockbuster movies Hulk and War of the Worlds. He’s made audiences laugh as the peculiar pathologist on the hit medical comedy Scrubs. He’s also shared credits with acting icons Michael J. Fox, Patrick Swayze, and Tom Cruise. But, this past fall, Kastl walked away from Hollywood to take on his most challenging role yet—first-year law student at the University of Iowa.

“I love acting, but I always had my eye on law,” says Kastl, best known for his eight years as Dr. Doug Murphy on Scrubs. “[Law school is] a big switch, but I’ve never been one to stagnate.”

Kastl’s road from the silver screen to

the college scene began in 2008 when Scrubs changed networks after a wildly successful run. The actor, long interested in law, decided to bow out of the show to work for a Chicago law firm. Then he got an invitation to act with Swayze in his last television role, The Beast. Says Kastl, “The opportunity to work with the original Johnny Castle [Swayze’s Dirty Dancing character] was too fortunate to pass up, but I found a way to juggle it with my advocacy work.”

After the FBI series ended in March 2009, Kastl began searching for a law school close to the Chicago area, where his wife and two sons live. He was instantly impressed with the atmosphere, resources, and students of the UI Boyd College of Law. Though the allure of fame and fortune draws many to Hollywood, Kastl never intended to stay in acting.

“Some people take time off to backpack through Europe; I moved to L.A. to work in TV and film,” he says. In those early days, he pretended to be his own agent, making phone calls using a British accent and a fake name. In 2000, he auditioned for the lead on Scrubs, but later accepted a recurring role as Murphy, a doctor so incompetent that he has causes of death named after him.

“Doug is essentially my insecure self,” says Kastl. “He’s not fearful of the world, but his place in it. Yet, everything is a new, exciting experience for him.”

Now the former actor faces his own eyeopening adventure, balancing family life in Chicago with eight-hour school days in Iowa City. Kastl, who has biology and drama undergraduate degrees from Washington University in Saint Louis, plans to graduate from Iowa in 2013 and practice litigation law. “The passion and tenacity required to become a working actor in Hollywood translate well into law and advocacy,” he says. “The skills I’ve acquired in overcoming challenges will only make me a better lawyer.”

Citizen Lawyer Program offers students chance to give back The Citizen lawyer program helps law students become fully engaged citizens and community leaders by matching them with volunteer opportunities, pro bono work, and informational seminars. By offering dozens of opportunities throughout the year, the CLP teaches students the importance and rewards of giving back to their communities and neighbors and instills these future lawyers with a responsibility - and a passion - for service. The fourth year of the CLP was the best yet, with more students participating, higher visibility, and greater impact in the community and beyond.

Pro Bono Projects: Law-related volun-

teer activities that present opportunities to develop skills, meet clients, learn substantive areas of law, try different practice settings, and learn the value of doing pro bono publico work.

preLaw Magazine (Winter 2011 edition) ranked the Iowa law college as having one of the top public interest law programs in the United States, earning a grade of A- and placing among the top 36 in the country for its public interest projects and alumni who pursue careers in that area of law.

London Law Consortium The London Law Consortium (LLC) term kicked off with a bus tour of the city and the Inner Temple grounds.

Maintaining the tradition started by former LLC Director Patricia Acton and Richard, Lord Acton (d. 2010), the program students visited the House of Lords, watched a session, spoke with a Lord—Baroness Goudie, and visited the Supreme Court.

This semester featured some amazing speakers and field trips. Among those were Stephen Carroll, a Kentucky alumnus, as well as Michael Amado, a French lawyer. The British Legal Methods course had speakers open to all students.

The students visited O’Melveny partner and Iowa alumnus, John van der North, and heard from: Wilma Morrison from the Central London Law Centre; Crown Prosecutor Francis Davis; Makbool Javaid from the Simons Muirhead firm; and James Ormrod, associate general counsel for Hewlett-Packard. The International Human Rights course hosted Aisha Springer, a Muslim solicitor.

Professor Johnson’s Global Financial Crisis course included a tour of the Bank

of England and a visit with Associate Robert Schwartz at Allen & Overy’s London office. Guest lecturers included: Professor Rosa Lastra; Erica Johanson, a partner at Delphi (a Swedish law firm); University of Bologna Professor Costanza Russo, and Bank of England Economist Joche Schanz. Johnson’s Corporate Finance class featured two guest speakers: Bruce Bloomingdale, partner at Mayer Brown; and Amelia Slocombe from the Loan Marketing Association.

Professor Michael’s International Business Transactions class visited the London office of Covington & Burling, where they met with two attorneys and discussed intellectual property issues and practice.

This year was the first for a pre-law panel for undergraduate students studying in the building. The panel had a good turn out and answered many questions for aspiring law students.

Additionally, this group of students was the first to take an international trip.

The students visited the Hague, Neth-

erlands and the International Court of Justice. At the Hague, the students observed the Macedonia v. Greece case in the morning and had the unique opportunity to meet and speak with Judge Simma and Judge Yusuf in the afternoon. There was a group dinner with a presentation by Iowa alumnus, Sam Sadden, who works at a Brussels law firm.

The LLC wrapped up its final programming with the annual Thames boat cruise, joined by two of the program’s alumni -- Martha Baker from ChicagoKent and Shea Easterly from IndianaBloomington.

Program members also attended a dinner at the Inner Temple with local barristers and students honoring barrister Mark Wyeth’s twentieth anniversary of involvement with the program. Current and former barristers from over the years, as well as a representative from the US Embassy, attended the event.

Wyeth celebrates 20 years with the London Law Consortium In March, members of the University of Iowa College of Law celebrated Mark Wyeth’s twentieth year of affiliation with London Law Consortium (LLC).

Wyeth has been teaching English Legal Systems and is responsible for coordinating the barristers who sponsor the College’s students. A reception was held at the Inner Temple for students, faculty, and the current and former barristers who have sponsored students. At the barristers’ dinner, Adrien Wing, Bessie Dutton Murray Professor of Law, presented Wyeth with the book, The History of the Iowa Law School 1865-2010, from the UI College of Law faculty.

ICLP continues to promote global perspective of law

International and Comparative Law Program (ICLP) Comings and Goings: The University of Iowa College of Law sent two students to participate in the Alpbach program on European Integration in August 2010. The renown seminar brings together students and practitioners from a variety of disciplines to explore the issues related to the integration of Europe’s fiscal, monetary, and social systems. Two students travelled to Lisbon to study law as part of the College’s exchange program with Catolica University. The College also welcomed three law students to Iowa, as in the inaugural year of our exchange program with Radboud University of The Netherlands.

The LLM program continued to attract students from several continents and welcomed researchers from all over

the world to the College’s fabulous library as part of the Visiting Scholars Program.

Summer externships saw Iowa students placed in legal positions in The Hague, Israel, and China, with two students receiving travel support from the brand new Annette Stewart International Summer Travel Stipend, established by the 2004 alumna in 2011, to support students pursuing non-credit bearing international internships.

