Stacey’sjourneyintolawwasunconventionalandbest describedasintentional.At15,shelefthomewithnothing butafewgarbagebagsfullofclothesandadetermination toproveeveryonewrong:“OnedayIwillbealawyer”. Despiteconstantdoubtandobstacles,sherefusedtoquit.
Inthemid-80's,shestartedasareceptionistatalawfirm, workedherwayuptolegalassistant,putherselfthrough nightschooltobecomealawclerk,andultimately,at40, becameapersonalinjurylawyer,allwhileraisingtwosons. Hercareerwasbuiltongrit,notprivilege.
Staceywasdrawntopersonalinjurybecauseit’snotjust aboutcasesbutpeople.“It’sabouthelpingindividuals rebuildtheirlivesafterdevastatingtragedies,”shesays. “They’renotjustseenascasefilesbutashumanbeings deservingofjustice,dignity,andsupport.”
Thisdeterminedmotherandgrandmotherknowsathingor twoabouthowtonavigateaworldthatoftentoldherthe oddswereagainsther.Butjustasshehadrefusedtoaccept thoselimitations,shenowfightstomakesureherclients don’teither.
ForStacey,oneofthemostfulfillingpartsofherworkis beingasteadypresenceforherclients,guidingthem throughsomeofthemostchallengingmomentsoftheir lives.“Idon’tjustrepresentthem—Iempowerthemto reclaimtheirsenseofcontrol,theirconfidence,andtheir future.”
Thisphilosophyextendsintoherbroadermission:helping aspiringfemalelawyersdeveloptheskillsandstrategies thatstrengthentheirconfidenceandresilience.Staceyis determinedtohelpwomenlawyersredefinesuccessontheir ownterms–withoutguilt,burnout,orlosingthemselvesin theprocess.
Younglawyersquicklyrealizethedemandsofalaw practicecanbeunforgiving.“Themessagingcomingoutof lawschoolisthatwomenlawyersareexpectedtowork harderandshowupmorethantheirmalepeerstoachieve thesamesuccess,”Staceysays.Formany,thatmeans hidingtheirtrueauthenticselves,ultimatelyleavingthem drainedmentally,physically,andemotionally
In2023,theFederationofLawSocietiesofCanada releasedPhase1ofit’sReportontheStateofMental HealthintheLegalProfession,whichfoundthat67.5%of practicingwomenlawyerssuffersilentlywithanxiety, depressionandburnout.StudiesacrossNorthAmerica confirmthatlawvaluesmasculinetraitslikeunshakable confidence,emotionaldetachment,andaggressive communicationstyles,puttinguniquestressorsonwomen. Thismanifestsinhigherburnoutratesandself-caredeficits.

Staceybelievesimpostersyndromecreepsin.“Women oftensilencethemselvesinmeetings,overanalyzetheir contributions,andquestionwhethertheywilleverbe enough,”shesays.“Theyabsorbtheenergythatcomes fromunspokenbiases,likebeingtalkedoverinnegotiations orbeingaskedtobethenotetakerorgetcoffee.”These microaggressionsoftenfeedwomen’sinnercriticsand impacthowtheyshowupintheirlives,andhowtheysee theirpotentialtobecomeleaders.Overtime,ittakesatoll.
In2023,theLawSocietyofOntarioalsoreleaseditsannual StatisticalSnapshotofLawyersandParalegals,revealing troublingfindings.Whilemorethan50%oflawschool graduatesarefemale,about30%ofwomenleavetheir practicewithinfiveyears.
“Thesestudiescameoutattheperfecttime,”saysStacey Duringthepandemic,shewasexhausted,frustratedandat herwitsend.“Foryears,Iwasmanagingasuccessfullaw practice,commutingtoworkandhome,andthenmeeting myfamily’sneeds.ButIneverstoppedtothinkaboutthe impactthishadonme;Ijustpushedthrough,thinkingit waspartofthejob.”ThesefindingspromptedStaceytodo moreresearchandreflectonhowsocietalexpectations shapedhervaluesandbeliefs.
