AN ACT PROHIBITING DISCRIMINATION, MARGINALIZATION, AND VIOLENCE COMMITTED ON THE BASIS OF SEXUAL ORIENTATION, GENDER IDENTITY, GENDER EXPRESSION AND SEX CHARACTERISTICS AND PROVIDING SANCTIONS THEREFOR Be It enacted by the Senate and the House of Representatives of the Philippines in Congress assembled: 1 2 3
SECTION 1. Short Title. - This Act shall be known and cited as the "SOGIESCbased Anti-Discrimination Act." SEC. 2.
Declaration of Policy. - The State values the dignity of every

individual, and guarantees full respect for human rights. It promotes human dignity

as enshrined in the United Nations Universal Declaration on Human Rights, the

Convention on the Elimination of

Convention on the Rights of the Child, International Covenant on Civil and Political
8
Rights, International Covenant on Economic, Social and Cultural Rights and all other
9
relevant and
All Forms of Discrimination Against Women,
universally accepted
human
rights instruments,
international

conventions and general principles of law, as well as the Yogyakarta Principles and

General Recommendation No. 28 on Non-discrimination Based on Sexual Orientation

and Gender Identity;

In enforcement of this Act, the right to religious freedom in the performance
14
of religious services which exclusively cater to the members of their religious order