Going, going, going . . . most notably, Nick Dial (’12) fulfilled a lifelong dream of travel by spending 51 weeks overseas, participating in the 2010 Arcachon program and travel tutorial in the Middle East, the Alpbach seminar, exchange program in Lisbon, and 2011 spring semester London program. He even took the opportunity to accompany UI College of Law Professor Adrien Wing on a spring break trip to India, where she presented a lecture and Nick met with Indian law students.

Academics The London spring semester program continued to thrive under the direction of Professor Adrien Wing, who succeeded long-time director Pat Acton in 2010.

This year’s students visited legal venues in London, met with the alumni of partner schools, including John Van de North (’96). They also travelled to The Hague to sit in on international tribunal sessions and meet with two judges of the International Court of Justice.

A pilot spring break program in London allowed students and alumni to come together for a short course on a cutting-edge topic in international and comparative law. The course, Interna-

College of Law N e w s tional and Comparative Family Law, was taught by Professor Ann Estin and was offered to students for credit and to alumni for CLE credit. The mix provided for a stimulating educational experience. Said Tracie Melvin (’03), “I loved this experience! I have been bragging about the program on Facebook and several alums are interested in attending next year! Best CLE that I ever attended!”

At the time of this writing, the 2011 Arcachon program is underway, with students from five US law schools and several Russian lawyers participating in the classes. The post-program tutorial for Law and the Muslim World is set to examine issues related to Muslim law in several European nations.

Meanwhile, back in the US students continued to demonstrate that international connections can be local too.

The e-book sponsored by the Center for International Finance and Development (http://ebook.law.uiowa.edu/ ebook/) continued to generate attention as students joined Professor Enrique Carrasco in commenting on global finance issues. Students participating in a special seminar on international legal issues related to responding to the Haitian disaster traveled to Washington, DC, with Professor Marcella David, where they presented policy proposals to officials of the US Department of State and US AID. The Transnational Law & Contemporary Problems journal celebrated its twentieth year with an interdisciplinary review of international law and policy in the Middle East. Amazingly events in Egypt were unfolding even as speakers, including noted scholar Richard Falkland, opined on the future of the region.

The edition will be edited by Professor Wing and Professor Emeritus Burns Weston.

Scholarship: ICLP is sad to note the departure of Professor Mark Sidel, who will join the University of Wisconsin law faculty as Professor Margaret Raymond assumes the role of Wisconsin’s new law school dean. But we are delighted to welcome new faculty with strong international interests, including Anabdeeo “Andy” Grewal (International Tax), and Maya Steinitz (International Arbitration).

Nathan Miller, who has strong NGO experience, will join us as a senior fellow in human rights and social justice. We welcome back to the College Professor Carlson, who has concluded his service in central administration and will teach International Environmental Law next year. And, Professor John Reitz was selected to be the president of the American Society of Comparative Law. To help coordinate ICLP programming the law school welcomed Gustavo Orepreza as a part-time program assistant, and already he is making a difference, connecting ICLP faculty with students and alumni. Welcome, Gustavo!

World views: Of course, the heart of ICLP is the passion for international travel. ICLP destinations included nearly every continent: Europe (Professors Alexander Somek, David, Estin and Wing); China (Professors John Reitz and Sidel); Nepal (Professor Reitz); Egypt (Professors David and Wing), India (Professor Wing); and South America and Antarctica (Professor David).

During the 2012 spring semester, the University of Iowa College of Law will offer an elder law colloquium about important legal and public policy issues posed by the aging population and the related rise in Alzheimer’s Disease (AD) and other dementias. The colloquium will be sponsored by the Program on Aging of the National Health Law and Policy Resource Center, a national “think tank” affiliated with the College.

Background The US population is aging rapidly.

Iowa has a particularly large and growing aging population. Aging is a major risk factor for AD and other dementias leading to memory loss and decline in other cognitive functions. As a result the number of older individuals with some form of dementia is increasing dramatically. (See aging and dementia fact sheet on page 48.)

At some point these individuals lose their capacity to make decisions about their living situation, financial matters, and health care; they are vulnerable to financial exploitation, abuse, and neglect because of their cognitive impairment; and they generally require long term and costly care over a period of years.

Awareness and concern about the problem of AD and other dementias is growing. At the beginning of this year, the President signed into law historic federal legislation, the National Alzheimer’s Project Act, calling for an

College of Law to offer Elder Law Colloquium “aggressive and coordinated national strategy” to combat the crisis of an aging population and the rise in AD and other dementias. Similarly the Iowa Alzheimer’s Disease Response Strategy (HF390) enacted earlier this year is directed at the development of a state strategy to respond to needs of Iowans with AD and other dementias.

Colloquium Description The Colloquium will address public policy and legal issues with respect to the following: n substitute, or surrogate, decision making for older persons who lack the capacity to make decisions regarding financial matters and health care due to dementia, as well as other causes; n financial exploitation, abuse, and neglect of older persons including but not limited to those suffering from dementia; n the financing, organization and provi-

sion of long term care for the elderly with dementia and other persons with long term care needs; n the regulation of nursing homes and other facilities and institutions providing care for older persons suffering from dementia.

Emphasis will be placed on examining how the clinical and research body of knowledge about AD and other dementias can and should be translated into public policy and law.

College of Law N e w s policy and legal experts from around the country. It will also feature nationally recognized experts on Alzheimer’s disease and other dementias and geriatric care.

Given the large aging population and the high prevalence of AD and other dementias, there is a great deal of interest among public policy makers, legal and health professionals, and the general public regarding issues, including public policy and legal matters related to these phenomena. One manifestation of this interest was the enactment this year of landmark federal legislation, the National Alzheimer’s Project Act, which will create a national plan to combat AD. The Colloquium will make a contribution to what is an increasingly high profile dialogue about how to address the public policy and legal problems and issues posed by the rapidly aging population and the dramatic rise in AD and other dementias.

Colloquium Participation The Colloquium will consist of 14 weekly class sessions beginning on January 9, 2012.

Law students may enroll in the Colloquium for course credits. College of Law alumni also may participate in the Colloquium via the Internet. Colloquium sessions will be live streamed via the Internet, and videos of the sessions will be posted on the web site of the National Health Law and Policy Resource Center. It is anticipated continuing legal education credit will be available for College of Law alumni and other lawyers participating in the Colloquium.

NHLP Resource Center Fact Sheet Facts about the aging population in the United States In 2009:

The number of persons 65 years of age or older was 39.6 million, or 12.9% of the total population.

The number of persons 85 years of age or older was 5.6 million, or 1.8% of the total population.

The American population age 65+ is growing rapidly, and the aging of the baby boomers, who begin turning 65 in 2011, will accelerate that growth.

From 2007-2030: It is projected that the aging population 65 years and older will increase by 89%, more than four times as fast as the US population as a whole.

It is projected that the aging population 85 years and older will increase by 74%.

U.S. Numbers 1 in 8 Americans aged 65 and over, has Alzheimer’s, and nearly half of those aged 85 and older have the disease.