“Ilearnedthatyoungwomen(andmen)areshapedby societalexpectationsthatultimatelyleavethemwithaset ofpreconditionedvaluesandbeliefs,”saysStacey.“But oncetheyentertheworkforce,theselearnedbehavioural traitsmaynolongerservethem.”Theseincludeprioritizing others’needsovertheirown,minimizingtheirownneeds outoffearofexclusion,enduringhardshipinsilenceand peoplepleasing.
Thiscanleadwomentooverextendthemselves, micromanagetheirenvironments,orsacrificetheirown authenticitytomeetotherpeople’sexpectations.“Women arethenexpectedtoexcelinaworkplacewheretheyare toldto“leanin,”despitefacingsystemicbarriers,andshow assertivenessthatmayresultinunflatteringlabels,”says Stacey.“Intheend,womenlawyersoverworktoprovetheir worth,suppresstheirauthenticselvestofitrigidnorms,or burnoutfromtryingtobalanceimpossibleexpectations.”
Staceysawherselfintheresearchandrealizedshehadto lookatthingsdifferently.“IhadtoquestionhowIwas actingasaresultofsocietalnorms,andwhethermy behaviourwashurtingratherthanhelpingme.”Foryears, Staceyfollowedunspokenrulesinthelegalworld—project confidence,staycompetitive,andnevershowemotion—but wasthatthetrueStacey?Asshedismantledoldvaluesand beliefsthatnolongerservedher,shecreatedanewsetthat redefinedwhatachievementandauthenticitymeanttoher Now,sheisstillconfidentandcompetitive,butinaway thatisrootedincollaborationandcompassion.She communicatesauthentically,whetherwithstaff,clientsor opposingcounsel.Sheintegratesherroles—lawyer,mother, leader,andmentor—ratherthanrejectingthem.
Twodecadesago,whenStaceyworkedasasummerlaw student,therewasonlyonewomanlawyer Afterarticling, shepracticedatanotherfirmwhereshewastheonlyfemale lawyer.Itwasn’tuntilshejoinedThomsonRogersLLPthat shebegantoseeashiftinfemalerepresentation.Today, nearly40%ofThomsonRogers’partnershipismadeupof women.“ThisissomethingIamveryproudof,”says Stacey TheLawSocietyofOntario’s2020AnnualReport onmembershipstatisticsfoundthatwomenmadeuponly 26%oflawfirmpartners.“It’simportantformetobeata firmwherewomenareatthetable,andyoungfemale lawyershavementorstoturntoforadvice.”
Overthepast24years,Staceyhasmentoredmanywomen lawyers,bothformallyandinformally,who’vefound questionedwhethertheycansustaintheprofessionthey oncedreamedof.OnesuchlawyercametoStaceyata breakingpoint,unsureifshehadwhatittooktocontinue.
Throughconversations,Staceyhelpedherseethather strugglesweren’tareflectionofhercapabilitybutofthe pre-conditionedvaluesandbeliefsthatshapedherstory. Theyexploredwaysforhertorewritethenarrativesshe encounteredeverydayfromothersandherowninnercritic.
Together,theyworkedonacknowledgingtheclashbetween herfeminineenergyandtraitsandthemasculineenergyand traitsrequiredasapracticinglawyer,identifyingtheimpact thishadonher,anddevelopingstrategiestoempowerherto begroundedinboth.Theyfocusedonrewritingherstory, reframingoldnarrativesandredefiningsuccessinaway thatwasauthentictoher
Today,thislawyerstandsconfidentandaccomplished, leadinghercareeronherownterms.Hertransformationis notjustpersonalbutproofthatwhenwomenhavetheright support,theydonothavetochoosebetweensuccessand fulfillment.ForStacey,mentoringwasareminderthat “leadershipisnotaboutforcingwomentofitintosystems thatarenotmadeforusbutaboutempoweringthemto buildcareersthatalignwiththeirvaluesandaspirations.”
Womenwhostopchasingimpossibleexpectationsand releaseself-imposedguiltcanstepintocareersbuilton resilience,balance,andexcellence.Thisisn’tabout rejectingambitionbutpursuingitinawaythatdoesn’t requireself-destruction.