In 2011, 5.4 million Americans had Alzheimer’s disease.

By 2050, it is estimated that as many as 16 million Americans will have the disease.

Deaths Alzheimer’s disease is the sixth leading cause of death in the United States and the fifth leading cause of death for those aged 65 and older.

Deaths from Alzheimer’s increased 66% between 2000 and 2008, while the incidence of deaths from other major diseases, including heart disease, the leading cause of death, decreased.

Caretakers In 2010, 14.9 million family and friends provided 17 billion hours of unpaid care to those with Alzheimer’s and other dementias.

The economic value of the unpaid care provided to those with Alzheimer’s and other dementias totaled $202.6 billion in 2010.

Public Costs In 2011, the cost to American society of caring for those with Alzheimer’s will total an estimated $183 billion. That is an $11 billion increase over last year – more than four times the rate inflation.

If things continue as they are, in 2050 Americans will be facing Alzheimer’s costs of $1.1 trillion (in today’s dollars).

UI working with eight Iowa communities on new economic development strategies A University of Iowa project is underway to help eight selected towns around the state find a new way to create a community-wide economic development plan that can be used as a model by other small towns in Iowa.

The pilot project brings together leaders from municipal and county government, civic organizations, and nonprofit and faith-based organizations to find new ways to develop local economies. Jeff Schott, director of the UI Institute for Public Affairs (IPA) who is overseeing the project, said this kind of broad-based planning encourages new ideas and ensures wide community support for the plan’s goals.

“We sense a lot of excitement in all of these places to see these plans move forward,” Schott said. “With involvement from so many people and so many groups, we think there’s a lot of forward momentum in our client communities to make sure these plans come to life.”

The communities working with the UI are all under 5,000 population and include Belle Plaine, Chariton, Pocahontas, Prairie City and the Lee County communities of Donnellson, Franklin, Montrose, and West Point -- all of them cooperating on a joint economic development plan. The UI resources are provided by the IPA and the Larned A. Waterman Iowa Nonprofit Resource Center (INRC) at no cost to the communities.

The project recently completed its first phase, which was to meet with some 30 to 50 people from each community in order to develop a vision, define goals and write a report with steps to take for each community. Schott said the project committees included members from local and county governments, civic groups, nonprofit and faith-based

He said successful implementation of the plans will require extensive civic cooperation.

“It’s much more difficult to do if someone is going their own way or just sitting on the sidelines.”

With the plans approved in each community, the INRC and IPA will now provide training and technical assistance to help implement them.

“Implementation is certainly the number one issue we’re seeing now,” said Schott. “It’s easier to define a vision and goals, but it gets harder when we start to ask who’s going to put it in place. There are only so many resources in smaller communities, but we’re confident that with our assistance, they can make these plans happen.”

Schott said each town had a different set of priorities and goals for itself. In the Lee County towns, for instance, tourism was important, as community members seek to capitalize on their location near the Mississippi River and an established trail system to attract visitors.

But in Pocahontas, Schott said, the community pointed to quality of life as a primary issue, as the town’s employers struggle to attract workers to fill job openings.

However, some goals were common to all the communities. Schott said that encouraging downtown development, working with aging rural populations, bringing new employers to town and helping existing businesses grow seem to be important everywhere.

“Most economic development comes from existing businesses, so it’s important that communities have an infrastructure in place to work with those businesses and help them find resources to expand and add jobs,” he said.

Schott said the results obtained from the pilot projects will be used to develop best practices for nonprofit organizations and local governments to build organizational capacity and promote collaboration to develop long-term community economic recovery strategies.

The program is funded by a $250,000 grant from the Strengthening Communities Fund –- State, Local and Tribal Government Capacity program of the American Recovery and Reinvestment Act (ARRA) of 2009. The Strengthening Community Fund is dedicated to improving the effectiveness and long-term sustainability of communities and secular and faith-based nonprofit organizations located and providing services throughout Iowa.

The College of Law welcomed Amandeep (Andy) Grewal to its faculty as an associate professor.

Grewal received his BA in Economics from Williams College, his JD from The University of Michigan Law School, and his LLM in Taxation from Georgetown University Law Center. Most recently he was a visiting associate professor at the Sandra Day O’Connor College of Law at Arizona State University where his courses include Individual Taxation, Partnership Taxation, Corporate Taxation, International Taxation, and Tax Procedure and Admin. Practice.

He formerly was a tax associate at Skadden, Arps, Slate, Meagher & Flom, LLP in Washington, DC.

Professor Emily Hughes is an expert in criminal law and criminal procedure. She teaches criminal law and procedure and has co-authored a casebook on federal habeas corpus. A recipient of the Sacks Fellowship at the Criminal Justice Institute at Harvard Law School, she has spoken across the country on legal issues involving mitigation evidence during the penalty phase of capital trials; developing the capital trial team; and ethics and discovery.

She joins the UI College of Law as a tenured professor from the Washington University School of Law in St. Louis. Prior to her faculty position at WUSTL, she clerked for the Hon. Michael J. Melloy, Chief Judge, U.S. District Court for the Northern District of Iowa, now serving on the Eighth Circuit Court of Appeals. She also worked as a state public defender in Iowa and practiced criminal law in Illinois as a part of the Center for Justice in Capital Cases at DePaul University College of Law.

The College of Law welcomed Jason Rantanen to its faculty as an associate professor. Professor Rantanen received his AB in Biology and History from Brown University, his MA in History from the University of Chicago, and his JD from the University of Chicago. Most recently, he was a visiting researcher at the University of California, Hastings College of Law. Prior to that, he practiced at Munger, Tolles & Olson LLP. He clerked for The Honorable William C. Bryson on the US Court of Appeals for the Federal Circuit (2003-2004).

He is a contributing author to Patently-O Patent Law Blog (http://www. patentlyo.com/), which with more than 30,000 visits each week has become a primary source for the most current patent law news and information.

The College of Law welcomed Maya Steinitz to its faculty as an associate professor. Professor Steinitz received her LLB at Hebrew University Faculty of Law and her LLM and SJD at New York University School of Law. Before coming to Iowa, she was an Associate-in-Law at Columbia Law School.

Prior to that, she practiced at Latham & Watkins LLP and at Flemming, Zulack & Williamson LLP. She also clerked for Israeli Supreme Court Justice Esther Hayut, served as a clerk in chambers at the United Nations International Criminal Tribunal for Rwanda, and served as consultant and intern at international NGOs and the United Nations. Additionally, she is currently an arbitrator at the Paris-based ICC.

College hires human rights fellow

Jean C. Lawrence The University of Iowa College of Law is pleased to announce that Jean C. Lawrence (’80) has accepted a position as visiting clinical professor of law for the year July 2011 through June 2012. Professor Lawrence will direct a new offering in the College’s Clinical Legal Programs: the family assistance project representing parents involved in the Children in Need of Assistance (CINA) and termination proceedings in the Iowa City area. In addition to supervising law students working on these cases, she will be developing and implementing a series of educational programs and materials for use by the legal profession throughout the state of Iowa.

Professor Lawrence is a 1980 graduate, with high distinction, from the College of Law and has practiced for the last sixteen years with the

firm of Aasgaard & Lawrence, PLC, in Marion, Iowa.

She has broad experience in juvenile law in general and particularly in CINA and termination cases. Before coming to the law school, she had taught in the paralegal program at Kirkwood Community College.

The position in the clinic is funded by a one-year grant from the Children’s Justice Initiative at the Iowa Supreme Court. The Initiative is committed to optimizing how the Iowa child welfare systems works, especially for those children and parents who find themselves involved in it. To that end, the Initiative has led a series of conference, summits, and continuing legal education programs to improve the quality of legal representation in the system and to enlarge the training opportunities available for judges and lawyers who work there.

The College of Law welcomed Nathan Miller as its senior fellow in human rights and social justice.

Miller received his BA in philosophy and spanish from the University of Dayton and his JD from New York University School of Law. He was the human rights program officer for the International Senior Lawyers Project. Since graduating from law school, he has been a visiting researcher for the International Criminal Tribunal for Rwanda; Programme Officer, Rule of Law for the United Nations Development Programme in Sudan and Kenya; and served as founder and executive director of the Rule of Law International.

Professor Ward retires Professor Larry Ward, Orville L. and Ermina D. Dykstra Professor of Federal Tax Law, taught his final class as a member of the UI College of Law full-time faculty on December 1, 2010.

Ward expertly taught the College’s students for 38 years.

He received both his BS and JD from University of Kansas, before completing New York University’s taxation program. (He also picked up a MAc from the UI in 1996). Upon completion of his studies at NYU, Professor Ward joined the faculty at the UI College of Law. Near and far, alumni attribute their interest in tax law to his classes. Ward notes in his biographical statement that “[he] may be unique in the law-teaching

world in having served as a professor, a practicing lawyer, and chairman of a publicly-traded company,” all of which has enhanced his work inside and outside the classroom. Along the way, he earned the UI Collegiate Teaching Award, and while visiting at the University of Michigan, received its L. Hart Wright Award for Excellence in Teaching. He authored Problems and Solutions for Basic Federal Income Taxation and (with Gunn) Cases, Text and Problems on Federal Income taxation, and the cor-

responding teacher’s manual. For almost four decades, he has skillfully represented the College of Law through countless CLEs and leadership on a number of boards and committees, including but not limited to the AALS Section on Taxation, ISBA Section on Taxation, and ILSF Board.

The faculty, students, and staff thank Professor Ward for his years of dedicated service to The University of Iowa College of Law and wish him well. Ward became an active member of the emeritus faculty on July 1, 2011.

Raymond accepts deanship at the University of Wisconsin Law School Margaret Raymond, formerly the William G. Hammond Professor of Law, has accepted the deanship at the University of Wisconsin Law School, effective July 1, 2011. Professor Raymond had an extraordinary record of accomplishment when she became a member of the UI College of Law faculty: editor-in-chief of the Columbia Law Review, judicial law clerk to Judge James Oakes on the Second Circuit and to Justice Thurgood Marshall on the Supreme Court.

After joining the faculty in 1995, she quickly became the students’ “favorite teacher.” When former Dean, Carolyn Jones, recommended Margaret for appointment as the William G. Hammond Professor, she noted the “extraordinary range” of Margaret’s scholarship and the breadth and depth of her knowledge in criminal law, criminal procedure, and

legal ethics. Raymond has served as president of the University Faculty Senate and co-chaired the University’s Budget Committee. She was a popular and frequent CLE presenter. Most recently, she was named by the Chief Justice of the Iowa Supreme Court to a committee charged with the review and revision of the rules governing lawyer advertising.

“Margaret’s departure will leave a void in the University and Iowa legal community almost as large as the one she will leave here in the Boyd Law Building,” said Gail Agrawal, Dean and F. Wendell Miller Professor of Law, UI College of Law, “She will be a wonderful dean, but we will deeply miss her and her leadership on our faculty.”

With Raymond’s departure, the College also loses friend and colleague Mark Sidel, Professor and Lauridsen Family Fellow. Sidel is a prolific scholar and a

popular teacher. He provides important service within the law school, across the University, and in the international arena. He brings innovative ideas and great energy to the international programs. His strong international reputation and his leadership with SALT and the International Society for Third Sector Research enhance the stature and visibility of the Iowa College of Law across the nation and around the world.

Faculty Recognitions Faculty receive collegiate teaching award Two UI College of Law faculty members were honored with a Collegiate Teaching Award, Barry Matsumoto for 2009-2010, and Christina Bohannan for 2010-2011. The award is the highest honor a college can bestow upon its faculty for excellence in undergraduate and graduate teaching.

Barry Matsumoto, associate professor, received the award for 2009-2010.

Matsumoto joined the faculty in 1974.

He teaches in the areas of Constitutional Law, State and Local Government, Professional Responsibility, Property, American Legal Realism, and Critical Legal Studies.

Professor Christina Bohannan received the award for 2010-2011. Bohannan joined the faculty in 2002 and specializes in intellectual property law and tort law. She is the recipient of a Ewing Marion Kauffman Foundation research grant, which she is using to research and co-author a book about how intellectual property and competition law can be used more effectively to encourage innovation.

She is a member of the UI Faculty Senate.

David receives UI Distinguished Teaching Award

Pettys receives President and Provost Award for Teaching Excellence Todd Pettys, professor, received the 2011 President and Provost Award for Teaching Excellence. The award, which is administered by the UI Council on Teaching, was created in 2004 as a University-wide recognition for faculty members who have demonstrated a sustained, high level of teaching excellence.

Pettys holds the H. Blair and Joan V. White Chair in Civil Litigation and also serves as associate dean for faculty in the College of Law. He was instrumental in the development of a highly successful professionally run legal research and writing program that is in large part responsible for employers considering an Iowa Law graduate as one of the best trained in writing among law graduates in the country. He won the Collegiate Teaching Award in 2001.

Marcella David, associate dean for International and Comparative Programs and professor at the UI College of Law received a University of Iowa Distinguished Achievement Award at the Celebration of Excellence and Achievement Among Women in April.

The Distinguished Achievement Award is presented to staff or faculty members who have significant years of service within the university community, who are pioneers in their work or service; and are role models for women and/or girls.

In the past year, Professor Estin co-chaired the Faculty Appointments Committee with Professor Jim Tomkovicz, presented papers on international issues in child welfare law at the 2011 AALS meeting and conferences at the University of Oklahoma, Brigham Young University, and Michigan State University, and completed her book on international family law. During the 2011-2012 academic year she will revise her family law casebook and participate in a drafting committee amending the Uniform Child Custody Jurisdiction and Enforcement Act to implement the Hague Child Protection Convention.