Stacey’sfirmbeliefinthepoweroftransformationfuels her.Everyday,shewakesupknowingshehasan opportunitytomakeanimpactinherclients’andmentees’ lives.Herjourneyisatestamenttothepowerof authenticity,demonstratingthatwomencanredefine successontheirterms—withoutsacrificingtheirwellbeing.

TheCanadianlegalprofessionhasundergonerapid
transformationduringthelasthundredyears,drivenin largemeasurebythededicationandindustryofwomen lawyers.Fromstatute-exclusiontoleadershiponthebenchand atthebar,womenhavechallengedthetraditionalgrainand reshapedthecountry'slegallandscape.Whilemuchprogresshas beenmade,thisarticlealsohighlightsthesystemicchallenges thatpersistandthestepsnecessarytoensureamoreinclusive andequitablefutureforalllegalprofessionals.
ClaraBrettMartin'sentryintothelegalprofessionwasa breakthroughmomentinCanadianhistory.Herstruggletobe acceptedasa"person"underthelawandherultimatetriumph openedthedoorsofopportunityforfuturegenerationsof womenlawyers.Institutionalbarrierswerethereforher,and women,thoughtheyhadaccomplishedsomuch,hadlimited access,werediscriminatedagainstinsociety,andwereexcluded fromleadershiprolesinlawfirmsandcourtsoflawfordecades tocome.
Inthemid-20thcentury,womenbegangainingtheoretical recognitionaslawyers,butpracticalimpedimentspersisted.It wasn'tuntillaterdecadesthatdefactogenderequalityfor lawyerswasrealized.WomensuchasBeverleyMcLachlin, Canada'sfirstfemaleChiefJusticeoftheSupremeCourt, demonstratedthatwomencouldnotonlybeaccommodatedbut excelatthemostadvancedechelonsoflegalpractice.
Womennowformnearlyhalfofallpracticingbarristersin Canada.In2019,49,175womenbarristersand56,678men barristersexisted—thatisaclearindicationofprogresstowards genderequality.Lawschoolshaveachievedthisthroughthe applicationofinclusivehiringandadmissionpolicies.The UniversityofWindsor'sFacultyofLaw,forinstance,reported that70%ofitsclassof2024consistedofwomen,aninitiative thatreflectseffortstowelcomediversityandresilienceamong students.
Furthermore,gendervisibilityalsogainedgroundfor womenlawyers.TheChambersCanadaGuidehasseen tremendousincreasesintherateofwomenlawyersin recentyears.Initslatestedition,28.4%ofhighlyranked lawyerswerewomen—a10%plusgrowthfromsix editions.Notably,Ontarioleadsingenderrepresentation amonghighlyrankedlawyersat25%,followedbyAlberta at20%.However,disparitiespersistinprovinceslike QuebecandBritishColumbia,whichlagbehindnational averages.
Studiesshowhigherattritionamongwomenduetoworklifeconflicts,lowerexposuretomentorship,and institutionalbiaswithinlawfirms.Womenremaininthe minorityasheads;only23%ofseniorpositionsinlegal directoriesareheldbywomenlawyers—aminorincrease from15%sixyearsearlier
Thelegalprofessionisalsowithinthescopeofpayequity andwomen'scareerdevelopment.Thoughmoremenare beingreplacedbynewintakesintotheprofession, altogethertoomanyofthemarebeingmetwithobstacles thatstopthemfrombuildingcareersintoseniorpositions. Thisisanareathatnecessitatessystemicchangeonthepart oflawfirmsandprofessionalorganizationstotreatwomen solicitorsonthesametermsandaffordthemthesame opportunities.
GenderportrayalvariessignificantlyacrosstheCanadian provinces.OntarioandAlbertadominatewithrelatively higherpercentagesoftop-rankedfemaleattorneys. Saskatchewanalsoboastsencouragingpercentagesat 22.2%.SomeotherprovincessuchasManitoba,however, havenotopfemaleattorneys—adismalindicatorofthe persistingimbalancesintheprofession.