Thomas P. Gallanis continues to be active in law reform in the field of trusts and estates. Chapters 19-22 of the Restatement Third of Trusts, which he drafted in collaboration with U.C. Berkeley law professor Edward C. Halbach, Jr. (’58), were approved by the American Law Institute at its annual meeting in May. This will enable the

fourth and final volume of the Trusts Restatement to advance toward publication. Within the Uniform Law Commission, Professor Gallanis serves as the assistant executive director of the Joint Editorial Board for Uniform Trust and Estate Acts. He has also been named the reporter (principal drafter) for a new uniform act on powers of appointment.

The first meeting of the act’s drafting committee will be held in September.

Professor Gallanis published a new edition of his casebook, Family Property Law: Wills, Trusts, and Future Interests (5th ed. 2011). He also published two articles in legal history: “Victorian Reform of Civil Litigation,” in C.H. Van Rhee ed., Within a Reasonable Time: The History of Due and Undue Delay in Civil Litigation (Berlin: Duncker & Humblot, Comparative Studies in Continental and Anglo-American Legal History, 2010), and “Making Sense of Blackstone’s Puzzle: Why Forbid Defense Counsel?” in A. Sarat ed., Studies in Law, Politics and Society no. 53 (2010). During the 2010-2011 academic year, Professor Gallanis delivered two named lectures at the University of Iowa. In October, he gave the Shirley A. Webster Lecture in Wealth Transfer Law on the subject “The New Direction of American Trust Law;” this lecture will be published in the Iowa Law Review. In April, he gave the Donald W. Sutherland Memorial Lecture in Legal History on the subject “The Evolution of the Common Law;” this lecture can be viewed on the Internet at http://podcast.uiowa.edu/law/Sutherland/Sutherland_Lecture.mp4 Josephine Gittler continues to serve as director of the National Health and Policy Resource Center, a national think tank affiliated with the UI College of Law. She also continues to serve as associate director for policy of the John A. Hartford Center for Excellence in Geriatric Nursing at the UI College of Nursing. In addition she accepted an invitation to join the advisory com-

mittee of the Institute for Clinical and Translational Sciences at the UI College of Medicine and to become one of 30 senior mentors for Institute scholars.

In 2011, she became an editor of a scholarly peer-reviewed journal, the Journal of Gerontological Nursing, and is responsible for its section on legal and public policy issues, and she is member of the editorial board of another scholarly peer-reviewed journal, the Journal of Research in Gerontological Nursing, for which she reviewed articles dealing with legal and public policy issues.

In the past year she has been active at the state level serving as a member of the Court-Annexed ADR Subcommittee of the Iowa Supreme Court’s Civil Justice Reform Task Force, and she authored a report for the Task Force entitled, “Court Connected General Civil Mediation Programs: Issues and Options with respect to Mediators.” She also was appointed to the Iowa Child Protection Council Citizen Review Board by the Iowa Department of Human Services.

A major focus of her teaching, scholarship, and service has been health law and policy and elder law and policy, particularly substitute decision mak-

ing for older persons with diminished capacity due to Alzheimer’s Disease and dementia. She developed a new course, Surrogate Decision-Making for Incapacitated Individuals, which was offered for the first time during the August 2010 intersession. She published an article entitled, “Advance Care Planning and Health Care Decision Making,” in the Journal of Gerontological Nursing 37 (5): 15. In her capacity as director of NHLP Center, she oversaw the Center’s ongoing initiative on Substitute Decision Making in Iowa. In connection with that initiative she made educational presentations on substitute decision making for individuals with dementia, advance care planning, and advanced directives at two workshops for audiences consisting primarily of lawyers, bank trust offices, and financial planners in eastern Iowa. And she conducted research on the legal framework for substitute decision making in Iowa with funding from the Nellie Ball Research Trust.

This summer she is revising an article entitled, “The Aging Population, Family Caregivers, and the Law of Succession,” co-authored with Professor Tom Gallanis, which has been accepted for publication

Faculty N o t e s in the University of Michigan Journal of Law Reform, and she is writing an article on the Patient Protection Affordability Care Act, the federal health care reform legislation and long term care.

N. William Hines will continue on a Phased-Retirement program for next two years, teaching Property II and Trusts and Estates. In 2011-2012 he and Professor Bonfield will celebrate their fiftieth year of continuous service on the Iowa law faculty.

In January 2011 the University Printing Service published a book entitled The History of the Iowa Law School: 1865-2010. Hines was the editor of this book, and he contributed five of its 15 chapters. This summer he expects to complete the first phase of a long-term research project on the federalization of the U.S. law on punitive damages, based on a study of all 467 punitive damages cases reaching U.S. appellate courts over an eight-year period, 2003 to 2011.

In February 2011, Professor Hines was a member of the ABA/AALS Team that spent three days on the New Haven campus of Yale University, conducting a site visit of the Yale Law School. In March 2011 Hines presented to the Iowa Board of Regents the “Report of the Special Presidential Committee to Investigate the January 2011 Hospitalization of University of Iowa Football Players.” Hines chaired the Committee and was the principle author of the Report. In May 2011 President Sally Mason named Hines to serve as chair of the University’s Presidential Committee on Athletics during the 2011-2012 and 2012-2013 academic years.

His paper, “The Broadband Challenge: Consumer Protection in a Deregulated Digital Age,” was presented to the Iowa Department of Economic Development’s Telecommunications Sector Committee, on which he served. He co-authored with Shinji Uozumi, “Moto FCC lin-karano Message,” and was subsequently invited to lecture at four Japanese universities on the proposed “Japan FCC.” He spoke on “The Present and Future of FCC Reform” at the Public Knowledge Conference in Washington, DC, (“An FCC for the Internet Age: Reform and Standard-Setting”); to the Institute for General Semantics Conference in New York on “Was It Something I Said? General Semantics, the Outspoken Seven, and the Unacceptable Remark;” and at a couple of Iowa City events. He was interviewed on one TV and three radio programs. And he played the role of “Richard” in the local, Combined Efforts Theatre production of “Love at the County Fair.”

In response to students’ requests, he taught a new course in sports law during the 2011 spring semester. In the fall he will teach another newly revised course, cyber and electronic law. Onwuachi-Willig was an invited faculty workshop speaker at the University of Southern California School of Law, Washington University-St. Louis School of Law, George Washington University Law School, Marquette Law School, the University of Houston Law Center, and Seton Hall Law School. She also served as an invited panelist for conferences at the Indiana University-Bloomington School of Law, University of Minnesota Law School, University of South Carolina School of Law, University of California-Irvine School of Law as well as on the AALS Employment Discrimination Section Panel and at the Third National People of Color (NPOC)Legal Scholarship Conference. She served as the keynote speaker for the League of Women Voters of Johnson County Annual Dinner, and she was invited to join the Critical Race Theory and Empirical Research Methods Research Group at the University of California-Hastings College of Law and the Weekend Renewing America’s Promise Weekend in Massachusetts.

Onwuachi-Willig has forthcoming, co-authored symposium publications in the Indiana Law Journal and the Denver University Law Review. She and her husband Jacob Willig-Onwuachi published an invited response to Professor Rosenblum’s A Pregnant Man? in the Yale Journal of Law and Feminism. On behalf of the Society of American Law Teachers (SALT), she co-edited Vulnerable Populations and Transformative Law Teaching (with six law professors).

Onwuachi-Willig is currently working on her book, According to Our Hearts: Lessons on Race, Family, and Law from Rhinelander v. Rhinelander, which is under contract with Yale University Press.

She is the chair of the AALS Committee for the Recruitment and Retention of Minorities. This academic year, she completed terms as chair of AALS

Law and Humanities Section, a planning committee member for the AALS Mid-Year Conference “Women Rethinking Equality,” an executive committee member of the AALS Minority Groups Section, a member of the SALT Board of Governors, a member of the planning committee of the Third NPOC Legal Scholarship Conference, and a member of the inaugural Law and Society Prize Committee for the new John Hope Franklin Prize on Race, Racism and the Law. In 2010, Onwuachi-Willig was elected to the American Law Institute, and in 2011, she was invited to be a Fellow of the American Bar Foundation and to serve on the Grinnell College Alumni Council.

Mark Osiel has signed a contract with Cambridge University Press for his new book, After Atrocity: New Approaches to Redress and Restraint. In recent months, he has lectured, on legal responses to mass atrocity, at the Hebrew University of Jerusalem, Ecole National Superieure (Lyon), University of Paris (Sorbonne), American Bar Foundation, Northwestern University, Arizona State University, University of Georgia, Florida State University, Pace University, and the University of Michigan legal theory workshop.

Todd Pettys became the associate dean for faculty in January 2011. His article “Letter from Iowa: Same-Sex Marriage and the Ouster of Three Justices,” was accepted for publication in 59 Kansas Law Review (forthcoming 2011) and “Judicial Discretion in Constitutional Cases,” was published in 26 Journal of Law & Politics 123 (2011).

Somek presented three papers in October 2010, “Europe’s Social Question,” at the London School of Economics as part of the GOLEM workshop series; “The Spirit of Legal Positivism,” at a seminar conducted by Robert S. Summers and Robert Hockett at Cornell Law School; and in January 2011, “Three forms of collective self-determination” at the conference, Constitutionalism in a New Key, held at the Humboldt University Berlin.

John-Mark Stensvaag has completed four articles on Prevention of Significant Deterioration (PSD) under the Clean Air Act, to be published in the Environmental Law Institute’s Environmental Law Reporter. With the publication of these new works, his ongoing research into PSD implementation will have resulted in a seven-part series of articles for the Environmental Law Reporter.

James Tomkovicz spent the spring 2011 semester teaching full time at the UCLA School of Law as well as half time at the University of Southern California School of Law. His book, Constitutional Exclusion: The Rules, Rights, and Remedies that Strike the Balance Between Freedom and Order, was published in April 2011 by Oxford University Press.

He recently submitted to law reviews an article entitled, “Sacrificing Massiah: Confusion Over Exclusion and Erosion of the Right to Counsel.” He is the coplanner (with Prof. Margaret Raymond) of a symposium celebrating the twentyfifth anniversary of Batson v. Kentucky to be held at the UI College of Law in October 2011.

Adrien Wing directed the Arcachon summer program during summer 2010, during which she taught Law in the Muslim World. She then accompanied most of the students on a post-program tutorial that took them to Egypt, Israel, and Palestine. Because of unrest in the Middle East during spring 2011, Wing took the Arcachon 2011 students for a post-program tutorial entitled, “Mus-

Wing was on sabbatical during fall 2010 primarily working on a book entitled, Healing Spirit Injuries: National and International Legal Strategies. She continued as director of the London Law Consortium during spring 2011.

In London, she taught International Human Rights as well as the British Legal Methods course in which students paired up with British barristers. As a program first, she took the students to the International Court of Justice in the Hague, where they watched a hearing and met with Judges Simma and Yusef.

Wing’s other presentations included: “The International Human Rights of Blackwomen: Justice or just us??” presented at the National People of Color Scholarship conference; “Speaking Truth to Power: Derrick Bell the Scholar Activist,” presented for a plenary

at the same event; CUNY Law School faculty seminar and class on “Gender and Human Rights;” CCNY lecture on “Global Critical Race Feminism;” UI panel on Islamophobia; National Black Prelaw conference keynote speaker; Chicago Black Women Lawyers Association keynote panel; and Institute on Global White Privilege and Middle East in Minneapolis.

Wing’s service activities included: inspecting Columbia Law School for the ABA; being a blind reviewer for manuscripts at Oxford and University of Pennsylvania Press; and pre-law recruiting at Howard University and the Pacific Pre-law Forum. She has recently been nominated to the ABA Middle East/ North Africa Council.

College of Law mourns the loss of Professor David Baldus David C. Baldus, the Joseph B. Tye Professor of Law at the University of Iowa, died peacefully at home on June 13, 2011, after a lengthy battle with cancer. We are grateful for the many years he was our colleague and we mourn his loss.

Professor Baldus was an outstanding scholar, a beloved teacher, and a powerful voice for justice. He pioneered the use of statistical methods in legal research, and he was a world-renowned expert in the administration of the death penalty in the United States. He continued this important work until just days before his death, leaving instructions for its completion when his health deteriorated suddenly. David Baldus died as he lived, with grace, quiet dignity, and great courage.

Professor Baldus joined the law faculty at the University of Iowa College of Law in 1969, after earning an LLM degree from the Yale Law School that year.

He had previously earned a BA degree from Dartmouth College in 1957, a MA degree from the University of Pittsburgh in 1962, and a JD degree from the Yale Law School in 1964.

Early in his academic career, well ahead of his peers, Professor Baldus became convinced that proof in court of many factual assertions, especially those relating to race discrimination, required a mastery of empirical methods. Although not formally trained as a statistician, Professor Baldus brought a powerful intellect and his characteristic energy to the task. The work that followed confronted the weightiest problems of the day: detecting and quantifying the effects of race and other discrimination in American society with a focus on racial discrimination in

Through exhaustive empirical research, Professor Baldus was able to document the ways in which the application of the death penalty varied with the race of the victim or the perpetrator. His work informed his students, empowered the civil rights and death penalty Bar, and inspired the legal scholars who followed him.

Professor Baldus was repeatedly recognized and honored for his academic work. He was a respected member of the American Law Institute, the American Society of Criminology, and the Law and Society Association. He served at various times on the editorial boards of Evaluation Quarterly, Law & Policy Quarterly, Law and Human Behavior, and Psychology, Public Policy and Law. He was the recipient of grants from numerous agencies, including the National Science Foundation Law and Social Science Program, the State Justice Institute (with colleagues J. Gittler and J. McQueen), and the Nebraska Crime Commission.