Throughoutmuchofthenation,evenbeyondthemajor cities,thereareinstitutionalobstaclestowomen.These includedifficultieslikedemandinglegalcareersandfamily life,ashortageofinstitutionalizedmentorshipprograms, andculturalattitudesthatmaydiscouragewomenfrom pursuingorremaininginseniorlegalroles.Lawsocieties andprofessionalorganizationsmustconductlocalized assessmentstounderstandtherootcausesofinequalityand developtargetedinitiatives—suchasmentorshipnetworks, leadershipdevelopmentprograms,andregionalawardsthat spotlightwomen’sachievements.
Womenlawyers'integrationintotheCanadiansystemisa witnesstotheirgrit,determination,andstrengthof charactertofightagainstcenturies-longbarriersinthelegal profession.Withmuchachievedonthefrontsof representationandvisibility,equalitystillhastobe achievedforonaconsistentbasisacrossseveralfronts. Soundmentorshipschemescanbeastrongsourceof inspirationanddirectionforwomentoproceedoncareer developmentandleadershippathways.
Simultaneouslywiththis,policyinterventionbylaw societies—i.e.,interventiontoaddresssystematic discrimination,equalremuneration,andflexible employmentarrangements—isessentialtoconstructing equitableprofessionalcultures.Integrationofdiversity throughequitableadmissionspoliciesintolawschoolsalso establishesthefoundationforlong-termrepresentation. Additionalacknowledgmentofwomen'ssuccessthrough awardsandprofessionalleaguetablesnotonlylegitimates theirlaborbutalsoinspiresandactsasavehicleof empowermentforaspiringlegalprofessionals.
ThearrivalofwomenlawyersinCanadaisareasonto celebrate,yetalsoanimperative.Pathbreakersbrokeglass ceilings,andwomenlawyersnowgoontoredefine leadershipandvisionsofdistinctioninlaw Asdata suggests,equalityisalwaysjustbeyondreach—conditioned byprovincialboundaries,attrition,andentrenchedbarriers tocareerprogression.Tocreateanintegratedlegal profession,thelegalindustryrequiresmorethanparity figures;itrequiresrecurring,thoughtfulchangethatcarries womenwitheveryprogressionintheirowncareerpaths.
ThestoryofwomeninCanadianlawisoneof resilience,determination,andtransformative change.Frombeingexcludedfromtheprofession toleadingthehighestcourtsintheland,femalelegal trailblazershavenotonlybrokenbarriersbuthavealso redefinedjusticeandequalityinCanada.
Thejourneybeganwithapioneeringwomanwhobecame thefirstfemalelawyerinCanadaandtheentireBritish Commonwealthinthelate19thcentury.Herpathwas anythingbutstraightforward.Atatimewhenwomenwere notconsidered“persons”underthelaw,shefaced institutionalresistance,includinganinitialrejectionfrom thelegalsociety.Ittooksignificantadvocacyandachange inprovinciallawtoallowwomentobeadmittedas “persons,”enablinghertograduatefromlawschoolandbe calledtothebar.Herpioneeringspiritpavedthewayfor womentoenterthelegalprofession,afieldpreviously reservedexclusivelyformen.
TheFamousFiveandthePersonsCase
Theearly20thcenturysawfurtheradvances,mostnotably withalandmarklegalbattlethatresultedinwomenbeing recognizedas“persons”underCanadianlaw,makingthem eligibletoserveintheSenate.Thiscasewasledbyagroup offiveremarkablewomenwhowereinstrumentalinthis fight,whichdismantledamajorlegalbarriertowomen’s participationinpubliclife.Oneofthesewomenwas alreadyCanada’sfirstfemalemagistrateandplayedakey roleinthishistoricvictory.
Themid-20thcenturymarkedthebeginningofgreater diversityamongfemalelegalpioneers:
• Thefirstwomanappointedasajudgebythefederal governmentsetaprecedentforgenderdiversityinthe judiciary.

Today,womenmakeupasignificantportionoflawschool graduatesandpracticinglawyersinCanada.However, disparitiesremain,particularlyinleadershippositionsand amongwomenfrommarginalizedcommunities.Thelegacy ofCanada’sfemalelegaltrailblazersservesasboth inspirationandacalltoaction:tocontinuechallengingthe statusquo,advocatingfordiversity,andensuringthatthe legalprofessionreflectsthesocietyitserves.