He was the reporter for the Roscoe Pound American Trial Lawyers Foundation Conference on Capital Punishment at Harvard University in 1980. He was awarded the Law and Society Association’s Harry Kalven Prize for Distinguished Scholarship in Law and Society (with G. Woodworth & C. Pulaski) for

capital punishment research (June 11, 1987), and the Governor Harold E. Hughes Award by Iowans Against the Death Penalty (October 27, 2007). At the University of Iowa he received the Michael J. Brody Award for Faculty Excellence in Service to the University of Iowa (October 1996), and the Award for Faculty Excellence from the Board of Regents, State of Iowa (2000).

Professor Baldus devoted himself not only to writing on the issues about which he felt so passionately, but to pursuing justice actively in the courts as well. He was a consultant or expert witness in major capital punishment cases, including McCleskey v. Kemp, which resulted in a decision by the United States Supreme Court in 1987 and Ashmus v. Martel, currently pending in Federal District Court in California. He served as a consultant to the Delaware Supreme Court, the South Dakota Supreme Court, the National Center for State Courts, and as a Special Master to the New Jersey Supreme Court, in their reviews of proportionality and the death penalty.

News of David Baldus’s death spread quickly throughout the legal academic community and beyond. It was greeted with an outpouring of messages reflecting both a sense of loss and of gratitude for the contributions of a beloved and respected colleague and friend. David Baldus has changed the law and those who care about it for the better.

Professor Charles Davidson dies at 93 University of Iowa College of Law Professor Charles Davidson died on August 29, 2011 at the age of 93.

Davidson joined the faculty in 1950 as an assistant professor, became a full professor in 1957, and served with distinction until 1988 when he took emeritus status. Before joining the faculty, Charlie served as a captain in the Field Artillery in the US Army during World War II. He was born in Salem, Ohio, earned his undergraduate and law degrees from The Ohio State University and an LLM from the University of Michigan Law School.

As a much respected faculty member, he was especially regarded by his colleagues and students for his compassion and thoughtfulness. During his long years with the College, he taught courses in Real Property, Future Interests, Legislation, Modern Social Legislation, Trusts and Estates, Legal Profession and Ethics. Early in his career, Davidson served as an advisor to the Iowa Law Review, working to ensure student autonomy and the discretion of the student editorial board.

“The College of Law and its graduates have never had a better friend than Charlie Davidson. He was an excellent teacher in the classroom who taught generations of graduates a reverence for the majesty of the Law and the role of lawyers in creating a civilized world. His life and service will forever inspire us. We will miss him greatly but rejoice that he is such an important part of the legacy of the College and all who were privileged to know him,” said Chuck Kierscht, (’62) President, Iowa Law School Foundation and a former student of Davidson.

Davidson was active with the Iowa State Bar Association, including many years of service on the Title Standards Committee and in Continuing Legal Education. His University service included acting as interim director of the University of Iowa Museum of Art, membership in the Museum of Art Advisory Committee, Hancher Guild, and The Presidents Club.

He was director, secretary, and general counsel to the Iowa Measurement Research Foundation, which supported the College of Education by funding the construction of the Lindquist Center and provided an endowment to continue educational measurement testing. He was a wise and insightful counselor to three University presidents and served as chair of the University Faculty Council and on the UI Presidential Search Committee that led to the appointment of President Howard R. Bowen.

He was preceded in death by his wife, Jean, with whom he had three children. He was a long-time member and a national leader of the Unitarian Universalist Association of Churches.

The College is grateful for his long life, for the positive difference he made in the many lives he touched, and join his family and friends in mourning him. The Davidson family is planning a memorial service for October 1, 2011 at 10:30 a.m. at the Unitarian Universalist Society of Iowa City.

If you ask John today, though, he’ll tell you that what’s really important about the Iowa Law experience—and what inspires him to remain involved with the law school—hasn’t changed much at all.

“We had great professors,” John said, mentioning Sandy Boyd and Sam Fahr as personal favorites. “And we had real access to our professors, so we were able to build genuine relationships with them.”

Nowadays, competition is fierce among law schools to hire and retain top-quality legal scholars and educators. That’s why, before Bob Bouma passed away, the brothers worked together to create an endowment—combining outright contributions and bequests from both—to support Bouma Faculty Fellowships in the College of Law. These faculty fellowships will be used to recruit, retain, and recognize outstanding junior faculty in the Iowa Law School, with an emphasis on accomplishments in the area of trial law.

The Iowa Law School still prides itself on a low professor-to-student ratio, and our professors make it a point to stay in close contact with their students. In addition to educating students as lawyers, Iowa Law School faculty members mentor them as problem solvers, writers, critical thinkers, and community leaders. 2011 Alumni Achievement Award Recipient: Theodore (Ted) Seldin

Theodore (Ted) Seldin received a BA in Economics and an Air Force Commission in 1953. A JD was earned in 1955, followed by active duty as an Air Force JAG from 1955 to 1957. In 1956, he was admitted to practice before the US Court of Military Appeals, and continued in reserve duty for an additional 14 years.

Since 1957, he has enjoyed a long and distinguished career working with the Seldin Family firm, which became recognized as a leading homebuilder and developer in the Omaha/Council Bluffs Metro-area. In the late 1960s, he and his partners built and managed the Mayflower Apartment complex, the first privately owned student housing meeting the parietal rules of the University of Iowa. The complex was purchased by the University in 1983, and continues to provide quality living for 1000 students.

The Seldin firm is now a diversified commercial, multifamily developer, and real estate asset manager. It has developed and built affordable housing for a wide range of clientele including more than 3,000 single-family and 3,500 apartment homes. The firm developed the 900-acre Westwood Communities in Southwest Omaha, one of the first master planned sustainable communities in the Midwest which includes; single family and apartment homes, mixed-use retail centers, offices and sites for schools, churches, parks, and public facilities. Members of his firm have also re-developed blighted urban commercial areas in Omaha and Council Bluffs. He is especially proud of the more than 1,000 affordable apartment homes for seniors, which his firm built and manages across Iowa and Nebraska, providing senior citizens an opportunity to live independently with dignity, respect, and security.

“Ted has a strong social conscience. He is a pioneer in building affordable housing and has also been at the forefront of building sustainable communities. His career achievements bring great distinction to the University of Iowa,” said Willard “Sandy” Boyd, Rawlings-Miller Professor of Law and President Emeritus at the University of Iowa.

Seldin explains that through the years, Sandy Boyd has continued to be a friend and mentor, and an example of achieving success in life.

“I enrolled in a class in corporate / business law instructed by a new professor, Willard Boyd. I was fortunate to be in Sandy Boyd’s first class on his first day on the law faculty. Due to the information and foresight I received from this class and my continuing contact with Sandy, it enabled me to recognize that a legal education would provide me with skills that would be invaluable regardless which career path I followed,” said Ted.

As a member and chairman of various National Association of Homebuilders committees, he participated in the preparation of legislation at the national level to enhance production of affordable housing through various HUD programs and IRS Section 42, which provides tax credits for private investment in low and moderate income housing. He has been active at the state level on landlord and tenant and fair housing statutes and on zoning, development standards, and building codes.

He has been active in community affairs including: president of the Metropolitan Builders Association, member of the board of directors of the Omaha Community Foundation, the City Sponsored Park East Redevelopment Corporation, the Lutheran Hospital, and many other charitable and religious organizations. He was inducted into the Greater Omaha Chamber of Commerce Hall of Fame in 2010. He and his wife of 54 years, whom he met while in law school at Iowa, have established a scholarship in real estate in the Iowa College of Law. They have two adult daughters and four grandchildren.

“I was fortunate to have had the opportunity to pursue my college career at the University of Iowa, both for my undergraduate degree and to have gained the many benefits from my learning experience at the College of Law, and the relationship with its faculty and my classmates, which has provided the foundation for my life’s work,” explained Ted. “I am very honored to have received this recognition from the College. It is one of the most treasured achievements of my personal and business careers.”

He continues to be active in business and community affairs as chairman of the Seldin Company, which has real estate activities in six Midwest states.

2011 Alumni Service Award Recipient: Charles (Chuck) Coulter

Chuck Coulter has successfully served clients of Stanley, Lande & Hunter since 1965 with particular emphasis on corporate and business, real estate development, and estate planning. He has actively participated in Iowa State Bar Association and American Bar Association professional organizations. He served on the ABA Standing Committee on Technology and Information Systems and chaired the ABA Coordinating Commission on Legal Technology. Chuck also held many positions in the ABA Section of Law Practice Management and was elected to chair the Section in 19911992. He has written and lectured on law practice management topics.

When highlighting his volunteer activities, all of his colleagues com-

mented on his remarkable mentorship and leadership abilities. One nominator noted that “Chuck Coulter has been a leader in bringing sound office practice and procedures to the lawyers of the United States,” and another said, “[w] ithout exception Chuck has displayed the highest levels of integrity, kindness, and humanity, all while achieving superb results for the organizations for which he was volunteering his effort.”

He is a life fellow in the Iowa State Bar Foundation, a fellow in the American Bar Foundation, a fellow in the American College of Trust and Estate Counsel, and a charter fellow and former trustee in the College of Law Practice Management, of which he served three terms as president.

“It is certainly an honor to be recognized by my peers and receive the 2011 Alumni Service Award from the UI College of Law. At the same time, it is humbling to be singled out when Iowa lawyers are so well known for “giving back” to their profession and their communities. It is also an inspiration to continue to give back,” said Chuck.

Always active in his community, he founded the Leadership Muscatine program and the Muscatine Tennis Association. He has served for more than 30 years on the Muscatine Community Health Association, has been a director of Muscatine Health Support Foundation since 1986, and has worked in many political campaigns. He served 11 years on the board of directors of Old Brick Episcopal Lutheran Corporation in Iowa City; he currently serves as secretary of the Coralville Community

Alumni H ighligh t s Fund; as a director of the Community Foundation of Johnson County; and as president of the River Heights Racquet Club. The Iowa State Bar Association awarded Chuck the 2001 Community Service Award for the Seventh Judicial District in recognition of his long history of community service.

He worked with his wife, Elizabeth, who is an Episcopal priest, to start New Song Episcopal Church in Coralville the first new Episcopal Church in Iowa in more than 20 years. Chuck serves as a member and clerk of the church Vestry. Their daughter, Anne, is a freelance writer in Evanston, Illinois, and their daughter, Carol, is a trial lawyer in Grand Rapids, Michigan.

2011 Recent Alumnus Award: Pollyanna Folkins Hampton

Pollyanna Folkins Hampton has been honored for her national service as a trial attorney with the Department of Labor’s Office of the Solicitor. She is one of only four DOL attorneys selected to provide onsite legal advice to oversee the federal Mine Safety and Health Administration investigation into the Upper Big Branch coal mine explosion that killed 29 miners on April 5, 2010—the worst mining accident our nation has seen in 40 years.

After earning a BA from Northwestern University in 1999, Pollyanna graduated from the University of Iowa College of Law in 2004. She practiced general litigation in Pennsylvania for more than four years before moving to Washington, DC and joining the federal service.

Pollyanna’s legal advice has helped steer the federal civil investigation of the Upper Big Branch Mine disaster to determine the cause of the accident and in anticipation of enforcement actions to be issued under the Federal Mine Safety and Health Act. She has preserved the government’s interests in the collec-

tion and preservation of evidence in an intensely political environment. She has upheld the highest government interests of just, fair, and orderly action while being beset by overlapping investigations by federal and state regulators, the United Mine Workers of America, a special investigation by a panel convened by the West Virginia governor, a criminal probe by the US Justice Department, and an investigation by the mine company, Massey. As well, she has had to navigate scoops by investigative journalists and queries from plaintiff ’s lawyers representing victims’ families. She has been noted for her firm and clear commitment to public service. Her supervisor describes her appointment to the Upper Big Branch case by saying that it is rare that an attorney so new to SOL would be given such an opportunity to work on a high-profile and important project as the Upper Big Branch investigation, but they had confidence in her abilities and found her work to be both exemplary and that she was a major contributor.

In 2005, Pollyanna married Lance Hampton, whom she met at the UI College of Law while working for the Transnational Law and Contemporary Problems journal. Lance graduated from the College of Law in 2003, earned a PhD in National Security and Public Policy from the University of Pittsburgh, and is currently employed as a foreign policy analyst with the Office of Under Secretary of Defense for Policy. They are expecting their first child in September.

1965 Ronald T. Y. Moon ,

Honolulu, Hawaii, retired from the Hawaii Supreme Court in September 2010.

He had served the court as its chief justice since March 1993. Prior to accepting that appointment, he was an associate justice for three years and a circuit court judge for eight years.

1968 Ronald G. Whiting ,

Rockville, Maryland, retired from the Office of the Solicitor of the US Department of Labor after 42 years of service. The last 29 years he worked as the deputy solicitor in charge of regional operations (14 offices across the country with more than 300 attorneys).

Those offices do enforcement litigation of some 100 labor and employment laws.

1970s 1970 Jim Nepple ,

Muscatine, Iowa, was given one of Scouting’s highest honors in March 2011, the Silver Beaver Award. This award is given to volunteers who have had a significant impact on Cub Scouts and Boy Scouts. Mr. Fitzgibbons is a widely-known criminal defense lawyer in Tampa who is listed in Best Lawyers in America in both whitecollar and non-white-collar criminal defense, Florida’s Legal Elite and Florida Super Lawyers. Michigan, was named chief counsel of the US Army Tank-Automotive and Armaments Life Cycle Management Command, and a member of the federal Senior Executive Service. She leads a staff of attorney-advisors and support personnel who provide legal services and advice for Command Headquarters and for the Command’s arsenals, depots, and field activities. She was previously chief of a Business Law Divison of the Army Sustainment Command since February 2006.

He is a member of Cozen O’Connor and is the co-chair of its Professional Responsibility Committee and a member of the firm’s Professional Liability Committee.
